9 out of 10 don’t pay bribe - survey
09 May 2012

More Filipino families do not pay bribe or grease money when transacting business in government agencies according to a national household survey on experience with corruption commissioned by the Office of the Ombudsman.

The survey shows that only 10% of those who accessed government services paid bribe or grease money to an agency official to facilitate transaction or avoid problems. This is lower than the 16% bribe incidence in the Philippines reported by the Transparency International in the 2010 Global Corruption Barometer.

The low incidence of payment of bribe or grease money may be attributed to reduced red tape in government agencies, improved service delivery and customer satisfaction, or non-tolerance of corruption by the transacting public.

The least number of families paid bribe or grease money when accessing social services compared to other transactions with government such as registry and licensing, payment of taxes and other charges, and access to justice.

The same survey also reveals that 3 out of 4 who gave bribe or grease money volunteered to give it even without being asked to. This means that most of the bribery incidence in government agencies occurred at the instance of the giver and not of government officials.

However, 99% of those who have been asked to pay bribe or grease money did not report the same to proper authorities.

The survey on experience with corruption in the Philippines was a rider to the 2010 Annual Poverty Indicators Survey conducted by the National Statistics Office. It was commissioned to measure the scale of corruption in the Philippines in terms of actual experience as opposed to mere perceptions or public opinions usually reported by local and international survey groups. The total number of households surveyed was 26,000.

Results also indicate that those living in Southern Luzon are less likely to give bribe or grease money than those in other regions. But those living in the National Capital Region are least likely to volunteer giving bribe or grease money compared to others.

QC councilors charged for ‘ghost employees’
09 May 2012

The Office of the Ombudsman, through its Field Investigation Office, has lodged criminal and administrative complaints against Quezon City Councilors Roderick M. Paulate and Francisco A. Calalay, Jr., for maintaining “ghost employees” in the payroll of the Quezon City Council.

Acting on the complaint filed by Mr. Jimmy Lee Davis, a whistle-blower and QC insider, who was assisted by his counsel former Sen. Aquilino Pimentel Jr., the FIO managed to obtain evidence showing that Councilors Paulate and Calalay maintained “job order personnel” under their respective offices which turned out to be fictitious persons.

These fictitious personnel received monthly wages ranging from PhP2, 500.00 to PhP5,000.00.

Investigation disclosed that these fictitious personnel do not have birth records from the National Statistics Office, are not registered voters of Quezon City, have not secured NBI clearances, and are not known in the respective barangays where they allegedly reside or the indicated Barangay-addresses where they purportedly reside do not exist.

For the period January to November 2010, Councilor Calalay maintained a total of twenty-nine (29) ghost employees, while Councilor Paulate maintained thirty (30) ghost employees for the period July 2010 to November 2010.

A total of Php2,175,000.00 in wages was disbursed by Councilor Calalay, while Councilor Paulate disbursed a total of PhP1,125,000.00.

The disbursements of wages were made possible through the submission of spurious Personal Data Sheets and payrolls.
Charges of Malversation of Public Funds through Falsification of Public Documents, Violation of Section 3(e) of Republic Act No. 3019 and administrative charges for Grave Misconduct, Serious Dishonesty and Falsification of Official Documents have been filed against Councilors Calalay and Paulate, together with their respective Liaison Officers in the persons of Flordeliza A. Alvarez and Vicente E. Bajamunde.

Former Sarangani governor, 5 others charged over bogus financial aid
09 February 2012

Ombudsman Conchita Carpio Morales ordered the filing of graft charges against former Governor Miguel Escobar of Sarangani province and several others stemming from the grant of a 'financial assistance' worth P450,000 in 2002.

In an Information lodged before the Sandiganbayan, charged with violation of Section 3(e) of the R.A. 3019 (Anti-Graft and Corrupt Practices Act) were former governor Escobar, Juanito Purisima, Board Member; Amelia Carmela Zoleta, Executive Assistant to the Vice Governor; Suzette Clerigo, Accountant IV, and Alexis Dela Cruz, Management Analyst, all of the provincial government of Sarangani.

Private respondent Velsie Banzon, treasurer of Malapatan Fishermen's Group in Poblacion Malapatan, was also included in the charge sheet.

The Information stated the  respondents caused the disbursement of the amount P450,000 through a Development Bank of the Philippines (DBP) check dated 29 May 2002 to Banzon as payee.

It added that  they made it appear that financial assistance was requested and given to the fishermen's group, and that evidence pointed to Escobar as the one who approved the fictitious request and even certified "in the disbursement voucher that the cash advance was necessary, lawful and incurred under his direct supervision."

The Information further alleged that Clerigo certified as to the "completeness and propriety of the supporting documents despite no-compliance with Commission on Audit (COA) Circular No. 96-003 providing for the documentary requirements in disbursements for financial assistance, when in truth and in fact, neither was there a request for financial assistance nor was there financial assistance received by the Malapatan Fishermen's Group after the check was encashed, as herein accused, misappropriate and convert to their personal and benefit the said amount, thereby causing undue injury to the government."

Ombudsman reminds deadline of filing SALN
27 April 2012

Ombudsman Conchita Carpio Morales reminds government officials and employees to file their Statements of Assets, Liabilities and Net Worth (SALN) to their respective human resource management offices on or before the April 30 deadline.

