Sec. Cusi Visits RE CSR Project of Pilipinas Shell Foundation, Inc.
Press Release from DOE

PALAWAN PROVINCE – Department of Energy (DOE) Secretary Alfonso G. Cusi together with Undersecretary Donato D. Marcos yesterday (24 July) visited the Access to Energy (A2E) Microgrid Project of Shell Philippines located in Sitio Binaluan, Barangay Liminangcong in the Municipality of Taytay.

Binaluan is home to 509 Palaweños, including members of the Tagbanua Tandulanen indigenous peoples (IPs), and is within the Impact Zones of the Malampaya Deep Water Gas-to-Power Project, which fuels around 40% of Luzon's electricity needs.

A rural electrification project, Piliiinas Shell Foundation 's A2E utilizes renewable energy sources such as solar, wind and hydro to provide power to households without immediate prospects of being connected to any electricity grid in the province. Priority beneficiaries are IPs and homes situated in coastal barangays in north Palawan; communities nearest to the Malampaya offshore facilities. For the Binaluan A2E Project, the microgrid has a power capacity of 7.5 kilowatt (KW) of solar, 5 KW of wind, and 10 kilovolt-amperes of diesel.

Secretary Cusi said, "While the energy family is working to address the bleak power situation in Palawan, projects like this A2E of Pilipinas Shell Foundation , is a welcome development given the big impact they have on the lives of our kababayans living in remote areas with no access to electricity services especially since Palawan is host to Malampaya."

Also present during the visit were representatives of Shell Philippines led by Shell Philippines Exploration B.V. Managing Director and General Manager, Don Paulino; SPEX External Relations Manager Paulo Gavino; Marvi Trudeau and Yoyon Rebueno of Pilipinas Shell Foundation; President of the Binaluan Energy Association, Mr. Lionil Severino; and members of the Western Command of the Armed Forces of the Philippines.

AFP-PNP Roles in Counterinsurgency operations
By Harold Cabunoc

Pangalawa, dapat merong unity of effort ang security forces.

Wag maging makasarili. Show excellent leadership. Share resources. Consider the bigger picture. No shortcuts na violation ng human rights at laws of war o peace agreements.  Mag collaborate. Maging team player, walang iwanan!  Balance accomplishment of mission at welfare of men. Link tactical actions to strategic end states. Learn from history!

Philippine Provinces / Banana Plantation in Basilan
August 03, 2019, 09:11:48 AM
By John Unson

GOOD NEWS. READ AND PONDER.

COTABATO CITY (Aug3) ---The first ever 1,000-hectare Cavendish banana plantation project in Basilan to employ 3,000 workers can now takeoff following Friday's grant of certificate of registration for the venture.

Chief Minister Hadji Ahod Ebrahim of the Bangsamoro Autonomous Region in Muslim Mindanao turned over the certificate to the group pushing the project forward in a simple rite at the BARMM capitol here Friday.

The document from the Regional Board of Investments, or RBOI, was received by Lamitan City Vice Mayor Roderick Furigay and Alberto Bacani, president of the transnational Unifrutti Tropical Philippines, Inc.

Furigay said the office of Lamitan City's chief executive, Mayor Rose Furigay, has been extending extensive interventions needed to accelerate the project's takeoff.

The setting up of the banana plantation in Baragay Limook in Lamitan City, capital of Basilan, is a joint initiative of the Unifrutti and the Lamitan Banana Corporation, or LABCO, that are also planning to put up another farm in nearby Lantawan municipality in the same province.

Ebrahim said they will support the project through RBOI's executive director, Hexsan Mabang, and members of its board, among them investments and entrepreneurial analysts Moner Dumama, Suk Baraguir and Mohammad Pasigan.

Bacani said the project, the first ever in Basilan, shall commence within the year.

Furigay said it will help Basilan recover from its losses in coconut production due to the "cocolisap" infestation that destroyed vast swaths of coconut plantations in the province.

"It will also complement the earnings of the province from rubber being produced by local rubber tree farms," Furigay said.

Basilan is the country's top producer of dried rubber from latex, or sap collected from the bark of trees (Hevea Brasiliensis) being propagated on lands with rolling terrains.

In a statement Saturday, Basilan Gov. Jim Salliman said the coming in of Unifruitti will boost efforts to prove to prospective investors outside of the province and abroad that the domestic investment climate has rapidly been improving.

Salliman said he is grateful to the BARMM government for helping hasten LABCO and Unifruitti's multi-million joint Cavendish banana propagation project that could employ thousands of Basilan residents.

DOE Inspects Gas and LPG Establishments in Pangasinan

PANGASINAN PROVINCE – The Department of Energy-Luzon Field Office (DOE-LFO) spearheaded the conduct of a Focused Inspection (FI) in the different municipalities and cities of Pangasinan from 22 to 26 July 2019, as part of the DOE's stringent inspection and monitoring of the compliance of gasoline stations and liquefied petroleum gas (LPG) establishments with national petroleum standards.

"The DOE will continue to conduct these activities to make sure that our consumers get nothing but quality liquid fuel products. Compliant retail outlets have nothing to fear. However, we will not hesitate to enforce the law against those who will refuse to uphold quality, quantity, and safety standards," Energy Secretary Alfonso G. Cusi emphasized.

Composed of personnel from the Oil Industry Management Bureau, field offices, and the Energy Research and Testing Laboratory Services (ERTLS), the DOE team conducted the FI together with the representatives from the concerned local government units, the Department of Trade and Industry, Bureau of Fire Protection, and Philippine National Police.

FIs were done in liquid fuel retail outlets (LFROs) and LPG establishments in Agno, Alaminos, Anda, Bolinao, Burgos, Mabini, Infanta, Dasol, Sual, Lingayen, Binmaley, Bugallon, Labrador, San Carlos City, Basista, Urbiztondo, Aguilar, Bayambang, Malasiqui, Santa Barbara, and Calasiao.

Of the total 145 gasoline stations inspected, the FI team found 132 to have committed violations of LRO regulations, with 55 of the inspected dispensing pumps declared "Out of Order" by the DOE due to underdelivery. The top three violations included operating without a Certificate of Compliance, operating without an appropriate test measure, and operating without any calibration record.

The DOE gathered 184 samples of gasoline and found 86 to have failed either the quality or quantity standards. On the other hand, all 88 samples of automotive diesel oil tested were found to be compliant.

Meanwhile, of the 78 LPG establishments and four LPG refilling plants inspected, 53 were found to have committed violations, which included operating without a Standards Compliance Certificate, selling LPG cylinders with inappropriate seals, and selling underfilled LPG cylinders.

All failed samples were brought back to the DOE-ERTLS laboratory for confirmation testing, which would be included in the final report being prepared by the DOE-LFO.

The DOE continues to assure the public that it will remain vigilant in ensuring that all LFROs and LPG establishments nationwide strictly adhere to all relevant laws and regulations.

General Topic / How Duterte Fights
July 27, 2019, 05:36:32 PM
THE ENEMY AND HOW DUTERTE FIGHTS
BY LUCELL LARAWAN, BOHOL TRIBUNE AND THE DAILY GUARDIAN

"The enemy is us," President Rodrigo Duterte said during his recent State of the Nation Address (SONA), describing the real war we are fighting. No euphemism to make us look friendlier to ourselves. No need to mince words. He specifically refers to those pestering among us-- the slackers, brilliant-in-their-parochial-eyes, greedy extortionists and thieves. This could be a pinch to their ears as they hold their vicious feasts.

I do not mind about what the three percent of the population say about president Duterte. They are always at loggerheads with a president who cannot bestow them the status quo. But for supporters of change, they want a leader to whack a whip.

What is the meaning of Duterte's statement? If we observe the real score in the offices issuing business permits, we can see how bureaucrats still love to make things difficult for entrepreneurs. In their pursuit of formality, they always alienate their clients—an issue that makes bureaucracy a meaningless Jurassic invention. If these offices continue to slacken the processing of permits, ignoring warnings that their system has become dysfunctional, sometimes disapproving business permits out of vindictiveness towards non-allies, they become "enemies". Meaning, those who become wet towels to burning ideas that improve markets and economies. Enemies of growth.

This does not just happen in one government office. Corruption has become so pervasive that it is almost impossible to deter a public officer from deliberately delaying transactions or opening his or her desk drawer, giving a signal that money be put in. In lieu of a diplomatic approach for such erring government official, a leader needs to bite. Duterte should not soften his stance if it seems he is seriously working while the rest are either napping or milking through their offices. So the message is clear: your milk will make you vomit.

Corruption is truly an epidemic in our country. At times, Duterte remarks with frustration, saying he sometimes think of quitting because of it. Just a few days since Duterte's SONA, he makes a convincing message by closing all forms of gambling run by the Philippine Charity Sweepstakes Office (PCSO). He declares their activities illegal. His rationale: the agency has become so depraved. What can we say? If the PCSO activities continue, they may make the fight for dishonest gain a Zarzuela.

The president always has the prerogative to bypass directors of agencies like the Bureau of Customs, BIR, LTO and COA if he finds some of their runners remiss. Duterte always listens to feedback from his 8888 hotline. Using grassroots information, he can fire employees from these offices—and this happened to the 64 customs employees who now cannot work with the same office. After talking to these employees to give them the right of due process administratively, Duterte gave them a floating status. Such move could be drastic for some, but needed.

As a public example, Duterte's whip for these customs officials should make the extortionists cringe. He also fired several high-ranking officials, remember. And let us take a look at the local government units that did not care to solve the drug menace in their locales: the governors and mayors lost their police power—a thing that is remotely possible before.

Looking at the supportive climate for whistle-blowers, anyone should report anomalies among public officials without fear of retribution through the hotline 8888. The feedback system gives the power to the ordinary Filipinos. No longer can anyone look down on the lowly because if they report misdeeds, it ends the arrogant and dirty man's peep-o-day. This is the ordinary man and woman's leverage.

Let us use it because it effectively confronts corruption.

July 2015 by Dumaguete Metro Post
The ethanol plant in barangay Tamisu, Bais City, which has been blamed for the fishkill in north Bais Bay, has temporarily stopped its operations.

Provincial Board Member Melliemoore Saycon, who is a resident of the same barangay, said that the plant has stopped operations while it was processing its Mayor's permit and other documentary requirements needed for some environmental clearances.

Saycon said that the public should now stop worrying because the plant has stopped its operations.

However, he called on the plant management to hasten the cleaning of the plant because of the foul odor in the barangay Tamisu coastline, which is believed to come from the said ethanol plant.

Bais City Mayor Mercy Teves-Goni earlier said the plant was operating without a Mayor's permit.

The plant is expected to release a statement soon. (SGR)

General Topic / 31 Social Etiquette You Should Know
July 27, 2019, 05:36:12 AM
BASIC SOCIAL ETIQUETTE YOU MUST KNOW
Reposted from Facebook

1. Don't call someone more than twice continuously. If they don't pick up your call, that means they have something more important to attend to.

2. When someone drops something on the floor by mistake or drops food from the plate or doesn't know how to use a knife/fork.. don't stare at them. The same goes to people sneezing, coughing or even an uncontrollable fart. It's an involuntary reaction.

3. Always skip using the cubicle beside the occupied one. It makes it uneasy for the person in the occupied cubicle as well as yourself if you occupy the one right next to theirs.

4. Return the money that you've borrowed even before the other person remembers lending it to you. Be it 1Php or 100Php. It shows integrity and character. Same goes with umbrellas, pens and lunch boxes.

5. Never order the most expensive dishes on the menu when someone is treating you for lunch/dinner. If possible, ask them to order their choice for you.

6. Don't ask awkward questions like 'Oh so you aren't married yet?' Or 'Don't you have kids' or 'Why didn't you buy a house?' .. For pete's sake it isn't your problem.

7. Always open the door for the person coming behind you. Doesn't matter if it is a guy or a girl. Or if you're a guy or a girl.. You don't grow small by treating someone well in public.

8. If you took the cab with a friend, and he/she pays for it now.. offer or do pay next time.

9. Respect different political opinions.

10. Don't call people on the phone late at night if it's not urgent.

11. Never interrupt people talking.

12. If you tease someone, and they don't seem to enjoy it, stop it and never do it again.

13. Say "thank you" when someone is helping you.

14. Praise publicly. Criticize privately.

15. If you're talking to someone and notice any of the following, they're trying to end the conversation: Their eyes keep darting away. They angle their body away from you. They give you rapid one-word answers.

16. There's almost never a reason to comment on someone's WEIGHT. Just say, "You look fantastic." If they want to talk about losing weight, they will.

17. If you're getting a long flight or train, shower beforehand. The person next to you will appreciate it.

18. When someone shows you a photo on their phone, don't swipe left or right. You'd never know what's next.

19. If a colleague tells you they have a doctors appointment, don't ask what it's for, just say 'hoping all's good'. If they want to talk about it they will and you don't put them in the uncomfortable position of having to tell you their personal illness.

20. Treat the janitor with the same respect as the CEO. Nobody is impressed at how rudely you can treat someone below you, but people will notice if you treat them with respect.

21. If a person is speaking directly to you, staring at your phone is beyond rude.

22. Never give advice until you're asked.

23. Do not make plans in front of those you are not involving.

24. Don't talk to someone if they are wearing headphones.

25. When meeting someone after a long time, unless they want to talk about it, don't ask them their age and salary.

26. When a friend/colleague offers you some food, you can politely say 'No'. But, don't do this after tasting or smelling it. It's an insult to the one who has offered it to you.

27. When someone starts talking about their ailments, don't start talking about yours.

28. When someone you know has an obvious change in appearance, e.g., weight gain/loss, bald spot, acne.. never comment on it until they talk about it to you, they already know what has happened to them.

29. Never kiss a baby that's not yours.

30. Mind your own business unless anything involves you directly — just stay out of it.

31. Keep handbags off the table at all times!

Health and Food / 11 Ways to Prevent Stroke
July 26, 2019, 10:08:21 PM
You can fight stroke on many fronts. A single thrust is good; a many-pronged attack is even better. Here are 11 things you can do to stay stroke-free:

Know and control your blood pressure.

Don't smoke; stop if you do.

Lose weight if needed.

Become more active.

Identify and manage atrial fibrillation.

