Science and Research / Mysterious Mummy Found in Peru
October 18, 2022, 04:42:44 PM
Mysterious mummy found in tomb in Peru with hands covering its face .
In 2021 , A mummy, fully bound in ropes and with its hands covering its face, has been discovered in an underground tomb in Peru.
Archaeologists from the National University of San Marcos found the mummy in good condition in Cajamarquilla, a significant site 15.5 miles inland from the coastal city and capital Lima, Peru.
The mummy is estimated to be between 800 and 1200 years old.
Although the mummy's striking pose – bound by ropes and in the foetal position – appears chilling at first sight, researchers believe it is a southern Peruvian funeral custom.
The tomb also contained ceramics, vegetable remains and stone tools.

RUSSIAN WARPLANE CRASHES NEAR APARTMENT BUILDING, KILLING 13

A Russian warplane crashed Monday into a residential area in a Russian city on the Sea of Azov after suffering engine failure, leaving at least 13 people dead, three of whom died when they jumped from upper floors of a nine-story apartment building to escape a massive blaze.

A Su-34 bomber came down in the port city of Yeysk after one of its engines caught fire during takeoff for a training mission, the Russian Defense Ministry said. It said both crew members bailed out safely, but the plane crashed into a residential area, causing a fire as tons of fuel exploded on impact.

After hours of combing through the charred debris of the building, authorities said 13 residents, including three children, were found dead. Another 19 were hospitalized with injuries.

Vice governor of the region, Anna Menkova, said three of the four victims died when they jumped from the upper floors of the building in a desperate attempt to escape the flames, according to the RIA-Novosti news agency.

The authorities reserved emergency rooms at local hospitals and scrambled medical aircraft. Over 500 residents were evacuated and provided with temporary accommodations. | via Associated Press

Republic of the Philippines
SUPREME COURT
Manila

EN BANC
A. M. No. 1008 January 22, 1980
PASAY LAW AND CONSCIENCE UNION, INC., complainant,
vs.
ATTY. DAVID D.C. PAZ, respondent.

FERNANDEZ, J.:

On June 5, 1971, the Pasay Law and Conscience Union, Inc. (PLACU) filed this disbarment case against David D.C. Paz, a member of the Philippine Bar. The complainant charged the respondent with malpractice, gross misconduct in office, gross immoral conduct and/or disloyalty to the Republic of the Philippines. 1

In a resolution dated June 22, 1971, this Court required the respondent to file an answer to the complaint against him. 2

After the respondent had filed his answer 3 and the complainant had submitted a reply, 4 this administrative case was referred to the Solicitor General for investigation, report and recommendation. 5

On January 23, 1973, the Solicitor General, having found sufficient grounds to proceed against the respondent after due investigation of the administrative case against him, submitted, among others sixteen copies, in a sealed envelope, of his complaint against the respondent, together with the transcript of stenographic notes taken during the investigation of the case, the folder of exhibits, the record of the investigation not the case and the original Supreme Court record. 6

The Solicitor General charged Atty. D.C. Paz with representing clients with conflicting interests and gross misconduct in office.

Regarding the charge of representing clients with conflicting interests, the complainant alleged that in 1969, in the course of the investigation then being conducted by the "Charlie Division" of the Presidential Agency on Reforms and Government Operations, otherwise known as the PARGO, on the complaint of Dr. Irineo P. Sia for anti-graft against the then ex-Mayor Pablo Cuneta of Pasay City, the respondent, David D.C. Paz, was then PARGO's Legal Officer and Chief Prosecutor, as well as the head of the aforesaid "Charlie Division"; that in the series of follow-ups made with PARGO by Dr. Irineo P. Sia himself and at times in company of Atty. Galileo P. Brion, President of the complainant, PLACU, of the aforesaid anti-graft complaint against the then ex-Mayor Pablo Cuneta, the respondent enlisted the help of Dr. Irineo P. Sia and Atty. Galilee P. Brion in the gathering of evidence which included PLACU's copies of the records of Civil Case No. 72967 of the Court of First Instance of Manila, entitled "Vicente D. Isip vs. The Pasay City Government, et al."; that in the course of the investigation by the PARGO of the aforesaid anti-graft complaint, but prior to September 10, 1969, the respondent even administered oaths to some persons who had given written statements before the PARGO investigators; that on September 10, 1969, the respondent was detailed by the then PARGO Secretary Ramon D. Bagatsing as Executive and Police Adviser to the Mayor of Makati, Rizal; that on the same day, the respondent designated as division-in-charge Atty. Rodolfo Navarro, who was then Team Leader of Charlie-two under PARGO's "Charlie Division" to act for and in respondent's behalf while not in office and while performing his duties and functions as such adviser in Makati, Rizal; that later on, after respondent had resigned from the PARGO sometime in January 1970 and on the basis of the investigation conducted by the PARGO on the aforementioned anti-graft complaint of Dr. Sia, the PARGO's successor, the Complaints and Investigation Office (CIO) filed an anti-graft charge and another charge for technical malversation both against Pablo Cuneta and others with the Pasay City Fiscal's Office, docketed therein as I.S. Nos. 71712 and 71712-A. respectively; that on November 13 and 23, 1970, during the preliminary investigation by the Pasay City Fiscal's Office of I.S. Nos. 71712 and 71712-A, the respondent entered his appearance, participated and orally argued therein as one of the counsels of Pablo Cuneta; that while in subsequent hearings thereof, the respondent no longer appeared as counsel for Cuneta, it was only after his appearance had been questioned by Atty. Brion; that inasmuch as at least up to September 10, 1969, the respondent was then PARGO's Legal Officer and Chief Prosecutor, as well as head of PARGO's "Charlie Division", he had access to, and necessarily acquired, directly or indirectly, knowledge of the facts of the said anti-graft case, its weak as well as its strong points, and such knowledge is confidential and should be guarded with great care, lest it jeopardizes PARGO, an agency and instrumentality of the Republic of the Philippines whose interest respondent swore to serve and protect without any mental reservation, in the ultimate prosecution of the said case; that there was, therefore, then a relationship of attorney and client between respondent and the government; that for having appeared twice, participated and orally argued as counsel for Pablo Cuneta during the preliminary investigation of the charges for anti-graft and technical malversation filed by the CIO, successor of PARGO, against said Pablo Cuneta and others before the Pasay City Fiscal's Office, the respondent violated Section 6 of the Canons of Legal Ethics and Section 20 (e) of Rule 138 of the Revised Rules of Court; and that the alleged withdrawal of the respondent as counsel for Pablo Cuneta, although in this connection there is nothing reflected in the records of the preliminary investigation, is of no moment for he had already violated the aforesaid Canons of Legal Ethics and that respondent's having appeared twice as Counsel for Cuneta in the preliminary investigation of the aforesaid charge constitutes clear attempts on respondent's part to damage CIO's cause against Cuneta.

On the charge of gross misconduct in office, the complaint stated that in the course of the investigation by the PARGO of Dr. Sia's anti-graft complaint against the then ex-Mayor Pablo Cuneta of Pasay City, but prior to September 10, 1969, the respondent borrowed and received from Atty. Brion the PLACU's copies of the record or expedients of Civil Case No. 72967 of the Court of First Instance of Manila entitled Vicente D. Isip vs. The Pasay City Government, et al.," in the presence of Dr. Sia and Atty. Alidio for the purpose of making xerox copies of such relevant documents therein to be utilized as evidence in the said anti-graft case; that notwithstanding repeated requests by Atty. Brion, the respondent never returned to the former the aforesaid PLACU's copies of the record or expedients, and when Atty. Brion manifested before Pasay City Fiscal Pineda during the preliminary investigation on November 13, 1970 of the anti-graft and technical malversation charges against Pablo Cuneta and others about the non-return to him of said expediente, respondent denied having borrowed and received the same, to the prejudice of PARGO's prosecution of the said charges, so that PARGO, through Atty. Brion, had to reconstitute the answer and its seventeen annexes which formed part of the said record or expedients, and it was only then that these documents were presented in the aforementioned preliminary investigation; and that the respondent's conduct in this regard tended to prevent and obstruct the administration of justice by concealing evidence, thus constituting gross misconduct in office.7