The Ombudsman likewise reminded that, in order to fully comply with the laws on SALN, the same must not only be filed, but must be accomplished truthfully.  “It is high time that we instill the perspective of not just filing the SALN but of accomplishing the same with honesty by correctly and completely abiding with the requirements of the law,” the Ombudsman said.

Section 17, Article XI of the 1987 Constitution requires “public officials and employees to file their SALN upon assumption to office and as often as may be required by law”, which under Section 8(A) of Republic Act No. 6713 (Code of Conduct and Ethical Standards for Public Officials and Employees) should be filed upon entry or exit from government service and on or before April 30 of every year thereafter.  The same requirement is likewise found under Section 7 of Republic Act No. 3019 (Anti-Graft and Corrupt Practices Act).

In connection therewith, Rule 10, Section 46(D)(8) of the Revised Rules on Administrative Cases issued by the Civil Service Commission classifies the failure to file SALN as a less grave offense punishable by suspension of one (1) month and one (1) day to six (6) months for the first offense and by dismissal from the service for the second offense.   The filing of an untruthful SALN, on the other hand, will expose the filer to a possible charge of perjury under Article 183 of the Revised Penal Code.

As the “protector of the people,” the Office of the Ombudsman has been actively coordinating with concerned government agencies in monitoring the submission of SALNs.  It warned that non-compliant government officials and employees will be subjected to investigation where appropriate charges and penalties may be rendered.

Based on latest CSC Memorandum Circular (MC No. 5, series of 2012), government officials and employees may use either the old or new SALN form.

Those who serve in an honorary capacity, laborers and casual or temporary workers are exempted from the filing of SALN (Section 8[a] of Republic Act No. 6713).

19 April 2012

The Office of the Ombudsman (OMB) and the Dept. of Justice (DOJ) signed a Memorandum of Agreement (MOA) “to simplify procedures to be observed by the OMB and the DOJ for a more efficient and effective investigation and prosecution” of cases involving government officials and employees.

The MOA was signed by Ombudsman Conchita Carpio Morales and Justice Sec. Leila de Lima.

Under the MOA, the OMB will have “primary jurisdiction in the conduct of preliminary investigation and inquest proceedings over complaints for crimes cognizable by the Sandiganbayan.”

Under Sec. 4 of RA 8249, among the cases over which the Sandiganbayan has exclusive jurisdiction are the following: “I) Violations of RA 3019 (Anti-Graft and Corrupt Practices Act); II)RA 1379 (Forfeiture of Illegally Acquired Wealth); III)Crimes by public officers or employees embraced in Ch. II, Sec. 2 Title VII, Bk. II of the Revised Penal code (Crimes committed by Public Officers) namely : Direct Bribery, Indirect Bribery, Qualified Bribery, Corruption of Public Officials; IV) Other offenses or felonies whether simple or complexed with other crimes committed in relation to their office by the public officials and employees mentioned above” and cases involving government officials and employees with Salary Grade 27 or higher for a)Violation of RA 6713 (Code of Conduct and Ethical Standards) b)Violation of RA 7080 (The Plunder Law) c)Violation of RA 7659 (The Heinous Crime Law) d) RA 9160 (Violation of the Anti-Money Laundering Law when committed by a public officer)  e) PD 46 (Prohibition Against Gift-Giving) and  f)PD 749(law granting immunity to bribe-givers who voluntarily gives information)  .

It said that when complaints involving the above-mentioned cases were filed before the DOJ, the same shall immediately be endorsed to the OMB.

The two officials also agreed that the OMB and the DOJ shall have concurrent jurisdiction over cases involving public officials falling outside the exclusive jurisdiction of the Sandiganbayan. However, “the office where such complaint is filed for preliminary investigation shall acquire jurisdiction over the complaint to the exclusion of the other”.

Once the DOJ acquires jurisdiction over said cases, the Prosecutor General or provincial/city prosecutors shall resolve them without need of approval from the OMB.

The OMB shall conduct reinvestigation, when ordered by the court, of cases which underwent preliminary investigation at the OMB but referred to the DOJ for prosecution.

The MOA also states that “the OMB shall ensure that a motion for reconsideration has been resolved or the period for filing thereof has lapsed before endorsing an Information to the DOJ for filing with the proper court”.

On the Inauguration of COA-OMB Joint Investigations

18 April 2012

SAADO Auditorium, Commission on Audit

Quezon City

Today is a propitious day, as we inaugurate a strategic partnership between the Commission on Audit and the Office of the Ombudsman in the fight against graft and corruption.

When we came to office about a year ago, we were confronted with an alarmingly huge inventory of case files involving allegations of bribery and wanton misuse of public money.  Many more complaints of the same tenor have since deluged our offices, and the inflow of information and investigation and audit requests â€" mostly from citizens â€" continues to increase.

While we lost no time in working on these cases within our respective organizations, we soon came to realize that for a more speedy and effective resolution of these cases, we needed to institutionally partner with one another in a structured, targeted and coordinated manner, in a spirit of utmost mutual assistance and cooperation, and be bound by the highest purpose of holding each public servant â€" including ourselves â€" fully accountable to the people.

We are deeply mindful of the “culture of impunity” so often spoken of and written about, as one of the most impelling factors in the incidence of graft and corruption in the country.  How so often bewailed that graft pays, because only the “small fish,” if at all, get punished, and the big fish get away to yet another adventure, emboldening the next-in-ranks to help themselves in adventures of their own until they, too, become big fish, and the cycle goes on.

