Telcos need government support for ICT infrastructure

Local telecommunication companies need government support in the deployment of information and communication technology (ICT)-related infrastructure, most especially in rural and far-flung areas, to improve and address business viability concerns. National Telecommunications Commission commissioner Gamaliel Cordoba explained that since the Philippine telco industry is not dominated by state-owned firms, unlike in the rest of the ASEAN countries, privately owned telcos (PLDT and Globe) are financing the massive investments in network infrastructure. Given this scenario, Cordoba underscored the urgent need for government to implement the PHP72-billion national broadband network program to deliver fast Internet service to far-flung areas.

Ombudsman charges ex-Leyte mayor with graft (10 August 2017)

Former Mayor Charita Chan of Babatngon, Leyte is facing indictment anew before the Sandiganbayan for violation of Section 3(e) of the Anti-graft and Corrupt Practices Act (R.A. No. 3019), this time for issuing a business permit to a cockpit sans authority from the Sangguniang Bayan (SB).

A probe by the Ombudsman established that in 2008 and 2009, the SB issued two resolutions recommending that the franchise to operate granted to a certain Nicomedes Alde be revoked to due to non-compliance with legal requirements.  The SB noted that Alde failed to submit the required building permit, location and vicinity map of the cockpit, cockpit building plan and certification that the same is not located within the 200 lineal meter radius from existing residential and commercial areas.

Despite these recommendations, Chan approved Alde’s business permits for 2008 and 2009.

In its Resolution, the Ombudsman stated that, “respondent completely disregarded and ignored the concurrent authority of the SB to issue license and regulate cockfighting within the Municipality under Section 4 of P.D. 1802 and Section 6(h) of Ordinance No. 191 of Babatngon, Leyte by issuing on 28 August 2009 Mayor’s Business permit No. 03-30-2009 to the cockpit operated by Alde.”

“Chan acted with manifest partiality, evident bad faith or gross inexcusable negligence in the performance of her duties and responsibilities,” added the Ombudsman.

Section 3(e) of R.A. No. 3019 prohibits officers and employees from causing undue injury to any party, including the Government, or giving any private party any unwarranted benefits, advantage or preference in the discharge of official administrative or judicial functions through manifest partiality, evident bad faith or gross inexcusable negligence.

It will be recalled that in May, the Ombudsman filed graft charges against Chan for allowing illegal quarrying operations in the Salug Dongon river. - Press Release

ASEAN Forum on Coal (AFOC),
Japan Coal Energy Center (JCOAL),
International Energy Agency (IEA),
Gas Exporting Countries Forum (GECF),
Colleagues from the Department of Energy (DOE) and the Philippine National Oil Company (PNOC),
Distinguished guests,

Ladies and gentlemen, let me begin by welcoming you to the 1st East Asia Energy Forum, an associated meeting organized under the Asia Cooperation Dialogue (ACD).
I also want to give a special and warm welcome to those of who have come from far away to be with us this morning. Mabuhay! And I hope you are having a wonderful time in our beautiful country.

I must also thank the organizers for giving me the opportunity to address this distinguished gathering. This Forum, as noted, is the first of its kind and is indeed a historic occasion. Energy is obviously a key component in economic development: the latter simply cannot happen without the former.

It is hence, timely and relevant to deepen our critical awareness and share expertise in this area. I also earnestly hope that this Forum can eventually be institutionalized as a regular event in regional energy cooperation for ASEAN and East Asia.

Ladies and Gentlemen, the Philippines is today a nation of more than 100 million people spread across more than 7,000 islands. We are alsoâ€"according to the World Bankâ€"the 10th fastest-growing economy in the world. Developing economies, like ours, will need cost-efficient and reliable energy to meet our economic potential.

Our energy decisions are all the more complex when we consider the issue of climate change and greenhouse gas (GHG) emissions â€" matters which inevitably arise when discussing conventional energy. In Asia, where one in seven people lack access to basic electricity, the line between promoting socioeconomic growth and combating climate change is an extremely fine one for governments.

The good news is that renewable energy costs are falling. However, the intermittent nature of certain renewable technologies and high battery storage costs mean that it is not often a feasible or reliable source of baseload power.

Being aware of the energy needs of today, I am optimistic that the necessary technological progress in renewable energy will one day be made. Until that day comes, conventional energy will have a role to play.

Conventional energy is the benchmark that renewable energy will need to meet or surpass in order to be a sustainable solution to the world’s energy needs. In Japan, the Isogo Thermal Power Station has an electricity efficiency of 45%. To put things into context, the most efficient solar panels have efficiencies of below 30%.

Ultimately, conventional energy is our bridge to a carbon-free energy future. I don’t know when that will happen. But until it does, it is clear that conventional energy will provide the reliability, security and diversification we need to encourage socio-economic growth.

This in turn will make it more conducive for investments into more sustainable and efficient technologies. Moreover, direct competition between conventional and renewable energy will encourage rapid improvement in renewable technologies.

Ladies and gentlemen, there is no “one-size-fits-all” approach for an ideal energy mix. Each of our countries have different economies, geographies and social needs. As such, I believe it is important to take a “technology-neutral” approach when devising our energy policies.

Allow me to elaborate what I mean by this.  Broadly speaking, “technology-neutral” means that we shouldn’t be constrained by rigid or arbitrary targets in sourcing our energy. In other words, both conventional and non-conventional sources must be considered. However, this shouldn’t be equated with abandoning climate action.

There are things we can do fairly quickly to make conventional energy sources more sustainable. For instance, refurbishing old and naturally degrading coal power plants will increase fuel efficiency. Indeed, the International Energy Agency estimates that this could cut over 1.5 billion metric tonnes of carbon dioxide emissions annually.

This initiative is being driven by Asian countries such as Japan and India, not to mention China, whose re-engineering of the Shanghai-Waigaqiao No 3 Power Plant is a notable highlight.

We’re trying to replicate this creative approach in the Philippines, by phasing out old and inefficient generation facilities, and promoting critical coal-fired plants. This, among other efficient technologies, will allow developing nations to reduce their impact on the environment, providing alternative short- to medium-term solutions to prohibitively costly new energy sources that are more suited for long-term scenarios.
Ladies and gentlemen, of course, much more can and should be done. Today’s forum is hence a good opportunity for the ASEAN and East Asian economies to craft possible solutions to the inter-related challenges of energy security and climate change.

I hope that everyone will actively participate in developing recommendations to strengthen our energy policy that will serve as the basis for informed decisions at all levels â€"whether global, regional and national. We hope to learn, but also share our experiences with you. I end by wishing you all a very productive discussion ahead and to welcome you all once again.

Thank you and have an enjoyable week in the Philippines! Mabuhay!

OPENING STATEMENT FOR PRESSCON 2 (ERIA)
DOE Secretary Alfonso G. Cusi
1st East Asia Energy Forum
9 August 2017
Be Grand Hotel, Bohol, Philippines

To the delegates of the Asia Cooperation Dialogue, particularly the officers and members of the Economic Research Institute for ASEAN and East Asia (ERIA), and of course our ever-supportive friends from the media, thank you for gracing this Press Conference for the 1st East Asia Energy Forum. This is an associated meeting organized under the Asia Cooperation Dialogue (ACD).

Earlier today, I opened the Forum and it’s currently ongoing, tackling the significance of conventional energy and the entire oil industry to the Asian economies.

With the Philippine direction towards energy neutrality, we cannot--at the moment-- disregard the inclusion of conventional energy in our energy mix, particularly natural gas.  They serve as an important role in our daily lives regardless of the issues and concerns arising from them and that we also keep on addressing and resolving.

Thankfully, we have neighboring countries who are willing to set a regional direction on conventional energy as we continue to depend on them for the ASEAN and East Asia economies’ industrialization and further growth.

Along with our friendly neighbors from ASEAN and East Asia, our main thrust in this forum is the development of appropriate strategies and innovative solutions not only to our energy challenges but also on energy security threats.

With all that being said, I hope that the media will serve as the bridge between us, the policymakers, and the larger public. You are a vital institution in realizing the vision for the full development of the country and the Asian regions.

Mabuhay and good afternoon!

She underscored that provincial locations that currently take advantage of national incentives under a centralized government structure will be affected by the reduction or removal of the current set of tax incentives that have been attracting business process outsourcing companies.

Gov’t to investors: ‘partner PH, build value together’

MAKATIâ€"“Partner Philippines and Build Value Together” sums up the latest government campaign to encourage investors to ride on the ongoing Philippine (PH) growth story.

Speaking in a Dutertenomics forum, which includes the country’s economic managers, on 10 August, Department of Trade and Industry (DTI) Secretary Ramon Lopez encouraged investors to partner with PH, which will help in creating additional value for their businesses that will boost income-generation operations.

“The initiatives under Dutertenomics can help support investors by creating an environment where companies can do business swiftly and efficiently,” said Sec. Lopez, stressing that ongoing infrastructure projects strategically link the country’s industries, which will further power the growth of an already strong economic base.

“Build Build Build will facilitate greater trade and investment as it opens up access to new markets, while minimizing trade and logistics cost,” he added.

According to the trade chief, investors can fully recoup their investments as their businesses enjoy the benefits of operating in a fully-industrialized and secure business environment. They can also enjoy PH’s stable macroeconomic fundamentals, the educated English-speaking workforce, the demographic sweet spot that presents an enlarging consumer base, and wider market access thru preferential trade agreements.

“The hallmark of Dutertenomics is to attain growth with equity, that is, addressing inequality while reducing poverty across the regions towards improved quality of life for all,” he added.

Dutertenomics sums up President Rodrigo Duterte’s key 10-point socio-economic commitment to widen the gains of development, to address income gap and to uplift the quality of life of Filipinos.

Under Dutertenomics is the Build Build Build program that aims to develop massive and efficient infrastructure projects to create more opportunities in the countryside by developing more regional growth centers.

According to Sec. Lopez, PH has its greatest asset in its people: a large pool of highly qualified and educated work force that are strongly customer-oriented, highly trainable with fast learning curve, adaptable to universal cultures and with high level of commitment and loyalty.

He also shared with the audience, which includes British businessmen, that the country’s independent foreign policy strengthens Philippine ties with its partners and has opened new market prospects.

Major players Japan, China, Russia, and the Middle East have been involved in various cooperation projects with PH that translated to increased investments and more job and income opportunities. Sec. Lopez also shared the potential of the Regional Comprehensive Economic Partnership (RCEP) as key to open a huge integrated market base of 3.5 billion with ASEAN plus six Dialogue Partners China, Korea, China, Japan, Australia and New Zealand.

“To simplify, we convert trade and investment gains into employment opportunities for Filipinos, helping them move up in life. At the same time, we develop innovative, competitive, job-generating industries where PH has competitive edge,” said Sec. Lopez.

“Manufacturing, agriculture, infrastructure, services and tourism are the country’s critical industries,” he concluded. - DTI PR

DTI, TESDA ink MOA to offer
entrepreneurship trainings for TESDA grads

As part of the agency’s thrust to increase awareness on the positive gains of entrepreneurship, the Department of Trade and Industry (DTI) and Technical Education and Skills Development Authority (TESDA) link up to provide TESDA graduates with access to trainings on entrepreneurship to help generate to equip them with the necessary skills on entrepreneurship and employment.

According to DTI Sec. Ramon Lopez, acquired business skills by TESDA trainees from the Skills Training for Employment/Entrepreneurship Program (STEEP) can be used in effectively running their businesses in the future.

“This partnership not only complements our objective to equip our people with the right mindset and basic skills, it also contributes to our national goal to realize inclusive growth towards shared prosperity, powered by smarter Filipino entrepreneurs,” Sec. Lopez said.

STEEP aims provide interventions through skills development by providing access to training on entrepreneurship to graduates of TESDA program for self or wage employment to uplift their economic status.

“Through this partnership, we are glad to help TESDA graduates acquire more skills and development which can give them more opportunities to improve their lives by engaging in vibrant entrepreneurial activities,” said DTI Regional Operations Group Undersecretary Zenaida Maglaya.

