“For the moment, we consider him as public enemy number one. He has caused a lot of problems in the province,” pasabot ni Garbo.

“He’s a fugitive, may pending case siya, bench warrant, pending case with us anything is possible, hindi natin masasabi kung anong mangyayari” asoy ni Garbo.

Kinsay nalambigit

Soc way labot?

There's food for everybody 'ika nga!

mauna diha.. Sarap Maging Senador Yehee!!!

Pinay jailed for bringing shabu in 'tikoy' box to Saudi
ABS-CBNnews.com

MANILA, Philippines - A Filipina is now in jail in Jeddah, Saudi Arabia after airport authorities found 2.5 kilos of the illegal drug "shabu" in her luggage.
Another Filipino who was picking her up from the airport was also detained by the police.
Vice Consul RJ Sumague of the Consulate General ng Jeddah said the Filipina was returning from a vacation in the Philippines last February 2 when she was arrested at the airport.
Sumague said "shabu", the illegal drug methamphetamine hydrochloride, was found in three boxes of "tikoy". "Tikoy" is a glutinous rice delicacy usually served in the Philippines during the Lunar New Year.
According to the Filipina who talked to a consulate official, a friend had asked her to bring the "tikoy" boxes to Jeddah. The friend was the same person who was picking her up at the airport.

However, the friend had allegedly denied he asked the Filipina to bring the "tikoy" boxes.
The two OFWs are currently in jail in Jeddah as the investigation continues.
The consulate said the two OFWs may face the death penalty for bringing illegal drugs. - Report from Charles Tabbu, ABS-CBN

Marissa Lapid relieved case is over, says lawyer
LAS VEGAS, Nevada (UPDATE) - The wife of Sen. Lito Lapid is relieved that a US district court has handed down its verdict after she pled guilty to cash smuggling.

Marissa Tadeo Lapid was sentenced to three years of probation, including five months home confinement, a $40,000 fine, and forfeiture of $159,700 after pleading guilty to cash smuggling and conspiracy to structure money transactions.

Natalie Collins, spokesperson for lawyer Daniel Bogden of the US District Court of Nevada in Las Vegas, said Mrs. Lapid was charged for “knowingly and willfully conspiring and agreeing with other persons, both known and unknown, to commit the crime of structuring transactions with intent to evade reporting requirement.”

“Mrs. Lapid pled to two counts that are reporting violations and she received three years probation. There was no evidence that any of the money involved in the case was improperly obtained. It was simply a failure to properly report the money,” the decision read.

Senator Lito Lapid and wife Marissa Tadeo LapidIn a message to ABS-CBN North America News Bureau, Lapid’s lawyer Eliot Krieger said Mrs. Lapid can now breathe easy that the one-year trial is over.

“Mrs. Lapid is relieved to have this over,” he said.

He said Mrs. Lapid’s immigration status and her green card were not raised in the hearing yesterday. “The criminal case just had to do with the reporting violations,” he said.

Mrs. Lapid was arrested at the Las Vegas International Airport on January 15, 2012. The arrest was based on a warrant issued against her for allegedly smuggling $50,000 in cash at the McCarran International Airport in Las Vegas on Nov. 27, 2010.

In a copy of the arrest warrant obtained by ABS-CBN North America News Bureau’s Bev Llorente, the senator’s wife said she only had with her $10,000 and P10,000 in cash. But two socks containing $10,000 each and a cloth bag with $20,000 were found during an examination of Marissa’s carry-on luggage.

Mrs. Lapid was charged before US District Court Magistrate Judge Peggy Leen of Las Vegas in Nevada with a count each of cash bulk smuggling and conspiracy to structure transactions to evade reporting requirements.

The maximum penalty for conspiracy is a five-year prison sentence and a fine of $250,000 while the maximum penalty for bulk smuggling is five years imprisonment.

Collins said that inn addition to jail time, Mrs. Lapid is subject to a three-year off supervised release plus $100 special assessment per count at the time of sentencing.

No jury trial

In the plea agreement prepared by Assistant US Attorney Michael Chu and defense counsel Eliot Krieger, Mrs. Lapid pleaded guilty to bulk smuggling and conspiracy to structure transactions to evade reporting requirements.

Mrs. Lapid also agreed to waive her jury trial, to confront witnesses and to cross-examine them, the right to remain silent at such trial, right to testify in her own defense, the right to compel witness to appear at such a trial and testify on the defendant’s behalf, the right to have assistance of an attorney.

She can no longer withdraw her guilty pleas after she had entered them in court.

The plea stated Mrs. Lapid “knowingly concealed more than $10,000” in US currency on her person or other container.

When she was arrested in possession of $40,000, Mrs. Lapid remarked, “I’m sorry, it’s for my house.”

Mrs. Lapid will no longer wear an ankle monitor while under house confinement. Krieger said the senator’s wife could be allowed to travel after the 5-month confinement if allowed by the probation department.

Lapid loses $159,700 in US banks

Lapid’s decision to plead guilty to “structure cash deposits” also led to the forfeiture of  her assets in US banks.

A Philippine Star report said officials explained that Mrs. Lapid committed to “structure cash deposits” by separating a single deposit above the reporting threshold into two or more separate deposits for the purpose of evading” her financial institutions’ reporting requirements.

These financial institutions are banks located in the US. These banks are legally required since 1996 to report to the federal government cash deposits that were above a certain dollar amount, $10,000, “the reporting threshold,” by making the so-called currency transaction report (CTR) when a depositor makes a deposit.

The scheme involves breaking larger amount into two or more amounts that were less than the original amount and deposited them into multiple bank accounts, often on the same day.

According to the indictment, Mrs. Lapid on Jan. 5, 2009, deposited $5,700 cash at a Las Vegas branch of J. P. Morgan Chase Bank, a domestic financial institution.

Two days later, on Jan. 7, 2009, Mrs. Lapid deposited another $5,700 cash into the same bank account.

On or about April 8, 2009, Mrs. Lapid deposited $9,000 cash at a Las Vegas branch of Bank of America.

On April 8, 2009, Mrs. Lapid deposited another $9,000 cash at a Las Vegas branch of Wells Fargo Bank.

On May 11, 2009, she made another deposit of $9,000 cash at the Las Vegas Bank of America.

On the same day, Mrs. Lapid deposited $9,000 cash at a Las Vegas Wells Fargo Bank.

A week later, on May 18, 2009, Mrs. Lapid deposited $6,000 cash at Las Vegas Bank of America; $8,000 cash and $6,000 cash in Las Vegas JP Morgan and in Las Vegas Wells Fargo Bank of America.

On July 20, 2009, she deposited $8,000 cash at Las Vegas JP Morgan Chase Bank; the following day, she made another $9,000 cash deposit into the same bank account.