This culture of impunity must go if we are to restore public office as truly a public trust.  Complaints involving high officials of the land, plunderous misuse of public funds, and other cases highly impacting the drive against graft and corruption, must be attended to with dispatch and investigated with the highest degree of integrity, independence and competence.

Drawing from our respective constitutional mandates, and our statutory authorities to engage each other’s assistance in carrying out our solemn responsibilities to country and people, we have thus joined forces to dedicate a team that will primarily handle and attend to these cases.  We will do our best to obtain for the members of this joint investigation team continuous training to upgrade their capabilities in forensic auditing, evidence gathering and documentation, case strategies and presentation; deepen their commitment to civic responsibility; equip them with modern technological tools; and grant commensurate incentives as may be allowed by law.

And this is why we are here today, in this room at the Commission on Audit where the COA-OMB Joint Investigation Team will take residence in our quest to restore the confidence of the people in their institutions and servants.

In this quest, we humbly request everyone’s support and prayers. The success of the COA-OMB Joint Investigation Team will surely be the success of the Filipino people.

OMB leads corruption seminar for PAPRB members
22 February 2012

The Office of the Ombudsman in coordination with the Multi-Sectoral Anti-Corruption Council (MSACC) will lead starting February 23, 2012 the two-day seminar workshop on Administrative Investigation and Rules of Order for the members of the Philippine Association of Professional Regulatory Board (PAPRB).

The members of PAPRB sit as chairmen and members of the different professions of the Professional Regulatory Board.

The workshop to be held at the OMB Function Room is expected to enable professional board members to acquire skills, knowledge of processes, and strategic capabilities for efficient and effective discharge of their authority and investigation functions.

Prosecutor Bienvenida A. Gruta, Office-in-Charge-Director of Center for Integrity and Professional Development (CIPD) pointed out that the proposed skills training is an offshoot of the PAPRB Orientation and Planning Workshop conducted in November 2010. CIPD is under OMB’s Public Assistance and Corruption Prevention Office (PACPO).

Pros. Gruta added that the chairs and members of the professional boards who attended the said workshop made commitments to assist the Office of the Ombudsman in the areas of community coordination, fact-finding, and providing expert advice in the prosecution of cases involving expert’s testimonial evidence.

On their own respective fields, the boards have committed to developing integrity of and exacting accountability on their members many of whom are employed by the government.

Presently, according to Pros. Gruta, “these commitments are the boards’ major immediate concern considering the numerous complaints now pending before them and awaiting resolution for many years.”

The Center was created under Administrative Order No. 226 dated February 7, 1992 primarily to process tax credit and duty drawback applications as incentives to BOI-registered enterprises. The said incentives consist of government refund payments on the duties and taxes.

Meanwhile, the Ombudsman referred to the Office of the Special Prosecutor  for its appropriate action the motion to include private respondent Felix Chingkoe, President of Diamond Knitting Corporation,  in the plunder charges  filed against several DOF officials and other officials of the Chingkoe group of companies. The case has been undergoing trial before the Sandiganbayan. Ombudsman Morales penalizes 21 PNP officers over Davao Death Squad
29 March 2012

OMBUDSMAN Conchita Carpio Morales has penalized 21 high-ranking officers of the Philippine National Police (PNP) arising from the unabated killings in Davao City in the recent years attributed to the “Davao Death Squad (DDS)”.

Found guilty of Simple Neglect of Duty, for which they were meted the penalty of fine equivalent to one month salary, were P/SSUPT Catalino Cuy, P/SSUPT Jaime Morente, P/CINSP Matthew Baccay, P/CINSP Filmore Escobal, P/CINSP Leandro Felonia, P/CINSP Marvin Manuel Pepino, P/CINSP Ranulfo Cabanog, P/CINSP Vicente Danao, P/SUPT Harry Espela, P/SUPT Michael John Dubria, P/SUPT Rommil Mitra, P/SINSP Maximiano Atuel and P/SINSP Arnulfo Mahinay, both of the Davao City Police Office (DCPO).

Also fined were P/CINSP Alden Delvo, P/INSP Rolly Tropico, P/INSP Dionisio Abude, P/SINSP Antonio Alberio Jr., P/CINSP Juel Neil Salcedo, P/CINSP Joselito Loriza, P/CINSP Joel Neil Rojo and P/CINSP Napoleon Eguia.

Ombudsman Morales approved the Decision with modification as to penalty from one (1) month suspension to fine equivalent to one (1) month salary.

The case stemmed from a Letter-Complaint addressed to the Office of the Ombudsman sent by a person purporting to represent a group named Davao City Deserves Good Government Movement, claiming that a certain group known as the DDS was “responsible for the unsolved killings of more than 800 persons.”

The same complaint alleged that high-ranking officers of the PNP were directly involved in the murders.

Records showed that from 2005 to 2008, the Davao City Police Office registered an unusually high number of unsolved killings.

The perpetrators of these executions were usually 2 motorcycle-riding gunmen and the killings were mostly drug-related.

         The OMB-MOLEO fact-finding team reported that in 4 years, there were 720 persons murdered; 97 in 2005; 165 in 2006; 199 in 2007 and 259 in 2008.

A mere 321 or less than 50% of the cases, however, were solved.

The killings were repeatedly committed within the areas of jurisdiction of respondents’ precincts where they were assigned.

“From the foregoing figures, it is evident that respondents were remiss in their duty to significantly reduce the number of killings,” the Anti-Graft Office pointed out in its ruling.

