CEBU CITY -- Mandaue Cityâ€™s police force is tracking down a woman and three men believed to be behind the killing of call center agent Lynn Vi Ebarita, a case that Chief Inspector Eddie Recamara described Tuesday as â€œ90 percentâ€ solved.

The â€œclose friendâ€ who offered information to the police was rushed to the hospital, along with her mother, before the friend could sign her confession.

The mother reportedly suffered a minor stroke while the friend was under observation after what appeared to be an anxiety attack.

Ebarita was stabbed 24 times and her body stuffed in a plastic bag placed outside a hotel room. The stench eventually led to the bodyâ€™s discovery last January 22, five days after a woman first checked in and paid for the room.

POLICE arrested yesterday a friend of the call center agent whose body was found outside a hotel room, after investigators recovered the victimâ€™s wallet inside the friendâ€™s boarding house.

Jonnelle Enfectana, 26, initially volunteered to sign a confession, but changed her mind Tuesday night and refused to cooperate further with Mandaue City Police Office (MCPO) investigators.

At 3:30 p.m., police arrested her inside the private ward of the Mandaue City hospital, where she was resting a day after being admitted. Investigators brought her to the MCPO and prepared a murder case against her.

Police already have the names of two possible accomplices and have asked the Criminal Investigation and Detection Group in Tacloban for assistance.

Chief Insp. Eddie Recamara of the MCPO and his team recovered Lynn Vi Ebaritaâ€™s wallet, containing her identification cards, inside a room Enfectana rented in Florimer Subdivision, Barangay Banilad, Cebu City.

Recamara said they secured the homeownerâ€™s consent for the search and that the arrest, while warrantless, was legal because it formed part of their pursuit operations.

A radio report, however, quoted lawyer Michael Enriquez as saying he will question the validity of the search and arrest.
Asked about the motive, Recamara said he believed envy may have triggered the attack.

Last Jan. 18, some of Enfectanaâ€™s male relatives reportedly came to see her for the Sinulog. One of the investigatorsâ€™ theories is that the suspect arranged for a group sex session, but that the victim refused.

Four days later, Ebaritaâ€™s body was discovered stuffed inside a plastic bag.

From then on, Recamara said the police relied on leads provided by Enfectana, including printouts of chat conversations between Ebarita and her US-based boyfriend, and between the boyfriend and Enfectana.

One thing that provoked the boyfriendâ€™s suspicion was Enfectanaâ€™s use of a nickname that only his girlfriend knew and used.

Up until last Tuesday, police provided Enfectana with security because she said she received death threats. She collapsed that day before she could sign a confession detailing her role in Ebaritaâ€™s death.

But when her lawyer Michael Enriquez came to see her last Tuesday night, Enfectana changed her mind. No confession was signed.

During the search at noon Wednesday, police found among Enfectanaâ€™s things Ebaritaâ€™s wallet, which contained her TeleTech card, a PhilHealth card, a North General Hospital card and credit cards.

Deputy director for operations Bernard Tambaoan said that was enough â€œcircumstantial evidenceâ€ to arrest Enfectana.

Tambaoan also said they have two witnesses who are willing to execute affidavits to pin down the suspects.

that's a question being raised sa locals te!! and the front desk didn't even ask for an ID upon check in daw. maon dili sila ka verify if kisa tong naka register nga name didto. it's not the victim nor the suspect's name man gud.

This is so un-f*cking-believable... This Jonelle Enfectana lives right across us in Tacloban! I'm based in Manila right now but I do go home during holidays and I just saw her last December. We're not exactly in good terms since high school, but before that, we literally grew up together...

I can't really say that she's not capable of this hehe but the news is very appalling.

Sobrang papansin kamo, kala mo kung sino. Her ate married an Australian and is now based there. I'm guessing naiingit , I think this is an angle that the police are looking into. Pilit atang inaagaw yung bf nung victim, as the bf is US-based.

My mom called me earlier today to break the news and when I heard about it, I can't really say na nalungkot ako for her or her mom at least. For the victim, yes.

