im not a fan of both teams because im an oakland raiders and new orleans saints but still i love to watch american football being a sports fanatic.
that was santonio holmes (#10), pitt's starting wide receiver. and yes, he indeed became the superbowl MVP beating team mate and quarterback ben roethlisberger for the plum.

a person remains a suspect and still cannot be persecuted unless proven guilty by a court. according to the suspect's lawyer, all evidence taken and presented are all circumstantial evidences which is also known as indirect evidence. so meaning, whatever things that are used by the police as basis in pinning down jonell enfectana as the primary suspect is just a probative matter that does not proximately relate to an issue but that establishes a hypothesis by showing various consistent facts.
in law, evidence that is drawn not from direct observation of a fact at issue but from events or circumstances that surround it. example, if a witness arrives at a crime scene seconds after hearing a gunshot to find someone standing over a corpse and holding a smoking pistol, the evidence is circumstantial, since the person may merely be a bystander who picked up the weapon after the killer dropped it. the popular notion that one cannot be convicted on circumstantial evidence is false. most criminal convictions are based, at least in part, on circumstantial evidence that sufficiently links criminal and crime. so let's just wait and see the development of this case in the coming days.
circumstantial evidence or indirect evidence should always be accompanied by a direct evidence which is an evidence in the form of testimony from a witness who actually saw, heard, or touched the subject of questioning. it is also an evidence that, if believed, proves existence of the fact in issue without inference or presumption. meaning, the proof which tends to show the existence of a fact in question, without the intervention of the proof of any other fact. and that's what the police are still looking for to corroborate everything.
hopefully the police will take a look at all angles in this case and will not just attack without prejudice.

i watched the superbowl early in the morning. thank God steelers win. i thought it's going be the cardinals when they led by 3 23-20 with just over 2 minutes left. good thing roethlisberger showed nerves of steel as he was able to make a shotgun pass to santinio holmes for the game winning touchdown. kudos to the steelers and their rookie coach mike tomlin. added attraction was arnel pineda, the filipino frontman of journey who performed that day together with bruce springsteen and more.

hi! apil ko diri ha? i've been following her case and it really creeps me out. i hope justice will prevail so that ms. lynn vi ebarita's soul can rest in peace. condolence to all her family and friends.

lain ato, galagot lagi ko atong editorial ni anol mongoya. he's adding insult to lynn vi's already tragic death. diba gi-rule out naman ang "Group sex" angle kay klaro nah man kaau nga pre-meditated murder ni. kinsa man ni si mongoya? dapat ni sya badlungon bah. insensitive kaau. mang-generalize pa jud. kay abi taga call center, liberal sexual lifestyle nah diay dayon? buot2x ra kaayo siya.
that theory came from the police while they are gathering more evidences and linking clues about the crime. maybe añol mongaya just quoted what was earlier reported. when the police ruled out the group sex or orgy issue in the case, mongaya's comments had already been published. i do agree with you, when he said that call center agents are more sexually liberated. well, maybe he wasn't able to recall his rhetoric view because that's another thing. there might be some but not all. i think you are right, he could have spared that line just for the sake of the victim who is now dead. but we cannot take that away from a columnist mind. they really write what they wanted to write as part of the press freedom.

Angelina's Red Carpet Reversal

Angelina Jolie turned heads at the Screen Actors Guild Awards last Sunday, and it wasn't just because she was her usual stunning self. It turns out Angie was wearing her Max Azria gown -- a cornflower blue creation -- backward!

Did a spurned stylist tell her to wear it the wrong way round? Or was the "Changeling" star too busy caring for her newborn twins that she didn't realize her mistake?

