USA and Canada / Yet another execution

Condemned Ga. inmate has much support, little hope
By GREG BLUESTEIN - Associated Press | AP â€" 1 hr 37 mins ago

ATLANTA (AP) â€" Yet another appeal denied, Troy Davis was left with little to do Tuesday but wait to be executed for a murder he insists he did not commit.

He lost his most realistic chance to avoid lethal injection on Tuesday, when Georgia's pardons board rejected his appeal for clemency. As his scheduled 7 p.m. Wednesday execution neared, his backers resorted to far-fetched measures: urging prison workers to strike or call in sick, asking prosecutors to block the execution â€" even considering a desperate appeal for White House intervention.

He has gotten support from hundreds of thousands of people, including a former FBI director, former President Jimmy Carter and Pope Benedict XVI, and a U.S. Supreme Court ruling gave him an unusual opportunity to prove his innocence last year. State and federal courts, however, repeatedly upheld his conviction for the 1989 killing of Mark MacPhail, an off-duty police officer who was working as a security guard in Savannah when he was shot dead rushing to help a homeless man who was being attacked.

Davis' attorneys say he was convicted based on flawed testimony that has been largely recanted by witnesses, but prosecutors and MacPhail's relatives say they have no doubt the right man is being punished.

"Justice was finally served for my father," said Mark MacPhail Jr., who was an infant when his father was gunned down. "The truth was finally heard."

As Davis' attorneys considered filing another appeal, his supporters planned vigils and rallies around the world. Nearly 1 million signed a petition seeking clemency, according to Amnesty International.

"We've been praying about it and with God on our side anything can happen," DeJaun Correia-Davis, the condemned man's 17-year-old nephew, told a rally of hundreds in front of the Georgia Capitol late Tuesday. "Let this be a case that not only highlights the death penalty but will hopefully be a big part in bringing it to an end."

Georgia initially planned to execute Davis in July 2007, but the pardons board granted him a stay less than 24 hours before he was to die. The U.S. Supreme Court stepped in a year later and halted the lethal injection just two hours before he was to be executed. And a federal appeals court halted another planned execution a few months later.

This time, state officials are confident this lethal injection will be carried out. Georgia's governor does not have the power to grant condemned inmates clemency. Davis supporters are calling on Chatham County District Attorney Larry Chisolm to block the execution. But the prosecutor said in a statement Tuesday he's powerless to withdraw an execution order for Davis issued by a state Superior Court judge.

"We appreciate the outpouring of interest in this case; however, this matter is beyond our control," Chisolm said.

Spencer Lawton, the prosecutor who secured Davis' conviction in 1991, said he has no doubt he is guilty.

"What we have had is a manufactured appearance of doubt which has taken on the quality of legitimate doubt itself. And all of it is exquisitely unfair," Lawton said. -- http://news.yahoo.com/

By JULIANA BARBASSA - Associated Press | AP â€" 59 mins ago

RIO DE JANEIRO (AP) â€" A 14-year-old girl has told police she was held and raped for four days by inmates after being taken inside a men's prison in northern Brazil.

The girl escaped early Saturday and sought help from a jail guard, who took her to the police, said Fabiano Amazonas, head of the juvenile division of police in Para state.

The director of Heleno Fragoso prison and 19 other people working there between Friday night and Saturday morning have been fired, Aycha Nunes, spokeswoman for the Para prison system, said. The decision became official Monday.

The teenager has testified she was drugged, beaten and taken by a woman along with two other teenagers into the prison, which is 26 miles (42 kilometers) from the state capital, Belem.

Amazonas said he believes the girl was taken into the prison by someone intending to charge prisoners money to have sex with her.

"She said she was abused by several inmates inside the prison, but managed to escape," he said.

Investigators are trying to determine who took the teenager into the prison, who allowed her entry, who participated in the alleged assault, and whether there were other girls involved.

On Saturday, the girl was handed over to the police's juvenile division, where she testified. She was also taken to a hospital so she could be examined for evidence, Amazonas said. The girl was then housed in a shelter.

The state's governor, Simao Jatene, ordered a wall built around the prison to increase security, according to a press statement issued Monday. The penitentiary works on a semi-open regimen, with inmates free to leave during the day. There is no fence, and the back of the building is surrounded by jungle.

The federal prosecutor's office in Belem said it has started an administrative investigation to learn where the system failed and prevent cases like this from happening again.

"The facts show a violation of human dignity, a disrespect of the basic rights of this child, a serious violation of human rights," said the regional federal prosecutor for civil rights, Alan Mansur Silva.

It is not the first case of a girl allegedly being abused inside a men's prison in Para state.

In 2007, a teenage girl arrested on petty theft charges was locked up in a jail cell with 21 men for nearly a month in Abaetetuba, a city of 78,000 people outside Belem. She was forced to have sex with them in exchange for food and was released only after her case was reported by local media.