Almost everyone in the neighborhood hates them, including her sis Janice. Pangit ng mga ugali, ang yayabang pa. Inirapan nga minsan dad ko ng babaeng to eh, nag park lang saglit dad ko sa street sa harap ng haus nila. Kala mo nabili nila yung kalsada.

If anything, naawa ako sa baby nitong si Jonelle.

Police hold friend as 'slay suspect'

Cebu - One of the suspects involved in the killing of a call center supervisor last week is now under the protective custody of the police after she confessed participation in crime and named four other cohorts.

Although police are now discounting the possibility of a love triangle, they still could not ascertain the motive of the killing.

This is because the investigation was cut short last Monday afternoon when the suspectâ€™s mother, who accompanied her was rushed to the hospital after she suffered a â€œmild strokeâ€ during the questioning.

The investigation resumed yesterday morning, but when she was already starting to give her free and voluntary statement, the investigation was halted after the suspect herself got hysterical and collapsed. Police also brought her to the hospital.

Hours after being brought to the hospital, the suspect asked an investigator to visit her at the hospital were she finally confessed her participation to the crime and named her cohorts.

Since the investigation was halted with the suspectâ€™s confinement, the police are yet to determine the extent of her participation in the crime and the real motive in the killing.

However, Intelligence and Detective Management Bureau (IDMB) Chief Eddie Recamara said that although the case is now 90 percent solved with the confession of the victimâ€™s close friend, they cannot yet divulge the names of her four alleged cohorts until the case will be filed in court.

What triggered the investigators to doubt the suspect was the inconsistency in the information she provided to the police.

She also allegedly offered evidence supposedly to mislead the police in their investigation.

However, one of the evidence she presented to the police supposedly to mislead them also forced her to confess later of her participation.

During the course of investigation yesterday morning, the suspect who presented a print out of her chat messages to the victimâ€™s boyfriend has convinced the police that the victimâ€™s cellular phone, which was missing after her death, is with the suspect.

Police said they were convinced that the victimâ€™s cellular phone was with the suspect, this after they also called up the victimâ€™s boyfriend who was also surprised why the suspect was able to use the â€œcodenameâ€ which he and victim used during their chats, which only he an Lynn Vi Ybarita, the victim, knew.

Police said that the suspect was able to chat with Ybaritaâ€™s boyfriend last January 20 and 21, and the victim was already dead by then.

The victimâ€™s boyfriend also knew that it was not Ybarita who he was chatting with as the other person was using a different online account.

It was at this point of her confession that the suspect became hysterical and collapsed.

Late last night, sources at the Mandaue City Police Office said that the suspect has retracted her statements.

Ybaritaâ€™s body was found stuffed into two trash bags inside room 309 of the Nikkei Garden Hotel in barangay Subangdaku, Mandaue City last January 22 at 8 p.m.

The body of Ybarita, which was shed of its clothes, bore 24 stab wounds.

Ybarita, 26, was a single mother with a seven-year-old child.

She worked at Teletech, a call center, which has offices along A. S. Fortuna St .

The family of Ybarita reported her missing last January 20. She was last seen by her parents during the Sinulog grand parade last January 18. â€“/NLQ

i know the suspect's lawyer, michael enriquez. we were classmates, schoolmate and sometimes buddy in some school activities like ROTC way back in college. i never thought he became a lawyer after college but he's really a good student and loves to study that maybe the reason he pursued law.

I think so too. but even though dili siguro sila professionals coz if they did it sa cr, then the possibility of a blood evidence to be seen on the crime scene would be minimal. Samot na kay na limpyuhan na and room before the police or SOCO could inspect the room. And if they were really professional killers na nahire sa iyang amiga to kill her that night, then ngano man didto ra nila gi bilin ang body sa place where the crime happened? Im sure that they would think in advance that there would be a possibility na naay naka kita nila didto.

This fight is for Lynn Vi Ebarita's family and child that would grow up knowing that he\she could not ever feel her mother's warm embrace ever again.

