Boxing and Boxers / Oscar de la Hoya on Muhammad Ali
March 01, 2023, 09:10:21 AM
'The first time I met The Greatest of All Time - Muhammad Ali - I didn't know who he was.
I was 6-years-old and living in East Los Angeles, a tough neighborhood plagued by gang violence, with my family in a small apartment. My parents decided it would be good for me to visit the local youth gym to keep me out of trouble and off the streets. The gym wasn't even really a gym but rather an old church with the pews removed. The boxing ring was positioned in the same place where the altar for worship once stood.

Ali didn't say anything to us that day when he walked into the gym. He was alone and dressed in a sweatsuit for training that was fashioned from plastic, carrying a small gym bag. He went to the corner, wrapped his hands and quietly began training. We watched in awe as this towering man went from shadow boxing, to the speed bag, to the heavy bag.

Suddenly, he stopped and called out to us: 'All you kids! Get over here. I have something to tell you.' All of us were wide-eyed, not knowing who this man was and what he was going to say. We crowded around him and listened intently. 'Kids, listen to me. It's good to want to be a champion. I know that's why you are here and why you work hard. But, never forget: It doesn't matter what happens inside the ring; what matters is what you do outside the ring.'

All of us where surprised. We hadn't heard this before. We all wanted to become champions, to make money and leave our rough neighborhood behind. This was a revolutionary idea for me to hear at such a young age. These few words from Ali had such an impact on me. This became my mantra and has guided how I live my life, how I run my business and what I teach my own kids.

What matters most is the impact you leave on others around you and in your community. Ali lived his life this way. It's part of the legacy he now leaves behind. It's how I strive to live my life to this day. And it's the same message I share every time I go back to my old neighborhood and speak with the young kids there, to inspire and encourage them to lead positive lives and build strong character.'

- Oscar De La Hoya

Philippines aims to attract strategic investments with one-stop shop and green lanes

The Philippines government has approved the 2022 Strategic Investment Priority Plan (SIPP) to extend and expand tax incentives for a wide range of industries that are critical to the country's development¹. The SIPP covers sectors such as artificial intelligence, high technical manufacturing, renewable energy, and health care.

To facilitate and expedite the entry of strategic investments in these sectors, the Department of Trade and Industry-Board of Investments (DTI-BOI) will establish a one-stop shop within six months from the date of issuance of Executive Order No. 61⁴, which approved the SIPP on May 24, 2022.

The one-stop shop will serve as a single point of entry for strategic investments in applying for permits and licenses from various national and local government agencies, as well as quasi-judicial bodies. The DTI-BOI will also identify which projects are considered strategic investments based on certain criteria⁴.

Moreover, green lanes will be set up in and integrated with the one-stop shops under Republic Act No. 11032 or the Ease of Doing Business and Efficient Government Service Delivery Act of 2018 and Republic Act No. 11234 or the Energy Virtual One-Stop Shop (EVOSS) Act of 2018⁴. These green lanes will expedite and streamline permitting processes for DTI-BOI-endorsed strategic investments.

The processing time for applications under the green lanes will follow RA 11032: three days for simple transactions, seven days for complex transactions, and 20 days for highly technical transactions. The processing time may be extended only once for the same period. Applications with complete submissions and fully paid fees but unacted within the processing time will be automatically approved⁴.

In addition, national and local government agencies will allow electronic submissions and payments for applications under the green lanes. The DTI-BOI will also endorse cases of refusal to issue permits or licenses within the processing time to the Anti-Red Tape Authority (ARTA) for appropriate action.

The SIPP is expected to boost economic recovery from COVID-19 pandemic by attracting more foreign direct investments (FDIs) and creating more jobs in key industries. According to DTI Secretary Ramon Lopez, "the SIPP is a game-changer that will make our investment climate more competitive".

History / Henry Cavendish Weighed the Earth
February 28, 2023, 08:14:45 AM
#Newton had published his law of #gravitation in 1687, but he hadn't made any attempt to determine the constant #G or the mass of Earth. Then in 1798, another English man came into the scene and he calculated the #density (and hence the #mass) of the #Earth. That man is our "scientist of the day" today.

It's death anniversary of #HenryCavendish, the man who devoted his life to science - -

(Scientist of the Day - 24 February)

Cavendish was an important experimental and theoretical physicist & chemist. Because of his asocial and secretive behaviour, he often avoided publishing his work, and much of his findings were not told even to his fellow scientists. In the late 19th century, long after his death, #JamesClerkMaxwell looked through Cavendish's papers and found observations and results for which others had been given credit. Some examples of what was included in Cavendish's discoveries or anticipations were:-
- Richter's law of reciprocal proportions,
- Ohm's law......

Facts and Trivia / An Essay on Christian Faith
February 28, 2023, 02:38:36 AM
An essay is a focused piece of writing that explains, argues, describes, or narrates¹. To write an essay based on statements, you need to:

- Start with a question that relates to the main idea of the statements.
- Write your initial answer to the question as your thesis statement³.
- Outline your main points and supporting evidence for each point².
- Write an introduction that introduces your topic and thesis statement.
- Write body paragraphs that explain and support your main points with evidence and analysis.
- Write a conclusion that summarizes your main points and restates your thesis statement with a strong closing statement.

Here is an example of a possible essay outline based on your statements:

**Question:** How does our Christian faith affect our relationship with others?

**Thesis statement:** Our Christian faith calls us to die to ourselves and love our neighbors in need as a way of living out our prayer and friendship with God.

**Main points:**

1. Our Christian faith must be lived out not only in prayers and rituals but also in our day to day relationship with people around us.
2. The Gospel today stresses relationship especially with needy brothers and sisters who hold our "ticket" to enter heaven.
3. Helping others is not an easy thing to do; it challenges us to learn how to forget oneself and reach out to others.
4. Dying to oneself is another more serious way of putting it; but we are habitually afraid of dying, for this reason our prayer and friendship with God should come to the rescue.
5. God's word will lead us to the right direction and mission; His word is clear: to come to a new life one has to die like the seed that should first fall to the ground so that it could sprout into life.

**Introduction:**

Christianity is not just a set of beliefs or practices; it is a way of life that transforms our relationship with God and others. In this essay, I will argue that our Christian faith calls us to die
to ourselves and love our neighbors in need as a way of living out our prayer and friendship with God.

**Body paragraphs:**

(Each paragraph should start with a topic sentence that states the main point, followed by supporting evidence from the statements or other sources, and analysis that explains how the evidence supports the point.)

Paragraph 1: Our Christian faith must be lived out not only in prayers and rituals but also in our day to day relationship with people around us.

Evidence: The statements say that "our Christian faith must be lived out not only in prayers and rituals but also in our day-to-day relationship with people around us."

Analysis: This means that we cannot separate our faith from our actions; we have to show our love for God by loving His creation, especially those who are made
in His image and likeness (Genesis 1:27). Prayers and rituals are important ways
of expressing our devotion to God, but they are not enough if we do not also care
for His people.

Paragraph 2: The Gospel today stresses relationship especially with needy brothers
and sisters who hold our "ticket" to enter heaven.

Evidence: The statements say that "the Gospel today stresses relationship especially with needy brothers and sisters." They also say that "these people hold our 'ticket' to enter heaven."

Gilas Pilipinas suffers narrow loss to Jordan in final FIBA World Cup qualifier

BOCAUE, Bulacan – Gilas Pilipinas failed to end its FIBA World Cup Asian Qualifiers campaign on a high note as it lost to Jordan, 91-90, on Monday, Feb. 27 at the Philippine Arena.

Despite a career-high 41 points from naturalized player Justin Brownlee², Gilas Pilipinas could not complete a comeback from a 16-point deficit in the second half and saw its four-game winning streak snapped by Jordan.

Jordan was led by Ahmad Alhamarsheh and Dar Tucker, who scored 24 and 23 points, respectively. The visitors also dominated the boards, 51-35³, and shot better from beyond the arc, 12-of-28 compared to Gilas' 9-of-34⁴.

Gilas Pilipinas trailed by as much as 16 points in the third quarter but rallied behind Brownlee's hot shooting and cut the lead to just one point with less than two minutes left in the game.

However, Jordan held on with clutch baskets from Alhamarsheh and Tucker while Gilas Pilipinas missed some crucial free throws and three-pointers down the stretch.

The game was a rematch of their previous encounter last November 10 in Amman, where Gilas Pilipinas won by eight points⁵. Both teams have already secured their spots in the FIBA World Cup that will be co-hosted by Indonesia, Japan and Philippines next year.

Gilas Pilipinas finished second in Group A with a 7-3 record while Jordan placed third with a 6-4 record⁶.

Technology / How to Cut Carbon Emissions
February 27, 2023, 04:37:58 PM
Carbon emissions are the main cause of global warming and climate change. They come from burning fossil fuels such as coal, oil, and gas for energy, transportation, and industry. To cut carbon emissions, we need to use less energy, switch to renewable sources of energy, improve energy efficiency, and protect natural resources that absorb carbon dioxide.

Some ways to cut carbon emissions are¹²³⁴:

- Use public transportation, bike, walk, or carpool instead of driving alone.
- Turn off lights and appliances when not in use. Use LED bulbs and smart power strips.
- Buy energy-efficient appliances and electronics. Look for the Energy Star label.
- Install solar panels or wind turbines on your home or business. Or buy green power from your utility company.
- Eat less meat and more plant-based foods. Avoid food waste and compost organic waste.
- Buy local and organic products. Avoid products with excess packaging or palm oil.
- Plant trees and gardens. Avoid deforestation and land degradation.
- Support policies and initiatives that reduce greenhouse gas emissions. Join a climate action group or campaign.

What are some actions that you are already taking or planning to take to cut your carbon emissions?

Philippine Inflation Hits Highest Level Since 2008

The Philippine Statistics Authority (PSA) announced today that the annual inflation rate in the Philippines rose to 8.7% in January 2023, from 8.1% in December 2022¹⁴. This is the highest inflation rate recorded since November 2008¹³, and well above the market expectations of 7.7%¹.

The PSA attributed the surge in inflation mainly to rising prices of housing, electricity, gas, and other fuels, which increased by 8.5% year-on-year in January 2023, compared to 7% in December 2022¹. Other factors that contributed to higher inflation were food & non-alcoholic beverages (9.6% vs 9.4%), transport (10.2% vs 9%), health (6.5% vs 6%), and education (5.4% vs 5%)¹.

The PSA also reported that core inflation, which excludes volatile items such as food and energy, rose to 6.3% in January 2023, from 5.9% in December 2022¹. This indicates that inflationary pressures are broadening across various sectors of the economy.

The Bangko Sentral ng Pilipinas (BSP), the country's central bank, has been tightening its monetary policy stance since November last year to curb inflation and support the peso amid external headwinds such as rising oil prices and global supply chain disruptions². The BSP has raised its key policy rate by a cumulative of one percentage point to four percent as of its latest meeting on January 20th².

The BSP has also revised its inflation forecast for this year upward to six percent from five percent previously, citing higher risks from supply-side shocks and demand pressures². The BSP said it will continue to monitor price developments closely and act accordingly to ensure price stability conducive to sustainable economic growth.

February 27, 2023, 01:15:53 PM
Rings of Saturn 🪐

🪐 The rings we see on Saturn are made of billions of ice fragments and space rocks of different sizes. Some are like grains of sand. Others are the size of a house.
🪐 Surrounding the planet is a set of 7 main rings with space in between. Each one spins at a different speed. Scientists don't know the exact origin of the rings, but one hypothesis is that they are the remains of comets, asteroids, or moons that collided and collided, causing the fragments to go into orbit around Saturn.
🪐 Saturn's 82 natural moons help keep the rings in orbit, preventing them from expanding violently into space.

- The Court of Appeals (CA) has denied an appeal filed by Oasis and Leisure Islands Development Inc. (OLIDI), a resort developer that wanted to reclaim 450 hectares of land off Panglao Bay in Bohol province¹².
- The CA affirmed its 2021 ruling that dismissed OLIDI's petition for mandamus and prohibition against the Bohol provincial government and its officials³.
- The CA said that OLIDI failed to show that it had a clear legal right to compel the provincial government to honor its joint venture agreement (JVA) for the reclamation project³.
- The CA also said that OLIDI failed to exhaust administrative remedies before filing its petition in court³.
- The CA noted that the reclamation project was opposed by various stakeholders, including environmental groups, local residents, tourism operators and church leaders, who raised concerns about its impact on Panglao's marine biodiversity, cultural heritage and livelihoods³.

Book Reviews / Anna Karenina Novel Summary
February 27, 2023, 08:39:42 AM
Anna Karenina is a novel by Leo Tolstoy that was published in installments between 1875 and 1877³. It is considered one of the pinnacles of world literature³.

The novel depicts the efforts of its titular character, Anna Karenina, to escape an unhappy marriage to her older husband, Alexey Karenin, and pursue a love affair with a young and dashing count, Alexei Vronsky²⁴. However, Anna faces social ostracism and moral condemnation for her adultery, while Vronsky struggles with his military career and family obligations²⁴. Meanwhile, another plotline follows Konstantin Levin, a landowner who proposes to Kitty Shcherbatsky but is rejected because she hopes to marry Vronsky⁴. Levin retreats to his estate and contemplates his life and faith. He later reunites with Kitty and marries her after she realizes her mistake⁴.

The novel explores themes such as love, marriage, family, society, religion, morality and politics. It portrays the contrast between city life and country life in Russia during the late 19th century. It also shows how different characters cope with their personal dilemmas and choices.

I hope this summary helps you with your book report. Do you have any questions about the novel?

Health and Food / How to Cure Fatty Liver
February 27, 2023, 12:32:03 AM
Fatty liver is a condition that occurs due to excessive build-up of fat in the liver¹. It can be caused by various factors such as alcoholism, obesity, diabetes, hepatitis C infection, etc¹. Fatty liver can lead to serious complications such as liver cirrhosis, liver failure, or liver cancer if left untreated¹.

There is no specific treatment for fatty liver. It is a reversible condition that can be managed by making some lifestyle modifications to treat the underlying cause. Some of the home remedies for fatty liver are:

- Lose excess weight. The American Association for the Study of Liver Diseases (AASLD)'s 2017 guide identifies weight loss as a key factor in reducing liver fat⁴.
- Try the Mediterranean diet. Research from 2017 suggests that the Mediterranean diet may help to reduce liver fat, inflammation, and fibrosis⁴.
- Drink coffee. Studies have shown that coffee consumption may lower the risk of developing fatty liver disease and protect against liver damage⁴.
- Eat more vegetables, protein and healthy fats. Raw vegetables and fruits are the most powerful liver healing foods. They help to cleanse and repair the liver filter, so that it can trap and remove more fat and toxins from the bloodstream⁵. Protein helps to build and repair liver cells. Healthy fats such as olive oil, nuts, seeds, avocadoes, etc., help to reduce inflammation and improve insulin sensitivity⁵.

