Tan vs Court of Appeals

It has been repeatedly enunciated that “a client is bound by the action of his counsel in the conduct of a case and cannot be heard to complain that the result might have been different had he proceeded differently. A client is bound by the mistakes of his lawyer. If such grounds were to be admitted as reasons for reopening cases, there would never be an end to a suit so long as new counsel could be employed who could allege and show that prior counsel had not been sufficiently diligent or experienced or learned.”
#29524
Bejarasco vs People of the Philippines:

The general rule is that a client is bound by the counsel’s acts, including even mistakes in the realm of procedural technique. The rationale for the rule is that a counsel, once retained, holds the implied authority to do all acts necessary or, at least, incidental to the prosecution and management of the suit in behalf of his client, such that any act or omission by counsel within the scope of the authority is regarded, in the eyes of the law, as the act or omission of the client himself.

It is the client’s duty to be in contact with his lawyer from time to time in order to be informed of the progress and developments of his case; hence, to merely rely on the bare reassurances of his lawyer that everything is being taken care of is not enough.

By Rodger Baker and Zhixing Zhang

Over the past decade, the South China Sea has become one of the most volatile flashpoints in East Asia. China, Vietnam, the Philippines, Malaysia, Brunei and Taiwan each assert sovereignty over part or all of the sea, and these overlapping claims have led to diplomatic and even military standoffs in recent years.

Because the sea hosts numerous island chains, is rich in mineral and energy resources and has nearly a third of the world's maritime shipping pass through its waters, its strategic value to these countries is obvious. For China, however, control over the South China Sea is more than just a practical matter and goes to the center of Beijing's foreign policy dilemma: how to assert its historic maritime claims while maintaining the non-confrontational foreign policy established by former Chinese leader Deng Xiaoping in 1980.

China staked its modern claim to control of the sea in the waning days of the Chinese Civil War. Since most of the other claimant countries were occupied with their own independence movements in the ensuing decades, China had to do little to secure this claim. However, with other countries building up their maritime forces, pursuing new relationships and taking a more active stance in exploring and patrolling the waters, and with the Chinese public hostile to any real or perceived territorial concessions on Beijing's part, Deng's quiet approach is no longer an option.

Two lawmakers from the House of Representatives on Monday lauded the gains cited by President Benigno S. Aquino III in his State of the Nation Address, saying the country is moving in the right direction and all-out support from Congress should be given to his administration's reform agenda in order to capitalize on these gains.

Aurora Rep. Juan Edgardo “Sonny” Angara particularly praised the President and his education team for “putting where their mouths are.”

During the SONA, President Aquino underscored that backlogs in chairs and textbooks, amounting to P2,573,212 and P6.17 million respectively, will be answered by the end of 2012. The President likewise said that the shortage in classrooms, amounting to P66.800 billion, will be answered by 2013.

Angara, who chairs the House Committee on Higher and Technical Education, noted that the administration is asking for a larger budget for the Education Department in 2013 amounting to P292.7 billion â€" an amount representing an increase of 60 percent compared to the 2010 allotment of P177 billion.

The young legislator also lauded the gains made in other equally pressing areas like good governance and employment generation, among others that point to how we as a country are moving in the right direction and making improvements in the right places.

“There is so much momentum for change to capitalize. All the more should we work doubly hard to enact the reforms we seek," Angara said.

For his part, An Waray Partylist Rep. Florencio Noel said that President Aquino’s SONA, in effect, exhorted lawmakers to help in the pursuit of his administration's reform agenda.

“The President gave us clear guideposts - that we can work together in creating more jobs, building more hope, and giving more opportunities for our people,” he said. - PNA

Poems and Poets / Cranky Old Man
July 24, 2012, 05:35:47 AM
source: Google Plus

When an old man died in the geriatric ward of a nursing home in an Australian country town, it was believed that he had nothing left of any value.

Later, when the nurses were going through his meager possessions, They found this poem. Its quality and content so impressed the staff that copies were made and distributed to every nurse in the hospital.

One nurse took her copy to Melbourne. The old man's sole bequest to posterity has since appeared in the Christmas editions of magazines around the country and appearing in mags for Mental Health. A slide presentation has also been made based on his simple, but eloquent, poem.

And this old man, with nothing left to give to the world, is now the author of this 'anonymous' poem winging across the Internet.

Cranky Old Man

What do you see nurses? . . .. . .What do you see?
What are you thinking .. . when you're looking at me?
A cranky old man, . . . . . .not very wise,
Uncertain of habit .. . . . . . . .. with faraway eyes?
Who dribbles his food .. . ... . . and makes no reply.
When you say in a loud voice . .'I do wish you'd try!'
Who seems not to notice . . .the things that you do.
And forever is losing . . . . . .. . . A sock or shoe?
Who, resisting or not . . . ... lets you do as you will,
With bathing and feeding . . . .The long day to fill?
Is that what you're thinking?. .Is that what you see?
Then open your eyes, nurse .you're not looking at me.
I'll tell you who I am . . . . .. As I sit here so still,
As I do at your bidding, .. . . . as I eat at your will.
I'm a small child of Ten . .with a father and mother,
Brothers and sisters .. . . .. . who love one another
A young boy of Sixteen . . . .. with wings on his feet
Dreaming that soon now . . .. . . a lover he'll meet.
A groom soon at Twenty . . . ..my heart gives a leap.
Remembering, the vows .. .. .that I promised to keep.
At Twenty-Five, now . . . . .I have young of my own.
Who need me to guide . . . And a secure happy home.
A man of Thirty . .. . . . . My young now grown fast,
Bound to each other . . .. With ties that should last.
At Forty, my young sons .. .have grown and are gone,
But my woman is beside me . . to see I don't mourn.
At Fifty, once more, .. ...Babies play 'round my knee,
Again, we know children . . . . My loved one and me.
Dark days are upon me . . . . My wife is now dead.
I look at the future ... . . . . I shudder with dread.
For my young are all rearing .. . . young of their own.
And I think of the years . . . And the love that I've known.
I'm now an old man . . . . . . .. and nature is cruel.
It's jest to make old age . . . . . . . look like a fool.
The body, it crumbles .. .. . grace and vigour, depart.
There is now a stone . . . where I once had a heart.
But inside this old carcass . A young man still dwells,
And now and again . . . . . my battered heart swells
I remember the joys . . . . .. . I remember the pain.
And I'm loving and living . . . . . . . life over again.
I think of the years, all too few . . .. gone too fast.
And accept the stark fact . . . that nothing can last.
So open your eyes, people .. . . . .. . . open and see.
Not a cranky old man .
Look closer . . . . see .. .. . .. .... . ME!!

i personally who of two brothers whose filipina mother left them when they were very young kids. twenty years later, they were still searching for their mother. one day, a neighbor who went to australia informed the two brothers that their mother has been living in australia, and is married to an australian national. the two brothers got hold of the number of their mother and called her in australia. but the mother refused to talk to them for no reason at all.

this is a long story pero basin maglagot lang mo ug maghilak para sa mga bata nga gibiyaan. dili lang biya (gi-padlockan pa gyud ang kwarto). what if nasunog ang balay that time?

July 19, 2012, 01:57:53 PM
Nature of a Lawyer’s Oath:

► The lawyer’s oath is not a mere formality recited for a few minutes in the glare of flashing cameras and before the presence of select witness. (In re: Arthur M. Cuevas, Jr. 285 SCRA 59, January 27. 1998).

►The lawyer’s oath is not mere facile words, drift and hollow, but a sacred trust that must be upheld and kept inviolable. (Sebastian v. Calis, Adm. Case No. 5118, Sept. 9, 1999)