Be aggressive about treating a transient ischemic attack (TIA, or mini-stroke).

Treat circulatory problems like peripheral artery disease, sickle cell disease, or severe anemia.

Know and control your blood sugar and cholesterol.

If you drink alcohol, do so in moderation.

Adopt a healthy diet low in sodium and rich in potassium.

Know the warning signs of stroke (see "Stroke warning signs") and respond immediately.

Stroke warning signs
If you notice one or more of the signs below in yourself or someone else, or you're really worried that you or someone you are with is having a stroke, call 911 or your local emergency number right away:

sudden numbness or weakness of the face, arm, or leg, especially on one side of the body

sudden confusion or trouble speaking or understanding

sudden trouble seeing in one or both eyes

sudden problem with walking, loss of balance, or coordination

sudden, severe headache with no known cause.

Starting early is best. Acquiring healthy habits in childhood, the early teens, or young adulthood sets the stage for a healthy adulthood and old age. But if you are tardy in joining the prevention party, it isn't too late. Even small steps now can improve your health. - source: Harvard Medical School

Press Release
DOE and PDRF Update National Energy Contingency Plan

TAGUIG CITY - The Department of Energy (DOE) and the Philippine Disaster Resilience Foundation (PDRF), recently hosted a two-day workshop to update the 2002 National Energy Contingency Plan (NECP). They engaged the key players among the public and private sectors to craft a harmonized multi-sectoral preparedness and response measure for the energy sector.

"The DOE is committed to ensure the continuous delivery of energy to the people, even in times of disasters. We are constantly working with our partners from both the public and private sectors to establish a strong culture of readiness, prompt response operations, as well as enhance our rebuilding capacities. We must always be ready given that a disaster may strike anywhere at any time," Energy Secretary Alfonso G. Cusi said.

The DOE and PDRF likewise aim to develop the Resiliency Compliance Plan (RCP), highlighting the four primary aspects for energy security and disaster preparedness, namely: systems, stockpiling, response and recovery, and strengthening of infrastructure.

The event underscored the importance of coordination and cross-sectoral cooperation in establishing resiliency measures that will benefit the Filipino people, which included the oil contingency plan which aims to ensure the continuous flow of the oil supply chain in the event of any disaster.

In his opening message, PDRF President Butch Meily said, "We are stronger when we work together. That's why a public-private sector partnership to strengthen resilience is so important."

Among the resource persons to the workshop were DOE Undersecretary and Chairperson of the DOE Task Force on Energy Resiliency Alexander S. NORTH COTABATO (July26) --- A soldier was killed Thursday in a gunfight near the Liguasan Delta with religious extremists reportedly fabricating improvised explosive devices.

Sgt. Ahmad Mahmood succumbed to a bullet wound in the head sustained in an encounter with members of the outlawed Bangsamoro Islamic Freedom Fighters in Barangay Dasawao in Shariff Saidona Mustapha, Maguindanao.

Mahmood was among the Army personnel from different units of the 6thInfantry Division searching since Thursday for BIFF gunmen implicated in recent bombings in the Central Mindanao.

Mahmood was killed hours after a powerful explosion ripped through a house owned by a suspected member of the BIFF in Barangay Kabasalan in Pikit, North Cotabato.

The alleged BIFF member, Alimoden Masla, and his 10-year-old son, Edwin, were wounded in the blast. His wife, Misbah, was not as lucky. She died on the spot from blast injuries.

The Western Mindanao Command in Zamboanga City said Thursday one of the IEDs Alimoden kept in his house could have exploded accidentally.

Masla, now confined along with his son in a hospital in Pikit town in North Cotabato, reportedly belong to the most radical among BIFF's three factions, the one led by Abu Toraife, whose real name is Abdulmalik Esmael.

Masla said it could either be an artillery round fired from a distance, or a rocket launched from an Air Force helicopter that landed on his house and exploded.

Talks have been spreading around since Thursday night purporting that two of Abu Toraife's followers --- the bomb-makers Ibrah Musib and Mansur Akil --- perished in military airstrikes at the marshy border of North Cotabato and Maguindanao provinces that preceded the Army-BIFF clashes that resulted in the death of Mahmood.

Major Gen. Diosdado Carreon, commander of 6th ID, said Friday they are bracing for possible retaliations by the BIFF.

The group, which uses the flag of the Islamic State of Iraq and Syria as banner, has a reputation for pulling off bomb attacks targeting innocent people.

There are also BIFF hitmen on motorcycles preying on unarmed off-duty soldiers roaming in town centers and in the cities.

More than 30 soldiers in civilian clothes been killed by BIFF gunmen in one attack after another that began in 2017.

Official Statement of Davao City Police Office

This pertains to the allegations of the Bagong Alyansang Makabayan Southern Mindanao accusing the  PNP and LTO/LTFRB of interfering in the conduct of their rally in Davao City.

There is NO truth to these claims. The jeepney they claimed to have been waylaid unjustifiably by the PNP Davao was in fact duly intercepted by the PNP and LTO/LTFRB for grossly violating: OVERLOADING and OUT-OF-LINE, a clear  violations of Law provided for by Republic Act 4136 or otherwise known as the Land Transportation Traffic Code.

In the light of this predicament, there is therefore NO iota of truth to the claim that the government is interfering on their rights to conduct peaceful rallies and assemblies as the law enforcers are merely enforcing the law which was clearly violated.

We also would like to reiterate that the Davao City Police Office has exercised maximum tolerance in all our dealing of lawful protest rallies in the past, as  we always uphold and respect  the rights of every individual including the right to freedom of expression,  to peacebly assemble to petition the government but  we must not also forget that in doing so we shall all consider the prevailing laws of our Country and exercise self-restraint as not to violate the rights of others.

We implement the Law without Fear or Favor.

Bible Study / Geneva Bible
July 21, 2019, 05:45:57 AM
By Scott Robinson
A little bit of history of the (forgotten) Geneva Bible

The Geneva Bible was the "Bible of the Protestant Reformation", and the Bible of the Puritans and Pilgrims. It was the first Bible taken to America, brought over on the Mayflower. The Geneva Bible is the Bible upon which America was founded. You can imagine, most early American colonists, who were fleeing the religious oppression of the Anglican Church (Church of England), wanted nothing to do with the King James Bible of the Anglican Church!

John Calvin
Textually, the Geneva Bible offered a number of radical never-before-seen changes: It was the first Bible in English to add numbered verses to each chapter of scripture. Also, the Geneva was the first Bible to introduce easier-to-read "Roman Style Typeface" rather than the "Gothic Blackletter Style Typeface" which had been used exclusively in earlier Bibles. Another curious innovation; the Geneva was the first "Study Bible " with extensive commentary notes in the margins.

Queen Mary
The Geneva Bible is the version quoted from hundreds of times by William Shakespeare in his plays. Also called the "Breeches Bible", the Geneva Bible is the only Bible ever able to outsell and exceed the popularity of the King James Bible, as it did in the early 1600's until its printing ceased in 1644. In fact, one of the greatest ironies of history, is that Protestants of all denominations today embrace the King James Version of the Bible (which reads 90% the same as the Geneva), even though the King James Version is not a Protestant Bible (it's Anglican / Church of England). Most Protestants have never even heard of the Bible of their own heritage: the Geneva Bible. It was produced by John Calvin, John Knox, Myles Coverdale, John Foxe, & other English refugees in ever-neutral Geneva, Switzerland... fleeing the persecution of Roman Catholic Queen "Bloody" Mary in England. Mary would not tolerate the Protestant Geneva Bible, which proclaimed the Pope an "antichrist" in its commentarynotes.

As Protestants, I think, we owe it to older reformers, to read this Bible.

DAN LOK: A MODEL ENTREPRENEUR
LUCELL LARAWAN, THE DAILY GUARDIAN AND BOHOL TRIBUNE

There is nothing dramatic and exciting about financially blessed individuals who merely inherited wealth. We are, however, drawn to those who, through many hard knots, made their own names because they have winning business mindsets.

One of them is Dan Lok, an Asian in origin. He started early on at age 20 when he launched 13 businesses—all coming to grief. Against one's expectations, he rose from being in debt of $150,000 to one on the crest of the wave.

After his parents separated, Lok and his mother migrated to Canada. In one interview with Entrepreneur magazine, he quipped, "I will never forget the look of hopelessness on my mom's face and the tears in her eyes".  He continued: "At that moment, I decided that I would be successful. I didn't need my dad; I would provide for my mom. I never wanted to see that look again."

Lok's first and last minimum wage job was that of a grocer. He was told that he did not fit in as an employee because he could not be told what to do. He could not agree more.

He began mowing lawns and delivering papers--anything that could not possibly raise money. While attending full-time business classes at the Douglas College in Vancouver, he worked through one failed entrepreneurial idea after another. He tried vending machines and day trading, among others.

Seemingly crippled by debts from Lok's relatives, his cousins advised him that he rather find a job. But Lok reasoned with them: "If I just work for a job, I will never be able to repay you." He recalls in an interview, "I knew I would be better off as an entrepreneur, even if it took a decade. I never gave up because I couldn't afford to quit — and if you don't quit, then you can't fail." A strong-willed man of vision does not just take one's suggestion.

Between the first and the thirteenth attempt, anyone can pull the curtains down, but he reveals in an interview why he was tenacious: "Success is on the razor's edge of failure. When you think it can't get any worse, hang on just a little longer."

Lok, obsessed with marketing, soon discovered marketing expert Alan Jacques. He attended his seminars where he met Jacques in person.

Offering to buy Jacques lunch, Lok asked Jacques to be his mentee. Jacques declined, but Lok was notdeterred. He visited Jacques' office for a month where he demonstrated his worth,  including picking up trash around the office. Jacques finally hired Lok.

That job with his mentor was important for Lok which made him decide to quit college. He started to craft sales letters only for Jacques to tell him it was terrible. Jacques wasnot satisfied with these letters until his seventh revision. For Jacques, the first draft was "OK", he confessed later. But he said "OK" is not how one can master anything.

The 12-month mentorship was Lok's first "million-dollar year" though he did not get much money. From what he learned, he started a sole-proprietorship advertising firm. In one year, his clients earned millions from his sales letters. At a young age of 22, Lok could price a project at $10,000 and was earning six figures.

He returned to Hong Kong where he came from and met his father. Walking down the street, Lok pulled out a set of keys and said, "I bought that apartment for you." He could already provide for his mom.

The profit Lok earned from his online business went to real estate investments. At 27, he was already a millionaire.Lok founded or partnered in more than 15 companies--from beauty salons to e-commerce—now earning a combined sales that exceed eight figures annually.

Bohol Latest News / Port Projects in Bohol
July 21, 2019, 03:13:39 AM
By PIA Bohol/RAC
"Build, Build, Build" puts in P2.2 B
ports infra development fund-PPA

CORTES, Bohol, July 20 (PIA)—For the Philippine Ports Authority's programmed ports development alone, the government puts in over P2.2 billion to complete an inter-modal transport system under its Build, Build program.

This is according to PPA Bohol Ports Manager Engr. James Gantalao, during a Department of Transportation hosted Media familiarization Tour to the Port of Tubigon, a newly completed port that the PPA said, its major port in Bohol's northwestern quadrant.

The low-key and yet consummate performer port manager who has roots in Maribojoc, explained that the PPA is looking at diving Bohol into four, so as to rationalize its development to benefit the entire island.

While the PPA has major ports in Tagbilaran, Jagna, Ubay, Talibon, Getafe and Tubigon, the government has also looked at focusing on the four ports of Tagbilaran, Jagna, Ubay with Tapal, Getafe, whch is closer to Cordova in Cebu and Tubigon.

The idea is to make all these ports pick the same standard for international tourists that the tourism port of Tagbilaran has since adopted, according to Engr. Gantalao.

Getting the lion share in the Build, Build, Build finds through the PPA is Tubigon Port, which has a proposed P 500 million fund for the 23,385 square meters of additional space they government is reclaiming.

The port of Tubigon had DOTr Secretary Art Tugade officiating its project turn over early this year.

But even with some parts of the port showing the devastation caused by the 2013 earthquake, the PPA has managed to complete the port management's administration building with one-stop service station, and the 200 seats passenger terminal building as previously planned.

With the port getting more port calls, a passenger volume of about 6,000 now, and Bohol's identified rolling cargo port, expanding the port's spaces come as a necessity.

On this, the PPA, through the Build, Build, Build is again putting up half a billion fund.

This would expand the port into a convenient and spacious gateway to Bohol, Engr Gantalao shared.

Then, Ubay port, has a total of P200 million allocation, Gantalao updated the media.

With about 5 hectares of planned reclamation, when completed, Ubay port would soon be Bohol's biggest port which would serve the Leyte-Bohol Roll-On, Roll-Off link.

Moreover, its municipal ports of Tapal and Aguining are also allocated development funds.

The port of Tagbilaran, on the other hand gets another P150 million for a new and bigger passenger terminal building.

Already tagged by international tourists as among the best tourism ports in the country, Tagbilaran port has 22 daily port calls by one fast craft company alone.

And with limited parking space, and a small passenger terminal building, the need for another passenger terminal hub in the port complex is imperative.

According to the PPA, the port of Getafe, the one closest to Cordova in Cebu, with a travel time of 45 minutes, takes the government's attention.

For the port that is getting busier now, the government has allotted P150 million for its improvement.

Development planners at the PPA believe that the strategic port of Getafe can boost economic and tourism activities in northern Bohol.

For the port of Tagbilaran, which now has 22 Oceanjet trips alone, the government is putting up another P150 M, for an expansion and a new and bigger Passenger Terminal Building, and more parking spaces.

Tagbilaran is the strategic port that connects Bohol to north western Mindanao, Negros and Cebu.

On the southeast side is Bohol's gateway to Mindanao. Jagna Port, owing to its being a strong link to Mindanao gets P97 million this time from the Build Build Build.

Other than Jagna, the Port of Maribojoc, which has the potential to be a cargo port is now eyed for a P450 million port development in this year's infrastructure projects.

Other ports which the government splurging on infrastructure that ferries development are the ports of Aguining, Popoo, Tapal, and Albur, PPA said. (rahc/PIA-7/Bohol)

Press Release - A fourth-generation leather maker surpasses its campaign goal, raising more than $9,000 from crowdfunders for its new, high-quality and well-priced "Highlander Travel Bag" on Kickstarter.

