OMBUDSMAN Ma. Merceditas N. Gutierrez ordered the suspension of a public school teacher for inflicting injuries on a nine-year-old student.

Gutierrez ordered the six-month suspension from service without pay of Hilarion Araysa, public school teacher of Cambuac Sur Elementary School in Sikatuna, Bohol, after he was found guilty of simple misconduct.  
The case stemmed from a complaint filed by Joseph Oracion, Araysas student.

Oracion narrated that on Nov. 17, 2000, he asked to be excused from his religion class to attend to a call of nature. While outside the classroom, he stayed with some of his classmates who were playing at that time as they had no class. When Araysa called their attention, only he obeyed while his other classmates ran away.

When he got near Araysa, Oracion said the teacher allegedly scratched his face on the right side and struck his back with his hand causing him injuries.

Attached to the complaint is his medical certificate which shows the injuries sustained: pain at the back intrascapular area abrasion at maxillary area; abrasion and soft tissue contusion.

Araysa denies the accusation against him saying they are “baseless, fabricated, and replete with lies and misleading assertions.”

But the Ombudsman said Araysa failed to rebut the assertions of the complainant by positive and convincing evidence.

“Respondent’s attribution of ill-motive on the part of the complainant in filing the herein complaint is bereft of any factual basis, and is at best deemed self-serving,” Gutierrez said. (RP/Sunnex, Sun Star Manila, June 10, 2007)
