Corella - Bohol / Corella operations paralyzed!
April 06, 2012, 06:34:29 PM
By SEN GUINGGUING

It was complete paralysis as far as far as money matters are concerned in Corella town. Thus declared Corella Mayor Jose Nicanor Tocmo whose running war with V-Mayor Vito Rapal has reached alarming proportions resulting in a standstill of monetary transactions involving the town. This developed as the municipality received a writ of execution of all the goods and chattels of the Municipality of Corella in favor of PhilKonstruct Development Corp., a supplier and heavy equipment provider contracted by the municipality during the incumbency of mayor Vito Rapal. The following items are ordered garnished in favor of the complainant: P8,233,000.00 representing claimant’s claim for unpaid billings for work done and material supplied; P4,000,000 representing claimant’s claim for materials purchased and delivered but not installed; P611,650.00 representing claimant’s claim for accrued interest; and P87,721.00 as reimbursement of the amount advanced by claimant representing one third of the total arbitration fees.

The respondent municipality was liable of paying the claimant after a decision was promulgated on Nov. 8, 2011 by the Construction Industry Arbitration Commission, an arbitral tribunal under the Department of Trade and Industry. The writ of execution was to be returned to its issuing entity within 15 days from receipt of the order. However, the writ said if sufficient personal property cannot be found to satisfy the execution and lawful fees thereon, the municipality through Mayor Tocmo and v-mayor Rapal in his personal capacity were commanded that of the lands and buildings of the respondent “you make the said sum of money in manner required by the Rules of Court and make return of your proceedings with the writ within 30 days from receipt hereof”.

With the writ now in force, Mayor Tocmo is in a quandary whether to follow the order or not. He said what is at stake now is the bank deposit of the municipality in the Lank Bank of the Phils. With the bank presumably in possession of the writ, Mayor Tocmo wondered if the town is allowed to withdraw its deposit thereby paralyzing all its pecuniary transactions. The arbitration arose from a contract of agreement sometime in October 2009 entered by then mayor Rapal with PhilKonstruct for the procurement of materials, equipment and labor for the waterworks project of the municipality. Rapal’s support in the procurement of material and services was Municipal Ordinance No. 2010-02 which was later found to be illegal because the sixth mandatory vote to satisfy the requirement of the law was made by the presiding officer (vice mayor) officer even if there was no tie to break as shown in the voting sheet.

According to Mayor Tocmo, these transactions were highly irregular because there was no available funds that would support the invitation for bids; notice of award and the contract agreement. The problem cropped up when the supposed loan the municipality had applied in the amount of P12 million was not released by Land Bank. The loan release was supposed to finance the project. The bank withheld release of the loan pending compliance of requirements particularly the endorsement from the Sangguniang Bayan and the Sangguniang Panlalawigan. Although no money was yet in sight to finance the delivery of equipment and services, the contractor-supplier went ahead with its part of the deal. One component of the package was the delivery of a road roller which for sometime being exposed to the elements after Mayor Tocmo ignored its delivery. With the supplier holding the empty bag given the refusal of the Tocmo administration to acknowledge delivery of the equipment, the company was forced to sell it to another party to cut its losses.

In his own answer to the arbitration proceedings, Mayor Tocmo said he was consistent in his position that Rapal did not get the authorization from the SB to enter into a loan with Land Bank for failure to get the qualified majority vote of six members as mandated by Article 107 (g) of the Implementing Rules and Regulations of Republic Act 7160 as shown in the voting sheet of the enabling municipal ordinance. At the same time, Mayor Tocmo also denied that his refusal to pay the alleged obligations of the complaint was not grounded on the political differences with former mayor Rapal. The mayor said he was not under obligation to pay the contracted supply and services because there was no loan that was released from Land Bank. For his part, former mayor Rapal declared that there was nothing irregular in the municipal ordinance that he used in support of his plan to borrow money from the Land Bank to finance his pet project involving the improvement of the Corella Waterworks System.

Corella to court: junk water deal with BWUI
July 31, 2011

Like Cortes town, Corella did not agree with water compensation paid by service provider. Now, it is digging the dirt against the water deal with Bohol Water Utilities, Inc. (BWUI), which is extracting water resources in its back yard with a very low price tag.

After Cortes town annulled similar Memorandum of Agreement (MOA) over alleged "unfair" water transaction, BWUI is facing yet another legal battle over the same deal. This is aside from another case to be elevated to the National Water Resources Board (NWRB) by city government over the water bill collection that retroacts in 2006.

