Philippine Laws / Leung Yee v. Strong Machinery
November 11, 2019, 01:56:10 AM
Leung Yee v. Strong Machinery (37 P 644)
- Compania Agricola Filipina purchased rice cleaning machines from Strong Machinery and executed a CM on the machines and building. Agricola failed to pay, so Strong Machinery foreclosed and recorded it in the Chattel Mortgage Registry. Leung Yee, another creditor of Agricola, purchased the same bldg and recorded it in Registry. Leung knew of Strong's claim though.

H: bldg is real prop BUT Strong has better right since Leung is a buyer in bad faith
The building is a real property, therefore, its sale as annotated in the Chattel Mortgage Registry cannot be given the legal effect of registration in the Registry of Real Property. The mere fact that the parties decided to deal with the building as personal property does not change its character as real property. Thus, neither the original registry in the chattel mortgage registry, nor the annotation in said registry of the sale of the mortgaged property had any effect on the building. (void as to 3rd persons)

Philippine Laws / Construction of all kinds
November 11, 2019, 01:52:56 AM
Constructions of all kinds:
- It is understood that the attachment must be more or less permanent. A wall or a fence is good example of this kind of immovable by incorporation.
- As long as there is intent to permanently annex the same, it is immaterial whether the materials used are only made of stone. Railroad tracks or rails come under this category.
- Wooden scaffoldings on which carpenters stand while constructing a house are merely personal property in view of the lack of "adherence" to the soil or the intent to permanently annex the same to the soil.

Buildings of permanent structure are always classified as immovable.

- It is immaterial whether it is built on a rented or owned land.

- The nature of the building as property does not depend on the way the parties deal with it (see: Leung Yee vs. Strong Machinery Co. 37 Phil 664.]

- Buildings are considered immovable provided they are more or less of a permanent structure, substantially adhering to the land, and not mere superimpositions (ex. of superimpositions are barong-barong, Quonset fixtures)

- A dismantled building or house and/or the materials of such dismantled house should be regarded as personal properties (see: Biscerra vs. Tenezz, 11-29-62,1, L-16218).

Land is the best example of immovable property:
- It is immovable by its very nature. And even, if land is moved by an earthquake or an extraordinary happening, the land should still be considered an immovable.
- Even if land is rented, it is still considered as immovable.
- A shovelful of land, however, should be considered personal property since this no longer adheres to the soil.

Philippine Laws / Classes of Immovable Property
November 11, 2019, 01:46:18 AM
Classes of Immovable Property:
1.)   Immovable by nature = those which cannot be moved from place to place because of their nature such as land (Art 415(1)), mines, quarries and slag dumps (Art 415(8));
2.)   Immovable by incorporation = those which are essentially movables but are attached to an immovable in such manner as to become an integral part thereof [Examples: those mentioned in par 1, 2, 3, 4 & 6 of Art 415, except land, buildings, and roads]
3.)   Immovable by destination = those which are essentially movables, but by the purpose for which they have been placed in an immovable, partake the nature of the latter because of the added utility derived there from (such as those mentioned in pars 4, 6,7 & 9 of Art 415); and
4.)   Immovable by analogy or by law = those mentioned in Art 415(10) -- right of usufruct easements, and servitudes.

With respect to machinery and equipment used for an industry or works
o   General rule: they may not be validly subject to replevin so long as they are intended by the owner for an industry and they directly meet the needs of the industry -- they are considered as real property. (They are not subject to replevin which is an action to recover specific personal property.)
o   Exception: when the machinery is placed by the lessee in the real estate leased to him by the owner of the real estate.
o   Exception to the exception: when the lessee places the machinery on the estate as an agent of the owner-lessor.

If a chattel mortgage is constituted over a building separately owned by the mortgagor, the same may still be valid and effective between the contracting parties by reason of estoppel provided no rights of third persons who are in good faith are impaired.
o   However, in case of foreclosure the mortgagor may proceed in accordance with the rules on foreclosure of real estate mortgage.

A building is considered an immovable property.
o   Even if the owner of the land is different from the owner of the building constructed on such land, the building does not lose its immovable character.

Philippine Laws / Importance of Property Classification
November 11, 2019, 01:12:31 AM
Importance of the classification:
It does not assume its importance from the fact of mobility or non-mobility but from the fact that different provisions of the law govern the acquisition, possession, disposition, loss, and registration of immovable and movable.

Examples:
a.   Donations
1)   real property (like land) = must be in a public instrument, otherwise, the alienation will be null and void even as between the parties.
2)   movable (like a ring valued at say P 5,000.00) = needs only to be in a private instrument. (Art748).

b.   Ownership by prescription
1)   real property (in bad faith) = 30 years (Art 1137)
2)   personal properly (in bad faith) = 8 years (Art 1132).

c.   Generally, to affect third persons, transactions involving
1)   real property must be recorded in the Registry of Property;
2)   personal property = need not be recorded

May parties by agreement treat as personal property that which by classification under the law is real property?

It would seem that under the Civil Code, it is only the LAW which may consider certain real property (like growing crops) as personal property for the purpose of making a chattel mortgage. (Art 416(2)) Also, for purposes of taxation, a real property may be considered as personal property.

Philippine Laws / Classification of Property
November 11, 2019, 01:10:06 AM
PROPERTY, classification:
a.   Immovable or real property; and
b.   Movable or personal property

Note: According to some authors, the classification given in Article 414 is not complete in that there should be a third classification the – "mixed" or the "semi-immovable". This classification refers to movable property like machines or removable houses or transplantable trees which under certain conditions, may be considered immovable by virtue of their being attached to an immovable for certain specified purposes.

Philippine Laws / What is appropriation of property?
November 11, 2019, 01:07:25 AM
What is appropriation?
The New Civil Law Code does not define what appropriation is, but it has been considered as equivalent to occupation, which is the willful apprehension of a corporeal object which has no owner, and with intent to acquire its ownership.

Anonymous Diary Blog / Kanye West Questioned
November 11, 2019, 12:45:47 AM
Posted by Ryan Liberty

Tell me again how he had a Paul moment? Here's the truth brethren, he is a wolf seeking to infiltrate the flock. He preaches another Gospel. He says false religions inspired by doctrines of devils have the same Gospel as us. But as I Said before and I say again if you can't see through Kanye you also will not be able to see through the Antichrist.

All roads lead back to Rome, can't you see their end goal? their motives? their love of money which is the root of all evil? They want a 1 world religion under their false messiah. The Antichrist is coming soon. Choose your side now whom you shall serve. The god of their fathers or the Holy Father in Heaven and Jesus Christ.

Don't be so naive. Oh but he invited someone to preach  a good message at his concert service... What a grand move... is that all a man has to do to win your applause? Test the spirits. You will know them by their fruit. Out of the abundance of the heart the mouth does speak. God said if anyone comes bringing a different Gospel let him be accursed.

Any man of God that is called to be an overseer of the flock is severely lacking in diligence if you neglect to warn the sheep when a wolf is in their midst. I'm not concerned with the wolves in the wolf pack. You are to sound the trumpet and ready the staff, which is the word of God.  His fangs have shown through the masquerade of  light.

Beware of wolves in sheep's clothing said our Master.

Galatians 1
8 But though we, or an angel from heaven, preach any other gospel unto you than that which we have preached unto you, let him be accursed.

9 As we said before, so say I now again, if any man preach any other gospel unto you than that ye have received, let him be accursed.

10 For do I now persuade men, or God? or do I seek to please men? for if I yet pleased men, I should not be the servant of Christ.

Alicia - Bohol / Founder of Alicia Musika Kawayan
November 11, 2019, 12:06:18 AM
By Kat Tamang (FB)

Kuya Ado is the founder of Alicia Musika Kawayan. According to him, he grew up turning to music to cope with his difficult family life. He wanted to have a musical instrument of his own but couldn't buy one because they didn't really have any money.

One day, his father came home drunk (or mad ) and threw some bamboo tubes in the ground. The impact on the floor gave off an interesting sound. That gave Kuya Ado the idea that they can be used to produce music. If he can't buy a musical instrument, he'd make one himself.

Kuya Ado made the instruments from scratch. He cuts the bamboo into long and short plates (or tubes), each one a specific length to bring out the appropriate tune. He also makes the sticks used to hit them. The result is a beautiful melody that everybody can enjoy.

"And knew not until the flood came, and took them all away: so shall also the coming of the Son of man be."
Matthew 24:39

Universal was the doom, neither rich nor poor escaped: the learned and the illiterate, the admired and the abhorred, the religious and the profane, the old and the young, all sank in one common ruin. Some had doubtless ridiculed the patriarchwhere now their merry jests? Others had threatened him for his zeal which they counted madnesswhere now their boastings and hard speeches? The critic who judged the old man's work is drowned in the same sea which covers his sneering companions. Those who spoke patronizingly of the good man's fidelity to his convictions, but shared not in them, have sunk to rise no more, and the workers who for pay helped to build the wondrous ark, are all lost also. The flood swept them all away, and made no single exception. Even so, out of Christ, final destruction is sure to every man of woman born; no rank, possession, or character, shall suffice to save a single soul who has not believed in the Lord Jesus. My soul, behold this wide-spread judgment and tremble at it.

