In answer to the two criminal cases filed against him by deputy city mayor Mariano Uy, respondent city councilor Edgar Lo Kapirig is asking the prosecutor handling the preliminary inquest to dismiss the two cases for lack of merit.
The preliminary hearing is set on Tuesday, Jan 12 with Assistant City Prosecutor Romeo Chatto, handling the twin complaints filed by Uy.
“The dye is cast. There is no turning back. I would even file cases of perjury against Mr. Uy’s witnesses if they are found lying under oath,†Kapirig said.
Two witnesses of the complainant, namely Jedo Lopena and Constantino Garcia did not have any personal knowledge of the alleged utterances that are subject of the Libel case filed by Uy. The two only just heard it from a certain Dr. Sepe allegedly admitting the utterances of Kapirig.
Being not present during the actual alleged incident, their testimonies are all hearsay, the answer of Kapirig stated.
Uy is suing Kapirig for Libel with a corresponding claim of P10-million for damages.