“Also, the same shows that respondents failed to solve a substantial number, if not all, of the killings.”

The Decision added: “Under Executive Order No. 226 dated 17 February 1995, an officer of the Philippine National Police or that of any other law enforcement agency is held accountable for “Neglect of Duty”  under the doctrine of “command responsibility” if he has knowledge that a crime or offense shall be committed, is being committed, or has been committed by his subordinates, or by others within his area of responsibility and, despite such knowledge, he did not take preventive or corrective action either before during, or immediately after its commission.”

Ombudsman dismisses “Deped Noodles Case” vs Lapus
15 March 2012

Ombudsman Conchita Carpio Morales dismissed the administrative and criminal charges against former Secretary of the Department of Education (DepEd) Jesli Lapus, five other DepED officials, and the President of Jeverps Manufacturing Corporation, Alex Billan, relative to the allegedly rigged biddings that DepEd conducted in 2007 for fortified instant noodles “with fresh eggs” and in 2009 for fortified noodles “with fresh eggs and malunggay”  that allegedly resulted to million peso losses by the government due to overpricing.

In an 18-page Joint Resolution approved on March 6, 2012, Ombudsman Morales dismissed the complaints against Lapus, Assistant Secretary for Special Concern Thelma Santos, Bid Awards Committee (BAC) Chairman Teodosio Sangil, BAC Vice Chairman Macur Marohombsar, and BAC Members Demetria Manuel and Nanette Mamoransing, after finding no sufficient evidence to hold respondents either administratively or criminally liable.

The cases stemmed from separate complaints filed by Prudencio Quido, Jr. and Myrna Gonzales for Misconduct and violation of Sec. 3 (e), (f), and (g) of Republic Act No. 3019 (Anti-Graft and Corrupt Practices Act).

In the Resolution, the Ombudsman stated that ”The charge that the biddings were rigged and favorably awarded to one and the same winning bidder was negated by the following undisputed facts: the biddings were posted and published in a newspaper of general circulation; on account of such publication, several public bidders including the complainant’s corporation, Kolonwel Trading, actually bought bid documents in 2007; the required pre-bid conferences for the biddings were duly conducted by the BAC in order to clarify and explain the requirements, terms, conditions and specifications stipulated in the bidding documents; and Jeverps successfully passed the eligibility check and its bids were declared the single calculated and responsive bids for the procurement of noodles in 2007 and 2009, after the other participating bidders either failed the eligibility check or voluntarily withdrew their bids.”

The Resolution pointed out that during the pre-procurement conference, the end-user Health and Nutrition Center of the DepEd was the one which recommended to the BAC that the noodles to be procured should be packed at 100 grams per pack to save on packaging cost, and that the required phrase “with fresh eggs,” instead of merely “eggs,” to be added to the title of the product, was to emphasize the actual use of fresh eggs in the preparation of the noodle dough, and not merely egg powder.

It further stated that that the complainant has not shown “a palpably fraudulent and dishonest purpose to do moral obliquity or conscious wrong doing for some perverse motive or ill-will” on the part of the respondents, nor that the respondents were actuated by evident bad faith, manifest partiality or gross inexcusable negligence during the assailed procurement process.

The Office of the Ombudsman found no substantial evidence to fault the respondents for Misconduct. “In the absence of the actual canvass sheets and/or price quotations from identified suppliers as a valid basis for comparing the prices to the winning bidder, the respondents cannot be held liable for the alleged overpricing of the noodles.” The Resolution stated that the claim of overpricing was not substantiated. The Review Committee headed by then Undersecretary Ramon Bacani found that the price paid by the DepED to the winning bidder was reasonable.

“It appearing that the complainants’ letter of protest and opposition to the awarding of the biddings to Jeverps were seasonably acted upon by the respondents in their reply letter dated 23 February 2009 denying the same for having filed out of time, the respondents cannot be faulted therefor.”

The Certification from Uni-Vietnam Co. Ltd that the noodles do not contain fresh eggs cannot be considered conclusive as the said company is not officially accredited by the Philippine Government to conduct such analysis. Moreover, the test report made by BFAD confirmed the quality and contents of the noodles.

Records also showed that the DepEd conducted a Nutritional Status Report on the Food for School Program, contrary to the complainant’s claim that the DepEd did not conduct “check ups” with students covered by the DepEd feeding project. The complainant did not assail the validity of the said Status Report.

In the Resolution, the Ombudsman stated that the complainants failed to overturn the presumption of regularity in the performance of official duties stands.

The Information stated that the said officials “willfully, unlawfully and criminally cause the award through negotiated procurement of Contract ID No. 06H00048 consisting of four projects”, namely: 1) Supply and Installation of testing and commissioning of L.E.D. bulbs, traffic signal lantern and other traffic control devices at junctions ML Quezon Avenue-Terminal Bldg access road and ML Quezon Avenue-Patalinghug Avenue; 2)Supply and Installation of street lighting facilities along Punta Engaño Road Network, Lapu-lapu City; 3) Supply and installation of street lighting facilities (decorative lamps) along Patalinghug Avenue (ML Quezon-Sangi section), Lapu-lapu City; and 4) Supply and installation of street lighting facilities (decorative lamps) along Patalinghug Avenue (ML Quezon-Sangi Section), Lapu-lapu City on 08 March 2007.

The contract, which costs P35,634,401.25,  was signed between Dindin and Surla, Chairman of the Board     of Gampik Construction and Development Inc..

