Texting while Driving Kills 5 High School Graduates

CANANDAIGUA, N.Y., July 13 (AP) — Text messages were sent back and forth on the cell phone of a 17-year-old driver moments before her sport-utility vehicle slammed head-on into a truck, killing her and four other recent high school graduates, the police said today.

A text message was sent from the phone of the S.U.V. driver, Bailey E. Goodman, at 10:05:02 p.m., according to Sheriff Philip C. Povero of Ontario County, adding that a friend here sent a text message to Ms. Goodman’s phone asking, “What are you doing?” (read: "Nag-unsa ka"? This question can kill)

“The message was received on the cell phone at 10:06:29,” Sheriff Povero said.

A call reporting the accident to the authorities from a passenger in a car the S.U.V. had passed just before the crash was made at 10:07, according to The Rochester Democrat and Chronicle.

“The records indicate her phone was in use,” he said. “We will never be able to clearly state that she was the one doing the text messaging.”

Ms. Goodman had been driving her friends to her parents’ vacation home when her S.U.V., which had just passed the car, swerved back into oncoming traffic, hit a tractor-trailer and burst into flames. Five days earlier, the five teenagers had graduated from high school in Fairport, a Rochester suburb.

Sheriff Povero cited Ms. Goodman’s inexperience at the wheel, evidence that she was driving above the speed limit at night on a winding, two-lane highway as well as the succession of text messages on her phone as possible factors in the crash in the Finger Lakes region of western New York.

Several minutes before the first 911 call came in, Ms. Goodman had talked briefly with one of four fellow graduates who were trailing her in another vehicle. Then, two minutes before the crash was reported, the text messaging began, the sheriff said.

Autopsies determined that Ms. Goodman and Meredith McClure, both 17, and Hannah Congdon, Sara Monnat and Katherine Shirley, all 18, were killed on impact.

The S.U.V. was traveling about 60 miles an hour when it crashed shortly after 10 p.m., police estimated. The speed limit on that stretch of road was 55 m.p.h.

Routine tests ruled out alcohol as a factor and, while toxicology tests have not been completed, police say they do not suspect drug use was involved.

Ms. Goodman had a junior driver’s license, making it illegal for her to be driving late at night or to be carrying so many young passengers.

While she had taken a class qualifying her for a standard license, the state Department of Motor Vehicles had received no paperwork and “does not recognize that her license was ever upgraded from junior status,” the sheriff said.

In New York, junior drivers cannot drive after 9 p.m. without a parent, guardian or someone performing parental duties unless they are going to work or school.

They also cannot carry more than two passengers younger than 21 unless they are immediate family.
