IT'S BEEN THREE YEARS

Every now and then we look back at our lives and see how things were and examine how things are at present. Three years ago I was one of those who reached port. As things turn out, I will still be on shore for a while.

My fervent congratulations and safe journey to all those who made it on board.

DECEMBER 27, 2012. 7:00 AM. Dumaguete City.

I sent off Lucille to the Dumaguete Port. She needs to attend their session of the Sangguniang Panlungsod of Tagbilaran that morning to present the Proposed Resolution celebrating the life and achievements of Representative Erico B. Aumentado, and expressing profound condolences to the bereaved family.

3:30 PM. Dumaguete City

I took the OceanJet to depart for Tagbilaran. We need to prepare and work out the details for the Congressman's return to Bohol...

DECEMBER 26, 2012. 12:35 AM. Dumaguete City.

I woke up to the telephone call of Mr. Antonieto "Boy" Pernia. He called to inform me a most shocking news. Cong. Erico B. Aumentado died at St. Lukes Hospital, Global City, Taguig earlier at 8:30 PM of December 25.

I called my uncle, Egay del Rosario, who manages the Congressional District Office of the Congressman and received confirmation and other details.

I could not return to sleep...

Same here, Sir... and how time flies when you don't count the days.

Someone said a long time ago that you may take the fish out of the sea but you can't take the sea out of the fish. We may be away from our old familiar places but we always bring a part of it wherever we go.

It has been more than a year since I posted on this thread and the Lord has been good.

Bumping into old colleagues every now and then is such a delight.
Handling Cong. Aumentado's developmental radio program keeps me linked to government.

Last Tuesday I visited my son who was in Ubay. It was the last day of the Provincial Jamboree of the Boy Scouts of Bohol. I'm sure many of us have been Boy Scouts, too, when we were younger. And wouldn't you feel a sense of pride when your son has also taken the trail you've taken before not too long ago?

I don't do yoga and too lazy to exercise. I believe stretching exercises (like yoga) are beneficial to the body. But I don't think Christians should be chanting words they don't understand especially if it involves focusing your mind on them.

We can't be sure when the investors will come. And if they do, we don't know if there will be job for everyone. More likely, not everyone can get a job from the businesses that these investors will put up. The STARS project equips the beneficiaries to be self-reliant so that with or without the investors, they can have the skills to make a living. In this project, not only are the identified beneficiaries given free training, the tools provided to them during the training are given to them so they already have the tools to start their livelihood right away.

Hi Everyone need lang ng advice here tungkol sa pagkuha ng visitor visa is it really important to an applicant to have a show money before makakuha ng visa? magkano ba dapat ang ipakita? and is it important to meet your friends in person first before visiting to the country? thanks to all hope anyone here can give me an answer at sana ay may makapag bigay ng sagot sa akin kung pewde po sana sa email ko din thank thank thank you po talaga

Sometimes they don't ask for show money. Just be prepared but don't volunteer to show your show money unless you are asked. As I see it, the visa is granted or denied based on the interviewer's assessment whether you have any reason to return to your home country or take a chance to stay in the US illegally.

(My closing remarks on June 30 2010 at the oath-taking of Bohol provincial and congressional officials)

All this time we’ve been on board this ship called the Provincial Government of Bohol. And today we have reached Port June 30â€"this allegorical harbor where local governments make call every 3 years.

Our journey had been exciting and challenging as it was fulfilling. We sailed on be it good weather or stormy nights. We cruised across calm oceans and at times we struggled through raging seas.

Our Captain steered the ship with his sharp eyes and skillful hands while we manned our stations with steadfast dedication.

Now the howling winds have quieted down and the gentle breeze brought us to shore. Let me take this time to share with you the memories once more.

I boldly say the journey with you, my dear shipmates, had been worthwhile and rewarding. I came on board at the start of the Captain’s second term. I quickly made new friends and acquaintances. I did my tasks and learned the ropes. I enjoyed how we grew professionally, strengthened our bond, deepened our understanding, widened our reach and honed our skills.

We solved problems together. Arm in arm, we faced adversities. We celebrated successes and mourned for the colleagues we lose midway.

I had the rare opportunity to occupy two coterminus positions. Starting out as Provincial Legal Officer which I held on for 5 years, the matters that were referred to me were usually issues that demand, and some “screaming”, for legal solutions. As Provincial Administrator in the last 6 months, a position that is practically running the whole day-to-day affairs of the Province, the task was much easier. Why, I simply indorse to the Provincial Legal Office the hard issues to solve. Seriously now, in that position you are confronted to make hard choices from time to time. And I die a little bit inside for those decisions that mean denying a financial claim or request, or discontinuing and even terminating an employment.

