Sandiganbayan suspends Tuguegarao mayor, 4 DBM execs

          The Sandiganbayan has ordered the suspension pendente lite of Tuguegarao mayor Jefferson Soriano for 90 days for his involvement in the anomalous procurement of rubber boats in 2008 to 2009. The order of suspension pendente lite was promulgated on 02 November 2015.

            In 2013, the Office of the Ombudsman filed graft charges against retired Philippine National Police (PNP) Chief Jesus Verzosa and seven others for the purchase of defective police rubber boats.

Ombudsman investigators found that Soriano, as then Chairman of the Bids and Awards Committee, awarded four separate supply contracts for rubber boats all dated 18 December 2009 totalling P131.5 million.  Upon delivery and inspection, various defects in the equipment were discovered “which make their use risky to end-users.” The boats and engines were also not functional when fitted together, rendering them unusable for disaster operation efforts of the PNP.

In a separate case, the Sandiganbayan also ordered the suspension pendente lite of officials from the Department of Budget and Management, Technology Resource Center and National Livelihood Development Corporation, for their involvement in the anomalous utilization of the Priority Development Assistance Fund of former Benguet representative Samuel Dangwa.

Ordered suspended for 90 days are Mario Relampagos, Rosario Nuñez, Lalaine Paule, Marilou Bare, Marivic Jover, Consuelo Lilian Espiritu, Belina Concepcion, Gondelina Amata, Gregoria Buenaventura, Chita Jalandoni, Sofia Cruz, Filipina Rodriguez and Ofelia Ordoñez.

Ombudsman prosecutors said that “the suspension under Section 13 of R.A. No. 3019 admits of no exceptions” and that “the impossibility of tampering with evidence and intimidating witnesses is not a ground for denial of the preventive suspension.”  They also argued that “the period of suspension by the other Sandiganbayan divisions pertains to cases separate and independent of the present case.”
In agreeing with the Office of the Special Prosecutor, the court ruled that “the claim that the suspension from work may deprive them of their only source of income cannot override the mandatory character of Section 13 of R.A. No. 3019.