(left to right) The front of Angelina’s Max Azria dress (Jason Merritt/Getty Images), the back (Steve Granitz/WireImage.com), and a model from Azria’s Spring 2009 collection (Scott Gries/Getty Images)

Neither, according to Jen Rade, who styles the starlet. Rade told Usmagazine.com that Jolie reversed the gown on purpose to make it "more blouson." For those of you who do not parle Francais, "blouson" is the French word for blouse. The end result was a bit too bland for my taste, and rather reminiscent of another Max Azria dress she wore to the Critic's Choice Awards just a few weeks earlier. Had she worn her gown the right way round, Angelina would have shown more skin but less of her distracting tattoos!

For some reason, the sexy actress has favored billowy blouson gowns with cinched waists this awards season. I just hope she takes a break from the trend come Oscars next month. She may be a mother of six, but she doesn't need to look matronly.

To hear more about Angelina's fashion choice, watch this report from E! News Daily. And to see more of Angelina's red carpet looks, check out Yahoo! Movies' Fashion Report Card, and click here for complete coverage of the 66th Annual Academy Awards.

Waiter returns $45,000 ring, is rewarded

Close this His salary may be less than minimum wage but it doesn't stop him from turning over a diamond ring worth about P2 million.

For his good deed, resort worker Rodolfo Niere yesterday received a cash reward of P10, 000 and a citation from Cebu Gov. Gwendolyn Garcia “for exemplary character of honesty.”

Niere, 20, was recognized for returning a diamond ring worth $45,000 (P2,070,000 at an exchange rate of P46 to a dollar) that a balikbayan left in their resort during the Suroy Suroy sa Sugbu southern heritage last week.

Another governor's citation went to Nida Abrenica, head of the housekeeping department at Club Serena resort in Moalboal where Sylvia Regis-Gogo left her credit card.

The cash reward came from Gogo, a retired nurse from Iloilo who promised to spread a good word on the provincial government's Suroy Suroy program and the good deeds that Niere and Abrenica did when she returns to the United States on Feb. 11.

“It's wonderful to know that during these times, there are still people who are honest and kind,” Gogo told Niere and Abrenica.

“It only affirms my faith that people are basically good and that you can never underestimate the power of prayers.”

Gogo said Nerie and Abrenica showed “sheer honesty that I could not believe”.

Niere has been working as a waiter and part-time cook at the Mediong Seaside Escape in Boljoon for a year and six months.

Garcia said that their display of honesty is also “another feather added to the cap of the two progressive towns (Boljoon and Moalboal) where they came from,”.

It was the first time that he found something valuable that a costumer left in their resort.

But Niere did not have second thoughts about returning the ring.

“Wala gyud ko mag-tuo nga mahalon diay kaayo to ang singsing. Pagkakita nako ako gyud dayon gi hatag sa among manager kay lain kaayo nga mag gunit ta ug butang nga dili ato,” said Niere.

Although he was only receiving P2,000 a month, he always makes sure that he will not make a mistake before he needed the job.

Someone who only finished grade four like him does not get in a public elementary school in Boljoon, employment opportunities being scarce, said Niere.

“Wala gyud ko makasabot sa akong gi bati karon (I don't know what to feel),” was all that Abrenica said when sought for her reaction.

Niere, a resident of El Prado in Boljoon, said he did not expect the recognition.

The youngest of four siblings, Neire said he has always tried to give his best when working in order to help his family.

His father died three years ago and he has lived with his mother.

Gogo said she joined the Suroy Suroy with 12 other friends while her husband, Prospero, a retired doctor from Lapu-Lapu City, was in a medical mission in Guihulngan in Negros Oriental.

She was one of more than 200 balikbayans who joined the southern heritage trail the Capitol organized on Jan. 21 to 23.

Saddam's luxury yacht heads home to Iraq

Agence France-Presse
First Posted 22:21:00 01/21/2009

BAGHDADâ€"A luxury yacht kitted out for Saddam Hussein with swimming pools, a mosque and a missile launcher will return to Iraq because the global economic crisis has thwarted attempts to sell it.

The 82-meter (270-feet) Ocean Breeze, which also sported a mini-submarine among its facilities, will be towed home from a Greek port, Iraq's government confirmed, saving it the cost of expensive berthing and maintenance fees.