If you have any symptoms or risk factors for fatty liver disease, you should consult your doctor for a proper diagnosis and treatment plan.

History / Sun Tzu was Military Strategist
February 26, 2023, 06:12:22 AM
What made Sun Tzu so great?

Sun Tzu was a great military strategist and philosopher from ancient China, who is most well-known for his book "The Art of War". His enduring legacy is due to several factors, including:

Strategic insights: Sun Tzu's strategies and tactics are still studied and applied in military, business, and political contexts around the world. His emphasis on understanding oneself and one's enemy, the importance of planning and preparation, and the use of deception and surprise are still relevant today.

Timelessness: Although "The Art of War" was written over 2,500 years ago, its lessons and principles remain relevant and applicable in various contexts. Sun Tzu's advice is not specific to a particular historical period or type of conflict, making it adaptable to many situations.

Conciseness and clarity: Sun Tzu's writing is known for its brevity and directness. He was able to convey complex ideas and strategies in a concise and clear manner that is easy to understand and remember.

Influence: Sun Tzu's ideas and teachings have had a profound impact on Chinese and East Asian culture, philosophy, and military strategy. His book has been translated into many languages and is still widely read and studied today.

Overall, Sun Tzu's greatness stems from his strategic insights, timelessness, clarity of expression, and enduring influence on military and political thought.

Lifestyle, Culture and Arts / Blue Origin Engineers
February 22, 2023, 05:21:23 PM
Paul Ebertz, Blue Origin's Vice President of Engineering and Program Management, kicks off #Eweek2023 with a special guest post.

Driven by curiosity, ambition, and innovation, Blue Origin engineers are making history every day. I dedicate this #Eweek2023 post to celebrating our talented, diverse engineering team and empowering future builders and dreamers to join our mission and create the future.

Blue Origin engineers are designing a future where millions of people will live and work in space for the benefit of Earth. Achieving this vision requires building a road to space through reusable vehicles, engines, and space systems.

We're designing and manufacturing rocket engines and space vehicles from the ground up in a unique, cutting-edge environment. Our engineers apply their expertise to solve intriguing challenges in orbital dynamics, vehicle design, material sciences, propulsion, fluid dynamics, human factors, flight control systems, and more.

"You can't become what you can't see" is a phrase that guides us as we inspire future generations to build the road to space. With that in mind, many of our engineers volunteer as Ambassadors with Blue Origin's nonprofit Club for the Future to share their story with children from similar backgrounds. We want to open their minds to careers in STEM and aerospace for the benefit of Earth.

Our team comes from diverse industries that have so much to offer the space industry —automotive, aviation, technology, nuclear submarines, and gaming, to name a few. We're stronger because of this mix of expertise. The engineering team grew by leaps and bounds last year, and we expect to continue expanding this year as we build the future of humans in space.

It's a privilege to work with our exceptional team that continues to push the boundaries of what's possible and inspire future generations. We hope you consider joining our mission. Visit our careers page for our open positions: https://bit.ly/3rUFZyR

Facts and Trivia / Mukaab of Saudi Arabia
February 21, 2023, 07:58:28 AM
Saudi Arabia has unveiled plans for a 400-metre tall cube-shaped skyscraper in Riyadh large enough to hold 20 Empire State Buildings. The Mukaab will rise as the centrepiece of a new 19-square-kilometre district called Murabba that's set to comprise over 25 million square metres of floor area and create 104,000 homes.

If successfully constructed, The Mukaab would become one of the largest structures ever built — its 400-metre height would be matched by a 400-metre length on all four sides. Designed as a "premium hospitality destination", the vast cube-structure is set to enclose 2 million metres of floor space, including a central atrium space framed around a spiralled tower.

The project will be delivered by Saudi Arabia's New Murabba Development Company (NMDC), as part of the country's Public Investment Fund (PIF) — a sovereign wealth fund established in 2017 that's seeking to diversify income sources for the Saudi economy.

In a press release, PIF explained that The Mukaab was inspired by the modern Najdi architectural style, and would be the "world's first immersive destination offering an experience created by digital and virtual technology with the latest holographics". It added that the wider Murabba district would "be built around the concept of sustainability, featuring green areas and walking and cycling paths that will enhance quality of life"

The gaming industry in the Philippines isn't for everybody. In fact, the Gokongwei group had been offered a license by the Philippine Amusement and Gaming Corp. (Pagcor) more than a decade ago. It could have been the fifth integrated resort developer after Okada, Solaire, City of Dreams and Resorts World but Go said the group declined.

Today, NUSTAR boasts of the largest gaming floor in Southern Philippines and the largest convention center in the region. Find out why Robinsons Land Corporation boss Frederick Go decided to take the plunge.

In 1844, the Philippines Skipped a Day, And It Took Decades for the Rest of the World to Notice.

European explorers who approached the Pacific Ocean by sailing to the east such as the Portuguese, and in their wake the Dutch, the English, and the French, naturally kept their ship's journals and diaries according to the day count of their homeland and this was of course also adopted by the colonists who settled along the Asian perimeter of the Pacific Ocean.

However, the colonization of the Pacific Ocean by the Spanish occurred from the opposite direction and more specifically from the Spanish possessions in America. Ferdinand Magellan landed at the Philippine archipelago in March 1521 and Spanish dominion over the islands was first firmly established in 1565 by Miguel López de Legazpi (c. 1510 – 1572), the conquistador and first Spanish governor-general of the Philippines....

Most of the shipping from the Philippines to Spain went over the Pacific Ocean to the Mexican port of Acapulco, was transported overland to the port of Veracruz, and then shipped to Spain. In order that the Spanish ships crossing the Pacific Ocean between the Philippines and the Spanish Americas would not have to adjust the dates in their journals whenever they sighted land, the Philippines observed the same day count as that of the Spanish Americas....

During the early 1840s, the commercial interests of the Philippine Islands turned more and more away from the Spanish Americas (which for a large part had severed their relations with the motherland Spain) and trading with the Chinese mainland (engendered by the ignominious but lucrative 'Opium Wars'), the Malay peninsula, the Dutch East Indies and Australia became increasingly important.

In order to facilitate communication and trading with its western and southern Neighbours, the secular and religious authorities of the Philippines agreed that it would be advantageous to abolish the American day reckoning and adopt the Asian day reckoning.

This was achieved in 1844 when Narciso Claveria, the governor-general of the Philippines, issued a proclamation announcing that Monday, 30 December 1844, was to be immediately followed by Wednesday, 1 January 1845.

To catch up, the Philippines had to skip a day. This was well before the International Date Line was officially established, and some cartographers had no idea the islands had made the switch. For decades, they put the Philippines on the wrong date.

Countries have shifted over the International Date Line only a few times since the it was established in 1884. In 1993, one atoll of the Marshall Islands flipped to the Asian side of the date line, skipping a Saturday in August. And, most recently, in 2011, Samoa and Tokelau made the same switch.

Samoa had actually switched once before. In 1892, American trading partners convinced the king to flip to their side of the date line, and the country lived through July 4, 1892 twice. But 119 years later, the economic geography of the island had changed, and most businesses was being done with Australia and New Zealand. To make the jump back to the Asian date Samoa and Tokelau skipped Dec. 30, 2011.

Bohol Latest News / Bohol Extreme Outdoor Sports

Bohol teams jockey for enduro
honors at BtB '3x80' epic race

TAGBILARAN CITY, Bohol, April 30 2022 (PIA) –In an epic three-man-race that signaled Bohol's opening to extreme outdoor sports activities after the Coronavirus disease lockdowns, Bohol's top cycling teams jockeyed for superiority, and to top it all, teams composed of members from other elite teams to seek for the perfect triad proved Bohol's promise in competitive outdoor cycling.

Bohol's elite cycling club Paseo de Loon/ Concept Racing Team continues to wave its pennant of superiority in endurance mountain biking when its three-man team of cyclists crossed the finish line first after a grueling 65 kilometers of epic racing Sunday, April 24.

Yet collaborating with another elite and leading triathlon team in Bohol: TriBohol, Paseo de Loon also claimed the last podium honors in a race participated in by 165 mountain bikers all over Bohol.

The team of Nicho Lumay, John Mark Ackman and Alpris Pajo crawled up the wave carved embankment after carefully completing a 5.5 kilometer maze of rubber-tearing coral stone garden trail over the historic Maribojoc uplift, and basked in the applause of friends and supporters to be hailed champions in the Bike Ta Bail 3x80 adventure race of epic mountain biking in 2022.

The trio bearing race numbers 001 clocked 4:44:32, some sex minutes ahead of their closest rival team of United Sagbayan Cyclists (USC) composed of Roberto Saniel, Archie Enad and Nicole Joshua Gambe, in race numbers 007.

The Sagbayan team trio finished the same distance at 4:50:18.
A race that relies on team work, coordination and cooperation as well as the capacity to be self-sufficient in the trail that includes stretches of isolated forest trails, the BtB 3x80 is the second edition of the toughest endurance mountain biking race that demands an excellent realtime reading of a computer fed route where a wrong turn can mean precious minutes of lost time.

Meanwhile, TriBohol's Butchie Zamora teamed with Paseo de Loon's promising riders Ruel Bryan Orcullo and Deven Valderosa for race number 002, claimed the third spot in the three tiered podium, finishing the route in 05:09:367, after the Sagbayan cyclists.

Tagbilaran City's CycloTribe trio of Julius Quilario, Paul Karlo Cericos and Glenn Lopez, in race number 005 checked in 3 minutes later, the team thankful after completing a draining 5:12:27 or continuous pedaling.

The city cyclists finished fourth.

Two minutes off their last man's second wheels were cyclists from Duero based Ako Ikaw Way Asawa  (AIWA) with cyclists Joseph Bobby Felisarta, Christopher Gultiano and Ariel Angelo Mapalo to register their team as the fifth to finish.

Also putting their strong contention was a CycloTribe team in a different name: Cycling Squad, running with race number 009 is Rhoel Solarte, Aldwin Adora and Gian Rolando Romarate.

These riders clocked in at 6:13:19 for the sixth finish.

But the most nail-biting and saddle-dropping finish was the sprinting finishes by Sikad Maribocjanon's (SIKMA) race number 23 with Marjun Hibaya, Regino Pacifico Antasuda and Resty Porlares against USC Team 2 with Austine Joseph Labuga, Melchor Gambe and Aster Bitang.

Battling for the seventh place finish, the six riders were head to head where a team can only officially finish as soon as the last man crosses the painted line.

Keeping their contenders at a visual distance, both teams have earned the respect and admiration of the opposing team, each eyeing the moment one team mounts the attack.

In the sharp-coralstone strewn trail in the dash to the finish, it took the team from SIKMA some 8 seconds edge to finish at 6:36:25 while USC team two at its heels for 6:36:33 to settle for eighth.

Antequera-based Brotherhood Engaged in Environmental Rides Bringing Oneness and Genuine Satisfaction (B.E.E.R.B.O.G.S) - Antequera, Bohol Cycling Club in race number 035 with top cyclists Mario Nilo Lawag, Miguel Angelo Taga-amo and Neil Lloyd Lawag came in three mintes later to clock 6:39:34 while on the tenth place is Pedal Brothers' Marcelo Sague, Christopher Ruiz and Jervis Marimon clocking in at 6:40:15.

The race's youngest rider; Austine Joseph Labuga at 17, finished with his team USC in sixth while the oldest biker; Emmanuel Galab at 61, finished 23rd.

Of the 55 teams which competed the grueling race that featured an elevation gain of over a thousand meters above sea level and a sauntering 400 meter climb in less than 4 kilometers, only 53 teams finished the race. (rahc/PIA-7/Bohol)

NO OUTSIDE HELP. A race where an outside help for the participants can mean disqualification, the epic 3x80 is Bike ta Bai's latest endurance cross-country race that separated the boys from the men in the local mountain biking scene. (bTb PIABohol)

From Living Word IT Park, Cebu
This week's prayer focus will be for the Unreached People Group: Mongallese Arab in South Sudan

From the JOSHUA PROJECT:
- Pray that gospel recordings, Bibles, Christian broadcasts and other literature will become easily available in Bimbashi Arabic for the Mongollese.
- Ask the Lord to call people who are willing to go to South Sudan and share Christ with these Muslims until they have their own Christ-ward movement.
- Pray that the Christians of South Sudan will be compelled to take the gospel to their unreached neighbors, including the Mongollese.
- Ask the Lord to raise up Christian medical teams to work among the Mongollese and other Arabized tribes.

We encourage everyone to join us in-person or to keep this in prayer wherever you are.

Our weekly prayer meeting is held every Friday, 6 PM, at our new sanctuary in Skyrise 1.

"...praying at all times in the Spirit, with all prayer and supplication. To that end keep alert with all perseverance, making supplication for all the saints..." (Ephesians 6:18)

THE POWER OF READING

Did you know that successful people at the top level are readers ?

1. Mark Zuckerberg.

They will tell you about Mark and Facebook but they would not tell you about his habits of reading.
Mark reads a book in a week and that's equivalent to 50 books in a year.

2. Ben Carson.

They will tell you how magical Ben is but they would not tell you what made him great.
He reads books since a child. From being a "F" student to an "A" through reading his mum put away the TV just to allow him and his siblings to concentrate on reading.

3. Mark Cuban.

They will tell you about the riches Mark Cuban is but without telling you about how he arrived there.

He is also a great reader.

3. Oprah winfrey.

They will point out to you how influencial oprah is without letting you know how she gets there.

She is a greater reader.
In one of her interviews, she said that reading is the path to freedom and reading books gave her the possibility to move forward and achieve more in life.

3. Barack Obama.

Don't you know that barack is the only great leader who modernized African Americans ?
Well he learned many things from books.
Reading makes him great.

4. Warren buffet.

" To become a rich, find yourself a book. Value-added books ".
Sure buffet reads 5-6 hours a day.
What is his annual income ?
Books help accrued his wealth.

5. Elon Musk.

Is elon a scientist ?
No. He built a spaceship and satellites by reading and learning.
He reads a lot of books.
He also reads 5-6 hrs a day.
Imagine reading the whole day ?

