The Court of Appeals (CA) has dismissed the petition of the government seeking to restrain the Iglesia ni Cristo (INC) from claiming ownership of a peace of land in La Union province.
In an eight-page decision of the CA, it said that the arguments raised by the Office of the Solicitor General (OSG) have no sufficient legal basis.
The OSG, in its petition, stressed that the INC has no hard evidence that they own a parcel of land which measures 275 square meters located in Barangay San Gregorio, Caba, La Union.
Based on Presidential Decree 1529, otherwise known as the Property Registration Decree, the OSG is authorized or mandated to represent the government on land registration proceedings or cases pertaining to land disputes so as to forestall any irregularities in the registration of properties of land.
The appellate court affirmed the earlier decision of Caba, La Union Municipal Trial Court which said that the INC had submitted sufficient evidence to prove that they own the property of land in question.
Among the evidences presented by the INC are the tax declaration dated 1947 and 1952 in the name of one Primo Peralta who was the original owner of the said property before it was purchased by and transferred to the INC. - PNA
