Bohol Lawmakers Find ERC Resolution Defective

The unnumbered Resolution requesting the Boholano solons for amendments on provisions of the Energy Regulatory Commission (ERC) Resolution No. 12-02, series of 2004, setting the Distribution Wheeling Rates for Private Distribution Capital Projects for CY 2010 with Franchise Area, appeared to be "out of place" when presented for approval during the session last week of the Sangguniang Panlalawigan of Bohol.

The said Resolution proposed by SP public utilities committee was not immediately approved since it appeared that it is beyond the power of the three Boholano congressmen considering that ERC is a separate body regulating power sector and distributors.

This prompted senior board member Atty. Dionisio Balite, who presided over the session Wednesday of last week, to call for a recess and suggested to correct the tenor of the proposed Resolution proposed by the said committee.

He said he's in doubt that why request the congressmen to amend the ERC Resolution when the latter should have the right body to do the amendment of its own REsolution.          
The change of the Resolution's gist was accepted by said committee represented by its chairman boar member Dr. Romulo Cepedoza. This modified the same (Resolution) from requesting the three solons to requesting the ERC itself to amend its Resolution No. 12-02, series of 2004, setting the Distribution Wheeling Rates for Private Distribution Capital Projects for CY 2010 with Franchise Area.

The same (SP Resolution) was an offshoot in relation to application of the Bohol Light Company, Inc. "for approval (by ERC) of the Annual Revenue Requirement (ARR) and Performance Incentive Scheme (PIS)."

Engr. Eulogio Signe, BLCI operations manager, told the committee meeting called by Cepedoza earlier that PIS is designed by ERC when distribution utilities that cannot attain a certain performance level will be slapped with penalties. But when it can perform well "will be given an award."

The PIS, on the other hand, also "mandates that a consumer will be compensated by BLCI or BLCI will pay a certain consumer when a certain performance level or guaranteed services level is not attained."

But the details on the BLCI application for ARR and PIS cannot be discussed without the presence of the ERC but only during the hearing slated last November 23, 2010, Signe said. - Bohol Chronicle
