Now a "broken vow" is in the offing.  It's getting clearer and clearer and clearer. . . . . the MAY 8, 2008 schedule of groundbreaking as earlier reported, should now be interpreted to mean - - - - - MAY IT HAPPEN IN 2008!!!!!!!!!!

If these junk shops did business without the requisite permits, then they had the closure order coming.  But if they were ordered closed merely as an offshoot of the airport burglary, then it is illegal.  We should take lessons from the case of Manila Mayor Fred Lim when he closed down Bistro Pigalle in his drive against prostitution.  The Supreme Court ruled that -----

"Mayor Alfredo Lim has no authority to close down Bistro’s business or any business establishment in Manila without due process of law.  Lim cannot take refuge under the Revised Charter of the City of Manila and the Local Government Code.  There is no provision in these laws expressly or impliedly granting the mayor authority to close down private commercial establishments without notice and hearing, and even if there is, such provision would be void.  The due process clause of the Constitution requires that Lim should have given Bistro an opportunity to rebut the allegations that it violated the conditions of its licenses and permits. " [lim vs CA; G.R. No. 111397; August 12, 2002]

Police Cadet Arturo Mendez Evangelista C-83036
“art or arthur” as fondly called by his friends and “vangie” by his mistahs, was orphaned by his father at the early age of 12.  This made him emotionally more mature than his peers since he has to fend not only for himself but also for his widowed unemployed mother and his siblings as well.  At this early stage of his life, he already aspired to become the Chief of Police of his hometown Ubay, in the province of Bohol.  Armed only with his grit and firm belief in himself, he bravely went to Manila to fulfill his ambition. His tender age and meager status did not prevent him from pursuing his studies. Working as a janitor, errand boy, messenger,  collector and later as driver of a security agency where he also sidelined as a shoeshine boy, he supported himself and  finished his high school at the Arellano University in Pasay City, Metro Manila. He further pursued his studies and took up Bachelor of Science in Criminology. Upon earning his degree at the PCCr in 1981, he tried his luck and passed the entrance exam of the Philippine National Police Academy (PNPA) and thus became the first boholano to join the premier learning institution of the then Integrated National Police (now the PNP).  Unfortunately, at the reception (beast barracks period) conducted by his upperclassmen his left knee was severely injured which entailed his hospitalization at Camp Eldridge Hospital in Laguna. Thinking that he was treated unfairly and savagely by his upperclassmen, he tendered his resignation. However, he was immediately persuaded by then PNPA Superintendent, Police Colonel Guillermo P Enriquez to stay, saying “don’t you know that sooner you will be an asset to the government and in return the government will be an asset to you? You stay put”.  He took up the challenge and stayed.  He became a member of the famous Silent Drill Company where he was a Navigator, he was also a Squad Leader of the Alpha Company. He is one of the best singers of the academy aside from being a sharpshooter of Magiting Class ‘83.  Regrettably, three months before his graduation, he was caught by his tactical officer driving a car inside camp under the influence of liquor on one weekend. Considered as a class 1 offense, the tactical officer recommended his dismissal.   On the other hand, the board members deemed that it would be a significant loss to the INP if he would be booted out of the service on that unfortunate offense. Thus, the board decided to downgrade the penalty to confinement and cancellation of privileges.  He finally took his oath as Police Lieutenant on June 16, 1983 at Camp Crame, Quezon City.

For risking his life beyond the call of duty when he rescued the crew and passengers and retrieving the PhP80.Million worth of gold bullions from the ill-fated Central  Bank plane in 1996, he became the first Magiting Class member to be meritoriously promoted to the rank of Police Superintendent in 1997 (all others in 1998).  A three-time awardee of the most coveted Lakan Award of his Alma Mater (1995, 1997 & 2007).  Although he did not attain his vision of becoming the Chief of Police in his lowly hometown (Ubay, Bohol),  he never thought his destiny would far surpass his dream when he was designated to a more prestigious position in his home province on October 5, 2005, as the first Boholano PNPAer to become the Provincial Director of Bohol Provincial Police Office (BPPO).  Under his stewardship, the BPPO Police Mobile Group (701st PMG) was awarded as the PNP’s “PMG of the year 2006” nationwide for the first time.  To cap his stint, it was during his helm as the PD-BPPO when PGMA declared in her 2006 State of the Nation Address (SONA), that “bohol is now free from terrorism”.