Charges vs. suspect in slay of call center agent delayed

Cebu - Murder charges are expected to be filed today against the suspect in the killing of call center supervisor Lynn Vi Ebarita after police failed to do so last night due to the delay in the release of the report of the autopsy performed on Ebaritaâ€™s body.

Mandaue police said they will file the complaint against Jonnelle Enfectana before the Mandaue City Prosecutorâ€™s Office first thing today.

Enfectana, 26, was a â€œclose friendâ€ and co-worker of Ebarita at the TeleTech Call Center. She was placed under arrest the other day after police recovered the victimâ€™s wallet under a pile of wood inside Enfectanaâ€™s rented room in barangay Banilad.

The wallet contained several identification cards of Ebarita.

Enfectana earlier confessed of her participation during a free and voluntary statement to the police but her lawyer retracted his clientâ€™s earlier admission and told reporters Enfectana had no participation in the crime.

Enfectana remains in the custody of the Subangdaku Police Station.

Mandaue City Police Office Director Orlando Ualat said his men continue to verify the other personalities involved in the killing, as the names that Enfectana had given during the earlier confession might just be fictitious.

The names Enfectana mentioned during the investigation reportedly turned out to be phony.

Ualat said they are also considering the possibility that the other suspects were hired killers based on how the crime was carried out.

The police are also still trying to trace the identity of the woman who registered at the front desk of the Nikkei Garden Hotel where Ebaritaâ€™s body was found last Thursday night.

Hmmm.. kung fictitious man ang mga names na iyang gi hatag sa mga police, then she is hiding something gyud. Could they be relatives ba gyud kaha? And kung tinuod man gyud na dili relatives sa girl ang mga lalake like what was said kaniadto na ni anhi sa sinulog but hired killers, then there would be a possibility na wala kaila ning si Jonnelle sa mga na hired niya. I also personally know the suspect kay officemates mi ana niya while she was working in one of the call centers here in IT Park. Ilado ni sya nga bati jud ug character kay gigukod sad ni sya ron sa duha ka tigpa-loan nga iyang gidaganan. Ang iyang mga co-makers maoy nagproblema ug bayad. I should know kay ang usa sa co-maker akong kaila nga naka-ingon jud karma sa suspect!

In a very busy environment at the office where I am away from my family, she gave high importance to me. She brought me stuff, spends time with me, share a meal, share a smoke, and we never ran out of conversations. Putting malice in our friendship never crossed my mind. i think maayo nalang pud na wala nikuyog ang friend nimo na lalaki that time. Coz if the killing of Vi was really planned in the first place, tingalig ma among lang siya apil. One is that we know na naay hired killers that time na kuyog ni Jonnelle.

THE boyfriend of a slain call center supervisor will return to the Philippines to testify against her close friend, identified by police as the primary suspect in her killing.

Jonnelle Enfectana, primary suspect in the killing of Lynn Vi Ebarita, has denied involvement in the crime. Her lawyer said he will question the search of Enfectanaâ€™s room and her arrest inside a hospital Wednesday afternoon, which were done without warrants.

Police are also not yet ruling out the possibility that Ebaritaâ€™s office mates may have been involved in her killing.

Chief Insp. Eddie Reca-mara of the Mandaue City Police Office (MCPO) said they already have the names of two of the four alleged accomplices of Enfectana. The two are from Boro-ngan town in Eastern Visayas. Police have yet to identify the two other accomplices, a man and a woman.

Recamara said printouts of online chat conversations and the recovery of Eba-ritaâ€™s wallet from Enfecta-naâ€™s boarding house are strong pieces of evidence against her.

Recamara said Eba-ritaâ€™s boyfriend assured police via a long-distance call that he will return to the Philippines to testify against Enfectana.

Ebarita and her boyfriend were co-workers in a call center in Lapu-Lapu City. They then transferred to another business process outsourcing company in Mandaue City before the boyfriend left for the US and Ebarita joined TeleTech.

Police said that one thing that provoked the boyfriendâ€™s suspicion was Enfectanaâ€™s use of a nickname that only his girlfriend knew and used.