In his answer filed on February 24, 1973, respondent, David D.C. Paz, specifically denied the allegation contained in paragraphs 1 to 9 of the complaint on representing clients with conflicting interests, the same being contrary to the evidence of record submitted to the investigation conducted by Solicitor Eulogio Racquel Santos and averred that the respondent, Paz did not participation the investigation of the Cuneta anti-graft case except to swear the witnesses; that the Secretary of PARGO issued Mission Order No. 362 directing Atty. Rodolfo Navarro and Engineers Platon Chaves, Ventura Villarosa, Gabriel Abellada, Jr. and agents Lysias G. Manalo and Edilberto Arguelles, Jr. and Henry C. Consina to undertake a special mission and carry out instructions given by the Secretary in connection with the confidential investigation being undertaken by PARGO; that a g to the affidavit Of Lysias Manalo of the Philippine Constabulary, the Secretary of PARGO, by virtue of Mission Order No. 362, the continuance of the re-investigation of the complaint of Dr. Irineo P. Sia, against the ex-Mayor Pablo Cuneta and they for violation of the Anti-Graft and Corrupt Practices Act; that in fact, in 1969, the respondent Paz was on detail as police ad. viser of the Mayor of Makati, Rizal and in 1970, he from PARGO and transferred to Congress; that except for the self-serving declarations of Atty. Brion and Dr. Irineo Sia, no other evidence was presented to prove that the respondent Paz investigated the said anti-graft case in the PARGO; that it is true that respondent Paz appeared among a battery of lawyers for Mayor Cuneta but when his appearance was questioned by Atty. Brion, it was withdrawn; and that the anti-graft case against Mayor Cuneta was finally dismissed.

Anent the charge of gross misconduct in office, the respondent denied the allegation in paragraphs 1 to 6 of the second count, the same being contrary to the evidence of record and alleged that the charge is a fabrication; that Atty, Brion was also a special assistant in the PARGO; that when the respondent Paz resigned from the PARGO, he was granted a clearance dated January 2, 1970 clearing him from any record or money accountability; that Hector Lumba, Docket Officer of PARGO who was presented by Atty. Brion as a witness, admitted on cross-examination that the respondent Paz had been cleared of accountabilities by the Docket Section; and that at the time the clearance was granted, the respondent had no pending cases in his possession that Atty. Brion admit" that the alleged expediente supposedly borrowed by the respondent Paz was merely his lawyer's file as intervenor in Civil Case No. 72967; that his motion for intervention was, however, denied; that the lawyer's file was allegedly finally reconstituted and presented in the preliminary investigation of the anti-graft case against Pablo Cuneta; and Atty. Brion declared that the respondent Paz "receipted" for the same expediente but during the investigation conducted by Solicitor Racquel Santos, Atty. Brion could not produce any receipt; that neither could Atty. Brion present any proof that he addressed a written complaint or demand to PARGO for the return of the alleged expediente and Dr. Sia admitted that the evidence gathered were turned over to Atty. Cuaresma and Mangase, not to respondent Paz.

On the charge representing clients with conflicting interests, the evidence has duly established that the respondent, David D.C. Paz, as PARGO's Legal Officer and Legal Prosecutor and head of the "Charlie Division", took part in the investigation of the anti-graft case against ex-Mayor Cuneta by administering oaths to witnesses and gathering evidence. He acquired knowledge of the facts and circumstances surrounding the anti-graft case. The respondent obtained confidential information and learned of the evidence of the PARGO against ex-Mayor Cuneta. There was undoubtedly a relationship of attorney and client between the respondent David D.C. Paz and the PARGO.

It is also a fact that at the early stages of the preliminary investigation conducted by the City Fiscal of Pasay of the anti-graft case against ex-Mayor Pablo Cuneta, the respondent appeared as counsel for said Cuneta. This is the same anti-graft case investigated by the PARGO when the respondent was head of the "Charlie Division" thereof. That the respondent later withdrew his appearances as counsel of Cuneta is of no moment. He had already violated the Canons of Legal Ethics and Sec. 20(e) of Rule 138, Revised Rules of Court which provides:

Sec. 20. Duties of attorneys. — It is the duty of an attorney:

xxx xxx xxx

(e) To maintain inviolate the confidence, and at a every peril to himself, to preserve the secrets of his client, and to accept no compensation in connection with his client's business except from him or with his knowledge and approval;

xxx xxx xxx

The respondent has displayed a lack concern for his duties as a lawyer and an office of the court. In Nombrando vs. Hernandez,8 this court said:

The Solicitor General is of the opinion, and we find no reason to disagree with him, that even if respondent did not use against his client any information or evidence acquired by ham as counsel it cannot be denied that he did become privy to information regarding the ownership of the parcel of land which was later litigated in the forcible entry case, for it was the dispute over the land that triggered the mauling incident which gave rise to the criminal action for physical injuries. This Court's remarks in Hilado vs. David, 84 Phil. 571, are apropos:

Communications between attorney and client are, in a great number of litigations, a complicated affair, consisting of entangled relevant and irrelevant, secret and well known facts. In the complexity of what is said in the course of dealings between an attorney and client, inquiry of the nature suggested would lead to the revelation, in advance of the trial of other matters that might only further prejudice the complainant's cause

Whatever may be said as to whether or not respondent utilized against his former client information given to him in a professional capacity, the mere fact of their previous relationship should have precluded him from appearing as counsel for the other side in the forcible entry case. In the same cast of Hilado vs. David, supra, this Tribunal further said:

Hence the necessity of setting down the existence of the bare relationship of attorney and client as the yardstick for testing incompatibility of interest. This stern rule is designed not alone to prevent the dishonest practitioner from fraudulent conduct, but as wok to protect the honest lawyer from unfounded suspicion of unprofessional practice. ... It is founded on principles of public policy of good taste. As has been said in another case, the n 43 not necessarily one of the rights of the parties, but as to whether attorney has adhered to proper professional standard. With these thoughts in mind, it behooves attorneys, like 's Ceasar's wife, not only to keep inviolate the client's confidence, but also to avoid the appearance of treachery and double dealing. Only thus can litigants be encouraged to entrust their secrets to their attorneys which is of paramount importance in the administration of justice. 9

Under the circumstances, the respondent should be punished by suspension from the practice of law for two (2) months, 10 with a warning that a repetition of the same offense wig be dealt with more drastically.

There is no sufficient evidence that the respondent had borrowed the record of Civil Case No. 72967 of the Court of First Instance of Manila entitled "Vicente D. Isip vs. The Pasay City Government, et al. According to Atty. Galilee Brion, the respondent issued a receipt for the record. However, no such receipt could be presented at the investigation. Moreover, Dr. Irineo Sia admitted that the evidence in connection with the Cuneta anti-graft case was turned over to Attys. Mangase and Cuaresma, both of the PARGO. In view thereof, the respondent cannot be held guilty of the charge of serious misconduct.

WHEREFORE, the respondent is found guilty of representing clients with conflicting interests and he is hereby suspended from the practice of law for two (2) months, with a warning that a repetition of the same offense win be dealt with i more drastically. The respondent is exonerated of the charge of g TOSS misconduct in office.

G.R. No. L-38975 January 17, 1980

THE PEOPLE OF THE PHILIPPINES, petitioner,
vs.
HON. EDUARDO P. CAGUIOA Judge, Court of First Instance of Bulacan, Branch VII, and PAQUITO YUPO, respondents.

Assistant Provincial Fiscal Amando C. Vicente for petitioner.

Edelmiro A. Amante for private respondent.

FERNANDO, C.J.:

It is not easy to make out a case of improvident exercise of authority on the part of a lower court when the assailed actuation was clearly inspired by a desire to adhere to the literal and explicit mandate of the Constitution. That is the difficulty confronting the prosecution when it filed this certiorari proceeding resulting from respondent Judge Eduardo P. Caguioa sustaining the objection of the defense to questions asked a witness based on an alleged extrajudicial admission by an accused private respondent Paquito Yupo, during a police interrogation conducted on July 18, 1973, without his having been assisted by counsel. There was, in the opinion of respondent Judge, a clear failure to abide by the express prohibition in the fundamental law against the possibility of any confession obtained from a person under investigation without his having been informed of his right to keep silent and to have the benefit of counsel. 1 Clearly then, the leading case of Magtoto v. Manguera 2 does not apply. the interrogation having taken place six months after the effectivity Of the present Constitution. The prosecution would deny its applicability, contending that there was a waiver. Respondent Judge was of the view that this innovation in the Constitution, intended to buttress and fortify the right against self-incrimination, was not susceptible of waiver. When he remained firm in his stand, the petition was filed, a grave abuse of discretion being imputed to him.