Made from weatherproof leather directly from the founder's family-owned tannery and designed to simplify travel, The Highlander is perfect for short trips or daily use at school or work.

MNML Leather creates beautiful, functional and high-quality leather goods designed to make life easier. Each product is made with a proprietary, weatherproof leather directly from their own tannery. MNML Founder Mitch Bank was inspired to create The Highlander Travel Bag after growing frustrated with the hassle of unpacking during his frequent short-term trips, and the inconvenience of getting through airport security checkpoints.

"I don't think of it as a bag...it's more of a travel system," Bank said. "I designed The Highlander as a highly organized, carry-on approved travel bag. It's made to open flat, so you never have to unpack it, to be quick and easy to get through airport security and compact enough to carry everything you need for trips up to four days. There's no more checked luggage and the frustration that comes with it."

Bank represents his family's fourth generation in the leather business, which started in the 1940s when his great-grandfather immigrated to Canada with his family after surviving the Holocaust. He started as a cowhide trader with his brother and eventually built their own hide plant in Toronto.

"Inspired by my family history, I decided to chart my own course to create beautiful, functional and well-made leather goods, using the highest quality leather from my family's own tannery," he said. "It means a lot to me to continue my family legacy."

Over more than seven decades, Bank's family has sold leather across the globe, and now owns Wicket and Craig of America – one of two remaining vegetable tanneries in the United States. Wicket & Craig is the only tannery in the world capable of tanning this specific weatherproof leather using its proprietary process, and supplies leather to many of the top fashion brands around the world.

"Most other high-quality leather bags are unreasonably expensive, but The Highlander is, what I call, 'reasonable luxury,'" Bank said. "It's beautiful, tough and priced well, especially considering the quality of the materials and level of manufacturing involved in production."

The Highlander's features include:

Organized pockets for easy packing
A full perimeter zipper that allows the bag to lay flat, providing easy access to everything inside.
A separate laptop pocket for easy access
A TSA-friendly front pocket designed to help speed users through airport security.
A zipper pocket for chargers
A shoe pocket
An internal pocket for small items that are easy to lose
Weatherproof leather (a proprietary trade secret)
Weatherproof canvas
Waterproof, smell-proof, easy-clean lining
Felt-padded shoulder straps
A multi-purpose handle that easily fits atop most roller luggage when needed
A simple, unisex design
In addition to travel, The Highlander is versatile enough to be used as the ideal day-bag for touring a city, enjoying a theme park, or going on a hike. It may also be used as a gym or even a diaper bag – and is stylish enough to take to the office.

To find out more about the unique Highlander Travel Bag, or to purchase the bag while it's offered at a special early-bird crowdfunding price, visit The Highlander Campaign Page on Kickstarter.

World Daily News / Advantages of Optimist
July 20, 2019, 05:02:33 PM
Press Release - It's not hard to see the advantages of being an optimist. Research has shown that people with this outlook are better at coping with stress, they're happier, and even healthier. Optimism can also be infectious. Walk into a room filled with optimists and you would probably find yourself feeling more upbeat and content. There's more to optimism, however, than the positive mindset and hopeful outlook. A recent study from PsychTests reveals that optimists have several more surprising advantages over their glum counterparts.

Assessing data from over 16,000 people who took their at: Happiness Test (at: https://testyourself.psychtests.com/testid/2114), PsychTests' researchers focused their analysis on a sample of 1,658 pessimists and 1,545 optimists.

Here is Where They Differed:

80% of the optimistic group look for the best in others, even the most onerous of people (compared to 16% of pessimists).
80% have a large support network that they can rely on in difficult times (compared to 19% of pessimists).
93% are able to be objective and view a problem from different perspectives (compared to 27% of pessimists).
97% have a strong sense of self-efficacy and eagerly take on challenges (compared to 18% of pessimists).
97% have a proactive attitude towards life and actively seek out change (compared to 20% of pessimists).
97% are totally comfortable being their true selves, faults and all (compared to 17% of pessimists).
96% make it a point to learn from their mistakes and failures (compared to 51% of pessimists).
75% of the optimistic group are/were above average students (compared to 53% of pessimists).
93% are satisfied with their personal relationships (compared to 29% of pessimists).
71% are satisfied with their job (compared to 13% of pessimists).
75% received good ratings at their last performance review (compared to 30% of pessimists).
On The Flipside, Psychtests' Stuy Also Revealed That:
40% of the pessimistic group were diagnosed with or being treated for depression (vs. 14% of the optimists).
79% confessed that they feel lonely (compared to only 2% of the optimistic group).
"Optimism isn't about pretending to be happy when you're not, acting like problems don't exist, or taking chances on blind faith," explains Dr. Jerabek, president of PsychTests. "It also doesn't mean that you should repress your negative thoughts. Those are the kind of pie-in-the-sky optimists who refuse to accept reality as it is and can actually be quite reckless. The best outlook is optimism with a dose of realism. These are the optimists who recognize that there is a lesson in every negative situation and every failure. They prepare and plan ahead in case something could go wrong, but they also stay positive and focus on possibility, hope, and success. Most importantly, they understand that their outlook has a huge impact on their circumstances, and as our study and many other studies have shown, the benefits of being optimistic are numerous. You don't have to force yourself to be cheerful. Just strive to remember that how you view a situation impacts how you cope with it and how you approach it. So why not do so with an attitude of hope, promise, and positivity?"

20-year-old Midsayap burger joint worker kidnapped
By John Unson

NORTH COTABATO  --- Gunmen snatched Friday a worker of a burger joint while on his way to work from a Friday worship rite in a mosque in Midsayap town in this province.
The Midsayap police office has confirmed the abduction of the 20-year-old Jake Omar Talusan but has no clue yet on who were behind it.
Witnesses said Talusan was on a motorcycle from a mosque in Barangay Sadaan, Midsayap en route to the Jollibee branch in the center of the municipality when gunmen flagged him down and forced him into a black, heavily-tinted van parked nearby.
Relatives told reporters via online Messenger that Talusan had sent a text message to his parents saying he was spirited by his captors to Digos City in Davao del Sur, about three hours away via overland travel from Midsayap.
Intelligence agents of the North Cotabato provincial police are now trying to track him down and his abductors, according to regional police spokesman Lt. Col. Aldrin Gonzalez.
Friends of Talusan told police investigators he has no known enemies and that he is a religious person who does not skip obligatory Islamic Friday worship prayers in the mosque.

TREASURED MEMORIES OF BOHOLANO CUISINE REMEMBERED BY SOME 70 TEACHERS IN HERITAGE MEMOIRS WRITING WORKSHOP

by Cooper Resabal

Some 70 teachers of creative writing and literature from all over Bohol and other cultural workers recalled memories of Boholano cuisine—ranging from sweet,  sour, milky and bitter, to salty and spicy—in a four-day heritage memoirs writing workshop on place, memory and food  on July 8-11, 2019 at the Bohol Arts and Cultural Heritage Institute (BACHI) in Tagbilaran City.

The four-day workshop introduced participants to the experience of creative writing, particularly the genre of creative non-fiction memoir, on their Boholano family food heritage. Guided by writing mentors, they culled from remembered stories of a food item, in terms of its particular contexts in place and time, the characters in these stories, and how the heritage continues to live in the family.

The all-Boholano team of facilitators included Dr. Marjorie Evasco, University Fellow and Literature Professor Emeritus of De La Salle University, Prof. Leo Abaya, full professor of the College of Fine Arts of University of the Philippines-Diliman, Dr. Ulysses Aparece, anthropologist and dean of the College of Liberal Arts of University of Cebu, and Dr. Rose Rara, Holy Name University graduate school professor.

The heritage memoirs writing workshop has been organized by BACH Institute in partnership with the Bohol provincial government, Diocese of Tagbilaran, Department of Education Division of Bohol, Loboc Youth Education Association Foundation and the National Commission for Culture and the Arts.

Designed for teachers of literature and creative writing, artists, cultural and development workers, the workshop opened with a panel provocation sharing  on "Cultural Heritage, Place, Memory and Food" by each of the facilitating writers, including a "Memory Mapping" with Lutgardo Labad, head of BACHI.

Participants were then divided into four groups,  each with a facilitator, and held close reading practices on a sample memoir writing "Puto Baang: Journey and Memory" by Ulysses B. Aparece.

In the first writeshop on "Framing the Narrative through Conceptualization and Form (Point of view and Story Arc)," the participants were asked to cull their memory of a traditional Boholano dish that is part of their family culinary heritage, like torta nga kinaraan, kalamay, inun-unan tulingan, etc.

A guide questionnaire prepared by Dr. Evasco urged participants to specify the elder in their family who specialized in preparing and cooking the dish. "Since the memoir is yours and is in the first person point of view, excavate your memory for the story you can tell of how this elder and her/his dish marks your family in a specific way by describing three scenes that you can use as the story's beginning, middle and end," she further instructed.

The first day produced draft sample narratives of some Boholano family culinary heritage. These included, "Kilawin Kindles Kinship," a draft account of a dish from goat meat, "Halang-Halang Manok Tinunuan " from Maribojoc about a chicken dish with coconut milk that spices up life in a village, "Hinudnong Bingka ni Manang"  as livelihood support, "Putos Putos nga Latik" as means for education, "Nilusak ni Mamala," "Puso sa Saging: A Story of Food and Healing," etc.

The second day tackled "Constructing the Story World; Setting as Place and Space; Setting as Time." Participants were asked to "think of the context in which the family dish is situated in the village and town." What is available in the area that is used in the preparation of the dish? When is this family dish prepared and why? Do other families know how to prepare and cook it?

At this stage, they were asked to extend the contexts in place and time of the family dish by interviewing  the one who specialized in cooking it (if still alive) on how the recipe came into his/her hands, who taught her the 'secrets' that made it distinct from the recipe of the same dish in other families.

The third writeshop on "Constructing the Plot and Desire in the Arc of Meaningfulness" followed. The facilitators asked participants to "think... why this dish is important to them personally and how it is connected to their sense of belonging to a family or clan." Do they know how to prepare and cook it? If not, who usually prepares and still cooks it now?

The guide question further instructed the teachers to "remember an occasion, including who were present, when the whole family gathered and had the dish. How is this family culinary tradition valuable to you? How important is this culinary heritage to you as a Boholano? How would you feel if it is lost forever in oblivion?

Since there were many heritage Boholano dish narratives written by the 70 workshop participants that could not all be presented within a limited time, each facilitator was asked to choose a best draft that was reviewed and critiqued by the panel and presented on the final day in a creative presentation or reading at the BACH Institute. The facilitators selected the following:

"Hinalang nga Baki: Lami o Dili" by Ejay Auxterio of Dagohoy, narrated the mixture of fun and difficulties involved in catching farm frogs for the hinalang nga baki dish in "sugid-balak"  or narrative prose poetry in Boholano with theater improvisation assistance by Kasing Sining artists Bryll Dumandan, Doydoy Calle, and one more.

"Pag-abot sa pagkaon, lahi ra gyud basta Bol-anon. Kugihan mangita up paagi para naay sud-anon. Usa na niini ang pagkaon ug hinalang nga baki, bati sa imong pamati apan kung ikaw makatilaw daw tumang kalami," Auxterio opens her narrative on a spicy frog dish.

"Puso: A Story of Food and Healing" by Jocelyn J. Laguna showed in English narrative how her grandmother's recipe of puso or banana blossom with lumayagan or squid was instrumental in healing a family trauma early in her childhood. Laguna presented a dramatic reading of excerpts from her heritage dish story.

"Bisa'g Saging Basta Labing" by Jaymay Derosahento presented a voice dramatization of how pounded banana sab-a mixed with grated coconut saved his family from hunger after typhoon Ruping devastated their house and farm. This banana mix eventually became the basis of a family business venture from his Lolo's nilurang nga sab-a to maruya. He concludes, "As long as there is saging, we will surely always be assured of labing (love)."

Raffy Salo presented a reading of his "Putos Putos Aron Mulampos: Latik," a story of how preparing and selling "balikutsa" or latik, a sticky mixture of cooked dark brown sugar and coconut milk wrapped in dried banana leaves, helped him and his family in facing the challenges of life, and in completing his education as a teacher.

The best final memoirs will become part of a book, "The Bohol We Savor," to be published by the BACH Institute in 2020.

A reading/performance of Marjorie Evasco's poem "Sumad" was presented by Rama Marcaida, Gardy Labad, Cooper Resabal, Rose Rara and one more, with drum and bamboo rainmaker sound backup as a final rite/offering of the workshop.

All participants who submitted a memoir or work of creative non-fiction on a heritage family dish were each given a certificate of participation for completing the writeshop signed by the four mentors/facilitators.

Cotabato City-based tourists still missing in Phuket, Thailand after large waves swept them away to deep sea
COTABATO CITY (July19) --- The two Filipinos missing after high waves battered on July 17 the Freedom Beach in Phuket, Thailand are both residents of this city.

Rescuers have still been searching for Noah Ibay, Jr., 40, and his companion, the 29-year-old Angelo Bian Rafael Cortez, according to Thai online news reports.

The duo was among 13 friends from this city who left for a vacation in Thailand early this week.

Relatives of Ibay, whose mother is a senior official in central Mindanao of the Department of Agrarian Reform, told reporters here they have requested the embassy of Thailand in Metro Manila to provide them periodic updates on efforts to find them.
Uncooperative weather has reportedly stymied the search and rescue missions.

Ibay's uncle, Mayor Cahar Ibay of Parang town in the first district of Maguindanao, said his nephew was not even swimming when big waves hit the beach where they were whiling away time along with Cortez and their companions.

"We are praying, hoping Thai rescuers could find them both," the mayor said.

Personal Remittances Increase to US$13.7 Billion in the First Five Months of 2019

Personal remittances from Overseas Filipinos (OFs) rose to US$2.9 billion in May 2019, a 5.5 percent increase from US$2.7 billion in May 2018. On a cumulative basis, personal remittances for the period January-May 2019 increased by 4.1 percent to reach US$13.7 billion from last years' level of US$13.2 billion. This was announced by BSP Governor Benjamin E. Diokno today.

