In a one-sentence order, the Second Division of the Commission on Elections (Comelec) upheld its earlier decision against the petition of defeated Dauis mayoralty candidate Victorio Migriño to nullify the proclamation of reelected Mayor Luciano Bongalos and recount the ballots cast in the May 14 polls.
The division denied Migriño’s motion for reconsideration and stood by its earlier resolution as it found “no new issues†to “warrant the reversal†of its own verdict.
The defeated contender for the top town seat had insisted victory by an alleged margin of about 900 votes over the winning incumbent, and what his next move may be is yet to be ascertained.
Bongalos was scheduled to fly to Indonesia and other Asian countries after receiving on Thursday his copy of the Comelec-Manila decision favoring him, again.
Migriño filed a motion for reconsideration after the same Comelec division then junked his instant petition to annul the proclamation of Bongalos as the winner and have the ballots recounted.