Investigators believed that Enfectana gave police printouts of chat sessions between Ebarita and her boyfriend and between the boyfriend and Enfectana, to mislead police.

MCPO Deputy Director for Operations Bernard Tambaoan told reporters that Enfectana once applied for a P15,000 loan with Ebarita as guarantor. He said Enfectana again applied for a loan but Ebarita declined to be the guarantor. He said this angered Enfectana.

Last Jan. 18, some of Enfectanaâ€™s male relatives reportedly came to see her for the Sinulog. Investigators said the suspect may have arranged for a group sex session but that the victim refused.

Four days later, Eba-ritaâ€™s body was discovered stuffed inside a plastic bag.

Up until last Tuesday, police provided Enfectana with security because she said she received death threats. She collapsed on that day before she could sign a confession detailing her role in Ebaritaâ€™s death.

But when her lawyer Michael Enriquez came to see her on Tuesday night, Enfectana changed her mind and no confession was signed.

During the search at her boarding house, police found among Enfectanaâ€™s things Ebaritaâ€™s wallet, which contained her TeleTech card, a PhilHealth card, a North General Hospital card and credit cards.

Tambaoan said these were enough â€œcircumstantial evidenceâ€ to arrest Enfectana.

Tambaoan also said they have two witnesses who are willing to execute affidavits. (OCP)

Police file murder charges vs. suspects

POLICE filed yesterday the murder complaint against the suspects in the killing of call center supervisor Lynn Vi Ebarita.

Upon the advice of her lawyer, detained suspect Jonnelle Enfectana, 26, a co-worker and close friend of the victim, refused to sign a waiver of detention since they will question the legality of her arrest and the search on her boarding house.

Both the arrest and search were done without warrants.

Michael Enriquez, Enfectanaâ€™s lawyer, asked to be placed on record that the suspect was brought to the Mandaue City Prosecutorâ€™s Office after the 36-hour reglamentary period already lapsed.

Prosecutor Bienvenido Mabanto, during the inquest, gave the suspect a chance to submit controverting evidences but Enfectana, through her lawyer, declined to do so.
Based on the evidence submitted by the police, Mabanto promised to resolve the case next week.
Enfectana will remain detained at the Subangdaku Police Station.

The suspect was arrested last Wednesday for the killing of Ebarita, whose body was found last Jan. 22 with 24 stab wounds and placed in two sealed garbage bags at
the Nikkei Garden Hotel in Mandaue City.

Ebarita, a single mother of a seven-year-old child and Enfectanaâ€™s supervisor at call center firm TeleTech, was believed to have been killed last Jan. 18 or 19 while
drinking with Enfectanaâ€™s relatives inside the hotel.

She is believed to have refused to have group sex with the suspects.

Ebaritaâ€™s father said he has forgiven the suspect and he just wants to let the law take its course.

â€œKung di man ugaling siya (Enfectana), motug-an na lang siya kung kinsa (If she didnâ€™t kill my daughter, she should just identify the culprits),â€ he told Sun.Star Cebu.

Enriquez, in an interview after inquest, said his client did not sign the waiver of detention since they will question the validity of the arrest and the eventual detention of his client.

â€œIf we sign a waiver, it would necessarily follow nga mamatay among claim for an illegal arrest,â€ Enriquez said.

Enriquez also said the evidence against his client are all circumstantial and not enough to link her to the crime.

â€œThere was never an instance and no witness that (could point that) she (Enfectana) was in the hotel when the crime was committed,â€ he said.

On the policeâ€™s possible use of the printout of the chat messages between Enfectana and Ebaritaâ€™s boyfriend a day or days after her death, Enriquez said there are rulings and standards to be followed on the use of electronic evidence.

He said it is up to the prosecutor to assess if the rules apply.

He said the justifications given by the police on the arrest of Enfectana without a warrant would not suffice to qualify their operation as a â€œhot pursuit.â€

He also described as illegal the absence of a warrant during the search on Enfectanaâ€™s boarding house. Police found Ebaritaâ€™s wallet there.