The yacht was built for Saddam 28 years ago, but the Iran-Iraq war -- which saw it moved from the southern port of Basra to Saudi Arabia -- was among the factors that meant the dictator never savored its ostentatious facilities.

The vessel became the subject of a legal wrangle when it appeared in the French Riviera city of Nice in autumn 2007, where a British boat dealer tried to sell it for 23.5 million euros (30.38 million dollars).

The Iraqi government, which has a right to recover the late dictator's property, managed in January 2008 to have a French commercial court block the sale until its ownership was firmly established.

Cayman island-based Sudeley Limited, part-owned by King Abdullah of Jordan, claimed to own the floating palace, but later renounced its claim, paving the way for its return to Iraq.

"The Iraqi government has authorized the transportation ministry to bring the presidential yacht to Basra province's port," an official government statement said, confirming the move from the Greek port of Piraeus.

Iraq will also pay costs to a Greek company as part of an agreement to maintain the yacht since July 2008, the statement added.

"The Iraqi government decision to bring the yacht home will spare Baghdad the possibility of facing other claims and saves it docking and crew costs, since the Iraqi government will not be able to sell the yacht in the current circumstances with the world dealing with the financial crisis," the government statement said.

The vessel, which was built in Denmark in 1981, started life as the Basra Breeze. It was moved to Saudi Arabia for fear that the Iran-Iraq conflict would see it damaged.

Indonesian 'sex cult' leader arrested

Agence France-Presse
First Posted 19:53:00 01/29/2009

JAKARTAâ€"An Indonesian cult head accused of leading his followers in wild orgies and giving sermons in his underpants was arrested Thursday and faces charges of "lewd acts" and insulting religion, police said.

Agus Noro, the head of the Satria Piningit Weteng Buwono sect, turned himself in early in the morning after a three-day hunt, Jakarta police spokesman Zulkarnain told Agence France-Presse.

Noro, who is called Agus Imam Solihin or "leader of the faithful" by followers, is alleged to have had sex with his disciples and instructed them to have group sex while he watched in the sect's mansion outside Jakarta.

"We're investigating him based on a report made by a female follower named Kartiningsih on January 26. She complained that Noro had asked her to massage him and touch his genitals," Zulkarnain said.

"She was also made to have sex with him, while her husband and followers watched," he added.

"Lewd acts" and insulting religion carry jail terms of up to nine years and seven years respectively, Zulkarnain said.

"If our investigations prove that he carried out lewd acts, we'll name him a suspect and hand him over to the court," Zulkarnain said.

"He has about 40 followers, all adults. At the beginning, Noro told them to pray and carry out religious recitations. After several months, he told them he was God and that they didn't have to do that any more," Zulkarnain said.

Noro gave religious sermons wearing only his underpants and told his disciples they would be taught "Kamasutra" sex techniques to use in the afterlife, former follower Eko was quoted as saying by news website Okezone.

"We just obeyed like we'd been hypnotized," Eko said.

Police described the sex guru, believed to be in his 40s, as looking "cool... just like youngsters nowadays," with dyed brown hair and fair skin, the website reported.

Basilan mayor, 3 others slain in ambush

By Julie Alipala
Mindanao Bureau, Agence France-Presse

ZAMBOANGA CITY, Philippines -- (UPDATE 3) The mayor of Albarkah, Basilan and three other persons, including a woman, were killed in an ambush in Tipo-tipo Central town Thursday afternoon, police said.

Superintendent Salik Macapantar, Basilan police director, said Mayor Karam Jakilan, his driver, a third man, and a woman were killed while three other people in the convoy, including a police officer, were wounded in the ambush between Badja and Kabangalan villages past 4 p.m.

"We are looking into 'rido' as one of the motives for the [mayor's] killing," said Bensali Jabarani, Autonomous Region in Muslim Mindanao police director.

Rido refers to blood feuds that often go unresolved over several generations.