According to the petition, the Provincial Fiscal of Bulacan filed on September 14, 1973, in the Court of First Instance of Bulacan, an information for murder against Paquito Yupo y Gonzales, which was docketed as Criminal Case No. 146-V-73, with the case, after the raffle, being assigned to Branch VIII, presided by respondent Judge. 3 Upon arraignment on October 5, 1973, the accused pleaded not guilty. 4 The trial of the case then proceeded, the prosecution having presented six witnesses, including the father of the deceased, Miguel Tribol, and his common-law wife, Lydia Begnotia who allegedly received the ante mortem statement of the victim, Rodolfo Tribol. 5 Then, at the hearing on June 3, 1974, the prosecution presented Corporal Conrado Roca of the Meycauayan Police Department, before whom a written statement of the accused Paquito Yupo and his alleged waiver of his right to remain silent and to be assisted by a counsel of his own choice was taken. 6 After this witness had Identified the statement of the accused and the waiver, he was questioned on the incriminating answers in such statement to the police, but there was an objection on the part of the defense counsel based on the ground of such statement being inadmissible in evidence, as the statement was taken by the police without any counsel assisting the accused in the investigation. 7 Respondent Judge sustained the objection of the defense on the view that such judicial confession of the accused is inadmissible in evidence for being unconstitutional, it appearing that the accused was not assisted by a counsel when it was given.8 He likewise stated that such right could not be waived. 9 Upon his refuse to reconsider such ruling, this petition was filed.

Certiorari does not lie. The petition must be dismissed. It was not shown that the alleged waiver was given freely and voluntarily. The questioning was rather perfunctory. An even more telling circumstance against such alleged waiver being given credence was that private respondent, a native of Samar, then nineteen years old, was interrogated extensively in Tagalog, no showing having been made that his acquaintance with the language was such that he could fully understand the import of what was asked him. On the specific question of whether or not the right to counsel during custodial interrogation interrogation may be waived, the Court rules that there is no bar to such a waiver if made intelligently and voluntarily, with full understanding of its consequences.

1. As far back as Abriol v. Homeres, 10 a 1949 decision, decided under the 1935 Constitution, which did not contain a provision similar to Section 20 which adopted the Miranda doctrine, this Court, through Justice Ozaeta, relying on the leading American case of Johnson v. Zerbst, 11 made clear that while there could be a waiver of the rights of an accused, it must be intelligently waived, otherwise a court's jurisdiction starting at the banning of the trial may be lost in the course of the proceeding. 12 The landmark opinion of Miranda v. Arizona, 13 decided in 1966, as noted above, the source of this constitutional provision, emphasized that statements made during the period of custodial interrogation to be admissible require a clear intelligent waiver of constitutional rights, the suspect being warned prior to questioning that he has a right to remain silent, that any utterance may be used against him and that he has the right to the presence of a counsel, either retained or appointed. In the language of Chief Justice Warren: "Our holding win be spelled out with some specificity in the pages which follow, but briefly stated, it is this: the prosecution may not use statements, whether exculpatory or inculpatory, stemming from custodial interrogation of the defendant unless it demonstrates the use of procedural safeguards effective to secure the privilege against self-incrimination. By custodial interrogation, we mean questioning initiated by law enforcement officers after a person has been taken into custody or otherwise deprived of his freedom of action in any significant way. As for the procedural safeguards to be employed, unless other fully effective means are devised to inform accused persons of their right of silence and to assure a continuous opportunity to exercise it, the following measures are required. Prior to any questioning, the person must be warned that he has a right to remain silent, that any statement he does not make may be used as evidence against him, and that he has a right to the presence of an attorney, either retained or appointed. The defendant may waive effectuation of those rights, provided the waiver is made voluntarily, knowingly and intelligently. If, however, he indicates in any manner and at any stage of the process that he wishes to consult with an attorney before speaking, there can be no questioning. Likewise, if the individual is alone and indicates in any manner that he does not wish to be interrogated, the police may not question him. The mere fact that he may have answered some questions or volunteered some statements on his own does not deprive him of the right to refrain from answering any further inquiries until he has consulted with an attorney and thereafter consents to be questioned." 14

2. Tested by such a clear and unequivocal standard, the alleged waiver falls far short. It is clearly inadmissible. There was a perfunctory opening statement asked by a certain Corporal Conrado B. Roca of the Police Force of Meycauayan, worded thus: "Ipinaaalam ko sa iyo na ikaw ay sinisiyasat tungkol sa isang paglabag sa batas na iyong ginawa, bago ko ipagpatuloy ang pagtatanong sa iyo, ikaw ay may karapatan na huwag magsalita kung ayaw mo at may karapatan ka rin na magkaroon ng abogado na iyong gusto at dapat mo ring mabatid na anuman ang sabihin mo dito ay maaaring gamitin ng ayon o laban sa iyo, magsasalaysay ka pa rin ba?" 15 Then came the monosyllabic answer Opo. That was ala Even the very annex submitted to the petition merely stated that there were signatures of private respondent Yupo, the aforesaid Roca, and a certain Roberto Sales. The day when it was subscribed and sworn to, allegedly before Municipal Judge Mariano Mendieta was not even specified. Again, there was a statement that it was a certified true copy by a certain Teresita M. Tecson, whose connection with the case or with the court was not even shown. There was no signature. There were only illegible letters, perhaps indicating that they were the initials. The doubt that must have occurred to the police officials of Meycauayan is evident from their submitting a one-page statement, presumably signed by the same people and certified by the same Tecson, reading in fun as follows: "[Sa sinumang Kinauukulan lpinabasa, ipinaalam at naintindihan ni Paquito Yupo y Gonzales], 19 na taong gulang, binata tubo sa San Policarpio, Eastern Samar ang nasa ibaba nito '[Ikaw ay sinisiyasat ngayon dahilan sa paglabag sa batas. Karapatan mo ang huwag magsalita. Anumang iyong sasabihin ay maaring gamiting katibayan laban sa iyo. At ikaw ay may karapatan sa tulong at sa pagharap ng abogado na iyong napipisil sa habila ng kabatiran ni [Paquito Yupo ng mga nilalaman ng nasa itaas, siya ay nagbigay pa rin ng salaysay.,"16 Could it be their way of trying to impress on a court the fact that there was an in waiver? If so, it did not cure the fatal infirmity. Rather the contrary.

3. People v. Bacong 17 stands as a warning against imputing to an accused an understanding of the proceeding when the language used is one with which he is not familiar. The point at issue was whether there was an improvident plea of guilt. It was stressed in the brief filed on behalf of the accused that he " 'is an ignorant and illiterate person, a neophyte in the national penitentiary, and one fully conversant [only] with his native Visayan. This is apparent from his statement thus: "26. An observation and closer look [at] his signature indeed reveals that the accused is an illiterate and unschooled person. The strokes of his signature are irregular, halting, and show a difficult and laborious effort to write the letters of his name. ... In his signature on file with this Honorable Court, the same observations can be made. ... Admittedly, the accused is a Visayan and still a neophyte in the national penitentiary who does not understand well Tagalog. ... We cannot expect the accused to have fully understood the legal signification of these qualifying circumstances, which allegations had been the subject of various interpretations of our courts. ...' " 18 As a matter of fact in that case, Solicitor General Estelito P. Mendoza, in lieu of appellant's brief filed a manifestation admitting that there was an improvident plea of guilt and that judgment should be set aside. In that case, there was an effort to ascertain whether the accused could read and write in Tagalog' In this case, the private respondent, a Visayan, was asked a kilometric question in Tagalog, and the interrogator was satisfied with the monosyllabic Opo. Also, the failure to submit to this Court the alleged signature of private respondent may be indicative of the fear on the part of counsel for petitioner that the absence of education of the nineteen-year old private respondent would be apparent. At any rate, it cannot be denied that to predicate a waiver under the circumstances disclosed would be to nullify the plain command of the constitutional provision requiring that a confession to be admissible must be given only if the accused were informed of his right to remain silent and to counsel; otherwise, it is "inadmissible in character." The lower court, therefore, acted in accordance with the plain dictate of the Constitution. To quote from that eminent civil libertarian Justice Douglas: "Formulas of respect for constitutional safeguards cannot prevail over the facts of life which contradict them. They may not become a cloak for inquisitorial practices and make an empty form of [constitutional rights]." 19

WHEREFORE, the petition for certiorari is dismissed. The trial of the case is ordered to be resumed forthwith No costs.