On Dec. 23, 2009, Mrs. Lapid deposited $5,000 cash each separately at Bank of America and at Las Vegas JP Morgan Chase Bank.

And on June 7, 2010, five months before she was arrested, Mrs. Lapid deposited $9,000 cash at JP Morgan Chase Bank at Las Vegas.

The US government forfeited all the “property, real or personal, involved in the offense, and any property traceable to such property,” including the $40,000 confiscated from Mrs. Lapid during her November 2010 arrival, and the monies she deposited in her bank accounts to the tune of $159,700.  -- With a report by Bev Llorente, ABS-CBN North America News Bureau; and the Philippine Star

CEBU CITY â€" As the video of two college students having sex continues to spread, the Criminal Investigation and Detection Group (CIDG) Central Visayas offered to investigate and help stop the video from circulating.

“If this girl will ask for justice sa pagkaguba sa iyang pagkatao ug sa iyang pagkababaye tungod aning scandal (for how this scandal has harmed her), we will be more than willing to help. This will also teach a lesson to others not to do such an act,” said Eddie Benigay, CIDG Central Visayas director.

Benigay, in an interview with reporters on Tuesday, said the man involved in the video might also be made to face charges for allegedly spreading the file. Copies of the three-part video have reportedly found their way to pirated DVDs and are also circulated by mobile phones.

The police, said Benigay, received reports that the man’s phone was repaired by a cell phone shop, which may have also uploaded the video.

“If that is true, then he will have to show documents or evidences to show that he was not the one who uploaded it,” added Benigay.

The video, allegedly shot two years ago, shows two students having sex. In one clip, the girl wears her college uniform and ID.

Students of that university were reportedly instructed by the school’s administration not to wear their uniforms starting Tuesday, to keep them from being bullied or embarrassed.

“We were told not to wear uniforms until further notice. One of our schoolmates was bullied by someone from another school because of the scandal,” one of the students told Sun.Star Cebu.

Benigay added that a case for violating Republic Act (RA) 9995, or the Anti-Photo and Video Voyeurism Act of 2009, and RA 9262, or the Anti-Violence against Women and Their Children Act of 2004 can be filed against the man involved in the video, depending on their investigation.

“But the question is if the girl is willing to file a case,” said Benigay.

He admitted the CIDG Central Visayas has no capability yet of tracing who might have uploaded the video, but said they can help prevent its further circulation.

“To those who have a copy of the video in their mobile phones, just keep it or better erase it. Do not spread it,” appealed Benigay. (JBT of Sun.Star Cebu)

Tinun-an `gitaktak’; Rama miapelar
Philip A. Cerojano ug Roger E. Vallena

“It is so much for her to be in that situation, where she can’t finish her study,” nagkanayon si Rama.

“They (duha ka mga tinun-an) need counseling. They need parental guidance. They need so much understanding,” pasabot sa mayor.

“If this girl will ask (for) justice, we will be more willing to help,” matod ni Binigay sa mga tigbalita.

(BRD)

CEBU CITY -- A woman died when her partner’s genital was locked tight inside hers, a radio report said.

In a Bombo Radyo report, the victims were having sex in a lodging house in Guizo, Mandaue City when the incident happened.

They were brought to the hospital but the woman was declared dead on arrival.

The doctor, however, refused to disclose the identities of the victims.

Both were said to be working in an export processing company in Mandaue City and each had relationships respectively.

Police are investigating the incident where it was reported that the male’s genital was cut.

The phenomenon is called penis captivus in medical terms or vaginal lock in which a woman's vaginal muscles clamp around the penis during intercourse so firmly it causes the male to be 'locked' inside her. (Sunnex with wire reports)

Even before the birth of Jesus Christ, humans have already been predicting the end of the world. The Romans speculated that a “mystical number” revealed to Romulus by 12 eagles meant the destruction of Rome.

Biblical scholars also interpreted passages such as “Verily I say unto you, This generation shall not pass away, till all these things be accomplished” (Matthew 24:34) as a warning of impending doom.

As we prepare ourselves for the so-called end of the world this Friday, December 21, based on an earlier interpretation of the Mayan calendar, here’s a look back at some of the most popular doomsday predictions that didn’t come true â€" although two ended with tragic consequences.

MANILA, Philippines - Yet another senator has blamed that he lost a child due to complications caused by the intake of birth control pills by the child's mother.

Sen. Bong Revilla said he cannot, in conscience, vote for the reproductive health bill because he witnessed first-hand the ill effects of taking artificial contraceptives.

Revilla said his wife, actress and Cavite 2nd District Rep. Lani Mercado, gave birth to a girl in 1990. The child died after 26 days due to a heart condition.

"Lani and I lost a daughter due to a complication caused by the use of contraceptive pills. Her name was Maria Alexandra.

Revilla said that before Mercado gave birth, she was religiously taking birth control pills.

Married women have a right to safe, satisfying sex, say Miriam, Pia, Loren

MANILA, Philippines â€" Women senators on Monday chided Sen. Tito Sotto for moving to strike out the phrase "safe and satisfying sex" in the Reproductive Health (RH) bill.

During the period of amendments, Sotto said he will no longer ask that the Senate remove the entire phrase but only the words "and satisfying."

“The reason why I wanted to remove the whole phrase originally is that I believe Reproductive Health in the context of a true Filipina does not pertain to safe and satisfying sex. When a true Filipina speaks of reproductive health, she means family, marriage, responsible parenthood, nurturing and rearing her children and the mother,” he said, causing a commotion in the Senate gallery.

Sotto said there are some phrases that are just not acceptable to Filipino culture.

“For the sake of the law, dahil mas magandang pakinggan at mas katanggap-tanggap sa ating mga kababayan, alisin na antin yung satisfying, Anyway it's subjective,” he said.

MANILA, Philippines (6th UPDATE) - The Senate and the lower House approved the reproductive health (RH) bill on 3rd and final reading Monday.

The lower House version of the bill, sponsored by Rep. Edcel Lagman, was first approved 133-79, with 7 abstentions.

The vote was made quickly, with 199 representatives present.

It passed by a higher margin of 54 votes on 3rd reading, in contrast to the close 113-104 vote on 2nd reading.

Some lawmakers made it to the plenary session to cast their votes despite being ill or having important matters to attend to.

Rep. Miro Quimbo, who voted in favor of the measure, attended the session despite being ill with dengue.

Quimbo, on a wheelchair, was accompanied by a doctor who held up his dextrose bag.

"Para sa bayan, I vote yes," he said when his name was called.

"Can't breathe well. Nursing a cold and headache. I almost screamed inside the plane bcoz of the pressure. But must go to Batasan," Negros Occidental Rep. Mercedes Alvarez said earlier in the day.

Those who voted no include party-list Rep. Juan Miguel "Mikey" Arroyo and Rep. Mitos Magsaysay.

