POLITICAL DYNASTIES are just wrong

first things first, from the online dictionary, a dynasty is

1.  a succession of rulers from the same family or line

2.  a family or group that maintains power for several generations: a political dynasty controlling the state

Politics in the Philippines has been under the control of a few notable families.  It is normal for a politician's son, wife, brother, or other kinsman, to run for the same or other government office.  The term coined by Filipinos to describe this practice is "Political dynasty", the equivalent of an oligarchy in political science. The 1987 Constitution of the Philippines states in Article II Section 26,

"The State shall guarantee equal access to opportunities for public service, and prohibit political dynasties as may be defined by law."

Though, political dynasties have been a present staple in Philippine political arena.

Many have called for the Congress to pass the Anti-Dynasty Law, but this bill has been passed over by each Congress since 1987.

Some have pointed that oligarchy is the root problem of all the corruption in the Philippine government.

Despite the entry of the Party List System in the 11th Congress, the proportion of lawmakers with relatives in elective positions have remained the same in the post-Marcos political scene. (wikipedia)

From the names drafted into the senatorial tickets, there are grounds to argue that the two coalitions rigged the selection process by tilting the choices heavily in favor of political families long embedded in power, not only on the national level from President Aquino down to members of both chambers of Congress, but also on the local level, including governors and mayors.  The tickets excluded nonelite candidates.  A scrutiny of the two lineups reveals the hand of political families whose interventions have virtually reduced the constitutional ban on dynasties to a scrap of paper.

The use of the family as a platform for political recruitment goes against an explicit state policy.  Section 26 of Article II of the 1987 Philippine Constitution declares: “The State shall guarantee equal access to opportunities for public service and prohibit political dynasties as may be defined by law.”  The failure of Congress to pass a law defining the terms and scope of this constitutional mandate is not an excuse for ignoring it.  The language and intent are clear.   If the nation’s legislators cannot be deterred by the ethical principle behind this provision, why do we expect public officials at the lower levels of government to abide by it?

If it expresses anything at all other than the greed and shortsightedness of our politicians, I think the failure of Congress to affirm what the Constitution says merely reminds us of the folly of legislating solutions for which society itself is not ready.  The question we ought to ask then is not why our politicians defy the Constitution, but why political clans persist, and what will make them obsolete.

The framers of our Constitution sought to break political monopolies by prescribing term limits and prohibiting political dynasties.  Both tools failed to loosen the grip of elite families over the nation’s political life. Why?  Because the political system failed to develop an alternative structure that could challenge the existing kinship networks as mechanisms of political recruitment and leadership formation.  That is the work of political parties.

But, instead of functioning as durable tools for aggregating diverse interest groups, our political parties have become no more than family-owned franchises to be sold and transferred like material assets.  Bereft of ideological commitment, they have no distinct identity to preserve, and no world view to pass on to a younger generation.  Rather than recruit and groom young leaders from a wide pool of talent, these parties have been content to nurture scions of the old political clans and to assimilate celebrities spawned by the mass media.

Not surprisingly, our so-called political parties have no permanent members, no rigid screening of applicants, no finances of their own outside of those provided by their current leaders.  But, more importantly, they neither command nor demand from their elected members strict compliance with any party line.  Thus, Filipino politicians are never taken to task for switching parties whenever it suits them.  Indeed, so insignificant is formal party membership that they have no problem retaining their nominal party affiliations even as they run as “guest” candidates in another party.

These traits may make politics “more fun in the Philippines,” but they are also the reasons why our institutions are weak.  We cannot continue to assign to a few families the work that in modern societies belongs to political parties.   A nation’s political system, like its economy, must be able to draw from the best and brightest of its population if it is to survive the growing complexity of the modern world.  It can only do this by professionalizing politics.  Does the President’s party, the ruling Liberal Party, have the will to achieve this?

