DIVISION
[ GR No. 222523, Oct 03, 2018 ]
JOSE JOHN C. GUERRERO v. PHILIPPINE TRANSMARINE CARRIERS +
DECISION
PERALTA, J.:

Before the Court is a petition for review on certiorari seeking to reverse and set aside the September 10, 2015 Decision[1] and the January 14, 2016 Resolution[2] of the Court of Appeals (CA) in CA-G.R. SP No. 132711.

The case traces its roots to a Complaint[3] filed by petitioner Jose John C. Guerrero (Guerrero) for permanent and total disability benefits, compensatory damages, exemplary damages, moral damages and attorney's fees against respondents Philippine Transmarine Carriers, Inc. (PTCI), Celebrity Cruises (CC), and/or Carlos Salinas (Salinas) [collectively, respondents].

A series of conferences between Guerrero and respondents were held before the Labor Arbiter (LA), but the parties failed to reach an amicable settlement. Hence, the LA required the parties to submit their respective position papers.

In his Position Paper,[4] Guerrero alleged that on August 15, 2011, he was employed by PTCI, represented by its President, Carlos Salinas, on behalf of its principal, CC, as a Casino Dealer on board the vessel GTS Constellation for a period of six (6) months with a basic monthly salary of US$255.00. Prior to embarkation, he underwent pre-employment medical examination at Metrics Center, Makati City, and was declared "fit to work as a seaman." He boarded the vessel on October 12, 2011. His duties and responsibilities as a casino dealer include having an understanding of all the games he will operate, dealing cards, distributing dice, operating game apparatus such as roulette wheel or baccarat wheel, as well as keeping an eye on patrons to make sure they are not cheating, and the gamblers are having a good time.

Guerrero averred that: sometime in January 2012 during a gastro-intestinal outbreak in the ship, he and other crew members were tasked and ordered to bring elderly guests out of the ship through wheelchairs; since the platform was not levelled with the ship's door exit, and the bridge connecting the platform and the door exit was too steep, they decided that the best way to move and transfer the elderly passengers was by pulling the wheelchairs; while he was pulling a wheelchair with a passenger, a sudden motion occurred which caused him to lose his balance but managed to prevent the wheelchair, the passenger and himself from falling; in order to keep the passenger safe, he had to push the wheelchair really hard to gain control over it; after said incident, he started experiencing back pains which he just ignored due to the demands of his work as a casino dealer; to manage his back pain, he took mefenamic acid tablets and applied pain relieving liniment and hot water on the painful area; and later, his back pain became unbearable prompting him to consult the doctor of the vessel who prescribed him pain reliever medication and sleeping pills.

While his vessel was docked at a port in the Caribbean, Guerrero underwent a Magnetic Resonance Imaging (MRI) procedure at the Isle Imaging Center of St. George, Caribbean, and after which, the attending physician made the following Impression: Findings revealed changes of Lumbar Spondylosis involving L2-3, L3-4, L4-5 disc causing of compression of left L5 and bilateral L4 roots as described. No cords conus abnormality seen.[5] In view of his medical condition, he was recommended for medical repatriation. Upon his arrival in Manila on March 26, 2012, Guerrero immediately reported to respondents and was referred to the Manila Doctors Hospital and the Philippine General Hospital (PGH) for post-employment medical examination and for further treatment. He underwent a series of physical therapy sessions at the Orthopedics Department of the PGH under the supervision of the company-designated physician/surgeon, Dr. Adrian Catbagan (Dr. Catbagan). On October 19, 2012, a major surgery called Transforaminal Lumbar Interbody Fusion L3-L4 & L4-L5 was performed on Guerrero by Dr. Catbagan at the Manila Doctors Hospital. On November 19, 2012, Dr. Catbagan issued a Medical Certificate[6] stating that Guerrero was confined at the Manila Doctors Hospital on October 19, 2012 and was discharged on November 9, 2012 with the following final diagnosis: Degenerative Disc Disease & Disc Herniation L3-L4 & L4-L5 Moyamoya Disease, resolved. After Guerrero's surgery, he continued his therapy sessions with Dr. Catbagan until January 15, 2013.

Guerrero alleged that since the pain still persisted notwithstanding the medical procedures performed on him, he consulted, on January 17, 2013, Dr. Cesar H. Garcia (Dr. Garcia), an orthopedic surgeon/bone and joint disease, who issued on even date a medical certificate[7] declaring him "UNFIT for further sea service in whatever capacity as a SEAFARER." Guerrero alleged that despite his permanent unfitness for further sea service as determined by his physician, respondents failed to compensate him of permanent and total disability benefits. He maintained that he sustained a spinal injury due to an accident arising out, and in the course of, his employment.[8]

In their Position Paper,[9] respondents maintained that Guerrero is not entitled to disability benefits because he sustained the alleged injury during an incident at the crew gym. Respondents adduced in evidence documents denominated as Crew Injury Statement,[10] dated March 22, 2012, and Personal Injury Illness Statement[11] in support their submission.

Respondents alleged that the essential duties of Guerrero as a Casino Dealer are reflected in the Job Description Manual. They contended that going to the gym and the use of gym facilities are not part of Guerrero's job and could not have any relation to his duties as a Casino Dealer. Respondents theorized that disability benefits are compensable only when the seafarer, such as Guerrero, suffers work-related injury or illness during the term of his contract. They posited that Guerrero's injury is not compensable since it has not arisen from a work-related incident. Respondents alleged that Guerrero's claim for damages and attorney's fees are bereft of any factual and legal basis stressing that they had faithfully complied with their contractual obligation to him and had even provided him with extensive medical attention for humanitarian consideration. By way of counterclaim, respondents alleged that the filing by Guerrero of a baseless complaint tarnished their reputations and were constrained to engage the services of an attorney to protect their rights. For these reasons, they prayed that they should be awarded damages of P200,000.00 attorney's fees and cost of litigation in the sum of P400,000.00.[12]

The LA Ruling

On February 28, 2013, the Labor Arbiter rendered a Decision[13] declaring that PTCI and CC are solidarily liable for disability compensation to Guerrero. The fallo of the Decision states:
WHEREFORE, premises considered, judgment is hereby rendered ordering respondents PHILIPPINE TRANSMARINE CARRIERS [INC.]/CELEBRITY CRUISES, jointly and severally, liable to pay JOSE JOHN GUERRERO the amount of US DOLLARS: SIXTY THOUSAND (US$60,000.00) or its peso equivalent at the prevailing rate of exchange at the time of actual payment representing his total permanent disability benefits and attorney's fees.

Mr. Carlos Salinas is hereby EXCLUDED/DROPPED as party-respondent in this case.

All other claims are DISMISSED for lack of merit.

SO ORDERED.[14]
The LA ruled that although Guerrero's injury had resulted from a gym incident, the same would not release respondents PTCI and CC from their liability for disability benefits. It held that Guerrero's medical condition has rendered him permanently incapacitated to be a seafarer, as found by his chosen physician, Dr. Garcia. Lastly, it observed that Guerrero has been incapacitated to work for more than 120 days from the date he was repatriated and seen by the company-designated physician.

Not in conformity, respondents PTCI and CC filed a joint appeal before the National Labor Relations Commission (NLRC) praying for the reversal and nullification of the February 28, 2013 Decision of the LA .and for the dismissal of Guerrero's complaint for lack of merit.

The NLRC Ruling

On July 31, 2013, the NLRC rendered a Decision[15] reversing February 28, 2013 Decision of the LA. The NLRC disposed the case as follows:
WHEREFORE, premises considered, the appealed decision is hereby REVERSED and SET ASIDE, and the case DISMISSED for UTTER LACK OF MERIT.

SO ORDERED.[16]
The NLRC ruled that Guerrero is not entitled to disability benefits and payment of his other monetary claims because his injury is not work-related or not an injury sustained while working on-board the vessel. The NLRC added that apart from Guerrero's assertion, no other evidence was adduced to support and corroborate his "wheelchair theory," which incident allegedly caused his injury.

Guerrero's motion for reconsideration was denied by the NLRC in its September 13, 2013 Resolution.[17]

Aggrieved, Guerrero assailed the NLRC Decision and Resolution via a petition for certiorari filed before the CA, ascribing grave abuse of discretion on the part of the NLRC in denying his claim for permanent and total disability benefits and for attorney's fees.

The CA Ruling

In its September 10, 2015 Decision, the CA resolved to deny the petition for certiorari based on the same ratiocinations the NLRC had rendered. The dispositive portion of the Decision reads:
WHEREFORE, in the light of all the foregoing, the petition is hereby DENIED. Accordingly, the Decision dated 31 July 2013 and Resolution dated 13 September 2013 issued by public respondent National Labor Relations Commission, Second Division, in NLRC LAC No. 05-000495-13 are hereby AFFIRMED.

SO ORDERED.[18]
The CA held that the challenged decision of the NLRC was in accordance with law and prevailing jurisprudence and that no grave abuse of discretion amounting to lack or excess of jurisdiction can be imputed against said labor tribunal.

Guerrero filed a motion for reconsideration, but the same was denied by the CA in its January 14, 2016 Resolution.

Unfazed, Guerrero filed the present petition insisting that he is entitled to disability benefits as well as to the award of damages and attorney's fees.

The Court's Ruling

The petition is devoid of merit.

From a perusal of the arguments raised by Guerrero, it is quite apparent that this petition is raising a question of fact inasmuch as this Court is being asked to revisit and assess anew the uniform factual findings of the CA and the NLRC that his injury was not work-related. Guerrero is fundamentally assailing the findings of the CA and the NLRC that the evidence on record does not support his claim for disability benefits. In effect, he would have us sift through, calibrate and re-examine the credibility and probative value of the evidence on record so as to ultimately pass upon whether or not there is sufficient basis to hold PTCI and CC accountable for refusing to pay disability benefits to him under the Philippine Overseas Employment Administration's (POEA's) "Amended Standard Terms and Conditions Governing the Employment of Filipino Seafarers On-Board Ocean-Going Vessels," which is deemed written in his contract of employment. This clearly involves a factual inquiry, the determination of which is the statutory function of the NLRC.[19]

Elementary is the principle that this Court is not a trier of facts, and this applies with greater force in labor cases; only errors of law. are generally reviewed in petitions for review on certiorari criticizing decisions of the CA. Factual questions are for the labor tribunal to resolve.[20] Moreover, findings of fact of quasi-judicial bodies like the NLRC, as affirmed by the CA, are generally conclusive on this Court.[21] Accordingly, the instant petition' must be dismissed outright as it raises a question of fact.