6. Bill Gates.

The former Microsoft CEO is a great reader.
He reads one book a week. That's equivalent to 50 books in a year.

There are thousands of people who made it through books.

" Book is the ticket to anywhere and anything ".

Now that we realize what make people great, we should read a lot of books.

Instead of copying successful people's lifestyle better focus on their life story.

Anonymous Diary Blog / Success is Revenge
February 18, 2023, 07:30:46 AM
"OUR SUCCESS IS OUR REVENGE"

Multi-awarded filmmaker Atty. Vince Tañada is advising actor Johnrey Rivas to ignore persons who don't appreciate the success that he is enjoying after the latter shared a 'feeling sarcastic' message to unnamed individuals who seemingly wants to pull him down.

Tañada was reacting to Rivas' Facebook post on February 15, 2023 where he bared his grievances:

"Don't give them the access to hurt you." Kaya ayun sinisiraan ka," said Rivas.

"Isa lang masasabi ko, Hindi ko rin alam kung bakit ko nararanasan lahat ng meron ako ngayon.  Pero isa lang ang maipagyayabang ko- "Mag harap harap tayo, Pagkatao sa pagkatao, Mata sa mata. Suntukan ng pag uugali at sampalan ng Talento. Hindi kita aatrasan, Ipagdarasal ko pa kayo," he said. "Tandaan: Ang paghihiganti lalong lalo na kung walang basehan at hindi para sa kabutihan, Walang patutunguhan."

Rivas' posts elicited various comments of support from the online community and fellow artists including his mentor Tañada, who said under the comment section: "Our success is our revenge. Wag ng pansinin."

Rivas is set to star in Tañada's upcoming musical film 'Ako Si Ninoy' which depicts the life story of former Senator Ninoy Aquino portrayed by actor/singer JK Labajo.

Prior to ASN, Rivas also appeared in Tañada's Martial Law musical movie 'Katips' where the former won a best supporting actor award and the latter bagged the best picture, best director and best actor awards during the 70th annual awards of The Filipino Academy of Movie Arts and Sciences (FAMAS) in August 2022. Anonymous Diary Blog / Inability to Work with Others
February 18, 2023, 07:30:02 AM
The inability to work with others, the inability to share his plans, was the
greatest handicap from which Tesla suffered. It completely isolated him from therest of the intellectual structure of his time and caused the world to lose a vastamount of creative thought which he was unable to translate into completeinventions. It is a duty of a master to train pupils who will carry on after him—but Tesla refused to accept this  responsibility. Had Tesla, in his most activeperiod, associated with him a half-dozen brilliant young scientists, they wouldhave been in a position to link him with the engineering and scientific worldsfrom which, despite his eminence and his outstanding accomplishments, he wasto a great extent isolated because of his unusual personal characteristics. Hisfame was so secure that the success of his assistants could not have detractedfrom it; but the master would have shone more brightly in the brilliantaccomplishments of his pupils. He might well have attracted some practicalyoung men who could have aided him by assuming the burden of makingpractical application of some of the minor but important inventions from whichhe could have earned sufficient profit to pay the cost of maintaining hislaboratories. Many scores of important inventions have undoubtedly been lost tothe world because of Tesla's intellectual hermit characteristics. Undoubtedly, heindirectly inspired many young men to become inventors.

Inspiration & Hope / No suffering goes to waste
February 18, 2023, 07:26:59 AM
No suffering goes to waste in the good plans of our sovereign God.

We see glimpses of this truth through the surprising number of prison stories recorded in the Bible. From Genesis to Revelation, God's people are thrown into dark dungeons, locked behind closed doors, and exiled to remote lands. Some of these individuals endured by trusting the Lord; others wavered in their faith. All of them leave valuable lessons about God's purposes for the trials that we face in this life.

13 Things Mentally Strong People Don't Do

1.Mentally Strong People Don't Worry About Pleasing Everyone

Pleasing everyone can negatively impact mental strength.

When you accept you won't please everyone, you become stronger and build courage when you anticipate displeasing others.

2.They Don't Feel the World Owes Them Anything

Mentally strong people can shift their focus away from their debt. Hence, they can help people in need. Mentally strong people keep themselves busy doing good deeds.

3.They Don't Waste Time Feeling Sorry for Themselves

No one is immune to hard times. However, it is how you react to these situations that is important. They replace self-pity with gratitude.

4.They Don't Resent Other People's Success

Overcome your envy of other people's success and learn how to use their success to your benefit.

When people enjoy and celebrate success, they attract other successful people, creating opportunities for collaboration success.

5.They Don't Give Away Their Power

No one should have power over your feelings.

One of the biggest factors in taking control of your feelings is forgiveness. When people forgive others, their blood pressure decreases, and their hearts beat more calmly.

6.They Don't Focus on Things Beyond Their Control

Remember you can't control what has happened. However, you can control what you focus on, what things mean, and how you behave.

7.They Don't Dwell on the Past

Coming to terms with the past doesn't mean acting as if certain things never happened.

You must accept and forgive the past so that you can build on it in the present.

8.They Don't Repeat The Same Mistakes

Identify the factors that led to the mistake:
thoughts, behaviors, and external factors.

Then, write an alternative action for the next time those thoughts, behaviors, and external factors arise.

9.They Don't Shy Away from Change

It's not as if some people have more willpower than others. It's just that some people are willing to adapt while others aren't.

10.They Don't Fear Taking Calculated Risks

Taking risks and stepping outside your comfort zone makes you stronger. Perhaps those risks aren't as scary as you once imagined.  Open yourself up to new opportunities and start facing your fears.

11.They Don't Give up After Their First Failure

Those who succeed view their failures as stepping stones for improvement.

Failure is simply a part of success, as it means you are being challenged.

12.They Don't Fear Alone Time

Spending time alone and quietly, results in renewal, rejuvenation, inspiration, and reflection.

Meditation positively alters the brain's structure by regulating cognition and emotion.

13.They Don't Expect Immediate Results

It is important to be patient, stick to your goal, and keep working at it. You must maintain these actions even when you do not appreciate any progress at a given moment.

Seriously Top 15 life lessons I'm glad I learned at 21 and not 41:

1. You need to start

This is your only life.

It's too short to keep putting off doing what you want to do

Live your life for you - not anyone else.

2. Your environment is crucial

Regardless of how disciplined or motivated you are
If you're in the wrong environment you'll never get anything done.

3. Be ready to pivot

Things change, plans fall through and life happens

Be ready and willing to pivot when chasing your goals according to what feedback you're getting.

4. Books are mental masturbation

I love reading, I love learning.

But too much reading and not enough doing is just like binge-watching Youtube.

Read, apply, repeat

5. You need to be selfish

You can't pour from an empty cup.

So be selfish, fill your cup first and then you can be selfless and pour into others.

6. The gym is preparation

In the gym, your mind is telling you to quit the whole time.

By not quitting, you're building your mental fortitude and resilience in preparation for life.

7. You can't stop learning

The moment you stop learning, you stop progressing.

Acquire new knowledge, learn new skills, apply, progress, repeat.

8. Not everyone wants you to win

Learn to recognise those that truly want the best for you and those who don't.

Cut the latter out.

9. Risk is a part of life

Whether you're taking a new job, starting your own business or moving country

Anything that has the potential to improve your life involves risk

Embrace it.

10. Challenge your beliefs

Why do you believe something? Because your parents told you? Because the news told you?

Challenge what you believe, be willing to listen to opposing opinions and always be ready to learn.

11. Money can buy happiness

Money can buy you time freedom, location freedom and most importantly

The opportunity to do what actually makes you happy.

12. You need discomfort

Whether it's physical discomfort in the gym or mental discomfort when chasing your goals

Embracing discomfort is the key to long-term fulfilment.

13. Nobody knows what they're doing

No, really.

Nobody has it all figured out, everyone is just blindly taking a step in what is hopefully the right direction.

14. Failure isn't final

Failure is nothing but a sign telling you which direction not to go.

Stop treating it like a never-ending red light.

15. Consistency always wins

Talented but not consistent? You'll fail.

Hard-working but not consistent? You'll fail.

So long as you have consistency - you'll win (eventually)

Inspiration & Hope / Happiest Man on Earth
February 17, 2023, 07:18:06 AM
6 LESSONS FROM THE HAPPIEST MAN ON EARTH

1. There are many things more precious than money

It is easy to be enslaved by the mindset that money is the most imperative treasure in society. Money is always transient, just like most things in life. It comes and goes, but how much are you willing to pay for the fleeting pleasure? The consequences of a money-mentality are much more damaging than the value of money itself. Are you willing to put your mental, emotional, and physical well-being on the line? There are things more precious than money. Here are a few:
-Experiences
-Genuine connections
-A feeling of purpose
-Genuine concern for helping others
-Eddie says, "there are many things in this world that no amount of money will buy you, and some things are priceless beyond measure."

2. Weakness can be turned into hatred

Weak people lack the ability to maintain any level of emotional intelligence. People who lack emotional intelligence and a strong sense of self are easily influenced to hate. Their values and convictions are not based on strong foundations; rather, they are proponents of radical causes. Hatred is a disease that consumes the human mind to the point of no return, causing significant harm to oneself and others.

"If enough people had stood up then come on Kristallnacht, and said, 'enough what are you doing? What is wrong with you?' then the course of history would have been different. but they did not. they were scared they were weak, and their weakness allowed them to be manipulated into hatred " — Eddie Jaku

3. Tomorrow will come if you survive. one step at a time

The majority of people give up because they feel the suffering will never end. They relinquish control because their vision is clouded by minor inconveniences rather than the bigger picture.

"The closer you get to something, the blurrier it gets," as the saying goes. Be well-rounded, logical, and foresighted. Nothing on it has the word "forever" written on it.

4. You can find kindness everywhere, even from strangers

If you take a step out of your own world for even a moment, you will notice that you are not alone. The most serious problem is that we cannot talk freely about ourselves, our lives, and our issues. You are not alone in the universe. There are people who would happily assist you if you were willing to be vulnerable.

5. One good friend

"The greatest thing you will ever do is be loved by another person" — repeat this sentence until you realise that love and friendship are the best medicine.

I cannot emphasise this enough, especially to young people. Without friendship, a human being is lost. A friend is someone who reminds you to feel alive.

6. Education is a lifesaver

I do not mean formal education when I use the word "education". Yes, formal education is fantastic and brings great opportunities, but life education is much more critical. Understanding the laws of human nature, being mindful of worldviews, and knowing how to connect so that your voice is heard are all examples of life education. To be self-sufficient and not depend on others for a good life.

You may not be able to change the world because it is beyond your power, but you can change yourself. Change is possible, despite what you can believe, but it requires discipline.

A thought experiment.
The premise:
1. Microsoft is integrating the ChatGPT chatbot AI into its Bing search engine.
2. Google is integrating the Bard chatbot AI into its Google search engine.
3. Both AI tools can receive complex conversational prompts and provide detailed and sophisticated responses that look like they were written by a human.
4. Both tools will be able to access current Internet data along with the data on which they were trained.
The experiment:
A. Set up two computers that can share their web content with each other. Both computers are online with high bandwidth connections to the Internet.
B. Open Microsoft Bing with ChatGPT on one computer, and Google with Bard on the other computer.
C. Provide prompts to each computer so that one initiates a request for a response from the other, and then let them "talk" to one another.
D. Be sure the initial prompt results in the two computers communicating with one another in the way that we do now when we are using or experimenting with ChatGPT.

How long will they go on?
Will their content be added back into the dataset of the Internet?
If not, can their content be posted concurrently with the "conversation" between the two computers to a blog, so that the two computers can "see" each other's responses.

I am hoping someone with more technical skills (and computers) than I have will try something along these lines.

Ex-Biliran mayor gets 10 years for graft
News Release
MANILA, Philippines — The Sandiganbayan has sentenced a former municipal mayor in Biliran to up to 10 years in prison in connection with a supply contract for medicine worth P8 million.

In a 125-page decision promulgated recently, the anti-graft court's Third Division found Noel Albelda, former mayor of Maripipi, and nine other former municipal officials guilty of violating Republic Act 3019 or the Anti-Graft and Corrupt Practices Act.

Aside from the prison term, the defendants were disqualified from holding public office.

Filed by the Office of the Ombudsman in 2018, the case stemmed from the municipal government's awarding of a contract to private firm Suremeds for the supply of medicine and other medical equipment amounting to P7.99 million despite supposed irregularities.

US OPEN CHAMPIONS!!!

Message from Earl Strictland:

Efren Reyes and I did challenge games with the patrons that came out to see Efren and myself. We played a race to seven 10-ball, I was anxious to see Efren play because haven't seen him play in person for a long time. Was curious to see how his nerves were. I won 7-3 it was just a short match, I thought Efren out played me and lost. He keep running down to the 6 , 7 , 8 , 9 and he would miss after making a tough out to get there. Efren pocketed more pool balls than I did and lost. He still looked good in spots, but just like me his nerves take over at times and we miss, of course it happens to all pool players. It was great to see Efren, and watch him figure out how to play his shots. One shot he played a Carom through a ball from the middle of the table. I wish we could play offensive straight pool or placement pool, something that would allow Efren and myself to compete.
The way nine ball is now, they have a jump stick, magic rack and players are slow and lucky the players today are cheap champions. Efren and I did'nt play this kind of pool, and we can't compete like this . He and I can still play, in a different format. Efren and I want to thank all the fans in pool it is you that keeps this great game alive and people that don't play pool are fools.

The fund was sourced from tariffs collected from the implementation of the Rice Tariffication Law (RTL), also known as Republic Act 11203.

Marcos recommended that farmers nationwide should be given financial assistance until 2024.

The senator will also oversee the distribution of Php 3 million to victims of a fire last January 28 in barangays Habog and San Juan in Iloilo City, with 300 families to receive Php10,000 each.

Hardware and Gadgets / The Future of Solar Power
February 13, 2023, 07:56:04 PM
MIT engineers have developed ultralight fabric solar cells that can quickly and easily turn any surface into a power source.

These durable, flexible solar cells, which are much thinner than a human hair, are glued to a strong, lightweight fabric, making them easy to install on a fixed surface. They can provide energy on the go as a wearable power fabric or be transported and rapidly deployed in remote locations for assistance in emergencies. They are one-hundredth the weight of conventional solar panels, generate 18 times more power-per-kilogram, and are made from semiconducting inks using printing processes that can be scaled in the future to large-area manufacturing.