"Mr. Speaker, this practicing Roman Catholic will always vote no," Arroyo said.

"I just voted NO!" Magsaysay said on Twitter.

House Speaker Sonny Belmonte Jr. and Rep. Lorenzo "Erin" Tañada III, who was the presiding officer in the 2nd reading, voted in favor of the measure in the final reading.

Senate nod

The Senate, meanwhile, approved it 13-8, on 2nd and 3rd reading.

The bill, sponsored by Senators Pia Cayetano and Miriam Defensor Santiago, immediately went to 3rd reading after the 2nd reading because President Benigno Aquino certified it as urgent.

The bicameral conference committee will get both versions of the bill for consolidation before the President signs it into law.

The Senate vote was made after the upper House tackled amendments proposed by Senator Vicente "Tito" Sotto III.

MANILA, Philippines â€" The corporate counsel of Getty Images is seeking stiff sanctions against Manny Pacquiao and 2 of his aides for attacking their photographer, Al Bello.

Yahoo! Sports’ Kevin Iole reported that Getty Image’s counsel, Lizanne Vaughan, sent a letter to the Nevada State Athletic Commission (NSAC) seeking a "significant suspension period" against Pacquiao, his adviser Michael Koncz and co-trainer Restituto “Buboy” Fernandez.

"We expect that you will take all appropriate actions against Mr. Pacquiao and his entourage, and expect that such will include a significant suspension period,” said Vaughan in her letter.

Koncz and Fernandez reportedly attacked Bello after they saw the photographer taking shots of the fallen Pacquiao following the boxer’s knockout defeat to Juan Manuel Marquez last week.

Koncz and Fernandez have issued separate statements, offering their apologies to Bello.

Pacquiao’s adviser said the incident was caused by a misunderstanding.

“And if it was construed any other way, then he has my sincerest apology,” he said.

Fernandez, for his part, sought the help of Philboxing’s Ed de la Vega to send his message across to Bello.

“Please help me tell the gentleman involved in the incident that I am deeply sorry for what happened,” Fernandez said. “I did not mean any harm. My reaction was just a result of the heat of the moment.”

He said he was confused and didn’t know how to react after seeing his best friend go down.

“Please tell him I am truly sorry.”

Bello himself said that he doesn’t want to get the police involved in the case. All he wanted was for Koncz and Fernandez to admit their mistake.

However, Vaughan said it won’t be enough.

“It is our view that an apology, while appropriate, is an insufficient consequence alone and will certainly not deter similar behavior in the future," she said.

Not Pacquiao’s fault

Top Rank president Todd duBoef said both Koncz and Fernandez need to take responsibility for their actions.

But he couldn’t understand why Vaughan is holding Pacquiao liable as the boxer was still unconscious when the commotion took place.

"Pacquiao didn't do anything wrong," duBoef said.

"There was a lot of emotion on the part of some people in his camp. If Koncz and Buboy did something, they need to be accountable for it. They need to talk to the commission and talk to the Getty people, but I don't see how you could ever think Manny Pacquiao would be.

MANILA, Philippines - Canadian singer Justin Bieber is now in danger of being declared a "persona non grata" in the Philippines for allegedly mocking People's Champ Manny Pacquiao in his Instagram account.

Yacap party-list Rep. Carol Jane Lopez is urging Congress to officially ban the Canadian singer from ever setting foot in the country after he posted allegedly insulting photos of Pacquiao on the Internet.

Lopez also urged the Filipino youth to stop listening to Bieber's songs and to stop going to his concerts. Bieber last held a concert at the SM Mall of Asia on May 2011.

The party-list lawmaker said the series of photos from Bieber about Pacquiao were hurtful to all Filipinos who admire the boxing champ. The photos showed Pacquiao's prostrate figure alongside personalities such as Michael Jackson and Simba, the cartoon lion from The Lion King.

Lopez said Bieber's photos were a personal affront since the Canadian singer is a known supporter of Pacquiao's rival for the pound-for-pound crown, American boxer Floyd Mayweather Jr.

Bieber earlier said Mayweather has nothing to gain from fighting Pacquiao after the Filipino champ lost his last 2 fights.

He later said he does not believe that loyal fans will abandon him for his boxing opinions.

Mayweather earlier urged Pacquiao to bounce back from his defeat to Juan Manuel Marquez.

Pacquiao, on the other hand, said he will pray for Bieber.

Dionesia Pacquiao would always lock herself up in her room before her son, Manny, faces a big fight.

Her fervor probably influenced the Pacman’s “rituals” at the ring before the start of the match.

Some of those rituals were absent during his latest match, where he lost to Mexican fighter Juan Manuel Marquez, even if Mommy D -- as she is fondly called -- did her usual routine.

After hearing the loss, she went out of her prayer room and cried in anguish, even blaming the boxer’s change in religion that led to the loss.

In an interview with dzMM later, a seemingly more relaxed Mommy D said: “Okay lang, tanggap na namin.

She said it will only be Manny who can answer the real reason behind the loss. Still, “sa aking side, gusto ko, huwag nyang iwan ang sign of the cross. 'Yun ang nakayaman sa kanya noon,” she said.

In a traditional Catholic country, speculations still abound as to what religion the boxing superstar is exercising now. Pacquiao said he did not change religions, but only sought a re-energized Christianity.

This newly found faith supposedly turned him around, with his vices such as gambling supposedly now a thing of the past.

Changes

Manny has even allegedly asked his mother to join him in his Christian path.

Also in a dzMM interview, boxing analyst Ronnie Nathanielsz noted the boxer’s rituals brought a deeper meaning to his every fight.

“In the past, he put the rosary around his neck and prayed solemnly in one corner,” he pointed out.

The rosary was absent on Sunday (local time), however.

While such rituals may be a superstition to some, analyst Ed Tolentino said: “Ang sa akin: May nawawala ba?

He cited that Pancho Villa always had his “voodoo green” shorts while Michael Jordan was always wearing his North Carolina uniform. Efren “Bata” Reyes never took a bath whenever he wins a match.

Nathanielsz added Pacquiao’s turning back on those previous rituals is “difficult, especially in a [Catholic] environment in the Philippines.”

Straying from the path While he could not deny the strategy and strength of Marquez, Nathanielsz said Pacquiao “strayed a little from his path…Maybe, God only knows. This is a lesson to him.”

For Mommy D, it could be a sign that his son should already hang up his boxing gloves for good.

Kung gusto nya as politician, dun na lang sya magserbisyo,” he said.

She also sought to console Filipinos from the heartbreak.

“Huwag na kayo masyado mabigo. Ako na nanay, tanggap ko na. Sana matanggap na ng fans…Ang Panginoon ang nag-uutos na huminto na sya,” she said.