Even if the Court is willing to overlook this procedural lapse, the present petition would just the same fail.

We carefully examined and evaluated the records of this case. Try as we might, however, this Court failed to identify any error committed by the CA in declaring that the NLRC did not commit grave abuse of discretion in dismissing Guerrero's complaint. Likewise, the Court sees no reason to disturb the similar factual findings of the CA and the NLRC regarding the non-work relatedness of the subject injury of Guerrero.

For disability to be compensable, two elements must concur: (1) the injury or illness must be work-related; and (2) the work-related injury or illness must have existed during the term of the seafarer's employment contract.[22] Work-related injury pertains to injury(ies) resulting in disability or death arising out of, and in the course of, employment.[23] Jurisprudence elucidates that the words "arising out of" refer to the origin or cause of the accident, and are descriptive of its character, while the words "in the course of" refer to the time, place, and circumstances under which the accident takes place. As a matter of general proposition, an injury or accident is said to arise "in the course of employment" when it takes place within the period of the employment, at a place where the employee reasonably may be, and while he is fulfilling his duties or is engaged in doing something incidental thereto.[24]

Work-relatedness of an injury or illness means that the seafarer's injury or illness has a possible connection to one's work, and thus, allows the seafarer to claim disability benefits therefor. The oft-repeat d. rule is that whoever claims entitlement to the benefits provided by law should establish his or her right thereto by substantial evidence.[25] Thus, the burden is placed upon Guerrero to present substantial evidence, or such relevant evidence which a reasonable mind might accept as adequate to justify a conclusion that there is a causal connection between the nature of his employment and his injury. The onus probandi fell on Guerrero to establish his claim for disability benefits by the requisite quantum of evidence that would serve as basis for the grant of the relief.

Unfortunately, Guerrero utterly failed to prove a reasonable connection between his work as a Casino Dealer and his alleged lumbar disc injury. Apart from his bare allegation that he sustained an injury sometime in January 2012 while assisting an elderly passenger on a wheelchair to disembark from the vessel in compliance to an order from the management, no other competent and independent evidence was proffered to substantiate and to corroborate his foregoing claim. We cannot overemphasize that self-serving and unsubstantiated declarations are insufficient to establish a case where the quantum of proof required to establish as fact is substantial evidence.[26] Awards of compensation cannot rest entirely on bare assertions and presumptions.[27]

On the other hand, respondents were able to expose the falsity of Guerrero's story when they submitted in evidence the Crew Injury Statement dated March 22, 2012, which contained Guerrero's admission to the effect that the subject injury resulted from his gym workout. For clarity, we hereto quote Guerrero's relevant narration of the gym incident which was written entirely in his own handwriting, thus:
On JAN 22, I went to the gym to do my usual workout after that I felt pain on my lower back. I went to see a doctor on that day and gave me 24 hrs. to rest after that I go back to work, but everytime I bend, I felt something painful on my left buttock so I decided to see the doctor again on March 4 after that the pain keeps coming back ever since.

Were you on duty at the time of the injury? No. It's my long break. I decided to go to gym to keep myself fit & healthy.

Please state what you could have done to avoid the accident? Do proper workout.[28]
The occurrence of the aforesaid incident was confirmed in a document denominated as Personal Injury Illness Statement which provided, inter alia, the following:
Brief Desc: Persistent painful lower back since heavy lifting in crew gym
Incident cause: SPORTS RELATED
Primary Factor: HUMAN ERROR
Lighting Type: Artificial Light-Bright
Location Condition: Clean
Involved Equipment Desc: gym
Equipment Condition: Good Working Order
Protective Gear Desc: Did Not Wear
These documentary evidence effectively belied Guerrero's insistence that he incurred the injury during the wheelchair incident. Guerrero's strenuous physical activity consisting of frequent bending and improper lifting of heavy objects during his routine workout at the crew gym on January 22, 2012 produced extreme torsional stress on his back which caused his subject injury. As aptly contended by the respondents, there is nothing in the Job Description Manual which states that part of Guerrero's duty as a Casino Dealer is to go to the crew gym and use its facility for his physical workout. Verily, Guerrero failed to prove work-causation of the subject injury. It may not be amiss to state at this juncture that the LA, the NLRC and the CA have similarly concluded that Guerrero's injury resulted from his crew gym workout on January 22, 2012.

Guerrero's contentions that his disability is permanent and total because Dr. Catbagan, the company-designated physician, failed to issue a medical certificate as to his fitness for work resumption or disability within the 240-day maximum period, and because his chosen physician, Dr. Garcia, issued a medical certificate finding him unfit for further service as a seafarer, would not advance his cause against the respondents.

To begin with, these arguments offered by Guerrero via the present petition were not raised before the labor tribunal and, thus, cannot be considered on appeal. It is well settled that matters that were neither alleged in the pleadings nor raised during the proceedings below cannot be ventilated for the first time on appeal and are barred by estoppel.[29] Points of law, theories, issues, and arguments not brought to the attention of the trial court ought not to be considered by a reviewing court, as these cannot be raised for the first time on appeal. To consider the alleged fact and argument belatedly raised would amount to trampling on the basic principles of fair play, justice, and due process.[30]

Further, the Court finds that the declaration of Dr. Garcia in the medical certificate that Guerrero is "UNFIT for further sea service in whatever capacity as a SEAFARER" leaves much to be desired. Said medical certification was not supported by any relevant and necessary diagnostic tests and/or procedures. No medical records or other sufficient proof was adduced to justify the above-mentioned pronouncement/diagnosis. It bears stressing that Dr. Garcia issued the medical certificate on the very same day that he was consulted by Guerrero. It is undisputed that the recommendation of Dr. Garcia was based on a single medical report which outlined the alleged findings and medical history of Guerrero despite the fact that said physician examined Guerrero only once. In the absence of adequate tests and reasonable findings, Dr. Garcia's assessment should not be taken at face value. At best, Dr. Garcia's medical certificate was merely concerned on the examination of Guerrero for purposes of diagnosis and treatment and not for the determination of whether the latter incurred a disability.

At any rate, any further discussion as to whether Guerrero suffered a permanent and total disability which entitles him to disability benefits, would be a mere surplusage. The medical certificate issued by Dr. Garcia and the alleged failure of Dr. Catbagan to issue the pertinent medical certificate within the maximum period of 240 days, are of no use and will not give Guerrero that cause of action he sorely lacked at the time he filed his complaint. His injury is not work-related, hence, not compensable.

Lastly, the Court observes that Guerrero proffered varying narrations/versions as to how he allegedly incurred his injury. In his Position Paper, Guerrero alleged that he sustained his injury when he lost his balance while assisting an elderly passenger on a wheelchair to get off the vessel as required by the management, but was able to regain equilibrium by pushing the wheelchair really hard. However, he gave Dr. Catbagan a different account by stating that he started feeling the back pain "after doing exercise at the gym" and this was reflected in the Medical Abstract/Discharge Summary.[31] Meanwhile, in his Comment/Opposition to Respondents-Appellants' Memorandum of Appeal,[32] Guerrero modified his version of the incident by adding that he heard a snap on his back while trying to maneuver the wheelchair and that "the gym incident was only the aggravating factor to complainant's severe back pain."[33] But in this present petition, Guerrero alleged:
Sometime in January 2012, he was involved in a medical call due to gastro-intestinal problem of an elderly. Together with a fellow crew, they placed the elderly on a wheelchair, but due to big waves, the vessel suddenly swayed before they could pass the platform of the bridge. As a consequence, petitioner was out of balanced and fell with his back landed first on the metal floor.[34]
Nowhere in any of his pleadings filed before the labor tribunals and the CA was there any mention that Guerrero accidentally fell with his back hitting the metal floor during the wheelchair incident. His conflicting and inconsistent statements cast serious doubt on the veracity of his wheelchair theory. Obviously, Guerrero willfully made such false statements in his futile attempt to deceive the labor tribunals, the CA and this Court that he suffered a work-related injury so as to obtain a favorable judgment. Thus, for not coming to court with clean hands and in order to prevent him from profiting from his own deception, basic rules of fair play dictate that we should deny his claim for disability benefits all the more.

Viewed in the light of the foregoing, the CA correctly ruled that no grave abuse of discretion can be attributed to the NLRC in dismissing Guerrero's complaint. The special civil action for certiorari under Rule 65 is intended to correct errors of jurisdiction or grave abuse of discretion amounting to lack or excess of jurisdiction.[35] Grave abuse of discretion means such capricious or whimsical exercise of judgment which is equivalent to lack of jurisdiction.[36] To justify the issuance of the writ of certiorari, the abuse of discretion must be grave, as when the power is exercised in an arbitrary or despotic manner by reason of passion or personal hostility, and it must be so patent and gross as to amount to an evasion of a positive duty or to a virtual refusal to perform the duty enjoined, or to act at all, in contemplation of law, as to be equivalent to having acted without jurisdiction.[37]

In the case at bench, Guerrero failed to demonstrate that the dismissal of his complaint by the NLRC was tainted with grave abuse of discretion or that the NLRC had no jurisdiction to order the same. On the contrary, the dismissal was proper and warranted since Guerrero has no cause of action against the respondents. We are so mindful that the respondents have exerted real efforts to extend medical assistance and even paid for all the expenses incurred in the course of the treatment of Guerrero. There is nothing on record that would justify a compensation on top of the aid and assistance already extended to him.

Let it be underscored that the constitutional policy to afford full protection to labor is never meant to be a sword to oppress employers. While the Court is committed to the cause of the labor, the same would not deter us from sustaining the employer when it is correct and proper. It must be emphasized that justice is, in every case, for the deserving and must be dispensed with after a thorough scrutiny and circumspect evaluation of the established facts, the applicable law/s and the·prevailing jurisprudence.

