With respect to machinery and equipment used for an industry or works
o General rule: they may not be validly subject to replevin so long as they are intended by the owner for an industry and they directly meet the needs of the industry -- they are considered as real property. (They are not subject to replevin which is an action to recover specific personal property.)
o Exception: when the machinery is placed by the lessee in the real estate leased to him by the owner of the real estate.
o Exception to the exception: when the lessee places the machinery on the estate as an agent of the owner-lessor.
