New VAT Requirement - Revenue Regulations (RR) 1-2012

Before under RR 16-2005:


VATable entities with quarterly revenue of less than P2,500,000 and purchases of P1,500,000  = exempt and not required to attach SLSP in the quarterly VAT declarations (BIR Form 2550Q)

Now under RR 1-2012:


VATable entities regardless of quarterly sales and purchases are all required to attach an SLSP in its quarterly VAT returns (BIR Form 2550Q)

Penalty:

There is a penalty of P1,000 for each quarterly VAT return nga way attachment.

Hi Te,

Real Estate Tax = Real Property Tax? Kung kana sa local government unit na sija nakadepend so kung asa imohang property adto ka sa munisipyo adto mobayad. Kada munisipyo lahi lahi ug rule sa real estate tax, may difference sa rate nga gigamit.

Let us take the case of Quezon City, ang annual real property tax for a commercial building is based on the assessed value per year. Ang assessed values based sa market value of the property multiplied with rates from 30% to 80%. Unja from the assessed value ang rate sa QC RPT is 2% for commercial. Ang penalty for not payment of RPT is 2% interest per month sa QC case ni sija.

Maajo untag mobayad ug sajo or in advance ba kay may mga discount man ihatag ang LGU. Sa Quezon City nga case 20% discount ang ilahang ihatag.

Last August 17, 2012, nag issue ang BIR ug usa ka Revenue Regulation (RR). Ang mao nga RR 11-2012 nag exempt sa OFW ug OCW remittances gikan sa documentary stamp taxes.

Aron ma-exempt ang pada gikan sa laing nasud, mao ni imong buhaton:

1. Kung ikaw OCW or OFW recipient or benificiary nga mokobra o mokuha ug kuwarta nga gipada sa imong partedos nga OCW or OFW, dad-a ang Overseas Employment  Certificate or valid Overseas  Workers Welfare  Administration (OWWA)  Membership Certificate or electronic receipt issued by Philippine Overseas Employment Administration (POEA) sa nagpada aron dili kuhaan ug docs stamps ang gipada nga kuwarta. Applicable ni sa mga mokuha sa kuwarta sa Western Union or Moneygram ba ron.

2. Kung ang gipada nga kuwarta gihug pinaagi sa bank account sa recipient ug withdrawhon pinaagi sa ATM, ang OCW or OFW maoy mopakita sa Overseas Employment  Certificate or valid Overseas  Workers Welfare  Administration (OWWA)  Membership Certificate or electronic receipt issued by Philippine Overseas Employment Administration (POEA) sa dihang sija mipada sa kuwarta (sa gawas sa nasud ni).

3. Kun ang kuwarta ipada pinaai sa bank account sa receipient ug withdrawhon pinaagi sa over the counter transaction, moapply ang rule number 1.

2. Value-Added Tax = All receipts are subject to VAT.

The BIR has issued recently Revenue Memorandum Circular 65-2012.

Kaning RMC 65-2012 places all the assessments of condominium corporations under VAT and Income tax. Sauna puro ni sila exempt receipts.

With this, expected na nga motaas ang assessments to the unit owners.

Higher taxes on tobacco, alcohol OK'd in Senate

The bill seeking to raise taxes on tobacco and alcohol products has moved closer to becoming a law with the Senate's approval late Tuesday.

Voting 15-2, senators endorsed reforms to the existing "sin tax" law in a bid to generate P40 billion worth of revenues on the first year of implementation to be used to expand healthcare services in the country.

Senators Francis "Chiz" Escudero and Joker Arroyo were the only ones among 17 legislators who voted against the most recent version of the bill certified as urgent by President Benigno "Noynoy" Aquino III.

The Palace, meanwhile, hailed the approval as "a vital step forward in improving and expanding public health safety nets for all Filipinos."

"This complements the Aquino administration’s relentless pursuit of Universal Health Care which underscores the belief that healthcare should be a right and not a privilege in our country," Presidential spokesperson Edwin Lacierda said in a statement.

Lacierda also thanked the senators who voted in favor of the measure, especially lauding the bill's sponsor Senator Franklin Drilon who he said "saw the important piece of legislation through this long, drawn out process..."