How marvellous the general apathy! they were all eating and drinking, marrying and giving in marriage, till the awful morning dawned. There was not one wise man upon earth out of the ark. Folly duped the whole race, folly as to self-preservationthe most foolish of all follies. Folly in doubting the most true Godthe most malignant of fooleries. Strange, my soul, is it not? All men are negligent of their souls till grace gives them reason, then they leave their madness and act like rational beings, but not till then.

All, blessed be God, were safe in the ark, no ruin entered there. From the huge elephant down to the tiny mouse all were safe. The timid hare was equally secure with the courageous lion, the helpless cony as safe as the laborious ox. All are safe in Jesus. My soul, art thou in him?

Bible Study / The church in thy house
November 10, 2019, 10:31:43 AM
"The church in thy house."
Philemon 2

Is there a Church in this house? Are parents, children, friends, servants, all members of it? or are some still unconverted? Let us pause here and let the question go roundAm I a member of the Church in this house? How would father's heart leap for joy, and mother's eyes fill with holy tears if from the eldest to the youngest all were saved! Let us pray for this great mercy until the Lord shall grant it to us. Probably it had been the dearest object of Philemon's desires to have all his household saved; but it was not at first granted him in its fulness. He had a wicked servant, Onesimus, who, having wronged him, ran away from his service. His master's prayers followed him, and at last, as God would have it, Onesimus was led to hear Paul preach; his heart was touched, and he returned to Philemon, not only to be a faithful servant, but a brother beloved, adding another member to the Church in Philemon's house. Is there an unconverted servant or child absent this morning? Make special supplication that such may, on their return to their home, gladden all hearts with good news of what grace has done! Is there one present? Let him partake in the same earnest entreaty.

If there be such a Church in our house, let us order it well, and let all act as in the sight of God. Let us move in the common affairs of life with studied holiness, diligence, kindness, and integrity. More is expected of a Church than of an ordinary household; family worship must, in such a case, be more devout and hearty; internal love must be more warm and unbroken, and external conduct must be more sanctified and Christlike. We need not fear that the smallness of our number will put us out of the list of Churches, for the Holy Spirit has here enrolled a family-church in the inspired book of remembrance. As a Church let us now draw nigh to the great head of the one Church universal, and let us beseech him to give us grace to shine before men to the glory of his name.

"It is enough for the disciple that he be as his master." - - Matthew 10:25

No one will dispute this statement, for it would be unseemly for the servant to be exalted above his Master. When our Lord was on earth, what was the treatment he received? Were his claims acknowledged, his instructions followed, his perfections worshipped, by those whom he came to bless? No; "He was despised and rejected of men." Outside the camp was his place: cross-bearing was his occupation. Did the world yield him solace and rest? "Foxes have holes, and the birds of the air have nests; but the Son of man hath not where to lay his head." This inhospitable country afforded him no shelter: it cast him out and crucified him. Suchif you are a follower of Jesus, and maintain a consistent, Christ-like walk and conversationyou must expect to be the lot of that part of your spiritual life which, in its outward development, comes under the observation of men. They will treat it as they treated the Saviourthey will despise it. Dream not that worldlings will admire you, or that the more holy and the more Christ-like you are, the more peaceably people will act towards you. They prized not the polished gem, how should they value the jewel in the rough? "If they have called the Master of the house Beelzebub, how much more shall they call them of his household?" If we were more like Christ, we should be more hated by his enemies. It were a sad dishonour to a child of God to be the world's favourite. It is a very ill omen to hear a wicked world clap its hands and shout "Well done" to the Christian man. He may begin to look to his character, and wonder whether he has not been doing wrong, when the unrighteous give him their approbation. Let us be true to our Master, and have no friendship with a blind and base world which scorns and rejects him. Far be it from us to seek a crown of honour where our Lord found a coronet of thorn.

Anonymous Diary Blog / The eternal God is thy refuge
November 10, 2019, 10:26:32 AM
"The eternal God is thy refuge."

- - Deuteronomy 33:27 - -

The word refuge may be translated "mansion," or "abiding- place," which gives the thought that God is our abode, our home. There is a fulness and sweetness in the metaphor, for dear to our hearts is our home, although it be the humblest cottage, or the scantiest garret; and dearer far is our blessed God, in whom we live, and move, and have our being. It is at home that we feel safe: we shut the world out and dwell in quiet security. So when we are with our God we "fear no evil." He is our shelter and retreat, our abiding refuge. At home, we take our rest; it is there we find repose after the fatigue and toil of the day. And so our hearts find rest in God, when, wearied with life's conflict, we turn to him, and our soul dwells at ease. At home, also, we let our hearts loose; we are not afraid of being misunderstood, nor of our words being misconstrued. So when we are with God we can commune freely with him, laying open all our hidden desires; for if the "secret of the Lord is with them that fear him," the secrets of them that fear him ought to be, and must be, with their Lord. Home, too, is the place of our truest and purest happiness: and it is in God that our hearts find their deepest delight. We have joy in him which far surpasses all other joy. It is also for home that we work and labour. The thought of it gives strength to bear the daily burden, and quickens the fingers to perform the task; and in this sense we may also say that God is our home. Love to him strengthens us. We think of him in the person of his dear Son; and a glimpse of the suffering face of the Redeemer constrains us to labour in his cause. We feel that we must work, for we have brethren yet to be saved, and we have our Father's heart to make glad by bringing home his wandering sons; we would fill with holy mirth the sacred family among whom we dwell. Happy are those who have thus the God of Jacob for their refuge!

Proverbs 1 - New English Translation
Introduction to the Book
1  The Proverbs of Solomon son of David, king of Israel:

2  To learn wisdom and moral instruction, and to discern wise counsel.

3  To receive moral instruction in skillful living, in righteousness, justice, and equity.

4  To impart shrewdness to the morally naive, and a discerning plan to the young person.

5  (Let the wise also hear and gain instruction, and let the discerning acquire guidance!)

6  To discern the meaning of a proverb and a parable, the sayings of the wise and their riddles.

Introduction to the Theme of the Book
7  Fearing the LORD is the beginning of moral knowledge, but fools despise wisdom and instruction.

8  Listen, my child, to the instruction from your father, and do not forsake the teaching from your mother.

9  For they will be like an elegant garland on your head, and like pendants around your neck.

Admonition to Avoid Easy but Unjust Riches
10  My child, if sinners try to entice you, do not consent!

11  If they say, "Come with us! We will lie in wait to shed blood; we will ambush an innocent person capriciously.

12  We will swallow them alive like Sheol, those full of vigor like those going down to the Pit.

13  We will seize all kinds of precious wealth; we will fill our houses with plunder.

14  Join with us! We will all share equally in what we steal."

 15  My child, do not go down their way, withhold yourself from their path;

16  for they are eager to inflict harm, and they hasten to shed blood.

17  Surely it is futile to spread a net in plain sight of any bird,

18  but these men lie in wait for their own blood, they ambush their own lives!

19  Such are the ways of all who gain profit unjustly; it takes away the life of those who obtain it!

Warning Against Disregarding Wisdom
 20  Wisdom calls out in the street, she shouts loudly in the plazas;

21  at the head of the noisy streets she calls, in the entrances of the gates in the city she utters her words:

22  "How long will you simpletons love naiveté? How long will mockers delight in mockery and fools hate knowledge?

23  If only you will respond to my rebuke, then I will pour out my thoughts to you and I will make my words known to you.

24  However, because I called but you refused to listen, because I stretched out my hand but no one paid attention,

25  because you neglected all my advice, and did not comply with my rebuke,

26  so I myself will laugh when disaster strikes you, I will mock when what you dread comes,

27  when what you dread comes like a whirlwind, and disaster strikes you like a devastating storm, when distressing trouble comes on you.

28  Then they will call to me, but I will not answer; they will diligently seek me, but they will not find me.

29  Because they hated moral knowledge, and did not choose to fear the LORD,

30  they did not comply with my advice, they spurned all my rebuke.

31  Therefore they will eat from the fruit of their way, and they will be stuffed full of their own counsel.

32  For the waywardness of the simpletons will kill them, and the careless ease of fools will destroy them.

33  But the one who listens to me will live in security, and will be at ease from the dread of harm.

Real Estate Property / Why Become a Real Estate Agent
November 10, 2019, 03:30:11 AM
WHY BECOME A REAL ESTATE AGENT
BY LUCELL LARAWAN

"Real estate is an imperishable asset, ever-increasing in value. It is the most solid security that human ingenuity has devised. It is the basis of all security and about the only indestructible security," averred Russel Sage, an American financier and politician. No wonder, investors and end-users find it attractive.