WHEREFORE, PREMISES CONSIDERED, the petition is DENIED. The Court of Appeals Decision dated September 10, 2015 and Resolution dated January 14, 2016 in CA-G.R. SP No. 132711 are hereby AFFIRMED.

SO ORDERED.

MANILA -- The Philippine Air Force (PAF) is set to acquire more air assets and equipment in the coming months, its commanding general said Tuesday.

In his speech during PAF's 72nd founding anniversary, Air Force commander, Lt. Gen. Rozzano Briguez said these aircraft are expected to support various operations of the PAF.

In the line-up for the PAF is another Lockheed C-130 "Hercules" transport aircraft, which is expected by the last quarter of this year and 16 combat utility helicopters and six additional NC212i aircraft which will start arriving by 2020.

Aside from these air mobility assets, the PAF chief said six brand-new Embraer A-29 "Super Tucanos" are expected to arrive by February 2020 and "will be a game-changing platform which will perform surface strike support to ground troops."

The "Super Tucanos" are expected to beef up the remaining North American Rockwell OV-10 "Bronco" attack aircraft being used by the PAF in strike missions.

The PAF's operational and strategic command-and-control will also be augmented by the arrival of "two command-and-control fixed-wing aircraft" which includes an EADS CASA C-295 medium transport which will arrive later this July and a Gulfstream G-280 twin-engine jet which will be delivered next year, Briguez said.

"Likewise, four unmanned aerial systems will be coming this year to support intelligence surveillance and reconnaissance for both operational and strategic functions," he added.

The PAF chief said they will also be finalizing its Integrated Command and Control, Communications and Computer Systems (IC4S) which will further enhance their capability in air operations.

"Through this, we will achieve robust, high performance, fully interoperable and integrated communications technology infrastructure that will provide all elements of the DND-AFP (Department of National Defense-Armed Forces of the Philippines) information requirement and support a common operational picture," he added.

Briguez thanked President Rodrigo R. Duterte for the "colossal and unprecedented support to the AFP" which includes the ongoing modernization program, significant salary increase for all soldiers, including the hazard duty pay of front-line troops in Sulu, together with the additional firearms.

These initiatives by the Command-in-Chief made troops more secure, confident, and focused in the conduct of operations, he added.

"We also highly appreciate the support of our foreign Air Force counterparts such as Japan, especially for the UH-1H spare parts they have given us. Our ASEAN partners, Indonesia, Malaysia, Myanmar, Singapore, Thailand, and Vietnam, and also South Korea, China, the United States, Russia, Australia, and other countries that we have been working closely with," the PAF chief said. MANILA — The Department of Labor and Employment (DOLE) on Friday reiterated that the government continues to implement programs aimed at advancing the rights of workers.

Labor Secretary Silvestre Bello III made the statement as he criticized reports citing the Philippines as one of the worst countries in the world for workers.

The DOLE chief noted that Filipino workers enjoy greater protection under the Duterte administration, emphasizing that the government has exerted genuine efforts in advancing their welfare, including the intensified enforcement of labor laws and standard, particularly in ensuring every worker's right to safe and humane working conditions, and to the security of tenure.

He was reacting on the International Trade Union Confederation (ITUC) Global Rights Index 2019 placing the Philippines "as among the top 10 worst countries in the world for working people,"

"It is unfortunate that ITUC failed to see the consistent efforts of the government in protecting the welfare of Filipino workers. To say that the country has drastically regressed in protecting the worker's rights is a drastically one-sided finding," Bello said in a statement.

Bello explained that the cases of "violence and murder, brutal repression of public protests, and repressive laws" among workers are all allegations as the cited accusations are not officially reported as labor-related incidents.

At the same time, he mentioned the enacted landmark laws that support the workers' greater interest, including the Occupational Safety and Health Law, and the Expanded Maternity Leave Law, among others.

Currently, the DOLE is in the process of hiring 500 additional Labor Laws Compliance Officers to complement the assessment of over 900,000 establishments across the country to ensure compliance with the general labor laws and standards.

"DOLE is not sleeping on its job and responsibility to protect the workers, in the same way, that we are mandated to encourage businesses to invest more. We remain committed to providing essence to our mandate despite these unwarranted accusations that undermine the genuine efforts of the administration," Bello said.

The ITUC promotes and defends workers' rights and interests and is the largest trade union federation in the world.

Last year, Duterte signed the landmark OSH Law, which ensures a safe and healthful workplace for workers by affording them full protection against all hazards at work.

It also provides that any person who manages, controls, or supervises the work is compelled to ensure that the place of employment is safe for workers, and should be free from hazardous conditions likely to cause death, illness, or physical harm to workers.

Earlier, the DOLE signed the IRR of Republic Act No. 11210 or the 105-Day Expanded Maternity Leave Law (EMLL), another landmark Act increasing the Maternity Leave Period to 105 days for female workers with an option to extend for an additional 30 days without pay and granting an additional 15 days for solo mothers and for other purposes.

Covered by the Law are female workers in the public and private sectors; in the informal economy; female members who are voluntary contributors to the Social Security System and female national athletes.

It also allowed a female worker, at her option, to allocate up to seven days of said benefits to the child's father, whether or not the same is married to the beneficiary. (PNA)

MANILA -- Once the Philippine Air Force (PAF) acquires brand-new multi-role fighters, the service will be capable of fielding an Integrated Air Defense System that will protect the country from aerial threats.

"The acquisition of multi-role fighters would soon complete the Integrated Air Defense System of the entire country, which is composed of sensors -- the radars, ground defense, and the interceptors, which will be our multi-role fighters," PAF commander, Lt. Gen. Rozzano Briguez, said in his speech at the Air Force's 72nd founding anniversary on Tuesday.

In support of this mission, Briguez said the Air Force has recently activated its FA-50 simulator facility at the 5th Fighter Wing, Basa Air Base, Floridablanca, Pampanga that will be used by the Air Defense Command in training a new generation of pilots.

"We have also installed our second radar at the Gozar Air Station in Lubang Island, Mindoro and we are continuously working on the construction of the radar basing support system for the third radar at Mount Salacot, Palawan," he added.

Briguez added that Defense Secretary Delfin Lorenzana has recently approved the plan to acquire the so-called "ground-based air defense system" that will be used in protecting radar bases and other important government facilities from internal and external threats.

The PAF Strategic Basing Plan intends to develop such areas as Lal-lo, Cagayan; Guiuan, Samar; Mati, Davao Oriental; Hill 900 in Zamboanga; and Balabac Island, Palawan to achieve effective and efficient air operations, he said.

The air force chief added that they will soon finalize their Integrated Command and Control, Communications and Computer Systems that will further enhance their capability to conduct air operations.

"Through this, we shall achieve a robust, high performance, fully interoperable and integrated communications technology infrastructure that will provide all elements of the DND-AFP (Department of National Defense - Armed Forces of the Philippines) information requirement and support a common operational picture," he added.

Briguez also took the opportunity to thank President Rodrigo R. Duterte for his "colossal and unprecendented support to the AFP," which includes the ongoing modernization program; significant salary increase for all soldiers, including the hazard duty pay of front line troops in Sulu; and the additional issued firearms.

These initiatives by the President and Commander-in-Chief have made the troops more secure, confident, and focused in the conduct of operations, he added.

"We also highly appreciate the support of our foreign Air Force counterparts, such as Japan, especially for the UH-1H spare parts they have given us; our ASEAN partners, Indonesia, Malaysia, Myanmar, Singapore, Thailand, and Vietnam; and also South Korea, China, the United States, Russia, Australia, and other countries that we have been working closely with," Briguez said. MANILA – Malacañang on Thursday said the Bureau of Fisheries and Aquatic Resources (BFAR) should validate a reported destruction of reef ecosystems in Panatag (Scarborough) Shoal and Spratly Islands due to China's reclamation and illegal fishing activities.

"I think this is under Department of Agriculture, kasi iyong Fisheries (BFAR) sa kanya (because BFAR is under DA) – they should conduct a study on that, to validate that particular finding of one particular group," Presidential Spokesperson Salvador Panelo said in a Palace briefing.

The University of the Philippines' Marine Science Institute (UP MSI) reportedly said the Philippines loses about PHP33.1 billion every year due to the damaged coral reefs in the disputed area of the West Philippine Sea.

Panelo said the Philippine government will undertake measures based on its own investigation.

"We will have to make our own study. The specific department concerned with that should conduct an inquiry on that matter and then the government will undertake measures," he said.

Asked if government is alarmed by the UP marine scientists' findings, Panelo replied: "We will always be concerned if it affects the security of the state and it affects the general welfare of the people".

Panelo said the Philippine Coast Guard should also enforce the country laws to prevent poaching activities within the country's exclusive economic zone (EEZ).

"They should know what to do, because they know their duty. We will leave it to them. The Coast Guards have their own specific duty in accordance with law," Panelo said. (PNA)

MANILA - President Rodrigo R. Duterte has signed an order directing various government agencies to focus on the development and support of economic zones (ecozones) in the countryside.

In Administrative Order No. 18 signed by Duterte on Monday and released to the media on Saturday, Duterte directed government agencies to provide needed interventions to strengthen ecozones in the countryside.

"There is a need to promote rural development, ensure inclusive growth in the countryside, and create robust economic activity and wealth generation in areas outside Metro Manila," the order read.

Duterte ordered the Department of Information and Communications Technology (DICT), Department of Trade and Industry (DTI), Department of Public Works and Highways (DPWH), Technical Education and Skills Development Authority (TESDA), and the Philippine Economic Zone Authority (PEZA) to hasten human capital and infrastructure development in the countryside and ensure the development of backward and forward linkages of industries in and around ecozones.

Moratorium on ecozones in Metro Manila

In the same order, the President ordered the PEZA to no longer accept, process, or evaluate applications for the establishment of ecozones in Metro Manila in line with the policy of promoting rural development.

"The herein moratorium shall not prevent locator companies from commencing their operations on existing ecozones in Metro Manila," the order added.

