SC stops cybercrime law, issues TRO

MANILA, Philippines - The Supreme Court on Tuesday, October 9, stopped the implementation of the controversial cybercrime law, insiders said.

In a unanimous verdict, the High Tribunal issued a temporary restraining order on the Cybercrime Prevention Act of 2012, the same insiders added.

The verdict comes on the same day that the Department of Justice began its consultations with various sectors to clarify the details and meaning of the law.

A total of 15 petitions were filed with the High Court questioning the constitutionality of the law, which, among others, criminalize libel, increase penalties of crimes under the Revised Penal Code to one degree, and allow government agencies to collect traffic data.

Lawyers and media organizations have slammed the law for its ambiguities and the power it extends to the Department of Justice, which can shut down any web site based on prima facie evidence of libelous content.

SC issues TRO vs Cybercrime law


MANILA -- Fourteen justices of the Supreme Court voted to temporarily stop the implementation of the much-criticized Cybercrime Prevention Act of 2012, a court source said Tuesday.

No official confirmation has been sent by the SC Public Information Office on the development but the source said a copy of the TRO will be issued on Tuesday afternoon.

Fifteen petitions have been filed with the SC against Republic Act 10175, which critics saw as unconstitutional because some provisions like online libel allegedly violate the freedom of expression, due process, equal protection, the right to privacy and correspondence, and the right against unreasonable searches and seizures.

Outside the SC, protesters for and against the law await the decision of the justices. (Virgil Lopez/Sunnex)