by the way, unsa may pinaagi aning "Rod Duterte Formula?"
To the criminals, it's something like "an eye for an eye", "a tooth for a tooth"; akin to the Fred Lim Formula also nga manglutaw sa pasig river.
To the policemen, it's something like "shape up or pack up".

afterall, it has been tried, proven and tested already.
in fact, two other city mayors can attest to that, namely: Mayor Tom Osmena and Mayor Fred Lim.
go ahead Mayor Dan.  Don't reward evil for good, otherwise evil wont leave your house.

bayaran jud na nila or else dili na sila maka byahe sa bohol.  if we recall, this fastcraft company earned the ire of the city council and the provincial board about two years ago tungod sa ilang walay klaro nga systema.  permi gubot ang pasahero kay double issuance ang seat number,  plus arogante pa jud ang ilang manager nga manubag to complaints and questions from the public.  that's why ang ilang manager was declared a persona non grata by the city council.  so with this tragedy, they have to shape up or else they will be completely kicked out of bohol.

yes lin duna jud nay TPL insurance as required by maritime regulations. but you know this insurance companies are also quick at looking for grounds why they will not pay.  such as in this case, there is initial observation by the Coast Guard that the fastcraft deviated from the designated channel when it entered the port.  if this is established, then magkatawa ang insurance company, og ma l.k.k. jud ang tag-iya.

Granting for the sake of argument that there was laboratory error, that will not exonerate the four (4) TMG men from the administrative charge of “serious breach of procedure”.   Granting that the eight (8) SUV’s were hot cars, the TMG has no summary power to confiscate them without court orders.  So these TMG men are now in serious trouble for making procedural shortcuts.  This could not have happened if only they do their job above board.  They are tasked to solve the carnapping menace by catching the carnappers.  But what they are doing is that they maintain liaison with the carnappers who tips them of the whereabouts of the hot cars, such as: where they sold them; what’s the new plate number and new color.  With these informations at hand, ilang gulaton ang nakapalit (like what they did in bohol).  And once they got the hot car, they will turn it over to the Insurance Company where it was declared by the original owner as “total loss”.  And I heard that the TMG gets a windfall of cash bonus for every hot car they turned over to the insurer.  I heard it’s several times bigger than the commission of a car salesman. Busa og imong tanawon, ang TMG daghan og accomplishment when it comes to recovery of hot cars, but zero accomplishment when it comes to apprehension of carnappers.  So it’s high time that the TMG should be abolished.

Kinahanglan adunay rason and petition against ni Col. Ingking, kay akong ipahibalo dinhi nga ako adunay kompyansa ug pagsalig ni Col. Ingking sa iyang pagdala sa iyang katungdanan pagka-PNP provincial director sa atong lalawigan. Sa iyang maayong krusada ako siyang gi-back-up-pan sa way lipod-lipod," Aumentado said.

In a related article dated December 9, 2007, mao sab ni ang gi ingon:
QuoteSome mayors, especially those who own cockpit arenas, were reportedly organizing the move to expel Ingking.

I suggest Guv. Aumentado should crack the whip against these mayors because if its true that they own the cockpits in their towns, then they are clearly committing the prohibited acts defined in Section 89 of the Local Government Code.

QuoteSECTION 89. Prohibited Business and Pecuniary Interest. - (a) It shall be unlawful for any local government official or employee, directly or indirectly, to:

(1) Engage in any business transaction with the local government unit in which he is an official or employee or over which he has the power of supervision, or with any of its authorized boards, officials, agents, or attorneys, whereby money is to be paid, or property or any other thing of value is to be transferred, directly or indirectly, out of the resources of the local government unit to such person or firm;

(2) Hold such interests in any cockpit or other games licensed by a local government unit.

