Health care providers have long identified the Stark and AKS law, intended to prevent abuse in Medicare in the form of self-referrals, bribes, or other unlawful payment, as barriers to the care coordination required of high-functioning value-based health care arrangements. Last month, the Department of Health and Human Services issued a pair of rules that would provide certain exceptions to the Stark and AKS laws to encourage taking financial risk in value-based care.
“These proposals represent the most significant potential revision to these laws in decades,” said Mr. Shah. “We will review some of the biggest practical impacts of the proposals and help providers identify opportunities to give the agencies feedback.”
These critical updates will modernize these laws for today’s health care reimbursement landscape. With the move away from a fee-for-service, volume-driven payment environment toward payments based on quality, these rules ease the way for participation in value-based payment.