Sensing that the MOA is disadvantageous to townsfolk all these years, Corella officials filed Civil Case No. 7939 for "Declaration of Nullity of Memorandum of Agreement and Damages" before the Regional Trial Court based here.

Named respondents is the BWUI represented by Mr. Romeo G. Robles, senior manager in the said case filed by the Municipality of Corella through Mayor Jose Nicanor Tocmo, Felix Salang, Onesimo Anong and Domingo Curayag.

In their eight page complaint, the plaintiffs asked the court to declare the said MOA as "null and void and of no further force and effect." They also prayed for the court to order the defendants to pay "deficiency" amount of "P1.25/ cu.m. on the amount of water extracted from the six wells since January 2003 up to the present" and to pay the reimbursement of P300,000 and P2,000 for every appearance of its counsel in the hearings. Atty. Antonio Arabejo of the Arabejo and Mar Law Firm assisted the complainants.

Mayor Tocmo is authorized by the Sangguniang Bayan to proceed with the filing of the said case by virtue of the Municipal Resolution No. 2011-28.

The Resolution pointed out to get the fair share of the town contrary to the MOA. "The extraction/royalty fee paid by BWUI is grossly minimal in the amount of P0.25 per cubic meter which is way below the P1.50 per cubic meter as provided in section 3.b of Municipal Ordinance No. C-013 of Corella, Bohol."

The Resolution also accused BWUI of not providing an environmental guarantee fund to answer for the conservation and sustainability as a result of the underground water extraction.

Corella-BWUI MOA void?

The MOA disputed by the Corella allows the respondent to establish five pumping stations and facilities in this town in connection with its rights to extract underground water.

It also provides that "BWUI shall pay the Municipality (Corella) as a royalty fee of P0.25 /cu. M. For water being extracted less the free water to the municipality from existing five deep wells of BWUI beginning upon the effectivity of this agreement."

Aside from this term, BWUI will also provide free water supply of not exceeding 15,000 cu m. And in excess of this volume, the town shall pay the former and amount of P15/ cu. M. The MOA took effect on January 1, 2003.

According to the complaint, then Mayor and now Vice-Mayor Vito Rapal entered into the said MOA with BWUI on September 17, 2004, more than a year already following the approval and enactment (on March 17, 2003) of Mun. Ordinance No. C-013, imposing a royalty fee of not less than P1.50/cu.m.

The said agreement is contrary to the aforesaid Ordinance, the complainants stressed. Thus, the SB of Corella passed the following year (2005) Resolution No. 71-05 declaring the said agreement "to be null and void."

The same MOA "has no concurrence of the Sangguniang Bayan of Corella," said the complainants. Under the Local Government Code, local chief executive must secure prior authority to enter into all agreements in the form of a MOA and other similar instrument of contracts.

The complainants also alleged that the said MOA did not provide P2 million as guarantee fund for development of watershed in the area near and around the pumping units.

As a consequence, "The Municipality of Corella is continually suffering the degradation of its natural water resources as the establishment of the watershed in the area is stalled by the non-compliance of the defendant to tender the agreed amount intended thereto."

Rapal and Hamelito A. Quiokeles, vice-president for utilities of BWUI, affixed their signatures to the said six-page MOA as verified by Atty. Artemio C. Villas on Sept. 17, 2004.

BWUI's reply

BWUI senior manager Romeo G. Robles, in his formal letter dated November 6, 2010 to Mayor Tocmo, disputed Corella's contention that the MOA is inequitable and disadvantageous to the municipality.

BWUI insisted that the MOA "is still valid, effective and enforceable." The water company stressed that declaring the MOA as invalid by Corella lawmakers in improper since it is only the court "with proper jurisdiction can declare a contract or any of its stipulations or agreements as null and void."

But BWUI admitted that the MOA "may not have been formally concurred by the Sangguniang Bayan" and said why the lawmakers did not bother to question or "disturbed" it (MOA) for past six years.

"We could rightfully claim that there is nothing wrong or inequitable, as to the adjustment of the royalty fee to P0.25/cu.m. from old wells and P0.50/cu.m. from new wells of water extracted. The MOA therefore is consistent and in harmony with Municipal Ordinance No. C-013."