(3) Purchase any real estate or other property forfeited in favor of such local government unit for unpaid taxes or assessment, or by virtue of a legal process at the instance of the said local government unit.

(4) Be a surety for any person contracting or doing business with the local government unit for which a surety is required; and

(5) Possess or use any public property of the local government unit for private purposes.

(b) All other prohibitions governing the conduct of national public officers relating to prohibited business and pecuniary interest so provided for under Republic Act Numbered Sixty-seven thirteen (R. QuoteSome mayors, especially those who own cockpit arenas, were reportedly organizing the move to expel Ingking.

This is very disturbing. The law in point is Section 89 of Republic Act 7160, otherwise known as The Local

So who are these mayors?  ???
Would anyone furnish TB their names so that we will report them to the Ombudsman?

Well, it's a fact --- the most corrupt branch of the PNP is the Highway Patrol Group.  They are the very people involved in selling hotcars.  Remember the recent bohol incident? Og unsay rason ngano --- well your guess is as good as mine.
#238

That's Mayor Dan Lim! Nothing to be surprised about his picking a fight.
But he should re think and re think many times about the move of holding the CVIRAA in Cebu City.  If that's his way of insulting Guv. Cheap shot, so to speak!

Good job Guv Aumentado.
Imagine, my friend in Cebu has a rent-a-car business.  A couple rented one of his brand new car for a tour in Bohol.

it's now fully functional, although before there was a problem when it locked someone inside for hours.
but, ang akong punto de vista is this: ang atong mga turista motanaw lang sa gawas, and that gives them the impression of what's probably inside. busa kun hugaw ang palibot, dili jud na sila ma engganyo og tanaw unsay naa sa sulod.  and that will leave them a bad taste.

Very well said Bingo.  Mayor Lim and VM Veloso ought to ponder on those lines.  Why stick to party loyalty when the peoples' welfare is already at stake?  Isn't loyalty to the people supreme over party loyalty?  One former president said so, but we don't know with Lim and Veloso.

On January 2, 2008, we saw the birth of the “69/75 Club”, the first alumni group in Sikatuna Central Elementary School.  At first, we thought of it to be exclusive for our Grade VI batch who graduated in 1975.  But then, we realized that a good number of our classmates in Grade I were not able to make it with us, so in order to accommodate them, we decided to open the group to all those who happened to be our classmate during the inclusive period of school years 1969 - 1975.  Hence, the name “69/75 Club”.

The initial meeting was done in the palatial residence of our classmate Brgy. Capt. Jose “Pangay” Ellorimo Jr  in Poblacion I, where we feasted on a smorgasbord of kaldereta, paklay, kilawin, adobong manok, humba, etc., all of which were duly blessed with grace before meal by another classmate Lay Minister/Municipal Agriculturist Ireneo “Rene” Gabato.  In the informal discussion that followed after lunch, the ever lovely Levi Villamor Calimpusan acted as the interim recorder/secretary.

Indeed the thirty-two years that passed since 1975 was quite long enough for us to trace, so we fell short of time for everything that we need to discuss.  We agreed to meet again this coming JUNE 14, hoping that many classmates will come home for the town fiesta.

So this page will serve as notice to all classmates who may happen to drop by here in tubagbohol.

Thank you.

I have some experience on this.  Three agencies are involved in this mess: TMG, LTO, and PNP CRIME LAB.  If you ask any one of these 3 agencies why the problem proliferates, each one will point at the 2 others to be in cahoots with the carnappers.  In fact, if you will scan the archives of Sunstar Cebu Newspaper, there was a news item sometime early this year that reported a near shootout between a group of TMG men and a group of CRIMELAB men over this insinuation.  The incident happened right in front of their offices which are just a stone’s throw away from each other inside Camp Sotero Cabahug, in Cebu City.

