Placement Fees for Domestics still Illegal

Overseas employment recruiters are finding a way around the new Philippine Overseas Employment Administration (POEA) rule prohibiting the charging of placement fees on prospective domestic workers, abs-cbnNEWS.com reported.

The said firms are still charging these fees – but are promising applicants a refund on these charges, Labor and Employment Secretary Arturo Brion said.

Brion warned applicants for household service worker positions to be wary of firms charging them placement fees with the promise of a refund once they are deployed.

He cited a report from Labor Attaché Romy Salud of the Philippine Overseas Labor Office (POLO) in Hong Kong showing that Filipino HSWs employed in the area had complained of refund of their placement fees. It was apparent that the HSWs paid placement fees to recruiters prior to their deployment to Hong Kong.

The DOLE chief said these recruiters deceived the workers because of the new POEA policies governing HSWs prohibiting the payment of placement fees.

Brion asked the HSWs to report immediately to the POEA those agencies and individuals who may charge them placement fees with a promise of a refund upon their deployment.

He said agencies found violating the policies on HSW deployment will be penalized in accordance with POEA rules and regulations.

POEA rules provide that agencies collecting placement fees from workers despite prohibitions will be penalized with cancellation of license as well as a refund of the fee collected from the worker.