Under the agreement, TESDA will provide its list of graduates to DTI from the Special Training for Employment Program (STEP) and other similar scholarship program, assist in the conduct of the entrepreneurship training, and monitor and evaluate the implementation of the project.

Upon assessment and selection of TESDA’s certified STEP graduates, DTI, in turn, will provide entrepreneurship training, assist in availment of the microfinancing facilities, provide them access to start-up capital for micro enterprises, and even facilitate business registration of those who wish to engage in business/sole proprietorship.

“This is the service that we will provide to them,” Maglaya explained, adding that “from giving them the right mindset, to ensuring that they will have assistance until they decided to put up their own business, we will make sure that we are with them every step of their entrepreneurial journey.”

The STEEP agreement with TESDA is one of the Department’s initiatives to sustainably generate employment and further promote entrepreneurship in the country as DTI pushes for its “Trabaho at Negosyo” agenda. - DTI PR

Southern Leyte governor dismissed from the service
10 August 2017

The Office of the Ombudsman has ordered the dismissal from the service of Southern Leyte Governor Damian Mercado after he was found guilty of Grave Misconduct for mishandling the 2007 procurement of second-hand vehicles.  The dismissal order carries the accessory penalties of perpetual disqualification from holding public office, forfeiture of retirement benefits, cancellation of eligibility and bar from taking the civil service examinations.  Governor Mercado and five other local executives are also set to face trial before the Sandiganbayan for violation of Section 3(e) of the Anti-Graft and Corrupt Practices Act (Republic Act No. 3019).

Charged alongside Mercado are  Bids and Awards Committee (BAC) Chairman Crispin Arong, Jr., BAC Vice-Chairperson Feorillo Demeterio, Jr.; BAC members Anecito Narit, Benjase Lumen and Consuelo Ladrera; and supplier Baltazar Avila, Sr. of Kojac Auto Repair Shop and Auto Supply.  Arong, et. al. were also found guilty of Grave Misconduct and ordered dismissed from the service.

Records of the investigation showed that in 2007, Mercado, then Maasin City Mayor, approved the purchase of three reconditioned vehicles totaling P2.3million. After bidding, the acquisition of the Mitsubishi Pajero, Isuzu Wizard and Toyota Grandia was awarded to Kojac Auto Repair Shop.   In-depth investigation found, however, that Mercado was the original owner of the Grandia which was sold to Avila in November 2006 for P390,000.00 and that the Wizard was acquired by Avila in 2006 for only P275,000.00.   Ombudsman investigators also found that “by the time the procurements were made, the Mitsubishi Pajero unit was already 13 years old while the Toyota Grandia was 11 years old and the Isuzu Wizard was 12 years old.”

In its Joint Resolution, the Ombudsman stated that respondents “exhibited manifest partiality, evident bad faith or gross inexcusable negligence in awarding the procurement contracts to Kojac without regard to pertinent law and rules.”

The Ombudsman explained that the BAC failed to show any proof of advertisement of the invitation to bid to ensure competitive bidding as the records only contain notices addressed to Kojac.  Respondents were also held liable for failing to meet the requirement on “remaining useful life in the procurement of second-hand or reconditioned vehicles as required under Department of Budget and Management National Budget Circular No. 446-A.” Under the circular, the remaining useful life of the vehicle to be purchased must not be lower than five years in the case of high official function cars, passenger vans and other service vehicles and three years for utility vehicles.  The respondents were also faulted for undue reference to brand names as the purchase requests clearly reflected the particular brand of vehicle to be bought, a prohibition under the Government Procurement Reform Act (Republic Act No. 9184).

â€œGiven that the subject vehicles were already more than 10 years old when these were purchased, their remaining useful life is obviously below the standard prescribed in the Circular,” the Joint Resolution reads.

“Whether the vehicles are in good condition, still functioning properly, or has been refurbished is also not considered material in determining their remaining useful life,” added the Ombudsman.
According to Ombudsman Conchita Carpio Morales, “as head of the procuring entity, [Mercado] has a duty to ensure that all the procurements of the city government are in compliance with the law and other applicable rules.”

Taxi operators eye similar ride-hailing app as Uber, Grab
August 3, 2017, 4:31 pm Share

MANILA, Aug. 3 -- A taxi operators group on Wednesday said that it is eyeing the creation a ride-hailing application similar to Uber and Grab to “level the playing field” in providing transportation service to the public.

Philippine National Taxi Operators Association (PNTOA) head Bong Suntay, during a Senate hearing on Wednesday, recognized that taxis and its drivers had its flaws, but stressed that these were due to “limits” to regulations set by the Land Transportation Franchising and Regulatory Board (LTFRB).

Taxi operators have repeatedly blamed Uber and Grab for a decline in the number of passengers who hail taxis and for the number of drivers who prefer to work for transport network companies (TNCs).

"We have nothing against Uber and Grab. We have always believed that the market is big enough for all of us to co-exist but co-existence but under a level playing field," Suntay said.

Suntay acknowledged that while taxi drivers refused passengers, usually during traffic, it was because they did not have the dynamic pricing scheme or surge pricing offered by transport network vehicle services (TNVS).

"What makes them distinct is they could use the application to tell passengers how much they pay. We are limited on using the taxi meter. We basically use the same vehicles. What makes us distinct are regulations," he added.

Suntay also asked for the conduct an "automatic review" of taxi fare every two years with or without inflation.

Former taxi driver now Grab driver Ronald de Guzman, agreed that the reason why he switched to driving for a TNVS service was because he could not meet the daily boundary required for taxis at PHP1,200 to 1,500.

Grab Country Head Brian Cu said that a Grab driver earns around PHP18,000 a month (or five and a half day) or PHP600-700 daily.

Senator Grace Poe, chair of the Senate Committee on Public Services, welcomed the proposal to create an app for taxis and the request for a review of taxi fare every two years.

"We’re going to craft a law that makes it fair (for both taxis and TNVS). Developing an app wherein taxis can be contracted will allow them to have price competition," Poe told reporters in an interview.

"We should have an automatic review. The reason why (taxi) drivers refuse passengers, complain, is because of traffic and the meager amount they earn while Grab and Uber are allowed to have price surges. It’s not a level playing field. That’s what we need to consider in crafting legislation," she added. (Azer N. Parrocha/PNA)

Undisciplined Bohol drivers blamed for surge of accidents

Human error, as what Bohol Police authorities would call it, is largely the prime cause of traffic-related physical injury cases.

Defensive drivers here, however, have a diagnosis for that: unregulated issuance of drivers licenses and graft.

No matter how careful you are, still there are drivers who apparently have no knowledge about traffic rules and make the roads just as dangerous to them, to other drivers and even to pedestrians, according to observers.

There used to be a time when licenses can be issued as long as one is willing to pay, another driver said.

The facility of owning a motorcycle, with companies offering tempting low down-payment schemes exacerbate the problem, traffic enforcers also add, citing most accidents by motorcycles.

Claiming 84 percent of the 984 traffic related injury cases noted from January to July 2017, accidents caused by human error zoomed as high as 835 cases, according to a report from Camp Dagohoy.

In a report delivered before the Provincial Peace and Order Council (PPOC) meeting, Camp Dagohoy crime statisticians defined human error as generally over speeding and other driving transgressions dependent on the human factor.

Also included in the definition is premature over taking, driving under influence of liquor, improper turns, untrained driver, aggressive driver, hitting pedestrians, driving in the wrong lane and drowsy driving.

Police noted that over-speeding cases resulting to injuries reached 163 cases in the first seven months white premature overtaking, which again is a case of over-speeding, reached 159 cases.

Bohol police also noted that cases of improper turns which has caused physical injuries and damage to property reached 115 while police also noted 101 cases of physical injuries by untrained drivers.

Crime statisticians also noted aggressive driving (69 cases), pedestrian lane violations (38 cases), and drowsy driving (22 cases).

Police authorities however also see non-human factors in these physical injury cases concerning traffic related incidents.

These, they said include design defects (26), brake failure (15 cases) and tire blow outs (3 cases).

Considering these, observers said a design defect in a vehicle is worth a lemon suit, of which, none of such has been filed or a recall from manufacturers implemented.
A brake failure and tire blow-out could also happen because of poor vehicle maintenance, which should fall under human error.

Camp Dagohoy, on the other hand, admitted that road obstructions due to flurry of road construction activities, absence of proper signage, slippery roads have already caused several accidents. (Rey Anthony Chiu/PIA)

WHY IS DFA’S OVERSEAS ABSENTEE VOTER REGISTRATION TARGET
JUST AT 10 PERCENT IN 2017?

In the 2018 budget proposal for the Department of Foreign Affairs, the Performance Indicators section states: >10 percent increase in the number of overseas Filipino voters registered over the previous election.

Just 10 percent as a minimum growth target? Compare that to the COMELEC goal of receiving one million new Overseas Absentee Voters. I now ask matter of factly, which is the more realistic goal, the goal of DFA or the goal of COMELEC?

COMELEC also said that its Office for Overseas Voting (OFOV) has urged 205,697 voters (deactivated after the May 2016 polls for failure to vote in two consecutive national elections) to reactivate their registration status.

Overseas voter reactivation can be done by the overseas Filipino simply by going to the embassy or consulate in the country where they are based, or the OFOV in COMELEC Intramuros or their local COMELEC office if they are in the homeland.

COMELEC said as per data as of October 17, 2016, some 58,992 of the deactivated voters are land-based while 146,705 are seafarers. If they do not reactivate they cannot vote in the 2019 elections.

COMELEC said there were 1,376,067 registered OAV in the May 9, 2016 National and Local Elections. My questions to the DFA:

1.           Are your seeking out each and every one of these deactivated 205,697 Overseas Filipino voters?  What is your registration target in 2018?

2.           What are you doing now and will do in 2018 to help the COMELEC add one million more overseas absentee registrants? Will you help COMELEC?

3.    The proposed DFA 2018 budget has P1,257,670,000.00 for protection of the rights and welfare of overseas Filipinos. How, in detail, does the DFA intend to spend this?

‘Collaborate, communicate’
â€"PH on the future of ASEAN

KUALA LUMPURâ€"As ASEAN celebrates its 50th founding anniversary, 2017 marks an opportune time to reflect on what ASEAN has achieved over the past five decades and what it seeks to accomplish ahead.

Speaking at the ASEAN@50 Conference in Kuala Lumpur on 4 August before an assembly of audience representing various stakeholders, ASEAN 2017 Economic Ministers chairman and Philippine Trade Secretary Ramon Lopez said that collaboration and communication are two essential elements to keep ASEAN moving.

“The region has to focus on two Cs, Collaboration and Communication. By engaging multi-stakeholders, ASEAN develops a win-win solution in ensuring that economic opportunities will be equitably felt by all ASEAN citizens,” he said.

Since its inception in 1967, the 10-member regional organization has transformed into a global economic powerhouse, with a population of 622 million and has become one of the world’s fastest growing investment destinations.

ASEAN’s total trade increased by USD 700 billion between 2007 and 2015, with intra-ASEAN trade comprising the largest share. In 2015, ASEAN attracted USD 121 billion of FDI with intra-ASEAN constituting the largest share of inflows. .

Sec. Lopez said that ASEAN should aim to communicate its programs and priorities to the ASEAN citizens, providing them with the right platform to know how they can contribute to the region’s growth story.

“Our communication must be sustained and intensified if we want to reap the benefits of the ASEAN Economic Community (AEC), working towards a deeper regional integration in 2025,” he added.

The trade chief made reference to the ASEAN 2025: Forging Ahead Together as a forward-looking roadmap to prepare the region in the next phase of evolvement, and which charts the pathway for strengthening the ASEAN Community over the next 10 years.

As one of the three pillars of the ASEAN Community, the AEC is a realization of ASEAN’s goal to have an integrated and prosperous economic region with a single marketâ€"where there is free movement of goods, services and investments.