Mr. Sarabosing’s reaction reminds me of exactly the same way how my friend in Cebu City resisted when she was flagged down by TMG operatives early last year.  Like Mr. Sarabosing, my friend also got the same line from the TMG --- “we don’t need court order because we are sure that your car is hot car”.  In her fit of anger my friend was tempted to ask what made the TMG man sure?  My friend’s companion also sarcastically injected a question, “if this is a carnapped vehicle, how did you know sir that this is the new plate number”?  And you know what happened to my dear friend after that?  She got all the cases filed by the TMG for CARNAPPING, ANTI-FENCING, and FALSIFICATION.

According to her lawyer, my friend could never be charged with any of those crimes because firstly, she was an innocent purchaser; secondly, there was a named seller in the deed of sale; and thirdly, the car dealer appeared in the investigation and disclosed the name of his source of the car.  Because of that, my friend’s lawyer filed criminal charges for dereliction of duty against the TMG men.

Then last May 20, 2007, we were all amazed to see a banner story in the Sunstar Newspaper which read, “Accident leads to arrest of syndicate head.”  “Marcelo T. Cabahug faces 20 carnapping cases, identifies himself as a major at RTMO 7 to CIDG official.”  We were amazed because it was the same name mentioned by the broker as the source of my friend’s car, but despite that, the TMG refused to file a case against him.  Rightly so, the TMG won’t run after him because he carries a TMG I.D., a Major at that, although fake.  But what is more surprising is that the TMG did not even disown him after the arrest?

But the remaining unsolved puzzle is why the TMG is only after of recovering hotcars, but not apprehending the carnappers?  Is TMG really meant at solving the carnapping menace with this kind of approach?   With this Bohol incident, I bet, you will hear nothing about TMG’s action against the source of those hot cars.  Instead, what you will surely hear in due time is that the TMG already turned over those vehicles to the Insurance Company who insured those cars at the time of loss, they being subrogated to the shoes of the original owner as a matter of law.   To my mind, this is a multi-million dollar question, even bigger than the ZTE Broadband Deal.  To whom does TMG work for?  If they work for the state, they should run after the carnappers.  But if they work for the insurance companies, then its just right that they will only be up at recovering those hot cars equipped not with court orders but with personal knowledge as to the whereabouts, new plate numbers or even  new colors of those hotcars.

I visited my Barrio Bahay bahay Nil, mingaw na kaayo a big different before. I think our Goverment should take a look, ining umaabot nga problema. Basin ato tanan kinahanglanon pulos na import.... Anyway just a thought.

Korek imo observation Lin. You are in the best position to see the difference because of the length of time that you have been away from home.  Not much for me because I go there often.
Farming  was a necessity then because if we dont wala tay kan-on.  I know we share the same experience. And I'm sure what drove you to go for white collar job is because we donot want to be farmers for life.  But now lahi na ang mga batan-on kay porma ray gadaghan. Walay abot, wala pod sud utok.  Maayo unta ug nangeskwela aron ma propesyonal pero wala man pod.
So, I'm seeing the same basis of your concern. Our younger generations are no longer interested to work in the farm; but they are not professionals either.  So what will we make out of them in the future?
I don't think our local government can solve this, kay ug imo tanawon ang atong  mga lokal opisyal, mga Grade VI ra man pod intawon.
Ato lang jud ni agwantahon.

Boom-boom's barriomates deserve the cancelled promise of Gov. Aumentado.  I suggest that Gov. Aumentado should add another condition, that is, they should first do away with their "crab mentality".  I heard boom-boom's family was forced to transfer to Tagbilaran because of their barriomates' notsogood comment about their improved lifestyle.  u know . . . . :o ??? ::)

In fairness to AJ BANAL and the people of Cebu City also, he is a resident of BARANGAY ERMITA, CEBU CITY. In fact, his father is the driver of one of the barangay garbage trucks of Barangay Ermita. I've been to his place.  Though his  father is from Anislag, Corella, but they are now living in Cebu for a long time already.  So it was not a mistake when the ring announcer said that AJ is from Cebu, Philippines.  And I think AJ claims also that he is from Cebu City.