At 12:00 o’clock noon today a chapter in my career as a public servant will come to a close.

I will miss my co-workers from whom I have learned a lot and who inspired me to keep on learning. Thank you for making my workload a great deal lighter. I am honored to have worked with you as a team.

I will miss Gov. Aumentado’s late night calls and dozens of instructions in a single breath. I thank him for his trust and confidence, and for the exposures that developed my potentials.

I will miss the tough and searching questions of the media. I thank them for I learned how to keep cool under fire.

I will miss the hot black coffee given to me automatically as I sat on my desk. I thank all my staff for the comfort and for giving me an extra hand amidst the daunting tasks.

I am proud that young lawyers whom I mentored at the Provincial Legal Office are now elected or will soon be appointed to public or professional positions. May you serve to inspire excellence in all that we do.

I look back and I stand tall seeing the things we accomplished together. But my heart cannot rest because there are still some unfinished business which must be completed.

We have reached Port June 30 and this is where I get off. I am a “Tom Jone” and there are a few others like me. Our tour of duty ends together with our wise Captain who is taking back his old assignment in Congress. Now, a new Captain has taken command, Gov. Edgar M. Chatto, with his first mate, Vice Gov. Consing Lim, ably supported by our distinguished gentlemen, Cong. Relampagos, Cong. Aumentado and Cong. Yap, and the members of the Sanggunian Panlalawigan.

We have heard the inspiring words of the new leadership. The ceremony this morning completed the transition process we started just after the election. We have a smooth transfer of authority. This is a day of hopeful jubilation.

For us who have packed our bags and will be disembarking, this is not yet the end of our voyage. It’s just a stopover until we will resume, perhaps on board another ship, the next leg of the journey. To many this stopover may be brief but for some it may take a while. I’ll be going home to my family tonight and will know for the very first time what it’s like to sleep in bed with a city councilor-wife.

And to all of you who will be continuing the journey on board this ship, I wish you all God speed. May you always have fair weather so your sailing will be swift and always find safe harbor to shelter you in the storm. See you beyond the horizon.

Once again I was tasked to act as annotator for President Gloria Macapagal-Arroyo's visit to Bohol to inaugurate the just completed expansion of the Ubay Port. PGMA spent a part of her last 48 hours as President in our Province. The Presidential chopper touched down at the Ubay Port at 12:00 noon.

The unveiling ceremony of the marker started the affair followed by a welcome message of Gov. Aumentado and briefing on the project by DOTC Annelli Lontoc. The protocol is that the President only makes one speech in a day. However, PGMA took the stage and, interviewed a construction worker and a port user to explain how the project helped their lives.

Thereafter, Gov. Aumentado and former Dept. of Agriculture Arthur Yap were sworn in by the President as congressmen of the 2nd and 3rd district, respectively.

The   President had lunch on site, sheltered by tents set up for the ocassion then flew off to Cebu at 1:00 PM for 3 more activities at Talisay City, Mandaue City and Danao City. Before coming to Bohol, she also inaugurated a project in Iloilo City.  Five sites in a single day. And at Ubay I was one of those who've seen her as President for the very last time.

Governor-Elect Edgar Chatto and his transition team met the Management Executive Team (MET) of the Provincial Government of Bohol last June 22, 2010 at the Carlos P. Garcia Hall. The MET is composed of Department Heads and Chiefs of Offices of the provincial government and, in the absence of the Governor, is presided over by the Provincial Administrator.

The meeting was part of the transition management plan. Earlier, Board Member Ae Damalerio who heads the transition team ofGov-Elect Chatto met with the MET.

Atty. John Titus Vistal, Provincial Planning and Development Coordinator, who is designated as focal person of the transition, presented the overview of transition documents and highlights of major decision points for action by the incoming administration.

Chatto appreciated the efforts of the transition teams of both outgoing and incoming administrations and expressed his desire for a one-on-one session with the department heads and chiefs of offices for a deeper discussion of existing and proposed programs.

Plane tickets and boarding passes. Notes and reading materials. And there are three more boxes of assorted documents. I never got to unpack these things. And before I knew it, the time has come for me to start packing up the new things that accumulated in my current office.