“ASEAN’s continuing economic transformation remains an example of how regional integration and cooperation is plausible despite challenges and diversity in size, geography, political background, and culture,” the trade chief said.

AEC reflects connectedness and translates diversity into strength as ASEAN’s variety becomes a source of attraction to global investors, mindful of the region’s stake in open global markets.

According to Sec. Lopez, promoting complementation and cooperation is at the heart of ASEAN integration efforts. Closer trade and enhanced economic cooperation, combined with continued engagement with Dialogue Partners, provides the region with a solid platform to continuously bolster the region’s growth and promote complementation of domestic reforms among Member States.

ASEAN has also become a significant link to the international community because of the dynamism and the huge potential it offers to the world.

“We have engaged our major trading partners namely Australia, China, India, Japan, Korea, and New Zealand in free trade agreements, negotiating as a single ASEAN entity rather than as individual economies discussing bilateral trade arrangements,” Sec. Lopez added.

In 2013, ASEAN initiated negotiations for a Regional Comprehensive Economic Partnership (RCEP), which aims to expand the current ASEAN market to a huge integrated market of 3.5 billion with its six Dialogue Partners China, Korea, Japan, Australia, New Zealand and India.

Sec. Lopez also took the opportunity to present the Philippine agenda as the current ASEAN chair. Under the inclusive, innovation-led growth theme, the country is poised to champion the development and internationalization of micro, small, and medium enterprises (MSMEs) with key strategic measures to increase trade and investment, integrate MSMEs in global value chains and pursue an innovation-led economy.

“ASEAN continues to develop into a pivotal marketplace with its relatively young, growing labor force and emerging middle class,” he said, adding that ASEAN has transformed into a community of dramatic diversity and manifold opportunities.

Philippine Education / Free College Education Act
August 05, 2017, 03:54:10 PM
1-Ang Edukasyon Rep. Salvador Belaro is one of the principal authors of the House version of the Free College Education Act - House Bill 5633 AN ACT PROMOTING UNIVERSAL ACCESS TO QUALITY TERTIARY EDUCATION BY PROVIDING FOR FREE TUITION AND OTHER SCHOOL FEES IN STATE UNIVERSITIES AND COLLEGES AND STATE-RUN TECHNICAL-VOCATIONAL INSTITUTIONS, STRENGTHENING THE UNIFIED STUDENT FINANCIAL ASSISTANCE SYSTEM FOR TERTIARY EDUCATION, AND APPROPRIATING FUNDS THEREFOR. Seven (7) bills penned by Rep. Belaro were consolidated into HB 5633.

Thank you Mr. President for signing into law the Universal Access to Quality Tertiary Education Act that both chambers of Congress approved. Pinatunayan po ninyo na sa sa administrasyong ito, totoong “Una Ang Edukasyon.”

Now to my colleagues in Congress, if we want to make Universal Access to Quality Tertiary Education happen, we then must find the billions and billions of pesos needed to fund it. We must do this during these ongoing budget deliberations.

Congress must also double check the estimate of the DBM. The Congressional Planning and Budget Office can do this. P100 billion, estimated by Sec. Ben Diokno, would not be easy to find. We would not need just P100 billion for 2018. We also must think about all succeeding years.

These are the steps I propose to my colleagues in Congress:

First, we would have to realign some budget items. Specifically, I am looking at the Gender and Development funds which is one of the most under-tapped items. We support access to education for all genders. There can be other items Congress can realign.

Second, to augment the budget for free college education, the government can issue EDUCATION BONDS.

I suggest the issuance of long-term bonds issued in various denominations to attract small, medium, and large investors alike.

If government is unable to find the budget needed to fund Universal Access to Quality Tertiary Education because cutting the budgets of other departments would just be too painful, then let us ask the entire country, the whole world even to invest in the education of our youth through the EDUCATION BONDS.

For the next five years of the Duterte administration until 2022, we would need at least P500 billion, assuming that DBM’s calculations are correct.

Let me take this opportunity to reiterate my appeal to add more capital outlay funds for not just some but for all state universities and colleges. SUCs need to Build, Build, Build also to replace and rehabilitate all those old and obsolete buildings and facilities on their campuses.

If capital outlays for SUCs will be added to the long-term bonds solution, we clearly would need more than just P500 billion for the SUCs until 2022.

Rep. Jess Manalo to push for budgets of crime labs

The problem in situations such as this encounter between the police and the now dead mayor of Ozamiz City is we cannot base our analysis of what happened just on the say so of either side. Their statements will naturally oppose each other.

Aside from intense interrogation of both sides by impartial investigators, perhaps the National Bureau of Investigation, the National Police Commission, the Ombudsman, or the Commission on Human Rights, we need scientific evidence and unedited video of the actual police raid.

We need forensic investigation by either the PNP Crime Laboratory or the NBI forensic lab.

We have several investigative agencies and that in itself is a problem. In addition to the probe agencies aforementioned, we also have a Peoples Law Enforcement Board, from which we hardly hear any accomplishments or activities.

We need bodycam video on every police officer. Bodycam video they cannot switch off. Bodycam gadgets the police officer cannot take off lest they face immediate suspension without pay.

Absent these factors that can help us determine who are guilty and corrupt, how can any of us say who did what was right and just and proper in this police raid?

Having laid down the premises, I will file tomorrow morning a bill for a Body Cam Law.

As Member of the Committee on Appropriations, I will support reasonable adequate funding for the the crime labs of both the PNP and NBI.

As Member of the Committee on Public Order and Safety and the Committee on Illegal Drugs, I will also seek the counsel of legal luminaries on how to improve or make better sense of having all of these investigative bodies and overlaps.

Offhand, I see the need for a rationalized system for the impartial investigation of police raids, encounters involving the police or military or any other armed service.

I sense exasperation, disappointment, and confusion from the public on our having to many investigating agencies.

But I also sense a desire by that same public to trust the authorities. They simply want a system that makes sense and can conduct impartial, evidence-based investigations. (END)

(Manila, Philippines). The Department of Energy (DOE) announced Friday (28 July) the maiden hosting of the Philippines of the Asia Cooperation Dialogue (ACD) to be held on 7-10 August 2017 in Panglao Island, Bohol.

Energy Secretary Alfonso G. Cusi said, “The hosting of ACD gives greater emphasis on the evolving global developments concerning energy and the environment and the energy-water-food nexus.”

“These topics are the key areas of cooperation where Asian nations can consolidate and expand efforts to ensure a secure, affordable, sustainable and resilient energy supplies in the region,” Cusi emphasized.

Established in June 2002, the ACD is a gathering of Asian countries to promote interdependence among Asian members in all areas of cooperation, one of which is on energy.

This year’s ACD Conference will focus on energy security, sustainability and resiliency as well as energy's relation to water and food.

The conference aims to gather energy policy makers in the region to discuss latest developments in their respective countries, and encourage consultations in identifying new cooperation initiatives that may be implemented in the ACD region.

Specifically, the Conference aims to promote information exchange and the sharing of best practices on energy policies, plans and programs among ACD Member States.

It will also be an avenue to drive investments in the following priority areas: (1) Renewable Energy and Clean Energy; (2) Natural Gas as Transition Fuel; (3) Low Carbon Future Thru Clean Energy Technologies; (4) Emerging Role of Nuclear Energy; (5) Energy Connectivity and Market Integration; and (6) The Role of the Younger Generation on the Future of Energy Development.

Participating countries are expected to share information and experiences on building a resilient energy sector, especially among high-risk countries on the adverse effects of changing weather patterns and disasters.

The other objectives of the ACD, Cusi said, are to expand trade and financial markets within Asia, and ultimately transform the Asian continent into One Asian Community.

Press Release: Cong. Relampagos Seeks Help of NGOs, Private Sector for Marawi Rehab

Bohol First District Representative Rene L. Relampagos has underscored the importance of land and housing development in achieving economic and social progress, stressing the right of every Filipino to affordable, safe, decent and resilient shelter.

Speaking at the 7th Monthly Business Meeting of the Chamber of Real Estate and Builders’ Association (CREBA) at Makati City last July 27, 2017, he urged the real estate industry and all stakeholders to help in the recovery, reconstruction and rehabilitation of Marawi City and other areas affected by the ongoing armed conflict between government forces and the Maute group.

“Let’s work together in restoring hope, peace and dignity in Marawi City and other affected areas. The most vulnerable sector in need of housing today is the sector of the internally displaced persons or the bakwits. And nowadays when we think of bakwits, the first that comes to mind are the victims of the ongoing insurgency in the City of Marawi. The rebuilding of Marawi, believe me, is not a task of the government alone. In all success stories, partnership between and among stakeholders, coming from both the private and the public sectors, are essential,” Cong. Relampagos stressed.

According to the United Nations Office for the Coordination of Humanitarian Affairs on the conflict in Marawi City, the number of internally displaced persons (IDPs) has reached 351,168, with the number of IDPs staying at evacuation centers (ECs) at 17,389 and the number of IDPs living with family/friends at 333,779.

He added, “Our Maranao brothers and sisters need to know that people care for them. When a person is in their lowest, the sweetest help are those coming from complete strangers. It doesn’t matter whether the help be big or small, what matters is that there is help. This we experienced during the 7.2-magnitude earthquake that shook Bohol in 2013. The surviving families of the members of the military and the police force who fought and died in the Marawi clash are also worthy of consideration as beneficiaries of your housing aspirations. After all, they lost their lives fighting for peace and security in our country.”

He further emphasized that the entitlement to have adequate housing is a right and not a privilege that is given to all, not just to a few. “The housing component of every civilization is not complied with after the construction of four walls and a roof to shelter a family. It is building houses that affirms and respects human dignity that fulfills this promise. Indeed the task of building homes for every Filipino is daunting but all dreams start with a single step and what best way than to start with those who need the most help,” Cong. Relampagos concluded.

CREBA is the Philippine umbrella organization of the real estate and housing industry composed of property developers, builders, contractors, suppliers and manufacturers of construction materials, real estate service practitioners and other professionals and entities engaged in 70 allied fields. CREBA’s “Five-Point Agenda for Housing” includes the vision of “A Home for Every Filipino” and targets the construction of 500,000 housing units per year to address homelessness within a period of 20 years.

Manila, July 29, 2017 â€" Officials from the Joint United States Military Assistance Group (JUSMAG) recently delivered 1,040 2.75” rocket motors and 992 2.75" rockets to the Philippine Air Force (PAF) through the Mutual Logistics Support Agreement (MLSA).  These timely transfers greatly enhance the Armed Forces of the Philippines’ (AFP) counterterrorism efforts. They are part of a series of upcoming transfers from the U.S. military to multiple branches of the AFP through both MLSA and the security assistance program.  Through the MLSA, the AFP is able to receive select munitions and equipment from U.S. military stock in an accelerated process reserved for allies and close partners of the United States.

The munitions and weapons deliveries will enhance the AFP’s counterterrorism capabilities, and directly support AFP members actively engaged in counterterrorism operations in the southern Philippines, including Marawi.  Upcoming weapons deliveries include 250 rocket-propelled grenade launchers and 1,000 M203 grenade launchers delivered to the Philippine Army through the security assistance program.

The United States is a proud and steadfast ally of the Philippines and will continue to provide support to the AFP’s long-term modernization goals and counterterrorism needs.

Full launch of PNTR set on August 1

The Philippine National Trade Repository (PNTR) which is a web-based portal that provides a single source of comprehensive, accurate and updated trade information will finally be launched on August 1, 2017. Its establishment is an important component of the government’s trade facilitation strategy. A more transparent trade environment will allow business easier access to information and facilitate their compliance with prescribed regulations. The ultimate effect will be to reduce the amount of time and costs in trade transactions.

The launching will be participated in by the Trade Regulatory Government Agencies (TRGAs), representatives from the private sector and selected importers accredited by the Department of Agriculture.

Expected to grace the event are the EXCOM Members of the Department of Trade and Industry, headed by the Undersecretary of the Industry Development and Trade Policy Group, Dr. Ceferino S. Rodolfo who will provide the keynote speech on behalf of DTI Secretary Ramon M. Lopez.