The steady growth in personal remittances during the first five months of 2019 drew support from the remittance inflows from land-based OF workers with work contracts of one year or more, which aggregated to US$10.5 billion from US$10.2 billion in the same period last year. Inflows from the compensation of sea-based workers and land-based workers with short-term contracts also contributed to this growth and totaled US$2.9 billion from US$2.7 billion a year ago.

Likewise, cash remittances from OFs coursed through banks rose to US$2.6 billion in May 2019, a 5.7 percent increase, from US$2.5 billion in the same period a year ago. This brought cash remittances for the period January - May 2019 to reach US$12.3 billion, 4.5 percent higher than the US$11.8 billion recorded in the same period last year. In particular, cash remittances from land-based and sea-based workers increased by 3.2 percent at US$9.7 billion and 9.2 percent at US$2.7 billion, respectively, during the first five months of 2019.

By country source, the US registered the highest share of overall remittances for January to May 2019 at 36 percent. It was followed by Saudi Arabia, Singapore, United Arab Emirates, the UK, Japan, Canada, Hong Kong, Qatar and Kuwait. The combined remittances from these countries accounted for 78 percent of total cash remittances from January to May 2019.

Message and Press Conference Of President Rodrigo Roa Duterte During The Welcoming Of Repatriated Overseas Filipino Workers From Al Khobar, Kingdom Of Saudi Arabia
August 31, 2016
MESSAGE AND PRESS CONFERENCE OF
PRESIDENT RODRIGO ROA DUTERTE
DURING THE WELCOMING OF REPATRIATED OVERSEAS FILIPINO WORKERS
FROM AL KHOBAR, KINGDOM OF SAUDI ARABIA
[Arrival Immigration Area, NAIA Terminal 2, Pasay City | 31 August 2016]

Magandang umaga po.

You know, 'nong umpisa pa lang ito, pag– 'Nong nag-assume ako ng office, gusto ko ng pumunta doon kasi nababasa ko na 'yung — lumalala nang lumalala 'yung problema as each day passes by. Last two weeks ago, sabi ko sa kanila, I will leave for Riyadh within 72 hours. Hanapan ninyo ako ng eroplano kasi... pera.

Actually, you have to inform the Embassy of Saudi Arabia. But for the nuances, hindi naman niya sinabi "huwag." Ang totoo, sabi nila na okay man. Hindi ka naman kailangan pumunta dito kasi lalabas na wala naman silang ginagawa, kailangan pumunta pa ako. Parang hindi maganda tingnan.

So inassess namin 'yung sitwasyon. Hindi naman sila nag-ayaw. Pero sabi nila... postpone your trip for a better time. Eh sabi nga nila, tinutulungan ko naman lahat.

So I send several officials of, workers in the government. I... pinadala ko si Bebot. Sabi ko: Bot, mauna ka na. Then, Yasay was also there and in addition, I commissioned Mamondiong — isang Maranao, pati isang brad ko na Maranao rin. Si Mamao. So sabi ko, tulungan ninyo doon lahat 'yung mga kababayan.

But we are ready... or anytime, pag kailangan, sabi ko, nag-okay ang PAL pati Cebu Pacific that they will send immediately, upon notice, eroplano.

So sabi nila huwag na muna. Gusto kong pumunta talaga doon, noon pa.

Mabuti't na lang, dumating naman kayo. Ayos naman ang kalagayan ninyo, except for one or two who died. Well, I'm sorry for that. Ginawa man namin ang lahat ang magagawa namin. But we have the money, we have the contingency and we have the means of resources to do it.

Maski pabalik ng araw-araw. Walang problema 'yan. So, kung ano lang ayusin doon, kailangan dapat maayos. 'Yung exit visa, na-waive naman 'yung penalties. So wala ng problema.

Ngayon, it's just a matter of time and motion. Kailan tayo aalis, tapos gaano katagal pabalik dito, na paikot-ikot para madala kayong lahat dito. We are not so bad actually, okay naman ang ekonomiya natin. Maghihintay-hintay lang kayo ng—Bigyan mo lang ako konting panahon. Aayusin ko lang and ekonomiya, at ang may opportunity for you to work here.

We are not really exceeding the expectations, but we are on target sa ating growth. We have hit a phenomenal of 7, but it's not something to crow about, we have to do more. And, kung paano natin pabilisin para marami 'yung pumasok negosyo, just like in Saudi Arabia. Maraming mga negosyo doon, investments. Kaya lang tinamaan tayo ng bagsak ng oil.

Alam mo kasi pag ka 'yung negosyo mo dependent sa oil, 'yan ang problema eh. So, ang volatile diyan itong langis. Otherwise, it could be very hard to get and at times there's a glut. And even if there's trouble, sumusobra naman 'yung gasolina. So it has affected, pag ka hindi na kumikita 'yung negosyo, 'yun ang mangyayari.

So ngayon na, take time to reassess yourself. Maybe you can—We are starting to... Saan si ano? Itong small, medium and small enterprises. Nag-uumpisa na ako. Binuhusan ko ng pera 'yan. Makahiram ka but you have to go the Department of Trade, mahusay tao diyan. 'Yung nagdala nga ng Go, Go Negosyo noon. Makahiram ka ng pera, makapag-start ka ng negosyo mo. But I really do not know the wherewithals of how to get it, how many persons should be granted. Pero meron 'yan. Take advantage of it. It's for everybody, 'yung small scale.

'Yun namang assistance ninyo, we will try to do. Meron man kayong matanggap but in addition to that, aalis ako ng Zamboanga kasi—Sinong Moro dito? Sige naman away doon. Saan ka? Tausug? Sana 'wag na lang... Pupunta ako doon, 15 – is that the word? – 15 'yung patay na sundalo. So magbisita ako doon. Sayang ang pera. Gastos mo ng bala, bigay mo na lang sana sa tao.

I'm talking now to the MI, MN.

It's really a question of crafting the state. Marami kasing bukol, away, tapos ekonomiya. Meron namang Abu Sayyaf na ayaw maniwala. Maraming bukol eh. Pag nahihilot mo 'to, pag naayos mo 'to, at gaganda, eh gaganda ang buhay natin.

Just the matter on drugs, eh pati ako hinahabol na ako ng United Nations. Kaya maggawa natin ng sarili natin. Eh pinapapakialaman tayo dito eh. Sabi ko lilinisin ko 'to. Because, you know, if I do not interdict or cannot stop the drug problem now, kung hindi ko makayanan 'to – hindi ako nagyayabang – kung 'yan lang sa makita mo mga politiko, walang makagawa niyan. Walang may kaya niyan.

Kaya ito, naumpisahan ko na lang rin. Tatapusin ko na lang. Hindi na bale kung nakulong ako, 'di bisitahan ninyo ako doon sa Munti. Magdala kayo ng droga, ako naman maglulong doon. [laughter]

Kaya lang, isipin mo lang ating bayan, parang bula, maraming bukol. Ayus-ayusin natin itong bukol. Number 1 na bukol, ekonomiya. It's really economy, even sa drugs.

Lahat talaga—Dalawa 'nong isang araw, nagpunta ako dalawang pulis. Araw-araw may dalawa ako, either military or police o police military na tinataman sa droga, everyday.

So ito ngayon, na-wallop tayo ng 15, but 24, is about, 23, 24 kanila. We do not enjoy killing people. I do not enjoy this war. I hate to sign documents that would procure things that would just kill or maim your citizen.

Hindi ito ang laro na gusto ko. Maghanap ako... gusto ko maghanap ng ibang kalaban. Huwag 'yung Pilipino. So, kaya kung every time we make decisions, nasasaktan ako. I mean, you know– Kasi ang lola ko Maranao.

Just be sincere and if you really want peace, more than you, I need it for my country.

So hindi na ako magtatagal, te-take off ng Zamboanga, Davao. Then, I'll have to prepare for the trip to Laos. Punta akong Laos kasi may ASEAN. Punta muna akong Brunei, Laos, tapos Indonesia pabalik. Meron rin tayong preso doon marami, drugs, pati si Veloso. Ewan ko kung anong—I'm praying that I could do something for her. But anyway, the guys beside me.

Putaragis. [laughter] Walang ginawa ito kung 'di mag—

So I have to ask for the indulgence, I'm leaving but may konting pera ako para pang-pamasahe o ano. Magkano? 15 million each? [laughter] Hindi, may 5,000 ako for each of you. [applause] But anyway, talagang ganito na lang. Kung talagang medyo hirap ka. Even to survive to it. Let me know. Let me know. Kasi kung talagang sarado, then enroll ko na lang kayo sa 4Ps. In the meantime, you have a little. But 'yung bigas mo, meron ka. Eh compulsory na lang kaya ilagay ko, until such time... just don't be a liar. Sabihin lang ninyo ang totoo. Kung may trabaho na kayo, then I'd stop the assistance, in the meantime, in the meantime I'll give it to you para may sigurado may bigas kayo sa mesa ninyo. [applause]

Tawagan mo lang ang 8888, tapos isabi lang ninyo. Ang problema kasi, maraming... Ito talagang Pilipino. For all of the good intentions, may 8888 ako. Para makatawag kayo maski anong klaseng problema. But primarily para 'yan sa graft and corruption.

Then we will check the recruitment. 'Yan ang mga animal diyan eh. 'Yang recruitment.  Diyan ako talaga galit. Kami na ang bahala. Pupunta ako sa ganon. Kunan ko 'yung data.

Then, ikaw mismo bigyan ka ng listahan. Sinabi ko sa lahat ng departamento, lahat lahat sa gobyerno. Ibigay mo lahat 'yung shopping list, 'yung listahan na kailangan i-produce. "Ito, produce mo, birth certificate." Ngayon, pag-produce, 'yang birth certificate, nandiyan sa Statistics and Census. So they have an office there. Sabi ko kay Bebot: Just across or whatever, 'yung tao, 'yung walking distance nila. Kunin mo. So doon mo kunin ang clearances mo. Either in the same building or a building adjacent and near walking distance.

Walang pila. Walang magbalik-balik. Punta ng... Census, tapos punta ng Police. Kaya nga may computer eh. Kaagad na, umiilaw na 'yan. So, it should not be a problem to you. 'Yan ang gawin ko within the next six months. I promised the reform. Ang pinaka-matindi away ko dito, droga. Maraming patay. Ako naman, I'm not trying to insinuate something. Pero kung may makilala kayo, anak—Magalit lang kayo sa akin, mag-away lang, sasama lang loob niyo sa akin.

Avoid drugs at all cost. Kasi sabihin ng mga... pi-pickupin (pickup) ng media. Avoid drugs at all cost because it could cost your life too. Ganon 'yan. Kasi ang tinamaan sa atin. Three million plus, mga 700, 800, nearing to four. That is a crisis for the country. Wala tayong pera, wala tayong—Kasi pumasok ako nandiyan na 'yung budget for this year. It was really passed the other year.

I'm operating on a budget na hindi akin. Hindi ko naman alam na... 'Nong sabi ko inipit ko na lahat. Naglabasan na. Umabot pala tayo ng—Kita mo, even the 700,000 na nag-surrender. Hundreds of thousand Pilipino tapos 'tong mga kriminal na lumaban, namatay, 1,600. Gawain mo ng 10,000. Linisin ko talaga 'to. Kasi pag hindi ko kaya, walang makakaya niyan. Maniwala kayo. Pwera si Bebot. Sabagay lady killer 'to. Hindi naman to pumapatay ng tao.

So, welcome to your country at tulungan ninyo ako. Wala akong balak na maging diktador. Abogado ako. Ang nanay ko Yellow Friday leader sa Davao. Sasabihin... mag-Marcos. Far from it. I am just doing my duty. Or else, I will compromise, mako-kompromiso ang next generation natin. Alam niyo kung sino 'yan? Mga anak ninyo. Pati mga apo ninyo. Then we will have a failed country. Sabi ng hindi mangyari, kanila 'yun. Hayaan mo sila, may theory tayo eh. "Hindi mangyari." Okay.

There is no such thing as a budget for three hundred seven thousand drug addicts.

I'm trying to catch up with time. Hindi ganon kasi ka-ano ang... ang ano ng tao. There are people who do not understand, who don't even know, then push it. An opinion there, as if they are the ex cathedra truth of the whole situation.

So welcome, alam ko gusto ninyong umuwi. May pupuntang ano, may mga taga-Davao? Isa lang? Ah, Cagayan.

Sana makakuha kayo but try to, try to... I will hurry up the, try to get something, maski umpisahan lang ninyo ngayon para makumpleto ninyo 'yung papel at maybe next year you can start a new business. In the meantime, if it spells hunger for your family, do not hesitate to call me. 8888, o pumunta ka sa Malacañang. Katukin mo 'yung... ito 'yung mga guwardiya. Basta naka-puti. Hindi 'yan sila bingi, radyo 'yan. Akala mo – ano 'yun? – hearing aid. Katukin mo. Sabihin mo ako 'yung kinausap ni Duterte doon sa airport. May sabihin lang ako sa kanya. And, I am now ordering them to let you in. Pag walang tao, hanapin mo lang si Medialdea. Or pumunta ka kay Department... kay Yasay. Maraming pera 'to. Mga 'to mayayaman na.

Yasay, 'nong nag-Martial Law, nawala 'to kasi hinanap ng pulis, aktibista 'to eh. Doon namin... But si Jun, is not really working here. Sa United States based ito. Professional lecturer ito doon. Hinila ko lang. Sabi ko, maski konting panahon lang. Tulungan mo ako dito. Bahala na ilang buwan. Pagkatapos niyan, okay na. Para maka-larga lang 'yung gobyerno. So, I will not stay long. I welcome you all. Assalamu alaikum, my friend. [applause]

QUESTIONS AND ANSWERS:

PRESIDENT DUTERTE: Before I forget, rather, magtatayo ako ng bangko [for] overseas bank lang para sa inyo workers. [applause] Kami ang magbigay ng kapital pero... para diretso na, pati inyo ang bangko para madali.

Yes, you are from?

Q:  ABS-CBN po. Si Doris Bigornia po.

PRESIDENT DUTERTE: Akala ko sa Lebanon. [laughter] Magaganda sa Lebanon eh. Doris Bigornia. Yes, ma'am?