It said the respondents, in awarding the contract to Gampik, resorted to negotiated bidding and not competitive bidding in violation of RA 9184 (Government Procurement Reform Act).

Moreover, the Information said the contract price for the said project is “in excess by P12,629,816.99 as against the Ombudsman computation of only P23,004,584.2” in violation of COA Circular No. 85-55A which only allows a 10% price variance.

“Becoming a CFE requires specific trainings and qualifications and is achieved by passing the CFE training and certification exam,” he said.

AO Rafanan said the program which aimed at strengthening the conduct of investigation and prosecution through skills enhancement in specialized techniques supports the thrust of Ombudsman Conchita Carpio Morales to improve the survival rate of fact-finding.

Ombudsman dismisses “GSIS Case” vs Echiverri
09 March 2012

Ombudsman Conchita Carpio Morales dismissed the administrative and criminal charges against Caloocan City Mayor Enrico Echieverri and three other Caloocan City officials relative to the alleged non-remittance of employees premium contributions to the Government Service Insurance System (GSIS).

In a 29-page Joint Resolution dated March 6, 2012, Ombudsman Morales dismissed the complaints against Echiverri, City Treasurer Evelina Garma, City Budget Officer Jesusa Garcia and City Accountant Edna Centeno after finding “no substantial evidence to hold respondents either administratively or criminally liable.” She also ordered that the Preventive Suspension slapped on said officials be lifted.

The case stemmed from a complaint filed by Caloocan City Vice-Mayor Edgar Erice against the said respondents, for Violation of RA 8291 (the GSIS Act of 1997), Sec. 3(e) of RA 3019 (Anti-Graft and Corrupt Practices Act) and for Grave Misconduct and Conduct Prejudicial to the Best Interest of the Service.

Erice based his complaint on a letter sent by GSIS Pres. and General Manager Robert Vergara alleging “that from July 1997 to December 2002 and from January 2007 to December 31, 2010, the premium contributions representing the personal shares of the employees, as well as the government shares of Caloocan City, were not remitted to the GSIS and remained unpaid as of December 31, 2010; and that the employees’ shares from July 1997 to Dec. 2010 were likewise not remitted to the GSIS”. The letter further stated that as of Dec. 2010, the City incurred total obligation amounting to P343,814,739.85.

In the Resolution, the Ombudsman stated that “Complainant bears the onus of proving that respondents’ questioned acts were attended with manifest corruption, clear intent to violate the law or flagrant disregard of established rule. This he failed to discharge.”

The Resolution stated that based on records, Echiverri had “taken steps to ensure the prompt payment of the city’s current premium contributions and to update its remittances to the GSIS.”

But such efforts were hindered by GSIS’ conflicting computations of the city government’s accounts. In an April 4, 2006 letter, the GSIS stated that “as of March 31, 2006, the total compulsory premium arrearages including interests of the City Government of Caloocan amounts to P126,506,221.82”. On the other hand, in a June 28, 2006 letter sent by the City Treasurer to GSIS, the City Government claimed that “as of March 31, 2006,we have remitted the premiums due from our city employees until December 2003 having a net balance of only P1,504,035.31”.

Still, in a July 17, 2006 letter sent by GSIS, it said Caloocan’s total obligation amounts to P138,295,405.48. Finally, the GSIS’ Chief Legal Counsel sent a final demand in an August 2010 letter, for the remittance of the sum of P337,181,809.46.

The Resolution stated that determination of the accurate amount of the City’s obligation “was not solely dependent on respondents but, in a large measure, on the institutional and logistical capabilities of the GSIS which were beyond the control of respondents.”

It further said “Recall that the city was assessed to pay more than P300,000,000 as of December 31, 2010. At the time Echiverri signed the GSIS MOA, however, the city government was liable for only P15,786,039.87 representing the principal and P54,807,170.63 representing interest, for a total of around P70,000,000.”

The Ombudsman also dismissed charges of Violation RA 3019, following jurisprudence that “where the administrative case is dismissed, and the basis for dismissal constituted an essential element of the crime, the criminal case must likewise be dismissed.”

Ombudsman Morales similarly dismissed charges of Violation of RA 8291 against the respondents, saying that the non-remitted premiums pertained to contributions which should have been settled during the term of then Mayor Malonzo. “Thus, their non-remittance within the period prescribed under the GSIS Act of 1997, or non-compliance with the period prescribed therein for the remittance of the monthly premiums, cannot be directly or primarily attributed to respondents.”#

The EO is targeted to be operational by September this year.

Former BSU officials face 10 years imprisonment for students’ caps and gowns
20 February 2012

The Office of the Ombudsman successfully prosecuted the graft case filed against two former officials of the Batangas State University before the Sandiganbayan.

In a 31-page Decision, the Sandiganbayan Fifth Division found Ernesto de Chavez, then President, and Rolando Lontoc, Sr., then Vice-President for Academic Affairs, both of the BSU, guilty beyond reasonable doubt of Violation of Section 3 (e) in relation to Section 3(h) of RA 3019 (Anti-Graft and Corrupt Practices Act).

They were both sentenced to suffer an indeterminate penalty of six years and one month to ten years imprisonment, and to suffer perpetual disqualification from holding public office.

The case stemmed from the Information filed against them alleging that the two former BSU officials “utilized their respective positions at BSU and directed the graduating BSU students to rent caps and gowns solely from their own cap-and-gown-rental business” in 2001.