Dr. Cielito F. Habito, Chief of Party of the USAID- Trade Project is among the guest speakers, together with Mr. Walter Van Hattum, Head of Economic and Trade Section, EU Delegation to the Philippines.

One of the highlights of the event is the MOA signing between the Tariff Commission and the Department of Trade and Industry- Bureau of Import Services. The PNTR’s seamless commodity search function became possible because of the wholehearted cooperation of Chairperson Marilou P. Mendoza of the Tariff Commission. The first three elements of the PNTR, the Tariff Nomenclature, the MFN tariffs and the Rules of Origin are linked to the Enhanced Philippine Tariff Finder (EPTF) of the Tariff Commission.

The formal launching of the PNTR portal will be presented by Mr. Roberto Galang of the International Finance Corporation, the World Bank’s private sector arm.  Through support from the Government of Canada, the project team led by Mr. Terence Chapman provided significant enhancements to the portal, in particular on the element of the Non-Tariff Measures and commodity search function.

Atty. Luis M. Catibayan, the PNTR Secretariat Head enjoins everyone to visit the PNTR portal at www.pntr.gov.ph. The PNTR is expected to benefit our stakeholders primarily Micro Small and Medium Enterprises (MSMEs) as the regulations and procedures administered and enforced by various government agencies are made readily accessible thru the internet.

Atty. Catibayan further stressed that the PNTR makes the regulations transparent and contributes to the ease of doing business. The PNTR’s link to the ASEAN Trade Repository will allow MSMEs who are into exports to have accurate and updated information, including regulatory requirements for the movement of goods to and among ASEAN member states, thereby facilitating greater access to the ASEAN market.

For inquiries about the PNTR portal, please send email at info@pntr.gov.ph or visit: www.pntr.gov.ph/ www.dti.gov.ph.

Government policies, guidelines, regulations, and procedures concerning the suspension or cancellation of classes and work have been limited to public storm warnings.

All too often, authorities have not been timely and accurate in their declaration of class and work suspensions or cancellations.

Widespread confusion, chaos, and disruption of peoples’ lives have frequently resulted from the lack of a rational system governing suspension or cancellation of classes and work.

This bill factors in not just storms, but also floods, landslides, earthquakes, tsunami, storm surge, toxic chemical spills, fire, active shooter situations, hostage-taking, kidnapping, banditry, terrorism, and state of emergency.

Classes and work may also be suspended or canceled because of widespread loss of electric power distribution, water supply distribution, or non-functioning of sewerage systems and widespread collapse or offline status of several banking or financial systems that disrupt the normal functioning or cause serious financial incapacity or disruption of households, communities, institutions, and workplaces.

Implementing rules and regulations will be crafted and promulgated by an inter-agency and multi-sectoral committee.

DTI-PTTC SME Week Free Seminars: 39 MSMEs Sign Up for E-Commerce

The Philippine Trade Training Center (PTTC), the training arm of the Department of Trade and Industry (DTI), recently conducted a total of 23 free seminars geared towards enhancing MSME’s managerial and technological capabilities during SME Week held on July 18-19, 2017 at the PTTC grounds.

With the theme “Moving Towards Skilled, Market-Driven and Engaged MSMEs”, the two-day event was attended by about 367 MSMEs. After participating in the UREKA Forum, 24 signed up for Shopinas, an online store of Philippine products, and an additional 15 after attending the seminar on "Doing Business in E-marketplaces."

As DTI Assistant Secretary Rosvi C. Gaetos emphasized in her opening remarks, “PTTC’s role and commitment in providing various training programs is to help MSMEs catapult into the global markets with the overarching goal of transforming them into global business entrepreneurs”.

Trade chief to construction industry players: ramp up your work force

MAKATIâ€"To support the government’s massive “Build! Build! Build!” program, a sufficient and steady manpower is vital to ensure proper infrastructure building and industry development, the country’s trade chief has said.

During the Philippine Construction Human Resource Forum 2017 on July 19, Department of Trade and Industry (DTI) Secretary Ramon Lopez urged industry players to help the government institutionalize human resource (HR) development in the construction industry.

“A well-designed compensation and benefits plan could be of great help in attracting, motivating and retaining talents in the industry,” said Sec. Lopez.

With the strong demographic fundamentals of the country, DTI aims to utilize the country’s labor force capacity to meet the massive labor requirements in anticipation of the surge of infrastructure projects in the coming years.

The trade chief highlighted the importance of capacitating workers, and equipping them with skill sets that will further lead to greater job satisfaction, stronger employee loyalty, and higher productivity.

DTIâ€"together with the Labor Department, the National Economic Development Authority, the Philippine Statistics Authority and the Professional Regulation Commissionâ€"collaborated with the International Labor Organization (ILO) and construction HR practitioners to develop a standardized compensation program that will align benefits plan for talents in Philippine companies.

“I am confident that our joint initiatives will provide the needed impetus to create a new phase in construction HR development that would be more responsive to the industry’s manpower requirements,” said Sec. Lopez.

The first-ever Construction HR Forum is a pioneering initiative of the Construction Industry Authority of the Philippines (CIAP) and the Construction Manpower Development Foundation (CMDF), the construction industry development and regulation arms of the DTI.

The goal of the Forum was to lay the manpower groundwork as the Philippines approaches the “Golden Age of Infrastructure” through the “Build! Build! Build!” Program.

“Let us work together to foster a collaborative environment that would support our construction industry as we build a nation where our countrymen can enjoy the fruits of our country’s inclusive growth,” he concluded.

MILLENNIAL SOLON RAISES TRANSPORT ISSUES AGENDA BEFORE HOUSE HEARING

On July 25, 2017, during the first hearing of the Committee on Transportation following President Duterte’s SONA, the 28-year-old House Assistant Minority Leader Neil Abayon enumerated the transport issues that need to be prioritized by the Committee. In attendance were the LTFRB Board Members and officials, TNC executives, TNVS drivers and other stakeholders.

1. Underlying all the problems affecting the riding public, besetting the LTFRB, and rippling through the transport sector are ARCHAIC LAWS on public transportation, public services, road use, road safety, and traffic. On these largely obsolete laws are many regulations and institutional paradigms.

2. We are no longer in the Commonwealth Era (when the Public Service Act became law) or in the 1960s (when the Land Transportation and Traffic Code and the Contractors License Law were enacted) or in the Marcos Era (when the Accessibility Law came to be).

3. These are but some of the major laws that need overhaul or updating to present-day situations and adjusting with built-in mechanisms for adapting to changes in the future.

4. The Land Transportation Franchising and Regulatory Board needs a new charter that will empower the LTFRB with a new mindset to solve the problems of today and the future instead of living in the past and bound by the laws of decades past.

5. We also need a National Road and Rail Safety agency with the specific mission of investigating all mishaps on the roads and involving rail systems.

6. It is imperative that we have better laws on traffic law enforcement nationwide. We have new laws on the wearing of helmets and riding on motorcycles, but these laws are not consistently and effectively implemented. There are also local ordinances that go against the national law on wearing helmets.

7. These times require us to promote and support automotive engineering, automotive technology development, civil engineering, and disaster adaption and mitigation of our transport systems with laws, policies, programs, and appropriations.

8. There is strong resistance to the phase out of old public utility jeepneys and the entry of the transport network vehicle services (TNVS) and Transport Network Companies because of the refusal to accept necessary change and refusal to admit obsolescence.

9. Finally, we have unacceptably high rates of deadly mishaps involving motorcycles and old trucks and jeepneys because of unaddressed underlying economic reasonsâ€"some of which can be addressed with new laws and effective implementation.

10. This Second Regular Session of Congress is the right time for the 17th Congress, particularly the House of Representatives, to prove it can get things done and done well.

11. We have more than 240 pending bills of national application in the House Committee on Transportation. It is now time to prioritize and rank the different bills. We also must also swiftly process bills that shall be the counterparts of Senate bills that are already past Second Reading, in Third Reading, or approved on Third Reading because those are deliverables that can become laws sooner than bills still in the early stages in this House.

12. Lastly, we have to revisit the proposed emergency powers bill earlier proposed to address urgent problems.

Manila, July 26, 2017 â€" The U.S. Embassy sponsored six Filipino maritime law enforcement experts to attend a curriculum development workshop on underwater crime scene investigation training in San Diego, California, from July 17 to 20, 2017.  The workshop is part of a larger P25 million U.S. government initiative to strengthen underwater crime scene investigation training programs for Philippine maritime law enforcement agencies, through partnership with the Port of San Diego Harbor Police Department and the U.S. Department of State Bureau of International Narcotics and Law Enforcement (INL).

Filipino experts from the Philippine Coast Guard, the Bureau of Fisheries and Aquatic Resources, and the Philippine National Police Maritime Group, met with U.S. counterparts, including representatives from the Port of San Diego Harbor Police dive team, U.S. Embassy Manila INL, and INL's Office of Criminal Justice Assistance and Partnership, to develop a special diver training course for underwater search, crime scene, and disaster investigations.

The course aims to equip Philippine divers from all three participating agencies with a variety of skills, including detecting illegal drugs smuggled on the hull of vessels or dumped overboard for later retrieval.  Once finalized, the course will be incorporated into the training academies of the three participating Philippine agencies.

Through the U.S. Embassy's INL programs, the Philippine government builds more effective law enforcement institutions and justice systems by drawing on American expertise in combatting crime, corruption, and narcotics trafficking.  The U.S. Department of State has more than 110 partners across the United States to facilitate training and exchanges with foreign countries, including with federal law enforcement agencies; state and local police and corrections departments; local and state courts; district attorney’s offices and public defenders; port authorities; and professional associations, academic institutions, and civil society organizations.

U.S. Military Presents Two New ISR Aircraft to Philippine Air Force

Manila, July 27 , 2017 â€" U.S. Ambassador to the Philippines Sung Y. Kim, joined by Deputy Commander, Pacific Command, Lt. Gen. Bryan Fenton, presented Secretary of National Defense Delfin N. Lorenzana with two new Cessna 208B aircraft during a transfer ceremony at Villamor Air Base, Pasay City on July 27.  Chief of Staff of the Armed Forces of the Philippines (AFP) Gen. Eduardo Año and Commanding General of the Philippine Air Force (PAF) Lt. Gen. Edgar Fallorina also participated in the ceremony, along with representatives from the U.S. Embassy.

The two new aircraft, valued at Php 1.67 billion, were delivered to Lt. Gen. Fallorina, through the U.S. National Defense Authorization Act Building Partnership Capacity Program.  This delivery is the latest donation from the United States government, which over the last five years has allocated more than Php15 billion of grant funding to provide the AFP with up-to-date equipment and training.  The equipment transfers, training, and continued bilateral exercises demonstrate the commitment of the United States to work with the Philippines in building capabilities towards eradicating global terror networks.

Since 2007, representatives from the Joint United States Military Assistance Group (JUSMAG) in the Philippines have delivered and programmed more than Php7.4 billion worth of military equipment to the AFP to enhance counterterrorism capabilities.  In addition, the AFP has procured small-arms weapons, maritime assault boats, vehicles, unmanned aerial systems, and personal protective equipment as part of the U.S. government’s security assistance programs.

The PAF’s 300th Air Intelligence and Security Group (300 AISG), based out of Edwin Andrews Air Base in Zamboanga will operate the two new C-208B aircraft.  300 AISG is the leading unit for air intelligence surveillance and reconnaissance operations for the Armed Forces of the Philippines (AFP).

The Cessna 208B aircraft will enhance the PAF’s counterterrorism capabilities, and help protect AFP members actively engaged in counterterrorism operations in the southern Philippines, to include Marawi.  Equipped with advanced sensors, cameras and communications equipment, these aircraft will significantly enhance the ability of the AFP to locate terrorist groups operating in Mindanao and the Sulu Archipelago.

The United States, as a steadfast ally of the Philippines, continues to provide support to the AFP through both grant assistance and expedited sales of arms and munitions to support both long-term AFP modernization goals and urgent counterterrorism requirements.