Our meeting with the Governor ended at around 10:30 PM. There were two meetings, actually.  The first was with Dr. Ernesto Pernia of the University of the Philippines School of Economics (and 2009 Ten Outstanding Boholanos Around the World [TOBAW] Awardee) and his colleagues from the UNFPA to discuss Bohol's milestones on reproductive health programs and pushing ideas for "population management" and "family welfare".

The second was on the social preparation and information/education campaign for the algae-bioethanol project in Northern Bohol.

I was apprehensive when Gov said, before he boarded his car, that I should be prepared when he won't be able to get up early for the Independence Day celebration. Apparently, he also had a meeting with Philippine Ports Authority Gen. Manager Sevilla before he came for our meeting.

This morning when I arrived at Plaza Rizal at 7:30, the first thing I did was to ask if Gov was at the Cathedral. I was relieved when told that he was there and will be delivering the Independence Day Message.

It was a simple, brief but fitting program. The celebration went well.

Happy Independence Day everyone!

Asking my beloved out, then after several months, asking her if I could court her. Everything followed suit.

I don't think it was marinated. But it seemed to have a dash of sesame oil and sesame seeds. And just before putting it in your mouth, you dip it in a kind of hot sauce seasoning.

Shared during the convocation program of the Provincial Agriculturist's Office that Gov. Aumentado is positioning Bohol to be in the forefront of alternative energy production, the next big step which is also aligned to Bohol's environment agenda. Going green with bio-diesel from jatropha and bio-ethanol from algae. On bio-ethanol, there's a big potential to generate more than 25,000 jobs for Boholanos.

Gov. Aumentado's work ethic is breath-taking. When he's focused on a project, he won' let go of it until he gets results. One time I was with him on official business in Manila. We shared the same hotel room together with his close-in security. He was already awake at 3:00 AM preparing for his meetings line up for the day. I had no choice but to get up from my bed, shook off my sleepiness, and started preparing for the day early as well.

Receiving a call from the Governor even at late nights is the norm. Instructions to prepare legal briefs ordocuments to be needed in an hour or at most by early morning for the first flight to Manila is a frequent occurence.

I thank the Governor for the opportunities to be part in the preparation or negotiation of mega projects for Bohol like the Panglao Airport, tourism master plans, research laboratory and other development initiatives... and the overall professional growth.

I thank him for making a mandatory reading "The Way of the Shepherd" back in 2006. Now that I will leaving the provincial government by the end of this month, I am starting to read the book again and I am refreshed of the lessons it bring.

Our afternoon session in our term-end assessment and transition planning dealt on sharing our experiences as Department Heads under the administration of Gov. Aumentado.

In the days before I joined the Aumentado Administration, I was "working wounded" as a legal counsel of a defeated mayoralty candidate in the 2004 elections. I suffered through 3 sleepless nights at the city board of canvassers and then proceeded to the provincial board of canvassers where I was a member of the legal panel of the dominant majority party. The canvassing was hotly contested. Gov. Aumentado was running for his second term. His closest rival was former governor Rene Relampagos. 2004 was also a presidential election year and lawyers from Manila representing the late presidential candidate Fernando Poe succeeded to convince the provincial board of canvassers to suspend the canvassing on some legal issue. After arguing before the board that the canvassing should resume, the board relented and the winners were proclaimed.

My term as City Legal Officer ended on June 30, 2004. In August that year, Gov. Aumentado appointed me as Legal Officer IV. I preferred a position that is co-terminus with the appointing authority. Thus, when Atty. Tomas Abapo, Jr. was appointed as Provincial Administrator (vice Atty. Antonio Amora, Jr.), I accepted the appointment as Provincial Legal Officer.

Mr. Lagunay,

Thank you for sharing that interesting cultural aspect of the Koreans. I could not help but link it to their Confucian Culture (something that they were introduced to by way of the Chinese Confucian Scholars, thousands of years ago), this sense of filial piety in action, and obeissance to popular demand is something that is quite intrinsic to East-Asian (namely Confucian societies; ergo. China, Japan, Korea and to an extent, Vietnam..)

The notion of honor seen in the Korean politicians and campaigners should be exported to the Philippines.

Question lang, is vote buying as prolific in Korea (or does it even exist at all?) as it does in the Philippines?

Thanks, Mr. Lagunay.

Indeed Confucius was a great teacher and his influence is vast and deep.