Cortes-BWUI MOA

In Cortes town recently, Sangguniang Bayan presided over by Vice-Mayor Danilo Montero passed a Resolution that dealt blow to water deal between this municipality and BWUI to provide Tagbilaran City residents with potable water to be drilled from Ohan Spring in barangay New Lourdes.

The Resolution, sponsored by Kagawad Lynn Iven P. Lim, has rescinded the "authority given to the Municipal Mayor Engr. Apolinaria H. Balistoy, Ph. D. to enter into a MOA with BWUI."

What prompted the SB members to revoke the said authority was the mere failure of the mayor to submit the draft MOA as she promised, said Montero. Montero and the six councilors voting to nullify the said authority wanted very much the copy of the draft MOA so that they can study and scrutinize it and be able to propose counter proposals.

He said they have been waiting for it (hard copy of the MOA) for so long since they approved the said authority last year, but to no avail until they only learned that the MOA is already signed by Mayor Balistoy without them knowing.

Montero's and the six councillors, however, did not say what are the conditions they wanted in the MOA.

Cortes SB wanted a higher price of the water to be extracted from Ohan Spring, barangau New Lourdes, Cortes since the proposed price tag is PhP0.25/cubic meter. Montero said the water deal is "disadvantageous" to Cortes.(RVO)

Corella-BWUI MOA void?

The MOA disputed by the Corella allows the respondent to establish five pumping stations and facilities in this town in connection with its rights to extract underground water.

Unsa man ang nakapa bag-o ni-ini.

September 08, 2008, 02:07:37 AM
(published by the bohol chronicle sept. 3, 2008)

Cebu group to get
water in Corella

A Cebu-based consortium will extract in 25 years great volume of water in Corella, which local government unit (LGU) has an existing contract with the Bohol Water Utilities, Inc. (BWUI).
The ARN Builders and AsiaMizu, Inc. and the LGU on Monday signed a memorandum of agreement (MOA) that will allow the consortium to draw as much as 500,000 cubic meters (CM) of water every month, according to Mayor Vito Rapal.
The mayor sealed the contract for the municipal government while Engr. Arnold Espinoza represented the consortium as its president.
Like BWUI, the Cebu group is interested to supply bulk water to the island town of Panglao in anticipation of the concrete start of Panglao Bohol International Airport Project probably early next year.
Gov. Erico Aumentado and Rep. Edgar Chatto are set to meet with the warring Panglao leaders on the urgent solution to water crisis in the prime tourism island on Friday.
The BWUI has long eyed to also solve Panglao island's water problem.
The biggest and most reliable water provider hereabout today, the BWUI and the municipal government have agreed to upgrade the water supply/distribution system and expand the service area in Dauis using the P6 million aid from Chatto.
Based on the MOA, the ARN Builders-AsiaMizu will initially extract from Corella's underground source10,000 cm of water daily.
In return, the LGU will earn P1 in royalty fee for each cubic meter of water drawn by the consortium.
Rapal said the consortium pledged to release P500,000 "environment fund" to the LGU six months since the sealing of the contract.
In addition, the commercial water extractor will grant an annual P400,000 "social fund."
But unlike the BWUI, the ARN Builder-AsiaMizu cannot give free water to Corella, the very source of the essential commodity.
The municipality has been consuming water more than the volume granted free to the town per BWUI-LGU agreement.
Thus, the excess would be charged against the royalty fee that the LGU would supposedly get from BWUI.
The LGU would still earn, though, because the town's water consumption would already include the free water from BWUI that the municipal waterworks system has in turn sold to resident-consumers.
The BWUI has a pending proposal to add wells, and Rapal said the LGU can act on it notwithstanding the entry of the consortium.
It can depend on the action of the Sangguniang Bayan, to which the BWUI plan has been referred, the mayor hinted.
Rapal said the 30-kilometer radius Corella aquifer can definitely sustain additional water extractions for human use as long as the negotiation pursues a "win-win" scheme.

ANG TUBIG SA CORELLA
(25 CENTAVOS SA 25 KA TUIG[/b])

Res.

First, Second ug third and Final reading.

GIUNSA MAN NIMO NI PAGKWENTA MAYOR RAPAL?

NA-UNSA NA MAN NING PAGKABUTANGA MAYOR RAPAL? GILUTO RA KAMI SA AMONG KAUGALINGONG MANTIKA!

Asa man ta mopalit ug tubig anang panahona?

Diin man niya kini pirmahi?

PAGPAKABANA… PALIHUG UG PASA/SABWAG SA UBANG MGA TAGA- CORELLA