He said his client shared the room with another boarder. Also, many people had access to the common wash area where the victimâ€™s wallet was found.

Mabanto said he had asked the suspect during the inquest proceedings, which started at 8:30 a.m. and ended at 3:40 p.m. yesterday, if there was an instance when her co-boarder and Ebarita met before the crime was committed.

Enfectana said no.

With regard to the search that led to the discovery of the victimâ€™s wallet in Enfectanaâ€™s boarding house, Chief Insp. Eddie Recamara explained to Mabanto that they secured the permission of the house owner.

Together with the complaint sheet the police submitted to the prosecutorâ€™s office were affidavits of three TeleTech employees who saw Enfectana and Ebarita during the Sinulog; the suspectâ€™s landlady; the victimâ€™s sister; the victimâ€™s neighbors; the investigators and arresting officers.

They also submitted the victimâ€™s wallet with its contents, the autopsy results and the printout of the chat between the suspect and the victimâ€™s boyfriend. (OCP)

Cebu - A murder charge was lodged before the City Prosecutors Office yesterday against the principal suspect in the killing of a call center employee two weeks ago.

Mandaue City police filed the complaint against Jonnelle Enfectana, a close friend and co-worker of TeleTech Call Center supervisor Lynn Vi Ebarita, soon after the Mandaue Hall of Justice opened at 8 a.m.

During the inquest proceedings, the police presented to City Fiscal Bienvinido Mabanto the affidavits of witnesses that could prove that Ebarita, Enfectana and another woman, who was also believed to be â€œinvolvedâ€ in the crime, were together prior to the killing.

Based on the account of the first three witnesses, at 12 p.m. on January 18, Enfectana called up the victim and asked her to bring the three cellular phones that were left in their house in barangay Cubacub and bring it to their Sinulog booth at the Fuente Osmena.

Ebarita, together with two others arrived with the phones at around 5 p.m. but left in a few while to have dinner with her two com

panions and returned at 6:30 p.m. Later, Enfectana arrived with a female companion, whom she introduced as her cousin named as certain â€œEvelyn.â€

Enfectana told Ebarita that someone has invited them for a drinking spree and they left the booth at 8:45 p.m.

On the same date, at around 9:30 p.m., three other witnesses who are friends of both Ebarita and Enfectana said that they saw both the suspect and the victim together with a woman whom they did not know standing along the road. Ebarita allegedly called the witnessesâ€™ attention and during their conversation, she introduced to them Evelyn also as her cousin.

The witnesses said they were amazed because it was almost 10 p.m. and Evelyn was still wearing a fishermanâ€™s hat and black sunglasses making them think she was a peculiar lady. They also observed that Enfectana appeared bothered during the meeting.

At the police station, where they were shown a cartographic sketch of the suspect who registered at the Nekkei Garden Hotel as Tina Panganiban, the witnesses said they recognized that the sketch was the same woman that Enfectana introduced to them as her cousin.

During the inquest proceedings, police said that among the other circumstantial evidences is that they believed Ebaritaâ€™s cell phone was with Enfectana because the victimâ€™s officemates were still receiving text messages from her even if she was believed to be dead already. Police suspected the text messages came from the suspect who pretended to be the victim to misled and delay the discovery of the brutal killing.

And because she has the victimâ€™s cell phone, police said the suspect also pretended as Ebarita during a chat with victimâ€™s boyfriend and use the â€œcodenameâ€ which only Ebarita and her boyfriend knew.

The victimâ€™s US based Fil-Am boyfriend also doubted that his girlfriendâ€™s cell phone was with the suspect, and it is from where Enfectana knew the â€œname,â€ which he and the victim call each other when they chat or exchange text messages.

During the inquest, Enfectana also denied that she asked for a â€œpolice protectionâ€ contrary to what was earlier recorder in the police blotter that she asked for it after she allegedly received a death threat.