The order said applications already submitted by the PEZA to the Office of the President will not be covered by the moratorium.

"The exclusion of an application from the herein moratorium shall not be construed as a guarantee that the same will be granted," it said.

Special economic zones are defined in Republic Act No. 7916 or The Special Economic Zone Act of 1995 as "selected areas with highly developed or which have the potential to be developed into agro-industrial, Industrial tourist/recreational, commercial, banking, investment, and financial centers."

An ecozone may contain any or all of the following: industrial estates, export processing zones, free trade zones, and tourist/recreational centers. (PNA)

MANILA -- The Technical Education and Skills Development Authority - National Capital Region (TESDA-NCR) targets to train 10,000 people in construction-related courses this year to support the government's "Build, Build, Build" program.

In 2006, TESDA signed a memorandum of understanding (MOU) with the Department of Public Works and Highways (DPWH), for TESDA to help in the training and assessment of DPWH's heavy equipment operators. The MOU was renewed last April.

In an interview with the Philippine News Agency (PNA) on Thursday, TESDA-NCR Director Conrado Bares said DPWH needs 36,000 workers for 1,600 projects in the region.

"We need to supply that workforce and be able to provide training to 36,000 individuals. We aim to train 10,000 people this year in construction-related courses," he said.

The challenge, he said, is that there are only 50 technical-vocational institutions (TVIs) in NCR offering construction-related courses.

The agency will strengthen the dual training system (DTS) to address this. DTS combines theoretical training in schools and practical training in companies. This kind of training would depend on the collaboratively designed plan of the training centers and the industry.

Using DTS, the total number of training hours is 60 percent in the company and 40 percent in school. TVIs should have memorandum of agreements with companies that will partner with them for the DTS.

TESDA-NCR on Wednesday organized a workshop for TVIs, companies, and contractors.

"The goal is to ensure there would be no gap in what we are offering and what the industry actually needs. Through this workshop, TVIs would hear if the courses or training that they offer do not match with what the companies are looking for," Bares remarked.

"Attendees would also bargain with how they can partner with each other in training our enrollees. We could also conduct the training at construction sites," he added.

Those who would undergo training at construction sites will receive certification of completing the program. They will also be assessed and receive a national certification (NC) if they pass and qualify.

Meanwhile, Bares said TESDA-NCR's budget for Training for Work Scholarship Program (TWSP) for 2019 is PHP403 million.

Construction-related courses are TESDA-NCR's priority in TWSP this year, he added.

Most of TWSP enrollees, he said, often choose tourism and ICT courses.

"This is why, we hope the salaries in construction-related fields and other TVET courses would be increased. Every forum, we say that these courses have high employability. But of course, we could attract more enrollees if these kind of job receive a high salary," he said. (PNA)

Philippine Government / TESDA Partnership with DPWH
July 07, 2019, 12:23:13 AM
MANILA -- Technical Education and Skills Development Authority (TESDA) Secretary Isidro Lapeña on Wednesday noted that the agency's partnership with the industries and the Department of Public Works and Highways (DPWH) is a huge help to achieve their newest tagline, "Abot Lahat".

In an interview over "Tech-Voc Track ay Swak!", a radio program segment dedicated to feature services that TESDA offers, Lapeña said partnering with the industries enables TESDA to reach more people and at the same time assures employment for its trainees.

"Training will not serve its purpose if we could not provide employment to our trainees," he remarked, adding that TESDA's mandate is to provide training that will lead the trainees to a livelihood or job.

"Partnering with big companies has good results. Our trainees get employed immediately," he said.

TESDA has been strengthening partnerships with multinational firms and also conducts consultative meetings with the League of Corporate Foundations.

Some companies provide scholarships, others donate a building, while others share their facilities. Some of them get TESDA's trainees as their interns, which makes the trainees get exposed to high-tech facilities and get hired immediately.

Companies also benefit from partnering with TESDA, as the agency helps them train their people to avoid job mismatch. TESDA provides them provide the necessary training to their pool of workers, and also helps them recruit people.

Meanwhile, TESDA has a "Train to Build, Build, Build" project since 2018, with the goal of expanding the capacity of technical vocational education and training, train more skilled workers and address the need for more construction workers for the country's "Build, Build, Build" program.

TESDA renewed its partnership with the DPWH last April for the government's "Build, Build, Build" program. TESDA has been helping the DPWH in the training and assessment of heavy equipment operators since 2006.

With the renewed partnership, TESDA will enable DPWH engineers to be trainers and assessors. A crash course will be provided for them to prepare them as trainers and assessors of other skilled or qualified construction-related workers.

The DPWH, for its part, will provide practicum and administration venues, according to TESDA.

Lapeña said TESDA's coordination with the DPWH helps the agency produce more skilled workers, particularly in the construction field.

"We do project-based onsite training through our coordination with the DPWH. TESDA trains workers using the equipment of construction companies or of the DPWH in this training," he said.

The TESDA chief added that through this on-site training in construction sites, the trainees would not need to go to TESDA's training centers.

"So this is huge help for us to achieve the 'TESDA Abot Lahat'," he noted. (PNA)

Philippine Government / TESDA Intervention
July 07, 2019, 12:20:56 AM
MANILA – The Technical Education and Skills Development Authority in Region 11 (TESDA-11) plans to strengthen its intervention in conflict-affected areas, an official said on Thursday.

TESDA-11 director Lorenzo Macapili said the agency's intervention must not only end on skills training provision.

"It (intervention) has to be sustainable. We need the support and inputs of other agencies, NGOs (non-government organizations and the LGUs (local government units), down to the barangay level, to achieve this," Macapili told the Philippine News Agency in an interview.

According to Macapili, there were many places in the region that were declared peaceful by the military.

"But when the military left, they are back to (being inharmonious) because there was no sustainable intervention," he said.

TESDA-11 has identified 331 barangays it considers conflict-affected. The agency is currently doing the profiling of these barangays, according to Macapili.

He said TESDA-11 held a meeting with different agencies, NGOs and Davao City LGU and oriented them with its "Indicative Action Plan" for July to December. A joint regional poverty reduction livelihood and employment cluster and provincial task force cluster meeting on Executive Order 70, on the other hand, is scheduled Thursday in Davao Oriental.

"Under EO 70, government agencies' programs are harmonized depending on the needs of the communities," Macapili said.

In an earlier statement, Macapili said TESDA will anchor all its programs on the needs of the affected communities in a holistic approach to come up with a doable action plan composed of programs and activities "that will be implemented by us with all resources being harmonized".

He told the PNA it is important to assess first the communities, for TESDA and partners to know the proper intervention, adopting the value chain programming approach to be implemented by cluster agencies.

Meanwhile, Macapili said convergence meetings are also slated on July 9, 11, 19, 23 and 25.

"We will assess the community needs, will have community dialogues, community profiling, and identify problems from July 5-27," he said.

Macapili added that the Department of Social Welfare and Development, teachers, and trainers will join TESDA's provincial task force.

The results of assessments will be presented to the Provincial Capitol, and the designing of the value chain policy programs will be set in August. The program design will then be presented to the communities for enhancement and finalization.

Implementation of programs and policies is expected in September, according to Macapili. (PNA)

MANILA — Davao Archbishop Romulo Valles was re-elected on Saturday as president of the Catholic Bishops' Conference of the Philippines (CBCP).

According to an article posted on the CBCP news website, the 67-year-old Davao prelate was chosen by his colleagues during their plenary assembly in Manila, which started on July 6 and will end on Monday, July 8.

He will be serving his second and last term as leader of the Catholic bishops' group in the country.

Valles was first elected as CBCP head in July 2017, succeeding Archbishop Socrates Villegas of Lingayen-Dagupan.

His re-election would also make him the more visible face of the church as it gears for the 500th anniversary of the arrival of Christianity in the Philippines in 2021.

The bishops also re-elected Caloocan Bishop Pablo Virgilio David as vice president, Palo Archbishop John Du as treasurer and Fr. Marvin Mejia as secretary general.

Their terms of office will begin on December 1, 2019, up to November 30, 2021.

Elected CBCP officials have a two-year tenure in office, or a total of four to include the second term.

Some 83 bishops, 73 of them are active and five are retired, are present at the bi-annual meeting held at the Pope Pius XII Catholic Center.

On the other hand, Pope Francis expressed support to the CBCP members as they hold their plenary assembly, where they discuss issues that affect the Church and the country.

The Holy Father also wished their gathering "bear fruit for the benefit of all the faithful in an environment of living communion".

At present, the CBCP is composed of 134 members— 83 of whom are active, three are administrators, and 45 are retired from 86 ecclesiastical jurisdictions.

The plenary assembly is held twice a year-- in January and in July. (PNA)

Basketball | NBA-PBA / Russia vs Philippines
July 03, 2019, 01:36:54 PM
MANILA -- Russia led for almost the entire stretch of the game before mauling Gilas Pilipinas Youth by 28 points, 92-64, in their final game in the group stage of the FIBA U19 World Cup at the Heraklion University Hall, Greece early Wednesday (Philippine Time).

A far cry from its first two games where it had its chances, Gilas Youth never found its groove offensively against Russia despite doing pretty at the other end of the floor as the team finished the preliminary round of the tournament winless after three tries.

Alexander Ershov tallied 21 points, six rebounds, and four assists, while Nikita Mikhailovskii added 16 points, 10 rebounds, and four assists to lead Russia, which finished in second place in Group C, setting up a playoff first-round encounter with China later on Wednesday.

Kai Sotto and Dave Ildefonso each made 14 markers for Gilas Youth, which slipped to the fourth seed in Group C and will face Serbia in their own playoff encounter. (PNA)

Philippine Laws / GR No. 234156, Jan 07, 2019
July 03, 2019, 05:43:14 AM
DIVISION
[ GR No. 234156, Jan 07, 2019 ]
PEOPLE v. EMMANUEL OLIVA Y JORJIL +
DECISION

PERALTA, J.:

This is an appeal from the Court of Appeals (CA) Decision[1] dated May 31, 2017 dismissing Emmanuel Oliva y Jorjil, Bernardo Barangot y Pilais and Mark Angelo Manalastas y Gapasin's appeal, and affirming the Decision[2] dated October 28, 2015 of the Regional Trial Court (RTC), Branch 65, Makati City, convicting appellants of Violation of Sections 5 and 11, Article II of Republic Act (R.A.) No. 9165.

