Manny Pacquiao laments losing endorsements, thanks to BIR

World boxing champion and Sarangani Rep. Manny Pacquiao on Monday revealed that he is losing endorsements abroad because his image had been tainted by a tax evasion case filed by the Bureau of Internal Revenue.
 
Pacquiao said at a press conference that his BIR case has tarnished his reputation overseas by creating a wrong impression that he is already being charged with tax evasion.
 
“Lumalabas sa Amerika na tax evader ako. Masama na ang tingin sa akin,” he said, adding that he will lose “millions of dollars” worth of endorsements until the issue is resolved.
 
“I am fighting for the glory of our country, and now I am being treated with this kind of harassment. I urge the BIR to stop this cavalier attitude,” he added.
 
Earlier this month, the BIR filed a case against Pacquiao for allegedly failing to submit documents such as tax records and contract endorsements the BIR asked him to produce.
 
Pacquiao’s battery of lawyers, however, claimed that the Sarangani representative was not given due process for denying him the opportunity to respond to the subpoena.
 
The boxing icon urged the BIR to sack the regional director of Region 12, Atty. Rozil Lozares, who filed the case against him in “bad faith” and besmirched his reputation.
 
“‘Yung mga taong tiwali at baluktot ang isip, kailangan na matanggal sa gobyerno. Hindi ata nila alam ang ginagawa nila. Sila ang nagpapabaluktot sa tuwid na daan ng pangulo,” Pacquiao said.

“Hindi ko naman sila pwedeng hamunin ng suntukan, talo na sila sa akin. Labanang legal nalang, para patas lang,” he added.
 
His lawyers added that they will file counter charges against Lozares for violating the anti- graft and corrupt practices act by causing “undue injury” to Pacquiao.

Pays more than Filipinos in Forbes 'richest' list

MANILA, Philippines – A senior administration congressman Sunday said that Saranggani Rep. Manny Pacquiao deserves to be honored as the country’s top individual taxpayer, having paid higher taxes than Filipinos cited by Forbes Magazine as among the richest in the world.

Rep. Antonio Alvarez (Lakas-Kampi, Palawan) said not only is Pacquiao the greatest Filipino boxer who has won eight world division titles but is also the Philippines greatest taxpayer.

BizNewsAsia magazine, citing what it called official sources, had enumerated the names of the country’s top 500 taxpayers with their corresponding payments.

Next to Paqcuiao in the BizNewsAsia list is Willie Revillame with P58.6 million; and Piolo Pascual who is No. 3 with P55.8 million payments.

Two other showbiz personalities made it to the Top 10 – Kris Aquino, No. 8 with P25.44 million; and Michael V (Beethoven del Valle Bunagan), No. 10 with P22.26 million.

Also landing in the BizNewsAsia’s Top 20 list are known chief executive owners of conglomerates: Philex President Walter Brown with P26.83 milliontax (No. 9); Rio Tuba Nickel owner Manuel Zamora Jr. with P19.96 million tax (No. 12); San Miguel Corp’s Eduardo Cojuangco Jr. with P18.98 million tax (No.13); PLDT Chair and Meralco CEO Manuel V. Pangilinan with P18.55 million (No. 14); the former Meralco President Manolo Lopez, P17.49 million (No. 16); Union Bank Chair and CEO Justo Aboitiz Ortiz, P15.2 million (No. 19), and SMC President and Petron CEO Ramon S. Ang, P14.85 million (No. 20).

Prominent tycoon Henry Sy Sr. was reportedly No. 73 in the list with tax payments of P7.27 million, while Lucio Tan failed to land in the top 100.

After nearly two months of absence, Pacquiao will return to the House of Representatives to attend Monday’s session and also to be honored by the chamber with his second Congressional Medal of Distinction for his most recent world boxing conquest.

You Against Corruption and Poverty (YACAP) partylist Rep. Carol Jayne Lopez, one of the organizers of the red carpet welcome for Pacquiao at the Lower House, said the Sarangani solon is “extremely honored for the second Congressional Medal of Distinction, which will be given by his own peers.”

Lopez, who also hails from Sarangani, said Pacquiao is doing what it takes to make himself a “champion” of his province when it comes to public service.

“Boxing may be his first love but public service is now his passion.

“I’ve seen him in action, I’ve worked with him in Sarangani, and we’ve discussed bills and issues. He is a legislator, not just a boxer, and to be honored by his co-equals in Congress, together with the people we represent is something very special to him. He said he is eternally grateful for his kind of honor and welcome from his peers,” said Lopez.

According to Lopez, the neophyte Sarangani lawmaker is “emotionally touched” by the gesture of his colleagues in the Lower House who contributed P1,000 each to honor the new WBC super welterweight champion who defeated Mexican boxing legend Antonio Margarito for the boxing crown last week in Dallas, Texas.

Alvarez said the Bureau of Internal Revenue reported last April that Pacquiao paid P125 million in taxes in 2008, making him the highest individual Filipino taxpayer in a list of top 500 taxpayers.

“If the government is running out of awards to give Manny, then it should think of honoring him for being the reigning champion in the individual income tax payment category,” said Alvarez, a member of the Commission on Appointments.

The Palawan lawmaker added: “He‘s not only the world’s pound-for-pound boxing king, but he’s also the country’s peso-for-peso tax payments title holder.”