PO3 Protacio Tago said they granted Enfectanaâ€™s wish for a police escort as they also wanted to protect her after she received a â€œthreat.â€ But they later learned that the suspectâ€™s cellular phone was dual SIM and she just used her other number and sent the threat herself.

Police said Enfectana was arrested after they found out that the victimâ€™s wallet was in her possession last January 28, but denied the suspect was restricted of her freedom to go out prior to that dates.

Enfectanaâ€™s lawyer Michael Enriquez questioned the way his client, saying it was a warrant-less arrest as it was no longer part of a hot pursuit operation. Mabanto, however, said it his office will be the one to determine whether the arrest was illegal or not.

Enriquez also objected to the number of hours before his client was brought to the fiscalâ€™s office for the inquest.

Mabanto explained to him that the 36-hour reglamentary period is not consist of continuous hours but refers to the time that the fiscal is holding office. â€œDonâ€™t expect me to be here at dawn,â€ he said. â€” /WAB (THE FREEMAN)

I learned from my bro last night that a couple of our neighbors sa Tacloban - who are certainly not her relatives - were implicated by Jonelle to be the killers themselves. I personally know these 2. What is she thinking, dropping names like that very easily?

i just learned about the news when my boyfriend sent me a message this morning. his friend called him and told him about it. we knew her 'coz we're also from tacloban.

we we're schoolmates way back in high school. she already had the reputation of being a bi***** because she is so full of herself. some say that she is a flirt and possibly a social climber. i just read all the replies on the topic and based on the flirtatious event that she did chatting with the U.S. boyfriend of the victim, i can say that she is capable of doing so. but with the murder, that i don't know.

to tell you the truth, i didn't like her back then or do i like her more today, as well, but i don't believe that we have the right to incriminate her or call her names if we don't have enough evidence against her. we should just wait for further investigations to clarify or give light to the issue. then if she did do it, God forbid, with all the proof, then you can call her any way you want.

let's just hope and pray that justice will prevail!

monday evening, (before we knew that Lynn is dead) Jonelle has gone hysterical looking for lynn vi. she was the one who declared that lynn vi's missing. right then and there she is trying to clear her name, till then...when we knew that bai's dead.

in fairness to Jonelle (since she's not yet convicted), if she is not part of the crime but she knew who did it... why prolonging the agony of the family and friends of bai? for her to take the spotlight and be the talk of the town?

during one of bai's wake in rolling hills, he came with security escorts and the police asked her on what would have been the killer's motive in killing bai, she answered "dah! bigaon man sad gud tong bayhana!" the reason that she was able to say that because, people admire bai so much and in contrast, people hate her (jonelle) so much and are so disgust with her!

i disgust looking at her senseless picture!

i was wondering... they must have been arguing about something really big for this horrible thing to happen. baka di na pwedeng pag-usapan. she certainly could not have done this alone. i remember jonelle to be of a small built, she could not possibly lift a bag containing a body of another person let alone be angry enough to stab lynn 24 times!!! tibay gud ang sikmura sa nagbuhat ani oi. i'm just more interested on the topic because it's not everyday that you know someone that gets involved in such case. kakilabot

i know a friend of hers but i did not bother to bring up the topic kay mauwaw ko. i'm sure that she'll know about it in time. besides, she's on the headline.

would you know how long jonelle and lynn knew each other? she must have trusted jonelle enough to go with her to that hotel with the "cousin" that she just met.

let this all be a lesson to all of us. i know how easy it is to be comfortable with a person especially if you think that you have so much in common, but it's much better to be safe than sorry.

that is freakin' scary!!! was Vi's phone found? and by the way, with regard to Jonelle keeping Vi's wallet it was a pretty stupid thing to do if she was indeed the one who did the deed. come on!!! didn't she think that if she comes out and be "a good friend that she is" and report to the police that Vi was missing, they would eventually make her a suspect and search her house or something.

Cebu - A murder charge was lodged before the City Prosecutors Office yesterday against the principal suspect in the killing of a call center employee two weeks ago.

