at last I just got this e-mail from my friend at the SP...excerpts of the privilege speech as delivered by Hon. Ae Damalerio:

“WE ARE NOT A RUBBERSTAMP LEGISLATURE”

   Honorable Presiding Officer, my dear colleagues, I rise on a question of personal and collective privilege.

   In fact, it is not original to me, but I merely quoted a press release from the Office of the Vice Governor,  and may I reaffirm, “we are not a rubberstamp Sangguniang Panlalawigan”.

   On March 9, 2010, 8 measures were rushed from the Executive Department for our approval; one of which was a resolution confirming the exchange of positions between two permanently appointed chiefs of offices.  There was no lengthy discussion on the merits or demerits of those measures.  Where in our civil service laws, rules and regulations can you see such a thing happen?  Or are we just following the whims and caprices of some vested interest? I wonder, but I think we are not, and will not.

   Luckily, we, so to speak, came to our senses and tabled five of those 8 proposed measures.  But of the three that we passed, no one will argue with me about the fact that indeed there was no lengthy discussion on those three legislative measures that we passed. We were just made to believe that they were needed to continue our projects with AusAid.  In fact, the Honorable Vice Governor and Presiding Officer himself said during our pre-session caucus (and I agree with him), though not exactly in the same words, that this is no longer the time for reengineering because we must protect the employees and it will be difficult to defend the issues when some of them are prejudiced in the process.

   But surprise, surprise!  The draft of the proposed measures that came from the Executive Department that we approved, particularly the draft for Provincial Ordinance No. 2010-007 (Creating the Provincial Internal Auditor’s Office) and Provincial Ordinance No. 2010-008 (Upgrading the Human Resources Management and Development Office into a Department) both CONTAINED PROVISIONS THAT PRACTICALLY APPROVED THE REENGINEERING PROGRAM without the benefit of our lengthy discussion, without our knowledge, without our intelligent appreciation, and contrary to our collective decision not to proceed with the reengineering program.  Were we hoodwinked?  I don’t want to believe so.  In fact, the Governor himself has constructively repudiated the reengineering program by allegedly filling up some 300 old vacant positions.

   Without further ado, Honorable Presiding Officer, my dear honorable colleagues, may I move for the following EN MASSE MOTIONS to save our faces:

First,
AN ORDINANCE RECONSIDERING OUR APPROVAL OF ORDINANCE NO. 2010-007 AND THEREFORE CONSIDER THE SAME AS NOT PASSED, with an accompanying motion for exemption from the three-reading rule;

Second,
AN ORDINANCE RECONSIDERING OUR APPROVAL OF ORDINANCE NO. 2010-008 AND THEREFORE CONSIDER THE SAME AS NOT PASSED, with an accompanying motion for exemption from the three-reading rule ;

Third,
A RESOLUTION RESCINDING OUR PREVIOUS APPROVAL OF THE ABOVE-MENTIONED MEASURES INCLUDING THE EXCHANGE OF POSITIONS BETWEEN THE PROVINCIAL GENERAL SERVICES OFFICER AND THE PROVINCIAL ENGINEER, PENDING A LEGAL QUERY WITH THE CIVIL SERVICE COMMISSION LEGAL DIVISION.

   And these are our grounds for doing this Mr. Chairman, my dear colleagues:

First, the aforementioned measures WERE CLEARLY CONTRARY TO OUR STAND ON REENGINEERING at this point of time.

Second, those two aforementioned ordinances WERE NOT PROPER IN FORM AND SUBSTANCE.  It is a cardinal rule in legislation that each measure shall contain only one subject matter at a time.  Those two measures contained NOT ONE, BUT FOUR subejct matters each, namely:  (1) creating an office, (2) abolishing certain positions, (3) creating certain positions, and (4) creating another body, A NEW PLACEMENT COMMITTEE.

   It was also pointed out that those measures are necessary for our AusAid projects.  We have evidence to prove that that is not so, Mr. Chairman.

   Here is a letter from Mrs. Rosalinda G. Paredes, PRMF Coordinator for Bohol, addressed to our SP Secretary REQUESTING THAT CERTAIN PROVISIONS BE INCORPORATED IN THOSE ORDINANCES.  It is proof of the fact that those measures we approved DID NOT CONTAIN what AusAid requires.

And on a positive note Mr. Chairman; and in order NOT TO PREJUDICE OUR PROJECTS WITH AUSAID, our fourth en masse motion is for the passage of

A RESOLUTION EXPRESSING THE SENSE OF GRATITUDE OF THIS AUGUST BODY TO THE AUSTRALIAN AGENCY FOR INTERNATIONAL DEVELOPMENT (AUSAID) FOR THE LAUDABLE PROGRAMS IT HAS SUPPORTED IN THE PROVINCE OF BOHOL,

And fifth,

A RESOLUTION ENJOINING OR ENCOURAGING THE LEADERS OF THE NEXT ADMINISTRATION TO CONTINUE WITH THE PROGRAMS SUPPORTED BY AUSAID, PARTICULARLY THE PROVINCIAL ROAD MANAGEMENT FACILITY (PRMF), AND GIVE THEM THE NECESSARY SUPPORT FOR THEIR SUCCESS.

   This, Mr. Chairman, my dear colleagues, regardless of whether the next administration is a Herrera, a Chatto, or a Montano-led administration.  FOR THE FIVE MEASURES I HAVE ENUMERATED BY MASS MOTION, MAY I MOVE THRU JUST ONE OMNIBUS MOTION, SO MOVED HONORABLE PRESIDING OFFICER….