As there are many investors, the demand for real estate agents is also on the rise. Why do they find this role attractive? Aside from one's autonomy in spending his or her time and the lure of big commissions, there are other reasons the seasoned agents can share.

Unlike many professions that require schooling which shells out P30,000 to P50,000 on tuition and miscellaneous fees per semester in four years or more, a real estate salesman only needs an accreditation which can later be upgraded into a real estate broker's license. One can only finish 72 units in college and get accredited as an agent. A medical doctor cannot take the job of an engineer, nor can an engineer assume the role of the doctor; but both the doctor and the engineer can become a real estate agent. In other words, the barriers to entry is not high while the income potential can be a big leap—at least four times more than what the average employee gets if an agent sells a property. This profession depends more on one's work ethics, a determinant that is far better than what runs some offices where politics demoralizes.

Aside from needing only low personal investments to become agents, real estate professionals enjoy travel. One sales director said about what makes her enjoy her career: "I have to say travel. A country and a hotel of your choice. Good thing my company doesn't scrimp on their incentives." I have heard that Filinvest gives an international travel as an incentive to those who put in a certain sales figure.

One thing that energizes an aspiring real estate agent is the commission for a single sales transaction. This means more financial freedom where one can buy what he wants and invest in a business. Though the typical agent gets an allowance of P10,000 to P15,000 a month, one gets at least two to three percent commission, depending on the developer. Three percent of a house worth more than P5 million is equivalent to P150,000 which means diligence is the key to one's success in this profession.

Sometimes, a real estate company gives high-end gadgets and cars aside from the usual cash incentives for agents and brokers.

The rewards of real estate agents are not only the tangibles. Some seasoned brokers say that they feel fulfilment in helping clients choose their right home.

To prove my point, a survey by Careerbliss, cited by Forbes, reveals that real estate agent job emerged as the happiest job-- a career "that will bring a smile to your face." This is because besides giving enticing income and numerous perks, the field allows for and professional growth, and its industry is ever evolving.

To help fellow Boholanos find income opportunities through a career that gives one's peep-o-day, I must inform them that Filinvest Land, Inc. is now hiring for real estate agents for condos at One Oasis Cebu. The company is looking for talents who possess: a) an affable personality; b) a reputable record in selling, but not a requirement; c) integrity; d) willingness to be trained; e) a mind-set that hungers for achievement; f) at least 72 units in college; and g) diligence in connecting with prospect clients.

As a backgrounder, Filinvest is the 9th top real property developer in the country which has operated for more than 50 years ago. With a diverse property portfolio catering to all markets and an assessed value of P532.33 billion in 2017, it has developed in 48 cities and towns over 2,500 hectares of land and more than 600,000 square meters of prime office, residential and retail spaces. The company is built on the Gotianun tradition of integrity, quality and service.

Be an agent of Filinvest. Attend its first interview and business opportunity meeting on November 26 and 27 (venue will be announced later). Bring your curriculum vitae or resume. To confirm your attendance, send a text message of your full name to mobile number 0919-4136604.

Bohol Latest News / New Tourism Products in Bohol
November 09, 2019, 05:59:34 PM
Tourism stakeholders
Inspect new products

TAGBILARAN CITY, Bohol, November 9, (PIA)—Taking cue from the projections in tourist arrivals in the next few months, Bohol Tourism Office under the Office of the Governor ventures into inspecting new tourism products developed to help decongest the main circuits and spread the benefits of tourism to other areas.

A team from the BTO composed of tourism product development specialists Gina P Kapirig, Cristopher Boncales, Bohol Federation of Tour and Travel Operators (BEFETTO) represented by Lourdes Sultan, Lenlen Bullecer, and Sarah Dejaresco, the Philippine Information Agency and some tour guides visited newly developed products November 5.

We want to inspect these newly developed destinations and accommodations, update them of the standards that we are following, make sure they also follow the minimum and still come up with a uniquely Boholano experience for tourists, Kapirig explained, during the ocular visit.

This also helps our tour and travel operators to see for themselves and think of creative ways to packaged and sell these destinations and accommodations, as our way of helping them out, she added.

It may be recalled that Bohol has put up a vision to become a prime eco-cultural tourism destination with a strong agro-economy and information, communication technology since then.

With this, the team also looks at how resorts and accommodations as well as newly developed destinations support the over-all vision and be guided by it.

In the itinerary for the day was Bung-aw Eco-Farm of Bugtongbod, Clarin, RJ Javier Tropical Fruits Farm in Cagawasan, Pilar, Bohol Foods (cacao) Farm in Tambo-an Carmen.

The team was also supposed to go to Pangas Falls in Barangay Dagohoy, Bilar but the team run out of time for that.

Bung-aw Eco Farm is a pool resort and eco-garden nestled on top of a cliff overlooking the panoramic Inabanga-Clarin sea and distant Cebu.

Boasting of its manicured sweeping lawns, garden trails, horseback and all-terrain vehicle rides as well as a splendid panorama as it overlooks Clarin and Inabanga towns, Bung-aw also boasts of unique accommodations: spoke-shaved bamboo huts like the ones you see displayed along the highways here.

Owned and operated by Angie Hoffman to offer Panglao guests with an entirely different recluse, Bung-aw also offers overnight packages and pool use, and with a small restaurant that seats about 30 people, one can be assured of a delectable menu and service that is at par with international tastes.

On the other hand, as soon as the farm gate opens, a colorful flower garden and an opportunity to ground with the earth on a barefoot earthing walk sets the tone for a tour ate RJ Javier Tropical Fruits Farm in Cagawasan, Pilar.

The arthing walk also ushers one to the sunflower alley, which leads to the sprawling tropical fruit farm that boasts of hectares upon hectares of tropical fruits, 22 kinds of them and only two or three have not been fruiting.

Foremost among their produce are the guapples (guava-apples), pineapple, lemons, guyabano, rambutan, passion fruit, veggeis and herbs as the owners RJ and Roel Javier also offers pick and pay schemes.

The farm also offers tours and farming lectures and inputs that include balancing the soil's acidity, pollination, organic fertilization and other sustainable agriculture technologies.

Bohol Food Farm is a primarily papaya, cacao, and vegetable farm on the outskirts of Acacia Glamping Camp in Tambo-an, Carmen.

A farm located in the generally flat-lands of the barangay, growing a papaya variety that is suited for ripening is the farm's main attraction.

Among its sprawling tracts of farm however is cacao, the plant whose seeds from its pod, when roasted, is the material for everyone's favorite chocolates.

A cacao farm tour can be arranged, while tourists can also pick and pay from the farm. (rahc/PIA-7/Bohol)

DTI Usec Castelo: Bohol
goods cheaper than SRP

TAGBILARAN CITY, Bohol, Nov 9 (PIA)--Believe it or not, there are more consumer products in Bohol malls that are priced lower than Department of Trade and Industry (DTI) suggested retail prices (SRP).

This was the observation of DTI undersecretary for consumer protection group, Usec. Ruth Castelo, who swung to the malls Saturday, November 9, to check and monitor the prices of basic commodities as controlled by the government.

Usec Castelo, who flew into town to attend the ASEAN Consultative Committee Meeting on Standards and Quality, Nov 5-8 at the Hennan Resort in Panglao, took a time off her schedules to monitor prices here and assure  Bohol consumers that prices of basic goods are right.

This, DTI Bohol Provincial Director Maria Soledad Balistoy said, assures minimum wage workers that they can still get the best value for their money.

Although there were a few products that were not compliant with the SRP, she advanced the information that the store is open to rectifying the price difference.

The SRP is well implemented, [in Bohol] overflowing ang supply and mas advanced nga [in terms of set-up and security], nakakapagcomply sa SRP, Castelo, who is a self-confessed Manileña, told media during the price monitoring sortie at the Island City Mall, Saturday.

And, despite all these, she assured that the local DTI Consumer Products Division would be continuing weekly the price monitoring, so make sure that the October 31 SRP will be followed until Christmas.

"We do not expect any price movements until next year, or until a now SRP advisory comes out then," Usec Castelo assures.

Among the goods the DTI official inspected are the noche buena items: queso de bola, cheese, sandwich spread, mayonnaise, pasta spaghetti, elbow and salad macaroni, spaghetti sauce, tomato sauce and creamer products, among the 134 products which has the DTI SRP issued since October 31.

In Bohol, where there is an ongoing entry ban on pork meat products as the African Swine Fever continues to be a threat, DTI said there is still one product that displays ham and  processed meat, and they have sufficient supply.

Besides, insiders said the hams were earlier prepared, way before the ASF scare exploded, and this should make the products safe for human consumption and ASF free.

There is still one brand that is now displayed in the Visayas that we can be assured ASF-free.

