Mario is a green card holder. His parents petitioned him as a single adult child 10 years ago. But unknown to his parents, Mario was already married to his childhood sweetheart, Anna. Mario also had a child with his second girlfriend.
During his interview for his immigrant visa, Mario did not disclose his marriage to Anna and the existence of his love child. After many years in the US, Anna obtained a visitor’s visa and lived with Mario. Both decided to marry again. This time Mario filed a petition for an immigrant visa in behalf of Anna. He also filed for an application for naturalization so he could be a US citizen.
Mario’s application for naturalization was denied because the immigration examiner discovered the first marriage he had with Anna. He was told that he could not be issued a green card because he was married at the time he obtained his visa, a fact he concealed from immigration authorities.
