Literally, the complaint against former Sangguniang Kabataan provincial federated president Jane Censoria Cajes has been buried and will lay in rest in the archives.
Board Member Venzencio “Benjie†Arcamo, Sangguniang Panlalawigan committee chair on public accountability, in his report rendered Friday, said since Cajes is no longer connected with the provincial Government of Bohol, having served and ended her term of office effective December 1, 2010, action taken or whatever outcome of any investigation on the matter has no more force or effect, therefore any probe is now moot and academic.
Accordingly, there is already a prior complaint filed in the Office of the Ombudsman against Cajes, involving the same issues, any action investigation, or inquiry that maybe conducted by the SP committee would be a duplication of the investigation that the Ombudsman may undertake.
The committee report was unanimously approved by the provincial board in session, presided by Vice Gov. Concepcion O. Lim, last Friday.
Earlier, a letter dated November 5, 2010 from the core members of the SK Reform Coalition-Bohol, was received by the SP requesting to conduct investigation and fact-finding on the alleged questionable transactions of SK President Cajes amounting to P93-million. The letter was referred to the committee of Arcamo.
A meeting presided by Arcamo, committee members Brigido Z. Imboy and Gerardo B. Garcia was held Dec. 3, 2010 treating the SK Cajes issue, earlier referred to the said committee.
In the committee meeting, it was found out that the letter-complaint was not verified or not under oath. Also, under Sec. 61, of the Local Government Code (R.A. 7160) the provision states: “A complaint against any elective official of a province, a highly urbanized city or an independent component city, shall be filed before the Office of the President.â€
Such provision of the law renders the Cajes issue not under the jurisdiction of the provincial board, Board Member Arcamo, who is also a lawyer, said.
The 3-page committee report finally recommended the letter-complaint, be kept in the SP data-bank for future reference.