But he did not identify who the rival clan might be.

Police in the province have been placed on alert in expectation of retaliation by Jakilan's followers.

Jakilan was a known ally of the late congressman Wahab Akbar, who was killed in the Batasan Pambansa bomb attack in November 2007.

The killing of Jakilan comes as three workers of the International Committee of the Red Cross continue to be held by gunmen who kidnapped them last January 15 in neighboring Sulu province.

It was also in Albarkah where 14 Marines were killed in an ambush by Moro rebels in July 2007. Ten of the soldiers were later beheaded.

Arroyo's climate change body 'ridiculous'

MANILA -- An anti-pollution advocate branded as "ridiculous and confused" President Gloria Macapagal-Arroyo's order reorganizing the Presidential Task Force on Climate Change (PTFCC) and appointing herself as its head.

Greenpeace Southeast Asia climate and energy campaigner Amalie Obusan said Executive Order (EO) 774, which seeks to step up environmental protection, "may seem sincere and creditable, (but) the EO is itself ridiculous and confused."

Arroyo Watch: Sun.Star blog on President Arroyo

Doubts

Obusan, in a statement, said Greenpeace believes that EO 774 cast serious doubt on the task force's effectiveness and called on Arroyo to instead implement "real and tangible climate change solutions."

"The reorganized task force, now headed by the President, basically mandates all government agencies and local governments to comply with laws and responsibilities that the said agencies should already be doing in the first place," she said.

"The President is already head of the government. To appoint herself as chairperson of a body which mandates government agencies to fulfill what are already their responsibilities -- and to put aside budget for that purpose -- is absurd," she added.

Tasks

Obusan said EO 774 tasks government agencies to follow the Solid Waste Management Act, which by law should really be implemented.

It also tasked the Department of Environment and Natural Resources (DENR) to survey, map, and protect watershed areas, which is already one of the agency's responsibilities.

She said the EO mandates that waterways and riverbanks should be cleared of obstructions, but this is already stated in the Clean Water Act.

The order also calls for a compliance audit of the Fisheries Code, which is one of the tasks of the Department of Agriculture (DA).

Obusan said the directive for the Department of Energy (DOE) to head the Task Group on Renewable Energy and swiftly implement the Renewable Energy Law is already a function of the DOE.

She added that EO 774 attempts to make PTFCC a body that comprehensively addresses as many climate mitigation and adaptation strategies as possible, including the promotion of traditional medicine.

"It betrays the government's lack of seriousness in getting down to business on the real causes of climate change," Obusan said.

"Climate change is the greatest environmental threat the world faces today, any climate change task force should focus on wide-reaching and lasting solutions, beginning with phasing out coal and nuclear plants and initiating a massive shift to renewable energy and energy efficiency technologies," she added.

Arroyo, in issuing EO 774, said the government should help push the mindset from the present traditional paradigms on economics to the new mindset of conservation, protection, and restoration (CPR).

She organized the task groups on solid waste management, watershed protection, rainwater conservation, water recycling, atmospheric activities, fossil fuels, information, fisheries, agriculture, education, renewable energy, CPR economics, and outdoor and rooftop structures.

She also ordered Cabinet members, who will be part of the task force, to practice proper solid waste management and environmental responsibility.

President Arroyo or presidential adviser on climate change Heherson Alvarez Jr. will visit government offices every Friday to ensure compliance with CPR.

She said the Presidential Management Staff shall clear her schedule on Fridays and devote five hours to concerns and initiatives for environmental security. (JMR/Sunnex)

5 Cebu fiscals ‘accept bribe’

CEBU CITY -- Representative Antonio Cuenco (Cebu City, south district) said Sunday that he received reports that at least five fiscals in Cebu are accepting bribes.

He, however, said the reports could not be substantiated because no one dared to come out and issue sworn statements.

