Usa ako ka retirado nga nga nag-alagad sa  City Government of Davao, particularly sa City Assessor's Office.  I was there from 1987 to December 4, 2006 being my 65th birthday. Naghupot ako ug katungdanang Feal Property Appraiser IV.  Mao nga human sa akong pag retire, naka huna huna ko nga mopa ambit sa akong nahibalo-an bahin sa pag hatag ug value sa mga kabtangan apil na niini ang pag compute sa mga buhis nga bayaran sa tag-iya matag tuig.

This Question and Answer Forum About Real Estate therefore is an invitation to all property owners and administrators who may have some problems relative to property valuation,  real estate  taxation and of course this includes the the Webmembers and visitors.

Rest assure that  I will answer you the best I can.  If there are some questions relative to real property which I believed is not within my area of expertize, I will ask my lawyer-friend who are still in the service for proper advice.

As an opening remarks, I will post this as my initial invitation.  You might have some reactions, or possibly an answer, so let us post it here for everyone to share.

i really would like to know pila kaha ako mabayran na tax sa amo residential property worth P3.1M?  hapit na tingbayad naman gud and this would be my first time to pay since last year pa namo napalit ang property.

Mangutana ko nimo bahin sa imong balay.

1.Pila man ka andana imong balay. ug pila man ang floor area in square meters
2. Bag-o ba kana siya
3.Kun bag-o kanus-a nahuman tuiga ug kanus-a usab gipuy-an nga tuig
4.Duna ka bay building permit/certification of completion or occupancy ug pila man ang nabutang didto nga construction cost
5.Kun bag-o wala pa ba kini mabisitahi ug Assessor o wala ka ba kaadto sa Assessor's Office aron ma declare,
6. Kun naka-adto ka sa Assessor's Office, gitaga-an ka ba ug  copya sa tax declaration sa imong balay, pila man ang nabutang didto nga
6-1 =Market Value
6-2 =Pila sab ang gibutang didto nga Assessed Value
7. Asa man ka nga probinsiya/siyudad/municipio nagpuyo.
8. You mention pala about palit, pila man ang nabutang sa Deed of Sale. Kay gipalit man diay kana, niadtong pagpalit unsay gihimo diay sa imong abugado, wala ka ba avisuhi sa angay nga buhaton sa Deed of Sale.  Niabot ka na ba sa BIR aron bayaran ang Capital Gains (seller ang mobayad ani kun walay sabot gihimo)

Kanang mopalit ka ug balay labina ug daan daan na, posible nga ang tag-iya nag declare na niana,  Wala ba nimo kuha-a ang iyang declarasyun sa maong balay kay mao man kana ang gamiton sa pagtransfer ngadto kanimo.  Gikan sa pagkahimo nianang balaya  ug hangtod sa iyang pagbaligya, ang seller mao ang mobayad niana sa buhis kun wala kini ma declare sa Assessor, kana kun walay sinabutan.  Pero kun miingon ang Seller nga  naa koy utang sa Treasurer, ikaw na ang mobayad sa Capital Gains, Docs Stamps, Documentations, Registration or transfer fee ug tanang gasto sa  pagpatransfer, mao nga Php 3.1M lang akong baligya sa akong  balay, imbes Php 4M 
mao na nga ikaw gayud ang mobayad sa tanan. Kun wala, ma perjuicio ka labina kun marunong ang Seller, pahirapan ka. You can not transfer in your name the declaration of the house, if you will not clear the tax obligation of the previous owner.  that is the law on property tax.
Kining tanang pangutana importante usa ko motubag kanimo, kay ang akong tubag mo basi sa imong tubag sa imga pangutana nga naa sa itaas.

Sa imong 2010 kun bayaran karon, 20% discounts mao na ang balad sa R. A. No. 7160

sir al, at d moment, i cant provide all the info yet kay naa sa attache case sa ako bana ang mga papers. he is already snoring.kalimot ko sa code,hehehe!

it's a two-storey house. we bought that house on sept. 2007. it was a new house actually when we bought it. kalimot sad ko sa floor area,basta ang whole lot is 137 sq meters lang. kumpleto na jud na sya tanan papers. naa na na sa ako name april of 2007 pa. cge lang, i will do my assignment so u can answer my question. thanks a lot!

You said it was a two - storey house. and the cost was Php 3.1 M and that it was new in 2007
My question now is.  Where did you buy the new house. Was it from any of the following:

A) Was it from a developer.  If so, package na sana iyon na mayroon kang tax declaration sa house and a tax declarasyon sa lot na 137 sqm.  This will be considered as new when declared in your name. Or if the debveloper declared it in its name, at the time of transfer the clerk would have transferred it in your name.  Anong nangyari pali after you paid the developer..

B) If the house and lot was bought in 2007 from a previous owner who is not a developer, kinuha mo sana ang kanilang old files sa tag declaration.  KUN WALA RIN SILANG MGA tax declaration dahil bago nga ng itoy ipagbili nila, parang kamo na talaga ang new owner.

The discount of 10% is until march 31, 2009 and a 20% discount is given also if you pay your 2010 tax due today until March 31, 2009.  PLEase get in touch with your City Treasurer.

WHEN POSTING your answer, INDICATE KUNG SAAN MO BINILI ANG BAHAY, SA DEVELOPER BA O sa previous owner.  Indicate also kung na declare ba ito previously under the old owners if any.
Please answer me this present inqury para maka bigay ako ng initial na sagot s a iyung katanungan.

So, i digested na per your last post that your papers are complete.  Now please follow the instruction.  Get the tax declarations of both the house and the lot.  in Davao, we are now using the new form which we are utilizing only the front page.  Dito makita mo ang Assessed Value.  Mayroong portion diyan sa baba na:

Example lang kini:

Sa tax declaration na land:

Kind /Class o Property       Market Value              Assessment Level         Assessed Value
Land-Residentai;               Php 300,000                     20%                          Php 60,000 (1)

Sa tax declaration na Building

Kind/Class of Property       Market Value               Assessment Level         Assessed Value
Building-Residential           Php 1500,000               30%                           Php 300,000 (2)

You try to read also the portion that says:

THIS TAX DECLARATION BEGINS taxable year __________(3)

4) Please call your City Treasurer how much is the Real proprty tax rate the year when the tax declaration became effective (see No. 3) above) and until 2009 if there were changes.

Asa na man ka karon. What is the Assessed Value of your Building and how much is the tax rate of Cagayan de Oro City. With this, I can answer you the question asked.

Until March 31 of the current year.  For sure, call now your Treasurer's Office para you will be apprised about it.  OUR LOCAL ANGGUNIAN MIGHT HAVE DIFFERENT IMPLEMENTATION AND RE GULATIONS.  NOONG UNA,  REAL Property Tax used to be a national tax, ngayon it is being administered by the local government unit.
