reclusion perpetua or permanent imprisonment does not allow pardon or parole until after the first 30 years of the sentence have been served; after 40 years without pardon or parole, the sentence ends. Life imprisonment does not have any definite extent or duration of imprisonment, and prisoners serving life imprisonment can have parole at any time.
Unlike life imprisonment, the length of a sentence for reclusiÃ³n perpetua is an indivisible penalty of 40 years and cannot be altered during sentencing.

  receive the maximum penalty.
She took a life then she has to pay for the consequences of her actions.
That is for the rest of her condemned life and hell-bound soul, she will

Family awaits court ruling

MORE than two years after her murder, the memories of Lyn Vi Ebarita linger on in the mind of her nine-year son Lykhan Paul.

Lykhan still asks his grandfather, Vicente Ebarita, 57, to accompany him to the cemetery to visit his motherâ€™s grave.

Despite being busy with his work, Vicente always stops what heâ€™s doing to bring the boy to the Golden Haven Memorial Park in Talamban.

Vicente said Lykhan still cries on his motherâ€™s grave.

â€œMaapektohan gyud kay gamay pa man gud (Heâ€™s affected because he is still young),â€ he said.

Lykhan was 7 years old then when Lyn Vi was murdered.

The case is awaiting decision. Vicenteâ€™s wife, who is in America, would sometimes ask about the case.

â€œMaghuwat na lang ta sa desisyon, naa na man sa husgado (Letâ€™s just wait for the decision.
Itâ€™s with the court already),â€ Vicente would tell friends and relatives who ask for updates about the case.

Lyn Vi was stabbed 22 times on Jan. 18, 2009. Her decomposing body was discovered four days later inside a garbage bag sealed with a packaging tape.

A strong smell led to the discovery of the body at the back of Room 309 in the Nikkei Garden Hotel in Mandaue City.

On Jan. 28, at 3:30 in the p.m., police arrested the suspect, Jonelle Enfectana, 28, the victimâ€™s officemate, inside Mandaue District Hospital.

Ebarita and Enfectana were call center agents working in Mandaue City.

Regional Trial Court Judge Marilyn Lagura-Yap will resolve this week or next week if the suspect will be allowed to post bail.

Murder is a non-bailable offense. The suspect is still detained at Mandaue City Jail.

But in a motion for bail, counsel Dominic Yap said the burden of showing that evidence of guilt is strong is on
the prosecution and unless this fact is satisfactorily shown, the accused may be bailed at the courtâ€™s discretion.â€

Assistant City Prosecutor Bienvenido Mabanto Jr. presented affidavits of officemates who saw the Ebarita together
with Enfectana and another woman, later identified as Tina Panganiban, the night she was killed.

The three officemates - Iker Fernandez, Ronnie Anudin and Vincent Catan â€“ were among those who last saw Ebarita alive.

Mabanto also presented the affidavit of Nikkei Garden front desk in-charge Morena Joy YbaÃ±ez, who identified Panganiban as the one who took the room where the victimâ€™s body was found.

YbaÃ±ez provided the description for an artist sketch of the suspects. The three officemates recognized the woman in
the sketch as the woman who was with the suspect and the victim when they last saw them.

The prosecutor presented the artist sketch as one of the pieces of evidence.

Mabanto said even before the discovery of the body, â€œthe accused Jonelle Enfectana already made manifestation
that she is aware where the victim could be located.â€

Vicente said he has no more ill feelings towards the suspects. He said that as a Christian, he doesnâ€™t bear a grudge against others.

â€œJonelle, I have forgiven you and your companions. But you have to be held liable before the law,â€ said the victimâ€™s father, Vicente.

Vicente said that one time during the hearing, they prayed over Enfectana.

â€œOthers thought that I was her lawyer, only to be surprised to learn that I am the victimâ€™s father,â€ he said.

What to say...

its been 3 years and i still think about linv all the time...
she's the source of my happiness.
i love her still to this day.
i was so close to marrying her.

i have no idea what to tell lykhan...
i should have stayed there but i wanted to make a better life for her and lykhan here in america.
all i had to do was buy her a plane ticket.
i had a place and a car ready for when she and lykhan arrived here.
she got her passport 2 weeks later.

i wonder if lykhan hates me.
i would have gladly lived with linv in cebu.
and i would protect her with my life.
we were happy.
i love both of them.
i still wonder if lykhan likes dinosaurs.

