DENR speeds up land patent issuances in Northern Mindanao

Cagayan de Oro City (1 July 2005) -- AT least 2,090 lots involving an area or 2,344.6733 hectares have been issued patents under the Agrarian Reform Fund (ARF) by the Department of Environment and Natural Resources (DENR) in Northern Mindanao as of June 15, this year.

"This is actually 28% of our target for the year, which is 7,545 lots involving 8,676 has.," Regional Technical Director Antonio L. Luis of DENR-10's Land Management Services (LMS) said.

"Land titles are then issued once these patents are registered with the Register of Deeds," Luis also said.

He said the highest issuance of these land patents is in the province of Bukidnon for 1,025 lots involving an area of 1,389.6551 has., followed by Camiguin for 143 lots involving an area of 89.1207 has.

Next is Misamis Occidental for patents of 29 lots involving an area of 318.1500 has., Misamis Oriental for patents of 26 lots involving an area of 367.1247 and lowest in Lanao del Norte for patents of 127 lots involving an area of 180.6278 has.

On the other hand, on-site patent distribution under the Handog Titulo Program had benefited 1,235 recipients from various parts of the region, Dichoso said.

Again, the highest number of 742 recipients of these patents were from Bukidnon, followed by Misamis Oriental with 202 recipients, Camiguin with 200 recipients, Misamis Occidental with 52 recipients, and Lanao del Norte, the lowest with 39 recipients.

As explained by Land Management Officer Edna Ferraris of LMS-10 during the "Normindanaw" TV program simulcast over COC TV and radio station DXJR in Cagayan de Oro City, the Handog Titulo Program (HTP) of DENR is the awarding of titles to the legitimate beneficiary where in the recipient receives the title to the land he is tilling, occupying and cultivating in a single transaction/office.

Conceived during the time of then Pres. Ferdinand E. Marcos as "Alay Titulo Program," the HTP was continued during the administration of former Pres. Corazon C. Aquino who improved the concept of distributing titles through the Door-to-Door program but due to lack of funds, it reverted back to the community concept of distribution.

Beneficiary of the HTP is the actual land tiller, possessor and occupant of an alienable and disposable (A&D) public land who may have possessed and cultivated the land for at least 30 years by himself or through predecessor-in-interest.

Under the HTP, an applicant files a Public Land Application (PLA) in the Community Environment and Natural Resources Office (CENRO) in whose jurisdiction the land belongs.

To acquire a patent over an unpatented agricultural land, a legitimate tiller, cultivator and possessor of the land should visit the nearest CENRO where the land is located to file his/her PLA, after which an LMO will conduct an ocular inspection and investigation and recommends issuance of patent.

Ferraris said there are three approaches in the implementation of the HTP as provided for by DENR Administrative Order No. 67:

    In areas where most of the classified A& D lands are already titled, the traditional system of individual investigation shall be applied.
    In areas where most A&D lands are not yet titled, mass acceptance of PLA and carpet investigations shall be applied.
    In areas where there are on-going additional survey projects, the approach of advance acceptance and processing of PLA shall apply.

This approach shall allow land claimants to file their PLA to the DENR representative in the area where the cadastral survey is on-going. Processing of these PLAs shall proceed while awaiting the approval of the survey returns. However, no order of approval of PLA and issuance of patent shall be issued unless the survey is approved.

Meanwhile, more than 250 has. of agricultural lands in Negros Occidental owned by the family of First Gentleman Mike Arroyo are up for distribution in the next few months, this year.

This brings to more than 1,200 has., the total of Arroyo lands distributed, the Department of Land Reform said. (PIA-10)