During trial, Assistant Special Prosecutor III Kristine Jennifer Carreon presented Nora Magnaye, currently  BSU President, who testified that Lontoc “instructed her to collect the rentals for the caps and gowns in the amount of P140 per student. Lontoc told her that the rental was for the President who is his brother-in-law.”

In its Decision, the Sandiganbayan said that “the accused used their official positions, influence and standing in BSU to corner the market for the rental of caps and gowns when they ordered Magnaye to secure the caps and gowns exclusively from De Chavez. The students had to pay through their Class Treasurers and had to receive the caps and gowns from their Class Advisers. Thus, the students did not actually have a choice on the matter.”

It further stated that as President and Vice-President for Academic Affairs of a State University, the two former officials were not authorized to oblige their subordinates to secure the caps and gowns from De Chavez.

The anti-graft court added that the accused gained unwarranted benefits when they exerted their influence over their subordinates and the students, at the expense of the BSU students.

Ex-Rizal mayor, 2 others face imprisonment for unlawful demolition of shanties
20 February 2012

The Office of the Ombudsman secured the conviction of former Rodriguez, Rizal Mayor Pedro Cuerpo and two others of graft charges for the unlawful demolition of shanties of about 93 families in 2003.

In a 33-page Decision, the Second Division of the Sandiganbayan found Cuerpo, Municipal Engineer Fernando Roño and Brgy. Chairman Salvador Simbulan, all of Rodriguez, Rizal, guilty beyond reasonable doubt of Violation of Sec. 3 (e) of RA 3019 (Anti-Graft and Corrupt Practices Act).

They were slapped with the punishment of imprisonment ranging from six years and one month to nine years, one month and one day. They were also perpetually disqualified from holding public office.

Records of the case showed that Samahang Magkakapitbisig (Samahan), composed of 93 families, used to occupy a parcel of land in Quezon City but were forced to vacate the same by virtue of a Writ of Demolition issued by a QC court. The property owner however gave them financial assistance in the amount of P2.25M which they used to purchase an 8,250 sq.m. property in Brgy. Burgos, Rodriguez, Rizal.

The families then submitted individual sets of application for building permit with the Office of the Municipal Engineer but were rejected “because the Office wanted them to secure a development permit first”.

Notwithstanding the lack of any issued building or development permit, the 93 families built their temporary shelters made of lumber and tarpaulin. “On that same day, accused Barangay Capt. Simbulan, upon the order of Mayor Cuerpo, arrived and asked for their development permit. When they told him that they had none, he informed that there would be a demolition that afternoon. Thus, at around 1:30 o’clock in the afternoon of the same day, a demolition team led by accused Capt. Evasco and consisting of SWAT and Police Officers arrived, bringing with them two (2) trucks, and dismantled plywood, and appliances.”

In its ruling, the anti-graft court stated that the prosecution has proven the existence of all the essential elements of the offense.

It noted that no sufficient notices were given to the families before their makeshift homes were demolished. It said, “Even Section 444(3)(vi) of the Local Government Code, which empowers the mayor to order the demolition or removal of illegally constructed houses, still provides that such demolition should be done within the prescribed period.” The court said the failure of the families to secure a development permit does not exempt the accused from observing the proper procedure in cases of demolition.

No probe on assets of prosecutors
15 February 2012
The Office of the Ombudsman has not initiated any probe on the supposed non-disclosure of Statements of Assets, Liabilities and Net worth (SALN) of the prosecutors in the impeachment trial of Chief Justice Renato Corona; their spokesmen, as well as the senator-judges of the impeachment court.

In an Evaluation-Report dated February 1, 2012, Ombudsman Conchita Carpio Morales approved the recommendation to “close and terminate without prejudice” the request for investigation of Atty. Oliver O. Lozano, since “the suspected or reported ill-gotten wealth and non-disclosure of the Statements of Assets, Liabilities and Net Worth (SALN) of all the Complainants, Prosecutors, their Spokesmen and Senators in the impeachment case against the Chief Justice”, lack sufficient leads or particulars to enable the taking of further action.

Also included in the recommendation to “close and terminate” was the issue of the filing of a defective impeachment complaint as it appears to be beyond the jurisdiction of the Office of the Ombudsman, and is more properly addressed to the Senate of the Philippines, sitting as an Impeachment Court.

Due to the “absence of the necessary and essential particulars which will support the conduct of an inquiry”, the issue of “the suspected and reported bribery of the complainants” was also “closed and terminated”.

Ombudsman Morales releases SALN
13 January 2012

The Office of the Ombudsman released today copies of the Statement of Assets, Liabilities and Net Worth (SALN) of Ombudsman Conchita Carpio Morales, after two media personnel filed the required Request Form.

When asked by the press during an official function yesterday morning about reports that she had not disclosed her SALN, Ombudsman Morales stated that there are regulations to be followed before a request for a copy of the SALN of a government official or employee is granted, such as the filing of a verified Request Form indicating therein a legitimate purpose for the request.

The Office of the Ombudsman’s Public Assistance Bureau (PAB) where SALN requests are filed, belied the report that the Office refuses to disclose the Ombudsman’s SALN, and revealed that since Ombudsman Morales assumed office, the PAB has not received any “Request Form” concerning the Ombudsman’s SALN until yesterday when two media reporters accomplished a SALN Request Form.

After evaluating the request forms filed yesterday by Philippine Star reporter Michael Punongbayan and News5 news team member Dave Gonzales, the PAB approved the requests and made available the copies of the SALN to the requesters.