Anonymous Diary Blog / Anger, resentment and jealousy
February 13, 2023, 05:35:12 AM
You know that person you are mad at right now - the person who has tweaked your sanity?
What if that person was suddenly taken away? Would you be ok, or would you spend the rest of your life regretting you didn't make amends?
If it is the latter, perhaps the anger you are holding needs to be replaced with love because some moments you just don't get back.
And while it is true there are things better left unsaid (especially the ugly things) unspoken feelings create all kinds of problems (inside out).
And there is nothing heroic or powerful about being mad at someone.
Here today, gone tomorrow- such is life- but having a clear and loving heart is better than living in regret.
Seize your moment, don't let it slip away.
Go clean and clear, without guilt - "should haves" are gut killers.
And no matter what you decide - you may wonder if you should have done something different- but wonder is ok, normal and human however, beating yourself up is not.

THIRD DIVISION
[ G.R. No. 116524. January 18, 1996 ]
PEOPLE OF THE PHILIPPINES, PLAINTIFF-APPELLEE, VS. LYNDON FLORES Y MALARAYAP, ACCUSED-APPELLANT.

D E C I S I O N
MELO, J.:

Charged with murder in an Information reading as follows:
That on or about the 20th day of June 1993, at around 12:00 o'clock noon, in barangay Malusak, Municipality of Boac, Province of Marinduque, Philippines, and within the jurisdiction of this Honorable Court, the above-named accused, did then and there, wilfully, unlawfully and feloniously, with deliberate intent to kill, and with treachery, assault, attack, maim and violently kick the vital parts of the body of one Manuel Lazarte y Malvar, while he was lying dead-drunk and unconscious on the pavement, inflicting upon him the following fatal injuries:

Ruptured Small Intestine (jejunum) with spillage of the Intestinal content In trap er iton eally

Cause of Death:

Ruptured Viscus, allegedly secondary to mauling

(p. 3, Rollo.)
Lyndon Flores, upon arraignment, entered a plea of not guilty, and after trial on the merits, he was found guilty by the court a quo in a decision which accordingly disposed:
In view of the above observations and findings, this Court found Lyndon Flores y Malarayap guilty beyond reasonable doubt of the crime of Murder without any mitigating nor aggravating circumstance attendant to its commission.

Under the rule on application of penalty and as enunciated in People vs. Muñoz, et al., G.R. No. L- 38969-70, February 9, 1989, 170 SCRA 107, reiterated in People vs. Sadia, Jr., G.R. No. 92633, Oct. 17, 1991, 203 SCRA 62-71, the proper penalty imposable is reclusion perpetua.  Hence, Lyndon Flores y Malarayap is hereby sentenced to suffer the penalty of RECLUSION PERPETUA together with the accessory penalty thereof (People vs. Penilles, et a!., G.R. No. 65673, 30 Jan. 1992; People vs. Catubig, G.R. No. 89732, Jan. 31, 1992).

The accused shall be credited with the full extent of his preventive imprisonment in accordance with the provision of the Revised Penal Code.

The accused is hereby ordered to pay the heirs of the victim the sum of P50,000.00 as and for death indemnity; the further sum of P30,000.00 for hospitalization and medicines and for the coffin and burial of Manuel Lazarte.

The body of the accused is hereby committed to the custody of the Director of Prisons, National Penitentiary, Muntinlupa, Metro Manila, thru the Provincial Jail Warden of Marinduque.

Let the mittimus be prepared for the accused's immediate commitment.

(p. 25, RoIlo.)
From said decision, the instant present appeal has been interposed, with accused-appellant putting up the general allegations or, shot-gun type of arguments that the trial court erred in finding him guilty of murder instead of simple homicide.  In consequence, accused-appellant submits that the trial court erred when it imposed the penalty of reclusion perpetua. We find no merit in the first argument.  With regard to the second argument, we sustain accused-appellant but on the basis of grounds other than those he proffers. But first to the background facts which were capsulized by the trial court in this wise:
Cesar Lanot pointed to the accused who is in court and declared that at 12:00 noon of June 20, 1993, while he was at the ground floor of their residence he saw Manuel Lazarte alias Ato being kicked by Lyndon Flores alias Jojo (accused).  Ato was then opposite Rustico Malvar's house lying on the pavement seven arms length from him dead drunk. Thereafter, Ato Lazarte was brought to the hospital.

He explained that the accused hit Ato Lazarte at his stomach twice with the use of the right foot with Topsider leather shoes.

He relayed that on that noon Ato's mother Emperatriz Lazarte had an altercation with the accused due to a cassette belonging to the former.  He was attracted by a commotion outside prompting him to go out so he saw Lyndon kicking Manuel Lazarte who had been lying on the pavement five (5) minutes before the kicking.

Of the persons present around he can remember only Popong Mendoza, Taba, whose exact name he does not know and Lydia Vargas.  Thereafter, Ato Lazarte was brought to the hospital where he died two days after the incident.  He even dissuaded Jojo, saying "that is enough because Manuel will not fight back as he remained lying," thereafter Flores left A to.

Dr. Dante Osmillo of the Marinduque Provincial Hospital attended to Manuel Lazarte on June 20, 1993 identifying Exh. B, explaining that there was no swelling nor abrasion but found tenderness at the epigastric area. The exploration of the intestine was done by Dr. Edgardo Mar quez (Exh. B-2) without his assistance.

That at the time of admission the patient Manuel Lazarte was positive of alcoholic breath complaining of epigastric pain.  He did not see any abnormal physical appearance and no sign of external illness.  The whole body appeared to be normal.  However, in the afternoon of June 21, the victim complained of epigastric pain such that believing it to be merely gas pain he gave medicine for such.  He endorsed the patient normally to another physician (Dr. Sevilla) there being no alarming sign and symptom.

Alfredo Alvarez declared that at 12:00 noon of June 20, 1993 after hearing a commotion outside their residence at Malvar and Madrigal Streets, Boac, Marinduque he went out and found Emperatriz Lazarte arguing with Lyndon Flores.  Later he saw Lyndon kick Manuel Lazarte who was lying on the pavement dead drunk in front of Malvar's residence about 4 arms length away from him.  Flores hit Lazarte three times at the breast and stomach with Lyndon's left and right feet wearing leather shoes. Chic-Chic, Lyndon's companion, held Manuel's breast shirt, slapped Manuel and dropped him.  That it was Cesar Lanot who first pacified Lyndon while Chic-Chic was just looking.  Police arrived and together with others carried (inusong) Ato upstairs of their residence, after which he went to the cockpit and did not know anything that transpired.

He described that the kicking was by dropping the feet on the stomach, first by the right foot which landed on the chest while the second and third at the stomach.  He did not hear anything from Manuel Lazarte.

Emperatriz Lazarte, mother of the victim, claimed that at 12:00 noon on 20 June 1993 while watering her plants she saw people outside their residence with her son lying prostrate on the pavement but did not know why.  She saw the accused Lyndon looking straight to her rubbing his hands. She recalled having lost her cassette and was able to trace it at Salvo's Pawnshop pawned by the accused in his name.  When Mrs. Salvo refused to give it back she redeemed it for P20.00 and instructed Mrs. Salvo to inform anybody who will complain to see her.  Confronting the accused, exchange of words ensued which made Lyndon mad. Accused Lyndon turned to her son and kicked him three times then pulled him by the shirt lifting his son then left him fall.  She got nervous because she heard the head hit the pavement.  The accused was with other man, one of whom was a certain

Chic-Chic. That the accused was pacified by Cesar Lanot up to the time her son was brought to her residence.  Ato Lazarte was brought to the hospital that Sunday afternoon and died in the evening of the following day, Monday.

That the victim was married with six children.  She allegedly spent P30,000.00 for the hospital, coffin, church and medicines.

Her son has no permanent occupation but earns.  That the victim was not suffering from any illness before the death but did not know why he was lying on the pavement that day.

Dr. Edgardo Marquez was consulted on June 21, 1993 to evaluate Manuel's condition whose abdomen was distended and tender.  There was no clear hematoma on the abdomen. X-ray showed presence of air intra-abdominally.  Suspecting that there was ruptured viscus, they operated on and found ruptured intestines, duodenum, with two (2) ruptured areas intra-abdominally with the abdomen bloody (chocolate color) with alcoholic contents.  He opined that it must have been caused by a strong blow, like repeated kicking on the abdomen.  Before the surgery the patient can communicate.  The proximate cause of loss of fluid was intestinal Infection. He did not find any ulcer on the small intestines since there was no perforation.  However, the ruptures appeared to be about 2 or 3 days but there was no abscess.

(pp. 1-5, Decision; pp. 14-18, Rollo.)
Accused-appellant denies having kicked the victim.  He asserts that he merely touched, with his right foot, the victim who was lying dead drunk on the pavement to wake him up so that the victim could explain the circumstances of the loss of Emperatriz Lazarte's cassette recorder. Emperatriz imputed to accused-appellant the loss of her cassette recorder which she eventually found in a pawnshop from where she redeemed it.  Accused-appellant insists that it was the victim Manuel Lazarte who pawned the cassette recorder and so he was trying to wake up the victim so that the latter could inform his mother that it was he who pawned the cassette recorder.

Accused-appellant's denial that he kicked the victim runs counter to the evidence on record. Prosecution witness Cesar Lanot categorically testified that accused-appellant kicked the victim in the belly, thusly:

(pp. 14-16, tsn., Oct. 7, 1993)
    (pp. 10-12, Appellee's Brief; p. 70, Rollo.)
There is no reason to doubt the credibility of these prosecution witnesses and the veracity of their testimony. Their statements are not tainted with any contradiction, inconsistency, or prevarication.  As the trial court observed, witnesses testified in a candid, categorical, and consistent manner, lending much credibility to their declarations and making their testimony deserving of full faith and credit (People vs. Barte, 230 SCRA 401 [1994]).

Likewise, there being nothing on the record to show that said witnesses were actuated by any improper motive, their testimony shall be entitled to full faith and credit (People vs. Dela Cruz, 229 SCRA 754 [1994]).  Moreover, it is settled that when the credibility of witnesses is at issue, appellate courts will not disturb the findings of the trial court, the latter being in a better position to decide the question, having heard the witnesses and observed their deportment and manner of testifying during the trial, unless certain facts of substance and value had been overlooked which, if considered, might affect the result of the case (People vs. Gomes, 230 SCRA 270 [1994]). Much as one way may scour the record, no such fact of substance or value seems to surface. Accused-appellant's denial is a feeble defense which cannot stand against the positive testimony of the eyewitnesses to the crime (People vs. Gomez, 229 SCRA 138 [1994]). The findings of fact of the trial court, therefore, stands.

The testimony of accused-appellant that he merely touched or nudged with his foot the victim as the victim was lying dead drunk on the pavement in order to wake him up so that he may explain to his mother the circumstances concerning the pawning of a cassette recorder is totally negated by the extent of the injuries suffered by the victim.  Had accused-appellant merely poked or nudged the victim with his foot, the latter would not have suffered any injury, much less deadly damage to internal organs. Verily, the foot jabs delivered by accused-appellant to the victim were more than nudges, but severe kicks which ruptured the intestines of the victim, later resulting in his death.  Dr. Edgardo Marquez, the attending physician, had this to say on the point:
Q.
Did you make any surgery?
A.
We had an impression that there is rupture of the viscus pre-operatively so, we did an emergency surgery, exploratory laparatomy on the patient.
Q.
What step was done next?
A.
We did an exploratory laparatomy and the operative findings are the following:
There is ruptured small intestines in particular the jejunum with two ruptured areas intra abdominally. The abdomen was filled with bloody chocolate colored fluid with alcoholic scent. The whole intestines are soaked with spilled intestinal contents.
Q.
What could have caused the ruptures viscus, Doctor?
A.
This was possibly caused by a very strong blow.
Q.
Could repeated kicks to the abdomen have caused the injuries?
A.
Possible, sir."

    (p. 4, Isn.,Dec. 3, 1993)
(pp. 12-13, Appellee's Brief; p. 70, Rollo.)
Accused-appellant's finally contends that the crime he committed is homicide and not murder.

Such contention is devoid of merit.  The evidence clearly establishes the fact that the victim was totally unconscious, dead drunk, lying on the pavement, when accused-appellant administered strong, vicious, and as borne out later, killing kicks at the belly of the victim. Totally unconscious at the time of the attack, the victim could not have put up any defense whatsoever against the sudden assault by the accused-appellant.  Unquestionably, the attack was characterized by treachery.  An attack upon an unconscious victim who could not have put up any defense whatsoever is treacherous.  There was absolutely no risk to accused-appellant from any defense that the victim might have made.  There is treachery when the offender commits any of the crimes against the person, employing means, methods or forms in the execution thereof which tends directly and specially to insure its execution, without risk to himself arising from the defense which the offended party may make (No. 16, Article 14, Revised Penal Code).

Nonetheless, we believe the trial court erred when it imposed the penalty of reclusion perpetua on accused-appellant.

Under Paragraph 1, Article 4 of the Revised Penal Code, criminal liability is incurred by any person committing a felony (delito) although the wrongful act done be different from that which he intended.  Thus, anyone who inflicts injuries voluntarily and with intent is liable for all the consequences of his criminal act, such as death that supervenes as a consequence of the injuries.  Here, accused-appellant is liable for the demise of the victim for such was caused by the violent kicks which he inflicted on the vital parts of the victim's body. And, as earlier discussed, since the assault was qualified by treachery the crime committed is murder and not homicide as suggested by accused-appellant.

However, the mitigating circumstance of lack of intent to commit so grave a wrong as that committed (Paragraph 3, Article 13, Revised Penal Code) should be appreciated in favor of accused-appellant for he had no intent to kill when he attacked the victim.  His intention was merely to inflict injuries on the victim.

Thus, the trial court erred in imposing the penalty of reclusion perpetua for it failed to appreciate the mitigating circumstance of lack of intent to commit so grave a wrong as that committed in favor of the accused-appellant.  Under Article 248 of the Revised Penal Code, the penalty for the crime of murder is reclusion temporal in its maximum period to death.  There being no aggravating circumstance to offset the mitigating circumstance of lack of intent to commit so grave a wrong as that committed, the imposable penalty is reclusion temporal in its maximum period, or 17 years, 4 months, and 1 day, to 20 years, the minimum of the penalty provided for by law (Paragraph 2, Article 64, Revised Penal Code).  Applying the Indeterminate Sentence Law, the penalty next lower in degree is prision mayor in its maximum period to reclusion temporal in its medium period or 10 years and 1 day of prision mayor to 17 years and 4 months of reclusion temporal (People vs. Espinosa, 243 SCRA 7 [1995] citing People vs. Roel Ponayo V Villanueva, G. R. No. 111523, August 10, 1994).