The facts follow.

The Chief of Station Anti-Illegal Drugs - Special Operations Task Group (SAID-SOTG), on January 23, 2015, received a report regarding the sale of dangerous drugs by a certain "Manu" in Barangay Cembo, Makati City and its nearby areas. As such, a buy-bust operation was planned and after coordination with the Philippine Drug Enforcement Agency (PDEA), a buybust team was formed wherein Police Officer 3 (PO3) Luisito Marcelo was designated as the poseur-buyer and given a P500.00 bill as marked money, and PO1 Darwin Catabay as back-up. Thereafter, the buy-bust team proceeded to the exact location of "Manu" after it was confirmed by the confidential informant.

When they arrived at the target area, the confidential informant pointed to appellant Oliva as "Manu," the seller of dangerous drugs; thus, PO3 Marcelo and the confidential informant approached the said appellant. PO3 Marcelo was introduced by the confidential informant to appellant Oliva as a buyer who wanted to buy P500.00 worth of shabu. PO3 Marcelo handed appellant Oliva the marked money after the latter demanded payment. Appellant Oliva then showed PO3 Marcelo four (4) transparent plastic sachets with white crystalline substance and asked the latter to choose one. Meanwhile, two (2) other persons, appellants Barangot and Manalastas were also at the target area to buy shabu. Appellants Barangot and Manalastas, and PO3 Marcelo each took one sachet from the four sachets that appellant Oliva showed.

Upon receiving the dangerous drug, PO3 Marcelo immediately scratched his chin, which is the pre-arranged signal to his back-up that the transaction has been completed. Subsequently, PO3 Marcelo grabbed appellants Oliva and Barangot and, thereafter, PO1 Catabay appeared and arrested appellant Manalastas.

The police officers conducted a body search on appellant Oliva and it yielded another sachet containing white crystalline substance, the marked money and two (2) more pieces of P500.00 bills. Eventually, appellants Oliva, Barangot and Manalastas were arrested and brought to the barangay hall where an inventory was conducted and on the basis thereof, an inventory report was prepared. The confiscated items were then marked and photographed, and a request for laboratory examination was accomplished and the seized items were submitted to the PNP Crime Laboratory. The substance found inside the sachets were all tested positive for the. presence of methamphetamine hydrochloride, a dangerous drug.

Thus, an Information for violation of Section 5, Article II of R.A. No. 9165 was filed against appellant Oliva, that reads as follows:

On the 24th day of January 2015, in the City of Makati, Philippines, accused, not being authorized by law and without the corresponding license and prescription, did then and there willfully, unlawfully and feloniously sell, deliver and distribute zero point six (0.06) gram of white crystalline substance containing methamphetamine hydrochloride (shabu), a dangerous drug, contained in one (1) small transparent plastic sachet, in consideration of Php500.00.

CONTRARY TO LAW.[3]
Also, in three informations, appellants Oliva, Barangot and Manalastas were separately charged with violation of Section 11 of the said law, thus:
Crim. Case No. 15-196
(against appellant Oliva)

On the 24th day of January 2015, in the City of Makati, the Philippines, accused, not being authorized by law to possess or otherwise use any dangerous drug and without the corresponding prescription, did then and there willfully, unlawfully and feloniously have in his possession zero point ten (0.10) gram of white crystalline substance containing methamphetamine hydrochloride (shabu), a dangerous drug.

CONTRARY TO LAW.[4]

Crim. Case No. 15-197
(against appellant Barangot)

On the 24th day of January 2015, in the City of Makati, the Philippines, accused, not being authorized by law to possess or otherwise use any dangerous drug and without the corresponding prescription, did then and there willfully, unlawfully and feloniously have in his possession zero point five (0.05) gram of white crystalline substance containing methamphetamine hydrochloride (shabu), a dangerous drug.

CONTRARY TO LAW.[5]

Crim. Case No. 15-198
(against appellant Manalastas)

On the 24th day of January 2015, in the City of Makati, the Philippines, accused, not being authorized by law to possess or otherwise use any dangerous drug and without the corresponding prescription, did then and there willfully, unlawfully and feloniously have in his possession zero point three (0.03) gram of white crystalline substance containing methamphetamine hydrochloride (shabu), a dangerous drug.

CONTRARY TO LAW.[6]
Upon arraignment, appellants, with the assistance of counsel, entered pleas of "not guilty" on all charges.

All appellants used denial as a defense.

According to appellant Oliva, on January 21, 2015, around 10:30 in the evening, he was in front of a neighbor's house when several armed men, riding in motorcycles, stopped by and invited him to go with them. When he refused to go, one of the armed men pointed a gun at him, handcuffed him, and forcibly took him to the SAID-SOTG office where he was detained.

On the other hand, appellant Barangot maintained that on January 22, 2015, around 2:30 in the morning, he was having a drinking spree with one Mel and Nonoy when several men barged inside the house and arrested them. They were then brought to the SAID-SOTG office where they were detained, and subsequently, freed after Mel and Noy paid the police officers for their release.

Appellant Manalastas also denied committing the offense charged against him and claimed that on the same date, he was inside his room sleeping, when he was suddenly roused by loud noises causing him to go outside and check the commotion. He saw armed men inside his house and, thereafter, the latter took him, his mother, a certain Bong, Ronald, Abby and two (2) boarders to the SAID-SOTG office where they were all detained.

The RTC found appellants guilty beyond reasonable doubt of the offenses charged against them and were sentenced as follows:
WHEREFORE, in view of the foregoing, judgment is hereby rendered as follows:

1. In Criminal Case No. 15-195, the court finds the accused, Emmanuel Oliva y Jorjil, GUILTY beyond reasonable doubt of the crime of violation of Section 5, Article II, R.A. No. 9165 and sentences each of them to suffer the penalty of life imprisonment and to pay a fine of Five Hundred Thousand Pesos (P500,000.00).

2. In Criminal Case Nos. 15-196 to 15-198, the court finds the accused, Emmanuel Oliva y Jorjil, Bernardo Barangot y Pilais and Mark Angelo Manalastas y Gapasin, GUILTY beyond reasonable doubt of the crime of violation of Section 11, Article II, RA. No. 9165 and sentences each of them to suffer the penalty of imprisonment of twelve (12) years and one (1) day, as minimum, to fourteen (14) years and eight (8) months, as maximum, and to pay a fine of Three Hundred Thousand Pesos (P300,000.00).

The period of detention of the accused should be given full credit.

Let the dangerous drugs subject matter of these cases be disposed of in the manner provided by law.

The Branch Clerk of Court is directed to transmit the plastic sachets containing shabu subject matter of these cases to the PDEA for said agency's appropriate disposition.

SO ORDERED.[7]
The RTC ruled that the prosecution was able to prove beyond reasonable doubt the guilt of the appellants.

The CA affirmed the Decision of the RTC in toto, thus:

WHEREFORE, the appeal is hereby DENIED.

IT IS SO ORDERED.[8]
The CA ruled that the prosecution was able to establish the key elements for illegal possession and sale of dangerous drugs, and that the bare denials of the appellants cannot prevail over the positive testimonies of the police officers. It also held that the failure of the prosecution to show that the police officers conducted the required physical inventory and take the photograph of the objects confiscated does not ipso facto render inadmissible in evidence the items seized.

Hence, the present appeal.

Appellants assigned the following errors:
I.

THE TRIAL COURT GRAVELY ERRED IN GIVING CREDENCE TO THE PROSECUTION WITNESSES' INCREDULOUS TESTIMONIES.

II.

THE TRIAL COURT GRAVELY ERRED IN FINDING THE ACCUSED-APPELLANTS GUILTY OF THE CRIMES CHARGED DESPITE THE POLICE OFFICERS' NON-COMPLIANCE WITH SECTION 21 OF REPUBLIC ACT NO. 9165 AND ITS IMPLEMENTING RULES AND REGULATIONS.

III.

THE TRIAL COURT GRAVELY ERRED IN ADMITTING THE ALLEGEDLY SEIZED DRUGS DESPITE THE POLICE OFFICERS' FLAWED MANNER IN THE CONDUCT OF INVENTORY AND MARKING THE SAME.

IV.

THE TRIAL COURT GRAVELY ERRED IN CONVICTING THE ACCUSED-APPELLANTS DESPITE THE PROSECUTION'S FAILURE TO ESTABLISH EVERY LINK IN THE CHAIN OF CUSTODY OF THE ALLEGEDLY SEIZED ITEMS.[9]
Appellants argue that it is difficult to believe the testimonies of the police officers because it is impossible for appellants to engage in drug transactions in the middle of the street, under broad daylight, and in the presence of strangers. They also claim that the arresting officers failed to immediately conduct a physical inventory of the seized items and photograph the same in the presence of the accused, their representative or counsel, a representative of the media and the Department of Justice (DOJ), and any elected public official who are required to sign the copies of the inventory. Thus, according to appellants, the prosecution failed to establish every link in the chain of custody of the seized items.

The appeal is meritorious.