South Korean local officials who run for reelection have to resign two months before election day. Employees and officials of the local government made it a point not the be seen together with the candidates. Our local hosts from Goheung County had to excuse themselves and apologized that they cannot accompany us when we visited Mayor Park (who resigned to run for reelection as Mayor).

More on my impressions while in Korea...

It was at the height of the election campaign for local officials when we visited South Korea. The candidates and their campaign staff are readily identifiable because they wear jackets (looks more like windbreakers) of their party color, i.e., yellow green, yellow, red, light blue. They had huge campaign posters on their headquarters, colored streamers on strategic location. And yes, they strictly adhere to common poster areas.

On the day we motored from Suncheon City to Yeosu Airport, we passed through a huge intersection in the heart of the city and there, along the side of the street, female campaign staff from the different political parties wearing their party jackets were dancing to the tune of the same music and chanting to vote for their candidates. Looks like a cheerdance simultaneous performed by different groups but without the tossing and acrobatics. I wonder if something like this can be possible in Philippine politics.

Great pictures, Mr. Lagunay. How was your stay in South Korea when you were there?

In regards to your work, I am so very happy to see the eco-friendly initiatives that are happening in Bohol Island Province. I believe that with this continued direction, Bohol Island will be a leading example for the rest of the Philippines how to conduct future environmental-economic programs. Additionally, it is also interesting to read that there is open discussion on the governmental level on the feasibility of the Bohol-Cebu Bridge.

Thank You for sharing your thoughts with us here in Tubag Bohol Dot Com.

The pictures are awesome, if I may add.

Best,
Bran Lorenzo Lucino

Lorenzo,

It was a great experience on the food culture side, and interesting insights, albeit briefly, on how they conduct their election campaign. It was election time when we got there.

It was springtime when we went to Korea. The air was still a bit chilly. So, yeah. Panuhot juD kon mag barong. Also, the Koreans usually wear western business attire. I guess most Asian countries are wearing business suits in their day-to-day affairs.

Some thoughts on our Korea trip...

Korea harvests rice only once a year because of its season. Vegetables, which they grow in greenhouses,  play a major part on their diet.

Their drinking etiquette with liquor is instructive. The younger man (or a subordinate) when drinking with an older man (or his boss) most often pours the liquor into the glass to signify that he will be sober all throughout. And when he drinks, he turns away from the older man or boss as a sign of respect.

I'm not sure if this is really their culture but I also noticed that the person who pours the drink for the others does not pour the drink into his own glass. Instead, one of his buddies will pour the drink for him.

We returned from an overnight stay at Balicasag Island. A time spent with family and friends. It was an extended celebration on Broccoli's 7th birthday and a treat for the staff in Lucille's campaign. Two days of snorkelling. Well, actually on the first day I stayed on the boat taking pictures. It was on Sunday that I dipped into the water and we snorkelled over the dive spot called "Cathedral", also within the Balicasag Island waters.

I will still be sporting this massive sunburn when I'll arrive in South Korea on Tuesday.

PROLOGUE

I will soon reach the port in a few days over a month from now. Port June 30 is where I will be disembarking from this ship on which I have been sailing for almost six years.

The journey has been exciting and challenging. Just as what sailors experienced, we went through calm seas and raging waves. Fair weather and stormy days. Our Captain steered the ship well. We stayed true as we manned our stations.

Port June 30 is where I get off. So, too, is our Captain who is taking a new assignment (actually he's going back to his old job which he labored on for nine years). A few of the crew will be getting off as well. "Tom Jones." That's what they call us. This play of words always brings a smile to our face.

I decided to share, if my time permits, some of my daily grind before reaching port... the things I'm doing in the few remaining days as Provincial Administrator of Bohol.

To many of us, Port June 30 is not the destination. It's just a next stop as we gear up for the next leg of the journey.

The signatures which appeared on the revocation of his CONA were those of the new Party Sec-Gen, Manglapus, and Deputy Sec-Gen, Roquero. There was no signature of the new Party President.

There is no expulsion from the Lakas-Kampi-CMD Party. Only a revocation of the CONA. Gov. Aumentado has elevated the matter to the Party Hierarchy.

Our eldest and only girl is named after her grandmothers (Carolette and Lucita) and initially we thought of it as CAROLUCI (say, carolosi). However, we finally settled to spell her name as CAROLUZZI (say, caro-lutchie) since it was the year Lady Diana died after being chased in the streets of Paris by Paparazzi. Her nickname is CAROTZ.