The case shocked Brazilians, and then-Gov. Ana Julia Carepa told The Associated Press at the time that the practice of locking women up with men, while illegal, was not uncommon.

Carepa also said she was aware of the "unfortunate practice" of putting young women in cells with men purposely for the male prisoners' sexual gratification. Carepa then said this wouldn't be allowed to happen again. -- http://news.yahoo.com/

Sinosauropteryx, a dinosaur with plumage similar to that found in Canadian amber. Specimens with hair-like protofeathers have been studied extensively from the Early Cretaceous of China, but this is the first time that plumage directly comparable to these specimens has been recovered from amber. A partial view of 16 feather barbs trapped within a single piece of Canadian amber. These specimens provide few clues about their potential bearer, but provide another tantalizing view of well-preserved pigments within the deposit. The overall colour of these specimens would likely have been medium or dark-brown. Photo: Ryan McKellar

A large number of isolated, hair-like filaments run diagonally through this amber piece. The best match for this very simple type of plumage is commonly referred to as “protofeathers” or “dino-fuzz”, and has been reported in association with a large number of Chinese dinosaur skeletons. Here, we cannot be certain which animal once bore the plumage, but its simple structure suggests a dinosaur source. Photo: Ryan McKellar

A very specialized feather found alongside a plant bug within Canadian amber. This feather displays specialized structures (coiled barbule bases) that are only known in modern birds adapted to gather water with their feathers. In some cases, this helps the bird dive, by reducing its buoyancy, in other cases, belly feathers with this type of coiling are used to collect water and transport it to the nest. A dark-field microphotograph that illustrates the apparent brown colour produced by pigments within the feather in amber. Much of the work on Canadian amber specimens has been limited by the technology available to observe the specimens. We have good indications of pigment intensity and distribution at a very fine scale, but large-scale colour patterns are elusive. Photo: Ryan McKellar

Within this amber piece, six feather fragments partially overlap each other. The beaded appearance of the barbules (finest structures) in this image is a result of pigments concentrated within just a portion of each of the segments that make up the barbules. These barbule segments or “internodes” are connected in a fashion similar to the segments in a bamboo shoot. Photo: Ryan McKellar

Since it’s getting so ugly over at TechCrunch, I thought I should provide an antidote of real beauty. Every now and then a scientific paper is published that hits it out of the park with imagery. Yesterday, McKellar el. al did just that in Science, publishing a smorgasbord of photographs of dinosaur and early bird feathers trapped in amber in addition to a truly stellar reconstruction of Sinosauropteryx by Chuang Zhao and Lida Xing. Without further ado:

An isolated barb that is structurally similar to those figured in 8HR, but lacks pigmentation. This specimen is largely visible as a result of being stuck within a drying line in the amber. The drying line is the darkened region within the amber, representing a surface where the resin was once exposed and partially dried. Found within the same piece of amber is a juvenile mite. During the past nine years, I have represented hundreds of clients in divorce cases. Most people want the assurance that the breakdown of their marriage was not entirely their own fault. In order to efficiently represent any client going through a divorce, I have to know all the details leading to the end of the relationship. Over the past few years, I have noticed that marriages fall apart for a multitude of reasons. Many happily married people come to me and ask what the signs are that a marriage may be headed for divorce. Based on my experiences as a divorce attorney, I have compiled a top ten list of signs that your marriage may be headed for divorce. Some entries on the list are filled with funny euphemisms. Some are more serious, but all have played major factors in the divorces I've handled.

RED FLAG #10: If your spouse is facebooking with his or her high school sweetheart on a daily basis, you may be heading for a divorce. While I don't personally believe it poses an issue if your spouse has occasional contact with an ex-lover, the contact seems to become a problem when this communication is substituted for communication with the spouse and/or if this communication is hidden from the other spouse. Many people wonder 'what if' when faced with the doldrums of everyday life. It is easy to imagine that your life would be better with that college sweetheart or that high school football star that got away. However, what one fails to realize is that a new relationship brings new issues.

RED FLAG #9: If you spouse has gained more than 20% of his or her body weight, you may be headed for divorce. In every marriage, it is important for each spouse to maintain a healthy lifestyle. Part of keeping the passion alive is maintaining the physical presence that attracted your spouse to you in the first place. When one spouse no longer cares about his or her appearance, the other spouse can lost interest quickly. The old adage of "what it takes to get her, it takes to keep her" is actually true.

RED FLAG #8: If you spouse is donning sexy new underwear all of a sudden, you may be headed for divorce. If your spouse makes a drastic change in his or her underclothes, you have to wonder why. This is one of the all-time biggest signs of an early stage of a new affair.

RED FLAG #7: If your spouse lies around all day and yet house needs cleaning, you may be headed for divorce. Being married is not a time for laziness. Each partner needs to do his or her part to share in the household chores. It is never permissible for one spouse to do everything in the marriage whether that is child-rearing, earning income, or maintaining the home.