Separate Opinions

BARREDO, J., concurs in a separate opinion.

I would like to underline, however, the important point that the Court rejects unanimously the view on which respondent judge based his ruling under review, that the right to silence and to counsel during custodial investigation is not subject to waiver. Both the main opinion of our eminent Chief Justice as well as the dissenting opinion of our other distinguished colleagues Justices Aquino and Antonio underscore the point that said rights are indeed subject to waiver, the only requirement in that regard being that such waiver must be proven to have been made voluntarily and intelligently.

But it is as to the legal significance or import of the "waiver made by the accused Paquito Yupo, herein private respondent, that the dissenters disagree with the main opinion. The dissenters feel that there is enough showing in the record that said accused had freely and conscientiously waived his right to silence and to counsel before he was interrogated by Corporal Roca, the investigator. On my part, I agree with the Chief Justice that merely informing a person under custody of his constitutional rights under the circumstances hereinunder to be stated and thereafter taking down his statement does not sufficiently safeguard those rights.

Thus, in the particular case at bar, the prosecution would deduce free and intelligent waiver from no more than the following:

(a) The perfunctory opening question and answer, which has been the usual form ordinarily followed by practically all police investigators reading thus:

Opo.

(b) A subsequent statement apparently taken by the Meycauayan police evidently purported o cure the apparent inadequacy of the waiver evidence by the question and answer just quoted was introduced in evidence. Said statement reads as follows:

In the light of these evidence, it is important to keep in mind that the pertinent constitutional provision ordains unequivocally that:

Sec. 20. No person shall be compelled to be a witness against himself. Any person under investigation for the commission of an offense shall have the right to remain silent and to counsel and to be informed of such right. No force, violence, threat, intimidation, or any other means which vitiates the free will shall be used against him. Any confession obtained in violation of this section shall be inadmissible in evidence.

It is thus emphasized that "any person under investigation for the commission of an offense" does not only have the right to remain silent and to have the assistance of counsel, he must in addition be informed of such rights. And it is my considered view that it is not enough that he be told he has those rights. To give meaning and substance to the manifest spirit and intent of the constitutional mandate, he must perforce be asked pointedly and unequivocally whether or not he wants to exercise them. Not every ordinary person, particularly the unschooled or one who is addressed in a language or dialect he does not sufficiently command, would readily comprehend to the extent intended by the fundamental law of the land the exact import of the bare information that he owns a right. To dispel any doubt, which is what I am certain the Constitution contemplates, and to best serve the ends of justice as it is understood by the common man it is imperative that the investigator should go one step further, as I have just indicated. What would be lost doing it anyway? I may have a right and may be reminded thereof, but if in my inadequate circumstances of education and means of intelligent communication, and because of the obvious anxiety and apprehension usually felt by one under questioning about his possible participation in a criminal offense, I am not made clearly aware when and how I can avail of such right, of what use would such right and reminder be to me? In my humble opinion, it behooves every police investigator who conducts a custodial investigation to possess definite knowledge of the constitutional rights of all persons being subjected by him to any inquiry relative to the commission of any offense, and what is more, he must see to it that the person being interrogated by him is not only informed of such rights but that he is specifically asked in the language the latter adequately understands whether or not he desires to exercise them, and only when such person definitely, categorically and freely answers affirmatively may the investigator proceed to conduct his inquiry and take the statement of the person detained, with the implicit understanding yet that even such initial waiver is not definitely final, for the person under investigation may still invoke at his option the same rights at any further stage of the interrogation.

Justice Aquino makes reference in his dissent to the prevailing practice whereby the ruling on the admissibility of a confession or of any document, for that matter, is done at the closing of the evidence of the party offering the same. In point of fact, Justice Aquino is correct. But in view of the express adoption by our Constitution of the Miranda ruling thereby raising it to an unalterable constitutional status as distinguished from a mere jurisprudential dictamen I would like to take this opportunity to suggest that trial fiscals and judges adopt special procedures that can best guarantee the enforcement of the constitutional rights to silence and to counsel of persons under custodial investigation. I have practiced the law profession long enough — more than forty-three years, to be exact — to know that the present practice pointed out by Justice Aquino would not, I regret to say, carry out faithfully the full significance of her rights under discussion.

Let us not overlook that the last sentence of Section 20 of the Bill of Rights above-quoted commands in no uncertain terms that "any confession obtained in violation of this section shall be inadmissible in evidence." This provision characterizes in bold relief the sanctity of the rights enshrined in the provision. To my mind, as a matter of principle, this constitutional mandate has at least the effect of equating the violation thus mentioned with the infringement of the right of an accused prohibiting the use of illegally seized evidence against him. And in this connection, it will be recalled that the Moncado ruling (1) which replaced Uy Kheytin vs. Villareal (2) was itself reversed in Stonehill vs. Diokno (3) Thus, under the prevailing rule now, upon proper indication or suggestion by the accused that the evidence intended to be offered against him at the trial had been illegally seized from him, he is entitled to a preliminary hearing as to the legally of such seizure and the evidence may be presented only if the court is satisfied that it had been legally taken or seized. In fact, the proceeding in this regard may be held before the trial proper. Such being the case with evidence allegedly illegally seized, why may not a confession, which is evidence of the highest degree be not given the same if not more than deserved importance and properly accorded the same procedure?

In other words, I feel very strongly that with the new constitutional developments in criminal procedure I have pointed out, there must be corresponding innovations in our trial practices to give bone, flesh and sinew to the additional rights of persons under custodial investigation or accused mandated by the new provisions of the fundamental law of the land. Accordingly, it is my view that before any confession is ever marked or Identified, upon timely objection of the accused, the court must first hold a separate proceeding solely for the purpose of satisfying itself that the same was taken with due regard to the constitutional rights of the accused discussed earlier in this opinion. The advantage of this procedure is that the court may not even see the incriminatory parts, if any, of the purported confession until after it is satisfied of the legality of its taking, hence any possible danger of the mind of the court being "poisoned" factually by illegal evidence, human as the judge is, is thereby eliminated, should the confession be denied stated does not mean that failure to timely object at the stage entry into the records. But, of course, what has just been just indicated already precludes the accused him questioning the legality of the confession at any other later stage of the proceeding.

I realize that practical considerations, — usually in the mind of over anxious and expeditiousness inclined, albeit possibly well intentioned, law enforcers — may be invoked to argue against the somewhat cumbersome procedure contemplated in this opinion. If practical considerations may indeed be sometimes of great or indispensable assistance in the prosecution of offenses specially because of the seriously deteriorating crime situation in the country, I can just say that the Constitution may not be assumed to have overlooked the imperatives of efficient crime prosecution and law enforcement when, in the interest of the more sacred rights of the people, for whom it speaks, it surrounded persons under custodial investigation or accused of criminal offenses with safeguards insuring, as much as it is humanly possible to do so, that no innocent person is placed in jeopardy of losing his life or liberty, without having had due opportunity to invoke them, and that even a guilty person is not railroaded to his deserved punishment, much less improvidently imposed a higher penalty than the law provides. Even the paramount need to defend the safety and security of the people in general and the community at large cannot justify less solicitousness founded on the inherent minimum standards for respect of basic human rights.

Aquino, J., dissent. "A defendant may waive effectuation of his rights to remain silent and to be assisted by counsel at a custodial police interrogation, provided the waiver is made voluntarily, knowingly, and intelligently" (Syllabus, Miranda vs. Arizona, 16 L. Ed. 2d, 694,697).

In the Miranda case, it was spelled out that the accused, who is in police custody, "must be warned prior to any questioning that he has the right to remain silent, that anything he says can be used against him in a court of law, that he has the right to the presence of an attorney, and that if he cannot afford an attorney one will be appointed for him prior to any questioning if he so desires. (Opportunity to exercise these rights must be afforded to him throughout the interrogation". The Court added:

After such warning have been given, and such opportunity afforded him, the individual may y and intelligently weave these rights and agree to answer questions or make a statement.