Our second child, a boy, got his name straight from a book of names. We gave him the names Lance (which means warrior) and Howell (which means lordly) making it LANCE HOWELL (Lordly Warrior). Incidentally, my name starts with H and my wife's starts with L. His nickname is CABBAGE.

We intended to name our third child, another boy, in honor of his great-great grandfathers (Diego and Miguel, mother side; Nicasio and Agapito, father side). Acknowledging the ordeal of a small child writing a very long full name "Diego Miguel Nicasio Agapito Yap Lagunay" at school, we decided to shorten his name to DIGNITY. His nickname is BROCCOLI.

At this point we have come to collectively refer to our children as CHOPSUEY.

Five years later, a fourth one came and its another boy again. We first decided that his nickname should be RADISH. Hence, we gave him the name KONRAD (as in Konrad Adenauer of Germany). Deciding to give him a second first name in honor of his grandfathers (Baning and Liani), we coined the name VALIANT. His final name: VALIANT KONRAD.

Recent updates on the Panglao Bohol Airport Development Project:

1. Detailed Engineering Design was awarded to PhilJAC, a Filipino and Japanese consulting firm, in December 2008.

2. PhilJAC's survey teams are now at the project site for precise survey for building and other facilities layout preparatory to construction. Other activities for DED are ongoing.

3. About 30 Panglaoanons will be hired to clear the shrubs for one month. This is to complement the work of the survey teams.

4. The relocation site for qualified affected families is also undergoing subdivision survey.

5. PhilJAC has recommended the development of an additional access road leading to the airport terminal (which will become the main access road).

6. DOTC has already transferred 37.5 Million to the Prov'l Gov't as additional funding for payment of lots, improvements, and related activities.

Talk of the Town / Re: Capitol Denies Bidding Anomaly

Grazie, thanks for your questions.

The posting and publication of the invitation to bid is the first step in letting the public know that the government is going to buy certain items (goods, services, civil works). The invitation to bid already contains the schedule of procurement activities (including the pre-bid conference date). This answers your query why it seems the invitation to bid takes precedence over the pre-bid conference.

The kind of conference that will be held before the advertisement is called "pre-procurement conference" where the end-users discussed with the BAC the specifications needed and when the schedule of the procurement activities are set,

The pre-bid conference (which already involves the interested and prospective bidders) should be at least 12 days from the date of submission of bids.

Bidders get to join the bid (after the invitation is published) by sending a letter of intent if it involves consultancy services or civil works. If procurements of goods, no need of LOI.

Bidders will buy the bid documents, accomplish the legal requirements and complete their bid and financial proposals and submit them on or before the deadline set.

Sorry I was unable to include the amount of financial proposals of the bidders from the Bids and Awards Committee  in my report. The data I got was only for the lowest bidder. For sure, the amount of bid did not exceed the ABC (approved budget of the contract). The amount of bids is available at the BAC. When I have the opportunity, I will add the amount of bids.

Nonetheless, the assessment focused on whether there is rigging and if the bidding procedures were properly followed, not on the amount of bids.

Attorney Handel, thanks for sharing to us your thorough analyses of the formal allegations filed by one participating bidder, Kowa Tsusho Co. Ltd. I actually read all of your report, though I can not claim everything stuck to my little brain and that I fully understood the intricacy of the bidding system.  It seems to me like some kind of legal audit.  :)

First questions came to mind, Attorney, why did the pre-bidding conference scheduled on February 23 and not before the first advertisement was published in the local paper?  It seems difficult to understand, at least to me,  why the date of advertisement can supersede the actual date of pre-bid conference.  Was this properly communicated to the bidders?  Also, how do we go about getting all these bids?  Do we send out letter of invitation to prospective bidders or the advertisement takes care of that?

Pasensya na, Attorney, my questions may seem insignificant to you or to others but I am just wondering.

And lastly - for now :), Attorney, I noticed that in your report, the bid amount were not written.  Is it legally not acceptable to include bid amounts to the report?  Ga wonder lang pod akong mind what could be the lowest bid amount.  :)

Thank you so much, Attorney Handel.  God bless you!

Talk of the Town / Re: Capitol Denies Bidding Anomaly
February 23, 2009, 06:33:08 PM
Mike,

To give the complete picture how I assessed the situation, I am uploading my report:

-oOo-

19 February 2009

For   :   THE GOVERNOR

Re   :   ASSESSMENT ON THE CONDUCT OF THE BIDS AND AWARDS
COMMITTEE ON THE PROCUREMENT OF HEAVY EQUIPMENT WITH
AN ABC OF P168 MILLION, PROJECT REFERENCE NO. 001.