The Court is not unaware of the New Death Penalty Law (Republic Act No. 7659) which took effect on December 31, 1993 (People vs. David, 235 SCRA 366 [1994]), amending Article 248 of the Revised Penal Qode by increasing the imposable penalty for murder to reclusion perpetua to death.  But such amendment cannot be applied to the present case for the crime was committed on June 20, 1993, before the effectivity of the Republic Act No. 7659.

WHEREFORE, the decision appealed from is HEREBY AFFIRMED with the modification that accused-appellant IS HEREBY SENTENCED to an indeterminate prison term of ten (10) years and one (1) day of prision mayor, as minimum, to seventeen (17) years and four (4) months, and one (1) day of reclusion temporal (People vs. Sarol, 139 SCRA 125 [1985]), as maximum.

No special pronouncement is made as to costs.

SO ORDERED.

Philippine Laws / Felicidad Morales vs Julio Tarongoy
February 12, 2023, 07:41:42 PM
322 Phil. 1
EN BANC
[ A.M. No. P-94-1032. January 18, 1996 ]
FELICIDAD V. MORALES, PETITIONER, VS. JULIO G. TARONGOY, DEPUTY SHERIFF, REGIONAL TRIAL COURT, BRANCH 19, PAGADIAN CITY, ZAMBOANGA DEL SUR, RESPONDENT.

D E C I S I O N
PER CURIAM:

In a complaint, dated 09 March 1994, Felicidad V. Morales charged Deputy Sheriff Julio G. Tarongoy with Grave Misconduct and Violation of Republic Act No. 3019, also known as the Anti-Graft and Corrupt Practices Act, relative to the execution of a final judgment of the National Labor Relations Commission ("NLRC").

Complainant averred that, on 27 January 1992, a decision was rendered by the NLRC in Case No. RAB VII-0584-88 ("Felicidad V. Morales vs. Ever Cinema Theatre," etc.) ordering the employer to pay her and a fellow employee the amount of P190,254.00. Somehow, the judgment obligor managed to evade payment that prompted Labor Arbiter Dominador Almirante to issue an alias writ of execution ordering the Provincial Sheriff of the Regional Trial Court of Pagadian City, Zamboanga del Sur, to collect the sum adjudged by the NLRC or to satisfy the judgment by levying movable and immovable property of the employer not exempt from execution. Complainant alleged that she personally handcarried the writ of execution to Pagadian City. Respondent Sheriff demanded a P15,000.00 fee for the implementation of the writ. Since she had no cash on hand at the time, and in her eagerness to have the writ of execution promptly effected, she borrowed a portion of the sum demanded and gave it to the Sheriff.

Respondent Sheriff thereupon levied two parcels of real property owned by the employer. After the required publication and three days before the scheduled auction sale, respondent informed complainant that she would have to put up a bond because the property levied were mortgaged with a bank. She then questioned respondent for making a levy on the mortgaged assets despite the fact that there were eleven other parcels of land registered in the name of the employer which were not similarly encumbered.

In its resolution of 25 May 1994, the Court required respondent Sheriff to comment on the complaint. Respondent failed to comply. In the Court's resolution of 20 February 1995, respondent was required to show cause why he should not be disciplinarily dealt with for his having ignored the 25th May 1994 resolution of the Court and to submit within 10 days from notice his compliance with both directives. Again, the Court received no word from respondent Sheriff althpugh it would appear that the Court resolutions were duly sent and acknowledged. Respondent Sheriff personally received a copy of the 25th May 1994 resolution on 27 June 1994 while a copy of the 20th February 1995 resolution was received by his authorized agent, Branch 19 Stenographic Reporter Rebecca Sucaldito, on 07 March 1995.

In a memorandum, dated 16 October 1995, the Office of the Court Administrator, through Deputy Court Administrator Zenaida N. Elepaflo, evaluated the case, expressed its findings and recommended thusly:
"Respondent was given an opportunity to defend his side but he chose not to comply with two (2) court resolutions requiring him to submit his comment on the complaint despite proof that he personally received the resolution dated 25 May 1994 on 27 June 1994 while the resolution dated 20 February 1995 was received by his co-officemate Rebecca Sucaldito on 7 March 1995. With his actuations, he is deemed to have admitted the charges.

"It cannot be denied that expenses are incurred in the execution of writs. Under the law, sheriffs are allowed to collect Sheriff's fee in the implementation of the writ. The instant complaint would have been avoided had respondent Sheriff required the prevailing party (herein complainant) to submit to the court for approval the amount necessary (Bill of Costs) to enforce the writ.

"As to the charge of grave misconduct for levying two (2) parcels of land (TCT No. 9844 and 136736) of the defendant which were found to be mortgaged with Metrobank and PNB for P2,000,000.00 and P7,000,000.00, respectively, we find the charge to be meritorious. It is noted that the money judgment is only P190,000.00. Respondent should have verified the value of the real property levied and checked whether or not the same were free from any liens or encumbrances. If the market value of these real estate would only cover the mortgage loan, then the levy is useless. Moreover, it is now undisputed that there are other properties of the employer which were not levied upon by respondent. Respondent failed to discharge his duties with prudence, caution and attention.

"xxx        xxx     xxx

"In view of the foregoing, it is respectfully recommended that Deputy Sheriff Julio G. Tarongoy be SUSPENDED from office for three (3) months without pay, with warning that a repetition of the same or similar offense in the future will be severely dealt with."[1]
The records would also disclose that respondent Sheriff had once before been found remiss in the performance of his duties. In A.M. P-90-468, he was found guilty of negligence by the Court (through its Second Division)[2] and fined an amount equivalent to a month's salary with a warning that future infractions would be dealt with severely by the Court.

More than anything else, however, respondent Sheriff has continued to disregard the Court's resolutions, aforementioned, which not only can be indicative of guilt but is also a plain defiance that cannot be countenanced.

All considered, the Court is constrained to order the dismissal of respondent Sheriff from the service.

WHEREFORE, the Court finds respondent Sheriff guilty of Grave Misconduct and orders his DISMISSAL from the service with forfeiture of all benefits, including leave credits and retirement benefits, and with prejudice to re-employment in any branch or service of the government, including any government owned and controlled corporation.
SO ORDERED.

Philippine Laws / People vs Maximo Abrenica GR No. 118771
February 12, 2023, 07:39:54 PM
322 Phil. 53
THIRD DIVISION
[ G.R. No. 118771. January 18, 1996 ]
PEOPLE OF THE PHILIPPINES, PLAINTIFF-APPELLEE, VS. MAXIMO ABRENICA Y TEJANA, ACCUSED-APPELLANT.

D E C I S I O N
MELO, J.:

Maximo Abrenica was charged in two separate Informations for the murder of Reynaldo Mabisa y Ebonia on September 11, 1991, and for frustrated murder, also allegedly committed on the same day concerning the multiple gunshot wounds suffered by Ramiro Garcia y Lachica.

After joint trial, Branch 24 of the Regional Trial Court of the National Capital Region stationed in Manila and presided over by the Honorable Sergio D. Mabunay, found Abrenica guilty as charged in a decision dated January 21, 1994, but promulgated on February 3, 1994, the dispositive portion of which reads:

Because of the foregoing, the court finds that the prosecution has established beyond reasonable doubt the guilt of the accused for the two offenses for which he is charged. The court therefore finds the accused guilty beyond reasonable doubt of the offenses of Murder under Criminal Case No. 92-103650 and Frustrated Murder under Criminal Case No. 92-103651 and sentences the accused under Article 248 of the Revised Penal Code, to a penalty of Reclusion Perpetua in Criminal Case No. 92-103650. Applying the provisions of the Indeterminate Sentence Law in Criminal Case No. 92-103651, the Court sentences the accused to 6 years, 1 month and 11 days of Prision Mayor in its Medium period to 12 years, 5 months and 11 days of Reclusion Temporal in its Medium period and to pay P50,000,00 in Criminal Case No. 92-103650, to the heirs of the victim Reynaldo Mabisa by way of civil indemnity without subsidiary imprisonment in case of insolvency, and also to indemnify the complainant, Ramiro Garcia in Criminal Case No. 92-103651 in the amount of P30,000.00 for lost income for five months, by way of civil indemnity without subsidiary imprisonment in case of insolvency. In the service of his sentence in both cases, the accused should be credited with full period of his preventive imprisonment if he is entitled thereto under the provisions of the Revised Penal Code.

(p. 22, Rollo.)

Dissatisfied therewith, Abrenica has interposed the instant appeal, anchored on his arguments that the surviving witness gave conflicting testimony which should not have been given credence, and that consequently, the trial court erred in holding that said witness had positively identified accused-appellant as the assailant.

The facts of the case, as set forth by the trial court in its decision and as supported by the evidence, are as follows:

The principal prosecution witness was Ramiro Garcia who is the complainant in Criminal Case No. 2103651. He testified that he worked as a stevedore at Muelle de Ia Industria along the Pasig River in the City of Manila. On September 10, 1991, around 7:00 o'clock in the evening, he was on the barge "Martam III" which was docked near the terminal of Elizalde and Company, at San Pedro Guevarra St., Binondo, Metro Manila, working with other stevedores in the unloading of the cargo of the barge. They worked from 7:00 p.m. of September 10, 1991 to dawn of the following day. It was raining intermittently. When he went up to the top of the barge, accused Maximo Abrenica, pointed a gun at him and then fired the gun, and Ramiro Garcia was hit in the left chest. He fell down and the accused approached and shot him again, and he was hit on the left hand and upper lip. He lost his small finger when the accused fired the gun while the complainant was holding the barrel. The accused pushed him into the water and when he was already in the water, the accused kept on firing at him. The accused also shot "Yoyong," his co-stevedore. "Yoyong" was hit in the face and "Yoyong" fell into the barge. He saw the accused shoot "Yoyong" when he had already been shot and he was already down when the accused shot "Yoyong."

After being in the water for sometime, he got out after and he saw "Yoyong" already dead. He went home and from there, he was brought by his wife to the Philippine General Hospital where he was treated. He stayed at the hospital for four months. His wife paid for his hospital expenses. He was earning P260.00 a day as stevedore and he worked 6 days a week and his average monthly earning was around Six Thousand Two Hundred Forty Pesos a month. He was not able to work for about five months. The full name of "Yoyong" is Reynaldo Mabisa Ebonia.

(pp. 15-16, Rollo.)

Accused-appellant contends that the trial court erred in finding that Ramiro Garcia, the surviving victim, positively identified accused-appellant as the gunman. We quote in this regard, the pertinent testimony of Garcia, thusly:

Q.   Who was the person who poked a gun at you?

A.   There, sir. (witness pointed to a person inside the courtroom who identified himself as Maximo Abrenica).

xxx xxx xxx

Q.   What was the reason why the accused poked a gun at you?

A.   There was no reason why the accused poked a gun at me. He immediately fired a gun at me, sir.

Q.   Were you hit?

A.   Yes, sir.

xxx xxx xxx

Q.   Were you the only one who was shot by the accused?

A.   He shot also my co-stevedore, sir.

Q.   Who was shot first, you or alias Yoyong?

A.   He shot me first, sir.

xxx xxx xxx

Q.   Was Yoyong hit?

A.   He was hit on the face, sir,

xxx xxx xxx

Q.   Where is Yoyong now?

A.   He was brought to the morgue, sir.

Q.   He was already dead?

A.   Yes, sir.

Q.   And who shot alias Yoyong?

A.   There, sir. (witness pointing to a person who identified himself as Maximo Abrenica).

(pp. 9-14, TSN., June 15, 1992)

The foregoing testimony unavoidably drives one to the conclusion that prosecution witness Ramiro Garcia positively identified accused-appellant as the culprit. We cannot conceive of a more positive and categorical identification of accused-appellant than the testimony of Garcia. He definitely pointed to accused-appellant as the one who poked a gun at him; he unequivocally declared that accused-appellant, unprovoked, fired at him; he likewise pinpointed accused-appellant as the one who shot Yoyong -the other victim, Reynaldo Mabisa y Ebonia, who unfortunately did not survive the murderous and bloody assault of accused-appellant.

To denigrate the testimony of Garcia, accused-appellant adverts to some alleged inconsistencies in the testimony of said witness. Accused-appellant refers to the different names given by Garcia to the other victim, at one time calling him Yoyong and at other times, in his affidavit, calling him Rene.

The different names used by Garcia in referring to the other victim cannot be considered inconsistent to such a degree as to negate the acts of accused-appellant. Indisputedly, accused-appellant did shoot both Garcia and the other victim named Reynaldo Mabisa. Then too, a person may have or be known by several nicknames. To be sure, accused-appellant cannot be heard to properly and competently raise any issue as to the identity of Mabisa. Be he known as Yoyong or Rene, he is just as dead by the hand of accused-appellant.

Another purported inconsistency in the testimony of Garcia asserted by accused-appellant is that "he testified that he and his co-stevedores were working from around seven o'clock in the morning of September 10, 1991 until dawn of the following day, September 11, 1991 in around the premises of the port area unloading the cargoes from the Martam III, but he however contradicted himself when he testified later on that after the rains have stopped at around two o'clock in the morning of September 11, 1991, he and Yoyong were directed by their Kabo (Lito Flores) to unload the cargoes from the Martam III" (p. 19, Appellant's Brief).

We find no such inconsistency in the testimony of Garcia. When said witness declared that he and his fellow stevedores worked from seven o'clock in the morning of September 10, 1991 until dawn of the following day, he was merely referring to the entire period when he and his fellow stevedores were on duty to unload the cargo of Martam III. This period of almost 24 hours also covered the time they were idle and not actually working, due to the order to stop unloading because of the heavy rains.

Accused-appellant views as incredible the testimony of Garcia that he was able to swim safely to shore despite the gunshot wounds he suffered in his chest and his left hand. This argument must be peremptorily brushed aside, for surely, accused-appellant is not thereby suggesting that Garcia did not sustain any wound at all. Or could it be that accused-appellant is expressing surprise why Garcia survived, unlike Mabisa who did not live to testify against accused-appellant.