But unless and until such warnings and waiver are demonstrated by the prosecution at the trial no evidence obtained as a result of interrogation can be used against him (lbid page 726).

In the instant case, the accused, Paquito Yupo, while in police custody, executed the following waiver of his constitutional rights to remain silent, not to incriminate himself, and to be assisted by counsel:

On that same date, July 18, 1973, when Paquito Yupo executed the waiver of his constitutional rights, his statement was taken by Corporal Conrado B. Roca of the Meycauayan, Bulacan, police. That statement or extrajudicial confession also contains a warning to Yupo as to his constitutional rights to remain silent, not to incriminate himself and to be assisted by counsel. The warning and waiver read as follows:

S: Opo.

On the basis of Yupo's confession, the provincial fiscal filed against him an information for murder in the Court of First Instance of Bulacan.

At the trial of that case, the prosecutor presented as witnesses (1) Miguel Tribol, the victim's father, (2) Lydia Begnotia who heard the antemortem statement of the victim pointing to Yupo as his assailant, (3) the medicolegal officer who conducted the autopsy, (4) two policemen and (5) Gracia Santos Wage.

Then, at the hearing on June 3, 1974, the prosecution placed on the witness stand Corporal Roca to Identify the extra judical confession of the accused, marked as Exhibit C, and his written waiver of his constitutional rights, marked as Exhibit F.

When police investigator Roca was questioned as to the incriminating answers given by Yupo in his extrajudicial confession, the defense counsel inyterposed an objection on the ground that the confession is inadmissible in evidence because it was taken by Corporal Roca without any counsel assisting the accused.

Judge Eduardo P.. Caguioa the objection and ruled right away that Yupo's Judicial confession was inadmissible in evidence. Judge Caguioa said-

COURT: In view of the fact dot the testimony of the witness is to the effect that. in the taking of the statement of the accused in this case there was t to lawyer on the ground that he was having his right in a writing as per Exhibit F of the prosecution, and con. considering the pro of the Constitution that an accused in making statement during investigation should be assisted by counsel at any stage of p and considering the history of this provision of the Constitution, the Court believes that this right to counsel cannot be waived, otherwise he wig again lapse into the same situation which was sought to be cured by the Constitution, namely, the making forcibly of the statement of the accused based on supposed voluntary waiver made by the accused.

The Court believes that when the accused is under custody, he cannot be said to be in the full possession of his constitutional right and considering that this provisions of the Constitution was precisely enacted to counteract forced confession obtained by police department and to prevent therefore accused from being maltreated to ex. tort from them involuntary confession the Court is of the opinion that these constitutional rights are not subject to waiver and any waiver of the accused will be null and void

In view thereof, the Court believes that this Exhibit C of the prosecution (the confession) is inadmissible in evidence for being unconstitutional and therefore the Court sustains all objections of counsel for the accused objecting to the admission of any question with regards to the exhibits.

Respondent Judge made a premature ruling on the admissibility of the confession. It was merely being Identified. It was not yet being formally offered in evidence. The time to obeject to the admissibility of the confession, Exhibit C, is when it is formally offered in evidence and that is when the prosecution is at the stage of closing its case. That is the well-known practice.

Respondent Judge also erroneously assumed that the right to counsel cannot be waived. As shown in the ruling in the Miranda case, already quoted, the right to counsel may be waived during custodial interrogation.

Corporal Roca was placed on the witness stand to testify on the voluntariness of the confession and to show that a sufficient notice was given to the accused as to his constitutional rights and that he waived those rights voluntarily, knowingly and intelligently. Roca would declare that the requisites of Section 20, Article VI of the Constitution were complied with or that the confession is admissible in evidence. His testimony should be allowed. To reject his testimony outright would prevent the prosecution from showing that the confession is admissible.

The accused may rebut Roca's testimony. On the basis of Roca's testimony and the testimony of the accused, if he repudiates his confession, the trial court may rule, when the confession is offered in evidence, that it is inadmissible because there was no compliance with the constitutional provisions.

I beleive that Roca in taking the confession and waiver of Yupo endeavored to adhere strictly to the guidelines laid down in the Miranda case.

I vote for the reversal of respondent Judge's ruling and to allow the fiscal to propound questions to Corporal Roca on Yupo's confession and waiver of his constitutional rights.

But unless and until such warnings and waiver are demonstrated by the prosecution at the trial no evidence obtained as a result of interrogation can be used against him " (lbid page 726).

In the instant case, the accused, Paquito Yupo, while in police custody, executed the following waiver of his constitutional rights to remain silent, not to incriminate himself, and to be assisted by counsel-

Judge Caguioa said:

Any confession obtained in violation of this section shall be inadmissible in evidence."

ROTC, military, and police cadets break barriers in marking the 5th liberation anniversary of Marawi siege

Reserve Officers Training Corps (ROTC), Philippine Military Academy, Philippine National Police Academy, Officer Candidate School of the Philippine Army, Philippine Air Force, and Philippine Navy gathered together to take the youth's role during the 5th Marawi Liberation Anniversary on October 15, 2022 at the Headquarters Philippine Army Grandstand, Fort Bonifacio, Metro Manila.

The officer cadets joined the exhibition tour, showcasing the different Army units' tactics and strategies which contributed in liberating Marawi city from the ISIS-inspired Maute terrorist group. The cadets participated from the demo lectures and combat displays to relive the experiences and learn the lessons of the five-month long armed conflict in Marawi, Lanao del Sur.

The Commanding General, Philippine Army Lt. Gen. Romeo S. Brawner, Jr., highlighted the utmost importance of remembering the heroism of the soldiers, law enforcers, and civilians who paid the ultimate sacrifice in liberating Marawi City. Lt. Gen. Brawner also encouraged the cadets to passionately serve the people and the country.

At 25, Andrew was soaring up the culinary career ladder as a pastry chef at a Michelin-starred restaurant in Scotland. Every delicious dessert and finely sculpted pastry in the kitchen was his creation. He was in a role that he had worked towards – and wanted – for years.

Andrew had reached these heights after just six years in the hospitality industry; he'd started at 19 as a kitchen porter in a local hotel in his hometown in west Scotland, and was quickly promoted to junior chef. By 21, he was a commis chef at an award-winning hotel in the Lake District, England, avidly studying patisserie and confectionary in his spare time. He was prepared to commit his life to perfecting his skills, saying: "That was all I cared about."

Instead, at the height of his career, working in his dream job in the revered Scottish eatery, he quit. At 26, he was a student, this time on a four-year software-development degree. He'd walked away, not just from the job he'd worked so hard for, but from the whole hospitality industry.

For Andrew, the tipping point came when, having finally got the glossy position he'd been aiming for, he realised none of the exhausting work required was worth it. "From 19 to 25, that whole period of my life, I just sort of sacrificed," he says. "Everyone else was out having a great time and I was basically a slave in the kitchen."

Throughout his career, he realised, he had felt overworked, under-appreciated and underpaid. "I was doing between 65 and 70 hours a week and getting paid [a salary of] £20,000 ($22,290) a year," he says. "I was running the [pastry] section. I was creating the majority of the desserts... for £5.95 an hour. For that little money, you just think, what am I doing with my life? Like, am I crazy?"

For the most part, workers have always hoped for roles that coincide with their interests and passions; swapping the office grind for that longed-for sourdough bakery, or fun role at a videogame company sounds like a no-brainer. Yet this 'do what you love' narrative comes with drawbacks. Many people find that their dream jobs require more work, under worse conditions. Others discover that the industries they idolise trade on workers' passions to keep pay low. In the face of these pressures, some workers find themselves asking whether the dream job is really worth it after all.