What is important is the availability of the products to consumers, and the one that is available follows the SRP, she bared. (rahc/PIA-7/Bohol)

Bohol Latest News / Blood bank in Gallares Hospital
November 09, 2019, 12:27:56 PM
GCGMH opens new
modern blood bank

TAGBILARAN CITY, Bohol, November 8 (PIA)— Gov. Celestino Gallares Memorial Hospital (GCGMH) inches its way to be true to its mantra, when it opened its new hospital blood bank, to serve more Boholanos, in fitting ecumenical services November 7.

A blood bank is a facility where blood gathered from blood donation is stored and preserved for later use in blood transfusion. Aside from storage, a blood bank also performs proper testing to reduce the risk of transfusion related adverse events, and the systematic separation of blood components for specific blood transfusion needs of patients.

Rev. Fr. Abelardo Omping, PACEM and GCGMH in-house preacher Pastor Felix Bernaldez joined forces during the blessing and launching of the new blood bank which is or spacious, better equipped and more modern blood collection and storage center inside Bohol's lead blood service facility.

Now adopting a brand of service in its mantra "so kind, so Gallares," the only tertiary public hospital which used to be limping with allegations of inefficiency, mismanagement and lousy care has now picked up pace to claim its rightful place in its promise to provide the highest standards of hospital service to its constituents.

Hospital Chief Dr. Mutya Kismet Macuno congratulated the hospital's pathology department headed by Dr. Anette Salillas for the momentous and grandiose milestone with exponential effects to their patients.

"This means another [opportunity to] manifest our commitment to help patients in need," the hospital director said.

Meanwhile, Dr Salillas stressed that the new development only shows how Gallares is committed to provide the highest standards of care.

"The bigger and more improved blood bank marks another milestone in GCGMH promise of service to the Boholano people," she said.

"Small, the steps maybe, but by these, we get closer to where we want. With every step, we can travel farther," she pointed out.

Dr. Macuno then recalled how Gallares was hunched with issues of unavailability of blood and the request process if there are, fells like going past seven hills. Macuno, who runs trails, said she knows how tough it can get past one hill.

When we were faced with the challenge, we rise up to the occasion, faced the challenge and struggled to win over the challenge, Macuno describes her general stint at the hospital.

She recalled that it was once Dr Juanita Arcay, the pathology department head then, who conceptualized the blood bank and achieved the status as one of the most sought after residency training hubs.

Now equipped too with a modern apheresis machine, the blood center now has a capacity to receive blood from a patient or donor and separate it into its various blood components: plasma, platelets, white blood cells and red blood cells.

Or the machine can only take the needed blood component, and return the other components to the body.

The new blood bank, with its two standing refrigerators, can accommodate about 400 blood units a day, and the apheresis machine even expands the blood bank's string capacity as it can already extract platelets via the machine which needs no refrigeration anymore.

Cancer and dengue patients specifically need huge storage of blood units which often congests their refrigerators, according to Blood Bank nurse Nickson Felix Epe. (rahc/PIA-7/Bohol)

BETTER BLOOD COLLECTION, STORAGE. Gov. Celestino Gallares Memorial Hospital director Dr. Mutya Kismet Macuno and Dr Anette Salillas along with Bohol Disaster Officer Anthony Damalerio formalize the operation of the new, spacious and  modern hospital blood bank with larger storage capacity to serve Bohol patients. Jan. 4, 2009 - The amendment of the Revenue Code of Bacolod City is a significant factor that will help increase the budget of the city, Bacolod City Mayor Evelio Leonardia yesterday said.

The Bacolod Sangguniang Panlungsod approved last month an ordinance revising the Local Revenue Code of Bacolod City.

Leonardia said this is long overdue as this is the first time in 15 years that Bacolod City has revised its local revenue code.

He said that if they had followed the normal process, they could have increased the income of the city by three times.

"If you talk of 15 years, at the rate things have grown and the prices have risen, the increase of 10 percent, divided by 15 years, is not even one percent per year," he added.

Leonardia said he believes that the revision of the Local Revenue Code was the proper thing to do. Besides the city is growing and it needs more revenues to better serve its people, he said.

Councilor Al Victor Espino, chairman of the Committee on Finance and Appropriations, said the revision of the Local Revenue Code will mean an increase of about P40 million a year for the city.

Meanwhile, Leonardia thanked Vice Mayor Jude Thaddeus Sayson and the SP for approving the new budget.

The SP approved the 2009 annual budget of Bacolod City during their first regular session at the Bacolod City Government Center last Dec. 22, 2008.

The budget was passed subject to certain conditions and shows an increase of 10 percent over last year's.

Leonardia said this is very encouraging because there were local government units before that, upon reaching P1 billion, were not able to sustain their budget the following year.

He said "Our budget shows that our city is healthy, vibrant and progressive."

Leonardia said he had read in the newspapers that the budget of Bacolod City is exactly the same as the budget of the province of Iloilo, which shows that the status of Bacolod is similar to that of a province.

Iloilo is also one of the premier provinces in the Philippines, Leonardia said. "So that proves that Bacolod, indeed, is developing and progressing at a very fast rate," he said.

Leonardia also said that, before, the budget of the city lagged behind those of other LGU's. "But now Bacolod is among the leaders, not only in the region but, I believe, in the whole Philippines," he added.*CGS

Philippine Provinces / CARP Extension
November 09, 2019, 12:15:47 PM
By Carla P Gomez
January 4, 2009 - The Comprehensive Agrarian Reform Law expired on Dec. 31 so there can be no legal movement of the CARP, Rep. Jose Carlos Lacson (Neg. Occidental, 3rd District) said yesterday.

That is because the president has not signed the joint resolution passed by the Senate and House extending the program for six months, minus the compulsory acquisition of land, he said.

Implementation of CARP from here on will only have a legal effect  if the president signs the joint resolution, or when it lapses into force of law on Jan. 22, he said.

Malacañang has said that the President would let the joint resolution lapse into law, which takes place 30 days after the Office of the President receives the measure.

"Even if the President allows the joint resolution to lapse into law by January 22, or 30 days after the enrolled copy of the joint resolution was officially received by the Office of the President on Dec. 23, 2008, there is no more LAD (land acquisition and distribution) to extend because it has already expired earlier. Once the deadline sought to be extended has expired, no belated extension could be effected," Albay Rep. Edcel Lagman said in a statement.

Lagman urged the House of Representatives to convert his pending CARP extension bill into one reviving the program's land acquisition and distribution component, including compulsory acquisition. His bill had sought to extend CARP for five years and provide it with a P100-billion budget.

Anakpawis party-list Representative Rafael "Ka Paeng" Mariano in a statement he issued yesterday said that House Bill 4077 cannot be converted into a land acquisition and distribution revival measure and resurrect the dead CARP.

"House Bill 4077 cannot resurrect the bogus CARP from the dead. It is long overdue to send this bill to the legislative archives," Mariano said."

"The sham CARP already expired. They should file a new agrarian reform bill, let it go through the legislative process, and not simply convert HB 4077 into a substitute bill," Mariano said.

Mariano appealed to Lagman and the House leadership to discuss House Bill 3059, a new and Genuine Agrarian Reform Bill pending before the House and "make it a priority legislative measure to enact a new, genuine, thoroughgoing and redistributive land reform program."

The GARB aims to cover all agricultural lands, without exemption and exclusion, and the free distribution of lands to farmers as its central goal. Within five years from the effectivity of the measure, the Department of Agrarian Reform is mandated to complete distributing land to beneficiaries, he said.*CPG

Press Release
DSWD: All quake-affected families will be provided with assistance

Davao del Sur – Grace Q. Subong, OIC-Regional Director of the Department of Social Welfare and Development (DSWD) Field Office XI, clarifies that all families affected by the series of earthquakes in Davao Region will be provided with appropriate assistance from the department.

"Regardless if these families are outside or inside the camps, DSWD is still mandated to provide for them," Director Subong said during her visit in the camps on Thursday morning.

This is in response to reports surfacing that only those who are inside the evacuation centers will be given assistance.

"Our goal is not to encourage families to flock in the evacuation centers. That's why we have to also provide for the families in spontaneous settlements or those temporarily staying in the open space near their homes," she added.

Data from the Disaster Response Operations Monitoring and Information Center (DROMIC) show that there was an increase in the number of families staying in the forty-one (41) evacuation centers in Davao del Sur.

To date, the total cost of assistance provided by DSWD XI to the 18,549 affected families in Davao Region is P12,126,731.00. (DSWD XI)

WASHINGTON (PRWEB) NOVEMBER 07, 2019

Pype, a leading software-as-a-service (SaaS) family of products for the construction industry, announced today its enterprise partnership with Hawaiian Dredging Construction Company, Inc. (HDCC), a full-service general contractor serving the state of Hawaii since 1902.