Acting on your directive, herewith is my assessment on the conduct of the Bids and Awards Committee (BAC) in the procurement for SUPPLY AND DELIVERY OF HEAVY EQUIPMENT with an Approved Budget for the Contract (ABC) of P168,296,000.00 following the complaint of Atty. Salvador Grupo on behalf of Kowa Tsoshu Co. Ltd.

On the period set from the first day of advertisement up to the submission and opening of bids

The complaint alleged that considering the amount of the project, Section 21.2.2 of the IRR-A of R.A. 9184 should have been observed which provides that the periods from the date of advertisement and/or first day of posting of the Invitation to Apply for Eligibility and to Bid (IAEB) up to the opening of bids should be:

•   Maximum of 30 calendar days for goods;
•   Maximum of 36 calendar days for infrastructure projects worth P50 million and below; and
•   Maximum of 50 calendar days for infrastructure projects worth above P50  million.

The complaining prospective bidder said that there was no ample time to prepare the bid because the period from the pre-bid conference on January 23 up to the submission of bids on February 9 is only 16 days. Accordingly, the 30-day period should be up to February 23.

A close reading of Section 21.2.2 shows that the 30-day period is counted from the date of advertisement or first posting of the IAEB, not from the date of pre-bid conference.

It is worthy to note that the third paragraph of Section 38.1 of the IRR-A states:

“The maximum periods and earliest possible time for action on specific procurement activities are provided for in Annex “C” of this IRR-A. In case the deadline for each activity falls on a non-working day (i.e., Saturday and Sunday), legal holiday, or special non-working holiday, the deadline shall be the next working day.”

The said Annex “C” provides that the earliest possible time to complete the bidding process from the date of advertisement or first posting up to the issuance of the Notice to Proceed, are as follows: goods, 28 calendar days (cd); civil works, 43 cd; and consulting services, 48 cd.

A question was raised whether the heavy equipment should be classified as goods or infrastructure project (civil works). This question is answered in Section 5(k) of the IRR-A which states:

“k)   Goods. Refer to all items, supplies, materials and general support services, except consulting services and infrastructure projects, which may be needed in the  transaction of public businesses or in the pursuit of any government undertaking, project or activity, whether in the nature of equipment, furniture, stationery, materials for construction, or personal property of any kind, including non-personal or contractual services such as repair or maintenance of equipment and furniture, as well as trucking, hauling, janitorial, security, and related or analogous services, as well as procurement of materials and supplies provided by the procuring entity for such services. The term “related” or “analogous services” shall include, but not limited to, lease or purchase of office space, media advertisements, health maintenance services, and other services essential to the operation of the procuring entity.” [Underscoring supplied.]

Based on the foregoing definition, there is no doubt the heavy equipment to be procured are “goods” because they are items needed in the pursuit of a government undertaking, project or activity.  In Annex “C” on the earliest possible time for procurement of goods, advertisement/posting of IAEB is 7 cd, and pre-bid conference is at least 12 cd before the submission of bids. The earliest possible time, therefore, is a minimum of 15 calendar days.

Taking together Sections 21 and 38, the BAC is not bound to set the deadline for submission and opening of bids exactly at the maximum of 30 calendar days for goods because the rules also provides for the earliest possible period to complete the entire bidding process which is only 28 calendar days.

The IAEB was posted and published at various outlets. Based on the record provided by the BAC Secretariat, the actual dates of posting or publication and corresponding period up to the submission and opening of bid on February 9, 2009 are as follows:

Date                 Period up to Bid Opening
Sun*Star Daily (Cebu)   January 8, 2009   32 calendar days
Cebu Daily News      January 15, 2009    25 calendar days
The Bohol Chronicle      January 11, 2009   29 calendar days
PGSO Bulleting Board   January 8, 2009   32 calendar days
Old Capitol Façade      January 8, 2009   32 calendar days
Provincial Library Lobby   January 8, 2009    32 calendar days
www.bohol.gov.ph      January 7, 2009    33 calendar days

From the foregoing, the period up to the submission and opening of bids is well within the range of maximum and minimum periods allowed under the implementing rules and regulations. It will be noted also that the 30th day from January 8, 2009 is February 7 which is a Saturday. Thus, pursuant to Sec. 38.1 (3rd par.), the bids will be opened on the next working day, Monday, which in this case is February 9.