MANILA, Philippines - Dionesia Pacquiao cried in anguish after watching her son’s heartbreaking loss to Mexican fighter Juan Manuel Marquez.

Immediately after seeing her son knocked out, Mommy D â€" as she is called â€" pleaded that he already stop from the sport that brought them out of poverty. Manny’s sister, Lisa, also asked that he retire from boxing.

Even the people of General Santos City, from where the boxing icon hails, could not believe what they saw.

Immediately after Pacquiao was knocked out in the sixth round, they began leaving the stadium and only a deafening silence can be heard. â€" from a report by Jay Dayupay, dzMM

But Why Not Mayweather Jr.?

A U.S. Senator Harry Reid has recently thanked and praised Manny Pacquiao for being such a positive financial force in Nevada Economy:

“Manny is a true friend of Nevada’s, whether he’s training or fighting in our state. His sport is a major player in our state’s economic arena and I, along with millions of others around the world, look forward to a great fight.”

I would have to agree that anytime that Manny Pacquiao fights in Las Vegas, the fights bring in a lot of people, which in turns cranks the local gambling and spending to a higher gear.  It is an honor to be mentioned in such a light, and I am sure that Pacquiao appreciates the compliment.

But what about Floyd Mayweather Jr.? Not only does he actually live in Vegas, but his fights bring in a tremendous amount of revenue, and he himself spends a ton of money in Las Vegason entertainment and every day purchases.  Gambling, houses, cars, and lavish hotel parties is something that Mayweather Jr. is known for, and correct me if I am wrong, but that is also a very generous investment into the local economy.

Before I could never see why many boxing fans thought that the treatment that Pacquiao and Mayweather Jr. get is not proportional, with Manny being given the credit for everything, while Mayweather scorned for anything he does. Now, I can see things more clearly.

Don’t get me wrong, Mayweather Jr. has done dozens of bad things in his life, or at least bad according to me, but for some odd reasons, his good deeds are either rarely appreciated, or go completely unnoticed. From having fundraisers, to paying for boxers or their families in financial turmoil, to giving away food to the poor; Mayweather Jr. has arguably done much more for those in need than the majority of the boxing community put together.

This recent statement by Senator Reid is yet another example of Floyd Mayweather Jr., a long time resident and ‘investor in the local economy’ of Las Vegas, being overlooked and ignored. Manny get a pat on the back for bringing the money to Vegas, yet Floyd is never thanked in such a fashion?

“I ended this meeting with a plea to all of the members and this is also a plea to all Cebuanos to pray for protection to our Señor Sto. Niño, to our Lady of Guadalupe and of course San Pedro Calungsod, that Cebu may be speared from the rummaging effect of what they call a super typhoon.” matod sa gobernador dihang nahinabi sa mga tigbalita sa Kapitolyo human sa tigom.

Gialerto

Bible Study / PRAYER FOR OFW'S
December 03, 2012, 02:25:31 PM
Dear Lord, source of hope and our way to salvation
Guide them as they travel.
Lead them on the right path,
And never let them depart from You.

Grant them a safe journey from the home they leave behind
To their respective destinations:
May they find true and honest friends,
May they encounter caring and gracious employers,
May they have decent and rewarding jobs,
May they have a peaceful stay,
May their sacrifices bear good and lasting fruits.

Watch over them and always lead them safely back home:
Keep them away from any harm and danger,
Spare them from sickness and accident,
Protect them from embarrassment and humiliation,
And deliver them from scandal and shame.

Stay by their side and always remind them of their true home:
As pilgrims, we are just passing in this world,
As Your creatures, we must return to You,
As Your servants, we must lead others to Heaven.

Watch over O Lord, those whom they leave behind;
Let their homes be always safe,
Let their children be always secured and responsible,
Let their love remain always faithful,
And let what they earn be spent for good.

Watch over us as we are away from one another.
With your grace and blessing, may we see each other again:
To enjoy once more each other’s company,
To hear and listen to our own life-stories,
And more than ever, to accompany one another
On the road that leads back to You.
Lord, please lead them safely back home.

AMEN.

MANILA (2nd UPDATE) - Five members of the Board of Directors of embattled firm Aman Futures Group Philippines, Inc. surrendered to the National Bureau of Investigation (NBI) on Sunday and expressed willingness to cooperate in the ongoing probe into the so-called P12-billion investment scam.

In a news conference, Justice Secretary Leila De Lima identified them as Leila Lim Gan, Edmund G. Lim, Wilanie Fuentes, Nazelle Rodriguez, and Lurix Lopez.

The 5, assisted by counsel, had executed sworn statements, and will appear on Tuesday's preliminary investigation hearing into syndicated estafa charges at the Department of Justice (DOJ).

NBI Deputy Director for Regional Services Virgilio Mendez, however, stressed that the 5 are not yet off the hook and should answer the charges against them. Mendez added that they surrendered for fear of their own safety.

De Lima said that while there is no request from the group, for now, to turn state witness, the likelihood for them to become witnesses of the prosecution is still there.

"Wala pa silang sinasabi ngayon [that they want] to be considered as state witness. They asked only for protective custody; we leave it to the [special] panel who among them can be utilized as state witness," she said.

De Lima said the information being shared by the group is vital in identifying not only the flow of investments in Aman Futures but also the assets of the firm.

The justice chief stressed that this is important in determining how the victims will be paid their lost investments.

One of the 5, who bared having spoken recently to Aman Futures founder Malaysian Mohammad Suffian Saaid, also known as Manuel Amalilio, reportedly divulged that Amalilio is still in Kota Kinabalu.

Another board member, Nonoy Luna, has yet to surface.

MANILA, Philippines (1st UPDATE) - Sen. Miriam Defensor-Santiago used plenary deliberations on the proposed 2013 budget of the Office of the Vice President (OVP) to berate Vice President Jejomar Binay for his statement against moves to craft a law banning political dynasties.

Early this month, Binay was quoted as saying that qualified candidates should not be prohibited from seeking public office just because their relatives are in politics.

Binay's son, Junjun, is the mayor of Makati City, and his daughter Nancy is running for senator.

Santiago, who authored an anti-dynasty bill that is currently pending at the committee level in the Senate, disagreed with Binay. She stressed that the Constitution prohibits political dynasties.

Even without an enabling law yet from Congress, she said politicians must not let their relatives run for office.

"Even if it's legal to establish a dynasty, I warn you, not all that is legal is moral," she said during the OVP's budget deliberations on Monday, raising her voice.

Binay was not present during the deliberations.

Santiago also hit Binay's statement that anti-political dynasty bills are "only being pushed by people who are perennial losers" in elections.

She recalled losing the 1992 polls to former President Fidel Ramos, which she said was marred by fraud.