As number of new HIV/AIDS cases zooms to 1,098 - highest since 1984

I respectfully urge the Committee on Health to urgently tackle all the pending bills on HIV-AIDS and convene hearings on them.  The Senate already has a consolidated version and it is waiting for the House counterpart measure.

As soon as the House hammers out a consolidated bill on HIV policy, I will formally urge President Rodrigo Roa Duterte to certify it as urgent, so the two bills can move even faster and more likely become law before Congress goes on recess on December 16.

It is no longer necessary for me to file another bill to add to the ones already filed. My colleagues have crafted good proposed measures. I prefer to fine-tune them when it is deliberated at committee and during plenary.

As of latest count there are 16 bills in the Committee on Health and two more on discrimination against persons with HIV pending before the Committee on Human Rights.

I am in consultation with concerned stakeholders and will present my suggestions at the proper time, so that the consolidated bill we produce will address the crucial issues facing us about arresting the surge of HIV nationwide and across all age groups, especially among the millennials.

The latest statistics on HIV in our country have become even more frightening. Congress must act fast to give the Department of Health and other concerned sectors the means and resources to fight HIV-AIDS now.

Ombudsman requests NBI to entrap investigator for extortion raps
25 July 2017

The Office of the Ombudsman has requested the National Bureau of Investigation (NBI) to entrap Leonardo Nicolas, an Associate Graft Investigation Officer III (AGIO III) for extortion.   The request for assistance was made as part of the Ombudsman’s continuing campaign to weed out undesirables in the institution.  Nicolas was under surveillance for several weeks after the Ombudsman received a tip that the investigator, pretending to be a lawyer, was trying to extort P3,000,000.00 from local officials in Pangasinan in exchange for the dropping of complaints undergoing fact-finding investigation.

On 21 July 2017, a joint operation was led by the Ombudsman and the NBI in a resort in Lingayen, Pangasinan.  During the entrapment operation, Nicolas together with his cousin, Isagani Nicolas, a labor arbiter from Dagupan, was caught red-handed receiving the marked money.  AGIO III Nicolas was also caught with a bogus copy of an Evaluation Report purportedly issued by the Field Investigation Office. The fake Evaluation Report was presented in exchange for P3,000,000.00.

In the early morning of 22 July 2017, the Office of the Ombudsman conducted inquest proceedings against the duo.  They are set to face charges for Direct Bribery, violation of the Anti-Graft and Corrupt Practices Act (Republic Act No. 3019) and violation of the Code of Conduct and Ethical Standards for Public Officials and Employees (Republic Act No. 6713).  In addition, they are also facing multiple administrative charges.

On 24 July 2017, the Ombudsman issued the preventive suspension orders against the respondents for a period of six months.

In a statement, Ombudsman Conchita Carpio Morales condemned the act and said, “the Ombudsman does not condone any form of corruption among its ranks.  We will not let up in the campaign to remove undesirables in government service.”

ASEAN unity in helping fuel MSME growth

PASAYâ€"With the adoption of the Manila Call to Action (MCA) for ASEAN MSMEs, all 10 ASEAN Governments, including the Philippines, are called to pursue affirmative actions for MSME development.

Adopted at the ASEAN MSME Development Summit on 14 July, the MCA strongly urges all ASEAN Member States (AMS) to dedicate fund to power programs and initiatives on MSME development.

“True to its name, the document is a call to action. We rally to purse 7Ms for MSME development and to translate our aspirations into deliberate actions at the regional, national and local levels,” said ASEAN Economic Ministers chairman and Trade Secretary Ramon Lopez.

The trade chief refers to the 7Ms, namely, mindset, mastery, mentoring, money, machines, markets and models. The 7Ms is the holistic MSME development strategy proposed by the Philippines to drive shared prosperity in the region.

“What we are discussing in our local engagements is now receiving regional attention. This is only indicative of the regional applicability of our grassroots efforts to help MSMEs move up in life,” he added.

The MCA has been concluded with the collective efforts of the private sector, civil society and government from across ASEAN, bringing together knowledge, perspectives and experience in growing MSMEs.

According to Sec. Lopez, MSMEs must be full participants and beneficiaries of the economic dynamism that the current ASEAN integration brings. To this end, MSMEs’ role and contribution in attaining inclusive, people-centered ASEAN must be further strengthened.

Said outcome document has subsections that purposely pertain to the 7Ms.

On mindset, mastery and mentoring, the MCA calls on integrating entrepreneurship values and skills in the educational system spanning all levels. A convergence mindset in all government entities that recognizes the centrality of MSME development is envisioned.

“An all-of-government approach for MSME development is needed across all ASEAN Member States,” Sec. Lopez said.

On money access, the MCA reiterates the importance of setting up alternative financial instruments to better serve MSMEs’ financing needs. In this regard, an appropriate regulatory framework to govern institutions shall be created. Financial literacy and management for MSMEs should also be intensified.

On machines, the MCA stresses the importance of establishing research and development centers, improving the government’s assistance programs and providing more platforms and opportunities for knowledge sharing on non-proprietary machines and technologies.

A unified ASEAN digital marketplace is aspired to reach MSMEs beyond national borders. To boost market access, the MCA also calls to ensure quality compliance to sustain global competitiveness of ASEAN products and services, as well as to widen linkages of MSMEs to the regional value chains.

“We advocate for the promotion of social enterprises, highlighting the community-based approaches to enterprise development, said Sec. Lopez, adding that the inception of an ASEAN MSME starter kit map that compiles different business models for MSMEs is crucial.

“We should not wait for growth to trickle down. The MCA is set to pave the way towards region-wide prosperity that is powered by our MSMEs, thus spurring growth from the bottom of the pyramid,” he concluded.

Ex-Iloilo congressman charged over P4.8M PDAF scam
20 July 2017 (Ombudsman Press Release)

Ombudsman Conchita Carpio Morales has ordered the filing of multiple charges against ex-Iloilo representative Niel “JunJun” Tupas, Jr. for his involvement in the anomalous utilization of his 2008 Priority Development Assistance Fund (PDAF).   Tupas is set to be tried before the Sandiganbayan for two counts of violation of Section 3(e) of the Anti-Graft and Corrupt Practices Act (Republic Act No. 3019), one count of Malversation, and one count of Malversation thru Falsification of Public Documents.

Also included in the charge sheet are Alan Javellana, Rhodora Mendoza, Romulo Relevo, Ma. Julie Villaralvo-Johnson, all from the National Agri-Business Corporation (NABCOR) and Marilou Antonio, project coordinator of the Kabuhayan at Kalusugang Alay sa Masa Foundation, Inc. (KKAMFI).

In a letter dated 15 May 2008, Tupas requested the Department of Agriculture (DA) for the transfer of P5 million to the NABCOR for the implementation of his PDAF-funded projects.  The funds were supposed to buy hand tractors, water pumps and grafted fruit seedlings.  As NGO-partner, Tupas recommended KKAMFI as project implementor. During its field investigation, the Ombudsman found that Tupas implemented “ghost projects” as mayors from the six municipalities of Ajuy, Batad, Estancia, Lemery, San Rafael and Sara denied receiving any of the farm implements.  The Ombudsman also found that the liquidation documents submitted by respondents were all fabricated, with Tupas himself signing the alleged list of beneficiaries of equipment and seedlings from his district.

In its Resolution, the Ombudsman highlighted that “to be able to repeatedly release substantial funds from the PDAF, access thereto must be made available, and this was made possible by Tupas, Jr. who directly chose and endorsed his own NGO to implement his PDAF-related projects. Tupas, Jr. himself issued the requisite indorsement letters and similar documentation addressed to the DA and NABCOR, acts which were necessary to ensure that the chosen NGO would be awarded the project.”

“The evident misuse of the PDAF allocations through fictitious or non-existent projects should render respondents liable for Malversation,” stated Ombudsman Morales.  She added that, “this Office is convinced that they conspired with one another in this nefarious scheme to misappropriate public funds drawn from Tupas, Jr.’s PDAF.”

The Office of the Ombudsman has found probable cause to indict former Northern Samar Representative Emil Ong before the Sandiganbayan for his involvement in the Priority Development Assistance Fund (PDAF) scam.  Ong and 24 others are facing multiple criminal charges for the misuse of Ong’s 2007 to 2009 PDAF amounting to P62 million.

In a Resolution released today, Ombudsman Conchita Carpio Morales ordered the filing against Ong of 19 counts of violation of Section 3(e) of the Anti-Graft and Corrupt Practices Act (Republic Act No. 3019), 12 counts of Malversation thru Falsification of Public Documents and seven counts of Malversation.  Standing as his co-accused in the various charges are Department of Social Welfare and Development (DSWD) officials, former Secretary Esperanza Cabral, Undersecretary Luwalhati Pablo, Assistant Secretary Mateo Montaño, Director Deseree Fajardo, staff members Joselita Enciso and Leonila Hayahay.

The Ombudsman also ordered the inclusion in the charge sheet of the representatives of implementing agencies (IA), National Livelihood Development Corporation (NLDC) Gondelina Amata, Emmanuel Alexis Sevidal, Chita Jalandoni, Gregoria Buenaventura, Ofelia Ordoñez, Sofia Cruz and Filipina Rodriguez; National Agri-Business Corporation (NABCOR) Alan Javellana, Rhodora Mendoza, Victor Roman Cacal, Maria Ninez Guañizo and Romulo Relevo; NGO representatives, Roberto Solon of the Economic and Social Cooperation for Local Development Foundation, Inc. (ECOSOC), Margie Luz and Ma. Cristina Vizcarra of Gabaymasa Development Foundation, Inc. (GDFI), Rowena Adriano and Nestor Serdeña of Interactive Training Opportunity Needs Alleviations Movement, Inc. (ITONAMI).  Also included as co-accused is Ong’s representative Jesus Acebuche.

In-depth investigation and actual field verification uncovered that from 2007 to 2009, Ong received the following amounts as part of his PDAF:

The multi-million peso funds were supposed to benefit the congressman’s constituents in the 2nd district of Northern Samar in the form of livelihood capital assistance, distribution of fruit and vegetable seedlings, vermi-culture livelihood training packages, distribution of off-season vegetables, trainings, and manuals.  Ong had earlier requested the DSWD, NABCOR and NLDC to act as IAs with ECOSOC, GDFI and ITONAMI as NGO project-implementers.

The Ombudsman, however, found the projects turned out to be non-existent or “ghost projects” facilitated by Ong and his cohorts.  Local officials in the 2nd district attested that “they were not even aware of the projects” and that “they denied receiving anything from the office of Ong or any of the project partners.” As part of the cover-up, respondents submitted fake documents to support the liquidation such as project reports, distributions lists of beneficiaries, receipts, certificates of acceptance and inspection. Ombudsman investigators also ascertained that the alleged suppliers denied transacting with respondents, while others were not registered with the Securities and Exchange Commission or with the Department of Trade and Industry.  Worse, the Bureau of Internal Revenue has no records of any tax returns, tax clearances, audited financial statements and/or financial reports of any of the NGOs or alleged suppliers.  Neither was there any public bidding conducted for the procurement of farm implements and livelihood projects.

Ong failed to file any counter-affidavit despite filing several motions of extension of time.

According to Ombudsman Morales, “despite this irregularity, Ong endorsed these NGOs as the project implementers. He entered into MOAs with the IAs and the NGOs, approved the project proposals, and thereafter, continuously sought the release of the funds in the NGO’s favor. His representative, Acebuche, assisted him in perpetrating the fraud by signing a certificate of acceptance in his behalf.” Meantime, DSWD officers and employees released the funds to the NGOs with unusual accommodation, as it did not conduct any verification of the implementation of the projects.

The Resolution stated that, “to be able to repeatedly divert substantial funds from the PDAF, access thereto must be made available, and this was made possible by Ong who indorsed ECOSOC, GDFI and ITONAMI to implement his PDAF-related undertakings. Ong sent or caused the sending of the requisite indorsement letters and similar documentation to DBM, DSWD, NABCOR and NLDC, acts which were necessary to ensure that the preferred NGOs would be awarded the project.”

