Basing on reports gathered from Cabilao residents, the controversial oil exploration in Bohol seas has started contrary to beliefs that the project proponents would respect their word of honor to resolve unsettled issues first.

Random telephone calls to Pantudlan in Cabilao Island off Loon indicate that since Thursday, project proponents have been sending advisories against diving in the vicinity of the island, while reports reaching the city state that the operations have been suspended.

Residents have also visually sighted MV Pacific Sword from the coastlines, and local fishermen have felt the activity’s impact with the drastic decline in fish catch noted in the island.

Environmental Legal Assistance Center (ELAC) a non-government organization spearheading the awareness campaigns on possible environmental effects of the seismic survey said the project proponents have started gathering the fish aggregating devices in the area. Aside from being navigational hazards, the devices could snag the survey operations.

Proponents have commissioned a special ship, Mv Pacific Sword to conduct the seismic survey. The ship is reported to drag some six kilometers of cable with sensors to record every detail of the sea surface.

Loon Mayor Cesar Tomas Lopez, in a radio interview Thursday promised to send somebody to check on the reports that despite unresolved issues on the environmental impacts and compensation of affected fishers, the survey team has indeed started.

Over the initial reports from concerned Loon residents that the project proponents went on with the survey despite an unresolved request for a temporary restraining order, Participatory Research Organization of Communities towards Education and Self-Reliance Project Director Emilia Roslinda sai she is frustrated at the things are happening in Bohol.

Roslinda is among the personalities comprising the Technical Working Group tasked to benchmark the effects of the survey on communities and the environment within the survey scope.

Lawyer Raul Barbarona, ELAC executive director, along with City Legal Officer and environmentalist Doni Piquero, Integrated Bar of the Philippines Bohol representative and lawyer Florendo Columnas and Bohol Alliance of Non-Government Organizations (BANGON) requested the courts to grant a temporary restraining order on the survey.

Even then, groups opposed to the seismic survey to determine the presence of oil and gas trapped under Bohol seas showed force Monday during a simultaneous activity in front of the Capitol and at the survey venue, Maribojoc Bay.

Close to two hundred commercial fishers and marginal fishermen set to be directly or indirectly affected by the survey showed protest as they festooned orange banners on their boats and paraded in a show of force Monday, the biggest gathering of boats so far in Bohol history.

On the filed prayer for TRO, Regional Trial Court Branch 4 presiding judge Achiles Melicor has given the oppositors chance to explain the merits of their plea and has set the hearing for July 2.

The same may be true to project proponents who shall be heard, Barbarona hinted.

In early coordination meetings in the city, Barbarona said NorAsian Energy Limited and the Department of Energy has committed not to start with the survey until issues on environment impact assessment, compensation and sharing is resolved.

Loon Mayor Lopez said the proponents have intimated to pay P115 to every affected fisher for the survey duration. Separate reports said the proponents have indicated no compensation to fish aggregating devices owned by commercial fishers, of which more than a hundred are still there.

Dako kaayo ang pagpakabana sa mga kadagkuan sa atong lalawigan kabahin niining gihimo nga oil exploration sa Department of Energy pinaagi sa NorAsian Energy Ltd. ug gihimo ang tanan sa kutob sa makaya sa gahum sa lokal nga pangagamhanan aron mahapnig ang kaseguroan sa mga gagmay nga mangingisda.

Oil exploration per se is not an affront to our national sovereignty because even the Constitution, ratified by the Filipino people, allows a joint effort with foreign corporations to utilize our natural resources.

This is not theft of natural resources because the State, the owner of every natural resource in our jurisdiction under the regalian doctrine, has consented to the exploration activity.

The oil exploration is part of national policy. Sa pagkatinood, the realistic options available to the local officials are:

- Negotiate with DOE and Service Contractor  to ensure the small fishers are compensated for the adverse effects of their livelihood. This responsibility is handled by the municipal local governments.

- Ensure the commitment of the project proponents that they will have to rehabilitate whatever environment damage will result out from the activity and on the tourism industry.

A court action was already filed asking for a Temporary Restraining Order to stop the conduct of the seismic activity. No TRO is issued yet and the court will still hear the side of the respondents (DENR, DOE, NorAsian).

Sa pagkatinood, mahuman na lang ang seismic survey, dili pa mahuman ang hearing sa TRO. Ug sa gikasulti ko na sa miagi, only the Supreme Court can issue a TRO to stop this kind of activity undertaken by the national government. By filing the complaint before the Regional Trial Court, wrong venue na and the judge will not risk to be held liable for ignorance of the law.

Laing punto mao nga ang Cebu did not show any opposition to the project, so it can be concluded its officials are in favor of it. Since the oil deposit is in the Cebu-Bohol Strait, the proponents can put the oil rig within the seawaters of Cebu but this does not mean the oil deposit within Bohol waters will not be "sucked" by the pumps.  This is the dilemma of the Boholanos. Basin na unya hinoon ug Cebu ra ang mabulahan and, whether we like it or not, the site of the oil rig would have an impact on our tourist's impression of our paradise.

Usa sa angayan buhaton mao ang pag-amendar sa atong balaod ug regulations. Magkinahanglan kini ug mga scientific study (nga gisugdan karon og himo pinaagi sa Environtal Baseline Data Survey Technical Working Group nga giapilan sa Silliman University Marine Laboratory [now Institute for Environmental and Marine Studies]) to back up the needed change.

Ang panawagan sa mga NPA nga maoy molihok aron sa pagbabag sa oil survey mahipunta lamang sa mga bungol nga dunggan. The NPAs will not lift a finger. Sulti-an ko kamo ngano:

- The bulk of the profit will go to the investor. This will not harm their cause.

- The bulk of the remaining profit will go to the national government which will go to the general fund which will ultimately go to the pork barrels of senators, congressmen and yes, including the party-list representatives -- a number of which have been suspected to be using their pork barrel to finance the operations of their armed counterpart.

- The remaining portion of the profit will be shared by the LGUs which may not generate substantial impact for the benefit of the local constituents.

You have just exposed the loopholes of our imperfect law and how to use this in making unethical money the legal way. You have just told us the mechanics of corruption. Yes, I suspect the same pork barrel is used to shut the mouths of our concerned departments who should be the protector of the people.

Yes you are right in saying that oil exploration is not an affront to our sovereignty…. It is the destructive method that is…. that is War is all about…..destruction…. We are the ones who are affected and it is only but just to defend ourselves.

It is true that on local levels, our officials are constrained with limitations up to their elected authorities. However, we the people who owns the government are not and we have every right to say “no” as a democratic society.

Personally, I am not bothered if Cebu gets all the Oil. Cebu is already a wasteland….let them get all the pollution they could possibly have. Nonetheless, I am not jealous of this small fraction that is already feasted by the National government & its officials.

We have an environment agency that seems not functioning. DENR must be incapable of searching for different options of safe oil exploration. There are better ways of exploring oil rather than this destructive, old method one. We have now what is called Remote Sensing or Satellite Imagery. Pero ang NorAsian natapus na sa paghimo ug 3 dimensional survey didto sa kadagatan sa Loon ug ang sunod nga schedule mao na lamang ang 2D survey diha sa kadagatan sa Dauis, Panglao, Tagbilaran , Maribojoc.
