His lawyer Joseph Sagandoy said there is no need to take or publicize mug shots if the subject is not yet convicted and therefore presumed innocent, if the subject’s identity is established or well recognized, and if there is no related public safety concern.
“Absent these requirements, as would be in the case of Sen. Enrile, the taking of mug shots or worse, their publication would be entirely unnecessary, and would just expose the subject to cruel, degrading or inhuman punishment as prescribed by Sec. 9 Article II of the Constitution,†Sagandoy said in a three-page letter.
The letter was addressed to Criminal Investigation and Detection Group (CIDG) chief Director Benjamin Magalong, copies of which were sent to PNP chief Director General Alan Purisima and public information office director Chief Superintendent Reuben Theodore Sindac.
The letter also stated that during the booking procedures of Senators Jinggoy Estrada and Ramon “Bong†Revilla Jr., Enrile’s co-accused in the pork barrel fund scam, their mug shots were taken and released to the media.
“The following days, their mug shots were splashed all over the front pages of the major newspapers and televised over major networks,†he said.
Enrile was taken to a room at the specialty ward or officers’ room of the PNP General Hospital. – Cecille Suerte Felipe