At any rate, the alleged inconsistencies noted by accused-appellant refer to collateral matters which do not impinge or detract from the main thrust of the testimony of Garcia that it was accused-appellant who shot him and Mabisa. Moreover, we have ruled that discrepancies between the affidavit of a witness and his testimony in court do not necessarily discredit him because it is a matter of judicial experience that affidavits taken ex parte are almost always incomplete and often inaccurate (People vs. Calegan, 233 SCRA 537 [1994]).

Finally, accused-appellant maintains that the delay of Garcia in lodging the criminal accusation impairs his credibility. We have held time and again that delay or vacillation in making a criminal accusation does not necessarily weaken the credibility of a witness where such delay is satisfactorily explained (People vs. Errojo, 229 SCRA 49 [1994]; People vs. Gornes, 230 SCRA 270 [1994]; People vs. Dèla Peña, 232 SCRA 72 [1994]). In the case at bench, it was but natural for Garcia to hesitate in immediately charging accused-appellant as the gunwielder for the simple reason that he personally knew that accused-appellant had homicidal tendencies, Garcia having been the object of accused-appellant's murderous attack. Considering the absence of evidence that Garcia was impelled by ill motives, his testimony shall thus be entitled to full faith and credit (People vs. Persiano, 233 SCRA 393 [1994]).

In view of the positive identification of accused-appellant as the perpetrator of the crimes charged, his denial and alibi that he was asleep in a nearby parked truck at the time of the incident are rendered futile and worthless. Positive identification prevails over denials and alibis (People vs. Cabuang, 217 SCRA 675 [1993]).

The killing of Reynaldo Mabisa and the wounding of Ramiro Garcia were unquestionably committed with treachery. Both Mabisa and Garcia were totally unaware of the murderous designs of accused-appellant. Immediately after the victims boarded the barge, accused-appellant suddenly, without warning, shot both Mabisa and Garcia pointblank, affording the victims no opportunity to put up any defense and without risk to himself whatsoever. There is treachery when the offender commits any of the crimes against the person, employing means, methods, or forms in the execution thereof which tend directly and specially to insure its execution, without risk to himself arising from the defense which the offended party might Make (No. 16, Article 14, Revised Penal Code). There is treachery when the victims were shot unexpectedly and were not in a position to defend themselves (People vs. Balanon, 233 SCRA 679 [1994]). Even a frontal attack is treacherous when it is sudden and unexpected and the victim was unarmed (People vs. Abapo, 239 SCRA 469 [1994]). The essence of treachery is a swift and unexpected attack on an unarmed victim without the slightest provocation on the part of the victim (People vs. Ponayo, 235 SCRA 226 [1994]). The evidence on record clearly shows that the attack on the victims was swift and unexpected, that they were unarmed, and that they did not commit the slightest provocation.

The presence of treachery qualifies the crimes perpetrated by accused-appellant as murder and frustrated murder.

In the determination of the penalty, the applicable legal provision is Article 248 of the Revised Penal Code. Although Article 248 has been amended by Republic Act No. 7659, said amendatory statute is not applicable because the offenses charged against and committed by accused-appellant were perpetuated on September 11, 1991, before Republic Act No. 7659 took effect on December 31, 1993 (People vs. David, 235 SCRA 366 [1994]).

In fine under the original provisions of Article 248 of Revised Penal Code, the prescribed penalty is Reclusion Temporal in its maximum period to death. There being no attendant aggravating or mitigating circumstances, the medium period, Reclusion Perpetua, is the penalty imposable upon accused-appellant for the crime of murder.

The trial court not having committed any of the error imputed to it, its decision must thus be affirmed.

WHEREFORE, the appealed decision is hereby AFFIRMED, without special pronouncement as to costs.

SO ORDERED.

322 Phil. 40
THIRD DIVISION
[ G.R. No. 116719. January 18, 1996 ]
PEOPLE OF THE PHILIPPINES, PLAINTIFF-APPELLEE, VS. PATRICIO AMIGO ALIAS "BEBOT", ACCUSED-APPELLANT.

D E C I S I O N
MELO, J.:

Initially, Patricio Amigo was charged with frustrated murder in an Information reading as follows:

The undersigned accuses the above-named accused of the crime of FRUSTRATED MURDER, under Art. 248, in relation to Art. 5 of the Revised Penal Code, committed as follows:

That on or about December 29, 1989, in the City of Davao, Philippines, and within the jurisdiction of this Honorable Court, the above-mentioned accused, armed with a knife, with treachery and evident premeditation and with intent to kill wilfully, unlawfully and feloniously attacked, assaulted and stab with said weapon one Benito Ng Suy, thereby inflicting injuries upon the latter, the following injuries, to wit:
"MULTIPLE STAB WOUNDS-LEFT ARM, LEFT CHEST, ABDOMEN AND LEFT THIGH WITH PENETRATION TO LEFT PLEURAL CAVITY, DIAPHRAGM STOMACH, DUODENUM, PANCREAS AND MIDTRANVERSE COLON."
thus performing all the acts of execution which should have produced the crime of murder as a consequence but nevertheless, did not produce it by reason of causes independent of his will, that is, because of the timely and able medical assistance immediately rendered to the said Benito Ng Suy.

(p.1, Rollo.)

to which he pleaded not guilty.

Subsequently, due to the death of the victim, an amended Information was filed charging now the crime of murder, to wit:

That on or about December 29, 1989, in the City of Davao, Philippines, and within the jurisdiction of this Honorable Court, the above-mentioned accused, armed with a knife, with treachery and evident premeditation and with intent to kill wilfully, unlawfully and feloniously attacked, assaulted and stabbed with said weapon one Benito Ng Say, thereby inflicting upon the latter multiple wounds which caused his death and the consequent loss and damage to the heirs of the victim.

(p. 3, Rollo.)

After trial on the merits, the court a quo rendered a decision, disposing:

WHEREFORE, finding the accused Patricio Amigo guilty beyond reasonable doubt of the crime of MURDER punishable under Art. 248 of the Revised Penal Code, with no modifying circumstance present, the accused is hereby sentenced to the penalty of reclusion perpetua, which is the medium period of the penalty of reclusion temporal in its maximum to death and to pay the cost; to indemnify the offended party the amount of P93,214.70 as actual damages and P50,000.00 as compensatory damages and P50,000.00 as moral damages.

(p. 32, Rollo.)

Reversal thereof is now sought, with accused-appellant arguing that error was committed by the trial court in imposing or meting out the penalty of reclusion perpetua against him despite the fact that Sec. 19 (1), Article III of the 1987 Constitution was already in effect when the offense was committed.

The facts of the case, as briefly summarized in the brief submitted by the Office of the Solicitor General and as borne out by the evidence, are as follows:

On December 29, 1989, at around 1:00 P.M., after having spent half-day at their store, located at No. 166-A, Ramon Magsaysay Avenue, Davao City, Benito Ng Suy was driving their gray Ford Fiera back home, situated at the back of Car Asia, Bajada, Davao City. With him during that time were his daughters, Jocelyn Ng Suy and a younger one together with his two year old son, who were all seated at the front seat beside him while a five year old boy was also seated at the back of the said vehicle. (TSN, April 29, 1991, pp. 3-5; TSN, March 31, 1992)

On their way home and while traversing the National Highway of Bajada, Davao City, an orange Toyota Tamaraw driven by one Virgilio Abogada, suddenly made a left turn in front of the Regional Hospital, Bajada, Davao City, without noticing the Ford Fiera coming from the opposite direction. This Tamaraw was heading for Sterlyn Kitchenette, which was situated at the corner of the said hospital. (TSN, April 29, 1991, p. 4; TSN, March 31, 1992, pp. 3 and 13)

With Virgilio was Patricio Amigo alias Bebot, a vulcanizer at Lingling's vulcanizing shop owned and operated by a certain Galadua. He was also seated at the right front seat beside Virgilio.

Due to the unexpected veer made by Virgilio, an accidental head on collision occurred between the Fiera and the Tamaraw, causing a slight damage to the right bumper of the latter. (TSN, March 31, 1992, p. 4)

Right after the collision, Benito immediately alighted from the driver's seat and confronted Virgilio Abogada who also went down from his vehicle. (TSN, April 29, 1991, p. 5)

Benito, who was a big man with a loud voice told Virgilio, "You were not looking," to which Virgilio retorted, "I did not see you." (TSN, April 29, 1991, p.16)

While the two drivers where having this verbal confrontation, Patricio who was merely a passenger of Virgilio also alighted from the front seat of the Tamaraw and instantaneously approached Benito and advised the latter to leave since it was merely a small and minor accident. (TSN, April 29, 1991, pp. 16-18)

A bit irritated with the actuation exhibit by Patricio, Benito rebuked the former and told him not to interfere, since he had nothing to do with the accident. (Ibid., p. 7)

Irked by the comment made by Benito, Patricio sarcastically asked; "You are Chinese, is it you?" With a ready answer Benito said; "Yes, I am a Chinese and why?" Patricio in turn replied; "So, you are a Chinese, wait for a while," then left. (Ibid., pp. 7 and 19)

Immediately thereafter, Benito ordered Jocelyn to call a policeman, but after a lapse of about one minute, Patricio returned and arrogantly approached Benito, asking the latter once again, "You are a Chinese, is it not?" To this Benito calmly responded in the affirmative.

(Ibid., pp. 7, 19-20)

Upon hearing the response, Patricio mumbled "Ah, so you are a Chinese," and suddenly took a five inch knife from his waist and simultaneously stabbed Benito hitting him twice on the chest. (ibid., p. 20)

After being hit, Benito wounded and sensing that his life was in peril, tried to evade his assailant by pushing Patricio away and run around the Tamaraw but Patricio wielding the same knife and not content with the injuries he had already inflicted, still chased Benito and upon overtaking the latter embraced him and thrusted his knife on the victim several times, the last of which hit Benito on the left side of his body. (Ibid., pp. 8, 10, 22)

It was at this juncture that Jocelyn who was still inside the Ford Fiera, pleading for mercy to spare her father tried to get out of the vehicle but it was very unfortunate that she could not open its door. (Ibid., p. 10)

Knowing that Patricio was really determined to kill her father by refusing to heed her pleas, Joselyn shouted for help, since there were already several people around witnessing that fatal incident, but to her consternation nobody lifted a single finger to help them. (Ibid., pp. 6, 10, 18, 21-22) Only after her father lay seated on the floor of their Ford Fiera after being hit on the left side of his body that she was able to open the door of the said vehicle. (Ibid., p. 12)

After this precise moment, her younger sister, upon seeing their father bathing with his own blood, embraced him, causing Patricio to cease from his ferocious assault and noticing the presence of several people, he fled. (Ibid., p. 22)

Thereafter, an enraged Jocelyn chased him, but since the assailant ran faster than her, she was not able to overtake him, thus, she instead decided to go back to where her father was and carried him inside the Tamaraw who bumped them and consequently brought him to San Pedro Hospital where he was attended to at the Emergency Room. (Ibid., p. 13)

While at the Emergency Room, Benito who was on a very critical condition, due to multiple (13) stabbed wounds, was operated by Dr. Rolando Chiu. After the operation, he was subsequently brought to the ICU and stayed there for three (3) weeks. (July 12, 1991, pp. 3 and 4)

In a last ditch effort to save his life, having only 10 to 20 percent survival, Benito was airlifted to Manila and was directly confined at the Chinese General Hospital. After three (3) weeks of confinement, Benito expired. CAUSE OF DEATH - SEPSIS (an overwhelming infection). This means that the infection has already circulated in the blood all over the body. (Ibid., pp.6-7)

(pp. 59-65, Rollo.)

Accused-appellant contends that under the 1987 Constitution and prior to the promulgation of Republic Act No. 7659, the death penalty had been abolished and hence, the penalty that should have been imposed for the crime of murder committed by accused-appellant without the attendance of any modifying circumstances, should be reclusion temporal in its medium period or 17 years, 4 months and 1 day, to 20 years of reclusion temporal.

Reasons out accused-appellant:
. . . Since the death penalty (or capital punishment) is not imposable when the stabbing and killing happened, the computation of the penalty should be regarded from reclusion perpetua down and not from death penalty. Indeed, the appropriate penalty is deducible from reclusion perpetua down to reclusion temporal in its medium period. Hence, there being no modifying circumstances present (p. 5 Decision, ibid.), the correct penalty should be in the medium period (Art. 64, par. 1, Revised Penal Code) which is 17 years, 4 months and 1 day to 20 years of reclusion temporal.
(p. 10, Appellant's Brief, ff. p. 50, Rollo.)

The question raised by accused-appellant was settled by this Court in People vs. Muñoz (170 SCRA 107 [1989]) thusly:

In People vs. Gavarra, Justice Pedro L. Yap declared for the Court that "in view of the abolition of the death penalty under Section 19, Article III of the 1987 Constitution, the penalty that may be imposed for murder is reclusion temporal in its maximum period to reclusion perpetua," thereby eliminating death as the original maximum period. Later, without categorically saying so, the Court, through Justice Ameurfina A. Melencio-Herrera in People vs. Masangkay and through Justice Andres R. Narvasa in People vs. Atencio, divided the modified penalty into three new periods, the limits of which were specified by Justice Edgardo L. Paras in People vs. Intino, as follows: the lower half of reclusion temporal maximum as the minimum; the upper half of reclusion temporal maximum as the medium; and reclusion perpetua as the maximum.

The Court has reconsidered the above cases and, after extended discussion, come to the conclusion that the doctrine announced therein does not reflect the intention of the framers as embodied in Article III, Section 19(1) of the Constitution. This conclusion is not unanimous, to be sure. Indeed, there is much to be said of the opposite view, which was in fact shared by many of those now voting for its reversal. The majority of the Court, however, is of the belief that the original interpretation should be restored as the more acceptable reading of the constitutional provision in question.

The advocates of the Masangkay ruling argue that the Constitution abolished the death penalty and thereby limited the penalty for murder to the remaining periods, to wit, the minimum and the medium. These should now be divided into three new periods in keeping with the three-grade scheme intended by the legislature. Those who disagree feel that Article III, Section 19(1) merely prohibits the imposition of the death penalty and has not, by reducing it to reclusion perpetua, also correspondingly reduced the remaining penalties. These should be maintained intact.