Under Section 5, Article II of R.A. No, 9165 or illegal sale of prohibited drugs, in order to be convicted of the said violation, the following must concur:
(1) the identity of the buyer and the seller, the object of the sale and its consideration; and (2) the delivery of the thing sold and the payment therefor.[10]

In illegal sale of dangerous drugs, it is necessary that the sale transaction actually happened and that "the [procured] object is properly presented as evidence in court and is shown to be the same drugs seized from the accused."[11]
Also, under Section 11, Article II of R.A. No. 9165 or illegal possession of dangerous drugs the following must be proven before an accused can be convicted:
[1] the accused was in possession of dangerous drugs; [2] such possession was not authorized by law; and [3] the accused was freely and consciously aware of being in possession of dangerous drugs.[12]
In both cases involving illegal sale and illegal possession, the illicit drugs confiscated from the accused comprise the corpus delicti of the charges.[13] In People v. Gatlabayan,[14] the Court held that it is of paramount importance that the identity of the dangerous drug be established beyond reasonable doubt; and that it must be proven with certitude that the substance bought during the buy-bust operation is exactly the same substance offered in evidence before the court. In fine, the illegal drug must be produced before the court as exhibit and that which was exhibited must be the very same substance recovered from the suspect.[15] Thus, the chain of custody carries out this purpose "as it ensures that unnecessary doubts concerning the identity of the evidence are removed."[16]

To ensure an unbroken chain of custody, Section 21(1) of R.A. No. 9165 specifies:
(1) The apprehending team having in trial custody and control of the drugs shall, immediately after seizure and confiscation, physically inventory and photograph the same in the presence of the accused or the person/s from whom such items were confiscated and/or seized, or his/her representative or counsel, a representative from the media and the Department of Justice (DOJ), and any elected public official who shall be required to sign the copies of the inventory and be given a copy thereof.
Supplementing the above-quoted provision, Section 21(a) of the Implementing Rules and Regulations (IRR) of R.A. No. 9165 provides:
(a) The apprehending officer/team having initial custody and control of the drugs shall, immediately after seizure and confiscation, physically inventory and photograph the same in the presence of the accused or the person/s from whom such items were confiscated and/or seized, or his/her representative or counsel, a representative from the media and the Department of Justice (DOJ), and any elected public official who shall be required to sign the copies of the inventory and be given a copy thereof: Provided, that the physical inventory and photograph shall be conducted at the place where the search warrant is served; or at the nearest police station or at the nearest office of the apprehending officer/team, whichever is practicable, in case of warrantless seizures; Provided, further, that noncompliance with these requirements under justifiable grounds, as long as the integrity and the evidentiary value of the seized items are properly preserved by the apprehending officer/team, shall not render void and invalid such seizures of and custody over said items[.]
On July 15, 2014, R.A. No. 10640[17] was approved to amend R.A. No. 9165. Among other modifications, it essentially incorporated the saving clause contained in the IRR, thus:
(1) The apprehending team having initial custody and control of the dangerous drugs, controlled precursors and essential chemicals, instruments/paraphernalia and/or laboratory equipment shall, immediately after seizure and confiscation, conduct a physical inventory of the seized items and photograph the same in the presence of the accused or the person/s from whom such items were confiscated and/or seized, or his/her representative or counsel, with an elected public official and a representative of the National Prosecution Service or the media who shall be required to sign the copies of the inventory and be given a copy thereof: Provided, That the physical inventory and photograph shall be conducted at the place where the search warrant is served; or at the nearest police station or at the nearest office of the apprehending officer/team, whichever is practicable, in case of warrantless seizures: Provided, finally That noncompliance of these requirements under justifiable grounds, as long as the integrity and the evidentiary value of the seized items are properly preserved by the apprehending officer/team, shall not render void and invalid such seizures and custody over said items.
In her Sponsorship Speech on Senate Bill No. 2273, which eventually became R.A. No. 10640, Senator Grace Poe admitted that "while Section 21 was enshrined in the Comprehensive Dangerous Drugs Act to safeguard the integrity of the evidence acquired and prevent planting of evidence, the application of said Section resulted in the ineffectiveness of the government's campaign to stop increasing drug addiction and also, in the conflicting decisions of the courts."[18] Specifically, she cited that "compliance with the rule on witnesses during the physical inventory is difficult. For one, media representatives are not always available in all corners of the Philippines, especially in more remote areas. For another, there were instances where elected barangay officials themselves were involved in the punishable acts apprehended."[19] In addition, "[t]he requirement that inventory is required to be done in police station is also very limiting. Most police stations appeared to be far from locations where accused persons were apprehended."[20]

Similarly, Senator Vicente C. Sotto III manifested that in view of the substantial number of acquittals in drug-related cases due to the varying interpretations of the prosecutors and the judges on Section 21 of R.A. No. 9165, there is a need for "certain adjustments so that we can plug the loopholes in our existing law" and "ensure [its] standard implementation."[21] In his Co-Sponsorship Speech, he noted:
Numerous drug trafficking activities can be traced to operations of highly organized and powerful local and international syndicates. The presence of such syndicates that have the resources and the capability to mount a counter-assault to apprehending law enforcers makes the requirement of Section 21(a) impracticable for law enforcers to comply with. It makes the place of seizure extremely unsafe for the proper inventory and photograph of seized illegal drugs.

Section 21(a) of RA 9165 needs to be amended to address the foregoing situation. We did not realize this in 2002 where the safety of the law enforcers and other persons required to be present in the inventory and photography of seized illegal drugs and the preservation of the very existence of seized illegal drugs itself are threatened by an immediate retaliatory action of drug syndicates at the place of seizure. The place where the seized drugs may be inventoried and photographed has to include a location where the seized drugs as well as the persons who are required to be present during the inventory and photograph are safe and secure from extreme danger.

It is proposed that the physical inventory and taking of photographs of seized illegal drugs be allowed to be conducted either in the place of seizure or at the nearest police station or office of the apprehending law enforcers. The proposal will provide effective measures to ensure the integrity of seized illegal drugs since a safe location makes it more probable for an inventory and photograph of seized illegal drugs to be properly conducted, thereby reducing the incidents of dismissal of drug cases due to technicalities.

Non-observance of the prescribed procedures should not automatically mean that the seizure or confiscation is invalid or illegal, as long as the law enforcement officers could justify the same and could prove that the integrity and the evidentiary value of the seized items are not tainted. This is the effect of the inclusion in the proposal to amend the phrase "justifiable grounds." There are instances wherein there are no media people or representatives from the DOJ available and the absence of these witnesses should not automatically invalidate the drug operation conducted. Even the presence of a public local elected official also is sometimes impossible especially if the elected official is afraid or scared.[22]
The foregoing legislative intent has been taken cognizance of in a number of cases. Just recently, This Court opined in People v. Miranda:[23]
The Court, however, clarified that under varied field conditions, strict compliance with the requirements of Section 21 of RA 9165 may not always be possible. In fact, the Implementing Rules and Regulations (IRR) of RA 9165 - which is now crystallized into statutory law with the passage of RA 10640 - provide that the said inventory and photography may be conducted at the nearest police station or office of the apprehending team in instances of warrantless seizure, and that non-compliance with the requirements of Section 21 of RA 9165 - under justifiable grounds - will not render void and invalid the seizure and custody over the seized items so long as the integrity and evidentiary value of the seized items are properly preserved by the apprehending officer or team. Tersely put, the failure of the apprehending team to strictly comply with the procedure laid out in Section 21 of RA 9165 and the IRR does not ipso facto render the seizure and custody over the items as void and invalid, provided that the prosecution satisfactorily proves that: (a) there is justifiable ground for noncompliance; and (b) the integrity and evidentiary value of the seized items are properly preserved. In People v. Almorfe, the Court stressed that for the above-saving clause to apply, the prosecution must explain the reasons behind the procedural lapses, and that the integrity and value of the seized evidence had nonetheless been preserved. Also, in People v. De Guzman, it was emphasized that the justifiable ground for non-compliance must be proven as a fact, because the Court cannot presume what these grounds are or that they even exist.[24]
Under the original provision of Section 21, after seizure and confiscation of the drugs, the apprehending team was required to immediately conduct a physically inventory and photograph of the same in the presence of (1) the accused or the person/s from whom such items were confiscated and/or seized, or his/her representative or counsel, (2) a representative from the media and (3) the DOJ, and (4) any elected public official who shall be required to sign the copies of the inventory and be given a copy thereof. It is assumed that the presence of these three persons will guarantee "against planting of evidence and frame up," i.e., they are "necessary to insulate the apprehension and incrimination proceedings from any taint of illegitimacy or irregularity."[25] Now, the amendatory law mandates that the conduct of physical inventory and photograph of the seized items must be in the presence of (1) the accused or the person/s from whom such items were confiscated and/or seized, or his/her representative or counsel, (2) with an elected public official, and (3) a representative of the National Prosecution Service or the media who shall sign the copies of the inventory and be given a copy thereof.

In this case, the absence of a representative of the National Prosecution Service or the media during the inventory of the seized items was not justifiably explained by the prosecution. A review of the Transcript of Stenographic Notes does not yield any testimony from the arresting officers as to the reason why there was no representative from the DOJ or the media. The only one present to witness the inventory and the marking was an elected official, Barangay Captain Evelyn Villamor. Neither was there any testimony to show that any attempt was made to secure the presence of the required witness.

In People v. Angelita Reyes, et al.,[26] this Court enumerated certain instances where the absence of the required witnesses may be justified, thus:
x x x It must be emphasized that the prosecution must able to prove a justifiable ground in omitting certain requirements provided in Sec. 21 such as, but not limited to the following: 1) media representatives are not available at that time or that the police operatives had no time to alert the media due to the immediacy of the operation they were about to undertake, especially if it is done in more remote areas; 2) the police operatives, with the same reason, failed to find an available representative of the National Prosecution Service; 3) the police officers, due to time constraints brought about by the urgency of the operation to be undertaken and in order to comply with the provisions of Article 125[27] of the Revised Penal Code in the timely delivery of prisoners, were not able to comply with all the requisites set forth in Section 21 of R.A. 9165.
The above-ruling was further reiterated by this Court in People v. Vicente Sipin y De Castro,[28] thus:
The prosecution never alleged and proved that the presence of the required witnesses was not obtained for any of the following reasons, such as: (1) their attendance was impossible because the place of arrest was a remote area;·(2) their safety during the inventory and photograph of the seized drugs was threatened by an immediate retaliatory action of the accused or any person/s acting for and in his/her behalf; (3) the elected official themselves were involved in the punishable acts sought to be apprehended; (4) earnest efforts to secure the presence of a DOJ or media representative and elected public official within the period required under Article 125 of the Revised Penal Could prove futile through no fault of the arresting officers, who face the threat of being charged with arbitrary detention; or (5) time constraints and urgency of the anti-drug operations, which often rely on tips of confidential assets, prevented the law enforcers from obtaining the presence of the required witnesses even before the offenders could escape.
Certainly, the prosecution bears the burden of proof to show valid cause for non-compliance with the procedure laid down in Section 21 of R.A. No. 9165, as amended.[29] It has the positive duty to demonstrate observance thereto in such a way that, during the proceedings before the trial court, it must initiate in acknowledging and justifying any perceived deviations from the requirements of the law.[30] Its failure to follow the mandated procedure must be adequately explained and must be proven as a fact in accordance with the rules on evidence. The rules require that the apprehending officers do not simply mention a justifiable ground, but also clearly state this ground in their sworn affidavit, coupled with a statement on the steps they took to preserve the integrity of the seized item.[31] A stricter adherence to Section 21 is required where the quantity of illegal drugs seized is miniscule since it is highly susceptible to planting, tampering, or alteration.[32]

Thus, this Court finds it appropriate to acquit the appellants in this case as their guilt has not been established beyond reasonable doubt. The resolution of the other issues raised by appellants is no longer necessary.