RED FLAG #6: If your spouse is secretive with his or her cell phone, you may be headed for divorce. In today's society it is very easy for one individual to maintain one persona to his or her spouse and another to others. Cell phone and computer use does not make it any easier. Many of my clients felt their marriages unravel when their spouse began to be overly secretive with cell phone usage.

RED FLAG #5: If your spouse makes you write down everything you spend money on, you may be headed for divorce. This is a classic sign of a controlling and emotionally abusive spouse. Marriage is about sharing love and life experiences not monitoring your spouse's every move. Control is never a healthy weapon in marriage. Each person is an individual and must be treated as an adult.

RED FLAG #4: If your spouse no longer wants to have sex with you, you may be headed for divorce. Sex in an integral part of a healthy marriage. It provides a way to connect with your spouse on an emotional as well as physical level. Sex is good exercise and promotes healthy well-being. If your spouse no longer shows sexual interest in you, it is imperative to try to find out why and work on the issues. Often lack of sex leads one spouse to resent the other spouse over time.

RED FLAG #3: If your spouse spends more time on the tennis courts than spending time with you, you may be headed for divorce. It is very easy for a married person to find oneself completely absorbed in the activities of everyday life. In order for a marriage to have a chance at succeeding over time, each spouse has to put the marriage first. Making time on a daily basis to connect with your partner is an absolute must. If you spend more time focusing on other people or other activities, then your marriage is bound to suffer.

RED FLAG #2: If your spouse cruises singles bars after work, you may be headed for divorce. The 'singles scene' should have a danger sign posted at every corner bar. It takes a person of high integrity and moral footing to be able to withstand the singles who do not believe in marriage or respect it. If your spouse is constantly going to singles bars alone, one has to wonder if he or she divulges their true marital status to the other singles out there.

RED FLAG #1: If your spouse wants you to swing with your neighbors, you ARE headed for divorce. It amazes me how a seemingly innocent and loving couple gets drawn into this lifestyle which almost always leads to the ultimate demise of a marriage. It begins when one spouse has fantasies of 'swinging' but the other spouse does not. The unwitting spouse gets sucked into this lifestyle by promises of good sex and a happier marriage. It often leaves the less enthusiastic spouse feeling guilty, less attractive, and vulnerable.

Take, for instance, the case of automotive industry. The cars from China are, as of now, ridiculed by the Western carmakers as being mere inferior copies of the high class products that they are making. Here one should remember that Toyota had received the same treatment in the 1960s. But today, the American carmakers are getting desperate to catch up with the growth of Toyota.

Another important aspect is that the U.S. trade deficit has been growing steadily since the 1970s. Its trade deficit has been increasing at a large rate since 1997. The United States reported a trade deficit equivalent to $45 billion in July of 2011.

This can affect the fate of the dollar. It has to be noted that China is shifting some of its massive foreign holdings into gold and away from the US dollar, undermining the dollar's role as the world's reserve currency. China plans to make its currency, the yuan, fully convertible for trading on international markets by 2015.

Buying gold and allowing the yuan to be traded freely would weaken the US dollar's dominance as the international reserve currency. The move would have major implications, making it more expensive for the U.S. government to borrow money and to run perpetual trade and budget deficits.

The last element within the third world phrase has to be concerned with enormous concentration of wealth within a small segment of the polity. The gaps in after-tax income between the richest one percent of Americans and the middle and poorest fifths of the country had more than tripled between 1979 and 2007.

There are other factors which will be contributing to third world status. This will include the state of education, health care, the infrastructure and a large middle class. The US education and health care systems are dangerously lagging behind the other first world nations. The U.S. is alone among developed nations in not having a universal healthcare system.

The U.S .is ranked 41st in the world for infant mortality rate and 46th for total life expectancy. The Organisation for Economic Co-operation and Development (OECD) found that the United States ranked poorly in terms of Years of Potential Life Lost, a statistical measure of years of life lost under the age of 70 that were amenable to being saved by health care.

All these factors warn the U.S. to take immediate measures to prevent the future from becoming worse. -- http://www.ibtimes.com/

The poverty rate has increased to 22 percent among children. While among the black children, poverty rate has increased to 39 percent, and among the Hispanic children, poverty rate has touched 35 percent.

The white child poverty rate has reached 12.4 percent. The report clearly provides the new confirmation regarding the incapacity of the country for escaping the persistent outcomes of the recession.

The report has come on an occasion when President Obama is trying to get his jobs bill passed by the Congress. The latest figures will help him present the bill with more conviction.

The relevant question here will be the one raised by Arianna Huffington in her book 'Third World America: How Our Politicians Are Abandoning the Middle Class and Betraying the American Dream': Is the U.S on the path to become a third world country?

One critical aspect to be noted here is the rising economic power of China. Take the case of the communications and technology products China exports. The U.S. is no longer the top exporter is this sector. China has clearly overtaken the U.S.

In addition, China is developing its indigenous technology. It graduates more than 200,000 engineers every year who help it become an important player globally in the sector of high end manufacturing.