Days after the Sarangani solon demolished Margarito for his 8th boxing title, a Palace official was quoted as saying that the government has ran out of awards to bestow on Pacquiao, as most of the honorary ranks that the President of the Philippines can present to an individual had been conferred on him.

But there’s still one, Alvarez insisted, “and that is in the category that combines honesty, integrity, and love for country.”

“He can probably reap two titles on the ring a year in spectacular fashion, but being taxpaying champion is what he does quietly throughout the year,” Alvarez said.

Alvarez cited another benefit of honoring Pacquiao as top taxpayer “and that it would spur others more moneyed than him to knock him out of the BIR listing.”

despite this, the local BIR guy still "dared" to question him?  yet he must have some basis or he wouldn't have dared.  one thing is sure, being a congressman now without any trouble with the current administration, he won't be hounded the way corona is being hounded.

The taxman may yet deliver a knockout punch in its fight with boxing icon Manny Pacquiao, once the Bureau of Internal Revenue’s poster boy.

Finance Secretary Cesar V. Purisima on Tuesday said that the BIR was just doing its job. “No one is exempted from being investigated by the BIR—even myself, they asked for my files,” he said.

“I don’t think the BIR will dare harass an eight-time world champion,” Purisima said, noting that most revenue officers are big fans of Pacquiao.

Speaking on the sidelines of a Philippine Investment Forum organized by Euromoney magazine in Makati, Purisima said that part of the process of auditing a taxpayer was asking for tax documents.

“We love and respect [Pacquiao] and we wish him the best,” the finance secretary said. “But at the same time we have a duty to make sure that we review everyone’s income tax return, and I don’t think Congressman Pacquiao should take this personally.”

A lawmaker advised Pacquiao to just “prepare a TKO evidence and consult law and finance” [experts] and resolve his problems like any ordinary citizen instead of enlisting the help of President Benigno Aquino III.

The BIR office in Central Mindanao has filed a complaint against Pacquiao for failure to submit complete tax records for 2010. If found guilty, Pacquiao could face up to two years in jail.

The boxer declared P1.13 billion in assets at the end of 2010 and no liabilities, making him the country’s wealthiest member of the House.

Forbes.com magazine estimated he spent $7 million in his election campaign in 2010 while also earning $35 million for his two fights against Joshua Clottey and Miguel Cotto.

Pacquiao’s lawyers have said the BIR director in Central Mindanao “railroaded” the tax charges.

Pacquiao maintained that he was not given enough time to comply with the BIR subpoena since it was given in the middle of his fight with Mexican Juan Manuel Marquez.

Singled out

The Sarangani lawmaker said the tax suit filed against him by the BIR had cost him millions of dollars in ad money.

“Why the BIR singled me out smacks of bad faith designed to tarnish my reputation. In just one instance, the BIR has tarnished my name. I shall rise to the occasion and I shall fight this case until the last and final round. We will fight,” Pacquiao said in a press conference on Monday.

Asked if there could be malicious motives for the BIR’s regional office to harass Pacquiao, Purisima said he did not know but he expressed confidence that the office would not dare do so.

“He’s a national icon, a national symbol, a national pride [but] I think that just like any Filipino citizen, we should open our records when asked  by the bureau,” the finance secretary said.

Last year, the BIR issued Revenue Memorandum Order No. 3-2011 which said that the audit of lawyers, doctors, engineers, accountants and other taxpayers who rendered professional services would be prioritized.

No support from House

In Congress, the eight-time world champion might be well-loved but he did not get any support from other lawmakers in his gripes against the BIR.

Speaker Feliciano Belmonte Jr. and Representatives Antonio Tinio (ACT Teachers), Raymund Palatino (Kabataan) and Walden Bello (Akbayan) have advised Pacquiao against asking President Aquino to fire a BIR official for harassing him on his tax payments.

“I think you’re correct,” Belmonte said when asked if Pacquiao should just use normal channels rather than seek presidential intervention in resolving his beef with lawyer Rozil Lozares, the BIR Central Mindanao director.

Inspire others

Tinio said that Pacquiao as a public official and role model should set the proper example and break the stereotype that the rich and powerful can evade the payment of proper taxes with impunity.

“If he feels he’s being unfairly targeted, then he should pursue it through the proper channels,” Tinio said.

Palatino said Pacquiao “shouldn’t bully, intimidate, threaten a coworker in government” and instead “inspire others not to abuse fame, wealth, and power to receive special treatment from the bureaucracy.”

Rather than ask the President to fire Lozares, Palatino said Pacquiao should just come up with “a TKO evidence” and resolve his problems like any ordinary citizen.

Bello said Pacquiao’s call for Mr. Aquino to step in his case was unjustified.

“Congressman Pacquiao, for whom I have a great deal of respect, should just comply with the BIR’s requests. If he’s telling the truth about his taxes, he has nothing to worry about,” the Akbayan lawmaker said.

Pacquiao’s tax problems are the latest colorful event in his career, which he hinted last week was nearing an end because God had told him to retire soon.

Pacquiao, who has a 54-3 win-loss record with two draws,  will stake his World Boxing Organization welterweight crown against undefeated American Timothy Bradley in Las Vegas on June 9. With a report from AFP