WHEREFORE, premises considered, the Decision dated May 31, 2017 of the Court of Appeals in CA-G.R. CR-HC No. 08121 dismissing appellants' appeai and affirming the Decision dated October 28, 2015 of the Regional Trial Court, Branch 65, Makati City is REVERSED AND SET ASIDE. Appellants Emmanuel Oliva y Jorjil, Bernardo Barangot y Pilais, Mark Angelo Manalastas y Gapasin are ACQUITTED for failure of the prosecution to prove their guilt beyond reasonable doubt. Science and Research / Dangers of Microwave Oven
July 02, 2019, 02:12:01 PM
Re-posted from FB
The Japanese government has decided to dispose of all the " *microwave ovens*" in the country before the end of this year.

The reason for the ban on "microwave ovens" in the land of the Rising Sun was a research by scientists from the University of Hiroshima, where they discovered that "radio waves" cause greater harm to the health of citizens over the last 20 years, especially when using microwave oven which is more harmful than the American atomic bombs on Hiroshima n Nagasaki in Sept 1945.

According to experts, food heated in a microwave oven has very unhealthy vibrations and radiation.

Indeed, all the largest manufacturers of "microwave ovens" in Japan are being closed where this product is manufactured.

In 2021, the production of "microwave ovens" will be stopped, as announced in South Korea, and China plans to abandon this type of technology in 2023.

A conference on cancer prevention was held at the Kashira Cancer Center n the recommendations made at the end of the conference were:
1. No Refined oil
2. No Milk of animal origin (recommended soy milk)
3. No Food cubes (chicken broth spices like Maggie and the like)
4. No Soda (32 pieces of sugar per liter)
5. No Refined sugar
6. No Microwave ovens
7. Do not perform mammogram before birth, except echocardiography
8. No Very narrow underwear n bra
9. No Alcohol
10. Do not Dissolve iced food and then refreeze it
11. Do not drink water from the refrigerator in plastic bottles
12. Special deodorants when used after shaving because they cause cancer.

According to the recommendations of the conference, they advise to add these to your diet :
1. Vegetables
2. Honey moderately used instead of sugar
3. Plant proteins (beans instead of meat)
4. Two cups of water at body temperature on an empty stomach before brushing teeth
5. The food should be warm and not very hot
6. Aloe vera juice + ginger + parsley + celery + bromalin. We recommend mixing them and drinking them on an empty stomach
7. Carrot juice every day
8. Tomato, garlic n onion with meals

Note :
The American Physicians Association found answers to the cause of cancer:
1. Do not drink anything hot in plastic cups
2. Do not eat anything hot wrapped in paper or cardboard or in a plastic bag (for example: fried potatoes)
3. Do not eat in plastic or microwave dishes

We wish to note the following:
When plastic is exposed to heat, chemical compounds that can cause 52 kinds of cancer are released.

You must also avoid drinking all kinds of soft drinks such as "Cola, Pepsi, Av, Fanta n all concentrated juices because cancer feeds on sugar. Eat fresh pineapples and avoid pineapple mix. Do not eat heavy food after 7pm

Drink more water in the morning n less in the evening. Do not take a horizontal position (lying down/sleep) immediately after eating.

Inspiration & Hope / Life After Death
July 02, 2019, 09:02:55 AM
Is there life after death?

The existence of life after death is a universal question. Job speaks for all of us by stating, "Man born of woman is of few days and full of trouble. He springs up like a flower and withers away; like a fleeting shadow, he does not endure....If a man dies, will he live again?" (Job 14:1-2, 14). Like Job, all of us have been challenged by this question. Exactly what happens to us after we die? Do we simply cease to exist? Is life a revolving door of departing and returning to earth in order to eventually achieve personal greatness? Does everyone go to the same place, or do we go to different places? Is there really a heaven and hell?

The Bible tells us that there is not only life after death, but eternal life so glorious that "no eye has seen, no ear has heard, and no mind has imagined what God has prepared for those who love him" (1 Corinthians 2:9). Jesus Christ, God in the flesh, came to the earth to give us this gift of eternal life. "But he was pierced for our transgressions, he was crushed for our iniquities; the punishment that brought us peace was upon him, and by his wounds we are healed" (Isaiah 53:5). Jesus took on the punishment that all of us deserve and sacrificed His life to pay the penalty for our sin. Three days later, He proved Himself victorious over death by rising from the grave. He remained on the earth for forty days and was witnessed by hundreds before ascending to heaven. Romans 4:25 says, "He was delivered over to death for our sins and was raised to life for our justification."

The resurrection of the Christ is a well-documented event. The apostle Paul challenged people to question eyewitnesses for its validity, and no one was able to contest its truth. The resurrection is the cornerstone of the Christian faith. Because Christ was raised from the dead, we can have faith that we, too, will be resurrected. The resurrection of Jesus Christ is the ultimate proof of life after death. Christ was only the first of a great harvest of those who will be raised to life again. Physical death came through one man, Adam, to whom we are all related. But all who have been adopted into God's family through faith in Jesus Christ will be given new life (1 Corinthians 15:20-22). Just as God raised up Jesus' body, so will our bodies be resurrected upon Jesus' return (1 Corinthians 6:14).

Although we will all be eventually resurrected, not everyone will go to heaven. A choice must be made by each person in this life, and this choice will determine one's eternal destination. The Bible says that it is appointed for us to die only once, and after that will come judgment (Hebrews 9:27). Those who have been made righteous by faith in Christ will go into eternal life in heaven, but those who reject Christ as Savior will be sent to eternal punishment in hell (Matthew 25:46). Hell, like heaven, is not simply a state of existence, but a literal place. It is a place where the unrighteous will experience never-ending, eternal wrath from God. Hell is described as a bottomless pit (Luke 8:31; Revelation 9:1) and a lake of fire, burning with sulfur, where the inhabitants will be tormented day and night forever and ever (Revelation 20:10). In hell, there will be weeping and gnashing of teeth, indicating intense grief and anger (Matthew 13:42).

God takes no pleasure in the death of the wicked, but desires them to turn from their wicked ways so that they can live (Ezekiel 33:11). But He will not force us into submission; if we choose to reject Him, He accepts our decision to live eternally apart from Him. Life on earth is a test, a preparation for what is to come. For believers, life after death is eternal life in heaven with God. For unbelievers, life after death is eternity in the lake of fire. How can we receive eternal life after death and avoid an eternity in the lake of fire? There is only one way"through faith and trust in Jesus Christ. Jesus said, "I am the resurrection and the life. He who believes in me will live, even though he dies; and whoever lives and believes in me will never die..." (John 11:25-26).

The free gift of eternal life is available to all. "Whoever believes in the Son has eternal life, but whoever rejects the Son will not see life, for God's wrath remains on him" (John 3:36). We will not be given the opportunity to accept God's gift of salvation after death. Our eternal destination is determined in our earthly lifetimes by our reception or rejection of Jesus Christ. "I tell you, now is the time of God's favor, now is the day of salvation" (2 Corinthians 6:2). If we trust the death of Jesus Christ as the full payment for our sin against God, we are guaranteed not only a meaningful life on earth, but also eternal life after death, in the glorious presence of Christ.

Chatto ends 9-year
legacy governorship
By Ven Arigo

Edgar Migriño Chatto caps his three full capitol terms that have spanned across nine years of legacy performances when he steps down from office as the 25th Bohol governor at noon today, June 30.

Many consider the governorship to be yet the most demanding of his public career.

But Chatto has accomplished what are too important and monumental to be negated even by the most calculated poundings on his competence from harshest critics.

"As I end my term today as 25th Governor of the Province of Bohol, let me say thank you for all the support and prayers. Nine years breezed through quickly and will always be treasured memories to keep. Padayon Bohol! God bless us all!" said Chatto this morning before their inaugural oathtaking at the Bohol Cultural Center.
Also this noon, Chatto's fellow Padayon Bol-anon pillars, Arthur Yap and Rene Relampagos, officially take over as the governor and vice governor, respectively, for the next three years.
Reputably Bohol's most awarded public servant and government official, Chatto returns to Congress as representative of the First District.

He had ably served as congressman of the same district also for three terms before sitting as governor.

The Bohol Panglao International Airport has been finally constructed and done in Chatto's time under two presidents, Benigno Aquino III and Rodrigo Duterte.

Finally built and operational after 30 years since it was conceptualized, the modern airport is regarded to be the biggest most important singular economic infrastructure in this part of the country to date.

The airport may start its night flight operation in the fourth quarter this year, according to a source who is privy to an upcoming meeting of aviation authority officials with the new governor.

Chatto's administration has given Bohol an imposing new provincial capitol which, according to regional public works and socio-economic planning officials, is Central Visayas' largest government building.

Once its surrounding structures are completed as planned, the capitol complex will be a total one-stop shop.
Services are accessed fast right in the convergence of provincial offices and other vital government offices to the ease and comfort of the public.
The spaces at the vacated old capitol building in the downtown of Tagbilaran City will be occupied by essential national agencies which are interested to put up Bohol offices.