Bible Study / God Abhors Worship of Images

GRAVEN IMAGES

I am YHWH : that is my name: and my glory will I not give to another, neither my praise to graven images. (Isaiah 42:8)

Thou shalt have no other gods before me.(Exodus 20:3)

Thou shalt not make unto thee any graven image, or any likeness of any thing that is in heaven above, or that is in the earth beneath, or that is in the water under the earth: (Exodus 20:4)

Thou shalt not bow down thyself to them, nor serve them: for I the LORD thy God am a jealous God, visiting the iniquity of the fathers upon the children unto the third and fourth generation of them that hate me;
(Exodus 20:5)

Ye shall make you no idols nor graven image, neither rear you up a standing image, neither shall ye set up any image of stone in your land, to bow down unto it: for I am the LORD your God. (Leviticus 26:1)

And ye have seen their abominations, and their idols, wood and stone, silver and gold, which were among them
(Deuteronomy 29:17)

Their idols are silver and gold, the work of men's hands. (Psalm 115:4)

They have mouths, but they speak not: eyes have they, but they see not:
(Psalms 115:5)

They have ears, but they hear not: noses have they, but they smell not:(Psalms 115:6)

They have hands, but they handle not: feet have they, but they walk not: neither speak they through their throat. (Psalms 115:7)

They that make them are like unto them; so is every one that trusteth in them.
(Psalms115:8)

The graven images of their gods shall ye burn with fire: thou shalt not desire the silver or gold that is on them, nor take it unto thee, lest thou be snared therein: for it is an abomination to the LORD thy God.
(Deuteronomy 7:25)

Neither shalt thou bring an abomination into thine house, lest thou be a cursed thing like it: but thou shalt utterly detest it, and thou shalt utterly abhor it; for it is a cursed thing.
(Deuteronomy 7:26)

Little children, keep yourselves from idols. Amen. (1John 5:2)

The Ramon Aboitiz Foundation, Inc. (RAFI) re-opens the Casa Gorordo Museum to the public today proudly reconnecting to our roots, reaching back into Cebu's rich and storied heritage. The house-museum, so beloved, by Cebuanos and visitors alike, re-opens with an ochre and green exterior, departing from its dark brown signature patina of the past four decades.

The repainted façade is deemed more faithful to the ethos of the late 19th and early 20th centuries, the period during which Casa Gorordo served as the dwelling of the Reynes and Gorordo families, the latter having had four generations living in it until the 1980s.

Declared by the National Historical Institute in 1991 as a National Historical Landmark, Casa Gorordo cradles within its walls treasures of Cebuano identity, from farm and household implements to riveting vignettes about the society that populated Cebu City's Parian district during the Spanish and American colonial periods. It offers an authentic experience of the domestic lifestyle of the affluent, landed gentry of that time.  The ground level displays are now updated to better illustrate how it functioned as the urban receiving hub for produce coming from countryside plantations.

The first floor of the house also vividly
communicates the grandeur of Cebuano faith during the colonial era. Jingjing Mariño-Farrarons Casa Gorordo Museum

History / Joanna Born in Toledo, Kingdom of Castile
October 15, 2022, 07:43:42 AM
Joanna was born in the city of Toledo, Kingdom of Castile. She was the third child and second daughter of Isabella I of Castile and Ferdinand II of Aragon, of the House of Trastámara. She was described as having a fair complexion, brown eyes and strawberry-blonde/auburn hair.
She was highly educated in anticipation of a good royal match. As a younger princess she was not expected to be heiress to the throne of either Castile or Aragon, but she could still bring and give political gain and influence through marriage.

She was educated in canon and civil law, genealogy and heraldry, grammar, history, languages, such as  Castilian, Leonese, Galician-Portuguese and Catalan, and became fluent in French and Latin, mathematics, philosophy, reading, spelling and writing.

She was also taught the skills of royal court etiquette, dancing, drawing, good manners, music, and the needle arts of embroidery, needlepoint, and sewing. She was especially skilled at dancing and music, having played the clavichord, the guitar, and the monochord. She was equally skilled at hunting, horse riding and hawking.
Unlike her fervently devout mother, Joanna began to show signs of religious skepticism, and by 1495 relatively no devotion to the Catholic faith that greatly alarmed her mother. This deviance from faith would not be tolerated by her mother, who declared she would rather see her dominions depopulated than fall into heresy. Joanna was punished for this lack of adherence with "La cuerda" (the rope). She was suspended by a rope with heavy weights attached to her feet; she would suffer this punishment for hours. But ever stubborn she refused confession and would not back down.

At sixteen, she was betrothed to the eighteen year old Philip of Flanders. In the autumn of 1496, Joanna left Spain for her husband's country, other than an encounter with her sister Katherine ten years later, she never saw any of her siblings again. After the deaths of her brother and older sister she was made the heir to the Spanish Kingdoms. After her mother's death Joanna inherited her throne, her father Ferdinand lost his status and was relegated to regent. This change did not sit well with him and despite his change in circumstances he had new coins minted in the names of Ferdinand and Joanna, King and Queen of Castile, León and Aragon.
By 1505 Ferdinand was actively working against his daughter trying to prove that her 'illness' prevented her for sitting on the throne and he would do the honours until her heir came of age. Her husband was also plotting behind the scenes to further his own ascension to her throne as King jure uxoris.

Joanna was desperately in love with her wayward husband and insanely jealous of his many dalliances.
Together they had six children, Eleanor, Charles, Isabella, Ferdinand, Mary and Catherine.
When they decided to return to Spain as a show of strength against her father Joanna forbade any women on the same ship with her husband, further giving both the men in her life more fodder for their schemes against her. Philip wanted to land in Andalusia and rally an army against Ferdinand but Joanna refused to act against her father. With the support of Spain behind her husband, he met her father met to sign a treaty, with Ferdinand promising to retire to Aragon. A second secret treaty was signed, depriving Joanna of her rights as queen and her freedom. A few weeks later Ferdinand renegaded on the seconded treaty and vowed to step in if his daughter's rights were infringed upon in any way.

Philip died in 1506 after a five-day illness in the city of Burgos in Castile. The official cause of death was typhoid fever. But many suspected he had been poisoned by his father-in-law.
Joanna attempted to reign in her own right, but with little support and success. Her father sat back and allowed the chaos to ensue and then swooped in and returned to power. Unable to do anything other than voice her opposition, Joanna effectively ceded her throne to her father. After his death she would be forced to co-reign with her son, who would eventually have her 'put away' and reign alone in both of their names. Locked away, she became very paranoid convinced her carers wanted to poison her, she refused to eat or sleep bathe or change her clothes. Her son Charles wrote to her caretakers ordering them to prevent her from talking or interacting with anyone. Her physical and mental state began to deteriorate further, locked away in a few rooms with little interaction.
She died on Good Friday, 12 April 1555, at the age of 75 and was entombed in the Royal Chapel of Granada, alongside her parents and, her husband.

Poems and Poets / A River by A K Ramanujan
October 15, 2022, 07:25:43 AM
In Madurai,
city of temples and poets,
who sang of cities and temples,
every summer
a river dries to a trickle
in the sand,
baring the sand ribs,
straw and women's hair
clogging the watergates
at the rusty bars
under the bridges with patches
of repair all over them
the wet stones glistening like sleepy
crocodiles, the dry ones
shaven water-buffaloes lounging in the sun
The poets only sang of the floods.

He was there for a day
when they had the floods.
People everywhere talked
of the inches rising,
of the precise number of cobbled steps
run over by the water, rising
on the bathing places,
and the way it carried off three village houses,
one pregnant woman
and a couple of cows
named Gopi and Brinda as usual.

The new poets still quoted
the old poets, but no one spoke
in verse
of the pregnant woman
drowned, with perhaps twins in her,
kicking at blank walls
even before birth.

He said:
the river has water enough
to be poetic
about only once a year
and then
it carries away
in the first half-hour
three village houses,
a couple of cows
named Gopi and Brinda
and one pregnant woman
expecting identical twins
with no moles on their bodies,
with different coloured diapers
to tell them apart.

World Daily News / Evacuation in Ukraine
October 14, 2022, 08:11:17 PM
The Moscow-installed leader of Kherson, one of four regions illegally annexed by Russian President Vladimir Putin last month, asked the Kremlin to organize an evacuation from four cities, citing incessant shelling by Ukrainian forces.

Vladimir Saldo, the head of the Moscow-appointed regional administration, said a decision was made to evacuate Kherson residents to the Russian regions of Rostov, Krasnodar and Stavropol, as well as to the Crimean Peninsula, which Moscow annexed from Ukraine in 2014.

"We, residents of the Kherson region, of course know that Russia doesn't abandon their own, and Russia always offers a hand," Saldo said Thursday.

Russia has characterized the movement of Ukrainians to Russia or Russian-controlled territory as voluntary, but in many cases those are the only evacuation routes residents of the occupied areas can or are allowed to take.