HDCC came to Pype seeking an intuitive solution that could streamline the process of creating submittal logs. The general contractor was following a standard procedure of creating the logs from scratch using spreadsheet software, and the process took up to a month of skilled work to complete for large projects.

"For every construction company today, time is an incredibly precious resource," said Sunil Dorairajan, co-founder and CEO of Pype. "At Pype, our goal is to utilize artificial intelligence and machine learning to create structure from unstructured data to mitigate project risks. If we can add capacity to a company by making contract compliance data more accessible, they can better invest their employees' skills to execute projects more effectively and positively affect the bottom line."

Since deploying AutoSpecs, HDCC reports they have been able to reduce the time spent on developing submittal logs for large-scale projects from one month of skilled work to one week.

"Being able to wrap your head around submittals earlier in a project's life cycle is a benefit to the entire team," said Christopher Baze, BIM manager at Hawaiian Dredging Company. "During an industry-wide labor shortage, time and efficiency are critical for construction professionals. When using AutoSpecs, we've found the turnaround from initially uploading a PDF to getting accurate results within minutes is truly a 'wow' moment."

Pype was recognized as one of Builtworld's top 50 software companies in 2018 and has become a staple in construction compliance and risk management. Pype's software integrates with other platforms, such as project management and document management tools, and its solutions are currently used by over 150 of ENR's top 400 companies. The Hybrid ColoCoil joins the most widely applied, self-contained family of ColoCoil AM isolation systems offered by LBA Technology, Inc., a unit of LBA Group, Inc. This next generation of the patented LBA ColoCoil provides seamless integration and isolation of hybrid cable on "hot" AM radio towers.

The nature of an AM radio tower requires that any metallic cable running to the AM tower must be electrically isolated from the tower to prevent disruption of the AM transmission. In many cases this means the use of what's generally referred to as an AM isocoupler. Hybrid cable is not excluded from this requirement. While the fiber does not have to be isolated, any DC or alarm wire pairs in a hybrid cable must be isolated from the AM tower.

With the growing use of remote radio heads (RRH) or remote radio units (RRU) by wireless carriers, the Hybrid ColoCoil allows the hybrid cable feeding these on-tower carrier systems to be run across the base of an AM tower with all wire pairs isolated from the AM. These precision designed LBA hybrid cable isolation systems can accommodate any model of hybrid cable on the market.

The LBA Hybrid ColoCoil is designed with features that add significantly to ease of installation, footprint conservation and long-term dependable operation. All fiber and the copper pairs terminate inside the unit eliminating the need to provide the entire length of hybrid cable as part of the manufacturing process. The system cabinets are designed to stack on top of one another, conserving ground space. The Hybrid ColoCoil also offers the option of not having to run hybrid cable from carrier equipment on the ground or in a building to the input of the system. If preferred, fiber and copper can be run separately in conduit to the LBA isolation system.

The Hybrid ColoCoil adds to installation ease in upgrade projects with the same size and footprint as LBA's most widely used and patented RF coax ColoCoils in use at hundreds of AM stations across the country. This means the Hybrid ColoCoil can replace a coax ColoCoil or be stacked on top of an existing coax ColoCoil, eliminating the need to expand the equipment footprint.

"The LBA research and development team invested countless hours in the creation of this latest addition to its patented line of AM isolation systems," LBA's Director of Sales, Jerry Brown said. "This latest addition makes carrier deployment of RRH's on AM towers efficient, dependable and cost effective," he added.

For more information on the new LBA Hybrid ColoCoil and the entire line of AM isolation systems offered by LBA visit: https://www.lbagroup.com/products/colocoil-am-isocouplers-enable-cellular-coax-or-hybrid-AM-tower-collocation or contact David Horn at 252-757-0279, david.horn@lbagroup.com.

Bohol Latest News / Salary increase for Capitol casuals
November 07, 2019, 12:36:32 PM
By Ven Arigo

DILI UNTA UNA IPALUSOT

(Ven rebo Arigo / Capitol foto, Ramil Rodela)

Talk of the Town / Benefits of SSS
November 06, 2019, 09:44:48 PM

(rahc/PIA-7/Bohol)

Bohol Latest News / Ex NPAs enrolled in TESDA courses
November 06, 2019, 09:32:20 PM
TESDA graduates 115
work-trained former NPAs

TAGBILARAN CITY, Bohol, October 28 (PIA)—Nurturing and guiding them back to the mainstream, government agencies in Bohol took convergence again to a new level showing the rare Bayanihan spirit in hand-guiding 115 former rebels towards self-sufficiency and productivity towards gainful employment and sustain a peaceful productive life away from the mountains.

Led by Technical Education and Skills Development Authority (TESDA), Bohol and its and its partner agencies collaborated in the implementation of Executive Order No. 70 (E.O. 70) or the Whole-Of-Nation Approach in attaining development and peace-building initiatives in conflict-affected areas and worked hand in hand to train these acclaimed freedom fighters on the skills they would need to survive in peaceful environment.

While then brandishing arms to effect the change they want in the society, these former rebels who finally decided to go the way to peace still have the desire to make the change, what a better way than to make it by themselves through construction?

Seeing this potential, TESDA looked at the possibility of getting them the skills and the competence to bring about the help for the Build, Build Program of the government.

Enrolled in the different courses in the construction sector, the former rebels took on Shielded Metal Arc Welding with national certification 2 (NC II), Electrical Installation and Maintenance (NC II) in TESDA Pilar Training Center (PTC), while women went on to PTC Bilar for the Bread and Pastry Production NC II.

In some areas, some former rebels now companions in reform took the services of TESDA accredited private training institutions like the Cebu Science of Welding and Skills Technology, Inc. (CSWSTI), Dumaguete Christian School Inc. and the Maribojoc Demo Farm.

These centers also offer Carpentry NC II, Bread and Pastry Production NC II and Organic Agriculture Production NC II respectively, in support of the builders of the program.

Bohol TESDA Provincial Director Grace Corazon Castillo, the chairperson of Task Force Dagohoy, a provincial task force created to End Local Communist Armed Conflict (ELCAC) particularly the Poverty Reduction, Livelihood and Employment Cluster (PRLEC) thanked the implementing institutions in providing skills training to this marginalized group.

"We are determined to help Boholanos particularly the former rebels rise, start anew and be ready to work with our government," TESDA-Bohol Provincial Director, Grace Corazon C. Castillo, who has since retired from service said.
Castillo, who had served the government through the TESDA also expressed her gratitude for the combined efforts of the task force as she delivered her speech during the ceremony, held in Camp Rajah Sikatuna in Carmen Bohol last September 25, 2019.
That day was a happy day for the former rebels as they gathered anew, now in a happy environment, unlike the times when they huddle in some forests, ready to scamper to safety anytime a threat is seen.

This time, the former rebels took to the aisles in an army base, beaming with pride as their receive their certificates of graduation from the courses that would hand them sustainable livelihood, and off the time when they would feed their families with money extorted from some businessmen.

The mass graduation given by the country's premiere technical skills education, and the success of the program would not also be possible without the presence and support of the of the provincial government of Bohol, governor, Arthur C. Yap represented by Mr. Pedro Budiongan, Leo Rubia representing Mayor Ricardo Francisco A. Turibio of the Municipality of Carmen, Jerome Gabin in behalf of Maria Soledad L. Balistoy of the Department of Trade and Industry (DTI), the Bureau of Fisheries and Aquatic Resources with Victor Doblas in behalf of Candido T. Samijon and with the all-out support of the Police and Military Forces.

TESDA specifically thanks the Philippine National Police (PNP) through Police Col. Jonathan A. Cabal represented by Police Lt. Conrado Manatad and the Philippine Army, with Maj. Jose Virgilio Pabon, Executive Officer of the 47 IB-Katapatan Batallion:  the country's two strong forces directed to protect life, liberty and property in the country. BFAR red flags Dauis
Tagbilaran bays for red tide

TAGBILARAN CITY, Bohol, November 2 (PIA)—What could be in the waters off Tagbilaran City Bay specifically between Tagbilaran City and Dauis town in Panglao Island that has kept the seas off it positive for red tide for over a year now?

While environmentalists surmise that it may be the impeded flow of the tides caused by the two bridges to Panglao and the pollution which they ascribe to the city residents and the nearby Badjao community, Bureau of Fisheries and Aquatic Resources (BFAR) has said the said area, along with eight other bays in the country have tested positive for paralytic shellfish poison (PSP).

PSP or otherwise known as redtide is a marine phenomenon that allows the blooming of algae, which in large numbers, can alter the marine environment as the shellfish and bottom feeders can ingest the alga bloom which can be harmful to humans sue to its toxicity.

In its Shellfish Bulletin No, 20, series of 2019, the BFAR has ordered the no harvesting, no selling, no buying and no eating of shellfish from the coastal waters of Dauis and Tagbilaran City.

