SUBSTITUTE BILL REQUIRES BODYCAMS IN ANTI-DRUGS OPS

The Committee on Dangerous Drugs is ready to present for plenary debates the proposed amendments to the law on the custody of illegal drugs and conduct of anti-illegal drugs operations, according to AKO BICOL Rep. Alfredo Garbin Jr, chairman of the technical working group that produced the consolidated or substitute bill of the proposed amendment to RA 9165 (Comprehensive Dangerous Drugs Act of 2002)

“I support President Rodrigo Roa Duterte’s call to destroy seized drugs. Para nga naman iwas-recycling ng mga nakukumpiskang drogang dapat sana’y itinatabi lamang upang magsilbing ebidensya sa mga paglilitis sa hukuman. Kontra tayo sa galawan ng mga tinaguriang ‘ninja-cops’ said Garbin, Vice-Chair of the House Committee on Justice.

Contained in the substitute bill is the mandatory proper dating of photographs of seized illegal drugs using newspapers and other publications dated the same day as day of seizure and conduct of inventory.

Swift passage of the bill would address concerns of police beat reporters and of President Rodrigo Roa Duterte on the conduct of anti-illegal drugs operations, Garbin said.

The Committee on Dangerous Drugs, chaired by Rep. Ace Barbers, approved the bill with safeguards and mandates, the Bicolano solon also said.

Garbin highlighted the following new requirements in the bill:

1. Mandatory use of bodycams and other “valid and legitimate technology” for proper documentation of anti-illegal drugs operations “from beginning until the end”;

2. Proper dating of photographs of seized illegal drugs using newspapers and other publications dated the same day as day of seizure and conduct of inventory;

3. Media coverage may be invited to join and cover anti-drug ops for journalism purposes only but “details and facts about the operation should not be used as condition for the reporter to sign the inventory.”; and
 
4. Under oath certification of the forensic laboratory examination results by the forensic laboratory examiner and the certification shall indicate the  kind of dangerous drugs seized, its chemical composition if possible, volume, weight, and other relevant information. (END)
