Panama Diplomat Accused of Raping a Pinay Teenager

A 35-year-old Panama national holding a diplomatic passport has been taken into police custody after a 19-year-old girl accused him of raping her during a date in Makati City on Monday night, the Criminal Investigation and Detection Group (CIDG) said on Wednesday.

Erick Bairnals Shcks was placed in CIDG custody even as Panama’s ambassador, Roberto Carlos Moreno, interceded on his behalf and sought his release, arguing that the man was protected by diplomatic immunity.

But the head of the CIDG Women and Children’s Protection Division, Superintendent Emma Libunao, said the CIDG would release the Panamanian only after the Department of Foreign Affairs has verified his identity and given them the go-signal.

at 19, she's no longer a child if she were normal, and i believe she is normal, with her logic (where could i go for help if even the government cannot help me?  she asked on tv camera, emoting, with her face hidden of course to protect her privacy).

i just feel uncomfortable with gabriela's logic, though.  she's not a cheap girl, they said; she comes from a rich family.  whaaaattt?  being cheap is only for the poor then?  come on.

not unlikely.  di ko ganahan manaway sa atong kababayan ug kabaro pa gyod, pero gingilngigan gyod ko kausa sa cebu, bag-o pa atong february.

in an ayala center restaurant where i took lunch, i was seated beside the glass panes facing the corridor where there are restaurant seats for smokers and those who prefer fresh air and where an endless stream of mall-goers pass by.  2 middle-aged male caucasians were seated there, concentrated on what seemed to be a serious talk.

soon an attractive 20-something in office clothes (a decent light suit) stopped by them and sat down smiling.  i can't hear their exchange, but she seemed to have introduced herself and the 2 white males asked her to go away.  they looked distracted and irritated.

what followed next was more shocking.  2 midteeners, they couldn't be more than 16 years old in my estimate, also stopped by them and sat down, smiling ear to ear.  i guess those 2 guys have had enough at that point; the girls were brusquely waved away.

is this what we have become?  i asked my lunch companions.  those young girls' aggression was incomprehensible.

who can say that if the scenario had been different, if those middle-aged foreigners took up their challenge instead of shooing them away, those girls may have ended up crying rape.

Ang ahong nahibaw-an aning bajehana is nakipag date sa Panamanian. Unja sa dihang gusto na sija mouli gihapit sija sa bay sa banjaga. Ug didto nahitabo ang tanan. Kay wa naman sijay mahimo.

What i'm worried of is the so called DIPLOMATIC IMMUNITY ato kay diplomat konong inahak. Ang diplomatic immunity man gud sa ahong pagsabot nga mabaw puwede i raise as ground kung ang nahitabo nga krimen nahitabo sa dihang nagperform ang diplomat sa ijahang function as diplomat, raping women as part of his diplomatic function doesn't fit lamang. Kalaay.  >:(

i wish to read up more on what the nuances are aning diplomatic immunity for crimes "committed in the performance of duties".  offhand, kun pinolosopohon, morag wa man tingaliy crime mahitabo while a diplomat performs his duties, gawas kun siya ang nag-drive unya nakaligis.  o kaha espionage, nga mahimong i-expel dayon sa host country.  (my understanding is mahimong persona non grata, but still di man tingali makiha o mapriso.) 

meantime, here's something from the Vienna Convention: Article 31.1c Actions not covered by diplomatic immunity: professional activity outside diplomat's official functions.

giklaro nga "professional activity".  i don't think the alleged rape belongs to this.

Panamanian diplomat accused of raping 19-year-old Filipina leaves PH

MANILA, Philippines - Panamanian rape suspect Erick Bairnals Shcks quietly left the Philippines Friday night.

Accompanied by the Panamanian ambassador to the Philippines Roberto Carlos Vallarino Moreno, Shcks boarded KLM Royal Dutch Airlines flight KL808 bound for Amsterdam at the Ninoy Aquino International Airport Terminal 1 in Pasay City.

The two checked in quietly without the customary diplomatic assistance given to dignitaries at the airport and presented their tickets at the KLM counter. Moreno was a Business Class passenger while Shcks was on economy flight.

Shcks, a 35-year-old technical officer of the Panama Maritime Authority who holds a diplomatic passport, was accused of raping a 19-year-old Filipina last April 23. 

However, the  Philippine government could not file a case against Shcks due to his diplomatic immunity.

Last Thursday , Philippine Department of Justice Secretary Leila de Lima said that “we really cannot do anything because of that diplomatic immunity. That’s an international agreement."

“The Department of Foreign Affairs had already issued a certification that Shcks had diplomatic immunity," she added.