Among them are the Professional Regulation Commission (PRC), Department of Foreign Affairs (DFA), and Land Transportation Franchising and Regulatory Board (LTFRB).
Fronting the old capitol is the original capitol built in Spanish time which has been restored, upgraded and converted in to the National Museum in the Visayas.

In Chatto's time happened the concreting and improvement of most number of kilometers of provincial roads, including bridges, longer than all those concreted in the past combined.
This was mainly through the tourism convergence program of the Department of Public Works and Highways (DPWH) and Department of Tourism (DOT); Roads Leveraging Linkages of Industry and Trade (ROLL IT), also a convergence but between the Department of Trade and Industry (DTI) and DPWH; KALSADA / CMGP (Conditional Matching Grant Program); Philippine Rural Development Project (PRDP); 20% Development Fund (DF), exclusively a provincial resource; and road nationalization laws.

The improved roads have gained greater economic importance as they lead or connect to existing farm productivity areas, new economic growth areas, and tourism potential areas.

The First District congressman by noon today will also prioritize in his legislations an education that regains the love for farm enterprise, the enhancement of tourism, and acceleration of information communications technology development for Bohol's catching entry to the call center industry.
DESPITE LIMITED
LOCAL RESOURCES

Chatto proved that leaders who know get their plans done despite limited local resources.

The DOT-DPWH convergence is nationally-funded pursuant to the National Tourism Act of 2009, which principal author is Chatto when he was first congressman.

The KALSADA/CMGP is a fund counterparting scheme, with the bigger amount contributed by the national government to pave well the local roads in the provinces.

The KALSADA was a brainchild of Chatto based on Bohol's model implementation of the Provincial Roads Management Facility (PRMF).
It was pushed by the governors' league, supported by the Department of Interior and Local Government (DILG), and adopted by the national government under then Aquino for annual budget.

Provinces hailed the program as it would make them save their limited funds because of the big national counterpart to help repair and improve the provincial roads.
The Duterte administration sustained the program, but under the new name CMGP.

Bohol as the "origin" of the CMGP was loudly cited in the recent multi-region construction industry forum initiated by the DILG-CMGP Central Office in Cebu City.

KALSADA/CMGP LAW
Once back in Congress, Chatto will craft KALSADA/CMGP into a law---separate from the annual General Appropriations Act (GAA) where the program's yearly allocations are not fixed---but even reduced.

His intent is for the KALSADA/CMGP to have an assured, secured budget that will even instead increase every year.
In the prevailing practice, its annual budget is not fixed and was even lately halved because it only depends on how much is approved in the GAA, also known as the national appropriations law.

Former provincial roads have been improved because of their nationalization by laws then also authored by Chatto, with the support of fellow Bohol solons then.
These include the Panglao circumferential road, Abatan-Maribojoc-Antequera-San Isidro-Tubigon road, and Balilihan-Hanopol-Batuan road.
San Isidro already belongs to the Second District and Batuan to the Third District.
In Chatto's time was conceived the ambitious offshore connector bridge or the third Tagbilaran City – Panglao island bridge via Dauis, which project implementation has already started.
The most anticipated establishment of a full Bangko Sentral ng Pilipinas branch in Dauis has been generously credited to the stubborn lobby of Chatto, along with the local banking and business sector.
Bohol's economic growth in last five years had averaged higher and faster than the national average, according to the Central Bank.
KEEP POVERTY
DROPPING

Chatto asked all to support the incoming provincial administration as he cited the need to sustain the strategies to keep poverty incidence dropping to its lowest level possible.
Bohol's poverty incidence of over 50% in the past has fallen, significantly and dramatically to only 21.7% in Chatto's time, according to the national statistics authority.
Greater poverty indicators have still been in the Second District side of the province.
During Chatto's administration,  the projects in the district have included the following: Bohol earthquake assistance implemented by the provincial government, P147.6 million; earthquake assistance downloaded to the LGUs, P666 million; PRDP, P221.8 million; aid to barangays, P41.5 million; hospital improvement thru regular budgets, P28.8 million; hospital modernization, phase 1, P24.3 million; school buildings, P47.7 million; provincial 20% DF for roads, P174.2 million; rehabilitation and minor improvement of roads / barangay road development, P7.2 million; financial aids to support various infrastructure projects, P16.4 million; and agricultural programs, projects and activities, P100.9 million.
Programs for poverty alleviation have been recognized, though, by the LGUs and barangays as indicated in the HNU survey, which shows that Second District gave Chatto a net satisfaction rating of +92.

INSTITUTIONAL AND
'ACCIDENTAL' LEGACIES

On institutionalized services, many regard as among Chatto administration's legacies the Telephone and Radio Integrated Emergency System (TaRSIER 117), continuing modernization of government hospitals, Countryside Development Program – Purok Power Movement (CDP-PPM), Community-Based Drug Rehabilitation Program Without Wall (CBRP-WoW), HEAT IT Caravans, and fiscal management reforms at capitol itself.
But Chatto may be longer appreciated for his extraordinary leadership in the province's overly-tasking rehabilitation and recovery from the epic earthquake in 2013, even according to the outsiders.
He was greater than his physical difference when Chatto, a victim of childhood polio and near-death car accident when he was youth leader, led the Boholanos crush the terrorist try in 2017.
Pres. Duterte was there, meeting with Chatto at the height of the Abu Sayyaf attempt. (Ven rebo Arigo)

Boholana humanitarian icon Francisca Baluyot today presented to the incoming capitol administration the need and value of sustaining the partnership for life through surgical missions.

In a coordination meeting at the new capitol this morning, Baluyot named the missions set from July 2019 to March 2020 or within the first eight months of assumption of Arthur Yap as governor.

Yap was represented in the meeting by his transition team head and lawyer Nilo Ahat while incoming Vice Governor Rene Relampagos sent his trusted aide Matt Nemenzo.

Baluyot summarized the joint accomplishments of the Gift of Life and Provincial Government of Bohol under now outgoing Gov. Edgar Chatto that have already saved numerous lives.

The scheduled missions include the following : a) Gift of Sight - Cataract Surgical Mission at the Bohol Medical Care Institute, July 16-22, 2019 b) Cleft Lip and Palate Surgical Mission, Borja Family Hospital, August 19-23, 2019 c) Heart Surgical Mission in November, 2019; and d) Operation Giving Back Bohol Surgical Mission, February 22-28, 2020.
Cases for free operation during the February mission next year involve goiter, gallbladder, hernia, cyst, etcetera.

Another surgical mission will be done on March 20-27 in 2020 which may include kidney operation.

The coordination meeting was also attended by Provincial Administrator Alfonso Damalerio II, Gift of Life board trustees Fr. Victor Bompat and Engr. Al Uy; staff of Provincial Board Member Jade Bautista, who chairs the Sangguniang Panlalawigan Committee on Health; Provincial Health Officer Reymoses Cabagnot; Phileos Blanco, representing Tagbilaran City Mayor John Geesnell Yap II, and Dondon Gutierrez, for Vice Mayor Jose Antonio Veloso; and Liza Flores of the Special Projects Unit of the Office of the Governor.

The Gift of Life will celebrate this September its 25th year in Bohol, which is the international foundation's Philippine base.

A longtime Red Cross administrator before, Baluyot said Chatto has consistently supported but never used the Gift of Life missions with the province for his political advantage.

She is expecting the same commitment from the incoming administration of the province.

In a media gathering with capitol officials yesterday, incoming Congresswoman Kristine Alexie Tutor of the Third District appealed to all Boholanos to work together for their good.

In its board meeting last May 28, the Gift of Life named and approved Tutor among the new advisers of the foremost surgical-medical mission foundation.

Technology / Mobile License Plate Recognition
June 29, 2019, 10:18:58 PM
ATLANTA (PRWEB) JUNE 29, 2019

SECURIX LLC, ("Securix"), owner of the twenty-seven state-based Public Safety Companies in the U.S., has chosen REKOR SYSTEMS' new Mobile LPR-2 systems as its standard for all mobile license plate recognition requirements in new installations. SECURIX has evaluated the available options and determined that REKOR's approach is not only far more accurate but also far more cost-effective than any alternative. Securix has just placed an additional order for thirty more units for ongoing national trials and, anticipates that over time, thousands of these units will be placed into service nationwide.

Securix's CEO Jonathan Miller commented: "REKOR's subscription-based model enables us to deploy a far greater number of systems quickly, greatly expanding Securix's footprint. We are now in four states and growing rapidly. Both the far better results and unique 'vehicle recognition as a service' option differentiates REKOR from other competitors, reducing upfront capital expense and unplanned repair and maintenance. The ability to move units from one car to another in minutes and mount a fixed system in under an hour is another REKOR exclusive saving us money."

Although REKOR's LPR-2 system is currently used to support other areas of Law Enforcement and Parking Operations, SECURIX' s use of the LPR-2 will mark the first time REKOR products will be utilized in the detection of uninsured vehicles, a huge and growing problem in the U.S. which is otherwise rarely detected. In addition to providing a complete solution to the uninsured vehicle problem in the U.S., SECURIX also enhances officer safety and efficiency, is violator-funded with no cost to agencies, is entirely non-invasive and respectful and, enables governments to recover revenues to enable other worthwhile community programs.

About SECURIX
SECURIX has established and operates Public Safety Companies in various states around the nation to deploy their system, a full-featured, complete solution to the massive problems of identifying, citing and bringing uninsured vehicles into compliance. The focus is on solving the problem and reducing the burden on the law-abiding, not on incarceration and penalties. It provides complete citation infrastructure and support along with an interactive court diversion program and an easy, inexpensive path to compliance and success for violators. The system is incapable of privacy violations or profiling because it identifies only the vehicle, never the driver. Even sworn law enforcement officials determining probable cause for citation purposes, have no access to personal information.

The exclusive SECURIX InsureNet link with NLETS (the government-owned system that links all law enforcement agencies), make it the only company able to automatically track insurance status of both in-state and out-of-state motor vehicles and take action to properly protect the public. All other systems have unreliable data or, are limited to a single state or insurer. Securix is the only method possible to legally and effectively provide fair and equal enforcement across state lines.