Q: Sir, tatanungin ko lang po sa nangyayari po ngayon sa Jolo, nalagasan po kayo ng 15. Meron po ba kayong point na naiisip niyo na na mag-declare ng State of Emergency doon?

PRESIDENT DUTERTE: No. It's just a punitive police action by the security forces of the government. The magnitude of the trouble there does not warrant anything except the industry of the AFP and PNP.

Pagod lang 'yan and we do not– at some point in time, I have to ask everybody there including Nur Misuari. We talked last night sa, nandoon ako sa opisina and I suggested to Nur Misuari about his problem that there is a pending warrant for his arrest and I told him: "Nur, I have no intention of detaining you or placing you in the custody of the government. You can simply walk out there, ask any soldier and police to escort you. Kung saan ako, mag-usap tayo."

But he wants Kuala Lumpur, in front of the OIC and some of the well, mga tao niya sa Bangsa Tausug — Bangsamoro 'yung isa, Bangsa Tausug 'to sila eh. 'Yung mga Tausug doon, sabi ko na: "Dalian mo Nur kasi we're wasting lives here." At tsaka sabi ko, kung matuloy 'yung federal, then each region can have its own economic policy.

For as long as it is not illegal, sabi ko, ibalik nalang natin yung barter trade. 'Nong panahon na 'yun walang rebelde and everybody was busy making a living. So sabi ko, ibalik nalang natin lahat ng anong gusto ninyo, anyway it's federal. It's up to you to earn or not earn for your region but 'nong ganon, historically, 'yung barter trade was there before any government was set up here in Mindanao and therefore, logic would say that kung ibalik mo 'yang historical livelihood nila, barter trade, it might help promote peace in the island of Mindanao.

Q: Sir, good morning po. Joseph Morong sir sa GMA 7. Just a follow up on Chairman Nur. Sir, amenable po ba kayo na makipagkita kay Chairman Nur sa Kuala Lumpur as he proposed?

PRESIDENT DUTERTE: Chairman Nur Misuari?

Q: Opo.

PRESIDENT DUTERTE: Yes. Kasi I can go to him, I can go to Jolo if he wants. Or if he wants somebody there, they can bring him back to Davao City or in Manila. He can be my guest in Malacañang, in the People's Palace, and we can talk there for a while.

Dalawa man 'yung kwarto sa Bahay na — anong tawag na ngayon? — Pagbabago. Wala man 'yan pintura, walang nagbago diyan, natulog lang. There are two rooms there, he can have– the other room is available.

Wala akong problema at this time, I cannot be too stringent in the matters that would affect whether or not we succeed. Kasi the most important thing really is that there is a dialogue going on kasi it has saved us a lot of money now that the threat quiet in Mindanao.

So habulin natin 'yan para 'yung pera pang-away, ibili nalang natin ng, ibigay natin sa mga tao para hanapbuhay.

Q: Sir, clarification lang. Because sir there is a prevailing warrant of arrest, nasa kapangyarihan po ba natin to ask it to be lifted?

PRESIDENT DUTERTE: Ako?

Q: Opo, or are you asking it to be lifted?

PRESIDENT DUTERTE: Ako man ang hepe ng pulis pati militar, eh sabihin ko lang, 'huwag ninyong galawin.'

Q: Sir, technically we're lifting the warrant of arrest?

PRESIDENT DUTERTE: Well, if there is a warrant for his arrest, all I have to do is to do not implement it against him because if you arrest Misuari, you place him under the custody of the police diyan sa Crame and he dies for whatever reason, kompromiso na tayo. Then there's gonna be conflagration of... mahirapan na tayo mag– He's the only known leader who has the influence and the structure. Nobody else stands there. While dito sa kabila, there's Murad and there's Jaafar and the Central Committee of the Bangsamoro, MNLF.

Q: Sir thank you very much po. Thank you sir.

Q: Good morning, sir. Leila Salaverria po from Philippine Daily Inquirer. Sir, according to the White House, President Obama expects to meet with you in Laos. What topics do you wish to discuss with him and are you–?

PRESIDENT DUTERTE: I don't know. He could wish any topic at all. I am ready to talk to him.

Q: Sir, just to clarify, are you willing to meet with him in Laos?

PRESIDENT DUTERTE: To talk to him?

Q: Opo.

PRESIDENT DUTERTE: Of course.

Q: Sir, the US wants to bring up the human rights issues with you. Are you willing to discuss that and what do you intend–?

PRESIDENT DUTERTE: Depends to what degree because they must understand the problem first before we talk about human rights. I would insist: Listen to me. This is what the problem is. Then we can talk about human rights. No problem.

Q: And are there any other topics you might wish to bring up with the US President?

PRESIDENT DUTERTE: Wala. At this time, I'm talking with China and China wants to talk to me bilateral. If it's good and if it's to the advice of my team, the military, the police, and these guys sa likod ko and they would say "larga tayo." It's always a Cabinet decision. It's a Cabinet decision.

Q: Thank you sir.

[President Duterte delivers another message]

[start of recording]

PRESIDENT DUTERTE: Ang kailangan lang maipakita lang 'yung employment contract ninyo, date when you went out and in, tapos OFW worker. At sa state colleges marami 'yan nakaikot, kung malapit. Kung wala, magusap tayo. Pumunta kayo doon sa, mag-set-up kami ng, sa probinsya, just to have evaluations so that I can respond correctly and accurately.

Pero 'yung nandito sa Maynila, you can enroll your children sa state universities, ako na magbayad. Diretso na ang billing sa Office of the President. [applause]. Marami tayong bangkong pagnakawan. Okay? Okay.

Para wala kayong... Pati 'yung sa elementary, sali na ninyo roon sa ano—Para walang... o ibig sabihin, even if you are here now jobless, the education of your children will continue. I will pay. Walang problema. [applause]

MARIA DE LEON TRANSPORTATION v. DANIEL M. MACURAY +
DECISION

DEL CASTILLO, J.:

This Petition for Review on Certiorari[1] seeks to set aside the March 17, 2014 Decision[2] and September 17, 2014 Resolution[3] of the Court of Appeals (CA) granting the Petition for Certiorar[4] in CA-G.R. SP No. 130387 and denying herein petitioner's Motion for Reconsideration,[5] respectively.

Factual Antecedent

On November 21, 2011, respondent Daniel M. Macuray filed a Complaint[6] for illegal dismissal against petitioner Maria De Leon Transportation, Inc. before the Regional Arbitration Branch No. 1 of San Fernando City, La Union, docketed as NLRC Case No. RAB-I-11-1119-11 (LC).

In his Position Paper,[7] respondent claimed that, in April, 1991, he was employed as a bus driver of petitioner, a company engaged in paid public transportation; that he plied the Laoag-Manila-Laoag route; that he received a monthly pay/commission of P20,000.00; that, in November 2009, petitioner's dispatcher did not assign a bus to him, for no apparent reason; that for a period of one month, he continually returned to follow up if a bus had already been assigned to him; that finally, when he returned to the company premises, the bus dispatcher informed him that he was already considered AWOL (absent without leave), without giving any reason therefor; that he went back to follow up his status tor about six months in 2010, but nobody attended to him; that he was not given any notice or explanation regarding his employment status; that he felt betrayed by the petitioner, after having served the latter for 18 years; that he considered himself illegally dismissed; that during this time, he was already 62 years old, but he received no benefits for his service; that he was being charged for the cost of gasoline for the bus he would drive; and that petitioner owed him three months' salary for the year 2009. Thus, he prayed that he be awarded backwages, separation pay, retirement pay, 13th month pay, damages, attorney's fees, and costs of suit.

In its Position Paper and other pleadings,[8] petitioner claimed that respondent was hired on commission basis, on a "no work, no pay" and "per travel, per trip" basis; that respondent was paid an average of P10,000.00 commission per month without salary; that, contrary to his claim of illegal dismissal, respondent permanently abandoned his employment effective March 31, 2009, after he failed to report for work; that it received information later on that respondent was already engaged in driving his family truck and was seen doing so at public roads and highways; that respondent's claim of illegal dismissal was not true, as there was no dismissal or termination of his services, and no instructions to do so were given; that the bus dispatcher from whom respondent inquired about his status had no power to terminate or declare him AWOL; that respondent had not actually approached management to inquire about his employment status, even though he and all the other employees knew that the Assistant Manager, Corporate Secretary, and Director of the bus company, Elias Dimaya, resided with his family within the bus company's station and compound in San Nicolas, Ilocos Norte; that respondent's witnesses had an axe to grind against petitioner, which accounts for their false testimonies; that based on respondent's Complaint, he claimed to have been illegally dismissed in January, 2009, which was contrary to the documentary evidence which showed that he continued to work until March, 2009, after which he completely abandoned his employment; that per Joint Affidavit[9] of petitioner's bus dispatchers, it is not true that respondent ever made inquiries and follow-ups about his employment until mid-2010; that there was no illegal dismissal, and thus respondent was not entitled to his monetary claims; that respondent never refuted the claim that he abandoned his employment with petitioner because he took on a new job as driver for his family's trucking business and was seen doing so in public roads and highways; that it was common practice for bus drivers of the petitioner to simply stop reporting for work for short periods of time, or even years, after which they would return and ask to be allowed to drive petitioner's buses once more, which management allowed after the absentee drivers gave satisfactory and reasonable explanations for their absences; that this practice was impliedly sanctioned in order to give the drivers the opportunity to take time off from the stress and boredom of driving on long trips; that respondent's allegations were not true, particularly his claim that he was told by a bus dispatcher that he was considered AWOL, since he refused to divulge the identity of the bus dispatcher who gave such information to him; and that there was no truth to respondent's allegations that the cost of gasoline for every bus trip was charged to him, as it was shouldered by the petitioner. Petitioner prayed for the dismissal of the case.

Ruling of the Labor Arbiter

On August 24, 2012, Labor Arbiter Irenarco R. Rimando rendered a Decision[10] dismissing the case for lack of merit, declaring that —

x x x [Complainant] cannot state with certainty the date and time of his dismissal if it was January 2009, middle of 2009 or November 2009 x x x.

n his pro forma complaint sheet, he mentioned that he was already 61 at the time that he filed his complaint on 23 November 2011. Yet in his position paper he mentioned that he was already 62 years old after he rendered service for 18 years x x x.

On the issue of constructive dismissal, seemingly Rudy Compañero and Loreto Casil presented a story that [showed] they were aware that Daniel Macuray was poorly treated by respondent when he was still employed between  2007 and 2009. But the records [did] not show that the complainant had shown any sign of whimper or protest. Therefore, x x x the claim is unfounded.

The [alleged] unpaid fuel expenses that were incurred by unidentified drivers for respondent's bus with Body No. 1 [was] not supported by substantial evidence which a reasonable mind might accept to justify a conclusion. He did not present a single accounting of his purchases for diesel fuel and how much. The complainant did not even claim that the unpaid gasoline expenses were charged to him.

The complainant failed to present evidence that the treatment he received from respondent was unreasonable or oppressive and unbearable that would amount to a constructive dismissal x x x.

The complainant never returned back to work after 31 March 2009. An informal voluntary termination is recognized under the law as an authorized ground for dismissal x x x. In such case compliance with the two (2) notice requirement of due process is not necessary. When this happens the employee is not entitled to separation pay and backwages. The dismissal is not illegal. Hence the claims for separation pay, backwages and damages are denied.

IN VIEW THEREOF, this case is dismissed for lack of merit.

SO ORDERED.[11] (Citations omitted)

Ruling of the National Labor Relations Commission

Respondent filed a Memorandum of Appeal[12] before the National Labor Relations Commission (NLRC). On December 28, 2012, a Resolution[13] was issued modifying the Labor Arbiter's judgment by awarding in favor of respondent the amount of P50,000.00 as financial assistance. The NLRC held:

x x x A close evaluation of the records however [showed] that complainant-appellant was unsure of the date of his dismissal. In his complaint, he entered the date January, 2009, in his pleadings the year 2009 and [in] his position paper be stated the month of November, 2009. Moreover, he failed to identify the dispatcher who did not assign a bus to him. Complainant-appellant therefore failed to establish the fact of his alleged dismissal with substantial evidence.

On the other hand, respondents-appellees stress that complainant-appellant did not report for work anymore from March 31, 2009 and in support thereof submitted folders showing the particulars of the trips where complainant-appellant served as assistant driver for the period 3 January to 30 March 2009; that neither did complainant-appellant file any leave of absence. Thus, respondents-appellees concluded that by his failure to report for work beginning 31 March 2009, complainant-appellant permanently abandoned and severed his employment effective 31 March 2009.

Although absence without valid or justifiable reason is an element of abandonment, settled is the rule, however, that mere absence or failure to report for work is not tantamount to abandonment of work. x x x

x x x Respondents-appellees' conclusion that complainant-appellant abandoned his work lacks factual basis.

In the consolidated cases of Leonardo vs. NLRC x x x the Supreme Court also ordered the reinstatement sans backwages of the employee x x x who was declared neither to have abandoned his job nor was he constructively dismissed. As pointed out by the Court, in a case where the employee's failure to work was occasioned neither by his abandonment nor by a termination, the burden of economic loss is not rightfully shifted to the employer. Each party must bear his own loss.

In this case, we note that complainant-appellant is already sixty two years old and he may not be apt for the job as bus driver considering the long hours of travel from Laoag City to Manila. Hence, his reinstatement may no longer be possible. Separation pay however[,] cannot also be awarded to complainant-appellant because he was not dismissed by respondent appellee. In cases where there was no dismissal at all, separation pay should not be awarded. x x x

Under this circumstance, financial assistance may be allowed as a measure of social justice and as an equitable concession. x x x

x x x Respondents-appellees are therefore ordered to award financial assistance to complainant appellant in the amount of FIFTY THOUSAND PESOS (P50,000.00).

WHEREFORE, premises considered, the DECISION dated 24 August 2012 is hereby MODIFIED ordering respondents-appellees to award financial assistance by (sic) complainant-appellant in the amount of FIFTY THOUSAND (P50,000.00) PESOS.