Reports have surfaced that some Ukrainians were forcibly deported to "filtration camps" with harsh conditions. In addition, an Associated Press investigation found that Russian officials deported thousands of Ukrainian children - some orphaned, others living with foster families or in institutions - to be raised as Russian.

As Ukrainian forces sustain counteroffensives in the country's east and south to recapture occupied areas, Russian troops have retreated from some areas they overran soon after invading the country in late February.

The Ukrainian gains and an Oct. 8 truck bomb explosion on a prized bridge linking Russia to Crimea have led to domestic criticism of the Kremlin's handling of the war and increased pressure on Putin to do more to turn the tide in Russia's favor.

The evacuation announcement came as Ukrainian forces pushed deeper into the Kherson region, albeit at a slower pace than a few weeks ago. Ukrainian forces reported retaking 75 settlements in the region in the last month, Ukraine's Ministry for Reintegration of Temporarily Occupied Territories said late Thursday night. | via Associated Press

Team Army on track to retain AFP-PNP-PCG Olympics 2022 overall championship

News Philippines - Team Army bolstered its bid to retain the Armed Forces of the Philippines-Philippine National Police-Philippine Coast Guard (AFP-PNP-PCG) Olympics overall championship trophy as it tallied wins in the goodwill games' second week, the Special Service Center announced on October 13, 2022.

Team Army is currently tied with Team Navy as the top team in Officers Basketball with identical 4-1 win-loss tallies. In a related development, Team Army broke a two-way tie in the Enlisted Personnel Basketball with Team Navy, scoring a 5-1 win-loss record. Moreover, Army ballers are leading the Women's Basketball competition with a 4-1 win-loss record.

Army soldier-athletes are currently leading tallies in sepak takraw, table tennis, volleyball men's and women's, chess, golf, and cycling events.

The Covid-19 pandemic prompted the cancellation of the annual AFP-PNP-PCG Olympics for two consecutive years. The goodwill games aim to foster sportsmanship and camaraderie between soldiers and law enforcers.

Bohol Latest News / Lambay in Ubay

Press Release - Cebu Governor Gwen Garcia and Department of National Defense (DND) Officer-in-Charge Secretary Jose Faustino Jr. led the turnover of the 16 parcels of land owned previously by the Cebu Province during a ceremony on Monday, October 3, 2022, at the Capitol Social Hall.

Faustino, Garcia and AFP Chief of Staff Lt. Gen. Bartolome Vicente Bacarro signed a Deed of Conveyance while Vice Governor Junjun Davide and Visayas Command chief, Lt. Gen. Robert Dauz served as witnesses.

"I have been working for this, not for my own personal benefit. I have been working, and working, and working, that we recover these lots and the entire 80 hectares because this is what the Cebuanos deserve," Gov. Garcia said.

Vice Gov. Davide said the recovery of these previously owned Cebu Province's properties went through a long process.

"With nothing but the best interests of the province in mind, the governor's relentless efforts to recover ownership and possession of these properties will have an enormous impact on the well-being of the province and the Cebuanos," Vice Gov. Davide said.

"We are grateful to the new leadership of the defense department for honoring the agreement and recognizing the importance of reconveying these parcels of land to the Province of Cebu," he added.

In 1959, the Provincial Government donated lots to the AFP to be used specifically for military purposes. In the deed of donation, a stipulation directed the recipient to return the parcels of land to the  Province if the lots would be utilized other than for military purposes.

Also present during the historic event were Cebu City Mayor Michael Rama and Vice Mayor Raymond Garcia, members of the Provincial Board,
mayors from towns under the province, and officials of the Department of National Defense and Armed Forces of the Philippines. KC/photos by Sven Alega

Press Release: Cebu Vice Governor Junjun Davide expressed his gratitude to Governor Gwen Garcia for leading the Cebu Provincial Government in facing huge challenges in the past 1,100 days.

"Gov. Gwen, you risked life and limb going around the province at the height of the Covid 19 as you were looking for ways to pluck the people from their miseries. You were also persistent in your efforts after typhoon Odette's devastation so the Cebuanos could fast-track rebuilding their homes," Davide said during his welcome address of the Governor's Report: A Thousand and 100 Days at the Capitol Social Hall.

"For that, we are grateful to you for always leading us the way and sharing your strength as we soldier on in every battle," he added.

Davide also wished  Gov. Garcia good health as the event coincided with the latter's 67th birthday celebration. KC/CONTRIBUTED PHOTOS

Philippine Government / IRA for LGUs
October 14, 2022, 03:20:32 PM
By Rey Anthony Chiu

(rahc/PIA-7/Bohol)

Maribojoc - Bohol / Maribojoc Rises from the Ruins
October 14, 2022, 12:09:21 PM
By Cooper Resabal
PAGBANHAW: MARIBOJOC RISES FROM THE RUINS

Remembering October 15, 2013, the day an intensity 7.2 struck Bohol and neighboring islands.

It was also the 153rd anniversary of the founding of Maribojoc, Bohol, as a "pueblo" which was on October 15, 1860.

We wish to thank all those who supported and encouraged Bohol islanders to stand again after the disaster.

When a powerful earthquake struck Bohol on October 15, 2015, it brought extensive damage to many of the province's heritage structures.

The Sta. Cruz Parish Church of Maribojoc, which was declared a National Cultural Treasure by the National Museum of the Philippines on May 5, 2010, was leveled to the ground.

Reconstruction of the heritage structure had been undertaken by the National Museum of the Philippines with work commencing in 2017. The reconstruction project entailed planning by the NMP architects, engineers and conservators, as well as consultations with technical experts, cultural workers and local stakeholders.

The church complex of Maribojoc includes the stone masonry church and convent, its side plazas, and the stone stairway at the back of the church leading to the town's port.

The rebuilding of the church structure involved monumental feats all aimed at reviving the country's unique built cultural heritage for future generations to cherish and enjoy, and use to strengthen their faith as well.

The reconstructed Sta. Cruz Parish Church of Maribojoc had been turned over December 12, 2021 by the National Museum of the Philippines, which took charge of the construction and facilitated its financing, to the Archdiocese of Tagbilaran.

We parents can only do so much to guide our children on the right path.

Who's Who in the Philippines / EJ Obiena Back Home
October 14, 2022, 09:08:32 AM
By EJ Obiena
Whoever coined the phrase "There is no place like home" was indeed spot on.

There is no place like home.  And for me that means The Philippines .

After a three-year hiatus, I have spent now 3 weeks rediscovering home. Reconnecting with family and supporters.  Revisiting with institutions of my youth that helped shape me to be who I am today.  It's been wonderful.

One thing I discovered are new opportunities to work with amazing businesses and brands. Pursuing these opportunities is important to me.  I have long advocated a great presence of private sector support for athletes. This has a dual-benefit. It not only brings more funding to needy athletes; but it also helps ease the burden on the Filipino taxpayer. I even wrote a column on this last year.

As my team is stretched, my existing agent and good friend and mentor, James Michael Lafferty and I, decided to bring in a new team member to help us manage. After a careful review of options, we chose Ms. Vania Padilla-Edralin of VMG Asia to join our team to help us manage my relationship with these brands in Philippines. Vania has a long and successful pedigree in the world of sports management and we are happy to have her be part of Team Obiena.

Welcome @vaniaedralin to Team Obiena!

Bohol Latest News / Bohol Pork Products

Online meat, pork products
sellers must show NMIS docs

TAGBILARAN CITY, Bohol, Oct 13 (PIA) –By this week, online dealers of pork and pork products who could not show proper documents of where their products were sourced out, would have their products confiscated and still be liable of P1,000 to P5,000 fine as well as imprisonment of not more than six months or at the discretion of the courts.

This also includes transport carriers of these illegally shipped products to Bohol would have the products confiscated and the driver, pilot or captain themselves would be fined P5K, even if it is for allowing the loading of such prohibited products.

This as Bohol Sangguniang Panlalawigan passed Provincial Ordinance No. 2022-011, last September 13, the Ordinance revising Provincial Ordinance No. 2021-015 which prohibits the entry of live pig, pork, pork products, frozen semen coming from African Swine Fever affected areas and providing penalties thereof.

Aptly called the Revised Bohol African Swine Fever Prevention Ordinance of 2022, the revised ordinance now carries penal provisions, administrative proceedings as well as the Implementing Rules and Regulations in the furtherance of the policy.