A reading of Section 19(1) of Article III will readily show that there is really nothing therein which expressly declares the abolition of the death penalty. The provision merely says that the death penalty shall not be imposed unless for compelling reasons involving heinous crimes the Congress hereafter provides for it and, if already imposed, shall be reduced to reclusion perpetua. The language, while rather awkward, is still plain enough. And it is a settled rule of legal hermeneutics that if the language under consideration is plain, it is neither necessary nor permissible to resort to extrinsic aids, like the records of the constitutional convention, for its interpretation.

xxx xxx xxx

The question as we see it is not whether the framers intended to abolish the death penalty or merely to prevent its imposition. Whatever the intention was, what we should determine is whether or not they also meant to require a corresponding modification in the other periods as a result of the prohibition against the death penalty.

It is definite that such a requirement, if there really was one, is not at all expressed in Article III, Section 19(1) of the Constitution or indicated therein by at least clear and unmistakable implication. It would have been so easy, assuming such intention, to state it categorically and plainly, leaving no doubts as to its meaning. One searches in vain for such a statement, express or even implied. The writer of this opinion makes the personal observation that this might be still another instance where the framers meant one thing and said another or - strangely, considering their loquacity elsewhere - did not say enough.

The original ruling as applied in the Gavarra, Masangkay, Atencio and Intino cases represented the unanimous thinking of the Court as it was then constituted. All but two members at that time still sit on the Court today. If we have seen fit to take a second look at the doctrine on which we were all agreed before, it is not because of a change in the composition of this body. It is virtually the same Court that is changing its mind after reflecting on the question again in the light of new perspectives. And well it might, and tan, for the tenets it lays down are not immutable. The decisions of this Court are not petrified rules grown rigid once pronounced but vital, growing things subject to change as all life is. While we are told that the trodden path is best, this should not prevent us from opening a fresh trial or exploring the other side or testing a new idea in a spirit of continuing inquiry.

Accordingly, with the hope that "as judges, (we) will be equal to (our) tasks," whatever that means, we hereby reverse the current doctrine providing for three new periods for the penalty for murder as reduced by the Constitution. Instead, we return to our original interpretation and hold that Article III, Section 19(1) does not change the periods of the penalty prescribed by Article 248 of the Revised Penal Code except only insofar as it prohibits the imposition of the death penalty and reduces it to reclusion perpetua. The range of the medium and minimum penalties remains unchanged.

The Court realizes that this interpretation may lead to certain inequities that would not have arisen under Article 248 of the Revised Penal Code before its modification. Thus, a person originally subject to the death penalty and another who committed the murder without the attendance of any modifying circumstance will now be both punishable with the same medium period although the former is concededly more guilty than the latter. True enough. But that is the will not of this Court but of the Constitution. That is a question of wisdom, not construction. Of some relevance perhaps is the parable in the Bible of the workman who was paid the stipulated daily wage of one penny although he had worked longer than others hired later in the day also paid the same amount. When he complained because he felt unjustly treated by the householder, the latter replied: "Friend, I do you no wrong. Did you not agree with me for a penny?"

The problem in any event is addressed not to this Court but to the Congress. Penalties are prescribed by statute and are essentially and exclusively legislative. As judges, we can only interpret and apply them and have no authority to modify them or revise their range as determined exclusively by the legislature. We should not encroach on this prerogative of the lawmaking body.

Coming back to the case at bar, we find that there being no generic aggravating or mitigating circumstance attending the commission of the offenses, the applicable sentence is the medium period of the penalty prescribed by Article 248 of the Revised Penal Code which, conformably to the new doctrine here adopted and announced, is still reclusion perpetua. This is the penalty we imposed on all the accused-appellants for each of the three murders they have committed in conspiracy with the others. The award of civil indemnity for the heirs of each of the victims is affirmed but the amount thereof is hereby increased to P30,000.00 in line with the present policy.

(at pp. 120-125.)

The above ruling was reiterated in People vs. Parojinog (203 SCRA 673 [1991]) and in People vs. De la Cruz (216 SCRA 476 [1992]).

Finally, accused-appellant claims that the penalty of reclusion perpetua is too cruel and harsh a penalty and pleads for sympathy. Courts are not the forum to plead for sympathy. The duty of courts is to apply the law, disregarding their feeling of sympathy or pity for an accused. DURA LEX SED LEX. The remedy is elsewhere - clemency from the executive or an amendment of the law by the legislative, but surely, at this point, this Court can but apply the law.

WHEREFORE, the appealed decision is hereby AFFIRMED.

SO ORDERED.

ASSOCIATED BANK, PETITIONER, VS. HON. COURT OF APPEALS, PROVINCE OF TARLAC AND PHILIPPINE NATIONAL BANK, RESPONDENTS.

D E C I S I O N
ROMERO, J.:

Where thirty checks bearing forged endorsements are paid, who bears the loss, the drawer, the drawee bank or the collecting bank?

This is the main issue in these consolidated petitions for review assailing the decision of the Court of Appeals in "Province of Tarlac v. Philippine National Bank v. Associated Bank v. Fausto Pangilinan, et. al." (CA-G.R. No. CV No. 17962).[1]

The facts of the case are as follows:

The Province of Tarlac maintains a current account with the Philippine National Bank (PNB) Tarlac Branch where the provincial funds are deposited. Checks issued by the Province are signed by the Provincial Treasurer and countersigned by the Provincial Auditor or the Secretary of the Sangguniang Bayan.

A portion of the funds of the province is allocated to the Concepcion Emergency Hospital.[2] The allotment checks for said government hospital are drawn to the order of "Concepcion. Emergency Hospital, Concepcion, Tarlac" or "The Chief, Concepcion Emergency Hospital, Concepcion, Tarlac." The checks are released by the Office of the Provincial Treasurer and received for the hospital by its administrative officer and cashier.

In January 1981, the books of account of the Provincial Treasurer were post-audited by the Provincial Auditor. It was then discovered that the hospital did not receive several allotment checks drawn by the Province.

On February 19, 1981, the Provincial Treasurer requested the manager of the PNB to return all of its cleared checks which were issued from 1977 to 1980 in order to verify the regularity of their encashment. After the checks were examined, the Provincial Treasurer learned that 30 checks amounting to P203,300.00 were encashed by one Fausto Pangilinan, with the Associated Bank acting as collecting bank.

It turned out that Fausto Pangilinan, who was the administrative officer and cashier of payee hospital until his retirement on February 28, 1978, collected the questioned checks from the office of the Provincial Treasurer. He claimed to be assisting or helping the hospital follow up the release of the checks and had official receipts.[3] Pangilinan sought to encash the first check[4] with Associated Bank. However, the manager of Associated Bank refused and suggested that Pangilinan deposit the check in his personal savings account with the same bank. Pangilinan was able to withdraw the money when the check was cleared and paid by the drawee bank, PNB.

After forging the signature of Dr. Adena Canlas who was chief of the payee hospital, Pangilinan followed the same procedure for the second check, in the amount of P5,000.00 and dated April 20, 1978,[5] as well as for twenty-eight other checks, of various amounts and on various dates. The last check negotiated by Pangilinan was for P8,000.00 and dated February 10, 1981.[6] All the checks bore the stamp of Associated Bank which reads "All prior endorsements guaranteed ASSOCIATED BANK."

Jesus David, the manager of Associated Bank testified that Pangilinan made it appear that the checks were paid to him for certain projects with the hospital.[7] He did not find as irregular the fact that the checks were not payable to Pangilinan but to the Concepcion Emergency Hospital. While he admitted that his wife and Pangilinan's wife are first cousins, the manager denied having given Pangilinan preferential treatment on this account.[8]

On February 26, 1981, the Provincial Treasurer wrote the manager of the PNB seeking the restoration of the various amounts debited from the current account of the Province.[9]

In turn, the PNB manager demanded reimbursement from the Associated Bank on May 15, 1981.[10]

As both banks resisted payment, the Province of Tarlac brought suit against PNB which, in turn, impleaded Associated Bank as third-party defendant. The latter then filed a fourth-party complaint against Adena Canlas and Fausto Pangilinan.[11]

After trial on the merits, the lower court rendered its decision on March 21, 1988, disposing as follows:

"WHEREFORE, in view of the foregoing, judgment is hereby rendered:

1. On the basic complaint, in favor of plaintiff Province of Tarlac and against defendant Philippine National Bank (PNB), ordering the latter to pay to the former, the sum of Two Hundred Three Thousand Three Hundred (P203,300.00) Pesos with legal interest thereon from March 20, 1981 until fully paid;

2. On the third-party complaint, in favor of defendant/third-party plaintiff Philippine National Bank (PNB) and against third-party defendant/fourth-party plaintiff Associated Bank ordering the latter to reimburse to the former the amount of Two Hundred Three Thousand Three Hundred (P203,300.00) Pesos with legal interests thereon from March 20, 1981 until fully paid;.

3. On the fourth-party complaint, the same is hereby ordered dismissed for lack of cause of action as against fourth-party defendant Adena Canlas and lack of jurisdiction over the person of fourth-party defendant Fausto Pangilinan as against the latter.

4. On the counterclaims on the complaint, third-party complaint and fourth-party complaint, the same are hereby ordered dismissed for lack of merit.

SO ORDERED.[12]

PNB and Associated Bank appealed to the Court of AppealS.[13] Respondent court affirmed the trial court's decision in toto on September 30, 1992.

Hence these consolidated petitions which seek a reversal of respondent appellate court's decision.

PNB assigned two errors. First, the bank contends that respondent court erred in exempting the Province of Tarlac from liability when, in fact, the latter was negligent because it delivered and released the questioned checks to Fausto Pangilinan who was then already retired as the hospital's cashier and administrative officer. PNB also maintains its innocence and alleges that as between two innocent persons, the one whose act was the cause of the loss, in this case the Province of Tarlac, bears the loss.

Next, PNB asserts that it was error for the court to order it to pay the province and then seek reimbursement from Associated Bank. According to petitioner bank, respondent appellate Court should have directed Associated Bank to pay the adjudged liability directly to the Province of Tarlac to avoid circuity.[14]

Associated Bank, on the other hand, argues that the order of liability should be totally reversed, with the drawee bank (PNB) solely and ultimately bearing the loss.

Respondent court allegedly erred in applying Section 23 of the Philippine Clearing House Rules instead of Central Bank Circular No. 580, which, being an administrative regulation issued pursuant to law, has the force and effect of law.[15] The PCHC Rules are merely contractual stipulations among and between member-banks. As such, they cannot prevail over the aforesaid CB Circular.

It likewise contends that PNB, the drawee bank, is estopped from asserting the defense of guarantee of prior indorsements against Associated Bank, the collecting bank. In stamping the guarantee (for all prior indorsements), it merely followed a mandatory requirement for clearing and had no choice but to place the stamp of guarantee; otherwise, there would be no clearing. The bank will be in a "no-win" situation and will always bear the loss as against the drawee bank.[16]

Associated Bank also claims that since PNB already cleared and paid the value of the forged checks in question, it is now estopped from asserting the defense that Associated Bank guaranteed prior indorsements. The drawee bank allegedly has the primary duty to verify the genuineness of payee's indorsement before paying the check.[17]

While both banks are innocent of the forgery, Associated Bank claims that PNB was at fault and should solely bear the loss because it cleared and paid the forged checks.

xxx

The case at bench concerns checks payable to the order of Concepcion Emergency Hospital or its Chief. They were properly issued and bear the genuine signatures of the drawer, the Province of Tarlac. The infirmity in the questioned checks lies in the payee's (Concepcion Emergency Hospital) indorsements which are forgeries. At the time of their indorsement, the checks were order instruments.

Checks having forged indorsements should be differentiated from forged checks or checks bearing the forged signature of the drawer.

Section 23 of the Negotiable Instruments Law (NIL) provides:

Sec. 23. FORGED SIGNATURE, EFFECT OF. - When a signature is forged or made without authority of the person whose signature it purports to be, it is wholly inoperative, and no right to retain the instrument, or to give a discharge therefor, or to enforce payment thereof against any party thereto, can be acquired through or under such signature unless the party against whom it is sought to enforce such right is precluded from setting up the forgery or want of authority.

A forged signature, whether it be that of the drawer or the payee, is wholly inoperative and no one can gain title to the instrument through it. A person whose signature to an instrument was forged was never a party and never consented to the contract which allegedly gave rise to such instrument.[18] Section 23 does not avoid the instrument but only the forged signature.[19] Thus, a forged indorsement does not operate as the payee's indorsement.

The exception to the general rule in Section 23 is where "a party against whom it is sought to enforce a right is precluded from setting up the forgery or want of authority. "Parties who warrant or admit the genuineness of the signature in question and those who, by their acts, silence or negligence are estopped from setting up the defense of forgery, are precluded from using this defense. Indorsers, persons negotiating by delivery and acceptors are warrantors of the genuineness of the signatures on the instIument.[20]

In bearer instruments, the signature of the payee or holder is unnecessary to pass title to the instrument. Hence, when the indorsement is a forgery, only the person whose signature is forged can raise the defense of forgery against a holder in due course.[21]

The checks involved in this case are order instruments, hence, the following discussion is made with reference to the effects of a forged indorsement on an instrument payable to order.

Where the instrument is payable to order at the time of the forgery, such as the checks in this case, the signature of its rightful holder (here, the payee hospital) is essential to transfer title to the same instrument. When the holder's indorsement is forged, all parties prior to the forgery may raise the real defense of forgery against all parties subsequent thereto.[22]

An indorser of an order instrument warrants "that the instrument is genuine and in all respects what it purports to be; that he has a good title to it; that all prior parties had capacity to contract; and that the instrument is at the time of his indorsement valid and subsisting."[23] He cannot interpose the defense that signatures prior to him are forged.

A collecting bank where a check is deposited and which indorses the check upon presentment with the drawee bank, is such an indorser. So even if the indorsement on the check deposited by the banks's client is forged, the collecting bank is bound by his warranties as an indorser and cannot set up the defense of forgery as against the drawee bank.

The bank on which a check is drawn, known as the drawee bank, is under strict liability to pay the check to the order of the payee. The drawer's instructions are reflected on the face and by the terms of the check. Payment under a forged indorsement is not to the drawer's order. When the drawee bank pays a person other than the payee, it does not comply with the terms of the check and violates its duty to charge its customer's (the drawer) account only for properly payable items. Since the drawee bank did not pay a holder or other person entitled to receive payment, it has no right to reimbursement from the drawer.24 The general rule then is that the drawee bank may not debit the drawer's account and is not entitled to indemnification from the drawer.[25] The risk of loss must perforce fall on the drawee bank.

However, if the drawee bank can prove a failure by the customer/drawer to exercise ordinary care that substantially contributed to the making of the forged signature, the drawer is precluded from asserting the forgery.