We have all heard the excuses they offer in defense of this [political dynasty] premodern practice:

one, that their family members are perfectly qualified, and that the younger generation of the same family is often better trained for public service

two, that political leadership is not any different from other professions where parents pass on to their children the same passion and aptitude for their chosen line of work

three, that society is better off when there is continuity in public service than when there is disruption in leadership

four, that the power to install individuals to public office in any case remains with the electorate, not with the family

and lastly, the fact that Congress has been unable all these years to craft a law defining a political dynasty signifies the impracticality of this constitutional provision

we remember how city mayor dan lim attacked the attempts of the torralbas to build a political dynasty in tagbilaran city, bohol. joe torralba fielded his wife as mayoral candidate in 2004 after his three terms expired.

now dan lim is doing the very same thing that he pretentiously hated. today he fielded his wife, sharleen, to run as vice-governor, and his brother, abraham, city mayor, as he himself seeks a congressional seat in the first district. meanwhile, his nephew, baba yap, is running for city mayor against his own uncle, abraham.

pareha ra na dire sa davao del sur... ang amahan modagan ug mayor, ang asawa congresswoman, ug ang anak, governor... sa davao city pareha pod.. pero ni give way ang isa ka anak... so duha na lang sila.. same pod sa mga pacquaio... their reason for running... "dahil gusto naming makatulong sa taong-bayan.."

The 1987 Constitution of the Republic of the Philippines: Article 2 - Declaration of Principles and State Policies, Section 26 states that:

“The State shall guarantee equal access to opportunities for public service, and prohibit political dynasties as may be defined by law.”

This provision clearly prohibits the existence of political dynasties in the country to preclude equal access to public service and the right for people to choose in the local election.  However, it is not self-executory, meaning the provision needs an implementing law before it can be applied.  Unfortunately, no such law has been approved in twenty years, mainly because of disagreements on the definition of a political dynasty, thus it continues to exert a pervasive influence on Philippine politics.  Furthermore, the democratic character of the government allows such groups to justify their existence and thrive under the mantle of legitimacy.  It is true that no political family should exercise monopoly of leadership but they have all the economic resources and political clout to do so.

In section 115 of the Election Code of the Constitution, there is a proposed definition of political dynasty that was included but was not approved.  The proposal prohibits persons having the same civil degree of relationship to run in any elective position in the same political unit in the same election.  It also does not allow any persons with the same civil relationship, including legal or common-law partners, to succeed an incumbent position of the latter.

Former Sen. Juan M. Flavier has authored SB 12 that defines and prohibits political dynasties.  It refers political dynasty as “the concentration, consolidation, or perpetuation, of public office and political powers by persons related to one another.”  Persons holding office and related within the third civil degree of consanguinity or affinity – including their spouses and the spouses of their brother-in-law and sister-in-law – will already be deemed to be in a political dynasty relationship.

There is a related piece of legislation that was filed in the House of Representatives, authored by Rep.Emilio C. Macias II – HB 44, that seeks to ban local officials from occupying the next higher position which they had previously occupied and for which they had served for three consecutive terms.  The bill is currently pending in the House Committee on Local Government.  If enacted into law, the bill will effectively prohibit an elected local official from filling a permanent vacancy by way of succession in the offices of the governor, vice governor, mayor or vice mayor during the prohibitive term or the term of office immediately after the third consecutive term.

While there is still no enacted law for these provisions, the Constitution has provided that all elective officials, from congressmen to municipal councilors, be limited to three consecutive terms.  The idea was to limit the power of political clans.  Unwittingly, the opposite has happened as the three-term limit gave the opportunity for political dynasties to perpetuate themselves in power.  After their three-term is over they would either put their spouses or their children or any relative to replace them for the post that they would leave and they would run for another post as there is no law saying that they cannot do so.

Now, the Constitution passed the enactment of these provisions to the Congress but the reality is that the dominant members of the House belong to political dynasties, which cannot be expected to legislate their own demise as a political entity.  However, the politicians think that if people do not like you, they would not vote for you.

pareha ra na dire sa davao del sur... ang amahan modagan ug mayor, ang asawa congresswoman, ug ang anak, governor... sa davao city pareha pod.. pero ni give way ang isa ka anak... so duha na lang sila.. same pod sa mga pacquaio... their reason for running... "dahil gusto naming makatulong sa taong-bayan.."

Tinuod mas grabe diri sa Digos, ang kapitan sa barangay sa among zone 3, uyoan sa governor si Dodo Cagas, ang gobernor, ang iyang anak, si Marc Cagas congressman sa first district ug ang asawa si Didi Cagas, board member sa District 1. Ngano nga dili man sila mapukan, tungod kay daghan ug mga projecto nga napahimuslan sa katawhan. Kon dili man maayo sila, ngano ba ug atong ibagsak sa sunod nga eleksyon. Naa ra sa katawhan kon itugot ang political dysnasty.
