ANOTHER OMBUDSMAN CASE IN THE MAKING
(an editorial of the Bohol Chronicle)

If City Hall and its allies don't watch out - they could be setting up another powder keg that only needs a match to ignite.

Take the case of the supplemental budget of P15 million (to pay landowners at the Dampas dump site) approved last Friday by the tyranny of numbers of the Majority bloc - against the rightful objection of the Minority.

If City Hall was a private corporation, it is a clear railroading of a budget appropriation that should call the attention of the Board of Directors.

For that to be approved, transparency and professionalism dictate that the names of the lot owners, the number of landowners involved and the size of their respective lots will have to be presented - as landmark basis for approving a huge P15 million of the people's money.

Be that as it may, when the deal is consummated - and the landowners are supposedly paid - the COA and independent anti-corruption crusaders can always verify the "cash-for-land" transaction in official public documents and will be measured by the zonal and market values (of the real estate) which are of public knowledge.

Surprisingly, the area is estimated at 2 hectares, more or less, which would mean that a dumpsite area would cost government no less than P650/sqm when the market value is only about P200/sq.m. Added to this, the lot to be paid is the area where the illegal dump site is situated since open dump sites were closed by DENR in 2006 under RA 9003, but is still being used until today.

Real ownership of the titles by the claimed owners can also be independently verified.

A case can still be built in the future, regardless of how opaque the Majority passed the Supplemental Budget last Friday.

Because, as they say, the day of reckoning will always come - as easily and as unerringly as Friday follows a Thursday.

Lack of transparency is a disease that has become the rule rather than the exception in many of City Hall deals.

For instance, all City Accountant Kurt Bongabong has to do is to present supporting documents at the SP to show that the 22 vouchers declared by the COA as "missing" are indeed in his possession, as Kagawad Zenaido Rama rightly declared.

Likewise, top-notch lawyer acting as private citizen Atty. Victor de la Serna's demand that City Mayor's gag order on the P20-million unliquidated advances in 2008 (found in COA's Report) be lifted is morally correct so that once and for all the City of Tagbilaran residents - who have all the right to know - can be at peace that scoundrels have indeed not stolen their money.

Or had used it for other extraneous purposes other than as approved - since it is taking forever for them to be liquidated.

The City lawyer de la Serna had no choice but to compare that getting public documents from the Capitol takes only 30 minutes - as it should - while the City has to go through a lot of hemming and hewing just to be able to tell people where their money went.

Methods of governance - because people follow by example - between the City and the Province, in matters of access to public documents, are a whale of a difference.

One is noteworthy, the other is both shameful and shameless. It proves, that one of them has something awful to hide.

It cannot be otherwise.