Arroyo Watch: Sun.Star blog on President Arroyo

“Wala man gyu’y mosumbong pud, magpa-anonymous, dili mo-issue og affidavit. Dili hinoon kaayo daghan, mga lima siguro (No one is willing to squeal or issue an affidavit, they want to remain anonymous. But I’m only referring to at least five fiscals),” he said.

Cuenco made the statement while answering questions on the House of Representative’s inquiry on the arrest of three persons in Alabang during a supposed buy-bust operation.

The suspects were released because of the absence of an arrest warrant and the failure of the arresting Philippine Drug Enforcement Agency (PDEA) agents to conduct an inventory at the scene.

Cuenco said the dismissal of the complaint was propped up by flimsy arguments, which understandably led the PDEA to expose an alleged bribery.

Denial

The concerned state prosecutors denied the accusation, and were subsequently cleared by the National Bureau of Investigation (NBI) in a follow-up investigation.

The NBI and the prosecutor’s office are both under the Department of Justice (DOJ), while the PDEA is under the Office of the President.

“Duna’y prosecutors dinhi among nadunggan nga modawat, wala pa lang ta’y pruweba. Dako akong pagtoo duna gyu’y modawat, labi na gyud sa drug cases (There are fiscals who accept bribes but we don’t have any proof against them. But I believe they accept bribes, especially on drug cases),” Cuenco said.

In a memorandum dated January 19, DOJ Secretary Raul Gonzales reminded all prosecutors across the country of the prescribed procedures on the seizure and custody of dangerous drugs.

The memorandum was in response to recommendations made by Dangerous Drugs Board (DDB) Undersecretary Paul Oaminal, who said Sunday that there is a circular clarifying that in cases subject for review by the regional state prosecutor, the arrested persons should remain in the custody of the authorities.

And while he did not contradict Cuenco in his statement, Oaminal said that for drug cases in the city, 98 percent of those filed before the Office of the City Prosecutor were sent to the court, or that only two percent got dismissed at its level.

Specifically, he said, only 11 of 516 drug complaints were dismissed for various reasons in 2008.

Because of the bungled Alabang operation, Cuenco is proposing the creation of a legal office composed of PDEA lawyers and state prosecutors for better coordination in the filing of drug cases.

On the controversy, he said the arresting officers and the prosecutors worked their separate ways.

The incident also prompted him to propose the holding of a national anti-drugs summit to be presided by President Gloria Macapagal-Arroyo.

This, as he urged the Supreme Court (SC) to designate special courts dedicated to hearing drug cases to fast track their resolution, as there are unresolved cases filed as early as 2000.

He also revealed that Congress is planning to review at least 10 big drug cases that were dismissed, as they suspected anomalies there.

If such is discovered, Cuenco said the concerned prosecutors may end up facing administrative complaints, particularly dereliction of duty. (RHM/Sun.Star Cebu)

1,000 jobs lost in rural banks’ closure

MANILA, Philippines â€" The closure of 27 rural banks over the past year resulted in job losses for 1,000 workers, who now need help in finding employment, a labor leader said Monday.

Many large foreign banks are expected to downsize their Philippine operations, Ernesto Herrera, secretary general of the Trade Union Congress of the Philippines, also said, citing two closures this month.

UK-based Standard Chartered Bank closed its offices in Quezon City and Caloocan City earlier this month, cutting to four the number of its Philippine branches, Herrera said. US-based financial services giant Wachovia Corp., which was recently acquired by Wells Fargo & Co., closed its representative office in Cebu City, he added.

Herrera also noted that last month the central bank closed down 12 rural banks with a total of 50 branches, and this month closed three more.

Herrera, a former chairman of the Senate labor, employment and human resources development committee, asked the banking industry’s groups â€" Bankers Association of the Philippines, Chamber of Thrift Banks, and Rural Bankers Association of the Philippines â€" to help find new jobs for the displaced personnel, mostly branch managers, cashiers, accountants, tellers, and credit investigators.