SO ORDERED.[14] (Citations omitted)

Respondent filed a Motion for Reconsideration,[15] which the NLRC denied in a March 18, 2013 Resolution.[16]

Ruling of the Court of Appeals

Respondent filed a Petition for Certiorari[17] before the CA, questioning the NLRC dispositions and praying for the relief he originally sought in his labor complaint.

On March 17, 2014, the CA rendered the assailed Decision, decreeing thus:

We find the petition to be meritorious.

In an illegal dismissal case, the onus probandi rests on the employer company to prove that its dismissal of an employee was for a valid cause. There is no such proof of a valid cause in the instant case. On the contrary, the facts bear the marks of constructive dismissal.

The Labor Arbiter's findings that there was an informal voluntary termination has no basis. Based on the age of petitioner as appearing in the records of this case, he was 58 years of age in November of 2009 when he was no longer assigned any bus. Nearing his retirement, it [was] irrational that he would suddenly opt for an informal voluntary termination. Thus, the NLRC's appreciation of facts is more in keeping with logic as it held that there was no abandonment. Surely, petitioner kept going back to the respondent company to check whether or not there would already be a bus assigned to him. There being no bad records or previous transgressions committed by the petitioner against respondent company, or any third party in relation to his job during his eighteen (18) years of working for respondent company, there was no rhyme nor reason why he would suddenly not be assigned a bus to drive and no reason why he would suddenly voluntarily stop working while nearing his retirement.

Reinstatement of petitioner, however, may not be in the best interest of respondent company and or petitioner himself. As correctly declared by the NLRC, petitioner is 'already sixty-two years old and he may not be apt for the job as a bus driver considering the long hours of travel from Laoag City to Manila. Hence, his reinstatement may no longer be possible.'

Undoubtedly, herein petitioner Daniel Macuray was performing a job that has an intimate connection to the business of respondent company as he worked as a driver of respondent Maria de Leon Transportation, a public transportation business company, for eighteen (18) years. As a regular employee who has been constructively dismissed, petitioner is entitled to separation pay equivalent to one (1) month salary for every year of service.

Under the above-mentioned twin remedies, there is likewise basis for the grant of backwages. x x x. In this case, petitioner was illegally dismissed in November of 2009 when he was no longer assigned any bus without cause or reason. Thus, his backwages may be computed from November of 2009 until December 28, 2012, when the NLRC held that 'reinstatement may no longer be possible.'

Reinstatement being no longer possible and petitioner being 62 years old, petitioner is entitled to retirement pay, having worked for respondent company for eighteen (18) years. It is herein noted that the required length of service, to be entitled to retirement pay under the law, is only five (5) years. The applicable law is Article 287 of the Labor Code, a amended by R.A. No. 7641 x x x:

In view thereof, petitioner is entitled to one-half (1/2) of his monthly commission for every year of service. x x x. Thus, for having been illegally dismissed, petitioner therein was entitled not only to separation pay and full backwages, but additionally, to his retirement benefits pursuant to any collective bargaining agreement in the workplace or, in the absence thereof, as provided in Section 14, Book VI 8 of the Implementing Rules of the Labor Code.

As interpreted by the Supreme Court in Auto Bus Transport Systems vs. Bautista, 'employees engaged on task or contract basis or paid on purely commission basis are not automatically exempted from the grant of service incentive leave, unless, they fall under the classification of field personnel.' Herein petitioner does not fall under the classification of field personnel. If required to be at specific places at specific times, employees including drivers cannot be said to be field personnel despite the fact that they are performing work away from the principal office of the [employer]. In this regard, Section 2, Rule V, Book III of the Implementing Rules and Regulations provides that '[e]very employee who has rendered at least one year of service shall be entitled to a yearly service incentive leave of five days with pay.' x x x

Petitioner, who is paid on purely commission basis, is however not entitled to a 13th month pay, being among those specifically enumerated by law as not covered by PD No. 851 (the law requiring employers to pay employees 13th month pay) x x x

Prescinding from the foregoing, moral damages, exemplary damages, nominal damages and attorney's fees are due to the petitioner.

x x x Petitioner is thus awarded moral damages in the amount of P100,000.00 and exemplary damages in the amount of P50,000.00

x x x In accordance with existing jurisprudence, petitioner is awarded P30,000.00 in nominal damages.

A grant of attorney's fees in the amount of P20,000.00 is likewise proper. x x x

WHEREFORE, in view of the foregoing premises, the petition is hereby GRANTED. The Resolutions dated December 28, 2012 and March 18, 2013 issued by the National Labor Relations Commission in NLRC LAC No. 10-003028-12 and Decision dated August 24, 2012, rendered by the Regional Arbitration Branch No. 1 of the Commission in NLRC Case No. RAB-I-11-1119-11 (LC) are REVERSED AND SET ASIDE.

Accordingly, a NEW JUDGMENT is entered finding herein petitioner to have been illegally dismissed by respondent company from employment and thus is entitled to: 1) separation pay; 2) backwages; 3) retirement pay; 4) service incentive leave; 5) moral damages; 6) exemplary damages; 7) nominal damages; and 8) attorney's fees.

Let this case be remanded to the NLRC for computation of the exact amounts due to the petitioner consistent with the findings made in this Decision.

SO ORDERED.[18] (Citations omitted)

Petitioner filed a motion for reconsideration, but the CA denied the same through its September 17, 2014 Resolution. Hence, the instant Petition.

In an April 18, 2016 Resolution,[19] the Court resolved to give due course to the Petition.

Issue

Petitioner argues in this Petition that —

1. THE COURT OF APPEALS ERRED AND GRAVELY ABUSED ITS DISCRETION IN NOT DISMISSING OUTRIGHT THE PETITION FOR CERTIORARI FOR HAVING BEEN FILED X X X BEYOND THE 60-DAY REGLEMENTARY PERIOD. X X X

3. THE COURT OF APPEALS ERRED AND GRAVELY ABUSED ITS DISCRETION IN NOT DISMISSING OUTRIGHT THE PETITION FOR CERTIORARI ON THE GROUND THAT THE DOCKET FEES WERE NOT PAID BY PRIVATE RESPONDENT AT THE TIME HE FILED THE PETITION OR WITHIN HIS REQUESTED PERIOD OF EXTENSION X X X

4. THE COURT OF APPEALS ERRED AND GRAVELY ABUSED ITS DISCRETION IN NOT DISMISSING OUTRIGHT THE PETITION FOR CERTIORARI OF THE PRIVATE RESPONDENT ON THE GROUND THAT HE FAILED TO INDICATE THEREIN THE OTHER TWO (2) MATERIAL DATES, NAMELY: THE DATE OF HIS RECEIPT OF THE RESOLUTION DATED 28 DECEMBER 2012 OF RESPONDENT COMMISSION MODIFYING THE DECISION DATED 24 AUGUST 2012 OF EXECUTIVE LABOR ARBITER, AND THE DATE WHEN HE FILED HIS MOTION FOR RECONSIDERATION THERETO. X X X

5. THE COURT OF APPEALS ERRED AND GRAVELY ABUSED ITS DISCRETION IN CONCLUDING THAT PRIVATE RESPONDENT WAS CONSTRUCTIVELY OR ILLEGALLY DISMISSED OR PETITIONER X X X

6. THE COURT OF APPEALS ERRED AND GRAVELY ABUSED ITS DISCRETION IN CONCLUDING THAT PRIVATE RESPONDENT IS ENTITLED TO SEPARATION PAY, BACKWAGES, RETIREMENT PAY, SERVICE INCENTIVE LEAVE PAY, MORAL DAMAGES, EXEMPLARY DAMAGES, NOMINAL DAMAGES AND ATTORNEY'S FEES.[20]

Petitioner's Arguments

Petitioner argues that the CA erred in entertaining respondent's Petition for Certiorari as it was belatedly filed and defective in form; that the CA erred in failing to appreciate that respondent was not illegally dismissed, but that he voluntarily resigned and abandoned his employment when he left to work for his family's trucking business; that respondent knowingly timed the filing of the instant labor case in such a way as to recover retirement and other benefits; and that since there was no illegal dismissal, respondent was thus not entitled to his money claims, including retirement pay and damages, as there was no bad faith on petitioner's part.

Respondent's Argument

Respondent argues that the Petition should be denied for lack of merit; that the CA's dispositions are correct and must be upheld; that there were no procedural lapses in the filing of the CA Petition for Certiorari; that petitioner itself was guilty of procedural lapses in the filing of the instant Petition; that the CA was correct in finding that he was illegally dismissed from employment; and that the CA did not err in awarding his money claims.

Our Ruling

Respondent claims that he continued to follow up on his employment status for six months. Petitioner counters that he could not have done the follow ups because members of its top management never met with him; even the bus dispatchers, who were not part of the bus company's management, denied meeting with respondent; they declared in a joint affidavit submitted to the labor tribunals that respondent never approached them at any time during the said period that respondent claimed he continued following up on his work status.

Indeed, respondent did not specify to whom his follow-ups were directed; if they were upon management, he would have said so, and the bus company management would have had no reason to deny this claim. However, the only follow-up he particularly referred to was one directed to a bus dispatcher, a certain Roger Pasion, who even denied the claim in an affidavit.[21]

For its part, petitioner claims that respondent simply stopped reporting for work; that he left his post as bus driver to work for his family's trucking business; and that he was seen driving the family truck on public roads and highways. This was not denied by the respondent. Petitioner further contends that what respondent did was typical of its bus drivers; they simply stop reporting for work for short periods of time, even years, only to re-appear looking to work for the company once again. Petitioner states that this is allowed in order to give its drivers the needed break from boredom typically encountered from driving on long trips on familiar, boring routes, a sort of therapy and sabbatical, a time to refresh oneself from monotonous work that benefits the driver, passengers, and the bus company itself; that this practice also affords its drivers the opportunity to find more lucrative employment or greener pastures elsewhere without foreclosing the possibility of returning to work for the company in the future.

The Court is inclined to believe petitioner's allegations: respondent left his work as bus driver to work for his family's trucking business. There is no truth to the allegation that respondent was dismissed, actually or constructively. He claims that the dispatcher informed him that he was AWOL; however, a mere bus dispatcher does not possess the power to fire him from work – this is a prerogative belonging to management. Respondent did not show that he met with management to inquire on his status. On the other hand, it appears that the Assistant Manager, Corporate Secretary, and Director of the bus company, Elias Dimaya, resided with his family within the bus company's station and compound in San Nicolas, Ilocos Norte. Having worked for the bus company for 18 years, respondent should have known this fact, and he could have visited with Elias Dimaya at anytime, if his employment was so important that it meant his own survival and that of his family. Apparently, however, it would appear that this was not the case, for the simple reason that respondent had found employment elsewhere.

Thus, respondent's failure to show that his follow-ups were properly directed at management bolsters petitioner's claim that no follow-ups were made by him. The logical explanation for this is that he found employment elsewhere and thus opted to stop reporting for work, as was the practice of other bus drivers working for petitioner.

At any rate, even assuming that respondent was indeed told by respondent's bus dispatcher Roger Pasion that he was AWOL, this was not tantamount to dismissal, actual or constructive. An ordinary bus dispatcher has no power to dismiss an employee; in a typical bus company, a driver might even be of more significance than an ordinary dispatcher. Bus drivers are a more valuable resource than a dispatcher; without the former, the latter is useless. Without a driver, there could be no bus to dispatch or trip to schedule. It cannot therefore be said that an ordinary dispatcher is superior to a bus driver; at most, they are equal in rank.

The fact that respondent made no sincere effort to meet with the management of the bus company gives credence to petitioner's allegation that he was never fired from work.

However, it cannot be said that respondent abandoned his employment. Petitioner itself admitted that it sanctioned the practice of allowing its drivers to take breaks from work in order to afford them the opportunity to recover from the stresses of driving the same long and monotonous bus routes by accepting jobs elsewhere, as some form of sabbatical or vacation, without losing productivity and in come and to safeguard the interests of the company and its patrons, as well as to avoid fatal accidents were the drivers to be suffered to work under continuous stressful conditions occasioned by driving on the same monotonous routes day in and day out.

Simply put, respondent availed of petitioner's company practice and unwritten policy – of allowing its bus drivers to take needed breaks or sabbaticals to enable them to recover from the monotony of driving the same route for long periods – and obtained work elsewhere. It appears that what matters to respondent is that when he did this, he was already approaching retirement age – he was 58 years old in April, 2009, when he took a break from being a bus driver – and when he filed the labor case in November, 2011, he was already 60. He was born May 20, 1951.[22] By that time, he had served petitioner for 18 years, or from April 1991 up to March 31, 2009. Respondent may have thought that for serving the bus company for a significant period, he should be rewarded for his loyalty.

Thus, since respondent was not dismissed from work, petitioner may not be held liable for his (respondent's) monetary claims, except those that were actually owing to him by way of unpaid salary/commission, and retirement benefits, which are due to him for the reason that he reached the age of retirement while under petitioner's employ. As to unpaid salaries/commissions, it appears from the record that petitioner failed to pay respondent three months' worth, that is, for the period January to March, 2009 – which, at P10,000.00 per month – amounts to P30,000.00. Indeed, this could be one of the reasons why respondent stopped reporting after March 31, 2009, as he complained of petitioner's failure to pay his salaries/commissions for the said period.

As for retirement benefits, respondent is entitled to them considering that he was never dismissed from work, either for cause or by resignation or abandonment. As far as petitioner is concerned, he merely went on a company-sanctioned sabbatical. It just so happened that during this sabbatical, he reached the retirement age of 60; by this time, he is already 67 years old. By filing the labor case, he may have pre-empted the payment of his retirement benefits; but it is a clear demand for retirement benefits nonetheless. Understandably, respondent may have already expected that he would not be paid retirement benefits since he stopped reporting for work in 2009 when he took his sabbatical; for him, such move might have been construed as a resignation or abandonment by his employer, the petitioner, and rightly so – for this is precisely petitioner's defense in this case.

Under Article 287 of the Labor Code,

Art. 287. Retirement. - Any employee may be retired upon reaching the retirement age established in the collective bargaining agreement or other applicable employment contract.

In case of retirement, the employee shall be entitled to receive such retirement benefits as he may have earned under existing laws and any collective bargaining agreement and other agreements: Provided, however, That an employee's retirement benefits under any collective bargaining and other agreements shall not be less than those provided herein.

