Bohol Children Code featured in Seminar of Vice-Governors

The province got a boost of its efforts in the promotion and protection of their rights when its Bohol Children Code (BCC) was featured during the seminar workshop of the League of Vice-Governors of the Philippines (LVGP) on September 20-22, 2007 at the Waterfront Hotel, Lahug, Cebu City. The activity spearheaded by the league's national president Vice-Gov. Julius Caesar Herrera was an offshoot of the its recent 33rd national general assembly held in Pasay City on July, 29 to August, 1, 2007.

It tackled contentious issues affecting children particularly the law (RA 9344) that prohibits law enforcers to detain erring minors despite they can be held liable. Lawyer Grace Agcaoili of the United Nations Children's Fund (UNICEF) made mention of the BCC, considered as the first being enacted by a province, as an example in promoting children's rights and protection.

The seminar workshop dubbed “Local Legislation and Development Enhancement Program” was aimed at equipping the vice-governors, especially those neophytes, including former congressmen, with BCC by way of an Ordinance No. 016-2000 was enacted in the year 2000.

In the succeeding years Sangguniang Panlalawigan of other provinces and cities followed through. Other provinces that have already their own Children Code are the following: Aurora (approved 4-16-2002), Isabela (5-7-2002), Zambales (6-25-2001), Guimaras (10-23-2002), Negros Oriental ( 1-17-2002), Agusan del Sur (6-24-2002), Bukidnon (12-3-2002), South Cotabato ( 11-16-2001), and Zamboanga del Sur (12-10-2002), according to the study of J. Prospero E. de Vera III, DPA of the National College of Public Administration and Governance, University of the Philippines, Diliman, Quezon City.

The cities that do have Children's Ordinances are: Cabanatuan ( 7-10-2002 ), Pasay ( 2-13-2001 ), Quezon ( 10-21-1997 ), Cebu ( 12-20-2000 ), Kabankalan ( 11-06-2002 ), General Santos ( 11-20-1997 ), Cotabato ( 11-5-2002 ), and Davao ( 2-14-1996 ).

Herrera said that the province BCC needs to be revisited because there are some updates that may be incorporated in the said Code. Aside from this, an implementing rules and regulations (IRR) of the Code has yet to be issued.

According to de Vera, BCC still lacks some some coverage programs for children such as creation of children's hospital, foster homes, child friendly building, support for local children's literature, training of teachers, growth monitoring, child minding program, and MCH program. Thus, the need for a review and amendments of the BCC. It already covered some key areasfor children's growth and protection such as birth registration, immunization, day cares, reproductive health, nutrition, trainings and education for health professionals and parenting orientation.

During the second day of the activity attended by almost 50 vice-governors, emphasis was given on Child Preparation Mechanisms in Local Governance, Link between Women and Children's rights, Budget and Children and Rights-based Approach to Legislation and Action Planning by Unicef. Discussion on Juvenile Justice system and the BRP 3rd and 4th Reports to the Committee on the Rights of the Child were also took place with the panel of discussants.
