Sunday Post: Owner-operators of floating restaurants and river-cruising boats here cried foul over the imposition carried out by  MARINA of charges for the Maximum Load Marking Certificate based on its Circular No. 2009-20.
In their manifesto sent to the Sangguniang Panlalawigan, the floating resto operators led by Walter Sultan urged the former (SP) to extend help requesting Marina “to reconsider” the implementation of said Circular.

Section 4.1 of said circular, Marina said “boats shall have permanent load markings placed on each side forward, amid ships and aft to indicate the maximum freeboard as determined in accordance with section V.i. Such a load mark shall be horizontal line of at least 200 mm in length forward and aft, 300 mm amidships and 25 mm in height with its upper edge passing through the point of maximum draft. The maximum load mark shall be painted in a contrasting color to the color of the side shell paint.”
Marking load charges imposed are the following rates: under 5 gross tons, P1,000; 5 and under 10 gross tons, P1,500; 10 and under 20 gross tons, P2,000; and 20 and above, P2,500.

“If these fees are regulatory, then they are unfair, outrageous and confiscatory, especially because they are imposed per unit/banca,” the Manifesto said, adding that the business of floating restaurants are under “severe financial constraints.”

Marina imposed fees “will exacerbate, not mitigate, the burden of operators,” and this will adversely affect the fledging tourism industry in the province.
Floating restaurants cannot be compared to sea-going vessels category and therefore this “does not give justice and inspire fairness,” the Manifesto said. It added that the nature and condition of travel of floating restaurant trade is far different from other vessels but should be placed under a different category.

The said manifesto was referred to the Committee on Public Utilities of the Sangguniang Panlalawigan. Copies of said manifesto were also furnished to Gov. Erico Aumentado, the Department of Transportation and Communication, the Sangguniang Bayan of Loboc and to Mayor Leon Calipusan for their action.
Teresita Sumampong, owner of the Riverwatch Floating Restaurant, Rosario Balbido, Long River Floating Restaurant; Mary Jo Varquez, Monarch Floating Restaurant; Herman Palapar, San Pedro de Loboc; Juliet Avenido, Greenwater Floating Restaurant; and Walter Sultan of The Village Floating Resto signed the manifesto. i don't think there is a need for them to cry foul about this manifesto as they are carrying people and these people are still subjected for safety. i've seen this floating restos in loboc and loay and there is really a need to regulate them as some of the operators doesn't know what hazzard is. they keep on letting people embark their resto even if it's really full. there should be a seating capacity including the crews and entertainers.

Even GMA the president rode on a Loboc floating resto.... I did not see her complaining.

But any craft floating on water used as a passanger boat should be licensed and insured for liability, as well as SOLAS training as seamen all around the world are being trained with for the past 15 years now.

They should also need to comply with the safety and and guidelins operations and have the right requirements as expected from the coastguard more then from the Provincail SB committee. Whether she be manual, wind powered, or powered by engine or even towwed she must be fit for all to be able to operate.

I disagree with the owners having to cry faul over this one.

I aggree that those crew should be trained and be given certificate of international standard in the sense that most of thier customer are foriegn tourist.

The crew training and the additional life saving equipment are for everybody not only for one nationality.We should always keep an open mind ,not to think that pinoy or foriegner one is superior than the other.That is an inferior thinking.

 Aaron, wako moingon ug dunay complete equipment, kay dili ko sure kong unsay imong gipasabot ug complete equipment ;) Pero duna ni silay mga LIFE JACKET ug duna poy COAST GUARD nga naga inspect sa FLOATING RESTO before ni siya mo travel...Pwede ba imong i CLEAR diri kong unsang complete equipment ang imong gipasabot...

That is not superiority at all, owing to the fact that some foreign breeds like causcasians are naturally have bigger body built. In that case, ang mga life saving devices should be standard to fit in. I remembered when we cruised the Pangsanjan Falls, my husband is a giant, he can hardly fit-in to those life jackets.

I have a CPR certification and mind you kalisod gyud i-maniobra ang mga dagkog lawas. Ikaduha, bug-at kaayo na sila, madefeat ang purpose sa safety kung ang responders mismo ma-injured.

Then again, kining mga foreigners daghan og allergies na sila maskin unsa, since mag-serve sila og foods there must be warnings about guests to declare some food allergies like peanuts, onions, garlic etc...

That is for the safety of the guests and the operators from liabilities.