In the related administrative case, the Ombudsman ordered the dismissal from the service of Pablo, Montaño, Fajardo, Enciso, Amata, Jalandoni, Sevidal, Buenaventura, Ordoñez, Cruz and Rodriguez.  They were found guilty of Grave Misconduct, Serious Dishonesty and Conduct Prejudicial to the Best Interest of the Service and were meted the accessory penalties of perpetual disqualification from holding public office, cancellation of eligibility and forfeiture of retirement benefits.

Tagbilaran City Port Security Issue
X-ray machine to finally operate
Published by The Bohol Standard on November 12, 2006

Apprehensions of tragic incidents resulting from terrorists’ attacks would lessened by now as the Philippine Ports Authority disclosed the other day that the x-ray machine that had arrived a month ago will finally be in operation.

Port Management Office (PMO) manager Raul Oblenda said construction of the compartment that will house the x-ray machine will start this week.

“All issues concerning its operation have been ironed out and the Starlite management, who operates the city port passenger terminal, had agreed to the installation of the machine inside the terminal,” Oblenda said.

Under a build-operate-transfer (BOT) agreement with PPA, Starlite, a private company, operates the passenger terminal for a period of fifteen (15) years starting from 1997 to 2014.

But under the same contract, it was not provided that Starlite should install an x-ray machine in the said passenger terminal.

When former PPA general manager Alfredo Cusi issued an order that all ports in the country should have an x-ray machine after the New York World Trade Center attack and the threat of bombings hounding the country, Starlite questioned the issue on who should buy such machine.

“We tried to bargain with PPA that if we buy and install an x-ray machine that would entail a new investment of about P7-million, we be granted an extension of the lease agreement to about 8 years more. But this was denied,” Starlite-Tagbilaran manager Nennet Nicasio said.

Starlite filed a motion for reconsideration on the denial. When the x-ray machine, provided and purchased by PPA corporate funds arrived, Starlite could not immediately allow the installation of the machine pending resolution of their motion filed at the PPA Manila office.

“I have now received a confirmation through the e-mail from Starlite general manager Karl Wozniak that the company will purchase its own x-ray machine for the Tagbilaran port passenger terminal. That will be next month,” Nicasio said.

Starlite head guard Christopher Tulop said, so far, the city port is safe as the company-hired security guards impose strict inspection of luggage and the prohibition of bringing firearms on the boat.

Port police, the PNP Maritime and Coast Guard units, sniffing dogs of shipping companies also help in the insurance of security in the port, guard Tulop said.

Meanwhile, the PPA owned x-ray machine will be installed temporarily as the peak of the Yuletide season approaches. PPA will provide the personnel while waiting for Starlite to have their own machine and trained personnel.

Oblenda said, a minimal charge will be collected to recover the investment for the machine. Determining how much is the amount will be submitted for discussion with the port management advisory council.

Upon arrival of the Starlite-owned x-ray machine, the one purchased by PPA will be pulled-out and eyed for transfer to the busy port of Tubigon.

P64-M QUESTION ON ROAD PROJECTS
TRUE LIES? - published by The Bohol Standard on November 12, 2006
By Fred C. Amora

The report on the alleged anomalous manner of awarding four multi-million road projects in the third district of Bohol was highly inaccurate and irresponsible!

This was the reaction of officials in the Department of Public Works and Highways Region 7 in an exclusive talk with the Bohol Standard Wednesday at its office in Salinas Drive, Lahug, Cebu City.

“The reporter should have (at least) exercise diligence in getting the true facts before making such reports,” DPWH 7 construction division chief Engr. Buenaventurada C. Pajo said.

“It is not true that the four road projects were awarded through a negotiated bidding facilitated in the regional office, neither that it was not published,” Pajo pointed out.

She clarified that only two of the projects were bided at the regional office while the two others were made at the DPWH Bohol 3rd District Engineering Office based in the town of Guindulman.

The projects costing P17-million each bided at the regional office were the improvement concrete paving works of Junction Jagna-Siera Bullones Road and the same type of work from junction Dat-an Carmen-Sierra Bullones-Alicia Road.

This was also confirmed by DPWH-Bohol 3rd engineering district BAC secretariat chairman Engr. Timoteo Bagucan in a phone interview Friday.

He said two of the projects were indeed bided at the local office.

They are: the improvement concrete paving along Loay Interior Road (LIR) Carmen-Sagbayan, Bacani National Road (St. 63+560 to St. 64+520 with exception Carmen Section) with a contract amount of P14,255,870.68 and another LIR concrete paving Buenavista-Carmen-Danao-Jetafe Road (St. 65+311.63 to St. 66+500 with exception of Carmen Section) with a contract amount of P14,198,899.44.

Each is estimated to be only 900 meters long, more or less; has set a completion period of 195 working days.

“A certain Ismael Malagar called me about this and I told him the projects were published. If the Bohol contractors were not able to read (know about) this, that is not our watch. Records of the Bids and Awards Committee are open (upon request) for them to scrutinize,” the DPWH 7 construction division chief added.

Insinuations
The four projects that were awarded to one contractor Persan Construction, Inc. was reported by a local newspaper as some sort of “pabaon” (parting gift) to former DPWH 7 director Juanito Abergas who was promoted as department undersecretary but set to retire January next year.

The idea to award the four projects allegedly took place during the time of Abergas and was executed by his successor Robert G. Lala.

“Regional Director Lala won’t certainly condone such acts. And it should be noted that he has Boholano roots, particularly from the town of Baclayon. Those projects are for Bohol and he could never do all those allegations being insinuated in those reports,” construction division chief Pajo, who also hails from Tagbilaran, said.

Facts
DPWH 7 Legal officer Atty. Augustinito Hermoso said the projects were awarded pursuant to existing laws, like the new Reformed Government Procurement Act - RA 9184.

The projects were awarded through an alternative mode of procurement but it was not negotiated but through “limited source bidding” allowed in the same law.

This mode of procurement undergoes the same competitive bidding; with each pre-qualified bidder dropping their project-cost quote in a sealed envelope and opened in the presence of their representatives.

“We are all careful here particularly in these times that the government is strongly campaigning against all forms of graft and corrupt acts. And besides, these projects should be taken by the Boholanos in the positive light,” Hermoso said.

He confirmed that the implementation of the project had some relations to the visit of many foreign dignitaries for the Association of Southeast Asian Nations (ASEAN) Summit to be held at the Cebu International Convention Center (CICC) in Mandaue City this coming December.

“Because of the summit and taking the tourism growth seen in Bohol, the province gained some blessings from the activity. Napiksan ug grasya ang Bohol tungod ani,” the DPWH lawyer added.

“It was approved by no less than President Arroyo and DPWH secretary Hermogenes Ebdane,” he further clarified.

The DPWH 7 bids and awards committee secretariat assured the Bohol Standard that all documents pertaining to the bidding and awarding of the project will be provided this week for all Boholanos to really know the true facts of the report.

Close watch
Meanwhile, third district congressman Eladio Jala denied any involvement in the selection of the projects’ contractor.

He, however, vowed to closely monitor the construction of the project and that it would be completed true to its specifications and standard quality.

Governor Erico Aumentado also assured the Boholanos and the group of local contractors that he will look into the matter at the DPWH-Manila central office.

MANILA, July 21 -- A senator on Friday expressed hope that the Senate could get an early start in reviewing the proposed 2018 budget of PHP3.767 trillion as soon as its second regular session resumes next week.

“When the budget is approved early, it allows for a more efficient delivery of services by the government,” Sen. Loren Legarda, chair of the Senate Committee on Finance, said in a press statement.

Legarda made this statement as Pres. Rodrigo Duterte is expected to submit to Congress the 2018 National Expenditure Program (NEP) during his second State of the Nation Address (SONA) on Monday (July 24).

She pointed out that the early submission of the NEP would allow the Senate to start early in reviewing the proposed 2018 budget.

“We hope we can also approve the budget ahead of the usual schedule to ensure continuity of ongoing programs and immediate implementation of new ones by government agencies,” she added.

Legarda, meanwhile, assured that like the 2017 budget, the 2018 budget will remain “pro-people”, “socially inclusive”, “gender sensitive”, “climate adaptive” among others.

The senator also vowed that the Senate would not waste time and ensure that “people’s money is judiciously used for the common good.”

The Department of Budget and Management (DBM) earlier said that the proposed 2018 budget prioritizes education and infrastructure development, particularly for the government’s infrastructure program, “Build, Build, Build”, and the provision of social services to the people. (Azer N. Parrocha/PNA)

Republic of South Sudan Travel Warning

The U.S. State Department warns U.S. citizens against travel to the Republic of South Sudan because of ongoing fighting, intercommunal violence, and violent crime.

This replaces the Travel Warning dated January 4, 2017.

In July 2016, violent clashes between government and opposition forces broke out in Juba, resulting in the expulsion of opposition forces from the capital.  Since then, armed conflict has expanded throughout the country, leading to continued instability that is exacerbated by intercommunal violence, cattle raiding, economic collapse, and an increase in violent crime. Aid workers, including U.S. citizens, have been the targets of shootings, ambushes, violent assaults, harassment, and robberies. All U.S. citizens in South Sudan should have evacuation plans that do not rely on U.S. government assistance, and should carry medical evacuation insurance.

The risk of violent crime is critical throughout South Sudan, including in Juba.  Due to the risk of carjacking, crime, and unpredictable armed violence, travel outside of Juba should be undertaken with a minimum of two vehicles and appropriate recovery and medical equipment in case of mechanical failure or other emergency.

Due to risks to civil aviation operating within or in the vicinity of South Sudan, the Federal Aviation Administration (FAA) has issued a Notice to Airmen (NOTAM). For further background information regarding FAA flight advisories and prohibitions for U.S. civil aviation, U.S. citizens should consult Federal Aviation Administration’s Prohibitions, Restrictions and Notices.

Jordan Travel Warning

The U.S. Department of State warns U.S. citizens to consider the risks of travel to and throughout Jordan due to persistent terrorist threats.

The self-proclaimed Islamic State of Iraq and ash-Sham (ISIS), its affiliates, sympathizers, and other violent extremist groups have successfully conducted attacks in Jordan and continue to plot against local security forces, U.S. and Western interests, and “soft” targets. Jordan's prominent role in the counter ISIS Coalition and its shared borders with Iraq and Syria increase the potential for future terrorist incidents. This replaces the Travel Warning issued December 23, 2016.

U.S., Western, and official Jordanian interests remain priority targets for ISIS and other violent extremist organizations. Within the last year, Jordanian authorities have notified the U.S. Embassy of several disrupted terrorist plots targeting U.S. citizens and Westerners in Jordan. In addition, on December 18, 2016, terrorists killed 10 people, including a Canadian citizen and seven Jordanian security and police officers, at or near a tourist site in Karak, 130 km south of Amman. Two days later, in the same area, a shootout between a different terrorist group and Jordanian security forces occurred. Terrorist entities continue to express interest in attacking other “soft” targets, such as high-profile public events, hotels, places of worship, restaurants, schools, and malls.

Travelers to Jordan should avoid the country's border with Syria and Iraq given the continued threat of cross-border attacks. All U.S. government personnel on official travel must receive prior permission to visit any area within 10 km from the Jordan-Syria border, which includes the town of Ramtha. The 10 km area does not include the tourist site of Umm Qais or the city of Irbid. U.S. government personnel must also have permission for official travel on Highway 10 east of the town of Ruwayshid toward the Iraq border. U.S. government employees on personal travel are not permitted to visit the border areas or refugee camps, and the Embassy advises U.S. citizens to avoid both locations. On occasion, the U.S. Embassy temporarily makes other areas within Jordan off limits to its staff based on the security situation.

