Two officials of Alburquerque town are charged with indirect contempt at the Regional Trial Court (RTC) for allegedly disrespecting the Supreme Court and the Commission on Elections (Comelec).
Former Albur mayor Efren Tungol charged Vice Mayor Rene Buates and Kagawad Jose Ugdoracion Jr. of "brazen display of disrespect to the courts of law and judicial processes" by continuing to hold their current government positions and receiving compensation in violation of resolutions promulgated by the high tribunal and the Comelec.
The case stemmed from the disqualification case filed by Tungol against Ugdoracion who won the mayoralty of said town in the May 2007 elections.
Tungol petitioned the Comelec to cancel the certificate of candidacy (CoC) of Ugdoracion due to the latter's residency status. The disqualification was decided by the Comelec en banc on September 28, 2007 and was later upheld by the SC.
As a result, Ugdoracion was ordered to vacate the office of the mayor, giving way to Vice Mayor Cirilo Jalad to assume the office on December 12, 2008 which was enforced by the Department of Interior and Local Government (DILG).
However, in a motion filed at the high court, Tungol said his son Ephraim Tungol should have been lawfully installed as mayor of the town as he garnered the next higher number of votes, following Ugdoracion's disqualification.