The bulletin, issued by Department of Agriculture Undersecretary for Fisheries Director Eduardo Gungona, bared that  upon laboratory tests, results proved that the shellfish collected from the coastal waters of Dauis and Tagbilaran City in Bohol, along with those from Puerto Princesa Bay in Palawan, Irong-irong and Silanga Bays in Western Samar, Coastal waters of Bataan which includes Mariveles, Limay, Orion, Pilar, Balanga, Hermosa, Orani, Abucay and Samal, Coastal waters f Pampanga and coastal waters of Sual in Pangasinan are positive for PSP beyond regulatory limits.

To this, BFAR has cautioned people from gathering, selling, buying or eating shellfish and alamang from these mentioned areas as they are not safe for human consumption.

On the other hand, fish, squid, shrimps and crabs are safe for human consumption provided that they are fresh and are washed thoroughly.

By washing thoroughly, it means gills and internal organs have been removed prior to cooking, according to BFAR. (rahc/PIA-7/Bohol)

FOTOS:
BLUEGREEN BUT RED. BFAR has tagged Tagbilaran Dauis bays in Bohol as positive for elevated levels of Paralytic Shellfish Poison, an effect when shellfish feed on the algal bloom in the water. Dauis and Tagbilaran bays also happen to be a favorite playground for dragonboat paddlers. (rahc/PIA-7/Bohol)

Bohol Latest News / Remembering Pres. Carlos P. Garcia
November 06, 2019, 09:22:48 PM
Privilege speech by Rep. Edgar M. Chatto
REMEMBERING CARLOS P. GARCIA
[Privilege Speech delivered by Rep. Edgar Chatto
in Congress yesterday, Nov. 4, 2019

Honorable Speaker, my dear colleagues, today I want to say "Happy 123rd Birthday to Bohol's most illustrious son, President Carlos P. Garcia" – the 8th President of the Republic of the Philippines.

It was on November 4, 1896 when Mayor Policronio Garcia and Ambrosia Politisco welcomed their second child – Caloy, in the municipality of Talibon in the province of Bohol.

Caloy acquired his primary education in his native town Talibon, then took his secondary education in Cebu Provincial High School, now Abellana National School, both at the top of his class. Initially, he pursued his college education at Silliman University in Dumaguete City, Negros Oriental, and later studied at the Philippine Law Schoolwhere he earned his law degree in 1923 and later, he received his honorary degree, Doctor of Humanities, Honoris Causa from National University in 1961. He was top 7 in the 1923 bar.

Rather than practice law right away, he worked as a teacher for two (2) years at Bohol Provincial High School. He became famous for his poetry in Bohol, where he earned the nickname "Prince of Visayan Poets" and the "Bard from Bohol". His most famous poem is entitled "Ang DalagangPilipinhon".

FIRST GOVERNOR UNDER AMERICAN REGIME

The young Carlos P. Garcia entered politics for the first time at the age of 29, was elected Bohol's 3rd District Representative in 1925 and served three terms until1931. He became Bohol Governor from 1934 to 1941. He was the last provincial governor under the American Regime.

He served the Senate for three terms from 1941 to 1953, interrupted by World War II.A neophyte senator in 1941, President Quezon told Garcia to go home to Bohol to help the people carry the hardships of the occupation when the Japanese invasion disrupted government functions.

Garcia refused to cooperate with the Japanese during the war. He did not surrender even when he was placed on the wanted list with a Php 50,000.00 price on his head. He, instead, took part in the guerilla activities and served as adviser in the free government organized in Boholearning even more trust and fame from his co-guerillas and the national leaders who learned of his exploits in Bohol.

SENATE MAJORITY LEADER

When he resumed duties as senator after the war in 1945, he was chosen Senate majority floor leader. The press consistently voted him as one of the most outstanding senators.

After the war, he also participated in several missions to Washington to work for the approval of the Philippine Rehabilitation and War Damage Claims. He was a delegate to the World Conference at San Francisco to draft the charter of the United Nations Organization in May 1945. He acted as presiding officer of the Southeast Asia Treaty Organization Conference in Manila in 1954, which produced the Manila Treaty and the Pacific Charter.

VICE PRESIDENT OF MAGSAYSAY

By 1953, Garcia was so popular that he was picked to be the running mate of Ramon Magsaysay, and they both won in the elections.

On March 17, 1957, President Ramon Magsaysay died in a plane crash in Cebu. This ushered Garcia's eventual ascent to the country's top seat to lead the country until the end of the remaining term.By the next presidential elections, Garcia won with Diosdado Macapagal as Vice President.

Garcia's transition to the national politics was not without an interesting story, Bohol historian Jose MarianitoLuspo recounted how the death of Senator Jose Arsenio Clarin, the senate speaker pro tempore and the country's third most powerful man, seemingly opened a way for the Boholano teacher, poet, and governor to start his path to the country's top seat.

It was said that the sudden death of Senator Clarin in 1935 had President Quezon's executive secretary, Jose Yulo, come to Bohol to finalize the funeral arrangements. It was there when he met the governor for the coordination that Yulo took notice of Garcia speaking impeccable Spanish. He arranged for President Quezon to meet Garcia. The president, also known as the Big Spanish, was so impressed with the governor from Bohol that he encouraged him to run for senate. And the rest is history.

THE CPG PRESIDENCY; FIRST TO WEAR BARONG

The Garcia Presidency was anchored on three (3) major policies and programs: Filipino First Policy, Austerity Program and Cultural Revival.

Honorable Speaker, my dear colleagues, perhaps the greatest legacy and commitment of President Garcia to nationalistic values is found in his Filipino First Policy, the definitive program that distinguished his administration from the rest.

It was a governance aimed at putting the Filipino ahead of others in the economic, business and social fields of endeavors. It sought to give local businessmen more priority over foreign investors as well as filipino products over foreign products. He was the first Philippine president to wear barong in his inauguration.

In 1958, the Garcia administration succeeded in hitching the Bohlen- Serrano Agreement, an accord that reduced the stay of the US bases from the original 99 to a mere 25 years.

The Austerity Program was implemented by Garcia in order to curt the rampant graft and corruption within the country. The program centered on wise spending, industry, thrift, trustworthiness, integrity and honesty.

The Garcia administration also put emphasis on cultural revival, due to the colonization of many countries he felt that the revival of the Filipino culture was needed. It gave birth to the "Republic Cultural Award" given to Filipino artists, scientist, historians and writers.

It was also during his time that the Philippine government successfully negotiated with the US government for the return of documents seized by American troops during the Philippine-American War – the so-called Philippine Insurgent Records(PIR), the magnetic lode of so many researchers who want to know more about our nation's historical past.

In his own words, during a speech at the Manila Law College in 1957, President Garcia said,

"Every Filipino loves his country. But not every Filipino is a true patriot. He who loves the Philippines only for what the country can give him — lands, houses, plantations – is not necessarily a patriot.

Patriotism is unselfish like Rizal's love of country. Patriotism is a passion that cannot be denied like Mabini's attachment to his beloved Philippines. Patriotism is boundless like Magsaysay's devotion to his people.

But this infinite affection, this predilection for our country, means a number of concepts. It means a belief that our land is the most beautiful, the most fertile, the most healthful in the whole world. Patriotism also means that wherever we may be we are proud of our culture — our dance and our arts and the traditions of our people.

To us, the most glorious history of all mankind began with the scroll written with the blood of LapuLapu in Mactan, which was unfolded through the centuries and embellished with the deeds of Dagohoy, Tamblot, Del Pilar, and the unsung heroes of '96 and of Corregidor and Bataan.

Patriotism has come to mean love of our countrymen. Each one is a part of us. Each one is a part of the Philippines. You hurt one Filipino and you hurt the whole nation.

Every Filipino is an inherent part of our nature. Therefore, any misfortune that a Filipino suffers is a misfortune of the entire Philippine archipelago. Thus, perhaps among ourselves, we do not feel intensely the harm we sometimes inflict upon our own fellow-countrymen. But let a foreigner pull one single hair from a Filipino's head or step ever so lightly on his toes and, as one man, we rise in his defense.

And so patriotism means that we love and cherish our fellow-Filipinos. We admire their courage, their diligence, their patience, their peaceful and law-abiding nature, their hospitality, their kindness.

We feel a terrible pain when Filipinos are accused of indolence, indifference, smugness, and complacency. And we proceed to teach ourselves to be more alert, more industrious, more persevering. This explains why PATRIOTISM is such a perennially fascinating subject. Patriotism is progressive and, like wine, it mellows with time. Patriotism is not isolationism. It is not chauvinism. It is the antonym of patrioteering.

How can we preserve this love of country forever? We can keep the patriotic spirit through education and information; through the practice of honesty and the observance of honor — above everything; through constructive action often impelled by what is known as civic conscience."