"I won in the voting but I lost in the counting," she said. "Hanggang mamatay ako, 'yan ang tatayuan ko."

MANILA, Philippines â€" Another Pasay City Regional Trial Court(RTC) judge has approved ex-Commission on Elections (Comelec) chairman Benjamin Abalos Snr's request to travel abroad.

Pasay RTC Branch 117 Judge Eugenio dela Cruz said Abalos may travel to Taiwan from November 27 to 30.

Abalos, who is facing 11 counts of electoral sabotage before the Branch 117, is asking that he be allowed to go Taiwan to scout for bangus fingerlings.

Dela Cruz granted Abalos' motion and ordered the latter to post P110,000 travel bond and submit a compliance report upon his return to the Philippines.

Pasay City RTC's Branch 112, where Abalos is facing another two counts of electoral sabotage, had also allowed Abalos to leave for Taiwan. He was ordered to post a P200,000 bond.

The two lower courts saw Abalos' sincerity that he will come back to face charges of electoral sabotage.

The Sandiganbayan earlier disallowed the same appeal, however. In the anti-graft court, Abalos is facing plunder raps in connection with the mothballed NBN-ZTE deal. â€" with a report from Zhander Cayabyab, dzMM

Britain's Ricky Hatton receives attention after being knocked out by Ukraine's Vyacheslav Senchenko during their boxing match at the Manchester Arena in Manchester, northern England November 24, 2012. Photo by Phil Noble, Reuters.

Ricky Hatton's comeback after a 3-1/2 year absence from the ring ended in a ninth-round knockout defeat by Ukrainian welterweight Vyacheslav Senchenko in Manchester, England on Saturday.

Britain's 34-year-old two-weight former world champion had lost 4-1/2 stone in preparation for the fight and 20,000 fans turned up at the MEN Arena to see his return in his home city.

He seemed to heading for a points win but began to tire in the later rounds and the 35-year-old Senchenko, himself a former world champion, unleashed a fierce left hook to the body.

Hatton hit the canvas and failed to beat the count leaving the Ukrainian, who only lost his world title to American Paulie Malignaggi in April, as the only man to beat him in England.

"I thought I was maybe four rounds up but there were clear signs of ring rust," a tearful Hatton said on Primetime TV. "I hurt him a few times, and I was winning.

"It was a good shot, I should have realised he was looking for that."

Former WBA world welterweight champion Senchenko, who has now lost just once in 34 fights, winning 22 by knockout, was a stern test for Hatton who must now decide whether to fight on.

"I suppose that is what three-and-a-half years out of the ring does. I think I did alright - this guy only lost his unbeaten record in his last fight," Hatton added.

"I don't want to make any hasty decisions but I am really heartbroken. I am just gutted. I am not a failure, that is not how my career should end but I have to have a good think about it now."

Britain's former welterweight and light-welterweight world champion, who had quit after a devastating two-round knockout by Manny Pacquiao in May 2009, has now lost three of his 48 fights.

His best performance came in 2005 when he stopped Australia's Kostya Tszyu to add the IBF light-welterweight title to the WBU belt he already held.

He had a perfect 43-0 record until he was floored by Floyd Mayweather Jr in Las Vegas in 2007 and was never the same again.

Unconvincing victories followed against Juan Lazcano and Malignaggi but he was outclassed by Pacquiao and after a long period of inactivity he retired in July last year. (Writing by Ken Ferris; Editing by Greg Stutchbury)

DEAR Lolo,

Tawga lang ko sa ngan nga Homol. Kini mahitungod sa akong hinigugmang babae nga akong gika-live in karon ug sa among homeboy.

Tambagi ko, Lo, kon unsay angay nakong buhaton.

MANILA, Philippines - A suspect in the abduction and killing of Julie Ann Rodelas has told investigators that the model and television talent was raped twice to teach her a lesson, and was only killed because she recognized her friend’s boyfriend as one of her abductors.

Jaymar Waradje, in an affidavit he issued after his arrest, bared the details of the events he claims led to the killing.

Rodelas’ friend and fellow model, Althea Altamirano, earlier admitted that the plan was “to teach (Rodelas) a lesson” for reportedly spreading rumors that Altamirano already has two children.

Out of control

Chief Superintendent Mario dela Vega, director of the Quezon City Police District (QCPD), has a theory on what happened. “It might have been a move that went out of control that the only way they could get out of it was to kill her,” Dela Vega said in an interview yesterday.

Chief Inspector Rodel Marcelo, head of the QCPD Criminal Investigation and Detection Unit, said it appeared there was no plan to kill the victim.

“(Fernando) Quiambao (Jr.) was just recognized by the victim,” Marcelo said. Quiambao is Altamirano’s boyfriend.

According to Dela Vega, the “lesson” that was going to be “taught” to Rodelas was probably just to rape her. “In her statement, Althea was pointing to that rape, claiming she never thought it would come to the point of killing her friend,” he said.

Altamirano said she told Quiambao about the “rumors” that Rodelas was “spreading.”

In his statement, Waradje even recalled the moment when they were approached by Quiambao at around 3 p.m. on Nov. 5 at their “tarimahan” on Lanao street in the Salam Mosque Compound.

He was then with Efren Talib when Quiambao sought their help regarding Altamirano’s problem, referring to Rodelas as “peste sa buhay niya (a nuisance in her life).” Waradje said they were indebted to Quiambao and so they agreed.

‘Baby, I’ll be there’

They went around until they reached a mall in Pasay City. Hours later, after eating and conducting a stakeout at the parking lot, Quiambao supposedly received a text message from Altamirano.

Quiambao supposedly said: “Okay baby, nandyan na ako (I’ll be there). Just wait a minute.”

Waradje said he and Talib dragged the victim into the Mitsubishi Montero. The plan was for them to go straight to the safehouse and so he told Quiambao: “Jay, doon tayo sa balwarte sa amin (let’s go to our turf).” Their faces were then covered.

Waradje said Rodelas, apparently recognizing Quiambao, pleaded for her life: “Arjay, Jay-Ar. Sorry.” He said this “angered” Quiambao, who accosted him for mentioning his name.

‘Please don’t’

While at the safehouse in Culiat, Talib went to a room with Rodelas, as Waradje and Quiambao waited in another room. At one point, Rodelas shouted, “Huwag po, huwag po (Please don’t, please don’t),” then fell silent.

After about 10 minutes, Altamirano called up Quiambao to tell him she was at a police station to report the abduction.

Quiambao went out and left Talib behind and a certain Bob and a certain Abdibe as “lookouts.”

Waradje then went home and fell asleep until he was awakened by Bob, who was asking why a man identified as alias Aldos was there.

When Waradje arrived there at the safehouse, it was Talib who was outside and acting as a lookout. Inside was Aldos talking to Rodelas while holding a .45 caliber pistol.