Mandaue City police filed the complaint against Jonnelle Enfectana, a close friend and co-worker of TeleTech Call Center supervisor Lynn Vi Ebarita, soon after the Mandaue Hall of Justice opened at 8 a.m.

During the inquest proceedings, the police presented to City Fiscal Bienvinido Mabanto the affidavits of witnesses that could prove that Ebarita, Enfectana and another woman, who was also believed to be â€œinvolvedâ€ in the crime, were together prior to the killing.

Based on the account of the first three witnesses, at 12 p.m. on January 18, Enfectana called up the victim and asked her to bring the three cellular phones that were left in their house in barangay Cubacub and bring it to their Sinulog booth at the Fuente Osmena.

Ebarita, together with two others arrived with the phones at around 5 p.m. but left in a few while to have dinner with her two com

panions and returned at 6:30 p.m. Later, Enfectana arrived with a female companion, whom she introduced as her cousin named as certain â€œEvelyn.â€

Enfectana told Ebarita that someone has invited them for a drinking spree and they left the booth at 8:45 p.m.

On the same date, at around 9:30 p.m., three other witnesses who are friends of both Ebarita and Enfectana said that they saw both the suspect and the victim together with a woman whom they did not know standing along the road. Ebarita allegedly called the witnessesâ€™ attention and during their conversation, she introduced to them Evelyn also as her cousin.

The witnesses said they were amazed because it was almost 10 p.m. and Evelyn was still wearing a fishermanâ€™s hat and black sunglasses making them think she was a peculiar lady. They also observed that Enfectana appeared bothered during the meeting.

At the police station, where they were shown a cartographic sketch of the suspect who registered at the Nekkei Garden Hotel as Tina Panganiban, the witnesses said they recognized that the sketch was the same woman that Enfectana introduced to them as her cousin.

During the inquest proceedings, police said that among the other circumstantial evidences is that they believed Ebaritaâ€™s cell phone was with Enfectana because the victimâ€™s officemates were still receiving text messages from her even if she was believed to be dead already. Police suspected the text messages came from the suspect who pretended to be the victim to misled and delay the discovery of the brutal killing.
And because she has the victimâ€™s cell phone, police said the suspect also pretended as Ebarita during a chat with victimâ€™s boyfriend and use the â€œcodenameâ€ which only Ebarita and her boyfriend knew.

The victimâ€™s US based Fil-Am boyfriend also doubted that his girlfriendâ€™s cell phone was with the suspect, and it is from where Enfectana knew the â€œname,â€ which he and the victim call each other when they chat or exchange text messages.

During the inquest, Enfectana also denied that she asked for a â€œpolice protectionâ€ contrary to what was earlier recorder in the police blotter that she asked for it after she allegedly received a death threat.

PO3 Protacio Tago said they granted Enfectanaâ€™s wish for a police escort as they also wanted to protect her after she received a â€œthreat.â€ But they later learned that the suspectâ€™s cellular phone was dual SIM and she just used her other number and sent the threat herself.

Police said Enfectana was arrested after they found out that the victimâ€™s wallet was in her possession last January 28, but denied the suspect was restricted of her freedom to go out prior to that dates.

Enfectanaâ€™s lawyer Michael Enriquez questioned the way his client, saying it was a warrant-less arrest as it was no longer part of a hot pursuit operation. Mabanto, however, said it his office will be the one to determine whether the arrest was illegal or not.

Enriquez also objected to the number of hours before his client was brought to the fiscalâ€™s office for the inquest.

Mabanto explained to him that the 36-hour reglamentary period is not consist of continuous hours but refers to the time that the fiscal is holding office. â€œDonâ€™t expect me to be here at dawn,â€ he said. â€” /WAB (THE FREEMAN)

soRRy. i got confused with the statement. first was "they believe" then "she has" the cell phone already? which is which? do they have it in hand? i haven't read much about the whole thing yet kasi, although i already read a couple of articles about it. i hope the writer of the article can shed some light on the matter.

It's only an assumption of the police that Vi's cellphone was with Jonelle.
That's why they also assumed it was only Jonelle who kept on sending messages acting as Vi.
