The Department of Trade and Industry and Department of Agriculture jointly issued the Administrative Order No. 2, series of 2008 otherwise known as the rules and regulations of the grant of special discounts to Persons with Disability (PWD) on the purchase of basic necessities and prime commodities.
"Since the enactment of Republic Act No. 9442 on April 2007, PWDs have prayed that this Magna Carta for Disabled Persons will be fully implemented.
"While the grant of special discounts on basic and prime commodities is just among the benefits granted to PWDs, they nevertheless congratulate the DA and DTI for the concrete and laudable response to section 32 of R.A. 9442."
Under the said rules and regulations, every person with disability shall enjoy a special discount of five percent of the regular retail price of basic necessities and prime commodities exclusively listed in the order. However, the total amount of said purchase shall not exceed the amount of P1,300 per calendar week without carry over of the unused amount.
To avail of the discount, a PWD must present his or her ID issued by NCDA or by authorized office of Local Government Units where he or she resides. A purchase booklet shall be presented by the PWD to the retailer everytime a purchase is made.
Under the administrative order, retailers covered are those persons engaged in the business of selling consumer products directly to consumers, which shall include among others, supermarkets, grocery stores, convenience and mini-convenience stores and shops, excluding sari-sari stores with a capitalization of less than P100,000 public or private wet markets, talipapa and cooperative stores.
Furthermore, LGUs shall procure and distribute the purchase booklets to the persons with disability residing within their respective territorial jurisdiction.
Just like in the elderly sector, retailers shall provide a special express lane for persons with disability. Priority shall always be given to them in case there is no express lane.
Penal and administrative sanctions provided under R.A. 9442 shall be imposed against business establishments which violate this administrative order.