CONCON PRESIDENT

On June 1, 1971, Garcia was elected delegate to the 1971 Constitutional Convention. Convention delegates elected him president of the convention on June 11, 1971.

However, just four days after his election, on June 14, 1971, Garcia suffered a fatal heart attack. Garcia became the first layman to lie in state in Manila Cathedral—a privilege until then limited to a deceased Archbishop of Manila.

FIRST PRESIDENT BURIED AT LIBINGAN NG MGA BAYANI

Garcia was also the first President to be buried at the Libingan ng mga Bayani.

Today is CPG Day – a fitting tribute to the favorite son of the province of Bohol. We have a day filled with activities. During my time as governor, we even conducted chess competitions in recognition of his favorite pastime as well as poetry reading and poetry writing as a tribute to the Bard of Bohol.

Bohol is proud to have contributed to Philippine governance through President Garcia. He is our ultimate inspiration in putting the Filipino first in our public service and in ensuring that culture is integrated in the Filipino way of life.

Thank you very much. Daghang Salamat.

Bohol Latest News / Banned by LTO
November 06, 2019, 09:09:18 PM
LTO bans 6-digit vehicle
Plate numbers since '17

TAGBILARAN CITY, Bohol, November 1 (PIA)—Still using the temporary six digits plate number in your private four-wheeled vehicle?

Then, be wary.

The problem with the Land Transportation Office (LTO) backlog in its license plates breed a whole lot of problems, and the issuances of temporary plates appear some of them.

It may be recalled that in January of 2017, LTO Assistant Secretary Edgar Galvante issued a memorandum standardizing temporary plates by using the MV file number for motorcycles and a combination of conduction sticker and MV file number for anything with more than two wheels.

This is even if the memorandum states that all vehicles released on or after February 15, 2017 onwards, to have a certain temporary plate format for "unity and ease of visual recognition" puts the obligation to motor dealers the attaching to the vehicles, of unified temporary plate format with complete information before delivery or release to the buyer.

The MV file number however appears only on the Certificate of Registration (CR), which one only gets upon completion of the registration process.

Now the LTO also incidentally pursues strict implementation of the No OR/CR, No Travel rule.

As to the LTO website, the issuance of a Conduction Sticker to accredited assemblers and importers of whole MV is only for road testing and delivery and is thus only allowable for legal use of motor vehicles prior to its initial registration, that is: road testing and delivery.

That, and the Virtual Plates.

The backlog in getting the permanent plate numbers has the LTO issuing "Virtual Plates" which contain the car registration numbers issued for a new vehicle; while the assigned plate number isn't available yet.

Having a virtual plate helps in the release of your permanent plate number in the future.

But these plates are now being cancelled since February 2917, LTO Bohol registrar Atty. Vicente Gador said.

According to the Land Transportation Office (LTO), as early as 2017, in a memorandum issued by the agency through Assistant Secretary Edgar Galvante, the LTO has banned the use of the 6-digits temporary plate number, and you could be penalized for using such.

During the recent meeting of the Provincial Peace and Order Council (PPOC) held at the new Capitol building, New Capitol Site, tourism transport sector representative Augusto Pascual elevated the concern to the council, and asked the LTO why it has "allowed" the use of the temporary plate when it issued and assigned these to vehicles, when in fact it is now banned?

The LTO through its Tagbilaran City District Office Registrar Atty. Vicente Gador, said the LTO has issued an advisory for information dissemination in 2017 asking owners of vehicles using the 6 digit LTO issued plates to have these cancelled at the district offices.

He said that the same 6-digit temporary plates have been issued to over 500 vehicles, and when that vehicle figures out in an accident, then the problem starts.

With over 500 units bearing the same 6-digit plates, vehicles can be red-flagged, meaning they can be ascribed to accidents or traffic violations when in fact, it was the plate of another vehicle that was tagged.

The LTO explained that their registrars have been tasked to crash these numbers out for a new set of plates then.
A case of a tour driver in Bohol who was apprehended for using the 6-digit plates is now made a sample case.

According to Pascual, who heads a tourist transport group, they had a driver member who was apprehended for using the plate issued by the LTO.

Apparently, LTO Bohol hand not cancelled the temporary plate for the permanent one, when it had the obligation to cancel the same.

On this, Governor Arthur Yap emphasized that it is incumbent upon the LTO to inform the public, and so it should not let the poor guy bleed for it is their responsibility.

Along this line, the PPOC has issued a resolution asking the LTO to inform the public again, and correct the situation.

The PPOC move is also consistent with the President's reform agenda of streamlining government systems to deliver services without delay. (rahc/PIA-7/Bohol)

Bohol Latest News / Pilar Mayor Cubrado Gets Justice
November 06, 2019, 09:07:49 PM
By Ric V. Obedencio
Ombudsman clears Pilar Mayor Cubrado

PILAR, Bohol - The Ombudsman has junked the complaint filed against Mayor Necitas T. Cubrado of this town for lack of probable cause.

"Wherefore, premises considered, the motion for reconsideration of Mayor Cubrado is granted and the assailed resolution is hereby reversed and set aside. The complaint against Mayor Cubrado is dismissed for lack of probable cause," the Ombudsman decision promulgated October 8, 2019 said.

The decision was approved by Ombudsman Samuel R. Martrires who affixed his signature to it as recommended by Assistant Ombudsman Jose M. Balmeo, Jr. and signed by Graft Investigator and Prosecution officer Rafael Rodrigo S. Esguerra.

"Mayor Cubrado clearly had no intention to usurp the powers of the Sangguniang Bayan, hence, there is no basis to file an information for usurpation of legislative power," the decision said in dismissing the complaint filed by former Mayor and Vice-Mayor Wilson Pajo, who was defeated by Cubrado in 2019 elections.

With the said decision, the Ombudsman reversed its previous decision which found Cubrado guilty of "grave misconduct" for the alleged usurpation of legislative power.

Cubrado was then meted dismissal from public service and with accessory penalty of perpetual disqualification from holding any public office by the Ombudsman.

The case arose from the intention of Cubrado in helping some 90 plus households of the barangays to avail of the energization program of the national government.

The mayor said she has sent a letter to SB asking for an enabling authorization for her to implement the said program. But the SB majority of whom are opposition ignored her request.

Capitalizing on her failure to secure legislative authorization from the SB, her detractors filed the said complaint against Cubrado.

It will be recalled that prior to 2019 elections, Pajo filed a disqualification against Cubrado before the Commission on Elections (Comelec) for the alleged misrepresentation in her filing for certificate of candidacy.

The complainant (Pajo) wanted Cubrado disqualified from running for reelection since the Ombudsman has found her guilty of "grave misconduct" for alleged usurpation of legislative power.

But the Comelec dismissed Pajo's complaint "finding of grave misconduct against Cubrado appeared to have not yet attained finality."

Thus, the Comelec upheld Cubrado's running for mayor in 2019 elections. (rvo)

Quotable Quotes / Women Empowerment
November 06, 2019, 08:13:15 PM
"I would never give up the friendships I formed with those women. But looking back, I realize that we already had the skills to do our jobs before we started. We had the smarts to learn the ropes on our own. Women are often in denial about their own capabilities and search for others—groups of women or commanding men—to establish their power. When doing important personal work, like caring for our parents and children, the old and the young—both tasks that fall primarily to women—we are far more adept at adapting to new work and unfamiliar situations. When called on to make ends meet, we do what we must without stopping to doubt ourselves. Women excel at times when they have no choice but to take the job and do their best. Why can't we have the same confidence in the jobs we want and like as well? We may not always have the knowledge going in, but I'd trust any woman to figure out nearly any job.' -Wendy Sherman, Chief Negotiator, US-Iran Nuclear Deal; Director, Center for Public Leadership

Sympathy Statement of the people of Kidapawan City

In behalf of the people of the City of Kidapawan, we would like to express our deep sorrow on the sudden demise of the water tanker helper who offered his own life for the service to the victims of the earthquakes in the town of Makilala and Kidapawan City as well.

Aside from giving his own life, the victim JUBERT CABRERA, 16 years old, Grade-11 student of Nikkei Jin Kai Senior High School in Davao City and a resident of Barangay Mahan-ug, Cateel, Davao Oriental, also saved lives of many commuters.

Sensing danger following the break malfunction of the water tanker carrying 7 tons of potable drinking water, Cabrera bravely shouted to the incoming vehicles on the opposite lane to maneuver at the shouldering to avoid collision with their vehicle.

Had he did not given the signal to the incoming vehicles, there could be multiple injuries and deaths as well.

We also pray for the fast recovery of the driver JIMMY CABEN, who sustained multiple physical injuries and now being given medical attention in the hospital. May the healing power of the Almighty Father bestow upon him.

In these difficult times, we Kidapawenos are with you and your family. We pray from the bottom of our hearts that the Almighty will grant your families peace and strength in facing these difficult times.