On the refusal of the BAC to postpone the deadline for submission and opening of bids

We found no provision in the IRR-A that allows the BAC to postpone the bidding at the request of a prospective bidder. After the schedule of procurement activities have been published, to approve such request coming from a prospective bidder could be perceived as giving such bidder undue favor to the disadvantage of the other bidders managed to submit their bids as scheduled.

Further, according to the end-user, they hope to take advantage of the favorable weather condition during which the heavy equipment will be used in the repair and improvement of provincial roads. Such favourable climate might be missed if the bidding process is delayed.

On this point, pertinent provision of Section 25 of R.A. 9184 provides:

â€œSec. 25. Submission and Receipt of Bids.â€"A bid shall have two (2) components, namely the technical and financial components which should be in separate sealed envelopes, and which shall be submitted simultaneously. The bids shall be received by the BAC on such date, time and place specified in the invitation to bid. The deadline for the receipt of bids shall be fixed by the BAC, giving it sufficient time to complete the bidding process and giving the prospective bidders sufficient time to study and prepare their bids. The deadline shall also consider the urgency of the procurement involved.” [Underscoring supplied.]

On the selection of newspapers where the Invitation to Apply for Eligibility and to Bid (IAEB) was published

It is alleged that Cebu Daily News and Sun*Star Daily are only local newspapers based in Cebu City. Upon verification, however, it is established that Cebu Daily News (an affiliate of the Philippine Daily Inquirer) is also in circulation and sold at newsstands in the Provinces of Oriental Negros, Bohol and Zamboanga del Norte. Sun*Star Daily is also in circulation in Metro Manila, Davao City, and some parts in the Visayas. Obviously, these newspapers are not just “locals.” The fact that two (2) participating bidders are based in Quezon City bolsters the fact that the said newspapers are of nationwide circulation. Thus, we find no deviation from the rules committed by the BAC on this regard.

On the period of making available the bid documents

It is alleged that the bid documents were not made available at the time the IAEB was first published and posted nor at the time of the pre-bid conference. The BAC denied this allegation saying that just because the issuance of bid documents is set on January 23, 2009 it does not mean that the bid documents were not available for the bidders right after the IAEB was posted or published. The BAC further said that the fact 2 bidders were able to get their bid documents immediately after the pre-bid conference debunks the allegation that the same were not yet ready at that time.

After carefully reading of the letters of the counsel of the prospective bidder, it is found that there is no allegation or statement that the prospective bidder ever asked for copies of the bids documents after the invitation was first posted and published and was refused. Thus, the allegation that the bid documents were not yet ready at the time the IAEB was first published is a non-issue.

The impression of the complaining prospective bidder that the bid documents were not yet prepared is based on the discussion which followed after a bidder asked clarification on the turbo-charge specification of the dump trucks and other equipment and the cost of the bid documents.

Going over the minutes of the pre-bid conference, we find nothing to support the contention of the prospective bidder. A pre-bid conference is the time to clarify matters regarding the bidding, including the specifications of the equipment which are most responsive to the needs of the procuring entity and it is only natural that such discussions will occur. Discussions regarding specifications at the time of the pre-bid conference does not mean that the specifications were not yet finalized at that time. Further, the cost of the bid documents are already fixed and stated in the published IAEB to be in accordance with Provincial Ordinance No. 2004-21.

On the minimum specifications of the equipment

The complaining prospective bidder alleged that the specifications of the equipment already show that there is a preferred bidder. In other words, the specifications were tailor-made for a particular brand.

We sought clarification from the BAC and the TWG. They stressed that the specifications were only minimum requirements. As the BACH chair said during the pre-bid conference, the preference on specifications are only descriptive but not restrictive. Any bidder who can offer an equipment with specifications which are above the minimum requirement is not precluded from participating the bid and can be ultimately awarded with the contract.

There should be no confusion between preferred specifications on one hand and a preferred brand or bidder in the other. The two are not the same. It is the latter which is prohibited by law while the former is a vital factor in awarding the project.

On the allegation that the bidding is rigged

We find no basis to the allegation that the bidding for the P168 million heavy equipment is rigged. The BAC followed the rules and procedures under R.A. 9184 and its IRR-A. There are six (6) bidders who participated in the bidding. The BAC has already conducted post-qualification procedures.

As of date, the results are as follows:

Bidders:

Bidders declared to have failed in the post-qualification proceedings are given seven (7) days to file a motion for reconsideration upon receipt of the notice.