For more information:

  • Contact the U.S. Embassy in Amman. The U.S. Embassy is located on Al-Umayyaween Street, Abdoun neighborhood, Amman 11118. You can contact the Embassy by telephone at +(962) (6) 590-6000. The emergency after-hours number is +(962)(6) 590-6500.  U.S. citizens in Jordan may also contact the consular section by email at Amman-ACS@state.gov. U.S. citizens seeking routine services must make appointments in advance.
  • Call 1-888-407-4747 toll-free in the United States and Canada or 1-202-501-4444 from other countries.

Egypt Travel Warning

The U.S. Department of State warns U.S. citizens to consider the risks of travel to Egypt due to threats from terrorist and violent political opposition groups.

This replaces the Travel Warning issued on December 23, 2016. A number of terrorist groups, including ISIS, have committed multiple deadly attacks in Egypt, targeting government officials and security forces, public venues, tourist sites, civil aviation and other modes of public transportation, and a diplomatic facility. Terrorists continue to threaten Egypt’s religious minorities and have attacked sites and people associated with the Egyptian Coptic Church.

Terrorist attacks can occur anywhere in the country, including major metropolitan areas. In early May, ISIS media threatened that places associated with Westerners, Christians, the Egyptian military or police, and Egyptian government facilities could be struck at any time. The northeastern Sinai Peninsula remains a particularly dangerous area, with frequent attacks on security forces and civilians. There are also reports of attacks on security forces in Egypt’s Western Desert, the large, mostly uninhabited area west of the Nile Valley, and in Egypt’s border areas. The Egyptian Military frequently conducts counterterrorism operations in these areas.

For security reasons, U.S. Mission personnel are prohibited from traveling to the Western Desert and the Sinai Peninsula. Overland travel is not allowed anywhere in the Sinai Peninsula, but U.S. Mission personnel are permitted to travel to and from Sharm El-Sheikh by air. Mission personnel are prohibited from visiting religious sites outside greater Cairo.

The Egyptian Government maintains a heavy security presence at major tourist sites in and around greater Cairo and Alexandria; at Sharm el-Sheikh, Hurghada, Marsa Alam and other beach resorts on the Red Sea and the Mediterranean coast; and at many of the major temples and archaeological sites located in and around the Nile Valley cities of Luxor and Aswan, including Abu Simbel.

Due to risks to civil aviation operating within or in the vicinity of Egypt, the Federal Aviation Administration (FAA) has issued a Notice to Airmen (NOTAM) and/or a Special Federal Aviation Regulation (SFAR). For further background information regarding FAA flight advisories and prohibitions for U.S. civil aviation, U.S. citizens should consult Federal Aviation Administration’s Prohibitions, Restrictions and Notices.

Burundi Travel Warning

The Department of State warns U.S. citizens against travel to Burundi due to political tensions, political and criminal violence, and the potential for civil unrest.

This replaces the Travel Warning dated November 15, 2016.

The political situation in Burundi is tenuous, and there is sporadic violence  throughout the country, including frequent gunfire and grenade attacks by armed groups. Police and military checkpoints throughout the country restrict freedom of movement, and police have searched the homes of private U.S. citizens as a part of larger weapons searches. U.S. citizens should take these facts into consideration when developing their personal safety plans.

Rebel forces, ex-combatants, and youth gangs have crossed into Burundi from the Democratic Republic of Congo and attacked and kidnapped civilians. Armed criminals have ambushed vehicles, particularly on the roads leading out of Bujumbura. Use caution if traveling by car, and travel with multiple vehicles when possible.

U.S. Embassy personnel are subject to restrictions when traveling in certain areas of Burundi and may be subject to other constraints as security conditions warrant. U.S. Embassy personnel are prohibited from traveling outside of Bujumbura at night, and trips to the Bujumbura neighborhoods of Bwiza, Cibitoke, Gasenyi, Kamenge, Kinama, Musaga, Mutakura, and Ngagara require advance approval.

Philippines Travel Warning

The Department of State warns U.S. citizens to avoid all non-essential travel to the city of Marawi, Mindanao and the Sulu Archipelago including the southern Sulu Sea, and to exercise extreme caution when traveling to other regions of Mindanao, due to terrorist threats, insurgent activities, and kidnappings.

Similar threats also occurred throughout the Philippines in 2017. This replaces the Travel Warning dated December 20, 2016.

There is a threat of kidnappings-for-ransom of foreigners, including U.S. citizens, from terrorist and insurgent groups based in the Sulu Archipelago and in the southern Sulu Sea area. This area stretches from the southern tip of Palawan, along the coast of eastern Sabah, Malaysia and the islands of the Sulu Archipelago, up to Zamboanga City, Mindanao. The U.S. Embassy requires U.S. government personnel to obtain special authorization before traveling to Mindanao and the Sulu Archipelago.

Separatist and terrorist groups continue to attack and kidnap civilians, foreigners, political leaders, and Philippine security forces in Mindanao. On May 23, 2017, the Philippine government declared martial law throughout the Mindanao region.  Review the following information:

  • In September 2016, a terrorist group detonated a bomb in Davao City, killing 14 and wounding at least 70 people. Following the attack, the Philippine government declared a "State of National Emergency on Account of Lawless Violence in Mindanao."
  • In May 2017, an ongoing conflict erupted between terrorist groups and Philippine security forces in Marawi City, Mindanao, resulting in multiple dead and injured.
  • In central Mindanao, extremist groups aligned with the Islamic State, the Bangsamoro Islamic Freedom Fighters, and other armed groups have carried out attacks on local government institutions, civilians, and security forces in the Cotabato City area, and in the Maguindanao, North Cotabato, and Sultan Kudarat provinces, where the government maintains a state of emergency and a greater police presence.
  • In Mindanao, terrorists, insurgents, and criminal gangs regularly conduct kidnappings for ransom. Since January 2017, at least six separate kidnappings have been reported.
  • In western Mindanao, terrorists, insurgents, and criminal gangs regularly conduct kidnappings for ransom.
  • The U.S. Embassy has restricted U.S. government personnel travel to Mindanao.
  • There have been no reports of U.S. citizens in Mindanao targeted specifically for their nationality; however, general threats to U.S. citizens and other foreigners throughout Mindanao remain a concern.

Recent terrorist threats, kidnappings, and bombings have occurred throughout the Philippines. U.S. Embassy Manila received credible information that terrorists planned to conduct kidnappings in Palawan, Cebu, and Bohol provinces in 2017. In November 2016, a terrorist group planted an Improvised Explosive Device near the U.S. Embassy in Metro Manila. In April and May 2017, bombings in Quiapo, Manila killed two and injured twenty.

Mali Travel Warning

The Department of State warns U.S. citizens against all travel to Mali due to ongoing terrorist attacks, criminal violence, and potential political instability.

U.S. citizens in Mali are reminded to stay vigilant, remain aware of their surroundings, and exercise caution, especially at night. This Travel Warning replaces the Travel Warning dated December 23, 2016.

The potential for terrorist attacks in Bamako is high. Locations frequented by Westerners and other expatriates, including but not limited to night clubs, hotels, restaurants, places of worship, and Western diplomatic missions are targets for attacks. On June 18, 2017 terrorists attacked a hotel/resort complex 24 km east of Bamako city center, a site frequented primarily by Westerners and other expatriates. This was the fourth attack on such a site in the Bamako region since 2015.

On April 28, 2017 the Government of Mali extended the State of Emergency by six months. Roadblocks and random police checkpoints, especially between sundown and sun-up, are common in Bamako and throughout the country.

Northern and Central Mali are high risk areas for terrorist attacks, armed conflict, and armed robbery. U.S. government personnel in Mali are restricted from these regions except for travel deemed to be mission critical.

Violent extremist groups targeting foreigners have claimed responsibility for multiple terrorist attacks throughout Mali over the past 12 months. In March 2017, four Al-Qa’ida-linked groups merged under the name of Jama’at Nusrat al-Islam wal-Muslimin (JNIM or “Group for the Support of Islam and Muslims”).  Terrorist groups are likely to continue, if not escalate, attacks on United Nations and Western targets throughout the Sahel.

Westerners have been kidnapped for profit and/or ideological motives. Several Western hostages are believed to be captive in Mali, including a U.S. citizen who was kidnapped in Niger in October, 2016.

Due to risks to civil aviation operating within or in the vicinity of Mali, the Federal Aviation Administration (FAA) has issued a Notice to Airmen (NOTAM) and/or a Special Federal Aviation Regulation (SFAR). For further background information regarding FAA flight advisories and prohibitions for U.S. civil aviation, U.S. citizens should consult FAA's Prohibitions, Restrictions and Notices.

(Manila, Philippines). Energy Secretary Alfonso Cusi said today (17 July) that the Duterte Administration is working hard to address the resiliency of energy systems and infrastructure and the reasonability of electricity rates in the Philippines as he opened the ASEAN 35th Senior Officials Meeting on Energy (SOME) at Okada Manila.

Cusi congratulated the organizers of the week-long series of meetings that form part of the events being hosted by the Philippines in celebration of the 50th founding anniversary of the ASEAN (Association of Southeast Asian Nations).

"We are tasked to ensure energy security for the region to sustain our respective domestic economies.  This becomes more urgent as we move towards the realization of an ASEAN Economic Community through greater collaboration," Cusi told the delegates.

Cusi cited the 10-year ASEAN Plan of Action on Energy Cooperation (APAEC) 2016-2025 as the region sets to achieve enhanced energy security, accessibility, affordability and sustainability.

On the home front, Cusi said government's "Ambition 2040" aspires to transform the Philippines to an upper middle-income economy in which Filipinos get to enjoy a comfortable and secure existence.

He added that the Philippine is moving to bring about a "golden age of infrastructure" through a "Build, Build, Build" infrastructure plan which is part of "Dutertenomics."

"In support of this infrastructure plan, the Philippines would need additional capacity of 44,000 MW up to 2040. To do this, the Philippines is pursuing fuel and technology neutral and balanced environmental protection goals and socio-economic growth,” Cusi told the delegates.

"Along this line, we have set our sights on an optimal demand behavior-based fuel mix with 70-20-10 share of baseload, mid-merit and peaking capacity requirement to support our growing economy," Cusi said.

The challenge is to increase energy supply specially electricity, both for grid and off-grid areas, he stressed.

"Our ultimate vision is to provide power of choice to our consumers," said the Energy Chief.

"We will implement policies that would increase our supply and make our electricity market more competitive while also addressing the perennial concerns of system inefficiencies."

Cusi invited energy sector players to come up with innovative solutions and dynamism, thus "increasing supply and ensuring more competition in the sector."

He pointed out that Executive Order (E.O.) No 30 signed by President Rodrigo Duterte on June 28 created a task force to establish a simplified approval process for permits and licenses to fast track the implementation of big-ticket energy projects.

“The EO instructs government agencies to act on applications of energy projects within 30 days upon complete submission of requirements,” Cusi explained.

Also, a new policy initiative of the DOE now subject to public consultations is institutionalizing disaster resilience in the energy sector by strengthening energy systems and facilities, quickly restoring damaged facilities and providing alternative energy sources during calamities.

Given the archipelagic nature of the country, “the DOE will pursue distributed electrification for currently off-grid island provinces through independent mini and/or micro grids served by local indigenous power sources like run-of-river and biomass,” said Cusi.

This is to mitigate the risk of extensive outages that may be sustained in the transmission lines and distribution networks due to natural and human-induced calamities like earthquakes and typhoons that are of increasing frequency and intensity lately.

"Major activities under this policy also include the implementation of the ‘Build-back Better’ principle in reconstruction and rehabilitation of infrastructures, improvement of operational and maintenance standards and practices, as well as resiliency standards for new energy facilities," said Cusi.

MILLENNIAL SOLON BATS FOR "SUPER" HIGH SCHOOL FOR MARAWI
‪Seeks P200M infusion for Marawi City National High School

House Bill 5963 seeking to rebuild and modernize the Marawi City National High School with a massive budget infusion of P200 million was filed in Congress by 28-year-old Congressman Neil Abayon of the AANGAT TAYO Party-list.