Closed down this month were the Rural Bank of Sta. Rita (Pampanga) Inc., Rural Bank of Bacolor (Pampanga) Inc., and the Rural Bank of Subangdaku (Cebu) Inc.

Padlocked last year were Rural Bank of Parañaque Inc.; Pilipino Rural Bank (Cebu) Inc.; Rural Bank of Bais (Negros Oriental) Inc.; Rural Bank of San Jose (Batangas) Inc.; Rural Bank of East Asia (Cebu) Inc.; First Interstate Rural Bank (Leyte) Inc.; Philippine Countryside Rural Bank (Cebu) Inc.; Dynamic Rural Bank (Batangas) Inc.; Nation Bank (Bacolod City) Inc.; Rural Bank of Carmen (Cebu) Inc.; Rural Bank of DARBCI (South Cotabato) Inc.; and San Pablo City Development Bank (Batangas) Inc.

Philippine Deposit Insurance Corp. has said it intends to start paying out by mid-February the deposit insurance claims of 135,000 depositors of the 12 rural banks closed down last year.

The central bank has given assurance that the Philippine banking system remains stable, with the closed banks accounting for a small fraction of its resources.

Gov’t urged to prosecute rogue bankers

MANILA, Philippines â€" An alliance of former high government officials has called on authorities to ensure that people behind fraudulent money-making schemes are prosecuted despite alleged connections to influential politicians.

Fraudulent banking practices are very costly to the government and damage public confidence in the banking sector, the Former Senior Government Officials (FSGO) said in a statement Monday.

Philippine Deposit Insurance Corp. (PDIC) has said it will would need about P14 billion to pay claims of depositors of the closed rural banks under the Legacy Group.

The FSGO, composed mostly of former economic officials, said the banks engaged in quasi-pyramiding schemes were enticing depositors by offering absurdly high interest rates.

After being closed by regulators, the banks simply left the burden of refunding deposits to PDIC, the group said.

The FSGO said the people behind the Legacy Group were not intending to do honest-to-goodness banking business but planned to subvert the system and defraud the government and depositors from the start.

“We enjoin the regulators to continue their vigilance in safeguarding the banking system and the depositing public, and in prosecuting wrongdoers to the full extent of the law, to act as deterrent for other, to hold those responsible accountable for their actions, and to keep people’s faith and trust in our banking system,” the FSGO said.

The FSGO welcomed the action of the central bank, Bangko Sentral ng Pilipinas (BSP), of closing down rural banks operating under the Legacy Group after they were found to engage in unsafe and unsound banking practices and failing to fully service withdrawals.

The group said that for a long time, “rogue” bankers had escaped penalties because they were protected by powerful and well-entrenched politicians.

“It is in this context and in furtherance of good governance that we commend and salute the Monetary Board and the BSP for the forceful exercise of their regulatory powers in the recent closures of those rogue banks involved in unsound and unsafe practices,” it said.

“For much too long, these criminal elements masquerading as bankers have abused the protection scheme afforded bank depositors by the PDIC. In the process, they have also defrauded depositors â€" large and small â€" in the same banks,” FSGO added.

PDIC has said it is examining the validity of claims of depositors of the closed rural banks and aims to start the payout by the second week of February.

The FSGO is composed of former PDIC presidents Ernest Leung, Norberto Nazareno, Ricardo Mirasol Tan, and Vitaliano Nanagas, former finance secretaries Cesar Purisima, Jesus Estanislao, and Ramon del Rosario Jr., former finance undersecretaries Milwida Guevarra and Edgardo del Fonso, former central bank governor Jose Cuisia; former Monetary Board members Cayetano Paderanga Jr. and Melito Salazar Jr., former national treasurer Leonor Briones, former Development Bank of the Philippines chairman Francisco del Rosario, former Land Bank of the Philippines president Deogracias Vistan, former budget secretaries Emilia Boncodin and Benjamin Diokno, and former trade and industry secretaries Juan Santos and Vicente Paterno.
