The Supreme Court en banc issued a status quo order on Tuesday preventing the execution of a Comelec en banc resolution directing Albur Mayor Jose Ugdoracion to vacate his post.
The Comelec en banc upheld the ruling of its First Division that disqualified Ugdoracion from being a candidate for mayor during the May 14, 2007 election.
A writ of execution was issued on March 6, 2008 ordering the Department of Interior and Local Government (DILG) to implement its ruling.
The Supreme Court's order came five days after Ugdoracion filed an urgent motion for the issuance of an injunctive writ requiring the Comelec to observe status quo.
In its order, the high tribunal notified the Comelec to "refrain from implementing [its] resolutions and writ until further orders" from the Supreme Court.