Lawmakers from the Senate and House of Representatives are now expected to reconcile their versions of the sin tax revamp through a bicameral conference committee.

Once approved by the joint body, the President will be asked to sign the bill into law.

The final version of the Senate bill espoused a series of amendments, including a lower unitary tax rate per cigarette pack, introduced by Drilon, who is acting chair of the Senate Ways and Means Committee.

The approved proposal seeks to jack up tax rates on low-priced cigarettes to P12 per pack in 2013; P15 in 2014, P18 in 2015, P21 in 2016, and P26 in 2017.

A rate of P16 per pack will be imposed of medium-priced cigarettes in 2013, with taxes increasing to P18 in 2014, P22 in 2015, P24 in 2016, and P26 in 2017.

The most expensive brands will be taxed at P20 per pack in 2013, P21 in 2014, P22 in 2015, P24 in 2016, and P26 in 2017.

"We would have wanted P30, but the reality is that it is a collective body and we tried to get the vote of our colleagues and this is the sweet, if you want to call spot that we were able to find P26," Drilon said.

"Of course, a higher unitary tax is desirable, but reality is that we have to submit this to the collective wisdom," Drilon told reporters.

In other news: New tack vs RH bill: Slew of amendments

Senators also adopted Senate President Juan Ponce Enrile's suggestion to compel cigarette manufacturers to source 20 percent of their production requirements from local growers.

For alcoholic products, a two-tiered system will be adopted once the bill is enacted.

A tax of P20 plus 15 percent of the net retail price will be imposed on distilled spirits in 2013, with the rates increasing to P20 plust 20 percent in 2015.

As for fermented liquors, brands with a net retail price of P22 or less will be taxed P20 while a P25 tax will be imposed on products with a net retail price over P22.

Arroyo complained, however, that the adopted version of the reformed sin tax bill failed to specify programs to deter smoking and drinking.

"Where is the expenditure program to reduce cigarette and liquor addiction? None. What is proposed is a lump sum appropriation of P40 billion ostensibly for health care?" Arroyo asked.

"What the Senate is being asked is to authorize lump sum appropriation of P40 billion. Lump sum appropriation is a curse in budget making," he pointed out.

The lawmakers proposed to take 60 percent or P24 billion in revenues from taxes imposed on tobacco products against 40 percent or P16 billion target of duties imposed on alcohol products.

Once enacted, the bill is seen to raise a total of P39.5 billion in 2013, P45.7 billion in 2014, P52.3 billion in 2015, P57.7 billion in 2016; and P64.4 billion in 2017.

Allies of President Aquino claimed the additional revenues will be used to provide health coverage to 5.2 million Filipino families and for the construction and repair of hospitals in the country, among others. (with reports from Kim Arveen Patria)

im having a problem sa tax relief system using the excel2010 .... dili sya mo print .... will i use nalang excel2007 instead?

Kaning SLSP Bay nga required attachment sa Quarterly VAT Return, way required FORMAT ani. Basta kay naa ni nga mga info:

For the Summary List of Purchases:
   a. Name of Payee
   b. TIN of Payee
   c. Amount
   d. Input VAT

For the Summary List of Sales:
   a. Name of Client
   b. TIN of Client
   c. Date of Official Receipt
   c. Amount of Sales
   d. Output VAT

Also, dili ni required nga ibutang pa ug CD. Puwede ra ni sija iprint ra nimo then iattach lamang sa VAT return then submit sa BIR.

Is this mandatory? - The answer is YES. Kung wa ka kafile ani, may penalty nga P1,000.

Bay, wa may problema ning sa compatibility sa BIR Forms ug sa MS Excel 2010. Mitawag pud ko karon sa BIR para iconfirm kung naa bay compatibility issue, then wa man kono. Basin may problema ra sa imong printer.

Base sa imohang pangutana murag lahi man ang tax process sa US ug Pilipinas. Hehehehe. Sa Pilipinas dili uso ang tax refund, puro tax credits ra.

Though, ang best way nga masigurado nimo nga makafile ka ug accurate return is to have a reliable and accurate accounting of your income and expenses.