He told Aldos that they were told by Quiambao to look after Rodelas. “Binilin sa amin yan ni Jay-Ar. Wag mong pakialaman (Jay-Ar left her in our care. Don’t mess with her),” Waradje said.

Aldos, however, replied: “Ano ba problema? Ito lang ayaw nyo pa akong pagbigyan (What’s the problem? Why don’t you grant me this favor)?”

Waradje responded that they were just told to look after the woman and Aldos again answered: “Yun lang? Ako bahala doon. Itatapon nyo na rin lang pakinabangan ko muna (That’s all? I’ll take care of it. You’re going to throw her away, let me use her first).”

Last meal

Quiambao arrived with a burger meal from a fastfood restaurant. It was handed to Waradje, who knocked at the door of the room where Rodelas was kept and handed the food to the woman â€" a move that he said he did to inform Aldos that Quiambao was already there.

Aldos answered: “Okay na. Tapos naman na ako (It’s okay. I’m done).”

When Aldos asked them what the plan was, Talib supposedly answered: “Shoot to kill daw, sabi ni Jay-Ar.” At this point, Aldos told the victim to eat the food they had bought and that she would be brought home. The victim, apparently still unaware that she was going to be killed, begged off and said she would just eat it when she reached home.

Waradje then went home and just asked for updates from the others. He said Aldos told him he was the first to shoot the victim and Talib followed.

According to Waradje, the victim was shot in the head five times, based on the account of Aldos and Talib. Waradje only managed to blurt: “Grabe naman. Sobra naman (That’s too much).”

Rodelas was dumped in Cubao, where she was also shot at around 5 a.m.

Policemen found her clutching a plastic bag with a receipt for the purchase at the fastfood restaurant. The same receipt was what led policemen to identify and arrest Quiambao

???

SAN JOSE, California â€" Nelly Gonzales, 58, still gets emotional when she talks about her ordeal as a caregiver in the U.S.

For 15 years, Gonzales was abused by her Filipino employer, paying her as low as $150 a month, to care for six developmentally-delayed adults 24/7.

She said, “All I wanted was respect. No matter your stature in life, you deserve some respect.”

It took her 15 long, agonizing years but Gonzales finally found the courage to fight back, after she saw Filipino caregiver Victoria Aquino on Balitang America talk about filing a case against her abusive employer.

She pointed out, “If she could do it, I thought, I could do it too. I could fight for my rights.”

Through the help of the Pilipino Association of Workers and Immigrants or PAWIS, Gonzales filed a claim for back wages against her employer in 2010.

PAWIS connected her with the Golden Gate Law Clinic, which provided her with free legal help.

Yesterday, in front of fellow caregivers, Gonzales announced that her employer settled with her for about $100,000.

But the fight is not over for Gonzales. PAWIS estimates that there are 114,000 Filipino caregivers in America â€" many of them abused.

Her kababayans need help.

This settlement may be a victory for Gonzales but the ultimate victory for her and her fellow caregivers is for the abuses to stop through legislation â€" through the passage of the California Domestic Workers Bill of Rights. The bill was vetoed by Governor Jerry Brown this year.

These caregivers and their advocates said they’re not giving up, until all caregivers â€" even those who are undocumented, are ensured proper wages and benefits.

Michael Tayag, organizer for PAWIS said, “Even if we see that there is more community organizing among domestic workers and caregivers, we really need to continue that fight.”

Gonzales’ message to fellow Filipino caregivers: “Speak up. Don’t be afraid. Fight for your rights â€" as a worker, and as human being.”

SINGAPORE: An unemployed man was jailed five months on Monday for filming his 15-year-old daughter while she was showering.

The man, who attributed it to a "lapse of judgment", was severely berated by a judge for "causing unthinkable harm" to the girl.

The father, who cannot be named due to a gag order, was found guilty of outraging his daughter's modesty.

He was also granted a discharge not amounting to an acquittal on a second charge under the Films Act.

The tall and bespectacled man, who turned up in court with his wife, remained emotionless during sentencing.

Investigations revealed that between January 2009 and March 2010, the girl was showering at home when she discovered she was being filmed.

Her father had placed a phone - on the video recording mode - in the pocket of a pair of jeans, which was hung in the toilet of his home.

His daughter discovered the phone while she was showering, and deleted the video after seeing the recording.

She later approached her school counsellor and a report was made in April 2010.

In mitigation, the man's lawyer, Mr Anand Nalachandran said that the man, who is a first time offender, "has gone through a very difficult period in the last two to three years."

He added that his client had pleaded guilty instead of contesting the charges in a trial.

Noting this, District Judge Lee Poh Choo said it was the only factor that held some mitigating weight.

However, she emphasised that the offense was "too serious, and leniency was not for parents who preyed on their young children at home".

She rebuked the man for "surreptitiously causing immense mental anguish and stress to the teenager".

She added that it was worse when the man had shifted the blame onto his daughter by calling her a "problem child".

Calling it an "absurd, ludicrous explanation", the judge pointed out that it reflected a lack of remorse.

Channel NewsAsia understood that the girl has been away from her family for a few years and is currently living at a Home.

The girl, who has two other siblings, is expected to live with her relatives eventually.

The unverified and undated video, with 438,224 views as of this story’s posting, is entitled “Robinson’s snake is dead.” It shows a snake supposedly with a humanoid head complete with blonde hair.

The video title refers to an old urban legend of a snake in Robinsons Galleria. There are other videos on YouTube also referring to the legend.

The videos are circulating again after several Robinsons malls opened and after the company announced the opening of new malls in Malabon and Cebu.

Robinsons is also set to open a new supermarket in Eastwood City on Thursday.

Screen capture of a video showing a supposed "Robinsons snake". It is one of many "snake" videos circulating on video sharing site YouTube.

The legend has several versions. According to one version, the snake was supposedly RLC tycoon John Gokongwei’s son, and the twin brother of Robina Gokongwei-Pe.

According to the story, the snakeman had access to the mall’s CCTV cameras, and would spy on women in the dressing rooms. If he saw a woman he liked, he would flip a switch and the woman would drop through a hole in the floor, straight into his arms.

Other versions alleged that the snake was a female and laid golden eggs, the source of the Gokongwei family’s wealth.

Yet another version claimed that Gokongwei kept a giant snake in the mall to ensure prosperity, and women in the dressing rooms would be chosen for the reptile to eat.

Actress Alice Dixon was once rumored to be among the snake’s almost-victims, and was allegedly paid a considerable amount to keep her silence.

In a speech Gokongwei-Pe gave in 2008 at the University of the Philippines’ School of Economics, she tackled the rumors, telling the graduating students:

“You were not born yet when the story of my kakambal na ahas who was half-woman, half-snake came out when we opened our second Robinsons Department Store branch in Cebu in 1985. My kakambal was supposed to be the source of our wealth as she laid golden eggs. She was supposed to be hiding under the floor of the fitting rooms, and every time a beautiful woman would enter, the floor would open and she would land right inside the mouth of my kakambal na ahas.