As of press time, another news staff member also filed a Request Form.

Ombudsman Morales filed her SALN on July 29, 2011 or “within 30 days after assumption of office” pursuant to Section 8 of Republic Act No. 6713 or the “Code of Conduct and Ethical Standards for Public Officials and Employees.”

Under the Revised Guidelines governing access to SALNs filed with the Ombudsman [Memorandum Circular No. 1 (2009)], all requests for copies of SALNs, which must be made in the prescribed form and under oath, shall be filed with the PAB which shall then determine if the requested SALN is in the custody of the Office or another agency.

Civil Service Commission (CSC) Resolution 06-0231, Section 5 enumerates the concerned agencies where SALNs are to be transmitted, and that the Office of the Ombudsman is the repository of the SALNs of the President, Vice President, Chairperson and Commissioners of the Constitutional Commissions and Offices, while the SALNs of other government officials are in the custody of seven other government agencies or offices.

Sandiganbayan places LLDA Administrator Acosta under 90-day preventive suspension
09 February 2012

The Sandiganbayan meted Presidential Adviser on Environmental Protection J.R. Nereus Acosta with a 90-day preventive suspension for allegedly misusing government funds in 2000 and 2001.

In a 10-page resolution, penned by Associate Justice Maria Cristina Cornejo, the anti-graft court’s Fourth Division gave weight to the motion of the Office of the Ombudsman’s prosecution team to preventively suspend Acosta for  alleged misuse of his Priority Development Assistance Fund or pork barrel while still a congressman of Bukidnon.

“J.R. Nereus Acosta is hereby ordered preventively suspended from office and said accused is directed to cease and desist from further performing and/or exercising the functions, duties and privileges of the positions he is currently occupying, namely as Presidential Adviser on Environmental Protection and General Manager of the Laguna Lake Development Authority (LLDA), or any other government position he may now or hereafter be holding, effective upon notice hereof and continuing for a period of ninety (90) days,” the ruling said.

The Ombudsman, invoking Sec. 13 of RA 3019 (Anti-Graft and Corrupt Practices Act) earlier filed motion to suspend Acosta  pendente lite to prevent him from frustrating or hampering his prosecution by intimidating or influencing witnesses or tampering with evidence or from committing further acts of malfeasance while in office.

            The said provision states:

“Suspension and loss of benefitsâ€"Any incumbent public officer against whom any criminal prosecution under a valid Information under this Act (RA3019) or under       Title 7, Book II of the Revised Penal Code or for any offense involving fraud upon        government or public funds or property whether as a simple or complex offense,           and in whatever stage of execution and mode of participation, is pending in court,         shall be suspended from office…”

The case stemmed from a complaint filed by Bukidnon Crusade Against Graft and Corruption alleging that Acosta used his pork barrel to procure a P2.5-million solar tunnel dryer for the Municipal Government of Manolo Fortich, Bukidnon.

Records of the case revealed that the supposed crime was committed while Acosta’s motherâ€"Socorroâ€"was still the municipal mayor of Manolo Fortich in 2001.

The anti-corruption group based in the province alleged that another P2.5 million was also supposedly given to a private cooperativeâ€"the Bukidnon Integrated Network of Home Industries (Binhi) Inc.

The complaint further disclosed that a private entity called Bukidnon Vegetable Producers Cooperative (BVPC) also received P5.5 million which was part of Acosta’s pork barrel.

Acosta's aunt, Ma. Nemia Bornidor, who was a member of the board of Binhi and Socorro, who was a member and director of BVPC, were both indicted for graft for the same offense.

In slapping suspension upon Acosta, the anti-graft court said that “any political motive allegedly behind the filing of the instant motion, uncorroborated as it is, is ineffective to negate the merits of the motion.”

The anti-graft court directed Executive Sec. Paquito Ochoa and the Board of Directors of the LLDA to immediately implement the order.#

Ombudsman reverses dismissal of Pestaño case
11 January 2012

Ombudsman Conchita Carpio Morales yesterday reversed the Joint Resolution dated June 15, 2009 that dismissed the criminal and administrative charges filed by spouses Felipe and Evelyn Pestaño for the murder of their son, Ensign Philip Andrew Pestaño.

In a 21-page Joint Order that granted the Pestaño spouses’ Motion for Reconsideration, Ombudsman Morales found probable cause to indict Naval Captain Ricardo Ordoñez and nine other naval officials for Murder.

Ombudsman Morales also found the respondents administratively liable for Grave Misconduct and ordered them dismissed from service.

The nine other naval officials are Cdr. Reynaldo Lopez, HM2 Welmenio Aquino, LCdr. Luidegar Casis, LCdr. Alfrederick Alba, MR2 Sandy Miranda, LCdr. Joselito Colico, LCdr. Ruben Roque, Petty Officer 1st Class Carlito Amoroso, and Petty Officer 2nd Class Mil Leonor Igcasan.

The Ombudsman ruled out the suicide theory as she found prima facie case of conspiracy to commit murder, after taking a hard look at the case including the additional evidence unearthed in the AFP investigation which were made available to the complainants ten years after the death of Ensign Pestaño.

The Information for murder was filed today with the Sandiganbayan.

Philippine Archive / Storm Welpring
November 24, 2017, 10:39:00 AM
December 2000 - It seems the weather will not cooperate with tonight's New Year's Eve celebration.