The Philippine Senate earlier approved the motion of Majority Leader Vicente Sotto to conduct marathon hearings on the issuance of multiple certifications by the DFA that resulted in the dropping of rape charges against Shcks.

“We will have a marathon hearing on this,“ Senator Loren Legarda assured Sotto after Senate President Pro Tempore Jinggoy Estrada referred the issue to the Senate committees on foreign relations and justice and human rights.

Senate president Juan Ponce Enrile supported the move. “We better look into this. My God, raping a Filipina, even a diplomat, at least he must be held in court and answer accordingly, i support the move."

MANILA, Philippines—The Panamanian national accused of raping a 19-year-old Filipina left the country Friday night, according to an airport official.

Erick Bairnals Shcks left the Ninoy Aquino International Airport before 8 p.m. on board Royal Dutch Airlines flight KL 808 bound for Amsterdam.

According to the airport official, who refused to be named for lack of authority to speak to the media on the issue, Shcks was accompanied by the Panamanian ambassador to the Philippines Roberto Carlos Moreno on the trip.

Airport personnel said the two checked in quietly and did not avail of the customary diplomatic assistance given to dignitaries at the airport.

Shcks’ alleged victim on Thursday went to the Department of Justice to seek help.

However, Justice Secretary Leila De Lima said that Shcks, a technical officer of the Panama Maritime Authority and a diplomatic passport holder, was covered by the immunity granted to foreign diplomats as stated in the 1961 Vienna Convention on Diplomatic Relations.

She said Shcks may leave the Philippines anytime, and there is no legal basis to hold him here.

“We really cannot do anything because of that diplomatic immunity. That’s an international agreement,” she said.

Shcks was accused of raping the victim in his rented condominium unit in Makati City on April 23, a few days after he purportedly befriended her.

De Lima noted that the Department of Foreign Affairs had already issued a certification that Shcks had diplomatic immunity.

“Under the existing jurisprudence, DFA is the primary agency with competence and authority to make such [a] declaration and certification. The only orders we refuse to obey are those made with grave error,” she added.

De Lima said that the only way the victim may pursue her criminal complaint against Shcks was for the Panamanian government to waive his immunity through the DFA.

MANILA, Philippines — The Department of Foreign Affairs has declared the Panamanian diplomat accused of raping a 19-year-old Filipina persona non grata (PNG).

The DFA’s decision came after the department received late Friday afternoon a Note from the Panamanian government saying that it has decided not to waive the immunity of Erick Bairnals Shcks, a member of the administrative and technical staff of the Panamanian Embassy.

The DFA said Saturday that the Note was delivered by Panama Ambassador Roberto Carlos Vallarino Moreno.

“In accordance with Article 9 of the Vienna Convention on Diplomatic Relations, Mr. Shcks should be recalled or terminated of his functions by the Panamanian Government. If no action is taken by the Panamanian Government within a reasonable period of time after he was declared as PNG, the Philippine Government will cease to recognize Mr. Shcks as a member of the Embassy and will accordingly be stripped of his immunities,” the DFA said in a statement.

This decision declaring him as PNG was immediately conveyed to the Department of Justice for appropriate action, it added.

the problem here of drawing the line is where does one draw it?  rape and murder as against cohabitation and estafa?  the nitty-gritty is almost impossible, considering that at the international level countries have different cultures and have therefore different takes on crimes.  pregnancy without a husband in the middle east is a crime; it is not in our country.  meanwhile, immunity is immunity, and all signatories of the vienna convention have to abide by it.  the exception of course is for the country to waive the immunity and have their diplomat tried in the host country.  panama has refused to waive, according to the news. 

i can't blame them.  for other countries, the philippine judicial system may give the impression that it's difficult to trust.  where else is a chief justice being impeached at the moment and a former president being barred from traveling?  such show of seeming government disarray is matched only by pakistan.  from our own vantage, we can hardly say outright that we can trust pakistan's judicial system.  add this to our sullied reputation, thanks in part to our media that tend to downplay the good about our country but give prominence instead to sensational negative stories.   

there are other ways for accused diplomats, of course.  they can be tried in their own country.  (that's what the u.s. does for their erring soldiers, right?  and these soldiers have no diplomatic immunity.  it gives the impression that more often than not the u.s. would rather try their own citizens rather than trust the judicial system of other countries.  as for that u.s. soldier accused of raping a filipina some years back, if i remember right, the charges were dropped, on the alleged victim's own volition.)