"I have no idea who started this incredible story, but I have to tell you that some people believed it and even started staring at my legs to see if there were any signs of snakeskin. A few people still ask me about it, and I have to tell them na naging handbag na ho sa Robinsons Department Store.

"Thank goodness there was no Internet yet at that time, or you would start receiving photos of me with a snake’s body and my kakambal na snake with a woman’s legs,” she said

MAKATI, Philippines - Vice-President Jejomar Binay on Friday said he does not approve of any law that will ban political dynasties.

In an interview with media at the Makati City Hall, Binay said people should be allowed to vote for their choice of leaders.

Vox populi," he added.

Binay and his wife, Elenita, are former mayors of Makati. Their son, Junjun, is the incumbent mayor of the city.

Binay's eldest daughter, Nancy, is running for senator under the United Nationalist Alliance in the 2013 elections.

Another Binay daughter, Abigai, is Makati congresswoman.

The vice-president claimed that the issue of political dynasties is only being used by those who can't win elections.

Gustong mabawasan ang kalaban," he said.

Binay said political dynasties are not a problem in other countries, such as the United States.

Patas patas lang yan eh," Binay said.

Feeling nako walay lami ang akong life nga walay love.

Rey Lyndon Lawas.

MANILA, Philippines â€" World super bantamweight champion Nonito "The Filipino Flash" Donaire congratulated the Filipino boxers who participated in Saturday's Pinoy Pride XVII, including AJ "Bazooka" Banal, who lost in the main event.

Donaire, fresh off his ninth-round technical knockout victory over Toshiaki Nishioka, was one of the commentators for the event.

In his Facebook and Twitter accounts, Donaire gave his recap of Pinoy Pride XVII, which was held last night at the Mall of Asia Arena in Pasay City.

"Four of our compatriots won and one lost. But did we really lose? Each of the wins came with great heart and determination," Donaire said. "It showed that homegrown talents should not be overlooked or forgotten and need to be supported."

"(Juan Martin) Elorde, (Jason) Pagara, (Rey) Bautista and (Michael) Domingo showed vast improvement and skill in the ring," he added.

Elorde defeated Gerry Sismundo with a fourth-round knockout in the undercard. Domingo, meanwhile, defeated Ugandan fighter Mudde Ntambe Rabison with a second-round knockout.

Pagara made short work of Barbados native Miguel Antoine, knocking him out in the very first round. Bautista, meanwhile, earned a hard-fought split decision victory over Mexico's Daniel Ruiz.

But Banal was not so fortunate. The Filipino boxer nicknamed "Bazooka" suffered a technical knockout loss to Thai fighter Pungluang Sor Singyu in the ninth round of the world bantamweight title fight.

Donaire, however, still commended Banal for showing great heart and effort despite the loss.

The one that can show all of them and be the best role model is the lone loss of the night--AJ Banal.

â€" Nonito Donaire Jr. (@filipinoflash) October 21, 2012

"The one that can show all of them and be the best role model is the lone loss of the night â€" AJ Banal” Donaire said.

"Yes, he cried. Losing hurts. I think it hurts more in boxing because you put your body out there and you can push it to extremes," he added.

"But amongst the wins, AJ's loss can serve as a learning lesson to not just himself but to other aspiring fighters out there," Donaire said.

Donaire pointed out that he, along with Filipino ring icon Manny "Pacman" Pacquiao, have both lost fights before.

Mannys lost,I've lost.Anyone can lose, but only the strong can come back.Hoping you come back stronger AJ.

â€" Nonito Donaire Jr. (@filipinoflash) October 21, 2012

"Anyone can lose, but only the strong can come back. Hoping you come back stronger, AJ," he said.

Banal lost for only the second time in his career, dropping his record to 28-2-1, with 20 knock outs.

Torres told dzMM that other passengers have disembarked from the plane and she was about to do the same when she noticed an envelope on the floor in front of her seat.

She initially thought the envelope only contained plane tickets. But when she opened it to check the contents, she was shocked to find dollars inside.

Torres immediately turned over the envelope to Customs personnel at the airport who counted the money. She found out the envelope contained US$5,000.

The money is now with the supervisor of PAL while authorities determine its rightful owner based on the flight’s manifest. -- Report from Dexter Ganibe, dzMM

Wannabe rock star wants Star Records deal

MANILA, Philippines -- In a letter addressed to actress-host Kris Aquino, her self-proclaimed "husband" Daniel Magtira responded to the presidential sister's branding of his claim as "crazy" with assurance of his unfailing love -- and a request to help him score a deal with a recording company.

Dated October 5, 2012, Magtira's letter to Aquino addressed the actress-host's televised reaction to his claim that he and the "Queen of All Media" are in fact married.

In an episode of her morning talk show "Kris TV," Aquino referred to Magtira as "baliw" (crazy) for having written her name as his wife in his certificate of candidacy. The Tondo resident was hoping to run as senator in the upcoming 2013 elections.

Referring to Aquino's apparent disgust at his claim, Magtira, in his letter to the Kapamilya star, informed her of his "love" and his resolve to stand by this despite criticisms.

"Kahit sabihan ako ng BALIW ay tatanggapin ko, DAHIL MAKAL KITA," Magtira said in his letter, closed with "Nagmamahal" and his signature.

Magtira also told Aquino that his aspirations of becoming a "rock star" are motivated by her, as she is his "inspiration."

Addressing Aquino's earlier statement that she cannot re-marry yet, Magtira assured the actress-host of his intentions to be bound to her in love.

Early this month, Aquino said she is not yet free to re-marry, even as her marriage with basketball player James Yap had already been annulled. According to the actress-host, she has yet to obtain the document from the National Statistics Office (NSO) which certifies her civil status as being single.

"Tungkol sa iyong NSO," Magtira said, "pakakasalan kita. Kahit itanong  mo kay  Doctor Love.

MANILA, Philippines (UPDATED) â€" The Sandiganbayan has granted the motion of former President Gloria Macapagal Arroyo to defer her arraignment for plunder charges. The charges stem from the alleged misuse of P366 million in Philippine Charity Sweepstakes Office funds.

The court said the arraignment of Mrs. Arroyo and former PCSO chairman Manoling Morato will be held on October 29.

Arroyo’s lawyers are asking the Sandiganbayan to allow the former President to be detained at the hospital. They are also asking the Supreme Court to issue a temporary restraining order on the case.

State prosecutors have withdrawn their objections for Mrs. Arroyo's hospital arrest.

Mrs. Arroyo was confined at the Veterans’ Memorial Medical Center due to a heart problem.