Accept the condolences and sympathy of the people of Kidapawan.

BUTUAN CITY -- The National Food Authority (NFA) in the province of Surigao del Sur has intensified its mobile palay procurement program to fully serve the rice farmers in the area.

With a buying price of PHP19 per kilo, more rice farmers in Surigao del Sur will be given assurance of a much higher price compared to the prevailing PHP15 per kilo buying price of local traders.

Daisy M. Luna, the provincial manager of NFA in Surigao del Sur told Philippine News Agency (PNA) on Tuesday that their mobile procurement teams have been deployed to different towns in the province.

Luna said that NFA-Surigao del Sur has three warehouses that are ready to procure palay products in the northern, central and southern parts of the province.

"Mobile procurement is our continuing effort to further serve the palay farmers in Surigao del Sur," Luna said, adding that their Duplex Warehouse in Tandag City that serves the towns in the central part of the province has initially procured 150 bags of dried and clean rice on Tuesday.

The initial 150 bags were procured from the palay farmers of Libas Sud, one of the remote barangays in the town of San Miguel.

The intensified procurement is also mandated under Republic Act 11203 or the Rice Tariffication Law that directs the NFA to maintain buffer stocks of rice in warehouses that can be utilized during calamities, she said.

Luna noted that NFA-Surigao del Sur has an existing Memorandum of Agreement with local government units stipulating that municipalities can directly procure or loan sacks of rice for distribution to their constituents in times of calamities.

The continuing direct procurement through mobile teams is a manifestation that NFA is functioning as a ready market for the palay products of local farmers in the province of Surigao del Sur, Luna said. (PNA)

Chatto calls support for Mindanao quake aid

Bohol Rep. Edgar Chatto has appealed for compassion and urged the Boholanos to support the relief mission for the victims of the successive powerful earthquakes crushing Mindanao areas.

He reminded "how we were helped during our difficult time" when the magnitude 7.2 tremor devastated Bohol island six years ago.

Chatto was the governor when, on October 15, 2013, the province was hit by the mightiest and most destructive earthquake in its recorded history.

The congressman directly appealed, especially to his district constituents, to help generate donations in their respective localities to be sent to Mindanao.

This is also in support to the call of Gov. Arthur Yap, who was himself in Davao City and assured Mayor Sara Duterte-Carpio of his and the Boholanos' help.

The series of strong earthquakes affected a wide Mindanao area that includes the Davao region and North Cotabato province, among others.

Chatto supported the call for donations through the Provincial Disaster Risk Reduction and Management Office (PDRRMO) under Dr. Anthony Damalerio at the Camp Bernido or the churches.

The PDRRM Council Command Center is also inside the Camp Bernido in Tagbilaran City.

Chatto was the governor, too, when Bohol sent assistance to Mindanao's Marawi City, which was crushed to ashes following the terrorist siege.

Chatto said after the great Bohol earthquake, "our fast recovery would not have been possible without God's blessings and the assistance from countless kind hearts all over the world, including help from the people of Mindanao."

The unforgiving earthquake delivered Bohol to epic disaster and tragedy since the ruins of World War II.

"It is now our time to show compassion to the Mindanao victims of this tragedy," Chatto said.

Meanwhile, the major earthquakes, not just aftershocks, hitting the same Mindanao areas in just two weeks have put to the fore the urgency of creating a cabinet for disaster management in the country.

Chatto has co-authored House Bill (HB) 00004 ceating the Emergency Response Department (ERD) and HB 00030 creating the Department of Disaster Resilience (DDR). (Ven rebo Arigo)

Philippine Business News / Bank Scam in Cebu
November 04, 2019, 12:22:30 PM
Balik ta sa alkanseya ani

Cebu City - Depositors of a commercial bank that lost millions of pesos through unauthorized withdrawals from their accounts by the bank's branch manager are set to file civil and criminal charges against the officer and the bank.

The subject bank  located in uptown Cebu City was not the only branch affected as another branch of the same bank  also lost their money through fraudulent bank transactions, according to a source.

CDN Digital is withholding the name of the bank as attempts continue to get its side on the allegation.

One of the victims told CDN Digital (October 26, 2019) the branch manager was able to withdraw P3 million from her time deposit account through forged documents and signatures validated by other bank officers.

The source claimed another depositor lost P7 million through the fraudulent transaction.  At least 20 other depositors lost millions of pesos from the illegal withdrawals for an estimated combined loss of 30 to P50 million.

The series of illegal withdrawals happened in September this year.   But according to one of the victims who spoke with CDN Digital, the scam could have happened as early as July this year after a businesswoman-client of the bank reported that P4 million in her deposit account went missing.

The source said the bank manager could have pilfered money from several time deposit accounts in order to reconcile the financial transaction.

According to her, she got wind of the fraudulent scheme when she told the manager this month that she intends to pre-terminate her time deposit account because she needed money for a big purchase.  Despite her persistent requests and the bank manager's assurance, she wasn't able to withdraw the money from her time deposit account. Prior to this she also noted the bank failed sending her statement of accounts, a regular monthly report issued by the bank for their depositors.

The victim said she and the other victims placed their money in the said bank because they trusted the manager, who, the source said, was a good friend.

One of the victims found out that his time deposit account had been emptied when he applied for a visa to travel to the United Kingdom.  Not knowing that funds from his time deposits had been fraudulently withdrawn, he submitted a bank certification which the UK embassy discovered to be spurious.  As a result, the UK government blacklisted the bank client from entering the country.

According to the source, she received reports that the branch manager has fled to Singapore.

Yesterday, the victims were set to go to the National Bureau of Investigation to seek the agency's help but NBI 7 top officials were not available.

Once a case is filed in court, the victims could seek the help of the International Police Organization (Interpol) through its National Central Bureau (NCB) in the Philippines.

In a separate interview, Lawyer Gary Maningo, manager of the Bangko Sentral Ng Pilipinas, said the aggrieved depositors may file a a complaint before the BSP's Financial Consumers Protection Department.

Financial consumers aggrieved by the conduct, products and services of a financial institution may seek redress through FCPD which is mandated to provide consumer assistance through "an effective redress mechanism," according to Maningo. - CDN Digital

MANILA ---Agriculture Secretary William Dollente Dar on Friday condoled with families of the 19 farmers who perished in a road crash in Apayao province Thursday night.

Initial reports said the farmers were on their way home to Lattut, Cagayan when the Elf truck they were riding fell off into a ravine in Sitio Gassud, Barangay Karikitan, town of Conner, in Apayao.

"My family and I, and the entire Department of Agriculture (DA) extend our sincerest condolence to the families of Lattut farmers, who came from an inbred rice seeds distribution ceremony, in Rizal, Cagayan, held earlier in the day," Dar said in a statement.

"Initially, we have given the surviving families PHP15,000 and a cavan of rice," he said.

The token amount and rice are on top of the cash assistance shared by the Provincial Government of Cagayan and the Department of Social Welfare and Development, DA Cagayan Valley regional director Narciso Edillo said.

"On behalf of the DA family -- RFO2, Philippine Rice Research Institute, and other concerned bureaus and agencies -- we will extend every possible assistance to the relatives of the victims and those injured," Dar added.

He said he is closely monitoring the situation, adding that he and his family are deeply touched by the unfortunate accident.

The DA has also given PHP15,000 to those seriously injured, totaling 22.

According to news reports, the Elf truck, with 44 passengers, including the driver, was going uphill when its engine suddenly conked off, along with its brake system, causing it to fall into a ravine.

The overloaded truck also carried dozens of sacks of inbred rice seeds and corn. Three passengers were slightly injured, according to news reports.

The victims and those injured were rushed to Conner District Hospital and Cagayan Valley Medical Center. (PR)

Philippine Daily News / Mindanao Earthquake Aftermath
November 03, 2019, 09:26:53 AM
By Ronda News Kidapawan

OFFICIAL STATEMENT OF THE ENERGY DEVELOPMENT CORPORATION (the sole producer of the country's geothermal energ):

"We would like to reassure our stakeholders that geothermal power production does not cause earthquakes or trigger volcanic eruption.

Scientists around the world are unanimous in saying that no man-made activity can cause a volcanic eruption.

Only a change in chemistry, pressure and temperature can cause a volcanic eruption.

Seismicity in each EDC geothermal site, including our Mount Apo Geothermal Project (MAGP), is monitored by seismic instruments installed by EDC in tandem with a network of monitoring instruments of the Philippine Institute of Volcanology and Seismology since our country is prone to earthquakes.

The recent movements in Mindanao all have epicenters south of Kidapawan City and none are within our project site.

To date, we have not affected the seismicity of the area two decades since we have started operating MAGP.

PHIVOLCS director Renato Solidum has already confirmed in his media interviews that the series of tremors that hit the area as well as other parts of Mindanao since October 16, 2019 was caused by the Cotabato fault system and were tectonic in origin."