In the absence of a retirement plan or agreement providing for retirement benefits of employees in the establishment, an employee upon reaching the age of sixty (60) years or more, but not beyond sixty-five (65) years which is hereby declared the compulsory retirement age, who has served at least five (5) years in the said establishment, may retire and shall be entitled to retirement pay equivalent to at least one-half (1/2) month salary for every year of service, a fraction of at least six (6) months being considered as one whole year.

Unless the parties provide for broader inclusions, the term one-half (1/2) month salary shall mean fifteen (15) days plus one-twelfth (1/12) of the 13th month pay and the cash equivalent of not more than five (5) days of service incentive leaves.

Retail, service and agricultural establishments or operations employing not more than (10) employees or workers are exempted from the coverage of this provision.

Violation of this provision is hereby declared unlawful and subject to the penal provisions provided under Article 288 of this Code.

In the absence of a retirement plan or agreement in Maria De Leon Transportation, Inc., the Court hereby declares that respondent is entitled to one month's salary for every year of service, that is:

P10,000.00 x 18 years = P180,000.00

Retirement compensation equivalent to one month's salary for every year of service is more equitable and just than the CA's pronouncement of one-half month's salary per year of service, which the Court finds insufficient. This is considering that petitioner has been paying its drivers commission equivalent to less than the minimum wage for the latter's work, and in respondent's case, it has delayed payment of the latter's compensation for three months. On the other hand, petitioner's lax policies regarding the coming and going of its drivers, as well as the fact that respondent's layovers are considerable – it appears that throughout his employment, respondent spends a good number of days each month not driving for petitioner, which thus allows him to accept other work outside – makes up for deficiencies in the parties' compensation arrangement.

Petitioner's argument that respondent's CA Petition for Certiorari should have been dismissed outright for being tardy and for being procedurally defective deserves no consideration. As has been shown above, respondent is entitled to part of his monetary claims; the NLRC judgment failed to appreciate that respondent remained an employee of petitioner. As against petitioner's claim of procedural infirmities, the Court must uphold and protect respondent's substantive rights. Procedure cannot prevail over substantive rights in this case.

Indeed, where as here, there is a strong showing that grave miscarriage of justice would result from the strict application of the [r]ules, we will not hesitate to relax the same in the interest of substantial justice. It bears stressing that the rules of procedure are merely tools designed to facilitate the attainment of justice. They were conceived and promulgated to effectively aid the court in the dispensation of justice. Courts are not slaves to or robots of technical rules, shorn of judicial discretion. In rendering justice, courts have always been, as they ought to be, conscientiously guided by the norm that on the balance, technicalities take a backseat against substantive rights, and not the other way around. Thus, if the application of the Rules would tend to frustrate rather than promote justice, it is always within our power to suspend the rules, or except a particular case from its operation.[23]

On the other hand, the CA Decision is unwarranted on account of its declaration that respondent was illegally dismissed from work, which is not the case. As a result, it awarded other claims that respondent was not entitled to.

As for attorney's fees, the Court finds that respondent is entitled thereto. Under paragraphs 7 and 11, respectively, of Article 2208 of the Civil Code, attorney's fees and expenses of litigation, other than judicial costs, may be recovered "in actions for the recovery of wages of household helpers, laborers and skilled workers" and "in any other case where the court deems it just and equitable that attorney's fees and expenses of litigation should be recovered." The CA award of P20,000.00 is thus reasonable and just under the circumstances.

Having resolved the case in the foregoing manner, the Court finds no need to address the other issues raised by the parties. They have become unnecessary and superfluous; their resolution contributes nothing to the essence of the Court's disposition.

WHEREFORE, the March 17, 2014 Decision and September 17, 2014 Resolution of the Court of Appeals in CA-G.R. SP No. 130387 are REVERSED and SET ASIDE, and in lieu thereof, judgment is hereby rendered AWARDING respondent Daniel M. Macuray the following amounts:

1. P30,000.00 as unpaid salaries/commissions for the period January to March, 2009;

2. P180,000.00 as retirement pay;

3. P20,000.00 as and by way of attorney's fees; and

4. Interest of 12% per annum on the total monetary awards, computed from the filing of the Complaint up to June 30, 2013, and thereafter 6% per annum from July 1, 2013 until their full satisfaction.

EXTRA EXCEL INTERNATIONAL PHILIPPINES v. AFABLE E. CAJIGAL +
DECISION

DEL CASTILLO, J.:

This is an administrative complaint[1] for gross ignorance of the law, gross inefficiency, grave abuse of authority, and evident partiality filed by complainant Extra Excel International Philippines, Inc., through its representative Atty. Rommel V. Oliva (Atty. Oliva), against respondent Judge Afable E. Cajigal, relative to Criminal Case No. R-QZN-13-00488-CR (People of the Philippines v. Ike R. Katipunan).

Complainant narrated that an Information[2] for qualified theft was filed against Ike R. Katipunan, complainant's former Inventory Control Service Assistant. The case was raffled to Branch 96 of the Regional Trial Court of Quezon City with respondent as Presiding Judge. Complainant alleged that, after the filing of the Information, respondent Judge did not set the case for arraignment nor issue a warrant of arrest; instead, he granted the accused's Motion for Preliminary Investigation and Motion to Defer Further Proceedings. Incidentally, in its May 30, 2014 Decision[3] in CA-G.R SP No. 132989, the Court of Appeals found grave abuse of discretion on the part of respondent Judge in granting the accused's motion for preliminary investigation.

Meanwhile, there being no resolution on the preliminary investigation despite the lapse of the 60-day period, and pursuant to A.M. No. 11-6-10-SC which mandates the accused's arraignment upon the lapse of the 60-day period, complainant filed a Motion to Set Case for Arraignment. Upon comment of the accused, respondent Judge ordered the City Prosecution Office of Quezon City to conclude the on-going re-investigation. Thereafter, the City Prosecution Office resolved to affirm the earlier finding of probable cause.

On March 24, 2014, complainant filed a Motion for Issuance of Hold Departure Order, which motion remains unresolved. Meanwhile, the accused filed on March 28, 2014 an Omnibus Motion for Judicial Determination of Probable Cause, Recall of Warrant of Arrest, and Deferment of Proceedings, thereby prompting complainant to file a Comment/Opposition and a Motion for Inhibition.

Respondent Judge eventually arraigned the accused on June 9, 2014. However, instead of ordering the accused's commitment, and despite the offense being nonbailable, respondent Judge allowed the accused to go home. On June 13, 2014, the accused filed a Petition for Bail. During the bail heating on June 24, 2014, respondent Judge found the filing thereof premature and issued a warrant of arrest against the accused. However, instead of committing the accused at the Quezon City Jail, he was instead detained at the Criminal Investigation and Detention Unit of Central Police District, Camp Karingal, Quezon City. Thereafter, respondent Judge scheduled the bail hearing on June 30, 2014 despite manifestation by complainant's counsel of his unavailability on said date.

During the June 30, 2014 bail hearing, respondent Judge declared the Petition for Bail submitted for resolution due to the absence complainant's counsel. On even date, respondent Judge issued an Order granting the bail petition and denying the motion for inhibition.

Finally, complainant claimed that respondent Judge attempted to fast-track the proceedings in the criminal case by re-scheduling the redirect examination of the prosecution's witness from February 17, 2015, as earlier agreed by the parties, to December 17, 18 and 22, 2014, in view of his impending retirement on December 29, 2014.

According to the complainant, the foregoing events clearly showed respondent Judge's gross inefficiency, incompetence, gross ignorance of the law, grave abuse of authority and evident partiality. Complainant argued that respondent Judge was guilty (1) of undue delay in resolving motions when he failed to resolve the motion for issuance of hold departure order within 90-days or despite lapse of nine months; (2) of gross ignorance of the law when he granted the accused's motion for preliminary investigation in violation of A.M. No. 11-6-10-SC since the accused was not a subject of a warrantless arrest or inquest proceedings; (3) of grave abuse of authority when he allowed the accused to go home after his arraignment for a nonbailable offense; (4) of gross ignorance of the law and evident partiality in granting the petition for bail despite complainant's pending motion for reconsideration and/or motion to set the hearing to another date; and, (5) of evident partiality when he failed to inhibit himself from further handling the case in view of his bias towards the accused.

In his Comment,[4] respondent Judge countered that he should not be sanctioned for acts done in the performance of his functions as a judge. He claimed that the allegations against him are unfounded, malicious, and intended solely to harass and embarrass him, and to cause undue delay in the release of his retirement benefits. In particular, he adverted to A.M. No. 03-10-01-SC,[5] which bars the filing of an administrative complaint "within six months before the compulsory retirement of a Justice or Judge."[6] According to respondent Judge, the administrative complaint was filed barely a week before his compulsory retirement on December 29, 2014.[7]

Respondent Judge justified his failure to resolve the motion for issuance of hold departure order on the fact that the accused had already filed an omnibus motion for the judicial determination of probable cause, recall of warrant of arrest and deferment of proceedings. According to respondent Judge, he set for hearing the motion for issuance of hold departure order alongside the accused's omnibus motion in order to accord both the prosecution and the defense ample opportunity to exercise their right to due process.[8]

As regards his alleged failure to order the commitment of the accused after his arraignment and allowing him instead to go home, respondent Judge explained that there was yet no warrant issued for the arrest of the accused; moreover, a petition for bail had been filed; hence, there was no reason to detain the accused.

With respect to the order granting bail to the accused, respondent Judge claimed that the same was not at all objected to by the public prosecutor during trial.[9]

As to the Order setting the re-direct examination of the prosecution witness to a date earlier than previously scheduled, respondent Judge claimed that he did so with the end in view of enabling the prosecution to finish the presentation of its evidence prior to his impending retirement; and that said Order was in line with the Constitutional right of the accused to a speedy trial.[10]

Finally, respondent Judge posited that Atty. Oliva had no personality to file this administrative complaint considering that it was Atty. Elmar Malapitan (Atty. Malapitan) who represented the complainant in the qualified theft case.

In sum, respondent prayed for the dismissal of the complaint.

Report and Recommendation of the Office of the Court Administrator (OCA)

In a Report[11] dated September 18, 2015, the OCA made the following evaluation:

On the charge of gross inefficiency, records show that there [was] delay in resolving the motion for issuance of the hold departure order. The motion was filed on 24 March 2014, however, respondent Judge had yet to resolve it. He rationalized his inaction by stating that, in his opinion, there was no need to issue a hold departure order since accused had filed an omnibus motion on 28 March 2014 and both motions were set for hearing to give the parties a chance to comment. The rules and jurisprudence are clear on the matter of delay. Failure to resolve cases and other matters within the reglementary period constitutes gross inefficiency and warrants the imposition of administrative sanction against the erring magistrate. x x x

On the charge that respondent Judge committed gross ignorance of the law when he granted the motion for preliminary investigation x x x, the records are bereft of evidence to show that respondent Judge, assuming that he erred, was motivated by bad faith, fraud, corruption, dishonesty in granting the motion. To constitute gross ignorance of the law, it is not enough that the decision, order or actuation of the judge in the performance of his official duties is contrary to existing law and jurisprudence. It must be established that he was moved by bad faith, fraud, dishonesty or corruption or had committed an error so egregious that it amounted to bad faith. Moreover, complainant already availed of a judicial remedy when it filed a Petition for Certiorari before the Court of Appeals x x x seeking to annul and set aside the resolution directing the Office of the City Prosecutor to conduct a preliminary investigation, which the Court of Appeals favorably acted upon. While the assailed Resolution was set aside, this is not enough to render respondent Judge liable for gross ignorance [of the law]. Jurisprudence is replete with pronouncements that not every error or mistake of a judge in the performance of his official duties renders him liable. As a matter of policy, in the absence of fraud, dishonesty or corruption, the acts of a judge in his judicial capacity are not subject to disciplinary action even though such acts are erroneous.

On the charge of grave abuse of authority for allowing accused Katipunan to go home after his arraignment instead of committing him directly to the City Jail, the same has no merit. Respondent Judge merely exercised his sound discretion in not immediately issuing the warrant of arrest and in suspending further proceedings pending reinvestigation of the case. x x x It is not obligatory, but merely discretionary, upon the investigating judge to issue a warrant for the arrest of the accused, even after having personally examined the complainant and his witnesses in the form of searching questions and answers, for the determination of whether a probable cause exists and whether it is necessary to arrest the accused in order not to frustrate the ends of justice, is left to his sound judgment or discretion.

On the charge of gross ignorance of the law and evident partiality for granting the petition for bail without conducting a hearing to prove whether the evidence of guilt is strong or not, which will form the basis for granting or denying the petition for bail, we agree with complainant. x x x In this case, when respondent Judge set the hearing for bail on 30 June 2014, the private prosecutor manifested his unavailability on the said date, but this notwithstanding, respondent Judge pushed through with the hearing. Immediately, complainant, through lawyer, filed an urgent motion for reconsideration explaining his absence during the 30 June 2014 hearing. Nonetheless, respondent Judge granted the petition for bail for failure of the private prosecutor and the witnesses to appear and in the absence of any objection from the public prosecutor. The law and settled jurisprudence demand that a hearing be conducted before bail could be fixed for the temporary release of the accused, if bail is at all justified. x x x The absence of any objection from the prosecution in such cases is not a basis for the grant of bail for the judge has no right to presume that the prosecutor knows what he is doing on account of the familiarity with the case. Said reasoning is tantamount to ceding to the prosecutor the duty of exercising judicial discretion to determine whether the guilt of the accused is strong. Judicial discretion is the domain of the judge before whom the petition for provisional liberty will be decided. The mandated duty to exercise discretion has never been reposed upon the prosecutor. There is gross ignorance because the need for hearing before bail is fixed/granted is so basic that respondent Judge ought to know that. So in this instance, good/bad faith is of no moment, unlike in the other instance of gross ignorance exhibited by respondent Judge when he granted the motion for preliminary investigation.