Afternoon rainshowers are expected in Luzon today, while stormy weather will soak the southern part of the country, especially Eastern Visayas and Northeastern Mindanao due to the approaching "Welpring," now a storm.

At 4 p.m. yesterday, the Philippine Atmospheric, Geophysical, and Astronomical Services Administration (PAGASA) spotted the center of Welpring at 140 kilometers east-southeast of Guiuan, Eastern Samar (coordinates: 10.8 degrees north, 127.0 degrees east).

Internationally known as Soulik, storm Welpring now bears peak winds of 65 kph, and may further intensify today as it threatens to hit Samar provinces.

Press Release Philippines / Marawi City Rebuilding Act
November 24, 2017, 10:29:31 AM
THE HONORABLE RON P. SALO
KABAYAN Party-list
Assistant Majority Leader

“The Build and Transfer mode shall be applied to this massive reconstruction program, so that the national government will not build the structures because the major private developers of residential subdivisions and commercial centers will undertake the construction. This bill also covers repairs of houses and commercial structures not damaged during the Battle of Marawi,” nakasaad sa explanatory note ng House Bill 6700 ni Salo. (WAKAS)

PNA - MANILA, Aug. 7, 2017 -- At least PHP14 billion has been allocated in the proposed PHP3.767-trillion national budget for 2018 to fund the hiring of additional soldiers, policemen, firefighters and jail guards as requested by President Rodrigo Duterte, a House leader said on Monday.

In a statement, House appropriations committee chair and Davao City Rep. Karlo Nograles further noted that the PHP14-billion allocation will also finance uniforms, firearms, rifles, ammunition, gears, training and other expenses needed for the new recruits.

“It is safe to say that out of the computed requirement, PHP14 billion is already specifically provided in the proposed 2018 budget," Nograles said, noting that the fund is distributed among the various uniformed services.

If approved without any amendment, Nograles said that this would allow the Philippine National Police (PNP) to hire 10,000 additional policemen,  2,000 additional personnel for the Bureau of Fire Protection (BFP), and 1,000 jail guards for the Bureau of Jail Management and Penology (BJMP).

"For salaries alone, the total basic pay for the creation of 10,000 police officer PO1 positions will entail around PHP1.78 billion. The creation of 20,000 soldiers may cost a total basic pay amounting to around PHP3.56 billion," Nograles said.

"As to the additional soldiers, we already created in 2017 for the Philippine Army 8,892 positions, which we are currently filling up," he added.

The Davao City lawmaker said the hiring of new uniformed personnel is necessary with the existing security challenges amid threats of terrorism and other forms of lawlessness.

“The Marawi crisis, the ongoing war against drugs and other forms of criminality that threaten the peace and security of the people are compelling reasons for us to prioritize the augmentation of our military and law enforcement personnel and the modernization of their weapons and equipment," he said.

According to the six-count indictment, 46-year-old Julia Poff mailed explosives to Governor Greg Abbott, President Barack Obama and Commissioner of the Social Security Administration Carolyn Colvin on Oct. 12, 2016.

Other court documents say Gov. Abbott opened the package, but it failed to explode because he didn't open it right. If opened correctly, documents say "it could've caused severe burns and death."

She was allegedly upset with Gov. Abbott for not receiving support from her ex-husband.
Federal investigators say they were able to connect Poff to the packages using pieces of the shipping labels, and also matched cat hair found in the box mailed to President Obama with her cat.

Poff has been charged with Injurious Articles as Nonmailable and Transportation of Explosives with the Intent to Kill and Injure for the crimes against the government officials.

Saudi Arabia's decision to ease its blockade on Yemen does not go far enough, say aid and human rights groups pointing to the spectre of famine that looms over the impoverished Arabian Peninsula country.

The kingdom has said it will ease its blockade on rebel-held parts of the country from Thursday and allow "urgent humanitarian and relief materials" to pass through the Red Sea port of Hodeidah and the capital's Sanaa international airport.

Saudi Arabia, which has been conducting an air campaign in Yemen since 2015, intensified its embargo on the country on November 5, closing all of the country's land, sea and air ports after Houthi rebels fired a ballistic missile towards the capital, Riyadh.

The kingdom said the blockade was a necessary precaution aimed at preventing weapons being smuggled into Yemen by its regional rival, Iran.

Iran has rejected allegations of arming the Houthis, calling them "malicious, irresponsible, destructive and provocative". - Aljazeera

DAVAO CITYâ€"More than 2,000 police and military personnel are now deployed to secure the week-long 6th Scout Association of Southeast Asian Nation (ASEAN) Boy Scout Jamboree on Nov. 27-Dec. 2 at the Energy Park, Apokon, Tagum city, Davao del Norte.

Police will strictly implement the security measures for the international event, said Police Supt. Julius Borja, the deputy provincial director for operations, during Wednesday’s AFP-PNP press conference held at Royal Mandaya Hotel.

“Today an accounting of personnel who will be involved on deployment are already done and tomorrow is the kick off ceremony on soft deployment on different areas of Tagum city,” Supt. Borja said.

About 29,000 delegates have already pledged to attend, including the scout masters and international teams, from 16 countries in Asia, the Boyscouts of the Philippines said.

Borja said government will implement a unified security effort together with the military, airforce, navy, aviation security group and Maritime police.

“The criminality threats, insurgency and terrorism we are considering that because we don’t want spillover that is why we consider that in our security preparation,” he said. (PNA/Rhoda Grace Saron)
