Facts of the Case: A husband and a wife entered into a mutual agreement whereby each could live with others, have carnal knowledge of them, without interference from the other. Pursuant to the agreement, the husband lived with another woman, and in the prosecution for concubinage, he presented in defense the prior agreement or consent. Is he guilty?

Decision of the Supreme Court: No, he is not guilty in view of the consent of the wife.

was this a written consent?  this is rather difficult because a sin is no sin only because someone agreed to it.  but then i have to admit that legal laws may have variants from church laws.  be that as it may (naks, mora na man kog sinultihan ug lawyer), it's rather awkward to say to one's spouse, "okay, let's sin together, jointly and severally".  ::)