Ang atong nasud wa magkinahanglan ug bag-ong tax laws ug mas wa nagkinahanglan ug additional tax impositions. What is needed in our income tax system is the ENFORCEMENT and COLLECTION. Based on my experience, 50 - 60% sa tax collections ang nahagbong sa bursa mga BIR personnel.

Pero sa ahong pagkahibawo sa tax code ang sales nga mokantidad ug P25 kinahanglan naay resibo. Ug kung naay resibo buot ipasabot kinahanglan registered sa BIR. Kung registered sa BIR the naay TAX. Hahahaha.

Mao ra ba ni dagan karon sa atong BIR. They are now going after institutions which were assumed before as INCOME TAX EXEMPT entities. Condominium corporations and non-stock non-profit hospitals were checked and assessed.

BIR Goes After Ryan Bang

MANILA, Philippines --- A South Korean actor and host of an ABS-CBN noontime "Showtime" show was charged yesterday with tax evasion by the Bureau of Internal Revenue (BIR) for alleged non-payment of income tax worth P1.8 million.
In a criminal complaint filed before the Department of Justice (DOJ), BIR Commissioner Kim S. Jacinto Henares identified the respondent as Hyun Sung Bang, whose screen name is Ryan Bang of Bel-Air Village, Makati City.

The BIR chief said the charges against the comedian ranged from "willful failure to register with the BIR to willful failure to file his income tax returns for the years 2010 and 2011."

The young entertainer was also accused of failure to file percentage tax and value-added tax (VAT) returns.

The BIR issued a letter of authority to examine his financial statements and determine his true income.

Based on documents, the South Korean received more than P993,000 from ABS-CBN, P58,000 from KP and PR and EMS, P2,300 from Summit Publishing Company, and P80,000 from Studio 23 in 2010.

In 2011, he also received more than P2 million from ABS-CBN Corporation, P33,333 from ABS-CBN Film Production, and P185,000 from Studio 23.

Despite his substantial income for the two-year period, Henares said Bang did not submit his income, VAT and percentage tax returns.

The case against the foreign comedian was the 145th filed by Henares before the DOJ as the BIR intensifies the campaign against various tax evasion schemes.

Sa tanang may printed ORs and Invoices, hangtud June 30, 2013 na lamang ang na sila magamit.

You need to secure a new ATP and have your old receipts and invoices invalidated by the RDO where you are registered.

Improperly Accumulated Earnings Tax (IAET) Unsa Man Ni?

Sa may mga kompanya nga giduma or ginapanag-ija ba ron, bantaji nga ang injong kompany dili makadawar ug assessment sa BIR para sa IAET. Ang IAET mao ang tax nga iassess unja sa BIR para sa mga kompanya nga ang Retained earnings (o karon gitawag na ug Accumulated profits) lapas na sa 100% sa Paid-up Capital (mao ni ang bahin sa total shares issued nga nabayran na).

Ang tax nga iassess sa BIR 10% sa balor sa lapas sa paid-up capital.

UNSA MAY PURPOSE ANING IAET?

Ang usa sa purpose ani mao ang paglimita sa mga kompanya nga dili gusto modeclare ug dividendo sa mga shareholders. Which is in line sa prinsipyo sa taxation nga mao ang distribution of wealth.

MAY EXEMPTION BA?

Naa. Kung ang kompanya may mga plano sa umaabot nga panahon nga nagkinahanglan ug dakong budget, puwede magtinir ug Accumulated Profits nga molapas sa Paid-Up Capital. Kani kinahanglan suportahan ug usa ka Board Resolution para sa pag appropriate sa mao nga excess for specific usage.

Ajaw kalimti nga karon girequire na sa BIR ang pagsubmit sa ilahang office sa BIR Form 2316 sa tanan nimong employee kada January 31 sa mosunod nga tuig. Kani uban sa pagfile nimo sa BIR Form 1604-CF, Alphalist of Employees and Withholding Tax from Compensation.

Take note, failure nga makafile sa mao nga form may multa nga P1,000. Where in some cases kung willful ang penalty may maximum nga P25,000 nga penalty.