Company profile of Kowa Tsusho Co. Ltd.

It will be noted that the reason why RDAK Transport Equipment failed the post qualification proceeding in its bid for the backhoe and bulldozer is that its Mayor’s Permit stated that its business line is for “trucks and jeepneys only.” This procurement activity is for heavy equipment.

Incidentally, the website of Kowa Tsusho Co. Ltd. (http://www.kowa-tsusho.com) states that it is an authorized exporter of Japanese automobiles, used cars, auto parts, generators, Chinese motorcycles. In another website (Alibaba.com), the product/service of Kowa Tsusho Co. Ltd covers Chinese new tires, Chinese new motorcycles, Japanese used motorcycles.

Formal Protest

On February 18, 2009, the counsel of Kowa Tsusho Co. Ltd filed a formal protest and urged for a re-bidding. Glaringly, there is no Board Resolution or any document from Kowa Tsusho Co. Ltd (a company that deals on used cars and Chinese tires) authorizing the counsel or any person for that matter to file the said protest (in a bidding for heavy equipment).

Nonetheless, the BAC will still need to treat the protest accordingly and in pursuance of the IRR of R.A. 9184.

Recommendation

Finding no basis to support the allegation that the BAC committed any irregularity or questionable behaviour in conduct of the bidding process for the SUPPLY AND DELIVERY OF HEAVY EQUIPMENT, Project Reference No. 001, it is recommended that the BAC be allowed to proceed to the next steps in the procurement activity.

The protest filed cannot delay or interrupt the bidding process as expressly provided in Section 57 of the IRR-A, R.A. 9184. However, such protest must first be resolved before any award is made.

   Respectfully submitted.

Thank you all for your greetings. Ate Lee (Simplylee) told me last night there is this thread :)

We had a quiet, private celebration on the 14th and that night I took my wife Lucille to a concert of Nina at Bohol Tropics.  On the 15th, we had lunch out at Villa Alzhun and afterward treated the kids to some Smoothies at Coffee Talk which just opened at the New Agora City Square.

Karate Kid reminds me of Peter Cetera's "Power of Love". If I remember it right, this was the theme love song of that Karate Kid set in Japan.

The title of the song is "Glory of Love,"  Gec.

I'm not sure but I think US Chief Justice Roberts tried to administer the Oath from memory. Perhaps he was not looking at a written copy.

The gaffe happened when CJ Roberts recited a long phrase of the oath and Pres. Obama had a hard time following. Obama just stopped mid sentence and smiled. CJ Roberts repeated the phrase and from then on, he abbreviated the oath.

It was thought that the failure to take the oath in the correct wording as stated in the US Constitution could affect the legality of Obama's assumption as President.

Indeed, taking the oath for the second time, as reported, is a good measure of caution. But, in my humble opinion, the oath-taking gaffe may not be considered a serious threat to Obama's legitimacy IF there is written oath of office which he signed afterward and subscribed before the Chief Justice.

I love best that Karate Kid movie set in Japan. The tea ceremony was a very magical moment.

I am so pleased to have met Ms. Angie Gulle for the first time in person in that EB. I was also happy to see Mike once again. Kanunay mi kita ni Simplylee on Sundays. Precious, kanunay pud, and Rey (new Manager of PIA), during important government activities.

Ayaw mo kaulaw oi kon mag EB. Please do come so I can meet you. I look forward to EBs because I couldn't post often here at TB as most of you do.

It was not intended as a formal affair. Gikan pa ko straight from the office that's why I was in barong.

I wasn't able to wait for Mari's Steve to join us because I needed to be home na  :)

Regards to all of you.

Jackie Chan is one of my favorite actors.

But I have reservations on the remake of the "Karate Kid".

I have fond memories of the old Agora especially the old "Sky's d' Limit" right across BQ.

For those who yearn of banana Q's, here's Jojie's Painitang Bol-anon. Have you checked this place already?

I have tried Jojie's Painitang Bol-anon. According to the owners, Arnold and Jojie Labunog, they want to bring back the experience of the "Painitan" of old but with a new twist on our traditional delicacies... suman, puto, biko, dinumugan (with cheese), etc.

Kafe nga mais, salabat, and other beverage that warms the belly.

I hope to find a puto kuchinta the next time I'll drop by the place.

If my memory serves me right, the school was first named after Rafael Palma who was one of the pillars of Philippine education before the second word war.
