Time running out for 3 Filipino drug mules in China

MANILA, Philippines—Time has run out on three Filipino drug mules in China, and the Philippine government appears resigned to their impending execution.

Chinese Ambassador to the Philippines Liu Jianchao Thursday announced that a commutation of the death sentence on Ramon Credo, Sally Villanueva and Elizabeth Batain to life imprisonment had been “ruled out.”

The three Filipinos were granted a rare reprieve last February on the representation of Vice President Jejomar Binay, raising hopes that their lives could be saved.

But in a press briefing at the Chinese Embassy in Makati City, Liu said: “The [death] penalty will be carried out sooner or later.”

He said that per agreement between the two governments, the Philippines would be informed “about the actual way” and “when the penalty will be done” through “diplomatic channels.”

In a chance interview in Malacañang, President Benigno Aquino III said he and Foreign Secretary Albert del Rosario had been busy discussing and “preparing” for the plight of Filipinos caught in the civil unrest in the Middle East and in the nuclear crisis in Japan triggered by last week’s earthquake and tsunami.

Focus on all

“The three [Filipino drug convicts] are our concern, and so are the thousands in the Middle East and the thousands in Japan, and of course we have to be ready to meet these things all at the same time. I hope you understand that we can’t focus on just one entity; we have to focus on all,” Mr. Aquino said.

But he acknowledged that from the start, the government was told that the stay of execution of the three Filipinos was “temporary,” and that “we have to conform to their laws.”

Binay’s office described Liu’s announcement as “unfortunate.”

The Vice President has yet to receive “official communication” on the matter from the Department of Foreign Affairs (DFA), “but as long as the executions are not carried out, [he] remains hopeful,” said his spokesperson, Joey Salgado.

But Del Rosario himself said “every effort has been made [by the Philippine government] to appeal for clemency.”

“The Chinese have their rule of law to follow,” he told reporters. “I don’t know what other initiatives we can undertake.”

Deterrent

The Philippine government had been seeking a commutation of the death sentence on the three Filipinos.

But Ambassador Liu said they “must be punished.”

“The purpose is not to take the lives of these people. It is to deter and curb [drug-related] crimes,” he said.

Credo, 42, and a father of five children, was arrested on Dec. 28, 2008, at Gaoji International Airport in Xiamen after getting off a China Southern Airlines flight from Manila.

A total of 4,113 grams of heroin was found in his luggage and he was formally charged with drug smuggling on Jan. 21, 2009.

Credo is being held at Xiamen No. 1 Detention House, as is Villanueva, 32.

Villanueva, the mother of two, was apprehended on Dec. 24, 2008, also at Gaoji International Airport in Xiamen, after arriving on a China Southern Airlines flight from Manila.

She was found with 4,410 grams of heroin in her suitcase. Villanueva was formally charged with drug smuggling on Jan. 23, 2009.

Batain, 38, was arrested on May 25, 2008, at the Shenzhen airport after disembarking from an Asiana Airlines flight from Kuala Lumpur.

A total of 6,800 grams of heroin was found “sealed inside two reams of bond paper inside her luggage.”

According to law

Batain was formally charged with drug trafficking on June 30, 2009. She is being held at Shenzhen No. 3 Detention House.

“The situation is really bad,” Ambassador Liu said, adding that the increase in the number of drug-related crimes in China between 2007 and 2010 had been “tremendous.”

“And that makes it more a necessity that these crimes be curbed and deterred,” he said. “Laws must be applied.”

Asked why the Chinese government had earlier agreed to defer the execution of the three Filipinos, Liu said the reprieve was done “in accordance to law.”

“We cannot do anything that is beyond the law,” he said.

Assistant Foreign Secretary J. Eduardo Malaya, the DFA spokesperson, said Thursday night that as conveyed by the Chinese government to Binay on Feb. 18, “the execution of the three Filipinos was postponed within the scope of Chinese law.”

Earlier in a statement, the Chinese Embassy said that according to Chinese law, “any person, no matter if he or she is a Chinese citizen or a foreigner, who commits crime shall be brought to justice.”

“No one is privileged to transcend the law. Drug-related crimes, which are doing appalling harm to our societies, have been universally recognized as a scourge by the whole world. [Illegal] drugs are bitterly detested by the international community, China and the Philippines included,” it said.

The Chinese Embassy also said the three Filipinos’ “legitimate rights and interests have been protected in accordance with law. The Chinese side will render their relatives assistance and facilitation as necessary to visit the inmates in China.”

To lodge appeal

Lacierda told reporters that the Palace might “try” to lodge an appeal.

“But we have to respect the decision of Chinese authorities on the matter. It was unprecedented that they granted us a stay, and this was the first time they did it for an ally,” he said, adding:

“It was very, very clear that it was only a postponement.”

He also said the DFA would explain the latest development to the families of the three convicts.

Asked if the President would still push through with his state visit to China scheduled in May, Lacierda only confirmed that there were such plans.

He said the final details would have to be announced by the DFA or the Chinese foreign ministry. With a report from Christine O. Avendaño
