More Gasoline Stations in Bohol

The latest threat to the environmental protection campaign of the province was confirmed by the local Environmental Management Bureau field office here.

EMB-Bohol records clerk Marietta Abing said gas stations owners applies for environmental compliance certificates (ECC), not in Bohol but in the regional office in Cebu.

“We only have copy of ECC if the project proponent provides us,” Abing said.

It is also public knowledge that there are “fixers” disguising as consultants in the EMB-7 vicinity in Cebu that offer easy, fast way to secure ECC for a “fee”.

In a separate interview, Provincial Environment and Natural Resources Officer Nestor Canda lamented the same concern as gas stations are now noticed put up everywhere and his office have no way of determining if owners have secured environmental compliance documents before starting with such business.

“Aside from the fact that ECCs are secured in the regional office in Cebu, the requirements provided in the terms and conditions are mostly within the jurisdiction of the local government units and DENR only acts if there are violations reported,” Canda said.

Reports say there are even gas stations without ECC owned by mayors of the towns where they are operating. Gas stations are supposed to abide by the Comprehensive Land Use Plan (CLUP) of the municipality where it is operating.

These kinds of businesses are prohibited to be put up in residential or environmentally critical areas and must seek clearance from the Protected Areas Management Board (PAMB). Protected Area Supervisor Marcial Ugay said they have discussed these concerns about gasoline stations in its recent cluster meeting.

Some gas stations also skirts securing ECC by applying instead for a Certificate of Non-Coverage (CNC). Applicants state in their application that their gas station is operating with just one tank and a capacity of maximum 18,000 liters only. These are called “bulilit” stations.

There are, however, bulilit gas stations exceeding such limits and the PENRO office said it had already issued notices for violations which could carry a penalty of P50,000 if found non-compliant to environmental requirements.

PENRO Canda said, the law, PD 1586 “Establishing an Environmental Impact Statement System” is not strong enough if environmental protection is to be taken seriously. In that law, liability of a violator is extinguished after paying the penalty. “It needs to be amended,” Canda said.
