The Department of Justice is poised to file child abuse and trafficking charges against an Italian diplomat, who allegedly sexually abused three minors while on vacation in the Philippines.

In a nine-page resolution, Biñan city prosecutor Agripino Baybay III said he found probable cause to charge Daniele Bosio, the Italian ambassador to Turkmenistan, with violation of the Anti-Trafficking in Persons Act and the Anti-Child Abuse Law.

"Most revealing... are the sworn declarations given by complainants by way of reply stating that while they were all given a bath by respondent at his condo unit in Eastwood before proceeding to Splash Island, the latter fondled their sex organs causing the same to be erect," read the resolution.

"Certainly, respondent's aforesaid act is imperative and telling of a concealed objective on his part of exposing complainants to sexual exploitation, taking advantage of their vulnerabilities as minor children, by affording them short-term respite and amusement in order to obtain their consent and have control over them," it added.

Bosio was apprehended while on holiday in the Philippines last March 5. A police report confirmed the arrest of one "Daniel Bosio" in Laguna. It described him as an Italian national but did not identify him as a diplomat at the time.

The police report said Bosio was arrested at a resort in Biñan after the police received complaints from Catherine Scerri and Lily Flordelis of Bantay Tuluyan Foundation alleging the foreigner had with him three male children aged 12, 10 and 9.

According to the victims, who were street children in Caloocan City, they were sleeping when Bosio woke them up and invited them to go swimming. Bosio and the children first ate a fast food chain and headed to his condo unit, before going to the Laguna resort.

In his defense, Bosio had argued that he "merely acted in the performance of his social and moral duty to afford them their rights to play and recreation, as well as their basic rights to food, clothing, and cleanliness."

The city prosecutor said Bosio's defense would be "best ventilated during a full blown trial, not in this proceeding where the quantum of evidence needed to warrant the filing of an information in court is only probable cause."  —NB, GMA News