I don't think naay hypnosis nga ingana ka strong.  Rape is not  a laughing matter but as women, we should also be the first to ensure our own safety....meaning, use your head and common sense. As opposed to what she claimed, Erick did not hold her tight enough that she can't let go. the only time she let go was when the elevator was about to open. She went out ahead of Erick again showing that she was not forced or coerced.

the downside of the whole thing was despite the cover she donned (a black cloth over her head and face) during the senate hearing (what for was she there?  to add more drama to the show of sotto and legarda?) to protect her identity, her name instead is now all over.  mariah thea gonzalez of st. scholastica's college.  a youtube comment even posted her mobile phone number.  one also claimed that she knew her since high school and that she had always been lascivious (malandi).

moral lesson: investigate a story first to have a reason for believing it.

MANILA, Philippines – Senate Majority Leader Vicente Sotto III on Saturday bristled at photos showing a Panamanian kissing a Filipino woman in the elevator before his alleged rape of her took place.

“The message is that once you allow yourself to be kissed on the first date that means you can be raped. Well, they’re wrong. If at the point of insertion, the woman says `no’ and you still do it, that’s rape. That’s the law,” Sotto said in a telephone interview, citing the law against rape.

Sotto was riled by photo grabs released by Erick Bairnals Shcks to the press showing him and the 19-year-old woman kissing in the elevator on their way up to his condominium unit in Makati City, where the alleged rape took place on the night of April 23.

“If that came from the Panamanian, the Department of Justice should all the more be outraged,” he said.

In an e-mailed statement to media, Shcks claimed he did not coerce the victim to go with him or spend the night with him “to have sex.” He said they dined and went to a bar at her invitation, and he later invited her to his apartment, which she accepted.

The victim filed a complaint with the police who arrested Shcks the next day. Prosecutors filed an information of rape against him with the Makati regional trial court, but this was withdrawn after the Department of Foreign Affairs certified he had immunity from criminal prosecution.

In last Thursday’s hearing by the Senate foreign relations committee, Senators Loren Legarda and Sotto upbraided Justice Secretary Leila de Lima and Foreign Undersecretary Rafael Seguis for quickly declaring the immunity of Shcks in disregard of the victim’s rights.

In a statement issued later in the day, Sotto said he found it incredible that Shcks would claim innocence and yet flew out of the country on May 11.

“If no rape transpired, why did the accused leave the country immediately?  Why did he get the Filipina drunk and smoke marijuana before the criminal act was committed?  Does it mean that when Filipinas kiss, they are soliciting to be raped? Why did not the diplomat escort the Filipina to get a cab after the incident if all was well?’’ he said.

The senator said the footage showing Shcks and the woman kissing was not proof that no rape happened. He said he had information that “she was assured that people were coming over to the room so there was nothing to worry about.”

“It is unfortunate that the whole system, the government, our own Departments of Foreign Affairs and Justice, and their offices, have joined the chorus against the victim rather than hear her story first,” he said.

“Colonial mentality is still with us.  We believe a foreigner more than we believe a Filipina who made a sworn statement that she was raped and went through the hassle of filing a case in court,” he added.

The senator wondered: “Would Panama have the same reaction if a Filipino was accused of rape in Panama?”

how the story unfolded wasn't quick.  judging from the press reports, the "rape" supposedly happened on april 23, the panamanian guy was apprehended and detained the next day (which, if the vienna convention had been applied quickly, the apprehension and detention shouldn't have come to pass at all even for a minute; i think he was detained for 5 days), the certificate of immunity was issued after almost a week, the persona non grata status was declared a few days later, and the panamanian left the country may 11.  it had rather taken that long for a supposedly guilty party to take flight.

obviously this refers to pepsi paloma, the 15-year-old movie actress of the 1980s.  some backgrounder:

Pepsi Paloma was an underaged Filipino-American actress who successfully made a name for herself during the early 80’s making sexy movies. She was one of the three “softdrink beauties” (the others were Coca Nicolas and Sarsi Emmanuelle) who simultaneously hit the big screen.

In 1982, she lodged a rape case against “Eat Bulaga!” hosts Joey de Leon, Vic Sotto, and Richie D’Horsie (also known as Richie Reyes). Paloma’s lawyer in the rape case was a much younger Rene Cayetano who would later be elected as a Philippine senator. The rape case was settled out of court. Afterwards, she stated that she was coerced to sign an affidavit of desistance by Tito Sotto (another “Eat Bulaga!” co-host and a future Philippine senator) to drop the case which had a punishment of death. De Leon, Vic Sotto and D’Horsie admitted guilt and made a public apology to Paloma.

In 1985, still burdened by her past, Pepsi Paloma hanged herself to death.