If at the same time the drawee bank was also negligent to the point of substantially contributing to the loss, then such loss from the forgery can be apportioned between the negligent drawer and the negligent bank.[26]

In cases involving a forged check, where the drawer's signature is forged, the drawer can recover from the drawee bank. No drawee bank has a right to pay a forged check. If it does, it shall have to recredit the amount of the check to the account of the drawer. The liability chain ends with the drawee bank whose responsibility it is to know the drawer's signature since the latter is its customer.[27]

In cases involving checks with forged indorsements, such as the present petition, the chain of liability does not end with the drawee bank. The drawee bank may not debit the account of the drawer but may generally pass liability back through the collection chain to the party who took from the forger and, of course, to the forger himself, if available.[28] In other words, the drawee bank can seek reimbursement or a return of the amount it paid from the presentor bank or person.[29] Theoretically, the latter can demand reimbursement from the person who indorsed the check to it and so on. The loss falls on the party who took the check from the forger, or on the forger himself.

In this case, the checks were indorsed by the collecting bank (Associated Bank) to the drawee bank (PNB). The former will necessarily be liable to the latter for the checks bearing forged indorsements. If the forgery is that of the payee's or holder's indorsement, the collecting bank is held liable, without prejudice to the latter proceeding against the forger.

Since a forged indorsement is inoperative, the collecting bank had no right to be paid by the drawee bank. The former must necessarily return the money paid by the latter because it was paid wrongfully.[30]

More importantly, by reason of the statutory warranty of a general indorser in Section 66 of the Negotiable Instruments Law, a collecting bank which indorses a check bearing a forged indorsement and presents it to the drawee bank guarantees all prior indorsements, including the forged indorsement. It warrants that the instrument is genuine, and that it is valid and subsisting at the time of his indorsement. Because the indorsement is a forgery, the collecting bank commits a breach of this warranty and will be accountable to the drawee bank. This liability scheme operates without regard to fault on the part of the collecting/presenting bank. Even if the latter bank was not negligent, it would still be liable to the drawee bank because of its indorsement.

The Court has consistently ruled that "the collecting bank or last endorser generally suffers the loss because it has the duty to ascertain the genuineness of all prior endorsements considering that the act of presenting the check for payment to the drawee is an assertion that the party making the presentment has done its duty to ascertain the genuineness of the endorsements."[31]

The drawee bank is not similarly situated as the collecting bank because the former makes no warranty as to the genuineness of any indorsement.[32] The drawee bank's duty is but to verify the genuineness of the drawer's signature and not of the indorsement because the drawer is its client.

Moreover, the collecting bank is made liable because it is privy to the depositor who negotiated the check. The bank knows him, his address and history because he is a client. It has taken a risk on his deposit. The bank is also in a better position to detect forgery, fraud or irregularity in the indorsement.

Hence, the drawee bank can recover the amount paid on the check bearing a forged indorsement from the collecting bank. However, a drawee bank has the duty to promptly inform the presentor of the forgery upon discovery. If the drawee bank delays in informing the presentor of the forgery, thereby depriving said presentor of the right to recover from the forger, the former is deemed negligent and can no longer recover from the presentor.[33]

Applying these rules to the case at bench, PNB, the drawee bank, cannot debit the current account of the Province of Tarlac because it paid checks which bore forged indorsements. However, if the Province of Tarlac as drawer was negligent to the point of substantially contributing to the loss, then the drawee bank PNB can charge its account. If both drawee bank-PNB and drawer-Province of Tarlac were negligent, the loss should be properly apportioned between them.

The loss incurred by drawee bank-PNB can be passed on to the collecting bank-Associated Bank which presented and indorsed the checks to it. Associated Bank can, in turn, hold the forger, Fausto Pangilinan, liable.

If PNB negligently delayed in informing Associated Bank of the forgery, thus depriving the latter of the opportunity to recover from the forger, it forfeits its right to reimbursement and will be made to bear the loss.

After careful examination of the records, the Court finds that the Province of Tarlac was equally negligent and should, therefore, share the burden of loss from the checks bearing a forged indorsement.

The Province of Tarlac permitted Fausto Pangilinan to collect the checks when the latter, having already retired from government service, was no longer connected with the hospital. With the exception of the first check (dated January 17, 1978), all the checks were issued and released after Pangilinan's retirement on February 28, 1978. After nearly three years, the Treasurer's office was still releasing the checks to the retired cashier. In addition, some of the aid allotment checks were released to Pangilinan and the others to Elizabeth Juco, the new cashier. The fact that there were now two persons collecting the checks for the hospital is an unmistakable sign of an irregularity which should have alerted employees in the Treasurer's office of the fraud being committed. There is also evidence indicating that the provincial employees were aware of Pangilinan's retirement and consequent dissociation from the hospital. Jose Meru, the Provincial Treasurer, testified:.

"ATTY. MORGA:

Q :  Now, is it true that for a given month there were two releases of checks, one went to Mr. Pangilinan and one went to Miss Juco?

JOSE MERU:

A :   Yes, sir.

Q :  Will you please tell us how at the time (sic) when the authorized representative of Concepcion Emergency Hospital is and was supposed to be Miss Juco?

A :   Well, as far as my investigation show (sic) the assistant cashier told me that Pangilinan represented himself as also authorized to help in the release of these checks and we were apparently misled because they accepted the representation of Pangilinan that he was helping them in the release of the checks and besides according to them they were, Pangilinan, like the rest, was able to present an official receipt to acknowledge these receipts and according to them since this is a government check and believed that it will eventually go to the hospital following the standard procedure of negotiating government checks, they released the checks to Pangilinan aside from Miss Juco."[34]

The failure of the Province of Tarlac to exercise due care contributed to a significant degree to the loss tantamount to negligence. Hence, the Province of Tarlac should be liable for part of the total amount paid on the questioned checks.

The drawee bank PNB also breached its duty to pay only according to the terms of the check. Hence, it cannot escape liability and should also bear part of the loss.

As earlier stated, PNB can recover from the collecting bank.

In the case of Associated Bank v. CA,[35] six crossed checks with forged indorsements were deposited in the forger's account with the collecting bank and were later paid by four different drawee banks. The Court found the collecting bank (Associated) to be negligent and held:

"The Bank should have first verified his right to endorse the crossed checks, of which he was not the payee, and to deposit the proceeds of the checks to his own account. The Bank was by reason of the nature of the checks put upon notice that they were issued for deposit only to the private respondent's account. xxx"

The situation in the case at bench is analogous to the above case, for it was not the payee who deposited the checks with the collecting bank. Here, the checks were all payable to Concepcion Emergency Hospital but it was Fausto Pangilinan who deposited the checks in his personal savings account.

Although Associated Bank claims that the guarantee stamped on the checks (All prior and/or lack of endorsements guaranteed) is merely a requirement forced upon it by clearing house rules, it cannot but remain liable. The stamp guaranteeing prior indorsements is not an empty rubric which a bank must fulfill for the sake of convenience. A bank is not required to accept all the checks negotiated to it. It is within the bahk's discretion to receive a check for no banking institution would consciously or deliberately accept a check bearing a forged indorsement. When a check is deposited with the collecting bank, it takes a risk on its depositor. It is only logical that this bank be held accountable for checks deposited by its customers.

A delay in informing the collecting bank (Associated Bank) of the forgery, which deprives it of the opportunity to go after the forger, signifies negligence on the part of the drawee bank (PNB) and will preclude it from claiming reimbursement.

It is here that Associated Bank's assignment of error concerning C.B. Circular No. 580 and Section 23 of the Philippine Clearing House Corporation Rules comes to fore. Under Section 4(c) of CB Circular No. 580, items bearing a forged endorsement shall be returned within twenty-four (24) hours after discovery of the forgery but in no event beyond the period fixed or provided by law for filing of a legal action by the returning bank. Section 23 of the PCHC Rules deleted the requirement that items bearing a forged endorsement should be returned within twenty-four hours. Associated Bank now argues that the aforementioned Central Bank Circular is applicable. Since PNB did not return the questioned checks within twenty-four hours, but several days later, Associated Bank alleges that PNB should be considered negligent and not entitled to reimbursement of the amount it paid on the checks.

The Court deems it unnecessary to discuss Associated Bank's assertions that CB Circular No. 580 is an administrative regulation issued pursuant to law and as such, must prevail over the PCHC rule. The Central Bank circular was in force for all banks until June 1980 when the Philippine Clearing House Corporation (PCHC) was set up and commenced operations. Banks in Metro Manila were covered by the PCHC while banks located elsewhere still had to go through Central Bank Clearing. In any event, the twenty-four-hour return rule was adopted by the PCHC until it was changed in 1982. The contending banks herein, which are both branches in Tarlac province, are therefore not covered by PCHC Rules but by CB Circular No. 580. Clearly then, the CB circular was applicable when the forgery of the checks was discovered in 1981.

The rule mandates that the checks be returned within twenty-four hours after discovery of the forgery but in no event beyond the period fixed by law for filing a legal action. The rationale of the rule is to give the collecting bank (which indorsed the check) adequate opportunity to proceed against the forger. If prompt notice is not given, the collecting bank maybe prejudiced and lose the opportunity to go after its depositor.

The Court finds that even if PNB did not return the questioned checks to Associated Bank within twenty-four hours, as mandated by the rule, PNB did not commit negligent delay. Under the circumstances, PNB gave prompt notice to Associated Bank and the latter bank was not prejudiced in going after Fausto Pangilinan. After the Province of Tarlac informed PNB of the forgeries, PNB necessarily had to inspect the checks and conduct its own investigation. Thereafter, it requested the Provincial Treasurer's office on March 31, 1981 to return the checks for verification. The Province of Tarlac returned the checks only on April 22, 1981. Two days later, Associated Bank received the checks from PNB.[36]

Associated Bank was also furnished a copy of the Province's letter of demand to PNB dated March 20, 1981, thus giving it notice of the forgeries. At this time, however, Pangilinan's account with Associated had only P24.63 in it.[37] Had Associated Bank decided to debit Pangilinan's account, it could not have recovered the amounts paid on the questioned checks. In addition, while Associated Bank filed a fourth-party complaint against Fausto Pangilinan, it did not present evidence against Pangilinan and even presented him as its rebuttal witness.[38] Hence, Associated Bank was not prejudiced by PNB's failure to comply with the twenty-four-hour return rule.

Next, Associated Bank contends that PNB is estopped from requiring reimbursement because the latter paid and cleared the checks. The Court finds this contention unmeritorious. Even if PNB cleared and paid the checks, it can still recover from Associated Bank. This is true even if the payee's Chief Officer who was supposed to have indorsed the checks is also a customer of the drawee bank.[39] PNB's duty was to verify the genuineness of the drawer's signature and not the genuineness of payee's indorsement. Associated Bank, as the collecting bank, is the entity with the duty to verify the genuineness of the payee's indorsement.

PNB also avers that respondent court erred in adjudging circuitous liability by directing PNB to return to the Province of Tarlac the amount of the checks and then directing Associated Bank to reimburse PNB. The Court finds nothing wrong with the mode of the award. The drawer, Province of Tarlac, is a client or customer of the PNB, not of Associated Bank. There is no privity of contract between the drawer and the collecting bank.

The trial court made PNB and Associated Bank liable with legal interest from March 20, 1981, the date of extrajudicial demand made by the Province of Tarlac on PNB. The payments to be made in this case stem from the deposits of the Province of Tarlac in its current account with the PNB. Bank deposits are considered under the law as loans.[40] Central Bank Circular No. 416 prescribes a twelve percent (12%) interest per annum for loans, forebearance of money, goods or credits in the absence of express stipulation. Normally, current accounts are likewise interest-bearing, by express contract, thus excluding them from the coverage of CB Circular No. 416. In this case, however, the actual interest rate, if any, for the current account opened by the Province of Tarlac with PNB was not given in evidence. Hence, the Court deems it wise to affirm the trial court's use of the legal interest rate, or six percent (6%) per annum. The interest rate shall be computed from the date of default, or the date of judicial or extrajudicial demand.[41] The trial court did not err in granting legal interest from March 20, 1981, the date of extrajudicial demand.

The Court finds as reasonable, the proportionate sharing of fifty percent - fifty percent (50%-50%). Due to the negligence of the Province of Tarlac in releasing the checks to an unauthorized person (Fausto Pangilinan), in allowing the retired hospital cashier to receive the checks for the payee hospital for a period close to three years and in not properly ascertaining why the retired hospital cashier was collecting checks for the payee hospital in addition to the hospital's real cashier, respondent Province contributed to the loss amounting to. P203,300.00 and shall be liable to the PNB for fifty (50%) percent thereof. In effect, the Province of Tarlac can only recover fifty percent (50%) of P203,300.00 from PNB.

The collecting bank, Associated Bank, shall be liable to PNB for fifty (50%) percent of P203,300.00. It is liable on its warranties as indorser of the checks which were deposited by Fausto Pangilinan, having guaranteed the genuineness of all prior indorsements, including that of the chief of the payee hospital, Dr. Adena Canlas. Associated Bank was also remiss in its duty to ascertain the genuineness of the payee's indorsement.

IN VIEW OF THE FOREGOING, the petition for review filed by the Philippine National Bank (G.R. No. 107612) is hereby PARTIALLY GRANTED. The petition for review filed by the Associated Bank (G.R. No. 107382) is hereby DENIED. The decision of the trial court is MODIFIED. The Philippine National Bank shall pay fifty percent (50%) of P203,300.00 to the Province of Tarlac, with legal interest from March 20, 1981 until the payment thereof. Associated Bank shall pay fifty percent (50%) of P203,300.00 to the Philippine National Bank, likewise, with legal interest from March 20, 1981 until payment is made.
SO ORDERED.

[2] Provincial aid was given irregularly. Hospital staff would often call the provincial treasurer's office to inquire whether there was an allotment check for the hospital. The hospital's administrative officer and cashier would then go to the provincial treasurer's office to pick up the check.

Checks received by the hospital are deposited in the account of the National Treasury with the PNB. All income of the hospital in excess of the amount which the National Government has directed it to raise, is excess income. The latter is given back to the hospital after a supplemental budget is prepared. When the latter is approved, an advice of allotment is made. Then the hospital requests a cash disbursement ceiling. When approved, this is brought to the Ministry of Health. The regional office of said Ministry then prepares a check for the hospital. The check will be deposited in the hospital's current account at the PNB. (Culled from the testimony of Dr. Adena Canlas, TSN, October 17, 1983, pp. 8-11; December 6, 1983, pp. 43-44).