Doctors said Mrs. Arroyo needs constant monitoring and still has to undergo a number of tests.

Reading 1 Wis 7:7-11

I prayed, and prudence was given me;
I pleaded, and the spirit of wisdom came to me.
I preferred her to scepter and throne,
and deemed riches nothing in comparison with her,
nor did I liken any priceless gem to her;
because all gold, in view of her, is a little sand,
and before her, silver is to be accounted mire.
Beyond health and comeliness I loved her,
and I chose to have her rather than the light,
because the splendor of her never yields to sleep.
Yet all good things together came to me in her company,
and countless riches at her hands.

28th Sunday in Ordinary Time

Gospel Reading: Mk 10:17-30

AS [Jesus] was
setting out on a
journey, a man ran
up, knelt down before
him, and asked him,
“Good teacher, what
must I do to inherit
eternal life?” Jesus answered him,
“Why do you call me good? No one
is good but God alone. You know the
commandments: ‘You shall not kill;
you shall not commit adultery; you
shall not steal; you shall not bear
false witness; you shall not defraud;
honor your father and your mother.’ ”
He replied and said to him, “Teacher,
all of these I have observed from my
youth.” Jesus, looking at him, loved
him and said to him, “You are lacking
in one thing. Go, sell what you have,
and give to [the] poor and you will
have treasure in heaven; then come,
follow me.” At that statement his face
fell, and he went away sad, for he
had many possessions.
Jesus looked around and said
to his disciples, “How hard it is for
those who have wealth to enter
the kingdom of God!” The disciples
were amazed at his words. So
Jesus again said to them in reply,
“Children, how hard it is to enter
the kingdom of God! It is easier for
a camel to pass through [the] eye
of [a] needle than for one who is
rich to enter the kingdom of God.”
They were exceedingly astonished
and said among themselves, “Then
who can be saved?” Jesus looked at
them and said, “For human beings
it is impossible, but not for God. All
things are possible for God.” Peter
began to say to him, “We have
given up everything and followed
you.” Jesus said, “Amen, I say to
you, there is no one who has given
up house or brothers or sisters
or mother or father or children or
lands for my sake and for the sake
of the gospel who will not receive
a hundred times more now in this
present age: houses and brothers
and sisters and mothers and children
and lands, with persecutions, and
eternal life in the age to come.”

MANILA, Philippines - The controversial  Republic Act No. 10175 or the Cybercrime Prevention Act of 2012 could have been a product of shoddy lawmaking, a technology law expert said Tuesday.

Atty. JJ Disini, who is among groups and individuals who filed the 15 Supreme Court petitions questioning the cybercrime law, said the statute should have been laid out and written better.

"There is a tendency to cut and paste," he said, referring to the lawmaking process in the country.

Disini said the cybercrime law, which has been suspended for 120 days following a Supreme Court temporary restraining order, was initially modeled after the  Budapest Convention on Cybercrime.

However, the Philippine version fares poorly compared to the international pact, he said.

"The quality of the language is not as good as in the provisions that were lifted from the Budapest Convention. It could have been tighter, better said or provided," he added.

Disini said some of the provided cybercrimes like cybersquatting, identity theft and even the provision on spam and cybersex are not in the Budapest Convention.

Online criminal libel is also not in the convention.

Disini said while the Department of Justice (DOJ) has done well in moving for the Philippines' accession in the convention, "there was just a disconnect with how it was expressed in the law."

"On the whole, this is a good law. Kailangan natin ito but on the other hand, there are some provisions which are objectionable," he said

"The problem is that, there are so many things they want to put into the implementing rules and regulations," he added. "It's not up to the DOJ to determine what its power is. The power should be clearly vested and delineated by Congress."

DOJ also comes up short

He also said DOJ Assistant Secretary Geronimo Sy's explanations at a forum Tuesday failed to adequately address issues regarding the law, particularly on Constitutional red flags.

"Asec [Assistant Secretary] Sy gave it his best shot in defending the law, but some of his arguments, at least from my view,  fell a little too short," he said. Some of his arguments were not good enough."

As an example, he cited the provision that penalizes cybersex.

Disini said under the law, victims of cybersex operations will be more criminally liable.

"If you read the provision, the one who is penalized is the one who is making the exhibit, the lascivious exhibition online, not the person who is paying," he said.

He added that the statute does not clearly say that those financing cybersex operations are covered and penalized.

Telco worries

He also said telco industry representatives are concerned with law's so-called "takedown" provision.

"They were concerned about obligations to conduct real-time monitoring of data traffic. From their standpoint, they don't want to pay for that," he said.

He believes that the monitoring of real-time data traffic will see the government install monitoring machines in telcos' network operations center.

The machines will allow the government to to see which websites people will visit, Disini said.

"They will know what sites you went to, how long you stayed there, which pages you looked at, when you went into those sites," he added.

"It's a type of surveillance that violates the right to privacy," he said.

Disini said lawmakers who have announced plans to amend the law should now act.

"Hopefully, moving forward is they have expressed an intention to make corrective changes. I hope that process would be inclusive and the online community could involve themselves into those process," he said.

KUWAIT CITY - A Filipina working at a dress shop in Kuwait almost died after she was allegedly raped and stabbed several times on the neck and back by a Kuwaiti traffic policeman on October 1 inside a police patrol car.

Marissa (not her real name), 27, a native of T’Boli, South Cotabato can barely move from her bed due to back pain. She was deployed to Kuwait on September 12, 2006 to work as a household service eorker for three years and later on at a dress shop in Farwaniya.

She recounted that on the evening of September 30, she and her female friend came out from a mall. They were inside a cab on their way home to Farwaniya when they were stopped by the suspect who alighted from the police car. Unfortunately, her residence visa just expired four days ago and was still being renewed by her new sponsor.

The suspect let her friend get away as she still had a valid visa while she was taken by the suspect to the police car. He drove her to a dark and deserted place in South Surra where he allegedly raped her.

She begged him to stop but he went on and stabbed her several times with a Swiss knife on her neck and back. He then kicked her in the back and left her along the highway.

A police on patrol passing by the area saw her lying unconscious and full of blood. She was taken by an ambulance to the Mubarak Al Kabeer Hospital where she was admitted to the intensive care unit for three days.

The suspect was arrested on October 4 and was presented by authorities to her on Sunday for positive identification.

Wala talagang konsensya,” sobbed Marissa.

She revealed that one of the female relatives of the suspect visited her on Saturday at the hospital and offered her some money and a job on a condition that she drops the case against the suspect. But Marissa declined and vowed to fight for justice.

Salamat sa Diyos at nabuhay ako,” she pointed out.

Meanwhile, the Philippine Embassy in Kuwait vowed to pursue the case against the suspect.
