The decision was issued by the Supreme Court of the Philippines on January 24, 1996. It involved a labor dispute between American Home Assurance Co., Inc. (AHAC) and its former employees Virgilio Malinao, Rosemilo Gacusan and Dominador Loriaga who were dismissed for allegedly falsifying their travel expense reports. The Labor Arbiter ruled in favor of the employees and ordered AHAC to reinstate them with backwages and other benefits. AHAC appealed to the NLRC which affirmed the Labor Arbiter's decision with modification. AHAC then filed a petition for certiorari with the Supreme Court challenging the NLRC's jurisdiction and factual findings.
The Supreme Court denied AHAC's petition and upheld the NLRC's decision. It ruled that AHAC failed to prove that it had valid grounds to dismiss its employees for serious misconduct or fraud. It also held that AHAC did not comply with the procedural requirements of due process in terminating its employees. The Court further stated that AHAC's allegation of lack of jurisdiction by the NLRC was belatedly raised and had no merit.