"This is also to protect the consumers who may not know where the meat they are buying online comes, or did it pass through the proper government regulations in meat safety," briefs Bohol Provincial Veterinarian Dr. Stella Marie Lapiz, in the sidelines during the National African Swine Fever Prevention and Control Program (NASFPCP) ASF Preparedness Private Stakeholders Meeting held at the Panda Tea Garden Suites earlier this week.

OFWs Worldclass Filipinos / Minimum Salary in Qatar
October 13, 2022, 11:22:42 PM
News Release
Department of Labor and Employment
September 27, 2020

Bello: New Qatar minimum wage law beneficial to OFWs

With a new 'non-discriminatory minimum wage', the government of Qatar becomes the first Arab state to introduce a significant labor policy reform covering all its migrant workers, the labor department said on Sunday.

Labor Secretary Silvestre Bello III said the government of Qatar adopted early this month Law No. 17 series of 2020, setting the minimum wage for all workers of all nationalities in the private sector at 1,000 Qatari Riyal (QR) equivalent to $274 or Php13,325.00, the basic wage.

Earlier, Qatar has abolished the kafala, an employment system that requires all migrant workers to secure the permission of employers before they can seek another employment.

In addition to the minimum basic wage, employers are directed to ensure that workers are provided adequate food and accommodation, or allocation of additional 500 QR for accommodation and 200 QR for food, bringing the minimum total gross salary to 1,800 QR equivalent to $ 494 or Php 24,000.00.

Citing a report from the Philippine Overseas Labor Office (POLO) in Qatar, the Labor Chief said the law establishes a Minimum Wage Committee that will review the impact and application of the minimum wage, in consultation with different bodies, experts, workers, and employers.

The report, according to Bello, said that the government of Qatar, through the Ministry of Administrative Development Labor and Social Affairs (MADLSA), will be working with employers to update all employment contracts where workers are earning less than the amount established by the new law.

Bello stressed that overseas Filipino workers (OFWs) who are already enjoying higher salaries and benefits need not worry as MADLSA gave an assurance that they will not be affected by the new law.

In addition, he said, there are amendments to the Labor Law prescribing stricter penalties for employers who fail to pay their workers' wages and provide adequate accommodations, prescribed by MADLSA.

The new minimum wage law will come into force after six months from its publication in Qatar's Official Gazette on September 9, 2020.

Only four countries side with Russia in UN vote

Four countries - Syria, Nicaragua, North Korea, and Belarus -  joined Russia in voting against the UN resolution condemning Moscow's attempted annexation of four areas in Ukraine.

Thirty-five countries abstained from the vote, including Russia's strategic partner China, while the rest did not vote.

Ukrainian President Volodymyr Zelenskiy tweets he was "grateful to 143 states that supported historic #UNGA resolution ...(Russia's) attempt at annexation is worthless."

In Brussels, more than 50 Western countries met to pledge more military aid to Ukraine, especially air defense weapons, following heavy retaliatory strikes this week ordered by Russian President Vladimir Putin in response to an explosion on a bridge in Crimea.

Pledges from allies included an announcement by France that it would deliver radar and air defense systems to Ukraine in the coming weeks. Britain has also pledged air defense missiles, while Canada said it would provide artillery rounds among other supplies.

Zelenskiy says the increased aid would strengthen their counteroffensive. (via Reuters)

BUSINESS: Finland to hire high-value skilled workers
By Ehda M. Dagooc

Aside from nurses, Finland is also on the lookout for high-value skills such as information technology experts and other specialized fields.

In an interview with Finland Ambassador to the Philippines Juha Pyykkö, he said while the social and health sector dominate the employment opportunities in Finland, there is also good potential for those in other fields of expertise to land a job, as the country is continuing to grow in other sectors.

At present, there are about 5,000 to 6,000 Filipinos living in Finland, most of whom are medical professionals.

A country with only 5.5 million population, the ambassador said they are needing experts in different fields, including nurses as a constant need for its growing economy.

Education and Manufacturing

Aside from Finland's interest to help the development of sustainable economy in the Philippines, such as improving the share of renewable energy mix in the country, the ambassador also mentioned that the Embassy has initial discussions with Department of Education (DepEd) secretary and Vice President Sara Duterte for a possible policy dialogue.

"We have a lot of [education] concepts that we want to provide here [Philippines] as well.

He also mentioned Finnish investors' interest in investing further in renewable energy, circle economy, plastic, battery storage technology, and other smart and green related technologies

Tourism

The ambassador also mentioned the Philippines big potential to attract more Finnish tourists to visit the tropical country, admitting that the Philippines is considered as an unchartered territory for Finnish nationals.

Pyykkö, who was in Cebu Tuesday, October 11, for the official conferment of Jose Franco B. Soberano as the first Honorary Consul ever installed by the Finnish government in Cebu.

According to Pyykko, with right promotional campaign to be initiated by the Philippine government, the Philippines may be able to get the attention of Finnish travelers, "now that the skies are opening." #TheFreeman

ATTY. LEILA M. DE LIMA'S STATEMENT ON THE HOSTAGE-TAKING

I am grateful to all who expressed concern for my well-being in the aftermath of the surreal hostage-taking incident that happened this Sunday morning.

I have already endured more than five years of unjust detention inside the PNP Custodial Center. It was therefore farthest from my mind that on top of this ordeal, I also had to survive the knife of a fellow detainee (reportedly an Abu Sayyaf member) who took me hostage in a desperate attempt to make known their grievances to the public.

After being told by the hostage-taker that since his two other companions were already dead, he might just as  well also kill me, I consider what happened to me as a near-death experience. If not for the timely intervention of the PNP security force, I don't think I would have come out alive since the hostage-taker was already determined to die and take me with him.

I am now safe and sound except for the lingering pain on my chest where the hostage-taker pressed the point of his knife while holding me hostage. Please also pray for the injured police officer who, like me, was the other but more unfortunate victim of this incident. While I have survived with only a knife mark and some considerable distress, he is still fighting for his life. Let us all pray for his quick recovery.

While I am still trying to recover psychologically and emotionally from this harrowing experience, I am sure of one thing that I learned from it. Being so near death has only made me value life even more.

Thank you for all your prayers. Most of all, I thank the Lord for being by my side during those terrible moments, and for saving my life today.

477 WHALES DIE IN 'HEARTBREAKING' NEW ZEALAND STRANDINGS

Some 477 pilot whales have died after stranding themselves on two remote New Zealand beaches over recent days, officials say.

None of the stranded whales could be refloated and all either died naturally or were euthanized in a "heartbreaking" loss, said Daren Grover, the general manager of Project Jonah, a nonprofit group which helps rescue whales.

The whales beached themselves on the Chatham Islands, which are home to about 600 people and located about 800 kilometers (500 miles) east of New Zealand's main islands.

The Department of Conservation said 232 whales stranded themselves Friday at Tupuangi Beach and another 245 at Waihere Bay on Monday.

The deaths come two weeks after about 200 pilot whales died in Australia after stranding themselves on a remote Tasmanian beach.

Mass strandings of pilot whales are reasonably common in New Zealand, especially during the summer months. Scientists don't know exactly what causes the whales to strand, although it appears their location systems can get confused by gently sloping sandy beaches. | via Associated Press

Philippine Education / Ateneo de Manila vs UP Diliman
October 12, 2022, 01:34:49 PM
By CNN Ph
Ateneo de Manila dethroned the University of the Philippines to become the top university in the country, according to a British higher education magazine.

ADMU landed in the 351-400 rank bracket. The previous list only included two schools — UP and La Salle.

The rankings are based on 13 performance metrics which include teaching, research, and international outlook. This year, they also based the list on research publications and a worldwide survey on the reputation of each school.

For the 7th straight year, Oxford in the UK is still the top university in the world. www.cnn.ph

October 12, 2022, 09:49:45 AM
NASA's Planetary Defense System called DART had successfully altered the course of an asteroid—the first time in history that humanity has changed the direction of a celestial body. Last month the $330m satellite crashed into Dimorphos, a 160-metre-wide space rock, at 14,000mph (22,000km/h). It was the first test of NASA's planetary defence system, which is designed to prevent asteroids colliding with, and potentially destroying, Earth. (Economist)