MCNHS is within the Autonomous Region in Muslim Mindanao (ARMM). A resolute effort is imperative to hasten the recovery of Marawi City and its residents from the armed conflict resulting from the invasion of the city by terrorist and separatist forces.

Normalization of life in Marawi City will be enhanced by the quick resumption of classes, particularly in the largest school in the city, the Marawi City National High School.

Marawi City NHS must be secured as a center of peace and learning for the benefit of residents, particularly the youth, of Marawi City and its surrounding municipalities.

The appropriation of P200 million will be sufficient to enable the Marawi City NHS to perform its crucial role as an integral part of Marawi.

The budget infusion is massive because MCNHS will be serving at least 2,000 students and likely much more than that because other schools were destroyed in the armed conflict. There is urgent need to provide funds for the following:

1. Purchase of land to which the school shall be relocated;

2. Acquisition of right of way and construction of the access roads to and from the school;

3. Design, site development and construction of school buildings: (a) that have high resistance to earthquake, floods, and other natural calamities; (b) that can accommodate enrollment of at least four thousand (4,000) students and faculty complement of five hundred (500) public school teachers; (c) with offices and function rooms and facilities for the parents-teachers-community association, official student publications, official school publications, supreme student government, school athletes, and school clinic with patients’ beds, dental equipment, and medicines;

4. Provision of security installations, equipment, measures, personnel, and training against robbery, theft, terrorism, and other security threats;

5. Construction of a separate multi-purpose area within the school campus that can serve as, among others, an evacuation site and multi-sports activity venue;

6. Provision and installation of high-bandwidth internet for the use of students, faculty, school administration and non-teaching personnel, a local area network and virtual private network (VPN), campus radio broadcast facilities, a campus-wide public address system, and a conference room/audio-visual function room;

7. Construction of an Alternative Learning System (ALS) and Technical Training Center that can accommodate at least five hundred (500) learners;

8. Installation, maintenance, and operation of power generation and electrical equipment and facilities, including solar energy and/wind energy for lights, potable water and sewerage facilities, communications and information technology equipment. and security equipment;

9) Installation of temporary learning facilities, using quick-construction prefabricated materials and container vans, for the conduct of classes and operations of various school offices while the rebuilding activities are ongoing; and

10) Provisions for and installation of other facilities and equipment deemed necessary by the Special Task Force for the operation and maintenance of the school.

The bill creates a special task force to implement the rebuilding program and a congressional oversight committee ensure effective implementation.

Former Cebu mayor to face charges for unliquidated cash advances
14 July 2017

Nicomedes De los Santos, the former Mayor of Alcoy, Cebu, is facing 12 counts of violation of Article 218 (Failure to Render Accounts) of the Revised Penal Code before the Sandiganbayan.  He was also found administratively liable for Simple Neglect of Duty and ordered suspended for one month and one day.  In case of separation from the service, the penalty is convertible to a fine equivalent to respondent’s salary for the same period.

The Field Investigation Office presented documents to show that De los Santos failed to liquidate and account for his cash advances issued to him from November 2006 to July 2011 totaling P199,624.00.  According to the list of unliquidated cash advances submitted by the Commission on Audit (COA), De los Santos received funds to cover expenses for meals, snacks, travel expenses, police operation expenses, intelligence funds, honorarium for referees in a basketball tournament, Lakbay Aral and Aliwan Festival expenses and Suroy-Suroy Sugbu expenses.

â€œBased on the [COA] guidelines, respondent clearly failed to liquidate within the period required.  In fact, he admitted that he only processed his liquidation after he received this complaint.  He submitted his liquidation report to COA on April 8, 2016 and refunded three cash advances on April 7, 2016,” stated the Resolution.

The Ombudsman added that “a prior demand is not required because nowhere in the provision does it require that demand be first made before an accountable officer is held liable for a violation of the crime.”

Article 218 states that “any public officer, whether in the service or separated by resignation or any other cause, who is required by law or regulation to render account to the Insular Auditor, or to a provincial auditor and who fails to do so for a period of two months after such accounts should be rendered, shall be punished by prision correccional in its minimum period, or by a fine ranging from 200 to 6,000 pesos, or both.”

Cusi:  Power Situation in Quake-Stricken Areas Seen to Improve by July 19

(Taguig City). Energy Secretary Alfonso Cusi told President Rodrigo Duterte in Ormoc City on Thursday afternoon that the supply of electricity in areas of the Visayas affected by the recent earthquake will noticeably improve by the end of the month.

Cusi relayed the latest timeline on the power restoration efforts in Region 8, Bohol and Ormoc City during a visit by the President and Cabinet members to the quake-stricken areas in this city.

The Energy chief gave the assurance that his department has been working nonstop to normalize power in the affected areas, citing reports by the National Electrification Administration (NEA), National Grid Corp. of the Philippines (NGCP) and Energy Development Corp. (EDC).

Subject to NGCP’s successful restoration of Transformer 6, “We expect a total of 309 megawatts (MW) of available capacity by July 19,” Sec. Cusi announced Friday (14 July).

“These capacities can serve the total demand of electricity for the affected areas of Region VIII (Samar and Leyte Provinces) and Bohol, which is at 291 MW,” Sec. Cusi said.
DOE Undersecretary Felix William Fuentebella had earlier called an emergency meeting attended by representatives from the NEA, Region 8 Electric Cooperatives, NGCP and EDC to provide updates and work timelines on the power restoration.

Based on the reports, there will be available capacities coming in from the EDC-run geothermal power plants: July 16 with 269 MW, July 19 additional 40 MW from its Tongonan geothermal power plant totaling to 309 MW by Wednesday next week.

All available capacities by end of July is expected to reach 322 MW.

"We will continue to explore all options available for Leyte, Samar and Bohol islands."

The DOE is also coordinating with the Energy Regulatory Commission to ensure compliance of electricity service providers with the required standards and the alignment in crafting resiliency policies.

Nation mourns passing of a religious leader
by Aleli Aggasid-Batara
Laoag City (24 June 2005) -- The death of Jaime Cardinal Sin, a known advocate of national unity, reconciliation and cooperation, should convince our political leaders to temporarily set aside their personal agenda in due deference to the former archbishop and work instead to improve the plight of the poor - who were closest to his heart.

Sin succumbed to multiple organ failure in the early morning of Tuesday at the Cardinal Santos Medical Center in San Juan after his long struggle with diabetes and kidney problem. He was 76 years old.
President Arroyo has declared a week of national mourning for the Catholic leader who was instrumental in the ouster of two Philippine presidents in a bloodless revolution.

The Bangko Sentral ng Pilipinas (BSP) has reported that the exchange rate closed today at P55.60 to $1 and the main stock index fell to its lowest in the week.

The continuing negative reaction from the investors and the market is indicative of the adverse impact of the conflict thus the need for the final resolution of the problem.
The House hearing on tape scandal is under way but is going at a slow pace because of the procedural debates between administration and opposition lawmakers.

The deliberation is but natural and is necessary to ensure proper resolution of the problem. What is important is that there is already a proper venue in place and to discuss the matter. (PIA)

Robert Tarongoy returns home
by Aleli Aggasid-Batara
Laoag City (24 June 2005) -- The arrival of Robert Tarongoy in the country today is a welcome respite from all the problems and confusion.
After seven months of being adducted by Iraqi militants Tarongoy came home to the warm embrace of his family and countrymen.

Kudus is due the crisis team of the Philippine Government for staying the course and exhausting all diplomatic channels to bring home the striving accountant who only wanted to help his family by working abroad.
The government has denied paying $1.4 million in ransom saying it was their negotiation efforts that ensured the safe return of Tarongoy.

With this development the Department of Foreign Affrairs has stressed once again the work ban in Iraq.
The DFA has reiterated that the primary consideration in deploying Overseas Filipino Workers is their safety in their work environment.

Gloria Arroyo not "jueteng" beneficiary - Bunye
MANILA (24 June) -- "President Gloria Macapagal-Arroyo has never benefited from the proceeds of illegal gambling."

Press Secretary and Presidential Spokesman made the statement after Lingayen Archibishop Oscar Cruz linked the First Family to alleged money laundering and "jueteng" payoffs.
Bunye questioned the timing of Cruz's accusations as they were brought forth at a time of mounting efforts to destabilize the Arroyo Government.

He said the present administration is seeing a grand design to weaken and undermine the national leadership through a conspiracy of deception.

The Palace official said he respected the Archbishop's views but pointed out that he maybe an unwitting pawn in the clandestine plans of the opposition.

Meanwhile, Bunye conveyed that the government's fight against "jueteng" has been without let up and there is no doubt that it will be eradicated within the time frame set by President Arroyo. (PIA-MMIO)

Political noise erodes investors' confidence

MANILA (24 June 2005) -- The growing political noise hounding the Philippine nation is starting to erode investors' confidence at a time when the country needs it most to meet the uncertainties in the global economy.
Press Secretary Ignacio Bunye made the statement after the International Monetary Fund (IMF) commented that political storm may derail economic prospects as other international financial institutions start to notice the political storm buffeting President Gloria Macapagal-Arroyo's government.

Bunye, who is also the Presidential Spokesman, pointed out that the opposition continues to sabotage the economic gains but the Filipino people continue to thwart all efforts intended to weaken the economy.
He, however, expressed confidence that these incipient fears would be overcame by the country's strong economic fundamentals as the Arroyo Government remains determined to stay in the course of urgent change and reform.
"Our economy is resilient enough, and our political system's mature enough, to withstand all challenges," Bunye added. (PIA-MMIO)

Bunye says Opposition desperate for power
MANILA (24 June 2005) -- The opposition is desperately gunning for power.

Press Secretary and Presidential Spokesman Ignacio Bunye made the description of President Gloria Macapagal-Arroyo's foes setting up pressure on her to talk on the alleged wiretapped conversation to rig the May 2004 elections.
Bunye stressed that President Arroyo will not turn her back on the sovereign mandate given to her by the Filipino people saying that it is the people who gave the President the power to lead, and only they can take it away through ordained political process.

He pointed out that the nation continues to move forward despite the mounting political noise and the Filipino people do not dignify or support isolated calls for the President to resign.

The Palace official reiterated that mob rule will never defeat the democratic rule under the present administration.
"The Government shall exercise maximum tolerance but we expect the opposition to exercise maximum prudence and not to test the limits of the law," he said. (PIA-MMIO)

Economy keeps on track amid controversy
by Rodrigo S. Victoria
Naval, Biliran (24 June 2005) -- Amid the controversies hounding the present administration, the country's economy remains resilient and is threading on the right track.

This was manifested anew with the confidence of the local and foreign investors to invest more in the country as shown in the record of the Board of Investments (BOI) which shows that for the first quarter of the year, BOI-approved projects amounted to $52.6 billion while PEZA-approved investments reached $13 billion.
It was also learned that China has committeed to invest at least $1 billion in the country's mining and railway sector.

The joint Foreign Chambers of the Philippines also noted that with the full implementation of the Expanded Value Added Tax Law early next year along with important revenue administrative reforms, it is expected that it will begin to close the budget deficit, reduce the consolidated public sector deficit and ease the public sector borrowings.
President Spokesperson Ignacio Bunye stated that these political and economic challenges must steel our resolve to keep on track and sustain the momentum of our gains.

Secretary Bunye further said that with greater unity and focus, the country can insulate the economy from political pressures and stay the course of putting our fiscal house in order, growing investments and jobs and spreading safety nets to ease the burdens of our people.

In the local scene, during the recent visit of Senator Manuel Villar in the province of Biliran this year, he mentioned the importance of creting jobs in the countryside in order to propel the economy of the country.
Taking before students of the Naval Institute of Technology (NIT), Senator Villar added that the people should rely more on oneself and not so much on government's help in the creation of wealth for the nation.

He also urged the students to engage in business or be an entrepreneur rather than dwell only on employment in order to contribute to the full economic development of the country.

The senator in closing stated that the only way that the country can move forward is for the people to engage in business which will directly help improve the economy. (PIA)