On the charge of evident partiality when respondent Judge failed to inhibit himself, the issue pertains to the second paragraph of Rule 137, Section 1 of the Rules of Court regarding voluntary inhibition of a judge, which states that 'a judge may, in the exercise of his sound discretion, disqualify himself from sitting in a case, for just or valid reasons other than those mentioned above.' Based on this provision, judges have been given the exclusive prerogative to recuse themselves from heating cases for reasons other than those pertaining to their pecuniary interest, relation, previous connection, or previous rulings or decisions. The issue of voluntary inhibition in this instance becomes primarily a matter of conscience and sound discretion on the part of the judge.

On the charge of evident partiality when respondent Judge issued an order setting the case for special sessions, the same cannot stand in the absence of substantial evidence to support the same. In administrative proceedings, the complainant has the burden of proving by substantial evidence the allegations in his complaint. In the absence of evidence to the contrary, the presumption that the respondent has regularly performed his duties will prevail.

In sum, we hold that respondent Judge is administratively liable for inefficiency on account of his delay in resolving the motion for the issuance of the hold departure order. Under A.M. No. 01-8-10-SC, undue delay in rendering a decision is classified as a less serious charge punishable either by: (a) suspension from office without salary and other benefits for not less than one (1) nor more than three (3) months; or (b) a fine of more than Php10,000.00 but not exceeding Php20,000.00.

Respondent Judge is also liable for gross ignorance of the law for granting the petition for bail without the benefit of a hearing. Under A.M. No. 01-8-10-SC, gross ignorance of the law or procedure is classified as a serious charge and should be penalized by (a) dismissal from the service, forfeiture of all or part of the benefits as the Court may determine, and disqualification from reinstatement or appointment to any public office, including government-owned or controlled corporations. Provided, however, that the forfeiture of benefits shall in no case include accrued leave credits; (b) suspension from office without salary and other benefits for more than three [(3)] but not exceeding six (6) months; or (3) a fine of more than Php20,000.00 but not exceeding Php40,000.00.[12]

Pursuant to Section 50,[13] Rule IV of the Revised Uniform Rules on Administrative Cases in the Civil Service, which directs the imposition of the penalty corresponding to the most serious charge in the event the respondent is found guilty of two (2) or more charges or counts, and in view of respondent Judge's retirement on December 29, 2014, the OCA recommended that respondent Judge be meted the penalty of fine in the amount of P40,000.00, for inefficiency on account of delay in resolving the motion for issuance of a hold departure order and gross ignorance of the law in granting the petition for bail without the benefit of a hearing, which amount shall be deducted from his retirement benefits.

Issue

Is respondent Judge guilty of gross ignorance of the law, gross inefficiency, grave abuse of authority, and evident partiality?

Ruling

We substantially adopt the findings and recommendations of the OCA, with the exception of its finding that respondent Judge acted properly in allowing the accused to go home after arraignment without bail.

We agree with the OCA that respondent Judge's act of granting the accused's Motion for Preliminary Investigation[14]  did not constitute gross ignorance of the law.

While the Order granting the Motion for Preliminary Investigation may not be proper inasmuch as respondent Judge based the Order on accused's bare allegation of non-receipt of notice from the Office of the Prosecutor,[15] we opine that the same did not necessarily amount to gross ignorance of the law. There was no showing that respondent Judge issued the Order because of the promptings of fraud, dishonesty, corruption, malice, ill-will, bad faith or a deliberate intent to do injustice. Indeed, it is axiomatic that not all erroneous acts of judges are subject to disciplinary action. As this Court stressed in Office of the Court Administrator v. Salise:[16]

Indeed, it is settled that, unless the acts were committed with fraud, dishonesty, corruption, malice or ill will, bad faith, or deliberate intent to do an  injustice, the respondent judge may not be [held] administratively liable for gross misconduct, ignorance of the law, or incompetence of official acts in the exercise of judicial functions and duties, particularly in the adjudication of cases. x x x

In Sibulo v. Judge Toledo-Mupas,[17] this Court further explained:

Moreover, the fact that a judge failed to recognize a 'basic' or 'elementary' law or rule of procedure would not automatically warrant a conclusion that he is liable for gross ignorance. What is significant is whether the subject order, decision[,] or actuation of the judge unreasonably defeated the very purpose of the law or rule under consideration and unfairly prejudiced the cause of the litigants. x x x[18]

However, we do not concur with the evaluation of the OCA that respondent Judge did not err in allowing the accused to go home after his arraignment. We are neither persuaded by respondent Judge's claim that there was no reason for him to detain the accused since there was yet no warrant issued for his arrest or that a petition for bail had been filed. Basic is the principle that upon setting a case for arraignment, the accused must have either been in the custody of the law[19] or out on bail. Another basic principle is that the judge must conduct his own personal evaluation of the facts and circumstances which gave rise to the indictment, pursuant to Section 5, Rule 112 of the Rules of Court and Section 2, Article III of the 1987 Constitution.

Indeed, in the present case, respondent Judge should not have waited for the accused to file an omnibus motion for a judicial determination of probable cause. As this Court held in Leviste v. Hon. Alameda,[20] "[t]o move the court to conduct a judicial determination of probable cause is a mere superfluity, for with or without such motion, the judge is duty-bound to personally evaluate the resolution of the public prosecutor and the supporting evidence."[21] Thus, the failure of respondent Judge to comply with this fundamental precept constituted gross ignorance of the law and procedure. His failure to heed this precept resulted in the said accused's arraignment, without the accused in custody of the law.

Likewise in point is this Court's teaching in Guillen v. Judge Nicolas,[22] where it was stressed that:

y setting the cases for arraignment and trial, respondent judge must have found probable cause to hold the accused for trial. [The judge] should have proceeded to examine in writing and under oath the complainants and [the] witnesses by searching questions and answers. The records do not show that the [judge] set the case for, or conducted, such examination preparatory to issuing a warrant of arrest. Neither [was] there any subpoena or order requiring the complainants or [the] witnesses to appear in court for such examination. The inevitable conclusion is that the respondent judge skipped this procedure.[23]

Needless to say, the failure of respondent Judge to conduct a judicial determination of probable cause under Section 5, Rule 112 of the Rules of Court was exacerbated by his act in allowing the accused to go home (without bail) after arraignment. These acts were indicative of gross ignorance of the law and procedure for which respondent must be called to account.

In addition, respondent Judge's failure to conduct a hearing on accused's Petition for Bail[24] constitutes gross ignorance of the law. It is axiomatic that a bail hearing is a must, despite the prosecution's lack of objection to the same. In Balanay v. Judge White,[25] we said:

It is basic, however, that bail hearing is necessary even if the prosecution does not interpose any objection or leaves the application for bail to the sound discretion of the court. Thus, in Villanueva v. Judge Buaya, therein respondent judge was held administratively liable for gross ignorance of the law for granting an ex parte motion for bail without conducting a hearing. Stressing the necessity of bail hearing, this Court pronounced that:

The Court has always stressed the indispensable nature of a bail hearing in petitions for bail. Where bail is a matter of discretion, the grant or the denial of bail hinges on the issue of whether or not the evidence on the guilt of the accused is strong and the determination of whether or not the evidence is strong is a matter of judicial discretion which remains with the judge. In order for the judge to properly exercise this discretion, [the judge] must first conduct a hearing to determine whether the evidence of guilt is strong. This discretion lies not in the determination of whether or not a hearing should be held, but in the appreciation and evaluation of the weight of the prosecution's evidence of guilt against the accused.

In any event, whether bail is a matter of right or discretion, a hearing for a petition for bail is required in order for the court to consider the guidelines set forth in Section 9, Rule 114 of the Rules of Court in fixing the amount of bail. This Court has repeatedly held in past cases that even if the prosecution fails to adduce evidence in opposition to an application for bail of an accused, the court may still require the prosecution to answer questions in order to ascertain, not only the strength of the State's evidence, but also the adequacy of the amount of bail.[26]

Hence, it is altogether of no consequence that the Order granting bail "was made in the presence of the public prosecutor, and the latter made no objection or comment to the oral manifestation of the defense counsel."[27]

We agree with the OCA's finding that respondent Judge was inefficient in failing to resolve the motion for issuance of a hold departure order despite the lapse of 90 days. We find his contention, that "there is no need to issue an HDO order [sic] because a Hold Departure Order (HDO) is based on sound judgment and judicial discretion of a Judge,"[28] unmeritorious. While it is true that the law gives respondent Judge considerable discretion whether to issue or not to issue a hold departure order, this grant of considerable discretion in no wise or manner means that respondent Judge need not resolve at all the pending motion.

Respondent Judge ought to know the difference between a judge's discretionary power to issue a hold departure order and his mandatory duty to resolve all kinds of motions within 90 days. Section 15, Article VIII of the Constitution mandates that all cases and matters must be decided or resolved by the lower courts within three (3) months or ninety (90) days from date of submission. In addition, Section 5, Canon 6 of the New Code of Conduct for the Philippine Judiciary directs judges to "perform all judicial duties, including the delivery of reserved decisions, efficiently, fairly and with reasonable promptness." Suppletorily, Rule 3.05, Canon 3 of the Code of Judicial Conduct likewise mandates:

Rule 3.05. – A judge shall dispose of the Court's business promptly and decide cases within the required periods.

This Court has explained in Biggel v. Judge Pamintuan[29] the reasons for requiring speedy disposition not only of all cases but also all motions, viz.:

Undue delay in the disposition of cases and motions erodes the faith and confidence of the people in the judiciary and unnecessarily blemishes its stature. No less than the Constitution mandates that lower courts must dispose of their cases promptly and decide them within three months from the filing of the last pleading, brief[,] or memorandum required by the Rules of Court or by the Court concerned. In addition, a judge's delay in resolving, within the prescribed period, pending motions and incidents constitutes a violation of Rule 3.05 of the Code of Judicial Conduct requiring judges to dispose of court business promptly.

There should be no more doubt that undue in action on judicial concerns is not just undesirable but more so detestable especially now when our all-out effort is directed towards minimizing, if not totally eradicating[,] the perennial problem of congestion and delay long plaguing our courts. The requirement that cases be decided within the reglementary period is designed to prevent delay in the administration of justice, for obviously, justice delayed is justice denied. An unwarranted [slowdown] in the disposition of cases erodes the faith and confidence of our people in the judiciary, lowers its standards[,] and brings it into disrepute.

Thus, respondent's failure to resolve complainant's motion to issue a hold departure order constitutes gross inefficiency which warrants the imposition of an administrative sanction.[30]

While this Court finds respondent Judge administratively liable for gross ignorance of the law and procedure and for gross inefficiency, we are not at all prepared to conclude that respondent Judge's denial of complainant's motion for inhibition and rescheduling the redirect examination of the prosecution's witness to an earlier date amounted to bias and partiality.

In Luciano v. Hon. Mariano,[31] this Court ruled:

To allege partiality, bias[,] and discrimination or over zealousness in siding with the guilty as against the innocent is one thing, but to show basis for the same is quite another. x x x The mere fact that a judge has erroneously ruled against the same litigant on two or three occasions does not create in our minds a decisive pattern of malice on the part of the judge against that particular litigant. This is not an unusual occurrence in our courts, and unless something in addition is alleged and proved, this Court is not inclined to disregard the presumption of good faith in favor of the actuations of courts. x x x[32]

Here, respondent Judge did not act improperly at all in denying complainant's motion for inhibition. "[T]he issue of whether a judge should voluntarily inhibit [one's self] is addressed to [one's] sound discretion pursuant to paragraph 2 of Section 1 of Rule 137, which provides for the rule on voluntary inhibition x x x."[33]

Complainant's motion for inhibition was based on (1) respondent's failure to resolve the motion to issue a hold departure order; (2) the grant of a preliminary investigation and in view of the appellate court's finding of grave abuse of discretion; (3) allowing the accused to go home after arraignment; and (4) granting bail without the conduct of a bail hearing.[34] While three of the four grounds stated therein are grounds for respondent Judge's administrative liability, these do not necessarily equate to bias or partiality. Respondent Judge's reasons behind his actuations seem to be more a manifestation of respondent's errors in judgment rather than "bias which excites a disposition to see and report matters as they are wished for rather than as they are."[35]

Neither is respondent's Order[36] dated December 15, 2014, setting the case for earlier dates than previously agreed indicative of bias and partiality. In light of respondent Judge's claim that he issued the said order to promote a speedy trial, i.e., that the prosecution be allowed at least to complete the presentation of its evidence prior to his retirement, so that his successor need only continue hearing the defense's evidence, this Court finds complainant's accusation in this respect quite untenable and respondent's stance more in keeping with the accused's right to speedy trial under Section 16,[37] Article III of the 1987 Constitution.

Finally, there is no merit in the contention of respondent Judge that Atty. Oliva lacks personality to file this administrative complaint because he was not the counsel of record of complainant in the criminal case for qualified theft. First, we are not aware of any rule that one must be a counsel of record in another case before an administrative complaint can be filed or prosecuted. Second, contrary to the assertion of respondent Judge, Atty. Oliva was one of the counsels of record of the complainant in the qualified theft case. An examination of the records reveals that complainant was being represented by Oliva Firme and Associates Law Firm, with Atty. Malapitan as the handling lawyer.

In sum, we find respondent Judge guilty of gross ignorance of the law and procedure in failing to make a judicial determination of probable cause and in failing to conduct a hearing on the accused's application for bail in Criminal Case No. R-QZN-13-00488-CR, and gross inefficiency in failing to resolve complainant's motion for issuance of a hold departure order.

Incidentally, this is not the first time respondent Judge is being administratively sanctioned. In Dulalia v. Judge Cajigal,[38] this Court had already admonished respondent Judge for his undue delay in resolving motions.

By and large, however, we take a holistic approach in the present case and we accord compassion and charity towards respondent Judge who appeared to have spent the best years of his professional life in the Judiciary. More than that, considering respondent Judge's retirement from the service on December 29, 2014, this Court believes that the imposition of a fine in the amount of P20,000.00 is appropriate and fair.

WHEREFORE, respondent Judge Afable E. Cajigal is found GUILTY of gross ignorance of the law and procedure and gross inefficiency and is hereby ordered to pay a FINE of P20,000.00 to be deducted from his retirement benefits.

SO ORDERED.

Leonardo-De Castro,* (Acting Chairperson),  Jardeleza, and Gesmundo,*** JJ., concur.
Tijam, J., on official leave.