i like to think that she still lives through me.
her memories i keep alive.
i can tell stories about me and her and lykhan easily.
especially how i met her mother for the first time...
or how i met lykhan for the first time...
linv told me he didnt like the water...
but he was cool about it when i was there.
pickin up shellfish...
some of them look pre historic.
he brought back a few and some hermit crabs.
the look on linv's face when she saw lykhan playing in the beach was oh so amazing.

linv to me is the perfect woman.
exciting and elegant and super smart !
she knew more words than i did.
her movements were graceful and i could not take my eyes off her.
she was and is the best part of my life.

i miss her but i love her more.
and if she's watching me... she'd be pissed if i was just sad all the time...
so with her fighting spirit in mind...
i will continue living.

when it comes to love... there's only 1 true love...
i dont think there can be another...
boo has my heart...
she's the kindest, sincerest, most beautiful, smart... basically everything you could ever love in a woman.
I love her with all that i am.

to linv's family...
im sorry... i tried real hard to get the fiance visa moving...
were were just waiting for her passport.
if lykhan needs new DS games let me know and i'll try sending it there.

please statesville, or anybody that i know who's following this, let me know whats happening.

sorry about not posting in this place...
i really dont like hearing about how my fiance was murdered.
and im a bit rusty in my bisaya but i still can understand a bunch of words if necessary.

Ryebai, I just came back from my 6 weeks vacation in Cebu I went to see Lykhan he's the opposite of a jolly boy that I know of.
He had a sad face and looking afar and when he answered a question he looked down as if looking for answers.
His aunt said that he always ask, " Why Mama's best friend killed her? I lost my mother, I missed her so much"
It really hurt to hear the lamentation of this young boy who got plenty of questions but no answers.

im confused as to who you are...
first you say linv's mom is in america...
i think i remember where she is...
then you tell me you just came back from vacation in cebu...

but if proof is what you need...
well i can say how i met linv's mom and her dad...

linv's mom...
well i was driving a black truck...
and dropped linv off outside her house...
right at the gate was a lady...

linv tells me its her sister...
actually linv liked to put me in awkward situations like that...
she likes to see me being nervous...

it turns out the lady was her mom...
her mom instantly knew i was a fil-am...
the funny part is what she said to linv...
"tambokikoy !!"
i also think she added a word right after that...
"kaayo"

i wasnt insulted
boo was laughing and big smiles...
and i was like...
yeah im a bit fat.

that was a funny moment...

then i met vincent at shakeys...
now... he was looking directly at linv...
and he should...
of course i was just a guy...
he knew nothing about me and really it seemed like he didnt care...

but i was holding on strong to linv's hand under the table....
i was as respectable as i can...
i mean how do you present yourself to the father of your girlfriend ??
its just really tough...
but i planned on letting vincent know that i can take care of linv.

i was living with linv for 9 months...

after a while vincents hard gaze eased up a bit...
i had a feeling he could see stability in me...
just a stand up person...
i never treated her bad...
i respected her very much.
of course i love her very much as well...

before i left i wanted to tell them both that i was going to marry linv.

ok so if you need more proof...
i can tell a bunch of things that happened.
but i think you know its me...

now about why i am here...
lykhan...
i need to talk to him...

its been a hard 3 years for all of us that loved linv so much.
i feel that i can talk to him...
and help him out of his invisible prison of sorrow.

why would lykhan listen to me?
well, i always thought he did because he asks me a lot of questions...
and i had answers...
to me lykhan is a cool kid...

i think i have an answer for his sorrow...

he knew english pretty well back then...
i hope he's not rusty.

to the family of linv.
i deeply apologize...
linv was the 1 i wanted to marry.
she was the love of my life...

linv was really smart and funny and super beautiful with the most gracious attitude.
she had a million traits about her that made her amazing...
not only that but her son is super cool...

i hope ya'll are doing well.
lykhan... i havent forgotten you.
i think linv wanted me to tell you a few things.

Ryebai, to clear up your confusion, I lived here in the U.S. for over 20 years and currently working as a Registered Nurse.
I took a vacation for over 6 weeks to see my family in Cebu and just returned recently here in the U.S.
About Lyn Vi's Mom and father they got divorced and both of them had re-married.
Bai's mom married an American and she came to the U.S. last July 2007 after her visa was approved.
Then on January 2009 during the Sinulog, Bai's mom was informed about the tragic death of her daughter.

As my sister drove by over a bridge, she told me to look on my right side and saw the hotel where Bai was murdered.
Both of us felt some pain in our chest, a painful reminder of how a loved one was taken from us abruptly.
It's the first time I saw the hotel, the foolproof witness of what really took place on that eventful day.
